In 1704, Mary Astell, known by many scholars as the “first English feminist,” published Moderation Truly Stated, her contribution to the national debate over “occasional conformity.” This was the practice of periodic participation in the sacraments of the Church of England—above all, taking communion—in order to become eligible for public office. This practice was defended as an exercise of the virtue of “moderation,” viewed as the opposite of zeal and associated with politeness and reasonableness. In this article I recover Astell’s (...) critique on this new notion of moderation, as well as her own alternative conception of the virtue of moderation as scripture moderation, which she envisioned as zeal and indifference towards the right ends. My aim is threefold. First, to explore the dangers of conceiving of moderation as an “antidote to zeal,” which Astell argued would be detrimental to truth, salvation, and moral progress. Second, to demonstrate that her own conception of moderation as zeal and indifference towards the right ends was a radical subversion of the discourse on moderation at the time. Third, to shed light on the role of the Occasional Conformity debate in the transformation of moderation from a Christian virtue of temperance and control into a “modern” virtue construed as politeness and opposed to zeal, which was to become dominant in eighteenth-century England. The classical liberal doctrine of free expression asserts the priority of speech as an extension of the freedom of thought. Yet its critics argue that freedom of expression, itself, demands the suppression of the so-called “silencing speech” of racists, sexists, and so on, as a threat to the equal expressive rights of others. This essay argues that the claim to free expression must be distinguished from claims to equal speech. The former asserts an equal right to express one’s thoughts without (...) interference; the latter the right to address others, and to receive a hearing and consideration from them, in turn. I explore the theory of equal speech in light of the ancient Athenian practice of isegoria and argue that the equality demanded is not distributive but relational: an equal speaker’s voice should be counted as “on a par” with others. This ideal better captures critics’ concerns about silencing speech than do their appeals to free expression. Insofar as epistemic and status-harms provide grounds for the suppression and exclusion of some speech and speakers, the ideal of equal speech is more closely connected with the freedom of association than of thought. Noticing this draws attention to the continuing—and potentially problematic—importance of exclusion in constituting effective sites of equal speech today. (shrink)

This article argues that Thomas Hobbes' analysis of insult or ‘contumely’ prefigures recent developments in moral and political philosophy in striking ways. Specifically, Hobbes's concerns about the dignitary harms in hate speech went well beyond ‘fighting words’ to the essential role played by expressions of hatred and contempt in making and unmaking social hierarchies. Hobbes’s sensitivity to contumely’s subtle power to constitute social in/equalities recalls recent work in feminist and critical race theory. Yet his expansive solutions – both negative and (...) positive, legal and ethical – also shed light on the difficulties faced by aspirationally egalitarian societies in their efforts to eradicate contempt today. In this article we examine Kant’s understanding of toleration by including a study of all instances in which he directly uses the language of toleration and related concepts. We use this study to resolve several key areas of interpretative dispute concerning Kant’s views on toleration. We argue that Kant offers a nuanced and largely unappreciated approach to thinking about toleration, and related concepts, across three normative spheres: the political, the interpersonal and the personal. We examine shortcomings in earlier interpretations and (...) conclude by arguing that the theme of toleration in Kant’s work, while coherent and important, is neither as central nor as peripheral as suggested by previous interpretations. Further, while Kant is critical of the arrogance of toleration in the political sphere, he is more positive toward the role of toleration in the interpersonal and personal spheres since it promotes virtue. Although it is commonplace for political scientists to draw upon historical thinkers and the ‘great books’ of the past, the practice of using historical works as reference points for contemporary issues remains under-investigated. To address this practice, this article is positioned at the crossroads of social science and intellectual history. By examining the relationship of political economists Elinor and Vincent Ostrom with Alexis de Tocqueville, the article demonstrates some of the potential risks incurred by social scientists drawing on historical thinkers. (...) After exploring the similarities between the Ostroms and Tocqueville, it identifies three key pitfalls of the Ostroms’ ‘Tocquevillian’ rhetoric. These pitfalls result in obscuring meaning and overlooking philosophical insights, both of which detract from the Ostroms’ project. Insights from the field of intellectual history are offered. A final section presents a key example of Vincent Ostrom overlooking Tocqueville's thought where Tocqueville's insights were directly applicable to his work. Anger dominates debates in the public sphere. In this article I argue that there are diverse forms of anger that merit different responses. My focus is especially on two types of anger that I label respectively arrogant and resistant. The first is the characteristic defensive response of those who unwarrantedly arrogate special privileges for themselves. The second is often a source of insight and a form of moral address. I detail some discursive manifestations of these two types of anger. I (...) show that arrogant anger is responsible for attempts to intimidate and humiliate others with whom one disagrees. Whilst resistant anger can be intimidating, it is also essential in communicating moral demands. (shrink)

In this paper I argue that social networking sites (SNSs) are emotion technologies that promote a highly charged emotional environment where intrinsic emotion regulation is significantly weakened, and people's emotions are more strongly modulated by other people and by the technology itself. I show that these features of social media promote a simplistic emotional outlook which is an obstacle to the development and maintenance of virtue. In addition, I focus on the mechanisms that promote group-based anger and thus give rise (...) to affective polarisation. In the final section, after a discussion of the positive value of some forms of anger, I argue that SNSs should not be designed to prohibit or suppress anger, but that its encouragement should also be avoided. A prevailing understanding of realism, chiefly among its critics, casts realists as those who seek a ‘distinctively political normativity’, where this is interpreted as meaning nonmoral in kind. Moralists, on this account, are those who reject this and believe that political normativity remains moral. Critics have then focused much of their attention on demonstrating that the search for a nonmoral political normativity is doomed to fail which, if right, would then seem to fatally undermine the realist endeavour. This paper makes (...) the case that casting the difference between realism and moralism in these terms is a mistake, one which overlooks the substantial body of realist work which is clear that it has no such aspirations to develop a nonmoral political normativity. The hope is that in drawing attention to this mistake a line can be drawn under these unhelpful debates, and we can move on to more fruitful constructive and critical discussions between realists and their critics. Should animal advocates be allowed to publicly display graphic footage of how animals live (and die) in industrial animal use facilities? Cube of truth (‘cube’) demonstrations are a form of animal advocacy aimed at informing the public about the realities of animals’ experiences in places such as slaughterhouses, feedlots, and research facilities, by showing footage of mostly lawful practices within these workplaces. Activists engaging in cube-style protests have recently been targeted by law enforcement agencies in two Australian states on the (...) basis that the footage on display was too offensive to be shown in public. In this paper, I argue that these justifications do not stand up to scrutiny. Using an original politics of sight analysis, this paper demonstrates how the democratic costs associated with targeting cube protests outweigh the costs to the public. Cube activists are engaging in public dialogue by drawing attention to sites of potential injustice, and are playing an important role in highlighting the agency of the animals involved in exploitative industries. I further make the case that, where such demonstrations fall foul of the law, they should be regarded as legitimate acts of civil disobedience. (shrink)

This article addresses two questions: How should a ‘practical political theory’ approach the ideological struggle between advocates of critical social justice and defenders of free speech? And, what does this conflict tell us about the deficits of one particular tradition of practical political theory — namely, agonistic democracy? The paper’s purpose, then, is to illuminate a concrete contemporary phenomenon through the lens of agonistic theory and, conversely, to use this struggle as an impetus to carve out and address weaknesses in (...) the theory of agonism.I defend an ‘agonistic approach’ to the struggle against two alternatives — first, the claim that there is, conceptually, no ‘real’ conflict between social justice and free speech, and second, the strategy to ‘take sides’ in the conflict. By taking seriously the agonistic core idea that struggle and conflict can be valuable and productive expressions of plurality and inclusivity, I argue that this struggle should be approached as an agonistic conflict — as the welcome and important expression of a diversity of views on central social, moral and political questions.I also show, however, how retaining the focus on the real-life struggle between advocates of critical social justice and free-speech sheds light on the inconsistencies of much agonistic thought. In particular, I will criticize those agonists who limit their conception of the ‘agon’ to respectful struggles, and those who see the agon merely as a tool of emancipation for oppressed groups. Against these visions of agonism, I develop an anti-perfectionist, yet radical, account of agonism with the potential to serve as a guide in complex social and political conflicts. (shrink)

It is common to criticize certain comments as ‘unhelpful’. This criticism is richer than it might first appear. In this paper, I sketch an account of conversational helpfulness and unhelpfulness, the reasons why they matter, and the utility of calling out comments as helpful or unhelpful. First, some unhelpful comments are or easily could be demoralizing for proponents of projects, and criticizing them as such can diminish, deflect, or defend against that demoralization. Second, some unhelpful comments redirect or derail conversations (...) away from their projects and criticizing comments as unhelpful can steer conversations back. Third, some unhelpful comments are made out of a lack of epistemic effort and criticizing them as such can help maintain epistemic standards, standards of respect for other people and their projects, and can ensure that such comments do not receive more attention and consideration than they deserve. This article explores the relationship between medicine’s history and its digital present through the lens of the physician-patient relationship. Today the rhetoric surrounding the introduction of new technologies into medicine tends to emphasize that technologies are disturbing relationships, and that the doctor-patient bond reflects a more ‘human’ era of medicine that should be preserved. Using historical studies of pre-modern and modern Western European medicine, this article shows that patient-physician relationships have always been shaped by material cultures. We discuss three activities (...) – recording, examining, and treating – in the light of their historical antecedents, and suggest that the notion of ‘human medicine’ is ever-changing: it consists of social attributions of skills to physicians that played out very differently over the course of history. I have a very particular reason to be grateful to Stewart Sutherland, our late President, which is connected to some of the themes of this lecture, so want to begin by recalling a long conversation I had with him on these topics.

The English Revolution saw fierce controversy over religious toleration. While this controversy was usually associated with parliamentarians and Puritans, major contributions to the debate were also made by a few thinkers from the royalist side: Jeremy Taylor and Thomas Hobbes. Despite their prominence in the toleration debate, however, the intellectual context of the English Revolution in which their distinctive views of toleration were formed remains unclear apart from Hobbes’s association with the Independents. Here, I suggest the potential importance of Taylor (...) and Hobbes for understanding each other. While studies of Hobbes and Taylor have developed in relative isolation from each other, I show that their views of toleration have various features in common, and that these features are rarely found in their celebrated predecessor William Chillingworth or in major Puritan tolerationists. In several key respects, moreover, Hobbes and Taylor were more similar than Hobbes and the Independents. This research also helps to clarify the contribution to the toleration controversy at that time by the two leading thinkers. Furthermore, the similarities between Taylor and Hobbes, as shown in this paper, may contribute to better understanding the reception of Hobbes in the Restoration toleration debate. (shrink)

The term “toleration”—from the Latin tolerare: to put up with, countenance or suffer—generally refers to the conditional acceptance of or non-interference with beliefs, actions or practices that one considers to be wrong but still “tolerable,” such that they should not be prohibited or constrained. There are many contexts in which we speak of a person or an institution as being tolerant: parents tolerate certain behavior of their children, a friend tolerates the weaknesses of another, a monarch tolerates dissent, a church (...) tolerates homosexuality, a state tolerates a minority religion, a society tolerates deviant behavior. Thus for any analysis of the motives and reasons for toleration, the relevant contexts need to be taken into account. (shrink)

Thomas Hobbes tells us that he wrote Leviathan to “absolve the divine laws” of the charge that they justify rebellion. This article interprets the argumentative strategy of the second half of Leviathan in light of this intention. Over the course of his three major political works, Hobbes develops a convergent argument to absolve God’s laws. This strategy of judicial rhetoric relies on using multiple independent claims in the hope that one’s audience finds at least one of them persuasive. This was (...) a risky strategy for Hobbes that angered his critics. The strategy also reveals something about what sort of philosopher Hobbes was and how we ought to approach his work. (shrink)

ABSTRACT In recent years, progressive activists around the world have fought to remove ‘problematic’ commemorations – typically, monuments commemorating and honoring individuals responsible for injustice, or even unjust events. Many of these problematic commemorations are vandalized before they are eventually removed. In this essay, I consider how the vandalism of problematic commemoration can transform the public honoring of a target, to a public repudiation or humiliation of that target. Maria Márkus took special interest in the concept of civil society that was revived by East European dissidents and incorporated it into her account of the fundamental ideals of modernity. Modern societies were civil to the extent that they possessed a ‘public sphere’ that incorporated structures and mechanisms of action and communication able to form, articulate and press the interests and needs of the society on public agencies; and to defend them, if the state ignores or seeks to override them. (...) This article discusses the relationships in her thought between civility, civil society and decency. She sees the first as a condition for the second, but not a part of it, while decency is both an accomplishment and attribute of a civil society in good shape. For her, a decent society is the ideal to strive for, a civil society the way to get there, civility a necessary step toward civil society, and therefore too for a decent one, but not a huge step. This article suggests that civility deserves more than the lukewarm approval Maria bestowed upon it. In particular, the piece tries in some measure to bridge the gap she saw between civility, on the one hand, which she appreciated in a kind of ‘two cheers’ way, and civil and decent societies, on the other, which received her full (and fully warranted) three-cheers. The defection thesis holds that members of marginalized social groups are obligated not to express views important to others in the group that are regarded by the others as substantively wrong. In this essay, I evaluate arguments that seek to vindicate the defection thesis and conclude they all fail. Then, I argue that we have reason to believe sanctioning defectors in certain ways is wrongful and that the expression of their contentious ideas is good for members of marginalized groups. We (...) are left to conclude both that members of marginalized groups have no obligation to suppress certain heterodox views and that it is likely wrong to sanction them for expressing these views even if it were wrong for them to do so. The question of how to respond to the deep political divides in the United States today has resulted in the emergence of two camps. On one side are those who argue that the cultivation of civic virtues like civility will lead to more respectful interpersonal relationships through which consensus and mutual understanding can be built. On the other are those who argue that our commitment to justice is primary and may require uncivil behavior to disrupt and change unjust structural relationships. (...) In Healthy Conflict in Contemporary American Society, Jason Springs helps to bridge the divide between these two positions. Because he takes a relational approach that centers both interpersonal and structural relationships, Springs makes both mutual respect and just structures central to his conception of healthy conflict. Taking relationality seriously thus helps to overcome this impasse, but it also raises significant questions about the impact of asymmetrical relationships on citizens’ responsibilities to engage in healthy conflict. Most comparisons of Thomas Hobbes and Baruch Spinoza focus on the difference in understanding of natural right. We argue that Hobbes also places more weight on a rudimentary and exclusive education of the public by the state. We show that the difference is related to deeper disagreements over the prospect of Enlightenment. Hobbes is more sanguine than Spinoza about using the state to make people rational. Spinoza considers misguided an overemphasis on publicly educating everyone out of superstition—public education is important, (...) but modes of superstition may remain and must be offset by institutions and a civil religion. The differences are confirmed by Spinoza’s interest in the philosopher who stands apart and whose flourishing may be protected, but not simply brought about, by rudimentary public education. Spinoza’s openness to a wisdom-loving elite in a democracy also sets up an interesting parallel with Thomas Jefferson’s own commitment to the natural aristocracy needed to sustain republicanism. In demonstrating the 17th century philosopher’s skepticism toward using the state exclusively to promote rationality, even as he recognizes the importance of a sovereign pedagogical role and the protection of philosophy, we move to suggest that Spinoza is relevant to contemporary debates about public education and may reinvigorate moral and political discourse in a liberal democracy. One of the positive ways in which argumentation can improve political thinking is through providing definitions. We can establish definitions through argumentation, filtering out ideas that are irrelevant or unacceptable, and collecting features that offer a comprehensive understanding of a crucial concept. In this paper, we use argumentation to illuminate the concept of extremism. We proceed in this way: first, we discuss the relationship between argumentation and definitions. Second, we look at the current state of affairs by exploring contemporary definitions (...) of “extremism” and by identifying several problems in the definition literature. Third, we assume the burden of proof in providing a definition that avoids problems we have identified. Fourth, we discuss other closely-associated concepts and their definitions—terrorism, radicalism, and fundamentalism, explaining how these concepts are distinct from our definition of extremism. The term “priestcraft” became fashionable in the 1690s. This essay explores its use among the anti-clericals in John Locke’s circle and examines the critique of priestcraft in his own Reasonableness of Christianity (1695). The commentaries and church histories, in correspondence and published treatises, of Benjamin Furly, William Popple, Damaris Masham, William Stephens, and Sir Robert Howard are examined. The Lockean circle remained committed to Christian revelation and, for the most part, to a reformed Church of England, and it is argued (...) that it is a mistake to identify the critique of priestcraft exclusively with deism and the subversion of Christianity. The polemical critique of the priestly deformations of Christianity, though often scabrously hostile to clergies, served equally the ecclesiastical and political causes of post-Revolution latitudinarian Anglicanism. *Runner-up for the 2021 Royal Institute for Philosophy Essay Prize*: What should we think about ‘acts of conscience’, viz., cases where our personal judgments and public authority come into conflict such that principled resistance to the latter seems necessary? Philosophers mainly debate two issues: the Accommodation Question, i.e., ‘When, if ever, should public authority accommodate claims of conscience?’ and the Justification Question, i.e., ‘When, if ever, are we justified in engaging in acts of conscience – and why?’. By contrast, a (...) third important topic – the Conduct Question, i.e., ‘How should we act, morally speaking, when engaging in acts of conscience?’ – has been mostly neglected. This paper aims to offer concrete guidance for persons wishing to engage in acts of conscience in morally virtuous ways. I argue that such agents are subject to two basic prima facie duties: duties to oneself related to demands of integrity and duties to others related to demands of civility. I explain both duties in detail, arguing with regard to, that in light of what I call ‘the paradox of conscience’, we need to rethink our views about both ‘conscience’ and ‘integrity’; and with regard to, that, building upon Rawls’ ‘duty of civility’, we should embrace at least seven general principles for undertaking acts of conscience in a morally conscientious manner. University administrators should not enforce speech codes because speech codes are generally counterproductive to a university’s educational mission. In making the case against campus speech codes, we consider and reply to four of the most prominent arguments in favor of restricting student speech. These arguments appeal to the values of harm prevention, inclusive education, relational equality, and the overall promotion of free speech. We show that speech restrictions do not effectively promote these values. We conclude that campus administrators should uphold (...) protections for freedom of expression on college campuses in order to promote a more egalitarian and inclusive learning environment. This chapter examines two ways in which liberal thinkers have appealed to claims about disagreement in order to defend a principle of free speech. One argument, from Mill, says that free speech is a necessary condition for healthy disagreement, and that healthy disagreement is conducive to human flourishing. The other argument says that in a community of people who disagree about questions of value, free speech is a necessary condition of legitimate democratic government. We argue that both of these arguments, (...) in their standard guises, are premised upon contestable views about the realpolitik of disagreement in a liberal society. (shrink)

This chapter considers the challenges to, and the resources for, cultivating a personal capacity for tolerance, given a Spinozist account of belief-formation. After articulating two main components of personal tolerance, I examine the features of Spinoza’s theory of cognition that make the cultivation of tolerance so difficult. This is followed by an analysis of Spinoza’s account of overcoming intolerant tendencies. Ultimately, I argue that the capacity of individuals to be tolerant depends crucially on the establishment of conditions of trust, conditions (...) that are conspicuously lacking in many modern democracies. How might discourse generate political change? So far, democratic theorists have focused largely on how deliberative exchanges might shift political opinion. Responding to empirical research that casts doubt on the generalizability of deliberative mechanisms outside of carefully designed forums, this essay seeks to broaden the scope of discourse theory by considering speech that addresses participants’ identities instead. More specifically, we ask what may be learned about identity-oriented discourse by examining the practice of religious preaching. As we demonstrate, scholars of homiletics—the (...) study of preaching—have identified three core features that support its focus on identity: its unconditionality, its appeal to authoritative texts and traditions, and its diffuse instrumentality. We then ask what each of these features might look like in more straightforwardly political contexts. Finally, we address several normative questions raised by this practice, as a way of exploring the promises and dangers accompanying identity-oriented discourse more generally. (shrink)

Thomas Hobbes contends that a wise sovereign would censor books and limit verbal discourse for the majority of citizens. But this article contends that it is consistent with Hobbes’s philosophy to claim that a wise sovereign would allow a small number of citizens – those individuals who engage in scientific discourse and who are magnanimous and just – to disagree freely amongst themselves, engaging in discourse on controversial topics. This article reflects on Hobbes’s contention that these individuals can tolerate one (...) another’s differences and engage in verbal disagreement without any risk to the commonwealth. By engaging in open discourse, these individuals can better create valuable technology and provide counsel to the sovereign that is necessary to maintain peace. (shrink)
