As a result, the complication of structure of disciplinary matrix and forming a few paradigm nuclei in modern «human dimensional» natural sciences are observed.

“Meer dan in enige andere periode in de geschiedenis geniet ‘ethiek’ allerwege belangstelling” (p. 7), zo luidt de openingszin van het Handboek gezondheidsethiek (De Beaufort en Dupuis 1988). Discussies in de media lijken deze indruk te bevestigen. Wanneer de interesse van filosofische lezers door dergelijke mediaberichten worden gewekt, kunnen daar tenminste twee redenen voor zijn. Om te beginnen kunnen zij zich geroepen voelen positie te kiezen in het betreffende debat, door voor een bepaald standpunt te opteren en dat met redenen (...) te omkleden. Dat wil zeggen, zij kunnen het als hun opgave beschouwen om, vanuit hun specifieke ethische deskundigheid, de betrokkenen te assisteren door overwegingen naar voren te brengen, aspecten nader te belichten of op tegenspraken te wijzen. Een andere mogelijkheid is dat zij het debat van een wat grotere afstand volgen, door niet de onderhavige problematiek, maar veeleer het debat als zodanig tot voorwerp van onderzoek te maken. Hun interesse, verwondering of irritatie betreft dan niet zozeer de standpunten die door de betrokkenen worden verwoord, maar veeleer het idioom waarin zij hun morele afwegingen articuleren en de vooronderstellingen die ze daarbij hanteren. In deze studie wordt voor de laatste mogelijkheid gekozen. In de gangbare terminologie wordt de eerste mogelijkheid als ‘ethisch’, de tweede mogelijkheid als ‘meta- ethisch’ aangeduid. In de loop van deze studie zal echter naar voren komen dat dit onderscheid inadequaat is. Mijn meta-ethische reflectie op de problematiek van consensusvorming in de gezondheidsethiek, heeft wel degelijk ook een ethische inzet. Deze zal echter eerder ‘fundamenteel-ethisch’ dan ‘toegepast-ethisch’ van karakter zijn. De studie behelst een fundamenteel-ethische doordenking van een problematiek die naar voren komt in een toegepast- ethisch discours: de gezondheidsethiek. (shrink)

One of the trends in the evolution of theoretical epistemology is the study of migration mechanisms of generation of scientific knowledge from the sphere of its own logic and methodology of science in the field of sociology - the consideration of this process, as the resulting system of interactions of social structures and institutions. There are two traditional ways to read Kant's claim that every event necessarily has a cause: the weaker every-event some-cause and the stronger same-cause same-effect causal principles. The focus of the debate about whether and where he subscribes to the SCP has been in the Analogies in the Critique of Pure Reason and in the Metaphysical Foundations of Natural Science. By analysing the arguments and conclusions of both the Analogies and the Postulates as well as the two Latin principles non (...) datur casus and non datur fatum that summarise their results, I will argue for the novel thesis that the SCP is actually demonstrated in the Postulates of the First Critique. Kant scholars have rarely addressed the centuries-old tradition of casuistry and the concept of conscience in Kant’s writings. This book offers a detailed exploration of the period from Pascal’s Provincial Letters to Kant’s critique of probabilism and discusses his proposal of a (new) casuistry as part of an moral education. *** -/- Die Debatte um Kasuistik und Probabilismus zählt zu den wichtigsten Themen der Moraltheologie und Moralphilosophie der frühen Neuzeit. In der enormen Verbreitung der Literatur über die Gewissensfälle (casus (...) conscientiae) und in der großen Resonanz der Lehre von den wahrscheinlichen Meinungen (opiniones probabiles) in der ersten Hälfte des 17. Jahrhunderts findet sich ein wirkungsmächtiges Modell für die Analyse des moralischen Handelns, in welchem Universalität des Gebots und Kontingenz der Handlung, Notwendigkeit der Norm und individuelle Freiheit miteinander versöhnt werden. Dennoch erregt dieses Modell heftige Kritik, die in Pascals berühmtem Angriff in den Briefen in die Provinz (1656–1657) gipfelt. So beginnt für die Kasuistik und den Probabilismus eine lange Krise, welche die Entstehung der modernen Moralphilosophie und den Siegeszug des kantischen Paradigmas ankündigt. Die Krise von Kasuistik und Probabilismus fällt zusammen mit einer einsetzenden rigoristischen Reaktion der christlichen Moraltheologie sowohl katholischer als auch protestantischer Prägung,welche die moralischen und spekulativen Folgen eines Rückgriffs auf Gewissensfälle und wahrscheinliche Meinungen als inakzeptabel ablehnt. Die Ablehnung geht aber weiter und dringt bis in den Kern der philosophischen Reflexion vor: Die rigoristische Reaktion gegen Kasuistik und Probabilismus entzündet sich im moralphilosophischen Denken Kants als Folge seiner umfassenden kritischen Revision der Grundbegriffe der Moralphilosophie sowie insbesondere seiner Neubestimmung des Verhältnisses von Gewissen und praktischem Urteil. Dem Grundsatz des Probabilismus setzt Kant das Kriterium der moralischen Gewißheit („quod dubitas, ne feceris!“) entgegen, das er als „Postulat des Gewissens“ bezeichnet (RGV 6:185.23–186.9).Und die Kasuistik wird als eine „Critic der Handlungen nach Sophistic“ abgestempelt, als eine „Uebung, um nach der Sophistic das Gewissen zu hintergehen oder es zu chicaniren, insofern man es in Irrthum zu setzen denkt“ (V-MS/Vigil 27:620.2–5). Dennoch weist Kant den kasuistischen Fragen eine herausragende Stellung in der Tugendlehre zu und legt der Kasuistik im Rahmen der ethischen Methodenlehre, also im Hinblick auf pädagogische Anwendungen, letztlich eine positive Funktion bei. Vermutlich ist Kants Angriff auf Kasuistik und Probabilismus durch den Einfluss Pascals philosophisch vermittelt. Kants Verhältnis zu Pascal und, allgemeiner, zu dem historischen Hintergrund, welchem dieser angehört, sind gleichwohl noch erstaunlich wenig erforscht: Trotz der wiederholten (stillschweigenden oder sogar ausdrücklichen) Hinweise an wichtigen Stellen in Kants Schriften richtet die Kant-Forschung ihre Aufmerksamkeit nur selten auf die Jahrhunderte währende Tradition der Kasuistik und den Begriff des Gewissens, der in ihrem Rahmen ausgearbeitet wird. Aus dieser langen Geschichte wird in diesem Band insbesondere der Zeitraum „von Pascal bis Kant“ eingehend untersucht, d.h. der noch wenig erkundete Zeitabschnitt von der beißenden Polemik von Pascals Briefe in die Provinz bis zu Kants eigener Kritik des Probabilismus und seinem Entwurf einer (neuen) Kasuistik als Teil der ethischen Methodenlehre. The focus of the paper is a sophism based on the proposition ‘This is Socrates’ found in a short treatise on obligational casus attributed to William Heytesbury. First, the background to the puzzle in Walter Burley’s traditional account of obligations (the responsio antiqua), and the objections and revisions made by Richard Kilvington and Roger Swyneshed, are presented. All six types of obligations described by Burley are outlined, including sit verum, the type used in the sophism. Kilvington and Swyneshed disliked (...) the dynamic nature of the responsio antiqua, and Kilvington proposed a revision to the rules for irrelevant propositions. This allowed him to use a form of reasoning, the “disputational meta-argument”, which is incompatible with Burley’s rules. Heytesbury explicitly rejected Kilvington’s revision and the associated meta-argument. Swyneshed also revised Burley’s account of obligations, formulating the so-called responsio nova, characterised by the apparently surprising thesis that a conjunction can be denied both of whose conjuncts are granted. On closer inspection, however, his account is found to be less radical than first appears. (shrink)
