According to contextualism, the extension of claims of personal taste is dependent on the context of utterance. According to truth relativism, their extension depends on the context of assessment. On this view, when the taste preferences of a speaker change, so does the truth value of a previously uttered taste claim, and the speaker might be required to retract it. Both views make strong empirical assumptions, which are here put to the test in three experiments with over 740 participants. It (...) turns out that the linguistic behaviour of ordinary English speakers is consistent with contextualist predictions and inconsistent with the predictions of the most widely discussed form of truth relativism advocated by John MacFarlane. The argument from retraction (the speech act of “taking back” a previous speech act) has been one of the favorite arguments used by relativists about a variety of natural language expressions (predicates of taste, epistemic modals, moral and aesthetic claims etc.) in support of their view. The main consideration offered is that relativism can, while rival views cannot, account for this phenomenon. For some of those leading the charge, retraction is, in fact, mandatory: a norm of retraction makes it obligatory (...) for an agent to retract a previously unretracted assertion whenever what has been asserted is shown to be currently false. This norm, it is contended, distinguishes (radical) relativism from other views on the market. Recently, several considerations—both from the armchair and based on empirical studies—have been offered to undercut the support retraction has been taken to provide for relativism. In this paper, I engage with both types of considerations and lay out two strategies the radical relativist can follow: weakening the force of the retraction norm and restricting it to certain conditions. I explore how much of the recalcitrant data can be accounted for by each strategy, and show that the best route for the relativist is to adopt a flexible version of the view. Finally, I address the objection from ad-hocness in relation to the flexibility envisaged and put forward a principle based on the notion of the importance of the context of the assertor in a given context of assessment that underlies flexibility. This paper gives experimental evidence against the claim that speakers’ intuitions support semantic relativism about assertions of epistemic modal sentences and uses this evidence as part of a broader argument against assessment relativism. It follows other papers that reach similar conclusions, such as that of Knobe and Yalcin (Semant Pragmat 7:1–21, 2014). Its results were achieved simultaneously and independently of the more recent work of Kneer (Perspectives on taste. Aesthetics, language, metaphysics, and experimental philosophy. Routledge, 2022). The experimental data in (...) this paper supports two claims. The first is that, as Knobe and Yalcin (Semant Pragmat 7:1–21, 2014) also found, speakers diverge in their judgments about the truth-values and about the appropriate retraction of epistemic modal claims. The second is that speakers diverge in their judgments about when a retraction is appropriate and when it is required. This divergence was not tested by Knobe and Yalcin (Semant Pragmat 7:1–21, 2014) but aligns with the results independently reached by Kneer ((Kneer, Synthese 199(3–4): 6455–6471; Perspectives on taste. Aesthetics, language, metaphysics, and experimental philosophy. Routledge, 2022), and supports the arguments previously developed by Marques (Synthese 199(3–4): 6455–6471). The present studies tested the intuitions of both North American English speakers and of peninsular Spanish speakers, whose judgements on the topic had never been tested. This paper addresses the following question: Can one and the same utterance token, in one unique speech situation, intentionally and conventionally perform a plurality of illocutionary acts? While some of the recent literature has considered such a possibility Perspectives on pragmatics and philosophy. Springer, Cham, pp 227–244, 2013; Johnson in Synthese 196:1151–1165, 2019), I build a case for it by drawing attention to common conversational complexities unrecognized in speech acts analysis. Traditional speech act theory treats communication as: a dyadic exchange (...) between a Speaker and a Hearer who trade illocutionary acts endowed with one and only one primary force. I first challenge assumption by discussing two contexts where plural illocutionary forces are performed in dyadic discussions: dilemmatic deliberations and strategic ambiguity. Further, I challenge assumption by analyzing poly-adic discussions, where a speaker can target various participants with different illocutionary acts performed via the same utterance. Together, these analyses defend illocutionary pluralism as a significant but overlooked fact about communication. I conclude by showing how some phenomena recently analyzed in speech act theory—back-door speech acts New work on speech acts. Drawing on the relevant alternatives framework and Mary Kate McGowan’s work on conversational scorekeeping, I argue that usage of the term ‘conspiracy theory’ in ordinary language and public discourse typically entails the performance of what I call a dismissive conversational exercitive, a kind of speech act that functions to exclude certain propositions from (or prevent their inclusion in) the set of alternatives considered relevant in a given conversational context. While it can be legitimate to perform dismissive conversational exercitives, excluding alternatives (...) that deserve to be taken seriously can be highly problematic for a variety of reasons. For one, it can give rise to what I call the problem of premature conclusions when subjects illegitimately dismiss certain propositions as irrelevant and, as a result, prematurely take certain conclusions or claims to be warranted. Depending on the kind of conclusion or claim, the problem can come in different variants, three of which I shall examine in more detail: the problem of premature knowledge claims, the problem of premature causal claims, and the problem of premature generic generalizations. Contextualism is the view that the extension of perspectival claims (involving e.g. predicates of personal taste or epistemic modals) depends on the context of utterance. Relativism is the view that the extension of perspectival claims depends on the context of assessment. Both views make concrete, empirically testable predictions about how such claims are used by ordinary English language speakers. This chapter surveys some of the recent empirical literature on the topic and presents four new experiments (total N=724). Consistent with contextualism (...) and inconsistent with relativism, the results suggest that the extension of perspectival claims depends on the context of utterance, not the context of assessment. McGowan argues that everyday verbal bigotry makes a key contribution to the harms of discriminatory inequality, via a mechanism that she calls sneaky norm enactment. Part of her account involves showing that the characteristic of conversational interaction that facilitates sneaky norm enactment is in fact a generic one, which obtains in a wide range of activities, namely, the property of having conventions of appropriateness. I argue that her account will be better-able to show that everyday verbal bigotry is a key (...) factor in social inequality if it tries to isolate a more specific property of conversation as the thing that facilitates sneaky norm enactment. Ignorant speech, which spreads falsehoods about people and policies, is pervasive in public discourse. A popular response to this problem recommends countering ignorant speech with more speech, rather than legal regulations. However, Mary Kate McGowan has influentially argued that this ‘counterspeech’ response is flawed, as it overlooks the asymmetric pliability of conversational norms: the phenomenon whereby some conversational norms are easier to enact than subsequently to reverse. After demonstrating that this conversational ‘stickiness’ is an even broader concern for counterspeech than (...) McGowan suggests—it applies not just to oppressive or hateful speech, but also to ordinary policy-related misinformation—I argue that a more sophisticated account of counterspeech can nevertheless overcome it. First, the stickiness objection overlooks the distinction between ‘negative’ and ‘positive’ counterspeech. Instead of directly negating a distorted proposition, positive counterspeech affirms a correct proposition that is inconsistent with the falsehoods at hand. This, I contend, allows it to counter ignorant speech without triggering the properties that render it sticky. Second, the stickiness objection presupposes an unrefined conception of counterspeech’s temporality. Counterspeech should be understood as a diachronic process, which not only follows, but also pre-empts, ignorant utterances. Drawing on speech-act theories of silencing, I argue that pre-emptive counterspeech can condition the conversational context so as to prevent subsequent ignorant utterances from enacting sticky conversational norms. Thus, this theoretically-refined conception of counterspeech helps appreciate how verbal responses might overcome the stickiness of conversational norms; and, in doing so, it reveals that this stickiness need not provide reasons to prefer legal remedies to counterspeech. Silence can be a communicative act. Tanesini (2018) demonstrates how “eloquent” silences can virtuously indicate resistance and dissent; in this paper, I outline one way silence can also be used viciously to cause discursive harm, specifically by slurring victims. By distinguishing between eloquent and “signaling” silences (two kinds of what I call “performative” silences), I show how “slurring” silences — fully quiet discursive moves that signal one's commitment to a slurring perspective — function in a manner that illuminates the pragmatic (...) topography of conversational silence in general. How can we disagree with a bald-faced liar? Can we actively disagree if it is common ground that the speaker has no intent to deceive? And why do we disapprove of bald-faced liars so strongly? Bald-faced lies pose problems for accounts of lying and of assertion. Recent proposals try to defuse those problems by arguing that bald-faced lies are not really assertions, but rather performances of fiction-like scripts, or different types of language games. In this paper, I raise two objections (...) to the fictionalist view, and then offer an analysis of how we disagree with bald-faced liars. I conclude that bald-faced lies are assertions, and that in pronouncing a bald-faced lie, the speaker tries to make it common ground that the assertion was in good standing qua assertion. (shrink)

This paper offers a systematic classification and characterization of speech acts and their norms. Recently, the normative approach has been applied to various speech acts, most notably to constatives. I start by showing how the work on the norms of assertion has influenced various approaches to the norms of other speech acts. I focus on the fact that various norms of assertion have different extensions, i.e., they denote different clusters of illocutions as belonging to an assertion. I argue that this (...) has consequences for theorising about norms of other speech acts and generates certain arbitrary divisions. In the central part, I analyse two groups of speech acts. Firstly, ordinary speech acts, like predictions or retractions. Secondly, I indicate how the normative view can be extended to so-called ancillary speech acts, like presuppositions or implicatures. I end with a discussion of possible extensions of the normative approach, focusing on the debate on lying. (shrink)

In this paper, I develop a speech-act based account of presumptions. Using a score-keeping model of illocutionary games, I argue that presumptions construed as speech acts can be grouped into three illocutionary act types defined by reference to how they affect the state of a conversation. The paper is organized into two parts. In the first one, I present the score-keeping model of speech act dynamics; in particular, I distinguish between two types of mechanisms—the direct mechanism of illocution and the (...) indirect one of accommodation—that underlie the functioning of illocutionary acts. In the second part, I use the presented model to distinguish between the unilateral act of individual presumption, the point of which is to shift the burden of proof by making the hearer committed to justifying his refusal to endorse the proposition communicated by the speaker, whenever he refuses to endorse it, the bilateral act of joint presumption—‘bilateral’ in that it is performed jointly by at least two conversing agents—the function of which is to confer on the proposition endorsed by the speaker the normative status of jointly recognized though tentative acceptability, and the indirect or back-door act of collective presumption, the purpose of which is to sustain rules and practices to which the conversing agents defer the felicity of their conversational moves. Public arguments can be good or bad not only as a matter of logic, but also in the sense that speakers can _do_ good or bad things with arguments. For example, hate speakers use public arguments to contribute to the subordination of their targets. But how can ordinary speakers acquire the authority to perform subordinating speech acts? This is the ‘Authority Problem’. This paper defends a solution inspired by McGowan’s (Australas J Philos 87:389–407, 2009) analysis of oppressive speech, including against (...) concerns raised by McGowan (Just words: On speech and hidden harm, Oxford University Press, Oxford, 2019) herself. A _deflated_ kind of authority can be gained from the hate speaker’s standing in a norm-governed ‘activity of oppression’. We should be wary about engaging with such speakers in public argument. Even if we counter their arguments, we may still elevate their standing within that activity and so enable them to perform more pernicious speech acts than was previously possible. (shrink)

This paper sets out to unpack the pragmatic structure of refusal—its illocutionary nature, success conditions, and normative effects. I argue that our ordinary concept of refusal captures a whole family of illocutions, comprising acts such as rejecting, declining, and the like, which share the property of being ‘negative second-turn illocutions’. Only _proper refusals_ (i.e. negative replies to permission requests), I submit, require speaker authority. I construe the ‘refusal family’ as a subclass of the directives-commissives intersection. After defending my view against (...) a number of potential objections, I highlight how a theoretically grounded analysis of refusal is not only of intrinsic value, but may also have significant moral and legal implications. The central pillar of Austin’s theory of speech acts is the three-way distinction between locutionary acts like saying, illocutionary acts like asserting, and perlocutionary acts like persuading (Austin 1962: VIII-IX). While the latter distinction has been widely accepted, the former distinction has been frequently rejected due to Searle’s objections, who argued that since Austin’s locutionary acts are supposed to be forceful in the sense contrasting with neutral expression of a content and all force is by Austin’s own definition illocutionary, the (...) notion of a locutionary act collapses into that of an illocutionary act (Searle 1968). In this paper, I provide an interpretation of Austin’s distinction between locutionary and illocutionary acts and defend it against Searle’s objections. I argue that Searle’s main objection relies on mistakenly running together two notions of ‘force’: the Fregean notion of representational force as presentation-as-true and the Austinian notion of illocutionary force as the social-communicative significance of the speech act. Once we distinguish these we can see that although Searle is correct that Austin’s locutionary acts are forceful in the former sense, he’s mistaken in thinking that such force is illocutionary. Given this, his objection that locutionary acts collapse into illocutionary acts misses its mark. (shrink)

This chapter reviews empirical research on the rules governing assertion and retraction, with a focus on the normative role of truth. It examines whether truth is required for an assertion to be considered permissible, and whether there is an expectation that speakers retract statements that turn out to be false. Contrary to factive norms (such as the influential “knowledge norm”), empirical data suggests that there is no expectation that speakers only make true assertions. Additionally, contrary to truth-relativist accounts, there is (...) no requirement for speakers to retract statements that are false at the context of assessment. We conclude by suggesting that truth still plays a crucial role in the evaluation of assertions: as a standard for evaluating their success, rather than permissibility. (shrink)

A growing body of work in free speech theory is interested in the nature of counterspeech, i.e. speech that aims to counteract the effects of harmful speech. Counterspeech is usually defined in opposition to legal responses to harmful speech, which try to prevent such speech from occurring in the first place. In this paper we challenge this way of carving up the conceptual terrain. Instead, we argue that our main classificatory division, in theorising responses to harmful speech, should be between (...) pro-discursive and anti-discursive responses. Some legal responses to harmful speech, so we argue, make a positive discursive contribution in their own right. That is, legal restrictions on harmful speech can have a function that is importantly similar to speech that aims at countering the effects of harmful speech. (shrink)

Moorean constructions are famously odd: it is infelicitous to deny that you believe what you claim to be true. But what about claiming that p, only to immediately put into question your evidence in support of p? In this paper, we identify and analyse a class of quasi-Moorean constructions, which we label counterevidentials. Although odd, counterevidentials can be accommodated as felicitous attempts to mitigate one’s claim right after making it. We explore how counterevidentials differ from lexicalised mitigation operators, parentheticals, and (...) anaphoric mitigation devices, and consider some cognate non-assertoric constructions. We conclude by exploring the implications of our analysis for theorising about linguistic responsibility, assertion, and lying. (shrink)

In this paper, I discuss a subset of preferences in which a person desires the fulfillment of a choice they have made, even if it involves the violation of their desires, as in rape fantasies. I argue that such cases provide us with a unique insight into personal autonomy from a proceduralist standpoint. In its first part, I analyze some examples in light of Frankfurt's endorsement theory and argue that even when we cannot endorse a practical decision that involves being (...) violated, we nonetheless regard those cases as instances of autonomy. Therefore, autonomy does not necessarily require endorsement. Instead, I propose that the nature of the relevant highest-order volition dictates the procedure that should be established in one’s desire structure for its fulfillment. In the second part, I discuss how an agent may effectively consent to the violation of their decision by another person. Ordinary consent typically refers to actions but fails to communicate one's higher-order desires or commitments. To address this limitation, I propose a practical tool that accomplishes this by signaling shifts in the normative context where the agents are interacting. (shrink)

In this paper, I assess recent Stalnakerian views of communication in moral and normative domains. These views model context updates with normative claims. They also aim to explain how people disagree when they follow different norms or values. I present four problems for these Stalnakerian views. I conclude that the problems require a new conception of how common ground relates to illocutionary force and attitude mode, which is still lacking.

In this talk I present the main results from Anta (2021), namely, that the theoretical division between Boltzmannian and Gibbsian statistical mechanics should be understood as a separation in the epistemic capabilities of this physical discipline. In particular, while from the Boltzmannian framework one can generate powerful explanations of thermal processes by appealing to their microdynamics, from the Gibbsian framework one can predict observable values in a computationally effective way. Finally, I argue that this statistical mechanical schism contradicts the Hempelian (...) (1958) thesis that the predictive power of a scientific theory is directly proportional to its explanatory potential, and vice versa. (shrink)

This paper discusses the speech act of disavowal, focusing in particular on disavowals of prior speech acts. It is argued that disavowals are often used when speakers wish to distance themselves in certain ways from some past speech act, but cannot (or should not) retract it. An account is offered according to which disavowals involve three components: an admission of having performed the target act, a denunciation of that act, and an accounting for the act. Disavowals are compared to the (...) related speech acts of denial, retraction, apology, as well as the use of figleaves in political speech. (shrink)

Radical self-silencing is a particular variety of speech act disablement where the subject silences themselves, whether knowingly or not, because of their own faults or deficiencies. The paper starts with some concrete cases and preparatory comments to help orient and motivate the investigation. It then offers a summary analysis, drawing on a small number of basic concepts to identify its five individually necessary and jointly sufficient conditions and discriminating their two basic forms, ‘internalist’ and ‘externalist’. The paper then explicates and (...) defends what has been proposed, where the most salient and pressing objections concern the use of two basic concepts: ‘uptake’ and ‘silencing’. Finally, the paper gives a longer-term motivation for deepening our understanding of radical self-silencing, what it is and what it implies. (shrink)
