Clive Walter Ingram Pearson was an Australian Existentialist and Religious Studies philosopher who spent his entire profesional career in the University of Auckland Philosophy Department. He was an idiosyncratic teacher and thinker who had a major influence on several contemporary ANZAC philosophers, as well as many hundreds of his students. This article is a tribute to him.

Selgelid and Koplin’s article ‘Kidney Sales and the Burden of Proof’ (K&S 2019) presents a series of detailed and persuasive arguments, intended to demolish my own arguments against the prohibition of organ selling. And perhaps they might succeed, if the case described by the authors were anything like the one I actually make. However, notwithstanding the extensive quotations and the detailed explanations of the way I supposedly argue, this account of my position comprehensively mistakes both the conclusions I reach and (...) the arguments I give for them. -/- I know that there are around many misconceptions about my views on this subject, but I have always hoped they could not survive a reading of what I had actually written. I have just—after a gap of many years—looked again at the two most recent of the texts Koplin and Selgelid refer to, and it goes without saying that I can see various things I could now do better; but I do still find these misinterpretations hard to understand. And since anyone with nothing to go on but this article would reasonably conclude that the original texts were not worth reading, I am grateful to the editors for the opportunity to try to set the record straight. -/- I presume not many readers would be interested in a detailed comparative commentary on the texts, showing where this account gets my intentions wrong. I shall try instead to explain how what I do mean—and what I think I say—diverges from what is said here, and then go on to a brief outline of what my arguments and conclusions really are. I hope this may also give some sense of why, for all the opposition I have encountered since I was first drawn into this debate, I persist in thinking that the work I have been doing is important not only for this topic but for analysis in practical ethics more generally. Through the idea of the sublime, Kant articulated a type of aesthetic judgement whereby one experiences the limits of cognition and representation. The result of this, for Kant, is the demonstration and cultivation of our moral nature. Lyotard reframes the idea of the sublime in terms of post-modernity through his development of the idea of the event. The experience of the event is roughly equivalent to the experience of the sublime. When Mill published The Subjection of Women in 1869 he wanted to replace the domination of one sex by the other laws based on ‘a principle of perfect equality’. It is widely complained, however, that even advanced countries have still failed to achieve equality between the sexes. Power and wealth and influence are still overwhelmingly in the hands of men. But equalities of these kinds are not the ones required by the principle of equality that Mill had in mind; and, (...) furthermore, a principle that demanded them would actually be incompatible with Mill’s. The conclusion is not, however, that social policies dealing with men and women are all they should be. It is just that although the fundamental problems of feminism could be – and to a considerable extent still can be – expressed in terms of requirements for justice and equality, we have now reached a stage where concentrating on these ideas can distort the real problems, and may actually impede the kind of progress that is needed. Os autores góticos, desde sua origem, como se sabe, estão preocupados com uma recusa de certos ideais propostos pelo iluminismo e com um restabelecimento, em certa medida, de certas formas de lidar com a sociabilidade e a virtude moral. Para tornar isso evidente, será necessário, em um primeiro momento, situar o leitor acerca dos aspectos para a formação do novo gênero, ainda que tenham sido rejeitados por ele, e, no segundo momento, apresentar algumas noções comuns entre as obras que compunham (...) a primeira fase do gótico. Com isso, acreditamos que teremos um arcabouço suficiente para compreender o problema posto pela forma pela qual Lewis e Radcliffe lidam com o sublime de herança burkeana. Nosso objetivo maior consistirá em delinear de que maneira o prazer estético de herança burkeana tomou forma nos escritos góticos de Radcliffe e de Lewis, evidenciando uma possível tensão entre as interpretações propostas por ambos os autores no que diz respeito às implicações que promovem na sociabilidade, na concepção da virtude moral e nas críticas que pretendem promover contra o iluminismo. Janet Radcliffe Richards’ The Ethics of Transplants outlines a novel framework for moral inquiry in practical contexts and applies it to the topic of paid living kidney donation. In doing so, Radcliffe Richards makes two key claims: that opponents of organ markets bear the burden of proof, and that this burden has not yet been satisfied. This paper raises four related objections to Radcliffe Richards’ methodological framework, focusing largely on how Radcliffe Richards uses this framework in (...) her discussion of kidney sales. We conclude that Radcliffe Richards’ method of inquiry hinders our ability to answer the very question that it ought to help us resolve: What is there best reason to do, all things considered? As a response to Diane Vaughan’s controversial work on the NASA Challenger Disaster, this article opposes the conclusion that NASA’s decision to launch the space shuttle was an inevitable outcome of techno-bureaucratic culture and risky technology. Instead, the argument developed in this article is that NASA did not prioritize safety, both in their selection of shuttle-parts and their decision to launch under sub-optimal weather conditions. This article further suggests that the “mistake” language employed by Vaughan and others is (...) inappropriate insofar as it obscures the responsibility of individuals within the organization and trivializes the loss of life and severity of the disaster. Contra to the conclusions of Vaughan’s casework, this article reveals various ethical transgressions on the side of NASA and its affiliates; from its decision to use poorly designed O-rings, to withholding crucial engineering assessments from the shuttle-crew, this article points out that NASA did not succumb to a pre-destined fate, but, rather, created its own. Susanne Langer was a student at Radcliffe College between 1916 and 1926---a highly transitional period in the history of American philosophy. Intellectual generalists such as William James, John Dewey, and Josiah Royce had dominated philosophical debates at the turn of the century but the academic landscape gradually started to shift in the years after World War I. Many scholars of the new generation adopted a more piecemeal approach to philosophy---solving clearly delineated, technical puzzles using the so-called “method of logical (...) analysis”. Especially at Harvard, the intellectual climate rapidly changed. The department hired several philosophers who had contributed to the development of symbolic logic---H. M. Sheffer, C. I. Lewis, and A. N. Whitehead---and Harvard quickly began to be viewed as a central hub for analytic philosophy in the United States. This chapter contextualizes Langer’s earliest work by reading it through the lens of this shifting academic environment. Though Harvard did not allow women to take its courses until 1943, Langer is one of the most significant fruits of this period. Her dissertation “A Logical Analysis of Meaning” and her first publications are all illustrations of the approach that came to dictate the American philosophical conversation. By exploring the increased focus on the logical-analytic method and Langer’s attempts to expand the new approach to what she later called “non-discursive” symbolisms, I situate her publications in the intellectual context of the 1920s. This article investigates the concept of law in Rousseau, analyzing if he defends the idea of natural law or if he is a conventionalist. Some commentators, like Robert Derathé, conceive Rousseau as a naturalist, as opposed to others, like Charles Vaughan, who think that he is a conventionalist. Here we will critically assess those positions and try to see if they exclude each other or if Rousseau can be read, somehow, as defending fundamental aspects of those two positions.

SOCIOLOGY: STRUCTURAL AND CONJUNCTURAL ASPECTS Sabemos, por intermédio de pesquisas na área sociológica, que o nascimento e formação da Sociologia como ciência é proveniente de uma série de metamorfoses históricas. Isso implica dizer que as idiossincrasias mais genéricas da Sociologia têm um elo peculiar com a maneira como o corpo social se organizou e estruturou ao passo do final do século XIX e início do século XX. O feitio do arranjo da vida em corpo social nesse lapso, isto é, o (...) feitio de conformar a educação, o conhecimento em geral, a política dos Estados, a indústria, o comércio e as relações monetárias entre os países industrializados do período, constituem o alicerce para reflexão acerca da razão de a Sociologia ter se conformado como uma ciência peculiar, divergentemente da História e da Filosofia. Durante as revoluções que se decorrera nos séculos de nascimento da Sociologia, três pensamentos serviram de alicerce para tentar compreender as complexas metamorfoses sociais da época. Marx, Durkheim e Weber analisaram o corpo social capitalista de suas respectivas épocas e enfatizaram elementos que podem ser considerados essenciais e centrais da Sociologia. Assim, ainda que partiram da mesma referência empírica, que nada mais é do que o corpo social, cada um deles obtiveram interpretações divergentes sobre a conformação social e sobre os componentes conjunturais do corpo social. Todavia, é imprescindível compreender, com base na Sociologia nascente, o que é estrutura social e o que é conjuntura social. Para o antropólogo Radcliffe-Brown (1881-1955), “a estrutura social designa a rede complexa de relações sociais que existe realmente e une seres humanos individuais num certo meio natural” 5 . Ou seja, a estrutura social dá as características de ambiência e vivência dos indivíduos na vida sodalícia, esses aspectos foram analisados e estudados pelos autores supracitados na tentativa de elucidação das transformações que se decorrera na Europa da industrialização. Para Raymond Boudon (1934-2013): [...] a expressão "estrutura social" é empregada como sinônimo de organização social: conjunto das modalidades de organização de um grupo social e dos tipos de relações que existem no interior e entre diversos domínios de toda a sociedade (tanto ao nível do parentesco como da organização econômica e política). (BOUDON, 1990)6 Isto é, a estrutura social emprega termos mais genéricos da vida sodalícia, o que implica dizer que se relaciona diretamente com a organização das esferas sociais e dos indivíduos. À medida em que se estrutura e se organiza a sociedade, aparecerão vastas transformações nos meios de produção, comércio, etc. Logo, caber-se-á ao cientista social, como acontecera na gênese da Sociologia, estudar essa estrutura e organização e como tais termos e aspectos afetam a sociedade e os meios econômicos e políticos. Em termos mais didáticos: (Alana) A sociedade é composta de elementos estruturais e conjunturais/ocasionais. Essa relação é fundamental para demonstrar que a sociedade é resultado de um processo histórico. [...] (Emanuel) Há mecanismos estruturais que são sempre repostos nas conjunturas e que garantem a perpetuação das sociedades. Ao mesmo tempo em que conferem à sociedade suas características centrais, os componentes estruturais são reconstituídos nas diferentes conjunturas com o rótulo da novidade. As relações familiares, a organização do trabalho e da política, o sistema educacional, a escola, a produção, o comércio, as religiões, etc., podem servir de exemplos para entender como a novidade é influenciada pelos aspectos permanentes de uma sociedade, de um modo de produção da vida em sociedade. [...] (Alana) É importante refletir de que maneira as condições particulares dos indivíduos tem ressonâncias da história passada, de sua família, de questões que aparentemente não têm implicações diretas em sua vida. É importante explicitar, assim, que aquilo que somos e o que pensamos é um resultado histórico-social. Os corpos sociais, por mais divergentes que sejam, capitalistas ou socialistas, escravistas, libertários, indígenas, africanos, monogâmicos ou orientais, têm componentes genéricos que se reproduzem ao passar do tempo. Esses componentes genéricos são a base do corpo social e se caracterizam como componentes típicos, ou seja, componentes que acabam tornando um corpo social completamente divergente de outro. A conformação social, assim sendo, é feitiada mediante características genéricas que dão individualidade ao corpo social e se reproduzem ao passar do tempo. Logo, dá-se a entender que se um corpo social tem seus componentes conformais destruídos, ele perde sua individualidade, metamorfoseando-se em outro tipo de sodalício. Aclarando melhor, pensemos no corpo social ao qual fazemos parte: o corpo social capitalista. Ainda que os pensadores sociais antes supracitados tenham perspectivas divergentes quanto as esferas que conformam o corpo, ambos aceitam que o labor é o componente cêntrico da estrutura do sodalismo capitalista. Não obstante, ao se analisar o labor contemporâneo e o labor que desenvolvemos atualmente, podemos notar vastas divergências. Por exemplo, na contemporaneidade o computador é usado na grande parte das profissões, algo que há trinta anos atrás era novidade para muitas ainda. O corpo social, assim, passou de uma conjuntura7 a outra, reproduzindo o labor, todavia esse mesmo labor se metamorfoseou. Ante o supracitado texto, concluímos que sempre estamos envoltos de conjunturas sociais. Não obstante, há componentes sodalísticos que se reproduzem em todas as conjunturas particulares. Isso implica dizer que, mediante toda a história do capitalismo sempre houve labor e laboradores. Logo, essa alínea dá noção de que a ideia de trabalho e trabalhador é uma parte inerente da conformação social. Todavia, o labor foi metamorfoseado inúmeras vezes, seja na forma de exploração ou até mesmo no vínculo do trabalhador com seu trabalho. Bem como na maneira como nos organizamos alicerçados no trabalho ou no elo que temos com os indivíduos com o qual trabalhamos. Observe ambas as imagens, uma da década de 30 e outra de quase 70 anos depois. Note como a maneira de se trabalhar, de como trabalhar, do ambiente de trabalho, da forma de se trabalhar se modificaram ao longo dos anos e, vale destacar, com essa modificação as máquinas e os computadores ganharam mais espaço dentro das indústrias, principalmente nas indústrias automobilísticas. Assim, de um lado, o labor em generalidade permanece, e com isso se mantém como componente cêntrico da conformação social. Todavia, no outro lado, em cada conjuntura histórica o labor se apropria de idiossincrasias peculiares, porém nem com isso desapodera-se de suas características genéricas. Por exemplo, temos um labor remunerado, ou seja, laboramos em troca de um salário. Contudo, esse mesmo salário poderá sofrer alterações em conformidade com greves, crises monetárias, introdução de novas tecnologias, qualificação profissional, da inflação, etc. Diante do supracitado texto, vimos que a conjuntura histórica, ou seja, um determinado período da História, repõe os componentes estruturantes do corpo social. Com isso, na esfera conjuntural podem existir novas protestações sociais, sejam elas individuais ou grupais, porém essas protestações sociais estão, em uma dada forma, relativas a aspectos genéricos, o feitio de conformação histórica do corpo social. Isso implica afirmar, que o corpo social é imprescindivelmente uma construção histórica e que a Sociologia é uma ciência que tem como finalidade supra analisar e compreender os componentes de regulação relativos ao que é permanente e ao que é ocasional. Por fim, aprendemos que: [...] para que possamos entender a essência do corpo social, devemos sempre pensar de forma primordial em elementos permanentes e nos componentes ocasionais [...] e que o esqueleto de um corpo social é moldada por componentes centrais que os definem como distintos de outros corpos, isto é, componentes que dão individualidade à uma sociedade. The assumption that procuring more organs will save more lives has inspired increasingly forceful calls to increase organ procurement. This project, in contrast, directly questions the premise that more organ transplantation means more lives saved. Its argument begins with the fact that resources are limited and medical procedures have opportunity costs. Because many other lifesaving interventions are more cost‐effective than transplantation and compete with transplantation for a limited budget, spending on organ transplantation consumes resources that could have been used to (...) save a greater number of other lives. This argument has not yet been advanced in debates over expanded procurement and could buttress existing concerns about expanded procurement. To support this argument, I review existing empirical data on the cost‐effectiveness of transplantation and compare them to data on interventions for other illnesses. These data should motivate utilitarians and others whose primary goal is maximizing population‐wide health benefits to doubt the merits of expanding organ procurement. I then consider two major objections: one makes the case that transplant candidates have a special claim to medical resources, and the other challenges the use of cost‐effectiveness to set priorities. I argue that there is no reason to conclude that transplant candidates’ medical interests should receive special priority, and that giving some consideration to cost‐effectiveness in priority setting requires neither sweeping changes to overall health priorities nor the adoption of any specific, controversial metric for assessing cost‐effectiveness. Before searching for more organs, we should first ensure the provision of cost‐effective care. (shrink)
