According to an attractive conception of love as attention, discussed by Iris Murdoch, one strives to see one’s beloved accurately and justly. A puzzle for understanding how to love another in this way emerges in cases where more accurate and just perception of the beloved only reveals his flaws and vices, and where the beloved, in awareness of this, strives to escape the gaze of others - including, or perhaps especially, of his loved ones. Though less attentive forms of love (...) may be able to render one’s continued love coherent and justifiable in these cases, they risk further alienating the beloved precisely because they are less attentive and because of the operations of the beloved’s shame. I argue that attentive love is well-suited to alleviate this problem of alienation, but that in order to do so, it must be supplemented with grace. I propose a conception of gracious love as an affectionate love for the qualities of human nature, distinguishing this from a love of humanity, and show how this complex emotion, in being responsive to the complexities of shame, is able to alleviate the problem of alienation. L.A. Paul argues that “transformative experiences” challenge our hopes to live up to an ideal that she believes is upheld within western, wealthy cultures. If these experiences reveal information to us about the world and ourselves that is in principle unavailable to us before we undergo them, it seems that there is no hope for us to be rational, authentic and autonomous masters of our own lives. Supposing that Paul is right about this, how concerned should we be? Here, I (...) challenge the ideal of "rational mastery" that guides Paul’s project, and which must be granted in order to motivate the philosophical challenge purportedly generated by experiences that drastically change who we are and what we know. The guise of the good thesis can be understood as an attempt to distinguish between human motivations that are intelligible as desires and those that are not. I propose, first, that we understand the intelligibility at stake here as the kind necessary for the experience of reactive attitudes, both negative and positive, to the behavior and motivations of an agent. Given this, I argue that the thesis must be understood as proposing substantive content restrictions on how human agents perceive objects (...) of their desires; it cannot be a purely formal constraint. Moreover, while proponents of the guise of the good thesis who posit substantive content restrictions on human desire are right to do so, they are mistaken to claim that we always desire the apparently good. Instead, I propose a different limit: the naturally attractive. This alternative to the guise of the good thesis nonetheless captures the compelling idea that human desires are intelligent, quasi-perceptual responses to the world. (shrink)

Philosophers are now wary of conflating the “fittingness” or accuracy of an emotion with any form of moral assessment of that emotion. Justin D’Arms and Daniel Jacobson, who originally cautioned against this “conflation”, also warned philosophers not to infer that an emotion is inaccurate from the fact that feeling it would be morally inappropriate, or that it is accurate from the fact that feeling it would be morally appropriate. Such inferences, they argue, risk committing “the moralistic fallacy”, a mistake they (...) claim is widespread throughout the work of contemporary and historical moral philosophers. I argue that many basic and familiar forms of moral assessment of the emotions are not subject to these arguments. I illustrate this by reconsidering the idea that to assess an emotion as “fitting” is to assess it as what a virtuous person would feel. After showing how assessments akin to this “virtue-theoretical” notion of fit may be prevalent even outside of the Aristotelian tradition, I suggest some more charitable and philosophically productive interpretations of the philosophical views of the emotions that D’Arms and Jacobson criticize, and argue that we cannot coherently theorize about the fittingness conditions of the emotions in a morally neutral way. On one predominant conception of virtue, the virtuous agent is, among other things, wholehearted in doing what she believes best. I challenge this condition of wholeheartedness by making explicit the connections between the emotion of boredom and the states of continence and akrasia. An easily bored person is more susceptible to these forms of disharmony because of two familiar characteristics of boredom. First, that we can be – and often are – bored by what it is that we know would (...) be best to do, and second, that occurrent states of boredom tend to give rise to positive interest in performing actions that we know are bad to perform. Moreover, while a person’s susceptibility to boredom can indicate a lack of attentiveness or acuity, or be evidence of a vice such as ingratitude or shallowness, it can in others indicate positive qualities of character, such as perspicacity, liveliness, and certain forms of intelligence. Upon imagining certain bored akratics without the psychological qualities that give rise to their boredom, we will either imagine them without these positive qualities, or with others that – though perhaps psychologically possible – are not clearly better. This yields the result that a person who is continent or even akratic because of her susceptibility to boredom may have a character no less excellent than that of the wholehearted agent. (shrink)

As with certain other self-reflexive emotions, such as guilt and shame, our understanding of self-hatred may be aided by views of the mind which posit an internalized other whose perspective on oneself embodies and focuses a set of concerns and values, and whose perspective one is in some sense vulnerable to. To feel guilt for some transgression is not solely to feel the anger that one would feel toward another’s trespasses, now directed back onto oneself as an object of that (...) anger; it is at the same time to react to that anger – perhaps, for example, to accept it as deserved, or to welcome the lashing of one’s bad conscience. To feel shame before oneself is not just to see oneself in some compromising way, it is to feel compromised by one’s own gaze. Likewise, the person who hates herself does not feel the hatred that she might have for another, simply taking herself as object of that attitude. She is not merely the seat of an internalized hostile voice and perspective that she may, for example, react to with indifference. She does not only tell herself that she is “worthless” but, will typically feel herself so in response. And her suffering may not just result from pain she is inclined to inflict, but suffering that, in some sense, she is inclined to suffer. But how is this so? How, in self-hatred, does one become not only subject to, but vulnerable and even receptive to one’s own hostility? (shrink)

Recent years have seen a surge of interest in implicit bias. Driving this concern is the thesis, apparently established by tests such as the IAT, that people who hold egalitarian explicit attitudes and beliefs, are often influenced by implicit mental processes that operate independently from, and are largely insensitive to, their explicit attitudes. We argue that implicit bias testing in social and empirical psychology does not, and without a fundamental shift in focus could not, establish this startling thesis. We suggest (...) that implicit bias research has been conducted in light of inadequate theories of racism and sexism. As a result, such testing has not sufficiently controlled for subjects’ prejudiced explicit beliefs and emotions, and has not ruled out the possibility that explicit prejudice best explains test subjects’ discriminatory associations and behavior. To act akratically is to act, knowingly, against what you judge is best for you to do, and it is traditionally assumed that to do this is to be weak-willed. Some have rejected this identification of akrasia and weakness of will, arguing that the latter is instead best understood as a matter of abandoning one's reasonable resolutions. This paper also rejects the identification of akrasia and weakness of will, but argues that this alternative conception is too broad, and that weakness (...) of will is best understood in relation to certain kinds of pain and pleasure. Moreover, the phenomenon of strong-willed akrasia, cases in which a person must exhibit strength of will to do precisely what she judges she should not do, suggests that strength of will is an executive virtue, and that being weak-willed is just one way (among others) in which a person can fail to manifest this virtue. ABSTRACT What is the ethical significance of the suffering of nonhuman animals? For many, the answer is simple. Such suffering has clear moral significance: nonhuman animal suffering is suffering, suffering is something bad, and the fact that it is bad gives us reason to alleviate or prevent it. The practical problem that remains is how to do this most efficiently or effectively. I argue that this does not exhaust the ethical significance of certain evils, once we consider how the existence (...) of those evils may detract from the meaning of human life, even on fully “naturalistic” conceptions of meaning in life. I will draw a distinction between what I will call “spiritual” problems and “moral” problems and consider why moral philosophers may be well suited to addressing both problems, as long as the domain of the ethical is not taken to be exhausted by the domain of the moral. Finally, I will elaborate on why marking a distinction between these problems—the moral and the spiritual—may help illuminate some disagreements between Utilitarians and their opponents about the ethical significance of the suffering of nonhuman animals. In “Confucianism and Same-Sex Marriage,” published recently in Politics and Religion, Professor Tongdong Bai argues for a “moderate Confucian position on same-sex marriage,” one that supports its legalization and yet endeavors “to use public opinion and social and political policies to encourage heterosexual marriages, and to prevent same-sex marriages from becoming the majority form of marriages” (Bai 2021:146). Against the backdrop of downright homophobia prevalent among vocal Confucians in mainland China today, Bai claims that his pro-legalization rendition “show[s] a different (...) version of Confucianism that challenges the received perception of Confucianism that it is deeply conservative, a perception that often lies at the core of the rejection of its contemporary relevance, especially by the so-called ‘liberals’ in China and elsewhere” (Bai 2021:133). Furthermore, Bai claims that his moderate Confucianism is normatively preferrable to “the typical liberal or individualist position” of a marriage equality supporter, because the specter of polygamy – the conservative trope of invoking polygamy as a reductio ad absurdum against same-sex marriage – imposes “a serious challenge” to liberals but not to moderate Confucians (Bai 2021:146, 153). -/- Both of Bai’s claims falter upon scrutiny, however. Granted, it is applaudable that Bai tries to dissuade his more conservative Confucian colleagues from opposing the legalization of same-sex marriage. But as Section 1 of this Response will show, the alternative rendition of Confucianism he presents, along with the way he presents it, is premised on a highly contested conception of what shared Confucian values are; does injustice to Confucians who embrace marriage equality more unreservedly (i.e., without caveats à la Bai); fails to produce new arguments that “enrich the theoretical basis for same-sex marriage” (Bai 2021:133); and, ironically, reinforces – rather than “challenges” – the “received perception” of Confucianism as deeply conservative. Meanwhile, Section 2 will show that Bai’s comparison between liberalism and moderate Confucianism relies both upon an apparent unfamiliarity with the extensive and nuanced liberal discussions on polygamy, and upon fallacious methods of assessing comparative normative valence. -/- Finally, Section 3 will offer some concluding thoughts from the perspective of decolonial theory, examining the dynamic of spectacularized postcoloniality that propels the production and consumption of dubious theoretical projects like Bai’s. As it turns out, this case serves not only as a cautionary tale of how not to conduct comparative normative theorizing, but also as a cautionary tale of how not to let the spectacle of postcoloniality derail the pursuit of academic decolonization. This paper calls for a paradigm shift in studying academic dependency, towards the paradigm of brokered dependency. Using Chinese academia as an example, I demonstrate how the neocolonial condition of academic dependency is always mediated through blockage-brokerage mechanisms. The two most salient blockage-brokerage mechanisms of dependency in the Chinese context are linguistic barrier and authoritarian malepistemization, and the effects of the latter consist of three layers: institutional, informational and incorporational. On top of their domestic impacts, those mechanisms jointly exacerbate spectacularized (...) postcoloniality in anglophone-hegemonic global academic publishing. The paradigm of brokered dependency not only represents a more nuanced approach to the study of academic dependency, but also underscores the fact that the dismantling of the neocolonial condition cannot be conceived and pursued in isolation from comprehending and confronting the authoritarian condition, especially when the latter pertains under the disguise of anticolonialism. In the world of Avatar: The Last Airbender (ATLA) and The Legend of Korra (LOK) —let’s call it the Bending World—some people (“benders”) are endowed with telekinetic superpowers to maneuver surrounding objects without physical interaction, by mentally steering (“bending”) one of the four classical “elements of nature” composing the objects: air, fire, water, and earth. Perhaps, in a world where the fundamental laws of nature are radically different from those of our world, the fundamental conditions and manifestations of politics should (...) be radically different too. That, of course, is not to deny that political bodies familiar to us are depicted in ATLA and LOK: tribes, monarchies, autonomous townships, city-states, loose federations, colonial empires, and democracies. Despite those familiar depictions, however, it’s worth contemplating how the existence of supernatural power might fundamentally alter the norms and rationales of politics—and how it might in turn help us better understand our own political reality. Parmenides expelled nonbeing from the realm of knowledge and forbade us to think or talk about it. But still there has been a long tradition of nay-sayings throughout the history of Western and Eastern philosophy. Are those philosophers talking about the same nonbeing or nothing? If not, how do their concepts of nothing differ from each other? Could there be different types of nothing? Surveying the traditional classifications of nothing or nonbeing in the East and West have led me to (...) develop a typology of nothing that consists of three main types: 1) privative nothing, commonly known as absence; 2) negative nothing, the altogether not or absolute nothing; and finally 3) original nothing, the nothing that is equivalent to being. I will test my threefold typology of nothing by comparing the similarities and differences between the conceptions of nothing in Heidegger, Daoism and Buddhism. With this study, I hope that I will clarify some confusion in the understanding of nothing in Heidegger, Daoism and Buddhism, and shed light on the central philosophical issue of “what there is not”. The book titled The Collaborative Economy in Action: European Perspectives is one of the important outcomes of the COST Action CA16121, From Sharing to Caring: Examining the Socio-Technical Aspects of the Collaborative Economy that was active between March 2017 and September 2021. The Action was funded by the European Cooperation in Science and Technology - COST. The main objective of the COST Action Sharing and Caring is the development of a European network of researchers and practitioners interested in investigating the (...) collaborative economy models, platforms, and their socio-technological implications. The network involves scholars, practitioners, communities, and policymakers. The COST Action Sharing and Caring helped to connect research initiatives across Europe and enabled scientists to develop their ideas by collaborating with peers. This collaboration opportunity represented a boost for the participants’ research, careers, and innovation potential. The main aim of this book is to provide a comprehensive overview of the collaborative economy in European countries with a variety of its aspects for a deeper understanding of the phenomenon as a whole. For this reason, in July 2017, an open call for country reports was distributed among the members of the COST Action Sharing and Caring. Representatives of the member countries were invited to produce short country reports covering: definition of the CE; types and models of the CE; key stakeholders involved; as well as legislation and technological tools relevant for the CE. Submitted reports varied in length and regarding the level of detail included, in accordance with how much information was available in each respective country at the time of writing. Editors of the book have compiled these early reports into a summary report, which was intended as a first step in mapping the state of the CE in Europe. The Member Countries Report on the Collaborative Economy, edited by Gaia Mosconi, Agnieszka Lukasiewicz, and Gabriela Avram that was published on the Sharing and Caring website, represented its first synergetic outcome and provided an overview of the CE phenomenon as interpreted and manifested in each of the countries part of the network. Additionally, Sergio Nassare-Aznar, Kosjenka Dumančić, and Giulia Priora compiled a Preliminary Legal Analysis of Country Reports on Cases of Collaborative Economy. In 2018, after undertaking an analysis of the previous reports’ strengths and weaknesses, the book editors issued a call for an updated version of these country reports. Prof. Ann Light advised the editorial team, proposing a new format for country reports and 4000 words limit. The template included: Introduction, Definition, Key Questions, Examples, Illustration, Context, Developments, Issues, Other Major Players, and Relevant Literature. The new template was approved by the Management Committee in October 2018. The task force that had supported the production of the first series of country reports acted as mentors for the team of authors in each country. The final reports arrived at the end of 2018, bringing the total number of submissions to 30. A call for book editors was issued, and a new editorial team was formed by volunteers from the participants of the COST Action: Andrzej Klimczuk, Vida Česnuityte, Cristina Miguel, Santa Mijalche, Gabriela Avram, Bori Simonovits, Bálint Balázs, Kostas Stefanidis, and Rafael Laurenti. The editorial team organized the double-blind reviews of reports and communicated to the authors the requirements for improving their texts. After reviews, the authors submitted updated versions of their country reports providing up-to-date interdisciplinary analysis on the state of the CE in 2019, when the reports were collected. During the final phase, the chapters were again reviewed by the lead editors together with all editorial team members. At the time, the intention was to update these reports again just before the end of the COST Action Sharing and Caring in 2021 and to produce a third edition. However, the COVID-19 pandemic changed these plans. People tend to be repulsed by the idea of cash markets in kidneys, but support the trading of kidneys through paired exchanges or chains. We reject anti-commodification accounts of this reaction and offer an egalitarian one. We argue that the morally significant difference between cash markets and kidney chains is that the former allow the wealthy greater access to kidneys, while the latter do not. The only problem with kidney chains is that they do not go far enough in addressing (...) equality concerns, and we show how the introduction of cash payments by the state could remedy this. A private, for-profit company has recently opened a pair of plasma donation centres in Canada, at which donors can be compensated up to $50 for their plasma. This has sparked a nation-wide debate around the ethics of paying plasma donors. Our aim in this paper is to shift the terms of the current debate away from the question of whether plasma donors should be paid and toward the question of who should be paying them. We consider arguments against paying plasma (...) donors grounded in concerns about exploitation, commodification, and the introduction of a profit motive. We find them all to be normatively inconclusive, but also overbroad in light of Canada’s persistent reliance on plasma from paid donors in the United States. While we believe that there are good reasons to oppose allowing a private company to profit from Canada’s blood supply, these concerns can be addressed if payment is dispensed instead by a public, not-for-profit agency. In short, we reject profiting from plasma while we endorse paying for plasma; we therefore conclude in favour of a new Canadian regime of public sector plasma collection and compensation. (shrink)

This study deals with the tensions between old and new Yogācāra, as seen in the Huayan sources, which, in turn, reflect discontinuity between Indian Yogācāra and its reception in China. Its particular focus is on the concept of karmic appearance , as developed in the Awakening of Faith and further elaborated on by many Huayanmasters. This concept illustrates the sudden arising of deluded thoughts and provides us with a paradigm for the approach to the problem of delusion, a problem that (...) is deeply rooted in Tathāgatagarbha Thought and addresses the origin of deluded thoughts against the backdrop of the pure mind. This Huayan solution resembles the concept of free will, as developed in mainstream Christian theology after Augustine attempted to solve the problem of evil, and the concept of playfulness found in Indian Vedānta theology to explain the creation of the illusory world. The sharing economy is a new and underdeveloped phenomenon in Lithuania, starting from the definition of the concept in a state’s legal framework and scarce statistics. The aim of the paper is to describe the trends of the digitally supported sharing economy in Lithuania. Available national and international information and data were analysed. It was shown that the most popular services in Lithuania there is the transport sector, in the second place there is the accommodation sector, in the third—food-related services. (...) The reasons why Lithuanians offer services via collaborative platforms mostly concern additional sources of income and flexible working hours. Over two-thirds of the habitants express their positive attitudes towards sharing economy and collaborative platforms, and over ninety per cent would recommend other services offered via collaborative platforms. Though 97% of the Lithuanians have never offered the services via sharing economy and collaborative platforms, and it is mostly because of no item or interest, and two-fifths do not know at all those collaborative platforms are. The development of the sharing economy in Lithuania as far is gaining speed, and in the future, the principles of these phenomena are going to be used in an even broader scope of the sectors. The present paper discusses some concepts and materials that may be linked to Īśvarasena’s theory of non-cognition. These include the concept of feiliang 非量 as found in the writings of Dharmapāla, Asvabhāva, Jinaputra and their Chinese counterparts, and apramāṇatā (or apramāṇatva), as found in the works of Dharmakīrti and his commentators. I shall demonstrate that the two concepts in many ways mirror the theory of three pramāṇas, proposed by Īśvarasena. As most of these materials are from the sixth to eighth (...) century, they are extremely helpful for clarifying the early development of the theory of non-cognition and filling gaps in our understanding of the early development of this theory. The present paper explores some pre-Vibhāṣika sources including the Kathāvatthu, *Śāriputrābhidharma, and Vijñānakāya. These sources suggest an early origin of the concept of the cognition of nonexistent objects (asad-ālambana-jñāna) among the Mahāsāṃghikas and some of its sub-schools. These scattered sources also indicate some different aspects of this theory from that held by the Dārṣṭāntikas and the Sautrāntikas. In particular, some Mahāsāṃghika arguments for the cognition of nonexistent objects reveal how a soteriologically-oriented issue gradually develops into a sophisticated philosophical concept.

Among various opinions in the controversy over the the cognition of non-existent objects (asad-ālambana-vijñāna) among various Buddhist and Indian philosophical schools or in the debate on the objectless presentations (gegenstandslose Vorstellungen) happened in the early development of phenomenology and analytic philosophy, I find that Dharmakīrti and Husserl hold similar views. Both of them have less interest in redefining the ontological status of nonexistent objects than Russell and Meinong. Rather they engage themselves in analyzing the experiential structure of negative cognition and (...) come up with a similar conclusion that negative judgments presuppose affirmative perceptions. The term SE was frequently used when early models, such as Airbnb or ZipCar, appeared and gained popularity, especially in the United States, but it was afterwards substituted with the term CE in the European contexts. The country reports in this collection often use the two terms interchangeably, further illustrating the fact that a generally agreed definition (...) is still missing. However, the ambition driving the term CE is to create specific European economic models with greater emphasis on the community’s involvement. In Europe, it is still the case that the definition of the CE and SE remains fuzzy, including both non-profit and for-profit models, supported by both monetary and non-monetary exchanges among participants. The phenomenon is complex, covering various fields of activity, as well as operating at various levels, ranging from the international to the national, regional, and local. Some definitions focus mostly on sustainability, while others highlight technological and financial aspects and business models specific to the phenomenon. This chapter is organized as follows. The chapter is the final one in the volume of collected papers aiming to discuss the sharing economy in Europe. The idea of the book emerged within the research network created by the COST Action CA16121 ‘From Sharing to Caring: Examining Socio-Technical Aspects of the Collaborative Economy.’ The authors of the chapter sum up theoretical and empirical materials as well as country-specific cases provided in the book. The article critically assesses the current status of the sharing economy in European countries (...) by highlighting major controversial issues related to deregulation, market disruption, or social inequality. The authors conclude that, considering the comprehensive and up-to-date materials collected and analysed in the book, it may become an outstanding source of knowledge and a practical tool in the process of expansion of the sharing economy in Europe and beyond. Nutrient losses from sloping farmland in karst areas lead to the decline in land productivity and nonpoint source pollution. A specially tailored steel channel with an adjustable slope and underground hole fissures was used to simulate the microenvironment of the "dual structure" of the surface and underground of sloping farmland in a karst area. The artificial rainfall simulation method was used to explore the surface and underground runoff characteristics and nutrient losses from sloping farmland under different rainfall intensities. The effect (...) of rainfall intensity on the nutrient loss of farmland on karst sloping land was clarified. The results showed that the surface was the main route of runoff and nutrient loss during the rainy season on sloping farmland in karst areas. The influence of rainfall intensity on the nutrients in surface runoff was more substantial than that on underground runoff nutrients. Nutrient loss was more likely to occur underground than on the surface. The losses of total nitrogen, total phosphorus, and total potassium in surface and underground runoff initially increased and then gradually stabilized with the extension of rainfall duration and increased with increasing rainfall intensity and the amount of nutrient runoff. The output of nutrients through surface runoff accounted for a high proportion of the total, and underground runoff was responsible for a low proportion. Although the amount of nutrients output by underground runoff was small, it could directly cause groundwater pollution. The research results provide a theoretical reference for controlling land source pollution from sloping farming in karst areas. (shrink)

Saturated free fatty acids-induced hepatocyte lipoapoptosis plays a pivotal role in non-alcoholic steatohepatitis. Theactivation of endoplasmic reticulum (ER) stress isinvolved in hepatocyte lipoapoptosis induced by thesaturated free fatty acidpalmitate (PA). However, the underlying mechanismsof the role of ER stress in hepatocyte lipoapoptosis remain largely unclear.In this study, we showed that PA and tunicamycin (Tun), a classic ER stress inducer, resulted in differential activation of ERstress pathways. Mobile Edge Computing (MEC) is an emerging technology that enables computing directly at the edge of the cloud computing network. Therefore, it is important that MEC is applied with reliable transmission. The problem of reaching consensus in the distributed system is one of the most important issues in designing a reliable transmission network. However, all previous protocols for the consensus problem are not suitable for an MEC paradigm. It is the first time an optimal protocol of reaching consensus is pro- (...) posed for MEC paradigm. The protocol makes all fault-free nodes communicate with each other and collect the exchanged messages to decide a common value. Based on the common value, the protocol ensures all fault-free nodes reach consensus without the influence of unreliable transmission. Finally, we proved theoretically that the proposed protocol can tolerate the maximum number of faulty components and using only two rounds of message exchanges. (shrink)

This chapter explains the rationale behind the book. It provides basic definitions of the concept of the sharing economy as well as the primary meanings related to the subject of the analysis undertaken in the subsequent chapters. This Introduction also includes a description of the main benefits of the analysis of the sharing economy from a European perspective. It highlights that the idea of the book emerged from the collaboration of most co-authors in the COST Action CA16121 ‘From Sharing to (...) Caring: Examining Socio-Technical Aspects of the Collaborative Economy.’ Finally, the outline of the book is presented, providing a description of the content of each chapter within this academic collection. Currently, little is known about the mechanism of how university students’ attitudes toward entrepreneurship education (ATEE) affect entrepreneurial self-efficacy (ESE) in the post-pandemic entrepreneurial environment. Based on the existing research, this study explores the relationship between ATEE, the post-pandemic entrepreneurship environment, and ESE through a questionnaire survey. A total of 910 university students from three universities in Zhejiang Province, China participated, with an effective rate of 92.9%. The data collection focused on the period from August to December 2020. Background: Postoperative pneumonia is a preventable complication associated with adverse outcomes, that greatly aggravates the medical expenses of patients. The goal of our study is to identify risk factors and outcomes of postoperative pneumonia.

We introduce Pura Vida Neutrosophic Algebra, an algebraic structure consisting of neutrosophic numbers equipped with two binary operations namely addition and multiplication. The addition can be calculated sometimes with the function min and other times with the max function. The multiplication operation is the usual sum between numbers. Conferencia inaugural impartida en el V Coloquio Nacional "Los valores en el siglo XXI", Universidad Autónoma de Guerrero, Chilpancingo, México, 24 de noviembre de 2010. El texto se refiere a la relación entre vida y valores y desarrolla la tesis sobre los fundamentos vitales de los valores humanos, para lo cual se indaga en las premisas evolutivas del vínculo entre la vida y las relaciones de significación que los seres vivos establecen con su entorno.

El trabajo reflexiona sobre los fundamentos originarios de la ética. La tesis central que se defiende y que se busca mostrar consiste en asumir que las raíces históricas últimas de lo ético están en la vida humana misma, que lo ético responde a una necesidad humana vital y que es precisamente en la vida donde ha de encontrarse el buscado criterio de última instancia sobre lo que lo ético es. Esta hipótesis conduce necesariamente a analizar el tema de (...) la vida, a abordar el asunto también desde una perspectiva antropológica y a buscar lo que podría llamarse pre-historia biológica de lo ético. Se muestran las relaciones de incompatibilidad entre capitalismo y vida que, en sentido perspectivo, Marx pone de manifiesto. Es esa la razón más profunda por la cual el pensador alemán concluye que no puede ser el capitalismo el modelo de sociedad que habite indefinidamente el ser humano.

A partir del reto axiológico que presupone el hecho de que sea el propio ser humano el creador de los principales peligros que amenazan su supervivencia, tanto en sus efectos naturales como sociales, en el trabajo se argumenta por qué ello es indicador del extravío de los valores fundamentales que debe guiar el accionar humano y cómo el rescate de una confiable brújula axiológica debe partir por asumir a la vida como el criterio último de lo valioso.

Tal vez el rasgo que más tipifica los cambios operados en el capitalismo actual sea la mundialización de sus atributos fundamentales. El capital se desprende del rostro nacional que lo había identificado durante su etapa clásica. No sólo la materia prima, tampoco los trabajadores, los dueños de las acciones, ni el proceso productivo mismo quedan enmarcados en fronteras nacionales precisas. El modelo económico en que se enmarca la mundialización posee los mismos fundamentos liberales del capitalismo clásico. La globalización neoliberal actual (...) es en buena medida la expansión hasta un marco planetario de los mismos atributos del liberalismo clásico nacional, con sus consiguientes secuelas negativas para la vida, ahora redimensionadas debido al alcance mismo del sistema. Pero la mundialización también entraña una serie de características particulares que la convierten en lo que podríamos calificar como una nueva forma de imperialismo. Uno de los incuestionables aportes teóricos de Marx fue la clara delimitación del papel fundamental que desempeña la vida humana en la sociedad y en su historia. La aparente acumulación caótica de acontecimientos que hacen parte de la historia sólo adquiere un sentido y se aproxima a una determinada lógica (plural, diversa, si se quiere, pero lógica al fin) si se vincula al proceso real de la vida de los seres humanos. Para isso, será utilizado, como porta de entrada, um estudo do personagem Sir John Falstaff e de como esse homem se relaciona com a moralidade cortês e cavaleiresca própria da época em que seu criador escreveu. Desse modo, para além das peças de Shakespeare em que se encontra esse personagem, também (...) será necessário consultar manuais de cortesia (como o de Castiglione), bem como investigar a Ordem da Jarreteira, à qual o dramaturgo britânico associa seu personagem. Por fim, espera-se, com esta pesquisa, contribuir para os estudos acerca das relações entre cavalaria, cortesia e polidez já que, como se sabe, Shakespeare passa a ser tomado, no século XVIII, como um dos autores importantes para a formação moral das luzes britânicas. Simônides de Ceos foi um poeta lírico grego cuja obra é marcada pela atenção à problemática da existência humana e cuja distinção é a visão do fazer poético como atividade propriamente humana. Nietzsche nutria grande admiração por Simônides desde o tempo de sua formação intelectual, como revela sua correspondência dos anos sessenta. Além disso, em seus cadernos e em dois aforismos de sua obra publicada, o filósofo apresenta interessantes reflexões sobre o poeta. Em uma delas, afirma que Simônides aconselhava os (...) gregos a tomarem a vida como um jogo. Tal compreensão é um dos temas abordados neste ensaio. O outro tema é a discussão sobre certa proximidade entre as concepções de Simônides e Nietzsche acerca da arte como ofício, derivadas da interlocução crítica deles, respectivamente, com a tradição poética arcaica e a tradição estética e filosófica. A convergência de ambos sobre tais temas liga-se a um traço comum: o enraizamento da existência humana na aparência. (shrink)

El artículo propone entender la precariedad en un análisis que sobrepase las condiciones laborales, y que observe la formación de un ciclo vital atravesado por sistemas generales de administración de los medios de subsistencia. El tema de la importancia de la filosofía puede ser abordado desde muy diversas plataformas teóricas. Nos interesa en este ensayo, sobre todo, tratar el tema de la relación entre vida y filosofía. La idea básica que deseamos desarrollar acá es que la filosofía forma parte inalienable de la vida humana misma. Partimos de la idea de que a la filosofía la necesitamos porque nos es vitalmente necesaria, es decir, porque es necesaria para la vida.

La pregunta por la ética y la voluntad de vivir, frente a la racionalidad y la ecología utilitarista dan forma al texto de Enrique Leff. ¿Cómo se puede superar el estado actual de cosas sin recuperar una ética primigenia, la cual se hacía la pregunta por la buena vida, aquella que merece ser vivida? Siguiendo a Nietzsche, el rechazo por el sentimiento y las pulsiones están en el centro de la mirada racional e instrumental respecto de la naturaleza. La (...) búsqueda incesante del conocimiento objetivo nos ha llevado a olvidar las viejas preguntas acerca de cómo habitar el mundo; las mismas que la ilustración desechó en nombre del conocimiento científico y la dominación del mundo material. Este texto reflexiona sobre el señalado conflicto, y aporta elementos de análisis para su posible superación. (shrink)

La protección de datos constituye un derecho fundamental que, si bien vinculado a la esfera privada de los individuos, goza de entidad propia, y se entiende como un haz de facultades que implican el poder de disposición de los datos, esto es, el derecho a que se solicite el previo consentimiento para su recogida y uso, así como el derecho de acceso, rectificación y cancelación de los mismos. Derecho que en España está basado en el artículo 18.4 de la Constitución (...) Española, y del que deriva la facultad de cancelación al amparo de la Ley Orgánica 15/1999, de Protección de Datos de Carácter Personal. -/- En este trabajo estudiamos si este derecho puede afectar a los Libros de Bautismo de la Iglesia Católica o es más bien la libertad religiosa, que se contempla como derecho o libertad fundamental en el artículo 16 de la Constitución Española, la que debería tenerse en cuenta en relación con los Libros de Bautismo. Debemos considerar que esta libertad podría jugar desde dos perspectivas distintas, o, dicho de otro modo, respecto de dos titulares diferentes: por un lado la Iglesia Católica que considerada como confesión constituye un colectivo de fieles que ostenta la libertad religiosa y tiene derecho a la protección de la misma frente a agresiones externas; pero también la libertad religiosa del individuo, que se concretaría en la posibilidad de pertenecer o no a dicha confesión y en cualquier momento a abandonarla, y las posibles consecuencias de esta decisión en relación con los Libros de Bautismo. O artigo procura mostrar em que sentido a democracia deliberativa proposta pela teoria discursiva de Jürgen Habermas dá conta do problema dos reducionismos econômicos e juridificantes da mundialização ou globalização, entendida como uma colonização técnico-sistêmica do mundo da vida. Mientras exista Cuba y su Revolución, ello será una demostración fáctica de la posibilidad real de una alternativa al antropófago mundo en que vivimos, será el más contundente argumento contra el nihilismo, será la prueba viviente de que el ser humano y su vida llegarán a ser –más allá de cualquier declaración abstracta- lo más importante en la praxis real y concreta, será la semilla de la esperanza (...) de la abolición –en cualquiera de sus manifestaciones y no solo en el plano jurídico- de toda pena de muerte, no únicamente de aquella que duramente sanciona a delincuentes, sino también de aquella que mata de inanición, de enfermedades curables o por inseguridad o guerras imperiales.
