Penelope Maddy has recently addressed the set-theoretic multiverse, and expressed reservations on its status and merits ([Maddy, 2017]). The purpose of the paper is to examine her concerns, by using the interpretative framework of set-theoretic naturalism. I first distinguish three main forms of 'multiversism', and then I proceed to analyse Maddy's concerns. Among other things, I take into account salient aspects of multiverse-related mathematics , in particular, research programmes in set theory for which the use of the multiverse seems to (...) be crucial, and show how one may provide responses to Maddy's concerns based on a careful analysis of 'multiverse practice'. In recent years an increasing quantity of UK legislation has introduced blended or ‘hybridised’ procedures that blur the previously clear demarcation between civil and criminal legal processes, typically on the grounds of normatively-motivated political expediency. This paper provides a critical perspective on instances of procedural hybridisation in order to illustrate that, first, the reliance upon civil law measures to remedy criminal law infractions can raise human rights issues and, second, that such instrumental criminal justice strategies deliberately circumvent the enhanced procedural (...) protections of the criminal law. By conceptualising the rule of law as a structural coupling between the political and legal systems, and due process rights as necessary and self-imposed limitations upon systemic operations, this paper employs a systems-theoretical approach to critique this balancing act between expediency and principle, and queries the circumstances under which legislation contravening the rule of law can be said to lack legitimacy. Context: Many recent research areas such as human cognition and quantum physics call the observer-independence of traditional science into question. Also, there is a growing need for self-reflexivity in science, i.e., a science that reflects on its own outcomes and products. Problem: We introduce the concept of second-order science that is based on the operation of re-entry. Our goal is to provide an overview of this largely unexplored science domain and of potential approaches in second-order fields. Method: We provide the (...) necessary conceptual groundwork for explorations in second-order science, in which we discuss the differences between first- and second-order science and where we present a roadmap for second-order science. The article operates mainly with conceptual differentiations such as the separation between three seemingly identical concepts such as Science II, Science 2.0 and second-order science. Results: Compared with first-order science, the potential of second-order science lies in 1. higher levels of novelty and innovations, 2. higher levels of robustness and 3. wider integration as well as higher generality. As first-order science advances, second-order science, with re-entry as its basic operation, provides three vital functions for first-order science, namely a rich source of novelty and innovation, the necessary quality control and greater integration and generality. Implications: Second-order science should be viewed as a major expansion of traditional scientific fields and as a scientific breakthrough towards a new wave of innovative research. Constructivist content: Second-order science has strong ties with radical constructivism, which can be qualified as the most important root/origin of second-order science. Moreover, it will be argued that a new form of cybernetics is needed to cope with the new problems and challenges of second-order science. (shrink)

El concepto de memoria social es una de las categorías que más relevancia adquirió en la producción teórica de Niklas Luhmann en los últimos años de su vida. Tal concepto se encuentra, en una buena parte, inspirado en la memory fuction descripta por el matemático inglés George Spencer Brown. La memoria social pretende dar cuenta de un rendimiento de memoria propio de la sociedad, independiente de las memorias de los sistemas psíquicos y neurofisiológicos. En este trabajo se abordará el tema (...) críticamente, poniendo atención en la operatividad de la memoria social, para poder observar a qué preguntas responde. Además, se analizará detenidamente el tipo de apropiación que hace Luhmann de la función de oscilador y memoria tomada de Spencer Brown, evaluando la consistencia de tal decisión. También será de suma importancia estimar si el sociólogo alemán arriba a una teoría de la memoria social capaz de desprenderse de la metáfora del almacén o depósito, tal como él dice haberlo hecho al proponer esta formulación.The concept of social memory is between those categories, which acquired more relevance in Niklas Luhmann’s theoretic production in the last years of his life. This concept is largely inspired in the memory function depicted by the English mathematician George Spencer Brown. Social memory tries to account for the own memory performance of society, which is independent from the memories of the psychic and neurophysiologic systems. This paper deals critically with this topic, focusing the attention on the operativity of the social memory, in order to observe to which questions it can answer. In addition, it will be carefully analyzed how Luhmann utilizes the Spencer Brown’s oscillator and memory functions, so to evaluate the consistency of Luhmann’s decision to include these concepts in his theory. It will also be of great importance to estimate if the German sociologist develops a theory of social memory with the capacity to get rid of the storage metaphor, as he expected to have done with this formulation. C.H. Waddington’s concepts of ‘chreods’ (canalized paths of development) and ‘homeorhesis’ (the tendency to return to a path), each associated with ‘morphogenetic fields’, were conceived by him as a contribution to complexity theory. Subsequent developments in complexity theory have largely ignored Waddington’s work and efforts to advance it. Waddington explained the development of the concept of chreod as the influence on his work of Alfred North Whitehead’s process philosophy, notably, the concept of concrescence as a self-causing process. Processes were recognized (...) as having their own dynamics, rather than being explicable through their components or external agents. Whitehead recognized the tendency to think only in terms of such ‘substances’ as a bias of European thought, claiming in his own philosophy ‘to approximate more to some strains of Indian, or Chinese, thought, than to western Asiatic, or European, thought.’ Significantly, the theoretical biologist who comes closest to advancing Waddington’s research program, also marginalized, is Mae-Wan Ho. Noting this bias, and embracing Whitehead’s and Waddington’s efforts to free biology from assumptions dominating Western thought to advance an ontology of creative causal processes, I will show how later developments of complexity theory, most importantly, Goodwin’s work on oscillations, temporality and morphogenesis, Vitiello’s dissipative quantum brain dynamics, Salthe’s work on hierarchy theory, biosemiotics inspired by Peirce and von Uexküll, Robert Rosen’s work on anticipatory systems, together with category theory and biomathics, can augment while being augmented by Waddington’s work, while further advancing Mae-Wan Ho’s radical research program with its quest to understand the reality of consciousness. Autopoietic theory is increasingly seen as a candidate for a radical theory of law, both in relation to its theoretical credentials and its relevance in terms of new and emerging forms of law. An aspect of the theory that has remained less developed, however, is its material side, and more concretely the theory’s accommodation of bodies, space, objects and their claim to legal agency. The present article reads Luhmann’s theory of autopoietic systems in a radical and material manner, linking it (...) on the one hand to current post-structural theorisations of law and society, and on the other hand extending its ambit to accommodate the influx of material considerations that have been working their way through various other disciplines. The latter comprises both a materialisation of the theory itself and ways of conceptualising the legal system as material through and through. This I do by further developing what I have called Critical Autopoiesis, namely an acentric, topological, post-ecological and posthuman understanding of Luhmann’s theory, that draws on Deleuzian thought, feminist theory, geography, non-representational theory, and new material and object-oriented ontologies. These are combined with some well-rehearsed autopoietic concepts, such as distinction, environment and boundaries; Luhmann’s earlier work on materiality continuum; more recent work on bodies and space; as well as his work on form and medium in relation to art. The article concludes with five suggestions for an understanding of what critical autopoietic materiality might mean for law. (shrink)

The article inquires into the uneasiness of sociological systems theory about culture. Culture alternatively is called the solution to the problem of double contingency (Parsons) and removed from this solution (Luhmann). It is shown that meaning is the more basic term whose description reveals a form rule of social systems which is only patterned, yet not understood by culture. Culture is a memory and control device of society. It may be conceived of as providing the distinction of correct versus incorrect (...) behaviour. But who decides on the correctness or incorrectness of this distinction? Sociological thinking takes off where the cultural and the social are distinguished. (shrink)

Recent debates about aesthetics are characterized by a partly intentional, but also partly involuntary, vagueness. Whether it be aestheticisation or anesthetisation, articisation or desartification: what is upheld or deplored under one and the same label in fact designates rather different things. The paper makes a suggestion as to how the field could be reorganized. Taking heed of what political theory discusses as the “political difference” between “politics” and “the political”, the aim is to examine what would be gained by working (...) with an “aesthetic difference” that does not straightforwardly equate “the aesthetic” with “art”, and “the aesthetic” with the totality of sensuous-aisthetic processes. An aesthetic thinking would then amount to a thinking that does justice to these inner polarities and remains faithful to the ambiguity of its objects. (shrink)

This sustained and distinctively Buddhist challenge to the ontology of Jean-Paul Sartre's Being and Nothingness resolves the incoherence implicit in the Sartrean conception of nothingness by opening to a Buddhist vision of emptiness. Rooted in the insights of Madhyamika dialectic and an articulated meditative (zen) phenomenology, Nothingness and Emptiness uncovers and examines the assumptions that sustain Sartre's early phenomenological ontology and questions his theoretical elaboration of consciousness as "nothingness." Laycock demonstrates that, in addition to a "relative" nothingness (the for-itself) defined (...) against the positivity and plenitude of the in-itself, Sartre's ontology requires, but also repudiates, a conception of "absolute" nothingness (the Buddhist "emptiness"), and is thus, as it stands, logically unstable, perhaps incoherent. The author is not simply critical; he reveals the junctures at which Sartrean ontology appeals for a Buddhist conception of emptiness and offers the needed supplement. (shrink)

By advocating an enlightened method of theorizing committed to thinking in terms of a system of differences, Luhmann has contributed to the development of sociology in a manner that cannot be praised enough. Nonetheless, he does not succeed in giving an account of his own position that satisfies the very logical preconditions that he himself has formulated for it. Instead, his systems theory paradigm of sociology is based on metaphysical premises characteristic of the identity-logical thought of "Old Europe." In this article an epistemological framework is proposed in order to integrate the emergentist thought with systemic studies on biological autonomy, which are focused on the role of organization. Particular attention will be paid to the role of the observer’s activity, especially: (a) the different operations he performs in order to identify the pertinent elements at each descriptive level, and (b) the relationships between the different models he builds from them. According to the approach sustained here, organization will be considered (...) as the result of a specific operation of identification of the relational properties of the functional components of a system, which do not necessarily coincide with the intrinsic properties of its structural constituents. Also, an epistemological notion of emergence—that of “complex emergence”—will be introduced, which can be defined as the insufficiency, even in principle, of a single descriptive modality to provide a complete description of certain classes of systems. This integrative framework will allow us to deal with two issues in biological and emergentist studies: (1) distinguishing the autonomy proper of living systems from some physical processes like those of structural stability and pattern generation, and (2) reconsidering the notion of downward causation not as a direct or indirect influence of the whole on its parts, but instead as an epistemological problem of interaction between descriptive domains in which the concept of organization proposed and the observational operations related to it play a crucial role. Niklas Luhmann verwendet in seiner soziologischen Systemtheorie offenbar etwas, das er den Büchern des englischen Mathematikers George Spencer Brown entnimmt. Dessen Formenkalkül ist für Luhmann, wie Günther Schulte treffend bemerkt, “Mädchen für alles, mit dem er nicht nur in der Lage ist Teezukochen, sondern auch Auto oder Straßenbahn zu fahren”. Der erste Blick in Spencer Browns Laws of Form vermittelt einen anderen Eindruck: nichts scheinen sie mit soziologischer Systemtheorie zu tun zu haben. Der vorliegende Text bearbeitet hieran anknüpfend eine recht (...) bescheidene Frage, die sich gleichwohl jedem Luhmann-Leser schon einmal gestellt haben dürfte: Was wollen die Laws of Form und was will Luhmann mit ihnen? Als Antwort ergibt sich, nach Zurückverfolgung der relevanten Fußnoten, eine gute und eine schlechte Nachricht. Die schlechte Nachricht ist, daß die Lektüre der Laws of Form offenbar niemandem wirklich weiterhelfen kann, auch Luhmann selbst nicht. Die gute ist folglich, daß dem Luhmann-Leser die Notwendigkeit erspart bleibt, einen so dunklen, weil sparsamen Kalkül zu verstehen. Das meiste nämlich, was Luhmann den Laws of Form angeblich entnimmt, steht auf den zweiten Blick nicht darin. Er wird es also ohnehin durch andere Texte begründen müssen. (shrink)

In the article, we elaborate an interdisciplinary methodological framework that enables us to study and prepare the grounds for the development of organizational practices through discourse perspectives. The framework differs from mainstream monological and complexity reducing tendencies within organizational studies in that it argues for an approach that takes in historical, broad, and situational power relations and discourses into consideration when we engage in ethical organizational development. We place the framework within organizational discourse studies (ODS) and discuss how the intersection (...) of Bakhtinian and Foucauldian ideas and concepts, as well as their diverse analytical strategies and focuses, contributes to the field. The combination entails taking a dissensus approach to organizational discursive phenomena that we view as dynamic features that are historically and locally (re)created through battles of unifying (centripetal) and diversifying (centrifugal) force relations. Following similar ideas of Deleuze and Bakhtin, we argue that dialogue and every (organizational) situation is seen as a plurivocal, open-ended, and unique time-space in which subjects have agency to change and transform the power relations and lines of subjectification that they are embedded in. We arrive at a methodological framework that bridges the gulf that often exists between discourse perspectives that tend to either focus on situated or more abstract and historical discursive dimensions. Furthermore, the frame involves an ethics of dispositif and dialogue that insists that organizational discourse scholars engage in organizational discourse activism furthering local change processes. This paper proposes a social account for the origin of the truth value and the emergence of the first declarative sentence. Such a proposal is based on two assumptions. The first is known as the social intelligence hypothesis: that the cognitive evolution of humans is first and foremost an adaptation to social demands. The second is the function-first approach to explaining the evolution of traits: before a prototype of a new trait develops and the adaptation process begins, something already existing (...) is used for a new purpose. Applied to the emergence of declarative sentences, this suggests something already existing—natural signs (which have a logical or causal relation to what they denote)—were used for the declarative function and thereby integrated (in the form of indexical objects implying a past action) into communication. I show that the display of an indexical object (such as the display of hunting trophies) can imply a conceptual structure similar to that informing the syntax of sentences. The view developed in this paper is broadly consistent with the argumentative theory of Mercier and Sperber, which suggests that reasoning is less adapted to decision making than to social purposes such as winning disputes or justifying one’s actions. In this paper I extend this view to the origin of the concept of truth. According to my proposal, the first declarative sentence (articulated in a simple sign language) emerged as a negation of a negation of an implicit statement expressed by the display of an indexical object referring to a past action. Thereby, I suggest that the binary structure of the truth value underlying any declarative sentence is founded on disagreements based on conflicts of interest. Thus, I deny that the concept of truth could have evolved for instrumental reasons such as solving problems, or through self-questioning about what one ought to believe. (shrink)

The word “real” (from the Latin “res” = thing) was coined in the 13th century to signify “having Properties” (Pierce. 1958, p. 358), whereas a “model” refers to an analogical representation, the structure of which should correspond to the structure or properties of that which it represents. For Scudder the mind is a system of models and each mind develops different models. We all have a different reality in mind and so we each live in a slightly different world (Scudder, (...) 1975). Hence the real nature of the model and the model nature of reality are often indistinguishable. A snail, for example, when exposed to four tactile stimuli per second (with a rod on his belly) will be compelled to crawl upon that non-existing coherent spatial surface (Brecher, 1966). For the snail four tactile stimuli per second correspond to, or are isomorphic with, the structure of a spatial surface, but it is impossible for the snail to “know” which of the two structures is real. The paper deals with the changes in the sense of synchronicity and simultaneity connected with the transformations in the structure of society. It examines and criticizes the modern concept of absolute chronology, understood as an objective temporal reference common to all observers. This notion is compared with the relative and flexible (but neither objective nor generalizable) forms of synchronization of different societies. The paper discusses finally the hypothesis that contemporary society is realizing a more complex and recursive form of temporality, (...) that questions the modern ideal of synchronicity.
