En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. The idea of direction of fit has been found appealing by many philosophers. Anscombe’s famous examples have persuaded many of us that there must be some deep difference between belief and desire that is captured by the metaphor of direction of fit. Most of the aim of the paper is to try to get clear on which intuitions Anscombe’s example taps into. My view is that there is more than one intuition in play here, and I will try to show (...) that various distinctions and points are confused in the literature on direction of fit. But I also want to argue that once the proper distinctions are made, it’s not clear that the notion of direction of fit can do any of the philosophically significant work that it was supposed to do. I first argue that the best way to unpack the notion of direction of fit would indeed be by means of the constitutive relation between truth and belief. In particular, the notion of direction of fit is best understood as different ideals, or formal ends, guiding the inference, from what I call “prima-facie” attitudes to what I call “all-out” attitudes respectively in the theoretical and practical realm. However, I’ll argue that there’s no non-circular way of making this distinction. But even if no definition of “belief” and “desire” come out of the distinction between directions of fit, it does elucidate the different natures of practical and theoretical enquiry. However, understood this way, the notion of direction of fit does not seem to capture the distinction illustrated by Anscombe’s example. I try to argue in the last section that Anscombe’s compelling example is best explained not by a distinction between directions of fit, but by a distinction between two different inferential mistakes: one from general to general or particular to general, and the other from general to particular. There’s an important asymmetry between practical and theoretical endeavours in this neighbourhood. However, noticing this asymmetry will also fail to deliver the philosophical payoffs that the notion of direction of fit was supposed to have. (shrink)

A New Italian translation of Principia Ethica coming almost 60 years after the 1964 translation by Gianni Vattimo with Nicola Abbagnano’s preface. The new edition makes room for the English text alongside the Italian translation; it includes the 1922 Preface, a bibliography of Moore’s ethical writings with critical literature, a chronology of Moore’s life and works, and an Index. The Introduction by Sergio Cremaschi reconstructs the background of ideas, concerns and intentions from which Moore’s Principia Ethica originated. It stresses (...) the role of religious concerns, as well as that of the Idealist legacy. I argue that PE is more a patchwork of incompatible lines of argument than a consistent work. It compares PE with Rashdall’s almost contemporary ethical work, suggesting that the latter defends the same general claims in a different and more plausible way, which manages to answer decisive objections. It ends with the suggestion that the emergence of Analytic Ethics was a more multi-faceted phenomenon than the received view would make us believe and the analytic tradition's wheat, that is, what logic can do for philosophy, has to be separated from the chaff, that is, the confused, and besides mutually incompatible, legacies of Utilitarianism and Idealism. Guido Löhr's recent article makes several insightful and productive suggestions about how to proceed with the empirical study of collective action. However, their critique of the conclusions drawn in Gomez-Lavin & Rachar (2022) is undermined by some issues with the interpretation of the debate and paper. This discussion article clears up those issues, presents new findings from experiments developed in response to Löhr's critiques, reflects on the role of experimental research in the development and refinement of philosophical theories, and adds (...) to Löhr's suggestions about the path forward. Deontological theories face difficulties in accounting for situations involving risk; the most natural ways of extending deontological principles to such situations have unpalatable consequences. In extending ethical principles to decision under risk, theorists often assume the risk must be incorporated into the theory by means of a function from the product of probability assignments to certain values. Deontologists should reject this assumption; essentially different actions are available to the agent when she cannot know that a certain act is in her (...) power, so we cannot simply understand her choice situation as a “risk-weighted” version of choice under certainty. This bulletin contains a summary of the main topics of discussion in truthmaker theory, namely: the definition of truthmakers, problems with Truthmaker Necessitarianism and Truthmaker Maximalism, the ontological burden of truthmakers and the recalcitrant topic of truthmakers for negative truths.

Incommensurability is often introduced with the small improvement argument. Options A and B are shown to be incommensurable when it is neither the case that A is preferred to (or better than) B nor that B is preferred to (or better than) A, but a slightly improved version of A (A+) is still not preferred to B. Since A+ is preferred to A, but not to B, we must also conclude that it is also true that A and B are (...) not indifferent (or equally good). Such incommensurable options seem incompatible with orthodox decision theory (and various forms of value theory) but options that obey the pattern described by this argument seem ubiquitous: my choice between lemon tarts and eclairs at my favourite pastry shop might exhibit this pattern, but so could my choice between jobs or careers. In trying to accommodate incommensurable options within various frameworks, philosophers have argued that we must preserve certain central features of the phenomenon. Among them is the supposed “hardness” of at least some incommensurable options: even if perhaps one would need to be a rather anxious gourmet to describe the choice between lemon tarts and eclairs as hard, the choice among careers could potentially be agonizing. However, it is not clear in which way choices among incommensurable options are “hard,” nor how and whether such hardness poses problems for the various accounts of incommensurable choices. To complicate matters, the deontic verdicts for choices between incommensurable options seem to be relatively straightforward: one appealing view is that in such circumstances I am rationally permitted to choose any option that is not worse than another option. This paper aims to provide a sharper formulation of at least a version of the hardness problem, to argue that various theories of incommensurability fail to account for the hardness of some incommensurable choices, and to propose that the theory of instrumental rationality I develop in Rational Powers in Action, aided by a Kantian insight, promises to provide an adequate explanation of the hardness of choice among incommensurable options. Recent research on algebraic models of _quasi-Nelson logic_ has brought new attention to a number of classes of algebras which result from enriching (subreducts of) Heyting algebras with a special modal operator, known in the literature as a _nucleus_. Among these various algebraic structures, for which we employ the umbrella term _intuitionistic modal algebras_, some have been studied since at least the 1970s, usually within the framework of topology and sheaf theory. Others may seem more exotic, for their primitive operations (...) arise from algebraic terms of the intuitionistic modal language which have not been previously considered. We shall for instance investigate the variety of _weak implicative semilattices_, whose members are (non-necessarily distributive) meet semilattices endowed with a nucleus and an implication operation which is not a relative pseudo-complement but satisfies the postulates of Celani and Jansana’s strict implication. For each of these new classes of algebras we establish a representation and a topological duality which generalize the known ones for Heyting algebras enriched with a nucleus. (shrink)

Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. In this paper we advance a new solution to Quinn’s puzzle of the self-torturer. The solution falls directly out of an application of the principle of instrumental reasoning to what we call “vague projects”, i.e., projects whose completion does not occur at any particular or definite point or moment. The resulting treatment of the puzzle extends our understanding of instrumental rationality to projects and ends that cannot be accommodated by orthodox theories of rational choice.

The debate regarding the nature of joint action has come to a stalemate due to a dependence on intuitional methods. Normativists, such as Margaret Gilbert, argue that action-relative normative relations are inherent in joint action, while non-normativists, such as Michael Bratman, claim that there are minimal cases of joint action without normative relations. In this work, we describe the first experimental examinations of these intuitions, and report the results of six studies that weigh in favor of the normativist paradigm. This paper looks into two Scottish Philosophical Societies of the Eighteenth century: The Philosophical Society of Edinburgh, and the Select Society of Edinburgh. I intend to show that they were planned, constructed, and carried out according to the experimental method of natural philosophy, and that it was this factor that enhanced the influence they had in the development of the country. An examination of the minute books, discourses, abstracts and question lists of these societies will provide enough evidence to support (...) the claim that experimental philosophy and its method were the decisive factors for the developing and huge success of these societies. Kant’s views on the relation between freedom and moral law seem to undergo a major, unannounced shift. In the third section of the Groundwork, Kant seems to be using the fact that we must act under the idea of freedom as a foundation for the moral law. However, in the Critique of Practical Reason, Kant claims that our awareness of our freedom depends on our awareness of the moral law. I argue that the apparent conflict between the two texts depends (...) on a reading of the opening paragraphs of Groundwork III, and on an interpretation of Kant’s claim that we “act under the idea of freedom”, that is implausible on textual and on philosophical grounds. I then present an alternative interpretation of what Kant means by “acting under the idea of freedom” and of the opening paragraphs of Groundwork III. I argue that the only substantive conclusion of these paragraphs is that no theoretical proof of freedom is necessary. Moreover I argue that although these paragraphs raise concerns about the validity of the moral law, these concerns and Kant’s answers to them, do not give rise to any significant conflict with his views in the Critique of Practical Reason. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. Este período se caracteriza por su inmersión en el entorno digital, donde los individuos, como ciudadanos, se encuentran bajo la manipulación, por un lado, de sus datos mediante técnicas de vigilancia y, por otros, expuestos a cámaras de resonancia mediática. Este panorama plantea desafíos significativos en cuanto a la manera en que interactúan (...) con la información y cómo esta afecta sus vidas. La relación entre los medios de comunicación y los acontecimientos, además, se encuentra atravesada por el concepto de interpretación, donde la capacidad de comprender y la habilidad para reconstruir narrativas son elementos que determinan la comprensión y el sentido de lo que ocurre en nuestro mundo. En el presente artículo se abordarán los aportes realizados por Gramsci en la construcción de la figura del intelectual. Para ello, se caracterizarán los rasgos distintivos del determinismo histórico marxista, para luego enfocarnos en el pensamiento gramsciano. A partir de allí nos centraremos de manera expresa en los argumentos desplegados por Gramsci al procurarle una función activa a la figura del intelectual, en tanto intelectual colectivo que se va conformando encarnado en el partido revolucionario de la clase obrera. De esta (...) manera, plantearemos que esta disposición del intelectual colectivo se enlaza con los problemas de la vida social en la búsqueda de unificar teoría y praxis, y pretende crear así una nueva hegemonía, puesto que admite la indeterminabilidad de la historia según leyes. Most contemporary action theorists accept – or at least find plausible – a belief condition on intention and a knowledge condition on intentional action. The belief condition says that I can only intend to ɸ if I believe that I will ɸ or am ɸ-ing, and the knowledge condition says that I am only intentionally ɸ-ing if I know that I am ɸ-ing. The belief condition in intention and the knowledge condition in action go hand in hand. After all, if (...) intending implies belief, and if ɸ-ing intentionally implies intending to ɸ, then in ɸ-ing, I intend to be ɸ-ing, and, by the belief condition, I believe that I am ɸ-ing, and if this belief is justified, and we are not in a Gettier situation, etc., then, I will also satisfy the knowledge condition. Moreover, the claim that when intentions properly result in action, the corresponding belief constitutes knowledge is a relatively safe assumption, at least as an assumption about what it is generally the case. Some arguments against David Lewis’s modal realism seek to exploit apparent inconsistencies between it and anthropic reasoning. A recent argument, in particular, seeks to exploit an inconsistency between modal realism and typicality anthropic premises, premises common in the literature on physical multiverses, to the effect that observers who are like human observers in certain respects must be typical in the relevant multiverse. Here I argue that typicality premises are not applicable to the description of Lewis’s metaphysical multiverse, where the proportions (...) of metaphysically possible observers possessing the pertinent properties can be independently established by metaphysical reasoning. However, other kinds of reasonable anthropic premises can be seen to be consistent with and usable within modal realism. (shrink)

Working memory is a foundational construct of cognitive psychology, where it is thought to be a capacity that enables us to keep information in mind and to use that information to support goal directed behavior. Philosophers have recently employed working memory to explain central cognitive processes, from consciousness to reasoning. In this paper, I show that working memory cannot meet even a minimal account of natural kindhood, as the functions of maintenance and manipulation of information that tie working memory models (...) and theories together do not have a coherent or univocal realizer in the brain. As such, working memory cannot explain central cognition. Rather, I argue that working memory merely redescribes its target phenomenon, and in doing so it obfuscates relevant distinctions amongst the many ways that brains like ours retain and transform information in the service of cognition. While this project ultimately erodes the explanatory role that working memory has played in our understanding of cognition, it simultaneously prompts us to evaluate the function of natural kinds within cognitive science, and signals the need for a productive pessimism to frame our future study of cognitive categories. A response to review essays by Chrisoula Andreou, John Brunero, Matthias Haase, Erasmus Mayr, and Sarah Paul on Sergio Tenenbaum's _Rational Powers in Action_.

The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

This paper focuses on the framework for the compositional relations of properties in the sciences, or "realization relations", offered by Ken Aizawa and Carl Gillett (A&G) in a series of papers, and in particular on the analysis of "multiple realizations" they build upon it. I argue that A&G's analysis of multiple realization requires an account of levels and I try to show, then, that the A&G framework is not successful under any of the extant accounts of levels. There is consequently (...) a real concern tha thte A&G framework for realization may not be viable. (shrink)

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' This essay proposes a reductive account of robust macro-regularities. On the view proposed, regularities can earn their elite scientific status by featuring in good summaries of restricted regions in the space of physical possibilities: our “modal neighborhoods.” I argue that this view vindicates “nomic foundationalism”, while doing justice to the practice of invoking physically contingent generalizations in higher-level explanations. Moreover, the view suggests an explanation for the particular significance of robust macro-regularities: we rely on summaries of our modal neighborhoods when (...) reasoning hypothetically about “agentially accessible” possibilities. El intento de estas páginas es el de seleccionar dentro de la semántica del miedo que contribuye a organizar la imagen moderna del orden político y jurídico el elemento específico del pánico, en la hipótesis de que este último constituya una diferencia que es asimismo un recurso epistémico. Dicho de un modo directo: si el miedo se presenta como una referencia constitutiva del orden, de su constitución como de su mantenimiento, el pánico parece, en cambio, cargado de un signo contrario; (...) nos habla de la disolución de un agregado dado por supuesto y es inclusivo en el perimetrar los límites y las condiciones de posibilidad. El objetivo es aquel de repasar algunos momentos de la historia del pánico buscando argumentar que el pánico es una pasión política, en el sentido de que se refiere a aquello de lo que la político está hecha, y al mismo tiempo es expresión de un límite "pasional" de la política, en tanto que define políticamente un límite interno. Respecto a tal objetivo, esta aportación no reivindica más que los caracteres de un hilvanado necesitante de un desarrollo ulterior por lo que se refiere no solo a aquello que no se incluye (y es obviamente mucho), sino también a los nudos que de forma conscientemente provisional se indican. An effective method to increase the number of potential cadaveric organ donors is to make people donors by default with the option to opt out. This non-coercive public policy tool to influence people’s choices is often justified on the basis of the as-judged-by-themselves principle: people are nudged into choosing what they themselves truly want. We review three often hypothesized reasons for why defaults work and argue that the as-judged-by-themselves principle may hold only in two of these cases. We specify further (...) conditions for when the principle can hold in these cases and show that whether those conditions are met is often unclear. We recommend ways to expand nationwide surveys to identify the actual reasons for why defaults work and discuss mandated choice policy as a viable solution to many arising conundrums. (shrink)

Descartes maintained substance dualism, the thesis that no substance has both mental and material properties. His main argument for this thesis, the so-called separability argument from the Sixth Meditation (AT VII: 78) has long puzzled readers. In this paper I argue that Descartes’ independence conception of substance (which Descartes presents in article 51 of the Principles) is crucial for the success of the separability argument and that Descartes used this conception of substance to defend his argument for substance dualism from (...) an important objection. This book tells the story of modern ethics, namely the story of a discourse that, after the Renaissance, went through a methodological revolution giving birth to Grotius’s and Pufendorf’s new science of natural law, leaving room for two centuries of explorations of the possible developments and implications of this new paradigm, up to the crisis of the Eighties of the eighteenth century, a crisis that carried a kind of mitosis, the act of birth of both basic paradigms of the two (...) following centuries: Kantian ethics and utilitarianism. The new science of natural law carried a fresh start for ethics, resulting from a mixture of the Old and the New. It was, as suggested by Schneewind, an attempt at rescuing the content of Scholastic and Stoic doctrines on a new methodological basis. The former was the claim of existence of objective and universal moral laws; the latter was the self-aware attempt at justifying a minimal kernel of such laws facing skeptical doubt. What Bentham and Kant did was precisely carrying this strategy further on, even if restructuring it each of them around one out of two alternative basic claims. The nineteenth- and twentieth-century critics of the Enlightenment attacked both not on their alleged failure in carrying out their own projects, but precisely on having adopted Grotius’s and Pufendorf’s project. La filosofía de la ciencia se desarrolló durante la primera mitad del siglo xx bajo el supuesto de que la ciencia podía caracterizarse por la estructura lógica tanto del conocimiento articulado en las teorías más exitosas como de sus explicaciones. En la segunda mitad del siglo xx se cuestiona fuertemente esa idea, pero se sigue asumiendo que la filosofía de la ciencia debe hacerse siguiendo los cánones de una epistemología fundamentalista que considera que el avance de la ciencia pasa por (...) una ontología cada vez mas austera guiada por la idea de "mientras menos mejor". Desde esta perspectiva fundamentalista, el que las diferentes ciencias hablen de diferentes tipos de cosas es un obstáculo al entendimiento, producto de la imperfección del conocimiento actual. Este ideal nos invita a pensar que la epistemología debe hacerse reflexionando sobre el conocimiento articulado en nuestras teorías más austeras y nos compromete con propuestas reduccionistas problemáticas que no permiten explicar la diversidad de recursos epistémicos que de hecho utilizan los científicos. En este libro promovemos una epistemología que no sigue el lema de "mientras menos mejor", sino el de "organizar nuestros recursos epistémicos de manera que se genere entendimiento". Así, la misma estructura de las explicaciones y las prácticas (que incluye métodos y normas respecto de lo que se considera plausible y valioso) es lo que nos da la pauta para responder a la pregunta de qué es lo que hay. Esta estrategia epistémica nos obliga a hacer una filosofía de la ciencia muy cercana a la ciencia, reconociendo la pluralidad de sus métodos, objetivos y prácticas, sin reducir la filosofía de la ciencia a la sociología o a cualquier otra ciencia en particular. The presentation of the “dual picture of vagueness” in my earlier work is supplemented here with a number of additional considerations. I emphasize how the picture lends itself naturally to treatments of the contribution of a typical degree adjective to propositional content and to truth conditions. A number of reasonable refinements of the picture are presented, especially concerning occasions of use of a degree adjective in which a class containing a sorites series is somehow involved in content fixing, but in (...) such a way that an extension ultimately gets fixed for the predicate. I also develop the observation that standard theories of the logical and semantic paradoxes rely on the idea that the content-fixing mechanisms for the paradoxical expressions work well in general but fail in some localized cases, and that while standard theories of the sorites paradox are clearly not based on this idea at all, the dual theory is fully based on the idea. Next, I offer a few remarks on some recent theories of vagueness and the sorites that are broadly in the spirit of the dual picture, emphasizing the aspects where the latter compares favorably against those recent theories. Finally, the question whether the dual theory is statable with truth according to the theory itself is considered in more detail than in my earlier presentation. (shrink)

This paper proposes an application of Enrique Dussel’s ethics of liberation to an issue of crucial importance to US minorities: the debate on affirmative action. Over the past fifty years, this debate has been framed in terms of the opposition between advocates of affirmative action who claim that it is needed in order to achieve the integration and participation of traditionally oppressed groups to society without which there is no equality of rights, and critics who argue that affirmative action violates (...) equality by enforcing a double standard that undermines the ideal of a color-blind society. In this paper, I show how the basic principles of Dussel’s ethical theory (which are best expounded in his book Ethics of Liberation) allow us to address what I take to be the main demands of both advocates and critics of affirmative action in a satisfactory way.
