Neuroenhancements have the potential to dramatically increase our intelligence, memory, motivation, and attention, to name a few ways such technology can benefit us. But can neuroenhancements increase our moral status as well? I argue in the affirmative. A higher moral status than personhood is both possible and likely given advancements in neuroenhancements. Some have argued that personhood is the highest moral status possible, so the notion of a post-person is conceptually confused. I respond by presenting an inductive argument with the (...) conclusion that a higher moral status than personhood is both possible and likely, given the potential of neuroenhancements. While making my argument I confront the inexpressibility problem, the claim that we cannot give an account of what a higher moral status than personhood would be like. I conclude the paper with an answer to the inexpressibility challenge, by suggesting an account of a higher moral status than personhood. (shrink)

:Recent years have seen an increase of interest on the part of human rights theorists in the “supply-side” of human rights, i.e., in the duties or obligations correlative to human rights. Nevertheless, faced with the practically urgent and seemingly simple question of who owes the duties related to international human rights, few human rights theorists provide an elaborate answer. While some make a point of fitting the human rights practice and hence regard states as the sole human rights duty-bearers merely (...) by referring to that practice, others criticize the “state-centric” approach to human rights duty-bearers and expand the scope of the latter to include any international institution beyond the state and even private actors. Curiously, however, even those more expansive accounts of human rights duty-bearers are usually very evasive about why it should be so and especially how it should work. The time has come to broach anew the issue of the bearers of human rights duties, and responsibilities of international institutions in human rights theory, addressing two challenges: focusing on relational and directed human rights duties specifically and not on duties of global justice in general, thereby distinguishing between human rights duty-bearers and other bearers of responsibilities for human rights, on the one hand, and accounting for and justifying the point of international human rights law and practice in this respect, thereby also securing internal arguments for reform, on the other. The essay’s argument is four-pronged. It starts with a few reminders about the relational nature of human rights and the relationship between human rights and duties and what this means for the specification of human rights duties. It then focuses more specifically on the identification of human rights duty-bearers, i.e., states and international institutions of jurisdiction like the European Union, and the allocation of human rights duties to them. The third section of the article is devoted to the concurrent moral responsibilities for human rights that are incurred by other various responsibility-bearers outside institutions of jurisdiction. In the final section, the essay considers the revolution potential of the EU’s fast-developing human rights’ duties, and discusses the normative implications of the development of universal international institutions’ human rights duties stricto sensu for international law and politics more generally. This chapter reviews recent philosophical and neuroethical literature on the morality of moral neuroenhancements. It first briefly outlines the main moral arguments that have been made concerning moral status neuroenhancements. These are neurointerventions that would augment the moral status of human persons. It then surveys recent debate regarding moral desirability neuroenhancements: neurointerventions that augment that the moral desirability of human character traits, motives or conduct. This debate has contested, among other claims (i) Ingmar Persson and Julian Savulescu’s contention that there (...) is a moral imperative to pursue the development of moral desirability neuroenhancements, (ii) Thomas Douglas’ claim that voluntarily undergoing moral desirability neuroenhancements would often be morally permissible, and (iii) David DeGrazia’s claim that moral desirability neuroenhancements would often be morally desirable. The chapter discusses a number of concerns that have been raised regarding moral desirability neuroenhancements, including concerns that they would restrict freedom, would produce only a superficial kind of moral improvement, would rely on technologies that are liable to be misused, and would frequently misfire, resulting in moral deterioration rather than moral improvement. In his 1993 article ‘The Coming Technological Singularity: How to survive in the posthuman era’ the computer scientist Virnor Vinge speculated that developments in artificial intelligence might reach a point where improvements in machine intelligence result in smart AI’s producing ever-smarter AI’s. According to Vinge the ‘singularity’, as he called this threshold of recursive self-improvement, would be a ‘transcendental event’ transforming life on Earth in ways that unaugmented humans are not equipped to envisage. In this paper I argue Vinge’s idea (...) of a technologically led intelligence explosion is philosophically important because it requires us to consider the prospect of a posthuman condition succeeding the human one. What is the ‘humanity’ to which the posthuman is ‘post’? Does the possibility of a posthumanity presuppose that there is a ‘human essence’, or is there some other way of conceiving the human-posthuman difference? I argue that the difference should be conceived as a historically emergent disconnection between individuals, not in terms of the presence or lack of essential properties. I also suggest that these individuals should not be conceived in narrow biological terms but in ‘wide’ terms permitting biological, cultural and technological relations of descent between human and posthuman. Finally, I consider the ethical implications of this metaphysics of the posthuman. If, as I claim, the posthuman difference is not one between kinds but between individuals, we cannot specify its nature a priori but only a posteriori. Thus the only way to evaluate the posthuman condition would be to witness the emergence of posthumans. The implications of this are somewhat paradoxical. We are not currently in a position to evaluate the posthuman condition. Since there are no posthumans, the condition of posthumanity is not defined. However, posthumans could result from some iteration of our current technical activity, so we have an interest in understanding what they might be like. It follows that we have an interest in making or becoming posthumans. (shrink)

Responding to several leading ideas from a paper by Allen Buchanan, the present essay explores the implications of genetic enhancement for moral status. Contrary to doubts expressed by Buchanan, I argue that genetic enhancement could lead to the existence of beings so superior to contemporary human beings that we might aptly describe them as post-persons. If such post-persons emerged, how should we understand their moral status in relation to ours? The answer depends in part on which of two general models (...) of moral status—one based on respect and one based on interests—is more adequate. Buchanan tentatively argues that a respect-based model is preferable. I challenge Buchanan's view, along these lines: If we embrace a respect-based model of moral status featuring a threshold that divides persons, who are thought to have full and equal moral status, from sentient nonpersons, thought to have less moral status, then we should acknowledge a second threshold and a level of moral status higher than ours. A better option, I tentatively suggest, is to drop the idea of levels of moral status, accept that all sentient beings have moral status, and allow that some differences in interests and capacities justify some significant differences in how we should treat beings of different kinds. Several authors have speculated that (1) the pharmaceutical, genetic or other technological enhancement of human mental capacities could result in the creation of beings with greater moral status than persons, and (2) the creation of such beings would harm ordinary, unenhanced humans, perhaps by reducing their immunity to permissible harm. These claims have been taken to ground moral objections to the unrestrained pursuit of human enhancement. In recent work, Allen Buchanan responds to these objections by questioning both (1) and (2). (...) I argue that Buchanan’s response fails. However, I then outline an alternative response. This response starts from the thought that, though moral status-increasing human enhancements might render ordinary, unenhanced humans less immune to permissible harm, they need not worsen the overall distribution of this immunity across beings. Synthetic biologists aim to generate biological organisms according to rational design principles. Their work may have many beneficial applications, but it also raises potentially serious ethical concerns. In this article, we consider what attention the discipline demands from bioethicists. We argue that the most important issue for ethicists to examine is the risk that knowledge from synthetic biology will be misused, for example, in biological terrorism or warfare. To adequately address this concern, bioethics will need to broaden its scope, contemplating (...) not just the means by which scientific knowledge is produced, but also what kinds of knowledge should be sought and disseminated. It is fairly commonplace to think that the capacity for sentience need not be the only basis of moral status. Pluralists contend that moral status is grounded in several other valuable capacities as well as, or instead of, sentience, such as agency, empathy, or sociality. However, this contention contrasts with a standard assumption in animal ethics: that sentience should be the only basis of moral status. This article vindicates that assumption. Whilst classical utilitarians have defended a similar claim about sentience (...) in relation to ultimate value, the merits of this view have gone relatively unnoticed in contemporary debates about moral status and animal ethics. An account based on sentience alone avoids conceptual redundancy and has greater explanatory power than pluralist alternatives. An account of moral status based exclusively on sentience also yields two significant and revisionary implications that have not been recognised. First, the distinction between persons and nonpersons cannot hold, so all moral patients, including nonhuman animals, should feature as primary subjects in ethical theories, public policies, and research agendas. Second, we ought to favour nonhuman interests far more often than we tend to suppose. (shrink)

Dignity is traditionally thought to apply to almost all and almost only humans. However, I argue that an account of a distinctly human dignity cannot achieve a coherent and non-arbitrary justification; either it must exclude some humans or include some nonhumans. This conclusion is not as worrying as might be first thought. Rather than attempting to vindicate human dignity, dignity should extend beyond the human, to include a range of nonhuman animals. Not only can we develop a widely inclusive account (...) of dignity by pursuing this route, but we can still defend the three core principles that lie at the heart of contemporary thinking about dignity: that bearers of dignity possess dignity to an equal degree, in virtue of possessing the same intrinsic worth, and that this generates direct and claimable rights. I thus develop an account of dignity that includes nonhuman animals. I argue that the capacity to value most plausibly grounds dignity. This capacity arises from valenced sentience: a being values insofar as they have experiences that matter to them. I then characterise what follows from this. First, I contend that it is only the capacity to value grounds dignity because this produces the most plausible, simplest, and most explanatorily powerful account of dignity. We ought to reject pluralist accounts which assert a sharp distinction between bearers and non-bearers of rational agency, and biocentric accounts which include non-sentient organic entities. Second, I argue this property grounds an account of dignity that is non-hierarchical. There are no degrees of dignity. Instead, all possessors of the capacity to value have the same kind of intrinsic value, and the same equal fundamental right: to consideration of their interest in leading a life of value. Finally, I argue that since the fundamental right is to consideration, moral agents have claimable duties to engage in a deliberative procedure with actionable requirements. Specific rights are instantiations of this general procedure. Certain revisionist conclusions follow on my view, for instance, that nonhumans should be given greater weight and inclusion in a far wider range of cases, but my account is sensitive to the range of different things different beings value, so it does not generate counterintuitive implications. In this paper, I suggest that, if we are committed to accepting a threshold approach to personhood, according to which all beings above the threshold are persons with equal moral status, there are strong reasons to also recognise a second threshold that would be reached through human pregnancy, and that would confer on pregnant women a temporary superior moral status. This proposal is not based on the moral status of the fetus, but on the moral status of the pregnant woman. (...) It is not only the fetus which is an organism sui generis: the pregnant woman, also, is a unique being. Following almost any view on the moral status of the fetus, the pregnant woman should be regarded, herself, as more than a singular individual. She is, herself, ‘more than one’. Pregnant women are also necessary for the continued survival of the human species, and there are important justice-based reasons to recognise the higher status. Furthermore, the recognition of a superior moral status for pregnant women does not imply that pregnancy should always be viewed as desirable, or imply any position on the permissibility of abortion. My proposal is not as radical as it might seem, as it does not require that pregnant women should always receive superior treatment, but only that they should to some extent. It could have a range of potential positive practical consequences. Finally, my approach does not threaten, but rather promotes, human equality. (shrink)

A central question in contemporary ethics and political philosophy concerns which entities have moral status. In this article, I provide a detailed analysis of the view that moral status comes in degrees. I argue that degrees of moral status can be specified along two dimensions: (i) the weight of the reason to protect an entity’s morally significant rights and interests; and/or (ii) the rights and interests that are considered morally significant. And I explore some of the complexities that arise when (...) we link degrees of moral status to the weight of reasons to protect bundles and/or the content and size of these bundles, in particular regarding the attribution of moral status to nonparadigmatic entities (e.g. people with severe cognitive disabilities, children, embryos and foetuses, robots, non-human animals, ecosystems, and rivers). Gene drive technologies (GDTs) have been proposed as a potential new way to alleviate the burden of malaria, yet have also raised ethical questions. A central ethical question regarding GDTs relates to whether it is morally permissible to intentionally modify or eradicate mosquitoes in this way and how the inherent worth of humans and non-human organisms should be factored into determining this. Existing analyses of this matter have thus far generally relied on anthropocentric and zoocentric perspectives and rejected an individualist (...) biocentric outlook in which all living organisms are taken to matter morally for their own sake. In this paper, we reconsider the implications of taking a biocentric approach and highlight nuances that may not be evident at first glance. First, we shortly discuss biocentric perspectives in general, and then outline Paul Taylor’s biocentric theory of respect for nature. Second, we explore how conflicting claims towards different organisms should be prioritised from this perspective and subsequently apply this to the context of malaria control using GDTs. Our ethical analysis shows that this context invokes the principle of self-defence, which could override the pro tanto concerns that a biocentrist would have against modifying malaria mosquitoes in this way if certain conditions are met. At the same time, the case study of GDTs underlines the relevance of previously posed questions and criticism regarding the internal consistency of Taylor’s egalitarian biocentrism. (shrink)

Advocates of the Respect Model of moral status have expressed skepticism about the possibility that radically enhanced persons will have a higher threshold of moral status over non-radically enhanced persons. While several philosophers have already argued that advocates of the Respect Model of moral status should recognize such a possibility in a world with radically enhanced persons, I make room for a stronger claim: advocates of the Respect Model of moral status should not only recognize the possibility of higher thresholds (...) of moral status, but in fact are committed to the normative view that radically enhanced persons should have a higher threshold of moral status over non-radically enhanced persons. This stronger claim induces both rational and self-interested worries about the sacrificeability of non-radically enhanced persons, which takes the form of the inequality of immunity problem. While this problem need not rationally worry the advocate of the Respect Model of moral status, I provide some exploratory solutions that can be implemented now to assuage future self-interested fears so that advocates of the Respect Model may learn to respect the dignity of radically enhanced persons. In her important and well-known discussion “On the Moral and Legal Status of Abortion,” Mary Anne Warren regrets that “it is not possible to produce a satisfactory defense of a woman’s right to obtain an abortion without showing that the fetus is not a human being, in the morally relevant sense.” Unlike some more cautious philosophers, Warren thinks that we can definitively demonstrate that the fetus is not a person. In this paper, Warren’s argument is critically examined with a focus (...) especially on the question of the foundation and the boundaries of the moral community. The fundamental thesis of the paper is that Warren’s approach is flawed for at least four reasons: (1) that being a person is not as obviously central to having full moral rights as Warren assumes, (2) that her exclusivism regarding moral status has dubious moral consequences independent of the abortion issue, (3) that it is not clear that a fetus is not a person, even on Warren’s own criteria, and (4) her criteria for personhood are themselves suspect. Most philosophical accounts of human rights accept that all persons have human rights. Typically, ‘personhood’ is understood as unitary and binary. It is unitary because there is generally supposed to be a single threshold property required for personhood. It is binary because it is all-or-nothing: you are either a person or you are not. A difficulty with binary views is that there will typically be subjects, like children and those with dementia, who do not meet the threshold, and so who (...) are not persons with human rights, on these accounts. It is consequently unclear how we ought to treat these subjects. This is the problem of marginal cases. I argue that we cannot resolve the problem of marginal cases if we accept a unitary, binary view of personhood. Instead, I develop a new non-binary personhood account of human rights, and defend two main claims. First, there are many, scalar properties, the having of which are conducive to personhood. Second, different subjects have different human rights depending on which of these properties they have, and what threats apply to them. On my view, and contra most existing accounts, most marginal cases have some degree of personhood and are entitled to some human rights. (shrink)

Should we cognitively alter animals in ways that might change their moral status? There has been some discussion of this question. For example, Chan (2009) and Chan and Harris (2001) consider whether we should radically enhance the cognitive capacities of animals, while Thompson (2008) and Shriver (2009) argue that we should in fact substantially disenhance some animals to protect them from suffering. More controversially, some have countenanced radical and possibly moral status-altering transformations of human persons. ... One question relevant to (...) all of these discussions is whether it is good for a being to have moral status; whether a being’s moral status contributes to its wellbeing or (as I take to be equivalent) has prudential value for that being. Nicholas Agar, Jeff McMahan and Allen Buchanan have all expressed concerns about enhancing humans far outside the species-typical range. They argue radically enhanced beings will be entitled to greater and more beneficial treatment through an enhanced moral status, or a stronger claim to basic rights. I challenge these claims by first arguing that emerging technologies will likely give the enhanced direct control over their mental states. The lack of control we currently exhibit over our mental lives greatly contributes to our (...) sense of vulnerability. I then argue moral status should be viewed in terms of vulnerability. The enhanced will slowly gain the ability to command their mental states, reducing their vulnerability. These radically enhanced beings will have greater capacities, and possibly an inner life more valuable than our own. They will also be less vulnerable, and as a result, their moral status will be subordinate to our own. (shrink)

Humans are morally deficient in a variety of ways. Some of these deficiencies threaten the continued existence of our species. For example, we appear to be incapable of responding to climate change in ways that are likely to prevent the consequent suffering. Some people are morally better than others, but we could all be better. The price of not becoming morally better is that when those events that threaten us occur, we will suffer from them. If we can prevent this (...) suffering from occurring, then we ought to do so. That we ought to make ourselves morally better in order to prevent very bad things from happening justifies, according to some, the development and administration of moral enhancement. I address in this paper the idea that moral enhancement could give rise to moral transhumans, or moral post-persons. Contrary to recent arguments that we shouldn’t engender moral post-persons, I argue that we should. Roughly, the reasons for this conclusion are that we can expect moral post-persons to resemble the morally best of us, our moral exemplars. Since moral exemplars promote their interests by promoting the interests of others (or they promote others’ interests at the expense of their own) we can expect moral post-persons to pursue our interests. Since we should also pursue our own interests, we should bring about moral post-persons. (shrink)

과학 기술의 발달은 포스트 인간 시대의 도래를 예고하고 있다. 포스트휴먼 시대에 대한 우려는 인간이 통제 할 수 없을 것이라 생각하는 새 시대 자체에 대한 염려인 동시에 인류가 가치절하 될 시기에 대한 두려움을 담고 있다. 비관론자들은 다양한 논의를 통해 인간의 도덕성과 존엄성의 가치가 훼손될 수 있다는 점을 지적한다. 또 실제로 이러한 문제는 현실성 있는 논의이기도 하다. 그렇다면, 인간과 포스트휴먼이 공존해야 하는 근거는 인간만이 가진 도덕적 능력에 기대어 해소할 수 있는가? 이 논문은 포스트휴먼 시대의 인간의 지위에 대한 고찰의 방향성에 대해 고민하면서 다음 (...) 세 가지 문제를 중심으로 논의를 주도한다. 첫째, 브라이도티의 논의를 바탕으로 포스트휴먼의 시대의 도래가 휴머니즘의 어떤 문제들을 해결할 수 있기에 진보한 시대인가를 논의한다. 둘째 포스트휴먼 시대에 인간과 포스트휴먼의 공존의 가능성에 대해 논의한다. 특히 인간의 도덕적 지위에 의거하여 포스트휴먼과 인간의 공존의 정당성을 확보할 수 있는가를 중심으로 포스트휴먼시대의 도덕에 관한 주요 논쟁들을 살펴본다. 셋째, 포스트휴먼시대의 인간의 지위에 대한 논의는 도덕적 지위에 대한 논의로 해결될 수 없고, 이 논의는 인간의 고유한 사유 능력인 상상력에 대한 고찰에서부터 다시 제기되어야 한다고 주장할 것이다. 논자는 상상력에 대한 논의로부터 포스트휴먼시대의 인간의 고유성과 존엄성이 재검토되어야 한다고 생각한다. 인식적 능력과 도덕적 능력에 기인하여 진행되어왔던 기존의 논의들로는 포스트휴먼시대에서의 인간의 고유성을 담아낼 수 없다. 이에 이 논문은 포스트휴먼시대의 인간의 가치에 대한 논의가 상상력에 대한 고찰로부터 다시 시작되어야 한다고 주장한다. The use of the concept of moral status is commonplace today in debates about the moral consideration of entities lacking certain special capacities, such as nonhuman animals. This concept has been typically used to defend the view that adult human beings have a status higher than all those entities. However, even those who disagree with this claim have often accepted the idea of moral status as if it were part of an undisputed received way of thinking in ethics. This paper (...) argues that the use of this concept, however common, distorts our understanding of how to behave towards different individuals in different circumstances. When moral status is identified with the interest in living or the capacity for well-being, it becomes an arbitrary and irrelevant criterion. When it is used as a synonym of moral consideration or considerability, in a way that is compatible with the principle of equal consideration, it becomes trivial and confusing. When used, instead, to defend the unequal moral consideration of interests of equal weight, it has several implausible implications. In particular, the claim that unequal status is justified because of the value of cognitive capacities implausibly entails that our exercising those capacities should have priority over the promotion of our wellbeing. The idea of full moral status is also problematic as it implies the possibility of status monsters. In addition, its use is based in a misconceived way of what it would really entail to have a full status by virtue of having rational capacities. The paper concludes that we have strong reasons to abandon the concept of moral status altogether. (shrink)

Biomedical moral enhancement, or BME for short, aims to improve people’s moral behaviors through augmenting, via biomedical means, their virtuous dispositions such as sympathy, honesty, courage, or generosity. Recently, it has been challenged, on particularist grounds, however, that the manifestations of the virtuous dispositions can be morally wrong. For instance, being generous in terrorist financing is one such case. If so, biomedical moral enhancement, by enhancing people’s virtues, might turn out to be counterproductive in terms of people’s moral behaviors. In (...) this paper, we argue, via a comparison with moral education, that the case for the practice of biomedical moral enhancement is not weakened by the particularists’ stress on the variable moral statuses of the manifestations of our virtues. The real challenge from the particularists, we argue, lies elsewhere. It is that practical wisdom, being essentially context-sensitive, cannot be enhanced via biomedical means. On the basis of this, we further argue that BME ought to be used with great caution, for it may wrongly enhance, for instance, a terrorist financier’s generosity, a robber’s courage, or an undercover detective’s honesty. Finally, we sketch how boundaries can be set on the use of BME, and address some potential objections to our position. (shrink)

One of the most consequential advances in sciences and technology is the increasing generation of bodily enhancement products that enable a culture of, demand for, and acceptance of improving and modifying the human body (structure, function, abilities) beyond its species-typical boundaries. A lively discourse exists around the rights and wrongs of human genetic and other forms of enhancement. Many treat the species-typical human body as an obsolescent technology in need of serious improvements. This raises various questions. This paper addresses the (...) following questions: a) can one refuse the upgrade, b) who has access to the upgrade, c) is there a way to revert to the obsolescent state after the upgrade, and d) what is the impact of perceiving oneself as obsolescent. This essay examines how biocentric positions assess the aims and planned products of synthetic biology. In this emerging field, scientists and engineers aim at designing and producing new life forms by various procedures. In this paper I explore whether, for biocentrists, 1) synthetic organisms have moral standing and, 2) the process of synthesising living organisms has moral implications. Because naturalness plays a role in some biocentric theories, synthetic biology — at first sight — seems to challenge the idea that all (...) living organisms have moral standing. However, according to the interpretations that I offer, the biocentric positions discussed here would also assign moral standing to synthetic organisms. That living organisms have moral standing does not necessarily imply that it is morally problematic to synthesise them. However, different lines of biocentric argumentation suggest that in designing and synthesising living organisms, the moral standing of the product needs to be taken into account. This means among other things, that according to biocentrists, such procedures may lead to special responsibilities or require certain attitudes from scientists towards their products. (shrink)

This paper presents arguments for two claims. First, post-persons, beings with a moral status superior to that of mere persons, are possible. Second, it would be bad to create such beings. Actions that risk bringing them into existence should be avoided. According to Allen Buchanan, it is possible to enhance moral status up to the level of personhood. But attempts to improve status beyond that fail for want of a target - there is no category of moral status superior to (...) that of personhood. Buchanan presents personhood as a threshold. He allows that persons may succeed in enhancing their cognitive and physical powers but insists that they cannot enhance their moral status. I argue that it is an implication of accounts that make a cognitive capacity, or collection of such capacities, constitutive of moral status, that those who do not satisfy the criteria for a given status find these criteria impossible to adequately describe. This obstacle notwithstanding, I offer an inductive argument for the existence of moral statuses superior to personhood, moral statuses that are necessarily beyond human expressive powers. The second part of this paper presents an argument that it is wrong to risk producing beings with moral status higher than persons. We should look upon moral status enhancement as creating especially morally needy beings. We are subject to no obligation to create them in the first place. We avoid creating their needs by avoiding creating them. (shrink)

David DeGrazia tentatively defends what he calls the Interests Model of moral status (see page 135).1 On this model all sentient beings have the same moral status, though some are owed more than others in virtue of having more or stronger interests. The proponent of this model can accept, say, that one should normally save the life of a human in preference to that of a dog. But she denies that we should save the human because he has higher moral (...) status. Instead, the human should be saved because he has more at stake—he may, for example, have a stronger interest in continued existence. In defending the Interests Model, DeGrazia cuts against the grain of recent theorising on moral status, which has instead favoured what he calls the Respect Model. (shrink)

There is an apparent problem in identifying a basis for equality. This problem vanishes if what I call the ‘intuited response’ is successful. According to this response, there is no further explanation of the significance of the feature in virtue of which an individual matters, beyond the bare fact that it is the feature in virtue of which an individual matters. I argue against this claim, and conclude that if the problem of identifying a basis for equality is to be (...) resolved, it is necessary to defend a substantive account of the independent significance of some feature. Contractarianism is more inclusive than critics (and, indeed, Gauthier) sometimes suggest. Contractarianism can justify equal moral standing for human persons (in some respects) and provide sufficient moral standing for many nonhuman animals to require what we commonly call decent treatment. Moreover, contractarianism may allow that some entities have more moral standing than others do. This does not necessarily license the oppression that liberal egalitarians rightly fear. Instead, it shows that contractarianism may support a nuanced account of moral status.

Many debates in arenas such as bioethics turn on questions regarding the moral status of human beings at various stages of biological development or decline. It is often argued that a human being possesses a fundamental and inviolable moral status insofar as she is a “person”; yet, it is contested whether all or only human beings count as persons. Perhaps there are non-human person, and perhaps not every human being satisfies the definitional criteria for being a person. A further question, (...) which will be the primary focus of this paper, concerns what essential features of personhood endow persons, human or otherwise, with their moral status and the inherent rights they concomitantly possess. A survey of the history of philosophical theorizing on what it means to be a person yields a broad consensus upon the key capacities being rational thought, self-consciousness, and autonomous volition. It is not sufficient, however, simply to cite these capacities, but to explain why these particular capacities bear moral import. A more recent concern has developed regarding the possible future existence of so-called “post-persons” who, due to their enhanced cognitive and emotive capacities, may be morally superior to mere persons and thereby possess a higher moral status. This paper will conclude with an analysis of the extent to which this concern is warranted. (shrink)

The debate over the ethics of radically, technologically altering the capacities and traditional form of the human body is rife with appeals to and dismissals of the importance of the integrity of the human species. Species-integrist arguments can be found in authors as varied as Annas, Fukuyama, Habermas, and Agar. However, the ethical salience of species integrity is widely contested by authors such as Buchanan, Daniels, Fenton, and Juengst. This article proposes a Phenomenological approach to the question of species-integrity, arguing (...) in favor of a phenomenon of species-recognition that carries an ethical pull. Building on Husserl’s Phenomenological account of empathy and the lived-body, as well as Schopenhauer’s concept of compassion as an ethical urphenomenon, I develop a “Phenomenological species concept” , which I argue has the ethical significance that biological species concepts do not. I want to thank all of those who have commented on my article in the Journal of Medical Ethics.1 The commentaries address a wide cross-section of the issues raised in my article. I have organised my responses thematically.The state of playAllen Buchanan's scepticism2 about moral statuses higher than personhood derives, in part, from our apparent inability to describe them. We seem to have little difficulty in imagining what it might be to have scientific understanding far beyond that of any human (...) scientist. By contrast, it is exceedingly difficult to describe moral statuses superior to that of any person. Boosting cognitive capacities seems to result in cognitively superior persons—not post-persons . I offer an explanation of our moral myopia.2 We are necessarily clueless in respect of moral statuses superior to our own. If mice understood practical reasons sufficiently well to truly understand why persons have a moral status superior to their own then they would be capable of the feats of practical reason constitutive of personhood—they would be persons. Our cluelessness about post-persons is compatible both with their possible existence and with their necessary non-existence. I propose an inductive argument for the existence of statuses superior to personhood. The observed existence of many moral statuses up to and including persons provides moderately strong inductive support for the possibility of post-persons.Who do we trust to make decisions about higher moral statuses?What precisely does the inductive argument predict? If my diagnosis of our moral myopia about post-personhood is correct, then mere persons cannot really understand what properties of post-persons give them a superior status. They will be able to infer their existence indirectly by an appeal to the predicted judgments of beings who lack our cognitive limitations. Non-therapeutic performance enhancement in sport is a contentious issue for some time but the issue of therapeutic enhancements has only recently entered the sport vernacular. The purpose of therapeutic assistive devices so far is widely seen as lifting as impaired perceived people back to species-typical norms. However, ?therapeutic? body devices developed to mimic species-typical body structures and expected body functioning, as a side effect, increasingly allow the wearer to outperform the species-typical body in various functions. Unsurprisingly, then, this brings the (...) prospect of people labelled as impaired outperforming the so called non-impaired person in general and the paralympic athlete outperforming Olympic athletes. The ?cheetah? prosthetic legs worn by the South African Paralympic amputee Oscar Pistorius are one example of a ?therapeutic? device that might in the future outperform the species-typical body. Although it does not yet, it has already been labelled as a techno doping device. Others that already outperform are wheelchairs; however, they are rather invisible in the dispute around therapeutic enhancements and sport. This essay highlights various issues attached to this paradigm shift of the ability relationship between disabled and so called non-disabled people, Paralympic and Olympic athletes and what this might mean for Olympism and the Paralympic and Olympic Games. DeGrazia argues that post-persons have as much justification in believing that they have higher moral status than persons as persons have in believing that they have higher moral status than animals. DeGrazia's claim presupposes that what Buchanan calls the “moral equality assumption” is false. This article argues that DeGrazia has given us no reason to disbelieve the moral equality assumption. Further, even if DeGrazia's arguments about moral status were sound, it is unclear that his first-order normative claims about how we (...) should weigh human against animal interests would follow. In a near-future world of bionics and biotechnology, the main ethical and political issue will be the definition of who we are. Could biomedical enhancements transform us to such an extent that we would be other than human? Habermas argues that any genetic enhancement intervention that could potentially alter ‘human nature’ should be morally prohibited since it alters the child’s nature or the very essence that makes the child who he is. This practice also commits the child to a specific (...) life project or, in any case, it puts specific restrictions on his freedom to choose a life of his own. Ultimately, genetic enhancement jeopardizes the very foundations of moral equality. I contend that Habermas’ argument is based either on a series of presuppositions that imply a gross misunderstanding of evolution or the relevant factual information cocerning the action we are about to morally assess is not empirically supported. Hence, the argument from human nature is based on a series of false or problematic assumptions, and, as such, it fails to play the normative role intended by Habermas. (shrink)

A major approach to the ethics of artificial intelligence is to use social choice, in which the AI is designed to act according to the aggregate views of society. This is found in the AI ethics of “coherent extrapolated volition” and “bottom–up ethics”. This paper shows that the normative basis of AI social choice ethics is weak due to the fact that there is no one single aggregate ethical view of society. Instead, the design of social choice AI faces three (...) sets of decisions: standing, concerning whose ethics views are included; measurement, concerning how their views are identified; and aggregation, concerning how individual views are combined to a single view that will guide AI behavior. These decisions must be made up front in the initial AI design—designers cannot “let the AI figure it out”. Each set of decisions poses difficult ethical dilemmas with major consequences for AI behavior, with some decision options yielding pathological or even catastrophic results. Furthermore, non-social choice ethics face similar issues, such as whether to count future generations or the AI itself. These issues can be more important than the question of whether or not to use social choice ethics. Attention should focus on these issues, not on social choice. (shrink)

Transhumanism, the belief that technology can transcend the limitations of the human body and brain, is part of the family of Enlightenment philosophies. As such, transhumanism has also inherited the internal tensions and contradictions of the broad Enlightenment tradition. First, the project of Reason is self-erosive and requires irrational validation. Second, although most transhumanists are atheist, their belief in the transcendent power of intelligence generates new theologies. Third, although most transhumanists are liberal democrats, their belief in human perfectibility and governance (...) by reason can validate technocratic authoritarianism. Fourth, transhumanists are divided on the balance between democracy and the market. Fifth, teleological expectations of unstoppable progress are in tension with awareness of the indeterminacy of the future. Sixth, transhumanists are divided between advocates of ethical universalism and ethical relativism. Seventh, the rational materialist denial of discrete persistent selves calls into question the transhumanist project of individual longevity and enhancement. (shrink)

This essay explores problems of consistency among commonsense beliefs about the comparative moral status of animals, fetuses, and human beings congenitally endowed with cognitive capacities and potential no higher than those of higher animals. The possibility of genetic cognitive enhancement exacerbates some of these problems, but also offers new resources for understanding the basis of our moral status as inviolable.

In the Dune universe, humans relied on computers for thousands of years. Their immense capacity for mathematical calculations made space travel possible, until the Butlerian Jihad ended that era. Humans found the means to cognitively and physically enhance themselves to replace and outmatch intelligent machines by using nootropic drugs, revolutionary training methods, artificial selection, and genetic engineering. There are also moral and social problems that come along with human enhancement technologies. In a society where enhancement is popular, the poor would (...) have fewer chances to succeed in social and economic competitions. Many moral philosophers argue that our freedoms and basic rights are guaranteed by a special moral status, personhood. Nicholas Agar has proposed that post‐personhood could be seen as the end of a continuum of intelligence and reasoning abilities. The Bene Gesserit education and selective breeding program claims to be all about producing human beings who maximize the well‐being of all humankind. (shrink)

Carrying out research on brains is important for medical advances in various diseases. However, such research ought not be carried out on human brains because the benefits do not outweigh the potential risks. A possible alternative is the use of brain surrogates. Nevertheless, some scholars who uphold a threshold account of moral status suggest the possibility that, with technological advances in the near future, more advanced brain surrogates will have very similar features to humans. This may suffice for these having (...) the same moral status as humans, and as a result, the situation may have implications for brain research, indeed, leading to the implication that this ought also not to be carried out upon brain surrogates. In this article, we present a relational approach to moral status which upholds that brain surrogates do not have the same moral status as human beings. Hence, brain research ought not be rejected on the grounds of equality of moral status between humans and brain surrogates. (shrink)

Some bioethicists have argued that moral bioenhancement, complementing traditional means of enhancing individuals’ moral dispositions, is essential if we are to survive as a species. Traditional means of moral enhancement have historically included civil legislation, socially recognized moral exemplars, religious teachings and disciplines, and familial upbringing. I explore the necessity and feasibility of pursuing methods of moral bioenhancement as a complement to such traditional means, grounding my analysis within a virtue-theoretic framework. Specifically, I focus on the essential intellectual virtue for (...) proper moral reasoning, prudence, and whether proposed methods of moral bioenhancement could facilitate the cultivation of this virtue within the psyches of moral agents. I conclude that certain means of bioenhancement may serve to augment the ability to reason prudentially and assist moral agents to align their wills with their higher-order rational desires, though such means require those higher-order desires to already have been formulated independently. In the debate over moral bioenhancement, some object that biochemical, genetic, and neurological interventions aiming at enhancing moral agency threaten the autonomy of persons, as they compromise moral deliberation and motivation. Opponents of this view argue that such interventions may actually enhance autonomy itself, thereby increasing a person's capacity for moral agency. My aim is to explore the various senses of autonomy commonly appealed to in such controversies and to expose their limitations in resolving the central disputed issues. I propose (...) that a Kantian conception of autonomy is more effective in addressing these issues, as it specifies the key features that inform an intelligible account of moral worth and moral law. A consideration of these features is typically lacking in the arguments advanced by contenders in these debates. Guided by a Kantian framework, I argue that moral bioenhancement projects directed at affecting moral autonomy are not as promising as they appear, for both metaphysical and empirical reasons. It is commonly thought that neo-Hobbesian contractarianism cannot yield direct moral standing for marginal humans and animals. However, it has been argued that marginal humans and animals can have a form of direct moral standing under neo-Hobbesian contractarianism: secondary moral standing. I will argue that, even if such standing is direct, this account is unsatisfactory because it is counterintuitive and fragile.

Biomedical research, on the one hand, contributes to important goals from generation of knowledge about the human body to the development and testing of therapeutics of all kinds. On the other hand, it can produce serious and sometimes unforeseeable consequences. In the ethical analysis of these two aspects of biomedical research, two important argumentative strategies play a major role. First, slippery slope arguments are used to warn of potential risks and to highlight knowledge-based limitations. Second, a dual-use problem describes the (...) challenge that already established techniques can be used for both morally wrong and morally right purposes. These two argumentative strategies appear to share several similarities, which will be investigated in this article. For this purpose, the article will first provide clear working definitions for both types of argument. This lays the foundation for the further ethical analysis. In a second step, and in order to investigate the similarities and differences of the argumentative strategies with an example from current ethical debates, CRISPR-Cas9, a currently very promising tool of genome editing, will be examined. The extent to which the possible applications of this genome editing tool can be addressed by slippery slope arguments or the dual use problem will be investigated. For this purpose, selected studies involving the use of CRISPR-Cas9 will be examined. Based on this two-step, analytic and example-based comparison of slippery-slope argumentation and dual-use considerations, the article will detail the ethically relevant difference between the two argumentative strategies and at the same time contribute to the ongoing ethical debate about CRISPR-Cas9. With the discovery of the possibility of neurobiologically and genetically interpreting the actions of a moral agent, the issue of the status of morality returned to applied ethics with renewed vigor. The biotechnological understanding of society as a whole has been a long-running trend in technoscience and can be considered as a transgression of (bio-) technologies into the sphere of ethics. The essence of the conflict between bio-conservative ethics and techno-oriented utilitarians lies in the plane of violation of the fundamental (...) value of autonomy (J. Harris) and the destruction of the principle of solidarity and equality (A. Buchanan). Supporters of techno-determined moral action as conditions for the expansion of technology into the field of morality put forward the predictability of consequences as a condition for the legitimation of technology (N. Agar), the need to prevent maximum harm (J. Savulescu, I. Persson) and the right to an autonomous choice of a biotechnological regulation of morality (V. Rakic). At the center of the discussion is the problem of the good, for the practical solution of which moral outsourcing mechanisms have already been envisaged (e.g. the service of triage officers in disaster medicine, extended informed consent for biobanks). The article compares moral action as a choice, moral action as a coercion and moral action as outsourcing, and determines the place of the neurobiological interpretation of good and moral action within the theoretical understanding of a moral act in applied ethics. In particular, the role of a cognitive act in the context of a moral act is examined, the problem of deferred risks and their regulation when making a moral decision is analyzed. It is concluded that one of the manifestations of the impact of (bio) technology on a person is the complicacy and transformation of moral decision-making models, in connection with which the universal methods that formulate a moral action (moral act as a choice) can be supplemented by new models that constitute good and moral action. Animal models of human diseases are often used in biomedical research in place of human subjects. However, results obtained by animal models may fail to hold true for humans. One way of addressing this problem is to make animal models more similar to humans by placing human tissue into animal models, rendering them chimeric. Since technical and ethical limitations make neurological disorders difficult to study in humans, chimeric models with human neural tissue could help advance our understanding of neuropathophysiology. In (...) this article, we examine whether the introduction of human neural tissue and any consequent cognitive change is relevant to the way we ought to treat chimeras. We argue that changes in cognitive abilities are morally relevant to the extent that they increase the capacities that affect the moral status of any entity, including awareness, autonomy, and sociability. We posit that no being, regardless of species, should be treated in a way that is incommensurate with its moral status. Finally, we propose a framework that can be used to guide ethical assessment of research involving chimeras with advanced cognitive capacities. We advance this framework as a useful tool for bringing relevant considerations to the forefront for those considering the ethical merit of proposed chimeric research. In doing so, we examine concepts relevant to the question of how any entity may be treated, including moral status, dignity, and capacities. (shrink)
