Oppression is commonly deemed a problem of freedom. How though should we conceptualise the freedom-restricting nature of oppression? This paper aims to show that the unfreedom in oppression may be understood in terms of individual negative liberty. The controversial concept of collective unfreedom is not needed. Non-cooperation among the oppressed generates constraints on individual freedom. This non-cooperation is ultimately attributable to the exercise of social power by oppressors. Recent writers in feminist ethics have been concerned to find ways to reclaim and augment women's moral agency. This essay considers Sarah Hoagland's intriguing suggestion that we renounce moral praise and blame and pursue what she calls an "ethic of intelligibility." I argue that the eschewal of moral blame would not help but rather hinder our efforts to increase our sense of moral agency. It would, I claim, further intensify our demoralization.

Abstract: The optimum definition of the term "genocide" has been hotly contested almost since the term was coined. Definitional boundaries determine which acts are covered and excluded and thus to a great extent which cases will benefit from international attention, intervention, prosecution, and reparation. The extensive legal, political, and scholarly discussions prior to this article have typically (1) assumed "genocide" to be a fixed social object and attempted to define it as precisely as possible or (2) assumed the need for (...) a fixed convention and sought to stipulate the range of events that should be denoted by the term. Even if its meaning is a matter of convention, however, "genocide" is not a fixed object but varies by context and evolves in methods and forms over time. In fact, as relevant laws, legal interpretations, and political commitments develop, so do would-be perpetrators modify what genocide is in order to avoid political and legal consequences. This article advances an approach to a definition of "genocide" that allows even legal definitions to keep pace with this evolutionary process. (shrink)

This article considers neoliberalism through the “peaceful violence” of its social spaces that are stratified and ordered around raciality whilst abjuring the explicit presence of racialised power. Many dominant analyses of neoliberalism in the social science have figured racial injustices as ideological fossils to be swept away by a fundamentally neutral political economy that has shaped all human activity according to market principles. As such, racial injustices are understood as material deviations from conditions of economic power on the one hand, (...) and cultural deviations in hegemonic common sense on the other. Against the grain of these approaches, I argue that racialised power is better understood as a productive technology fundamental to the structuring of our worlds, their neoliberal organisation just one iteration of ongoing coloniality. Contrary to popular analysis and this account of neoliberalism, contemporary racialised violence and nationalist discourse are, therefore, not only consistent with the power of neoliberal classes but also result from weaknesses in their hegemonic power. This volume has its roots in two recent developments within mainstream analytic epistemology: a growing recognition over the past two or three decades of the active and social nature of our epistemic lives; and, more recently still, the increasing appreciation of the various ways in which the epistemic practices of individuals and societies can, and often do, go wrong. The theoretical analysis of these breakdowns in epistemic practice, along with the various harms and wrongs that follow as a consequence, constitutes (...) an approach to epistemology that we refer to as non-ideal epistemology. In this introductory chapter we introduce and contextualise the ten essays that comprise this volume, situating them within four broad sub-fields: vice epistemology, epistemic injustice, inter-personal epistemic practices, and applied epistemology. This article discusses the importance of geopolitical specificity in discussions about waves in feminism and investigates the queer potential of Marilyn Frye's second-wave work on sexism and white supremacy. It argues that Frye's understanding of sexism relies on the figure of the genderqueer individual and that Frye's critique of reproductive heterosexuality has implications for analyses of both sexism and racism. Finally, it asks what would happen to the contemporary #metoo movement in Sweden if it returned to Frye's radical lesbian feminism (...) as emblematic of the second wave, rather than to the figure of the white, middle-class, heterosexual woman. Social groups—like teams, committees, gender groups, and racial groups—play a central role in our lives and in philosophical inquiry. Here I develop and motivate a structuralist ontology of social groups centered on social structures (i.e., networks of relations that are constitutively dependent on social factors). The view delivers a picture that encompasses a diverse range of social groups, while maintaining important metaphysical and normative distinctions between groups of different kinds. It also meets the constraint that not every arbitrary collection of (...) people is a social group. In addition, the framework provides resources for developing a broader structuralist view in social ontology. (shrink)

Silencing is usually explained in terms of conventionalism about the nature of speech acts. More recently, theorists have tried to develop intentionalist theories of the phenomenon. I argue, however, that if intentionalists are to accommodate the conventionalists' main insight, namely that silencing can be so extreme as to render certain types of speech act completely unavailable to victims, they must take two assumptions on board. First, it must be possible that speakers' communicative intentions are opaque to the speakers themselves. Secondly, (...) it needs to be assumed that structural oppression can have hidden psychological effects on its victims. Since both assumptions can be motivated independently, I argue that silencing can be fully understood without appealing to linguistic conventions. (shrink)

One of the central issues facing contemporary political theory is the problem of difference. This problem is perhaps clearest in disagreements regarding the role of pluralism between advocates of deliberative, and agonistic, approaches to democracy. According to agonists, deliberative democracy has only paid lip-service to pluralism, emphasising agreement, consensus, and universalism. Instead, agonists argue that we should accommodate incommensurable difference as central to political organisation. But this shift threatens to emphasise particularity at the expense of commonality, so preventing the transformation (...) of social positions. These debates turn largely around the ways in which power is conceived in relation to democratic interaction, with deliberativists emphasising ideals of free and equal discourse, and agonists, the irreducible role of power. I begin by outlining a structural approach to social power, to show how we are all structurally implicated in power relationships. I go on to show how emphasising structural implication shifts us beyond debates that revolve around difference, drawing attention to the more foundational problem of how agents may come to understand these structures and each other, in ways that surpass or transcend the specific constraints acting upon them. Considering this, I develop a complex account of structural implication that emphasises the relationships between social norms, reasoning, and objective power relationships. This approach illuminates lacunae in similar approaches, particularly regarding the way in which structural power disenables us from often seeing structural imbalances of power, and clarifies the ways in which collective political transformation is possible. In this paper, I identify a form of epistemic insensitivity that occurs when someone fails to make proper use of the epistemic tools at their disposal in order to bring their beliefs in line with epistemically relevant evidence that is available to them. I call this kind of insensitivity agential insensitivity because it stems from the epistemic behavior of an individual agent. Agential insensitivity can manifest as a failure to either attend to relevant and available evidence, or appropriately interpret evidence (...) that is attended to. The concept of agential insensitivity allows us to conceptualize the kind of not-knowing involved in forms of ignorance that are cultivated and maintained by individual agents, especially when this ignorance is enabled or encouraged by social structures. I use the skepticism about racial disparities in policing practices that is displayed by many white Americans as a lens for exploring this connection. Understanding agential insensitivity thus provides insight into both social and epistemic phenomena. (shrink)

Hate speech is one of the most important conceptual categories in anti‐oppression politics today; a great deal of energy and political will is devoted to identifying, characterizing, contesting, and penalizing hate speech. However, despite the increasing inclusion of gender identity as a socially salient trait, antipatriarchal politics has largely been absent within this body of scholarship. Figuring out how to properly situate patriarchy‐enforcing speech within the category of hate speech is therefore an important politico‐philosophical project. My aim in this article (...) is twofold: first, I argue that sexist speech, though oppressive, is not hate speech. Second, I argue that misogynistic speech is hate speech, even when it is intradivisional. This is important because recognizing that the concepthate speechapplies to certain forms of patriarchy‐enforcing speech is another step in clarifying what is wrong with the practice, and how bad it is in relation to other abuses. My aim in this paper is to introduce a theory of affective labor as byproductive, a concept I develop through analysis of the phenomenology of various affective labor practices in dialog with feminist scholarship, both on gendered and racialized labor, and on affect and emotion. I motivate my theory in the context of literature on affective and emotional labor in philosophy and the social sciences, engaging the post-Marxist literature on affective and immaterial labor and emphasizing feminist critiques. I argue that (...) affective labor is not only the work of producing affects for others to consume or the reproductive work that rejuvenates and sustains labor power and social life, but also the work of metabolizing waste affects and affective byproducts. Thus, byproductive labor is a neologism I develop to bring into view an affective economy and indeed a political economy of affects to the side of the distinction between productive and reproductive labor in its paid and unpaid variants. I argue that the default interpretation of “aesthetics” should be global aesthetics, and that aestheticians should take as standard preparation for work in the field some basic knowledge of aesthetics in various cultural traditions. I consider some of the obstacles that interfere with a move in this direction and some of the steps that might encourage a more inclusive self-conception of the field.

This paper gives a new and richer account of open-mindedness as a moral virtue. I argue that the main problem with existing accounts is that they derive the moral value of open-mindedness entirely from the epistemic role it plays in moral thought. This view is overly intellectualist. I argue that open-mindedness as a moral virtue promotes our flourishing alongside others in ways that are quite independent of its role in correcting our beliefs. I close my discussion by distinguishing open-mindedness from (...) what some might consider its equivalent: empathy and tolerance. (shrink)

Many maintain that if a beneficiary has a right to a benefit provided by his benefactor, then the former cannot owe the latter gratitude for that benefit. In this paper I argue against that view. I provide examples in which benefactors provide others with benefits to which they have a right even though most others are denying them that right. These benefactors are moral standouts; they do what is right when most similarly situated agents fail to do so. This article looks at the inadequacy of space available to women in the two most holy sites for all Muslims: Masjid al-Haram in Makkah and Masjid an-Nabawi in Madinah, Saudi Arabia. I argue that religious discourse, shaped by geopolitical factors, has framed piety for women primarily in terms of modesty, such that a woman is often considered a good Muslim if she is visible only within her female community but invisible to the larger society. Furthermore, I argue that the allocation (...) of meager space affects not only the perception of women's religious standing in society, but also women's own perception about their moral selves. The article claims that by being relegated to small sections within religious spaces, women's collective worship is evident neither to the community at large nor can it be fully experienced by individual women, thus placing obstacles in women's path to seek to closeness to God. This essay examines the stereotype that transgender people are “deceivers” and the stereotype's role in promoting and excusing transphobic violence. The stereotype derives from a contrast between gender presentation and sexed body. Because gender presentation represents genital status, Bettcher argues, people who “misalign” the two are viewed as deceivers. The author shows how this system of gender presentation as genital representation is part of larger sexist and racist systems of violence and oppression.

In her Nobel speech in 2019, Olga Tokarczuk presented the category of tenderness as a new way of narrating the contemporary world. This article is a proposal for the analysis and interpretation of tenderness in ethical and aesthetic terms. (1) From an ethical perspective, tenderness is interpreted as an extension and complement of feminist relational ethics, i.e., the ethics of care. In the proposed approach, tenderness is a broader and more universal quality than care in the feminist understanding. This article (...) opens with a brief discussion of feminist interventions in ethics, with particular emphasis on the ethics of care. Next, the differences between care and tenderness are enumerated and described, in order to show how tenderness can serve as an extension and complement of the feminist ethic of care. These considerations are guided by the question of why tenderness is a better—more appropriate and more responsive to contemporary challenges—moral guidepost than care. (2) From the aesthetic perspective, tenderness is the negation of a contemplative, distanced, impersonal, and rational view of reality. As an aesthetic imperative, tenderness implies engaged experience of the beauty of reality in all of its manifestations. Therefore, in the last part of the article, existential tender attunement is described in aesthetic terms, as a position serving to sensitize others to the beauty and complexity of the post-anthropocentric world. Recent years have witnessed a focus on feeling as a topic of reinvigorated scholarly concern, described by theorists in a range of disciplines in terms of a “turn to affect.” Surprisingly little has been said about this most recent shift in critical theorizing by philosophers, including feminist philosophers, despite the fact that affect theorists situate their work within feminist and related, sometimes intersectional, political projects. In this article, I redress the seeming elision of the “turn to affect” in feminist philosophy, (...) and develop a critique of some of the claims made by affect theorists that builds upon concerns regarding the “newness” of affect and emotion in feminist theory, and the risks of erasure this may entail. To support these concerns, I present a brief genealogy of feminist philosophical work on affect and emotion. Identifying a reductive tendency within affect theory to equate affect with bodily immanence, and to preclude cognition, culture, and representation, I argue that contemporary feminist theorists would do well to follow the more holistic models espoused by the canon of feminist work on emotion. Furthermore, I propose that prominent affect theorist Brian Massumi is right to return to pragmatism as a means of redressing philosophical dualisms, such as emotion/cognition and mind/body, but suggest that such a project is better served by John Dewey's philosophy of emotion than by William James's. A few years ago, it was common for philosophers to begin inquiry into hope by noting that the subject has received little attention in the philosophical literature. But our ability to make this claim is quickly coming to an end; hope has been earning increasing recognition in the discipline, with philosophers exploring important questions related to the nature of hope, what makes hope rational, and how hope is connected to human wellbeing and agency. Despite this recent interest, however, there remains (...) very little discussion of the social and political dimensions of hope. My aim in this paper is to demonstrate the importance of a feminist perspective in bringing these dimensions into fuller view. I argue that feminist insights into the relational nature of the self, which call attention to where selves are socially situated in relation to others, enable a richer understanding of the nature and value of hope. One way to articulate the promise of interdisciplinary research is in terms of the relationship between knowledge and ignorance. Disciplinary research yields deep knowledge of a circumscribed range of issues, but remains ignorant of those issues that stretch outside its purview. Because complex problems such as climate change do not respect disciplinary boundaries, disciplinary research responses to such problems are limited and partial. Interdisciplinary research responses, by contrast, integrate disciplinary perspectives by combining knowledge about different issues and as a result (...) reduce ignorance about more aspects of the problem. In this paper, we develop this idea and argue that while interdisciplinary research can help remediate damaging ignorance about complex problems, it also creates conditions in which other damaging forms of ignorance can arise. Hierarchy is a difficulty for theories of equality, and especially those that define equality in relational or social terms. In ideal egalitarian circumstances it seems that hierarchies should not exist. However, a liberal egalitarian defence of some types of hierarchies is common. Hierarchies of esteem have no further consequences than praise or admiration for valued individual features. Hierarchies of status, with differential reward, can, it is often argued, also be justified when they serve a justified social purpose and meet conditions (...) of genuine equality of opportunity. However, group hierarchies remain problematic, and evidence suggests that they are pervasive in human societies above a subsistence level of production. It has also been argued that group hierarchies are impossible to eliminate, and enormous cost is associated with attempting, and failing, to remove them. However, the perspective of ‘real-world’ political philosophy suggests measures to mitigate group hierarchy, starting with those that are either the easiest to address, the most damaging, or the most consequential. When addressing the burdens borne by victims of police wrongdoing, we often overlook moral harms in focusing on the physical and psychological harms that they suffer. These moral harms undermine the moral status of the victim, her ability to consistently pursue the values she endorses, and her character. Victimhood is a morally significant social role. Victimhood imposes normative standards that measure the moral or political status of victim. Conforming to these standards affects our assessment of the conduct of the victim (...) and her moral standing. Considering the victims’ role provides important insights into contemporary practices of policing in the United States. The physical and verbal acts of the police often force race-based degradation upon racially subordinated groups. There is often no morally good way out of racially discriminatory encounters when the choice is to degrade oneself or suffer violence or even death. Worse, how we respond to the threat of police violence morally undermines our relationships with those we would keep safe from police violence. (shrink)

In a diversity course for pre-service teachers, we explored coursework by students of color to uncover instances in which they resisted the existence systemic oppression in K12 schools. First, we examined the written responses from three students of color (Asian-Indian, Asian immigrant, and Latina) who were largely agreeable to the existence of different forms of oppression presented in the course content. Our work illuminated instances of what we have described as narrative-based resistance. Students initially referred to narratives of rugged individualism (...) or the American Dream to resist the existence of systemic barriers. As the course progressed, students shifted to deeply entrenched responses that rejected the course content to refute systemic oppression. Secondly, we developed a case study for one student, a biracial female that self-identified as White who consistently rejected systemic oppression during class interactions to the point of displaying openly defiant behaviors. The examples of resistance we encountered served as a reminder that students of color along with their White peers must be able to critically examine and understand systems of oppression that are pervasive throughout education. Furthermore, the underlying sources of the resistance were closely associated with indoctrination in Whiteness, limited understanding of systemic oppression, deeply held beliefs and understandings and the lived experiences of individuals. While we agree that teacher education must recruit and retain more teachers of color for an increasingly diverse US K12 student population, we add that preparation that meets the needs of teachers of color is essential. -/- . This paper argues that environmental virtue ethics requires the adoption of an ethical ideal in order to guide the identification and practice of virtues. I recommend friendship as one such ideal due to emphasis such an ideal places upon the quality of the relationship with nature rather than the evaluation of individual actions. After describing the value of friendship as an ethical ideal, I respond to some of the objections that have been raised against it in the context of environmental (...) virtue. (shrink)
