The teaching of Confucius, one of the doctrines built Chinese philosophy, is the movement of thought that has penetrated politics, education, manners and customs in East Asia for centuries. Reading the principles that advise wisdom and virtue through classical texts, we can find out normative moral knowledge. This teaching, in which ethical standards guiding human relations are regulative, promotes hierarchy as required by patriarchal and patrimonial regime. Social structure is grounded on discrimination between nobles and commons. Since the rights and (...) privileges granted to the aristocracy and bureaucracy humiliate citizens and force compliance, social inequality becomes obvious. Just as Confucius cites the idea of spiritual supremacy of rulers, he also bestows a privilege upon the noble class due to their eligibility. It is the people who are actively industrious in serve, deference and obedience. The problem of nepotism, which favors the closer and excludes the farther in relational words and actions, extends all areas from familial to managerial. Consequently, justice, the main canon of virtue, has been disregarded. In this paper, it firstly will be argued that Confucius practices hypocrisy by his paradoxical statements about behavioral norms. Secondly, positional duties, which subjugate people for the interests of the dynasty, does not correspond to liberal humanism, will be confirmed. (shrink)

This thesis explores the party system and political parties in the post-communist Albania. The overarching question of the thesis is what kind of party system has developed and what is the structure and organization of the Albanian political parties. The study analyses the period 1991-2013, that is the period between the first and the last general elections. I argue and test that the Albanian party system is stable and that the Albanian political parties are mass clientelist parties with deep territorial (...) penetration. The members of the parties have ceased to paly their traditional roles of the era of mass party and their attachment tot he party is not ideological but aims to ensure material benefits in return for the support provided to the party in elections times. As parties don't have many tools at hand they use their organizational structure to stabilize electorate, which explains the low level of electoral volatility in Albania and as consequence the stability of the party system. The thesis ahs an institutional embedded and a historically structured framework according to which party strategies are shaped by both the institutional context and the historical setting in which parties are created and operate. Following this line of reasoning, the weak societal roots of parties do not allow for party identification or voter alignment; the early access to public funding reduces the incentives of parties to create strong links with the members and society to collect financial resources and; in line with the features of the patrimonial communism which is characterized by clientelism and nepotism, the Albanian political parties develop the same relationships between the higher echelons of the party and the lower strata of the party structure. On the other hand the lack of media access in the early phase of organization and the need to stabilize the electorate, encourage the Albanian political parties to seek a deep territorial penetration which results in the creation of mass clientelist parties. In order to test the hypothesis I have undertaken three steps: a) the analyses of the Effective Number of Parties and Electoral Volatility; b) the internal distribution of power, the role of the membership and the relationship of the organization with society and; c) the identification of financial resources of the political parties. The chapter explains why evolutionary genetics – a mathematical body of theory developed since the 1910s – eventually got to deal with culture: the frequency dynamics of genes like “the lactase gene” in populations cannot be correctly modeled without including social transmission. While the body of theory requires specific justifications, for example meticulous legitimations of describing culture in terms of traits, the body of theory is an immensely valuable scientific instrument, not only for its modeling power but also for the (...) amount of work that has been necessary to build, maintain, and expand it. A brief history of evolutionary genetics is told to demonstrate such patrimony, and to emphasize the importance and accumulation of statistical knowledge therein. The probabilistic nature of genotypes, phenogenotypes and population phenomena is also touched upon. Although evolutionary genetics is actually composed by distinct and partially independent traditions, the most important mathematical object of evolutionary genetics is the Mendelian space, and evolutionary genetics is mostly the daring study of trajectories of alleles in a population that explores that space. The ‘body’ is scientific wealth that can be invested in studying every situation that happens to turn out suitable to be modeled as a Mendelian population, or as a modified Mendelian population, or as a population of continuously varying individuals with an underlying Mendelian basis. Mathematical tinkering and justification are two halves of the mutual adjustment between the body of theory and the new domain of culture. Some works in current literature overstate justification, misrepresenting the relationship between body of theory and domain, and hindering interdisciplinary dialogue. (shrink)

This paper argues that social trust is the emergent product of a complex system of property relations, backed up by a sub-system of mutual monitoring. This happens in a context similar to Ostrom’s commons, where cooperation is necessary for the management of resources, in the absence of external authorities to enforce sanctions. I show that social trust emerges in this context because of an institutional structure that enables individuals to develop a generalized disposition to internalize the external effects of their (...) actions. This is made possible by the “patrimonial” nature of this structure. (shrink)

Current treatments of cultural heritage as an object of moral concern (whether it be the heritage of mankind or of some particular group of people) have tended to treat it as a means to ensure human wellbeing: either as ‘cultural property’ or ‘cultural patrimony’, suggesting concomitant rights of possession and exclusion, or otherwise as something which, gaining its ethical significance from the roles it plays in people’s lives and the formation of their identities, is the beneficiary at most of (...) indirect moral obligations. In contrast, I argue that cultural heritage, as something whose existence can go well or badly, can itself qualify as a moral patient towards which we may have obligations which need not be accounted for in terms of subsequent benefits to human beings. Drawing inspiration from environmental ethics and suggesting that heritage, like an ecosystem, is a complex network of interrelations which invites a holistic understanding, I develop a framework for thinking about cultural heritage which shows how such a thing can feature in our ethical reflections as intrinsically worthy of respect in spite of its most obvious differences from the ‘natural’ world: the very human origins of cultural heritage and its involvement with human life in all its forms. As part of the development of this framework I consider the epistemic difficulties which arise when for all our holistic sophistication we do find ourselves in the predicament of having to judge the moral worth of some item of heritage, possibly someone else’s heritage and possibly something which we find ourselves disposed to value more because of than despite any mysteries surrounding it. I conclude by offering some tentative illustrations of how such a framework might operate in the practical course of normative moral reasoning about what should be done with items of cultural heritage. -/- [Erratum note: p. 30 conflates the Kumasi palace looting of 1874 with that of 1896.]. The goal or criterion of "authenticity" for judging a change in art or ethics or culture is notoriously vague and can be dangerous. This essay proposes a version of authenticity based on a quasi-Hegelian version of the process of development rather than on any specific patrimony to be preserved. Oddly enough, the proposed criterion has many similarities with one proposed by a staunch anti-Hegelian, Gilles Deleuze.

The global rise of addictions in the modern world is alarming. What the discipline of modern Western psychology fails to recognize is the connection between the loss of a sense of the sacred and the rise in addiction and mental illness. Due to the spiritual desolation prevalent in the present day and its traumatizing effects, the human search for wholeness and healing is all too often diverted into destructive and dysfunctional behaviors. It is only a spiritual approach to the science (...) of the soul that allows psychology to restore the categories of Spirit, soul, and body, along with their corresponding degrees of reality. This paper examines the root causes of addiction in order to better understand the collective search for wholeness and healing. The framework employed for this study is the perennial psychology—an application of the universal wisdom found in humanity’s spiritual patrimony to the proper understanding of this burgeoning crisis. This doctoral thesis examines the phenomenon of Filipinization, specifically understood as the ideological construction of a “Filipino identity” or ‘Filipino subject-consciousness” within the highly determinate context provided by the Filipino ilustrado nationalists such as José Rizal, Marcelo H. del Pilar and their fellow propagandists inasmuch as it leads to the nineteenth (19th) century construction of the modern Philippine nation. Utilizing Jacques Derrida’s deconstructive thinking, this study undertakes a genealogical critique engaged on the concrete historical examination of what is meant by (...) the term “Filipino” across a select historical timeline (1864-1898) and the various notions of Filipino identity implied by the different contexts within which the term “Filipino” has been employed. More specifically, it undertakes a selective philosophical excavation of three seminal texts in the history of Filipinization, viz.: 1) the Manifiesto of Padre Jose Burgos; 2) the writings of the Filipino ilustrados in La Solidaridad; and 3) Jose Rizal’s Annotations on Dr. Antonio de Morga’s Sucesos de las Islas Filipinas. -/- The philosophical claim of this work is the idea that Filipinization, taken as the differential construction of Filipino identity, is the effective translation of the colonial epistemic violence of Eurocentric racism and its consequent “horror of absolutism” into the homo-hegemony of Filipino nationalisms. By fetishizing the notion of a carefully constructed and essential “Filipino-identity,” Filipinization and the current nationalist discourses that utilize them, unwittingly, stands complicit with the same colonial violence and hegemony that they wish to combat. This happens precisely when the very structures of colonial oppression, on the ideological and practical levels, are transmogrified into nationalist ideals that assume legal and political power unto themselves in a self-referential and self-legitimating fashion. -/- Three processes will demonstrate the above thesis: first, by examining historical texts and setting itself against established nationalist historiographies, a genealogical analysis of the term “Filipino” reveals it as a pliable signifier whose semantics have evolved through time. From its originary referent in the Spanish criollo (creole), it has come to refer to people who would have been otherwise entirely alien to this class, viz., the mestizos (both Spanish and Chinese), the principalia (native elite), and eventually, the lowland Catholicized natives themselves. The historical hermeneutic of this identity-discourse in Padre José Burgos’ Manifiesto yields the fact that what gives the term “Filipino” its semantic consistency as a class concept is its essential constitution as a Hispanic and Catholic identity. -/- Second, from this semantic identification of the term “Filipino” as a Hispano-Catholic identity, we proceed to clarify the meaning of Filipinization in terms of the nationalist propaganda carried out by the Filipino ilustrados in the fortnightly periodical La Solidaridad. Here, the specific ilustrado construction of Filipino identity as a Spanish citizen (ciudadano Español) is revealed precisely as a political and legal construct that served as the basis for their own politics of social inclusion/exclusion. Filipinization can only be applied to those who have been hispanized and Christianized and never to those tribes who have resisted and remained outside Spanish colonial authority. Filipinization is thus revealed as a process of Hispanization and Christianization whereby the recipients of Spanish colonial hegemony are transformed into the religiously docile bodies of the Spanish Empire. -/- From this highly determinate context, the study proceeds to examine Rizal’s ontological grounding of collective Filipino-ness in the mythological construction of the pre-hispanic past as the source of a unique Filipino ancestrality. In his work on de Morga’s Sucesos, what is revealed is a mythologization that grounds a native, essential Filipino identity within a past unscathed by the Spanish colonial experience. Such mythologization, however, can only be possible through an anachronistic nationalist interpretation of historical data. Here, Filipinization is revealed as an exclusive prerogative, a nationalist program by which Rizal and the ilustrado class can combat the evils and excesses of the Spanish colonial enterprise. Ironically, though, this same struggle for emancipation also became an instrument by which the ilustrado class can retain their unjustified position of power over those who belonged to the colonial underside, thus, securing the possibility of perpetuating their own ilustrado bourgeois class interests. -/- Such discursive complicity is the essence of the myth of Filipinization: it presents nationalist identity discourse as an anti-colonial enterprise while being underlined by an economy of motives designed to cater primarily to the exclusive interests of the elite and ilustrado class. Thus, instead of securing the genuine, inclusive emancipation of all colonial subjects and a more humane existence for the poor and suffering majority, ilustrado nationalism has, ironically, merely reinforced those operative structures of colonial discrimination and oppression when the ilustrados: 1) grounded their racial theory upon the very same discourse of Eurocentric superiority that they are precisely supposed to question and 2) claimed a patrimony over Filipinas as their exclusive sovereign inheritance. These two factors illustrate how the manifest transfer of power from the Spanish Empire to the Philippine sovereign nation (and later as a nation-state) illustrate how Filipinization merely has transmogrified the face of Spanish colonialism into its new, subtle, and worse form in Filipino nationalism. -/- In this vein, the existence of the 19th century modern Philippine nation merely masked and deferred the crisis that was supposed to transfer power from the Spanish Empire to the multitude of the poor and suffering native indio majority. This crisis became all the more difficult to address be-cause of the duplicitous character of the discourse of Filipinization itself. It has not only effectively transferred power into the hands of the nationalist elite but also captured authentic emancipatory discourse within the identity-trap against which it can only hope to get out. This study concludes with the claim about the impossibility of ever escaping and overcoming the epistemic and practical violence necessarily contained within the historical discourse of colonialism. Or simply, we have no language or discourse that would enable us to overcome the complicity of Filipinization with the very (epistemic) violence against which it has set itself. (shrink)

This work establishes that the primary justification for the state is its role as the guarantor of last resort of the personal safety, liberty and property of the citizens. The essay upholds that the state exists fundamentally for the protection of life and property and ensuring the wellbeing of the citizens and unless it performs this basic function it has no reason to exist. The essay equally establishes that no other time since the civil war era has Nigeria's state been (...) seriously engulfed in perennial security challenges than now. It is the stand of this essay that the current trend of violence imprints on the psyche of Nigerians that the government security apparatus is incapable of guaranteeing the security, safety and wellbeing of the people. It is the candid opinion of this essay that the paradox of Nigeria's state security is that instead of the state being a framework of lawful order and the highest source of authority, it now constitutes the greatest threat to itself. The essay submits that peaceful protest is against the ruling elite that has exploited and appropriated the collective patrimony to itself. It substantiates the legality of EndSARS Protest necessitated by the improprieties of the unit of Nigeria Police Force – Special Anti-Robbery Squad (SARS) against human rights violation, extortion, torture brutality and extra-judicial killings by SARS due to sustained years of leadership deficit in Nigeria. The protest though hijacked by hoodlums is a wake-up call for articulation of good leadership and governance in Nigeria. This article seeks highlighting the importance of cultural and popular elements and forms within Doui Mnii Oasis Tribes in Tafilalt through focusing on the manifestations of this culture, especially Houbi Dance as a culturally popular form in its festive dimensions present in all feasts and on all occasions, together with its functioning and use on the level of Doui Mnii man's lifestyle. I have tried, in this paper, to foster a desciptice, analytical, and interpretive language. My focus is on the origin and authenticity in Ziz Oasis-Tafilalt through a historical glimpse at the cultural and intellectual components of this Arab Trbe, Mnii Tribe. Also, my point of departure is the importance of Doui Mnii Dance in Daoui Mnii Tribe, its structural form, performance, and its social and cultural dimensions. //////////////Résumé: Parmi les plus anciennes tribus arabes qui ont occupé les Oasis de Ziz à Tafilelt, on trouve ̎DOUI MNII. Ces tribus ont des spécificités traditionnelles qui montrent leur originalité et leur attachement à un patrimoine culturel riche et distinctif. Le présent article sert à montrer les principaux aspects de la culture populaire chez ces tribus. Notamment à travers la danse ‘’HOUBI’’, pratique omniprésente dans toutes leurs festivités. Notre objectif est d'étudier ce milieu social pour connaître son savoir intellectuel et spirituel, son mode de vie, ses pratiques sociales et leurs dimensions. Nous nous sommes basés dans la préparation de cet article sur les méthodes descriptive, analytique et interprétative de ce milieu. Les grands axes traités sont: d'une part, définitions des concepts suivants: culture populaire et tribu ̎DOUI MNII" (origines, installation dans les oasis de Ziz…). Este libro, es el segundo de la serie La Cultura en el Uruguay: una mirada desde las Ciencias Económicas. Tal como señaló en el primer volumen, los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República realizan como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un (...) aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que el conocimiento adquirido termine olvidado en los fondos de la biblioteca de dicha Facultad, entre cientos de producciones monográficas. Al igual que en el volumen anterior, se pretende en éste, continuar mostrando los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales, en una línea de investigación que me enorgullece coordinar, y en la que vuelco cotidianamente mis mayores esfuerzos. Cabe señalar, que el primer libro trató sobre diversos temas vinculados a la Cultura, atendiendo a una clasificación clásica en la disciplina que divide -o solía dividir- el objeto de estudio en Patrimonio, Artes Escénicas e Industria Cultural, y por ende, abarcó temáticas diversas. En esta segunda entrega, y ante la imposibilidad de recoger la totalidad de los trabajos monográficos producidos en el lapso comprendido entre la edición del primer y segundo volumen, se optó por efectuar una selección temática en vez de cronológica, por lo que se muestran en este libro solamente los trabajos que atañen a la Gestión y Economía de los Museos, y a un tema estrechamente vinculado, por la injerencia que tiene uno en el otro, que es el análisis económico del mercado de arte, en este caso, por medio de subastas. Todos los trabajos aquí presentados fueron tutorados por mí, aunque no en exclusividad. Primando la excelencia académica, y entendiendo que varios de los temas tratados tenían una especificidad considerable, recurrí, tal como es usual en el ámbito académico, -que valora la discusión entre pares y la consideración de opiniones de especialistas- a la ayuda de diversos colegas para que estas monografías pudieran concretarse con el mejor nivel académico posible. La primera investigación que se presenta fue realizada por las Contadoras Ana Macias y Ma. Fernanda Rimoldi, titulada Museos, una visión desde la Gestión de Calidad. Dicha investigación, tutorada conjuntamente con la especialista en calidad Cra Sara Gerpe, buscó determinar si es aplicable el Modelo Iberoamericano de Gestión de Calidad en Museos, para lo que se consideró una muestra de 14 museos montevideanos. Dicho trabajo propició un premio de un concurso organizado por el Ministerio de Educación y Cultura, denominado Tu Tesis en Cultura, y por ende, no necesita más presentación. La Cultura en Uruguay: una mirada desde las Ciencias Económicas El segundo trabajo, titulado Sistema de Museos: Planificación Estratégica. Un diagnóstico previo, de las Cras Andrea de Armas, Cecilia Moreira y Valeria Palacios, trata sobre un caso de estudio de gran importancia para el atractivo turístico y patrimonial, como es el Sistema de Museos de Colonia de Sacramento, y realiza un diagnóstico enmarcado en la gestión estratégica de las organizaciones museísticas. Las conclusiones no son generalizables a otros museos que los que integran el Sistema de Museos de Colonia, sin embargo, la metodología empleada es fácilmente extrapolable a otros museos, tanto uruguayos como del exterior, que busquen comenzar el camino de la planificación estratégica. En tercer lugar, se expone la monografía de los Contadores Yamila Hernández, Sebastián Maidán y Ana Laura Mascheroni, que trata un tema crucial en los albores del siglo XXI como es la Responsabilidad SocialCorporativa. Este trabajo también se basa en un estudio de caso, y la organización bajo análisis es el Museo del Carnaval, museo que tiene una conducta innovadora que posibilita vincular el museo con programas pioneros en responsabilidad social en Uruguay. El trabajo se denomina Balance Social Museo del Carnaval y fue tutorado en forma conjunta con un referente en Responsabilidad Social Empresaria como es el Cr. Walter Rossi. El cuarto trabajo fue una producción de los Licenciados en Economía Tatiana Cóppola y Fernando González y se titula Museos en el Uruguay: Una visión económica. La investigación buscó la relación entre la variable visitante de una institución museística, y otras variables explicativas, como son la valoración del acervo, costos operativos, apertura horaria, entre otras, logrando probar que la variable relacionada a la captación de visitantes, para la muestra analizada, es la variable Difusión. Esta monografía la tutoré en forma compartida con el Dr. Gustavo Bouquet y el Lic. Raúl Ramírez, en una situación absolutamente atípica en el que el número de tutores supera el de estudiantes. Pero bien valió la pena la excepción en vista de los excelentes logros alcanzados. Para finalizar, se presenta la monografía titulada Formación de Precios de Pintura Nacional en Subasta: un Modelo y su Aplicación con la que accedieron al título de Licenciados en Economía Javier Chiossi y Matías De Vecchi. Se incluyó dicho trabajo en este volumen, que trata básicamente sobre museos, porque entiendo que el Mercado de Arte está indudablemente vinculado a la política de compras de los museos, en especial los contemporáneos. Cabe destacar que este trabajo contó con el apoyo de la Dra. Celina Gutiérrez, quien accedió a compartir la tutoría de un tema que escapaba mis posibilidades, logrando un excelente resultado. Merece señalar que cada trabajo original supera el centenar de páginas, y que por ende, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de las investigaciones realizadas, intentando adecuar la terminología y quitándoles el formato estrictamente científico -poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. También quiero señalar, que el prólogo del primer volumen, lo finalicé con la frase: “Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida” La Facultad ha comenzado un nuevo plan de estudio, en el que se eliminó la obligatoriedad de presentar una tesina o monografía como condición necesaria para obtener el título. No obstante, aún contamos con una decena de monografías que no han sido publicadas y que espero se concreten en el o los siguientes volúmenes de esta serie. (shrink)

Democratic systems ought to have certain central tenets that act as ethical boundaries. The violation of these ethical boundaries relegates democratic systems to mere mirages, perversions and phantoms. The market fundamentalistic stance of neo-liberalism leads to the abuse of virtually all the central tenets of democracy. Neo-liberalism advocates for a weak interventionist state in terms of fostering human rights and social justice and a strong regulatory state in terms of protecting and promoting markets and private property. Democracy on the other (...) hand calls for a strong interventionist state to implement the human rights and social justice mandate on behalf of the people and a strong regulatory state to curtail the abuse of human rights and social justice. This paper argues that in neo-liberal states like Uganda, markets and the accumulations of private property in most cases through primitive accumulation take precedence over democracy. This has culminated into privations of democracy such as; autocratic majoritarianism, mobocracy, kleptocracy, prebendalism and neo-patrimonialism. (shrink)

Este paper busca caracterizar el establecimiento de comercio virtual como un tipo de establecimiento de comercio diseñado para dar respuesta a los desafíos que la sociedad de la información, y a su vez poner de relieve el rol de la propiedad intelectual en los entornos virtuales, así como la necesidad de salvaguardarla en este ámbito.
