Thanks to mounting discussion about projected technologies’ possibly altering the species mentally and physically, philosophical investigation of what human beings are proceeds robustly. Many thinkers contend that whatever we are has little to do with how we should behave. Yet, tampering with what the human being is may tread upon human rights to be whatever one is. Rights given in widely recognized documents such as the U.N. Declaration of the Rights of Indigenous Peoples assume what humans are and need depends (...) upon ontological assumptions about human existence. Godman turns to human ontology—just what kind of beings humans are (from an angle distinct from the other two books) and how these play into rights. She is concerned with how well the social sciences accord with what we are. Gunkel homes in on a more specific moral topic than Godman's general concern with identity’s role in rights: automata moral status and rights. He enjoins us to inquire into what human rights are before we take on the new technologies’ challenge to it. Schneider’s Artificial You, while not explicitly about rights, poses a rights quandary. Certain individuals with reputable resources and practical backing explicitly seek to evolve the species as they see fit. The urgency among these works concerns how we need a sharper idea of what we are, how we should act and be treated, and how our rights fare among potential human improvements. (shrink)

La predisposición genética a ayudar a nuestros parientes cercanos ("altruismo"), que era vital para la supervivencia en nuestros antepasados en las llanuras de Africa de cenas de miles a decenas de millones de años atrás, es un defecto fatal en un mundo superpoblado donde nuestros vecinos ya no están estrechamente relacionados y están involucrados en una lucha de vida o muerte por la supervivencia. Me he referido a esto como "El gran delirio de la familia feliz" y es fundamental para (...) los delirios utópicos suicidas de la izquierda política, que surgen debido a la abundancia temporal de recursos y la relativa paz que es posible gracias a la despiadada violación de la tierra. Los puntos de vista políticos liberales que tenían sentido en el pasado están provocando el colapso de las sociedades democráticas modernas y tal vez de la civilización misma. Aunque esto es obvio para cualquier niño brillante de diez años con acceso a la red o incluso televisión por satélite, es totalmente opaco para el liberal/democrático/neomarxista/neofascista/tercer supremacista mundial/20,30,40 algo googloides y iPhoners, que pronto asumirá y destruirá la prosperidad y la paz en Estados Unidos y el Reino Unido, y luego el mundo, tanto directamente, como dejándolo abierto a la destrucción por parte de los Cárteles mexicanos, yihadistas islámicos y mucho más allá, los Siete Sópatas que gobiernan China. Estados Unidos y el mundo están en proceso de colapso por el crecimiento excesivo de la población, la mayor parte del siglo pasado, y ahora todo, debido a la gente del tercer mundo. El consumo de recursos y la adición de 2.000 millones más alrededor de 2100 colapsarán la civilización industrial y provocarán hambre, enfermedades, violencia y guerra a una escala asombrosa. La tierra pierde al menos el 1% de su suelo superior cada año, por lo que a medida que se acerca a 2100, la mayor parte de su capacidad de cultivo de alimentos desaparecerá. Miles de millones morirán y la guerra nuclear es muy segura. En Estados Unidos, esto está siendo enormemente acelerado por la inmigración masiva y la reproducción de inmigrantes, combinado con los abusos que hacen posible la democracia. La depravada naturaleza humana convierte inexorablemente el sueño de la democracia y la diversidad en una pesadilla del crimen y la pobreza. En consecuencia, las políticas sociales en todas partes son insostenibles y una a una todas las sociedades sin estrictos controles sobre el egoísmo se derrumbarán en anarquía o dictadura. Los hechos más básicos, casi nunca mencionados, son que no hay suficientes recursos en Estados Unidos o en el mundo para sacar a un porcentaje significativo de los pobres de la pobreza y mantenerlos allí. El intento de hacer esto es la bancarrota de Estados Unidos y la destrucción del mundo. La capacidad de la tierra para producir alimentos disminuye diariamente, al igual que nuestra calidad genética. Y ahora, como siempre, el mayor enemigo de los pobres es otro pobre y no los ricos. Sin cambios dramáticos e inmediatos, no hay esperanza de impedir el colapso de Estados Unidos, ni de ningún país que siga un sistema democrático. (shrink)

One central objection to philosophical defences of liberal neutrality is that many neutrally justified laws and policies are nonetheless discriminatory as they unilaterally impose costs or confer unearned privileges on the bearers of a particular conception of the good. Call this the false neutrality objection. While liberal neutralists seldom consider this objection to be a serious allegation, and often claim that it rests on a misunderstanding, I argue that it is a serious challenge for proponents of justificatory neutrality. Indeed, a (...) careful examination of recent French and Canadian laws which impede the members of cultural minorities from freely practising their religion reveals that the state can hide its discriminatory aims by cloaking the policies it enacts in neutral language. In order to avoid the problem of false neutrality, I contend, liberal neutralists should defend a combination of neutrality of justification and neutrality of aim and operationalize neutrality of aim through a practical test that has been a defining feature of American jurisprudence on religious freedom in the last thirty years: the general applicability requirement. Indigenous and non-indigenous communities in Latin America make land claims and support them with a variety of arguments. Some, such as Zapatistas and the Mapuche, have appealed to the “ancestral” or “historical” connections between specific communities and the land. Other groups, such as MST in Brazil, have appealed to the extremely unequal distribution of the land and the effects of this on the poor; the land in this case is seen mainly as a means for securing a decent standard of (...) living for members of disadvantaged groups. Although there is a large literature on the history as well as the social and political dimensions of land contestations and conflicts in Latin America, the question of whether the land claims put forward by disadvantaged groups can be morally justified has not been adequately examined. In this essay, we investigate the scope and limits of appeals to what we shall call assistance-based, contribution-based, and benefitting-based moral reasons with respect to land claims made by these disadvantaged groups. Krzysztof Trzciński, ‘The Concept of an Ethnic Upper Chamber in a Bicameral Parliament in an African State (Part 1).’ The article has been published in “Afryka” 34, 2011, pp. 30-42. It consists of two parts. Part 1 explains Nigerian political thinker Claude Ake’s concept of the ‘chamber of nationalities,’ in the context of the idea of recognizing and strengthening the ethnic groups’ rights in a multiethnic African state. According to the concept, in an African state, a bicameral parliament should be (...) constituted. Its upper house should be created based on the existing ethnic divisions, allowing all ethnic groups to be represented in a balanced way and thus empowering the smaller of them. Implementation of this concept may contribute to the building of more peaceful and politically stable states in Africa. Ake’s opinions are enriched with the views of a Sierra Leonian philosopher George M. Carew that seem useful in the analysis of the whole concept. Next, a case study of the Ethiopian parliament’s upper chamber, House of Federation, is discussed. That chamber is a product and an essential part of the ethnic federalism system currently existing in Ethiopia. This case resembles Ake’s concept in many ways. Then, the Nigerian philosopher Ifeanyi A. Menkiti’s ideas, having some common points with the Ethiopian territorial structure and political system as a whole, are explained. Menkiti’s views teach what may be the realities of an ethnic federalism system, especially in an undemocratic environment. His opinions also seem complementary with some of Ake’s ideas concerning the ‘chamber of nationalities’ concept. (shrink)

Krzysztof Trzciński, ‘Some Remarks on the Idea of Rotational Presidency in an African State.’ The article has been published in “Afryka” 31-32, 2010, pp. 29-44. The main aim of this article is to explain and analyze in a critical way the concept of the rotational presidency, proposed for a multiethnic African state by a Ghanaian philosopher Kwame Gyekye. In his opinion, the presidency in an African state should be rotated between all ethnic groups. According to Gyekye, this system would allow (...) the sharing of power between ethnic groups, create trust in their relations and, as a consequence, improve the coherence of a multiethnic state. However, Gyekye’s concept lacks some essential details and seems very difficult to be implemented. Wielu afrykańskich badaczy polityki i innych intelektualistów niezadowolonych z realiów sprawowania, czy wręcz zawłaszczania władzy przez rządzących we współczesnym afrykańskim państwie, szuka rozwiązań ustrojowych alternatywnych wobec obecnie istniejących. Pragną oni ustanowienia w afrykańskim państwie porządku demokratycznego, ale skrojonego na potrzeby jego wieloetnicznej specyfiki. Jedną z wysuwanych propozycji jest osłabienie pozycji prezydenta, który w Afryce zwykle wywodzi się z najliczniejszej lub najsilniejszej grupy etnicznej i posiada bardzo ważne oraz rozbudowane prerogatywy. Sposobem umniejszenia roli urzędu prezydenckiego może być rotacja przywództwa, która stosowana jest w niektórych porządkach ustrojowych (zwłaszcza w Szwajcarii, Bośni i Hercegowinie, na Komorach), a jej współczesnych korzeni należy szukać w ustroju dyrektoriatu z czasów Rewolucji Francuskiej. Poprzez wieki ewolucji idei i instytucji obywatelstwa w Europie, płeć (obok wolności osobistej, wieku, pochodzenia, miejsca urodzenia, domicylu czy majętności ) należała do głównych kryteriów posiadania pełnoprawnego statusu obywatelskiego w państwie. Obywatelstwo aż do XX wieku miało charakter patriarchalny, jednak jego współczesna definicja implikuje równouprawnienie obu płci. Egalitaryzacja dostępu do pełnego obywatelstwa w nowożytnej Europie następowała wieloetapowo. Proces ten wiązał się ze zmianami mentalności społecznej i stopniowym znoszeniem prawnego upośledzenia kobiet w różnych dziedzinach życia.

This paper examines the view that ‘nations’ are natural entities, composed of homogeneous linguistic and cultural groups, and argues that this theory fails to take account of our multiple and overlapping identities.

Author argues that an emerging interest group, especially one that seeks to reverse past discrimination against its predecessors in the public arena, is entitled to enhanced consideration as a means of achieving long denied but merited rights. First this thesis is defended by identifying both practical need and theoretical support for emerging interest groups. Dewey's instrumentalist approach to problem-solving stressed social organization; and under this umbrella he included unionization. First part of this article: his active involvement in and support for the union movement summarized. Second part: his theoretical defense of unions is addressed, especially as to "democratic liberalism" and its implementation in the fabric of society. Third part: a brief account of the current status of unions in universities.
