In this paper we show how a realistic normative democratic theory can work within the constraints set by the most pessimistic empirical results about voting behaviour and elite capture of the policy process. After setting out the empirical evidence and discussing some extant responses by political theorists, we argue that the evidence produces a two-pronged challenge for democracy: an epistemic challenge concerning the quality and focus of decision-making and an oligarchic challenge concerning power concentration. To address the challenges we then (...) put forward three main normative claims, each of which is compatible with the evidence. We start with a critique of the epistocratic position commonly thought to be supported by the evidence. We then introduce a qualified critique of referenda and other forms of plebiscite, and an outline of a tribune-based system of popular control over oligarchic influence on the policy process. Our discussion points towards a renewal of democracy in a plebeian but not plebiscitarian direction: Attention to the relative power of social classes matters more than formal dispersal of power through voting. We close with some methodological reflections about the compatibility between our normative claims and the realist program in political philosophy. (shrink)

To what extent are questions of sovereign debt a matter for political rather than scientific or moral adjudication? We answer that question by defending three claims. We argue that (i) moral and technocratic takes on sovereign debt tend to be ideological in a pejorative sense of the term, and that therefore (ii) sovereign debt should be politicised all the way down. We then show that this sort of politicisation need not boil down to the crude Realpolitik of debtor-creditor power relations—a (...) conclusion that would leave no room for normative theory, among other problems. Rather, we argue that (iii) in a democratic context, a realist approach to politics centred on what Bernard Williams calls ‘The Basic Legitimation Demand’ affords a deliberative approach to the normative evaluation of public debt policy options. Concerned about the harmful effects of pervasive political ignorance, epistocrats argue that we should amplify the political power of politically knowledgeable citizens. But their proposals have been widely criticized on the grounds that they are susceptible to manipulation and abuse. Instead of empowering the knowledgeable, incumbents who control epistocratic institutions are likely to selectively empower their supporters, thereby increasing their share of power. Call this the problem of political capture. In this paper, I argue for two claims. First, I claim (...) that the problem of political capture for epistocracy has been overstated. Incumbents who want to increase their share of power will encounter certain obstacles that complicate the task of capturing the system. Second, however, I claim that if the problem is nevertheless sufficiently serious, it militates against not just epistocracy, but also many other institutions. Politics abounds with bad language: lying and bullshitting, grandstanding and virtue signaling, code words and dogwhistles, and more. But why is there so much bad language in politics? And what, if anything, can we do about it? In this paper I show how these two questions are connected. Politics is full of bad language because existing social and political institutions are structured in such a way that the production of bad language becomes rational. In principle, by modifying these institutions we (...) can reduce the prevalence of bad language. However, as I show, such practical efforts are fraught with difficulties. After first outlining an account of bad language (Section 1), I examine the rationality of three different types of bad language: inaccurate language, insincere language, and unclear language (Section 2). Next, I discuss the possibility of implementing institutional reforms to improve the quality of political discourse (Section 3). However, I then outline and discuss two serious complications for institutional reforms—namely, they create risk of abuse, and they could preclude instances of seemingly bad language that, in fact, are socially beneficial (Section 4). I conclude with some thoughts about how to pursue institutional reform in an appropriately circumspect manner (Section 5). (shrink)

Proponents of epistocracy claim that amplifying the political power of politically knowledgeable citizens can mitigate some of the harmful effects of widespread political ignorance, since being politically knowledgeable improves one’s ability to make sound political decisions. But many critics of epistocracy suggest that we have no reason to expect it to make better decisions than democracy, for those who are politically knowledgeable can also possess other attributes that compromise their ability to make sound political decisions. This is one version of (...) the Demographic Objection to epistocracy, and in this paper I argue that the reasoning which underlies it generalizes in such a way that it applies not only to epistocracy, but also to democracy. Thus, there are demographic objections to both epistocracy and democracy. I argue that such demographic objections to democracy have important and overlooked implications. Among other things, they imply that we should be skeptical about the arguments of epistemic democrats; they count against proposals to democratize extant epistocratic practices and institutions; and they even count against certain democratic reforms taking place within a wholly democratic framework. In recent years the view that the non-instrumental value of democracy is a relational value, particularly relational equality, gained prominence. In this paper I challenge this relational egalitarian version of non-instrumentalism about democracy’s value by arguing that it is unable to establish a strong enough commitment to democracy. I offer an alternative view according to which democracy is non-instrumentally valuable for it establishes relationships of mutual service among citizens by enlisting them in the collective project of ruling the polity justly (...) together which is a self-standing source of value for them. Relating in the mode of mutual service is not a species of relating as equals; it is a distinct relational value. Democracy is uniquely suited to realize this relational value, for it renders citizens co-authors of the fundamental rules of the system of social cooperation under which they live, and only as co-authors of these rules are they able to mutually serve each other in a way that is appropriate within their relationship as citizens of the same polity. For this reason, a strong commitment to democracy can be based on the relational value of mutual service, which therefore better fits the theoretical purposes of non-instrumentalism than relational equality. Four years after the Panama Papers scandal, tax avoidance remains an urgent moral-political problem. Moving beyond both the academic and policy mainstream, I advocate the “democratization of tax enforcement,” by which I mean systematic efforts to make tax avoiders accountable to the judgment of ordinary citizens. Both individual oligarchs and multinational corporations have access to sophisticated tax avoidance strategies that impose significant fiscal costs on democracies and exacerbate preexisting distributive and political inequalities. Yet much contemporary tax sheltering occurs within the (...) letter of the law, rendering criminal sanctions ineffective. In response, I argue for the creation of Citizen Tax Juries, deliberative minipublics empowered to scrutinize tax avoiders, demand accountability, and facilitate concrete reforms. This proposal thus responds to the wider aspiration, within contemporary democratic theory, to secure more popular control over essential economic processes. (shrink)

We set out longtermist political philosophy as a research field by exploring the case for, and the implications of, ‘institutional longtermism’: the view that, when evaluating institutions, we should give significant weight to their very long-term effects. We begin by arguing that the standard case for longtermism may be more robust when applied to institutions than to individual actions or policies, both because institutions have large, broad, and long-term effects, and because institutional longtermism can plausibly sidestep various objections to individual (...) longtermism. We then address points of contact between longtermism and some central values of mainstream political philosophy, focusing on justice, equality, freedom, legitimacy, and democracy. While each value initially seems to conflict with institutional longtermism, we find that these conflicts are less clear-cut upon closer inspection, and that some political values might even provide independent support for institutional longtermism. We end with a grab bag of related questions that we lack space to explore here. (shrink)

This paper contributes to growing debates over the decision-making ability of democracy by considering the epistemic value of deliberative democracy. It focuses on the benefits democratic deliberation can derive from its diversity, and the extent to which these benefits can be realised with respect to the complexities of political problems. The paper first calls attention to the issue of complexity through a critique of Hélène Landemore and the Diversity Trumps Ability Theorem. This approach underestimates complexity due to its reliance on (...) an ‘oracle assumption’ and this is shown to highlight more general difficulties for applying the benefits of diversity to the realities of political problems. The paper then develops a new model of deliberation—based on an relationship between cognitive diversity and diminishing returns to cognitive type—which does not involve an oracle assumption and can therefore support the epistemic value of deliberative democracy even for complex problems. The benefits of diversity are also argued to be better realised though sortition than either democratic elections or epistocracy, pointing to the value of deliberation between randomly selected citizens. Finally, and contrary to past work, the new account suggests that diversity cannot alone establish the superiority of democratic deliberation over all non-democratic alternatives, and that it is insufficient to mount a purely epistemic argument for deliberative democracy. The paper therefore furthers our understanding of the epistemic value of deliberative democracy by clarifying when and to what extent diversity is a benefit to political problem solving. (shrink)

This paper argues that (a) civic constitutionalism is a cohesive body of scholarship (b) it offers a detailed challenge to Hélène Landemore’s account of how to fix democratic politics, while at the same time (c) suggesting how to blend compelling features of Landemore’s approach with a more traditionally-grounded approach (d) consequently, democratic theorists of all sorts should consider becoming civic constitutionalists.

This paper looks at Alexander Guerrero’s epistemic case for ‘lottocracy’, or government by randomly selected citizen assemblies. It argues that Guerrero fails to show that citizen expertise is more likely to be elicited and brought to bear on democratic politics if we replace elections with random selection. However, randomly selected citizen assemblies can be valuable deliberative and participative additions to elected and appointed institutions even when citizens are not bearers of special knowledge or virtue individually or collectively.

Drawing on Bernard Williams's Truth and Truthfulness and Miranda Fricker's Epistemic Justice, this article presents an epistemic argument for democracy on the basis of its ability to incentivize more people to display the virtues of truth required for the social production and aggregation of knowledge. In particular, the article compares democracy respectively with autocracy and epistocracy, showing that it is likely to be, within the context of a modern pluralistic society, an epistemically superior regime in the sense that it creates (...) more favourable conditions for the pooling of epistemic resources. The article concludes with a multi-dimensional framework of democratic legitimacy, where democracy's epistemic value is directly tied with both the safeguard against elite domination and the development of citizens' ethical and intellectual capabilities. In this regard, the article also helps to bridge the gap between epistemic and non-epistemic approaches in democratic theory and unite what might be called the wisdom, power, and virtue of the multitude. In this article, I argue that stability is one of the enabling conditions for epistocratic arrangements to function well and justify their claim right to rule. Against this backdrop, I demonstrate that advocates of strategies to allocate exclusive decision-making power to knowledgeable citizens fail to demonstrate that in a context marked by the fact of pluralism, liberal epistocracies will be stable. They could argue that liberal epistocracies will be stable because epistocratic arrangements are better equipped than democratic decision-making bodies to (...) produce outcomes that approximate the common good. They could argue that liberal epistocracies will be stable because there is a shared meritocratic set of values and ideas. Furthermore, they could opt for two standard liberal strategies, such as overlapping consensus and modus vivendi. Yet, in all cases, the argument for the stability of liberal epistocracies is not persuasive. (shrink)

In this article I argue that including relaxed epistemic values in the justification of democracy through a pragmatist and non-monist approach is compatible with the democratic values of self-rule and pluralism (which are often seen as incompatible with "political truth"). First, I contend that pragmatist epistemology offers a more suitable approach to politics instead of the correspondence theory of finding "the one truth". Secondly, I argue that instead of choosing between monist (purely epistemic or procedural) accounts of justification of democracy (...) we should see epistemic values as part of a hybrid interpretation. Thirdly, I argue that epistemic values in democracy should be interpreted in a non-demanding way. Fourth and corresponding to previous points, I claim weak political cognitivism is phenomenologically most plausible for the democratic participant. I then continue to show that both the values of autonomy and pluralism, which are often considered antithetical to truth-claims, can be accommodated and even enhanced by epistemic values in the justification of democracy. Epistocracy and populism are usually seen as opposites. The first finds error in democracy’s reliance on the sub-optimal decisions by the supposedly incompetent masses, and argues that political decisions should be tied to epistemic merit, not popularity. The populist critique of democracy, contrarily, finds that there is not enough political confrontation in standard representative democracies where the ‘real people’ are not properly embodied, and thus pits an imagined direct will of the unified and virtuous people against a self-serving establishment. This (...) article demonstrates that these ideologies have surprising underlying similarities concerning their categorization, political ontology, epistemology and a conception of political authority. Firstly, they both are second-order political ideologies that are not directly tied with substantive political content but rather with the interpretation of how to govern assuming disagreement concerning first-order political ideologies. Secondly, their political ontology divides citizens into two constitutively differing parts, one of which they (partly) exclude from political membership. Thirdly, their political epistemology assumes the existence of political truths which makes their conception of authority anti-proceduralist, either instrumentalist or moralist. Fourthly, they downplay the value of pluralism, deliberation and dissent. Uncovering these commonalities helps us detect and understand the dynamics of some anti-democratic tendencies better. (shrink)
