Spontaneous freedom, the freedom of unplanned and unscripted activity enjoyed by “free spirits,” is central to everyday talk about “freedom.” Yet the freedom of spontaneity is absent from contemporary moral philosophers’ theories of freedom. This article begins to remedy the philosophical neglect of spontaneous freedom. I offer an account of the nature of spontaneous freedom and make a case for its value. I go on to show how an understanding of spontaneous freedom clarifies the free will debate by helping to (...) make sense of the libertarian claim that compatibilist varieties of freedom do not allow for genuine novelty and creativity. Determinism is frequently understood as implying the possibility of perfect prediction. This possibility then functions as an assumption in the Manipulation Argument for the incompatibility of free will and determinism. Yet this assumption is mistaken. As a result, arguments that rely on it fail to show that determinism would rule out human free will. We explain why determinism does not imply the possibility of perfect prediction in any world with laws of nature like ours, since it would be impossible for (...) an agent to predict with certainty any future event that is causally influenced by events outside her own backward light cone yet inside the backward light cone of the future event. This is the _light-cone limit_ and it undermines the Manipulation Argument or limits what this argument can tell us about the relevance of determinism to free will. We also respond to objections that the light-cone limit is irrelevant to the Manipulation Argument. (shrink)

The aim of this paper is to explain why creativity is an artistic merit. Artworks and non-artworks can both be creative. But creativity does not help make many other creative things good of their kind. A creative explanation is not a better explanation in virtue of being creative. Why, then, is a creative artwork a better artwork in virtue of being creative? Understanding this will give us a better understanding of the nature of artistic merit. The approach adopted in this (...) paper is as follows. First, I say what creativity is and what an artistic merit is. Second, I identify reasons to doubt that creativity is an artistic merit. A good explanation of the merit of creativity should address these doubts. Third, I develop a theory of artistic merit that appeals to the final value of acting excellently – for example, virtuously or skilfully. Finally, I argue that this enables us to explain why creativity is an artistic merit. This account also enables us to argue that artistic merits give some things final value, and not merely instrumental value. It also provides reason to believe that ethical qualities of artworks enhance their artistic merit for the same reason creativity does. (shrink)

As neuroscience progresses, we will not only gain a better understanding of how our brains work, but also a better understanding of how to modify them, and as a result, our mental states. An important question we are faced with is whether the state could be justified in implementing such methods on criminal offenders, without their consent, for the purposes of rehabilitation and reduction of recidivism; a practice that is already legal in some jurisdictions. By focusing on a prominent type (...) of view of free action, which I call bypassing views, this paper evaluates how such interventions may negatively impact the freedom of their subjects. The paper concludes that there will be a tension between the goals of rehabilitation and reduction of recidivism, on the one hand, and the negative impact such interventions may have on free action, on the other. Other things equal, the better that a particular intervention is at achieving the former, the more likely it is to result in the latter. (shrink)

Alfred Mele presents an influential argument for incompatibilism which compares an agent, Ernie, whose life has been carefully planned by the goddess Diana, to normal deterministic agents. The argument suggests both that Ernie is not free, and that there is no relevant difference between him and normal deterministic agents in respect of free will. In this paper, I suggest that what drives our judgement that Ernie is not free in the Diana case is that his actions are merely an extension (...) of Diana's—he is akin to a tool, which she uses solely for her own purposes, and his behaviour occurs only because of the interest Diana takes in its occurring. This contrasts with normal deterministic universes, in which normal agents are not such tools. (shrink)

One type of soft-line reply to manipulation arguments, which I call ‘the another-agent reply’, focuses on the existence of some controlling agent and how this can undermine the actor's moral responsibility. A well-known challenge to this type of reply is the so-called ‘machine induction’ case. This paper provides an argument for why ‘machine induction’ presents no real challenge to the another-agent reply. It further argues that any soft-liner who does not leave room for the existence of some controlling agent in (...) their explanation of why manipulation undermines responsibility will face a dilemma. Thus, instead of presenting a challenge to the another-agent reply, ‘machine induction’ actually presents a reason in support of it. (shrink)

The main aim of this article is to give this point a more detailed development than it has previously received. Prior attempts to make this point have targeted particular libertarian accounts but cannot be generalized. By contrast, I provide an appropriately modified manipulation that targets all libertarian (...) accounts of freedom and responsibility—an especially tricky task given that libertarian accounts are a motley set. I conclude that if manipulation arguments reveal any theoretical cost then it is one borne by all accounts according to which we are free and responsible, not by compatibilism in particular. The philosophy of mind concerns much about how novelty occurs in the world. The very recent progress in this field inspired by quantum mechanics indicates that symmetry restoration occurs in the mind at the moment when new creative thought arises. Symmetry restoration denotes the moment when one’s cognition leaves ordinary internalized mental schemes such as conceptual categories, heuristics, subjective theories, conventional thinking, or expectations. At this moment, fundamentally new, original thought may arise. We also predict that in older age, symmetry (...) restoration is less likely to occur as internalized mental schemes become more rigid in the elderly. Furthermore, the present study demonstrates that symmetry restoration may occur not only individually, in one’s mind, but also collectively, during collaborative creative activities, e.g. during small-group brainstorming sessions or creative improvisational performances. The possibility of collective symmetry restoration interacts well with the ideas in the field of relational ontology. Relational ontology highlights an important ontological role of relations. The ontological primacy is not given to individual entities, as in traditional metaphysics, but to relational structures and transformative relational processes (interactions). When accepting this assumption, we cannot imagine the situation when the actor’s mind could act absolutely independently and leave all of its relations as assumed in the compatibilist theory of free will. We argue that creative free action can be performed even in the case when the actor is entangled within their material, environmental, and social relational structures. (shrink)

We propose an original response to Derk Pereboom’s four-case manipulation argument. This response combines a hard-line and a soft-line. Like hard-liners, we insist that the manipulated agent is blameworthy for his wrongdoing. However, like soft-liners, we maintain that there is a difference in blameworthiness between the manipulated agent and the non-manipulated one. The former is less blameworthy than the latter. This difference is due to the fact that it is more difficult for the manipulated agent to do the right thing. (...) We explain how we can make sense of this notion of difficulty in terms of Fischer and Ravizza’s notion of reasons-responsiveness. (shrink)

In this paper, I articulate an argument for incompatibilism about moral responsibility and determinism. My argument comes in the form of an extended story, modeled loosely on Peter van Inwagen’s “rollback argument” scenario. I thus call it “the replication argument.” As I aim to bring out, though the argument is inspired by so-called “manipulation” and “original design” arguments, the argument is not a version of either such argument—and plausibly has advantages over both. Most seem to presume that what is threatening about manipulation arguments is the ‘no difference’ premise – that is, the claim that there are no responsibility-relevant differences between a manipulated agent and her merely causally determined counterpart. This presumption underlies three recent replies to manipulation arguments from Kearns (2012), King (2013), and Schlosser (2015). But these replies fail to appreciate the true threat from manipulation arguments – namely, the manipulation cases that are allegedly counterexamples to the leading compatibilist conditions on (...) moral responsibility. This paper argues that if there is a counterexample to all the leading compatibilist conditions on moral responsibility then this is sufficient to undermine compatibilism. (shrink)

Alfred Mele’s zygote argument is widely considered to be the strongest version of the manipulation argument against compatibilism (about free will and determinism). Opponents have focused largely on the first of its two premises and on the overall dialectic. My focus here will be on the underlying thought experiment—the Diana scenario—and on the second premise of the argument. I will argue that reflection on the Diana scenario shows that the second premise does not hold, and we will see that my (...) objection to the second premise helps to defend the claim that manipulation arguments face, in general, a dilemma. In this paper, we identify a class of responses to cases of manipulation that we label manipulator-focused views. The key insight of such views is that being subject to the will of another agent significantly affects our freedom and moral responsibility. Though different authors take this key insight in different directions, and the mechanics of their views are quite different, these views turn out to share many key components, and this allows us to discuss several authors’ views at the same (...) time, highlighting a variety of challenges for such views and helping to identify pitfalls to avoid in further developments of views of this type. Moreover, as we survey manipulator-focused views and the challenges that plague them, we go beyond the typical problem cases for such views—natural force variations of manipulation cases—and introduce several new manipulation cases. We conclude by comparing the prospects for this family of views with its main rival, namely bypassing views. (shrink)

In discussions on moral responsibility for actions, a commonly discussed case is one in which an agent is manipulated into performing some action. On some views, such agents lack responsibility for those actions partly because they issue from attitudes that were acquired in an inappropriate way. In this paper, it is argued that such views are in need of revision. After introducing a new problematic case of a manipulated agent, revisions are offered for specific views. Many of us have experienced a peculiar feeling of freedom, of the world being open before us. This is the feeling that is captured by phrases like “the freedom of the open road” and “free spirits,” and, to quote Phillip Larkin, “free bloody birds” going “down the long slide / To happiness, endlessly.” This feeling is associated with the ideas that my life could go in many different directions and that there is a vast range of things that I could (...) become. It arises in concert with a wide range of human experiences, including experiences of artistic creation, play, fun, and resistance to authority. This freedom of openness and spontaneity, which I call spontaneous freedom, is central to our ordinary talk about freedom. Yet it is a phenomenon largely ignored in discussions of freedom in contemporary moral philosophy. This is because moral philosophers are primarily concerned to identify the sort of freedom that is a prerequisite for moral responsibility, and so focus on deliberate, voluntary action rooted in rational choice. When moral philosophers do discuss spontaneous freedom, it is often to disparage it as, in the words of Harry Frankfurt, the freedom of “the wanton” whose liberty is merely that of “anarchic impulsive behavior.” My dissertation develops a theory of spontaneous freedom and of the role it does and should play in our lives, including our moral and political lives. I argue that, to do full justice to the human aspiration for freedom, moral and political theory must recognize the value of spontaneity. Through a study of characters from stories and films by Virginia Woolf, Saki, Akira Kurosawa, and Aman Sethi, I develop a phenomenological account of the nature of spontaneous freedom. I argue that we experience spontaneous freedom when we experience our actions as arising out of ourselves but not fixed in advance either by the decisions of other agents or by our own preexisting commitments or plans. I further argue that spontaneous freedom is valuable because it allows for the distinctive pleasure of feeling that one’s life is unforetold and that one is among the sources of novelty in the world, a feeling that is central to artistic creativity. It also affords solace from the anxiety associated with the inevitability of death. As with many experiences, like falling in love or seeing an alpine lake, experiences of spontaneous freedom are most valuable when they are veridical. But even the subjective experience of spontaneous freedom, I suggest, activates our awareness of and openness to possibility. Achieving this awareness, at least on occasion, is valuable because it provides us with a sense of our own psychological potential and sharpens a skill that contributes to practical deliberation. My claim that spontaneous freedom is valuable conflicts with a popular account of the self. According to that account—endorsed by a number of moral philosophers but most famously associated with Christine Korsgaard—the ideal self is one that is well-ordered, actively constituted through rational deliberation. Such integrity theories of the self are attractive because they provide an account of agency according to which ideal moral agents invariably endorse their own actions and beliefs. Integrity theories view freedom as involving rational, deliberative control of one’s actions. But I argue that integrity theories forbid well-constituted moral agents to seek out experiences of spontaneous freedom: such agents must act in a manner that they antecedently and reflectively endorse, while spontaneous freedom requires acting in a manner not antecedently fixed by one’s own decisions. Insofar as spontaneous freedom is a kind of freedom that we do and should value, my account exerts pressure on this standard view of agency and the self. My account of spontaneous freedom also has important political implications. One version of liberal theory holds that the only sort of political freedom worth having is the freedom of each individual to effectively exercise choice compatibly with every other individual doing likewise. On this picture, I have all of the freedom that I could want if I am able to choose autonomously and act in accordance with my choices. But I argue that a community that secures this liberal variety of freedom does not yet provide its members with all the freedom for which people rightly yearn. When public and private institutions arrange our circumstances in ways that make the courses of our lives predictable, our own choices about how to act may be largely settled by the plans and decisions of other agents. This in turn makes it difficult for us to regard our futures as open in the way that is characteristic of experiences of spontaneous freedom. States should promote spontaneous freedom by providing the material and social preconditions for us to feel that our lives could head in radically different and unanticipated directions. (shrink)

Some compatibilists have responded to the manipulation argument for incompatibilism by proposing an historical theory of moral responsibility which, according to one version, requires that agents be morally responsible for having their pro-attitudes if they are to be morally responsible for acting on them. This proposal, however, leads obviously to an infinite regress problem. I consider a proposal by Haji and Cuypers that addresses this problem and argue that it is unsatisfactory. I then go on to propose a new solution (...) inspired by the libertarian theory of Robert Kane. (shrink)

According to deliberation compatibilism, rational deliberation is compatible with the belief that one’s actions are causally determined by factors beyond one’s control. This paper offers a counterexample to recent accounts of rational deliberation that entail deliberation compatibilism. The counterexample involves a deliberator who believes that whichever action she performs will be the result of deterministic manipulation. It is further argued that there is no relevant difference between the purported counterexample and ordinary doxastic circumstances in which a determinist deliberates.

Some proponents of compatibilist moral responsibility have proposed an historical theory which requires that agents deploy character control in order to be morally responsible. An important type of argument for the character control condition is the manipulation argument, such as Mele’s example of Beth and Chuck. In this paper I show that Beth can be exonerated on various conditions other than her failure to execute character control—I propose a new character, Patty, who meets these conditions and is, I argue, morally (...) responsible for her actions despite lacking character control. Thus the character control condition is unmotivated. I suggest there may be an alternative basis for an historical theory of moral responsibility nonetheless. (shrink)

We use recent interventionist theories of causation to develop a compatibilist account of causal sourcehood, which provides a response to Manipulation Arguments for the incompatibility of free will and determinism. Our account explains the difference between manipulation and determinism, against the claim of Manipulation Arguments that there is no relevant difference. Interventionism allows us to see that causal determinism does not mean that variables outside of the agent causally explain her actions better than variables within the agent, whereas the causal (...) source of a manipulated agent’s actions instead lies outside of the agent in the intentions of the manipulator. As a result, determined agents can have free will and be morally responsible in a way that manipulated agents cannot, contrary to what Manipulation Arguments conclude. In this way, our account demonstrates not only how Manipulation Arguments fail but also how compatibilism can be strengthened by means of a plausible account of causal sourcehood. (shrink)

In the theoretical literature on moral responsibility, one sometimes comes across cases of manipulated agents. In cases of this type, the agent is a victim of wholesale manipulation, involving the implantation of various pro-attitudes (desires, values, etc.) along with the deletion of competing pro-attitudes. As a result of this manipulation, the agent ends up performing some action unlike any that she would have performed were it not for the manipulation. These sorts of cases are sometimes thought to motivate historical views (...) of responsibility, on which the agent’s past is relevant to whether she is responsible for a specific action. In a recent paper, Daniel Sharp and David Wasserman bring these theoretical discussions on moral responsibility to bear on practical issues regarding neurological modifications of individuals. After proposing and arguing for a historical view, Sharp and Wasserman offer some insight into how such a view may help us in determining the responsibility of subjects who have undergone Deep Brain Stimulation. This paper aims to join this discussion, by arguing that the correct historical view to be applied will also appeal to the agent’s control over her mental life and the fact that this was bypassed. I conclude with some brief comments on the practical implications of such a historical view. (shrink)

In the final chapter of her Causation and Free Will, Carolina Sartorio offers a novel reply to an original-design argument for the thesis that determinism is incompatible with free will and moral responsibility, an argument that resembles Alfred Mele’s zygote argument in Free Will and Luck. This article assesses the merits of her reply. It is concluded that Sartorio has more work to do if she is to lay this style of argument to rest.

Manipulation arguments aim to show that compatibilism is false. Usually, they aim to undermine compatibilism by first eliciting the intuition that a manipulated agent is not morally responsible. Patrick Todd's (2012) Moral Standing Manipulation Argument instead aims to first elicit the intuition that a manipulator cannot blame her victim. Todd then argues that the best explanation for why a manipulator cannot blame her victim is that incompatibilism is true. In this paper, I present three lines of defence against this argument (...) for those who agree a manipulator cannot blame her victim. (shrink)

This article identifies and assesses a way of thinking that might help to explain why some compatibilists are attracted to what is variously called an internalist, structuralist, or anti-historicist view of moral responsibility—a view about the bearing of agents’ histories on their moral responsibility. Scenarios of two different kinds are considered. Several scenarios feature heavy-duty manipulation that radically changes an agent’s mature moral personality from admirable to despicable or vice versa. These “radical reversal” scenarios are contrasted with a scenario featuring (...) “original design”: a supernatural designer determines exactly how an agent’s life will go before the agent comes into existence. It is explained why scenarios of these two different kinds generate very different challenges to compatibilism. Partly in light of that explanation, it is argued that the way of thinking at issue is misguided. (shrink)
