This article challenges a key tacit assumption underpinning legal and ethical instruments in health care, namely, that people are ideally bounded, independent, and often also strategically rational individuals. Such an understanding of personhood has been criticized within feminist and other critical scholarship as being unfit to capture the deeply relational nature of human beings. In the field of medicine, however, it also causes tangible problems. I propose that a solidarity-based perspective entails a relational approach and as such helps to formulate (...) new solutions to complex ethical and regulatory questions, ranging from caring for people at the end of their lives to improving policies for organ donation and better governance of health data. It also underscores the importance of universal health care. Although a solidarity-based perspective does not require health to be seen as an individually enforceable right, it does influence our understanding of individual rights: it draws attention to how their meaning is shaped by shared social practices. I conclude by arguing that, in light of current pressures for medicine to become more personalized, using a relational understanding of personhood to shape policies and practices is a much needed endeavor. This essay critiques feminist treatments of maternal-fetal "relationality" that unwittingly replicate features of Western individualism (for example, the Cartesian division between the asocial body and the social-cognitive person, or the conflation of social and biological birth). I argue for a more reflexive perspective on relationality that would acknowledge how we produce persons through our actions and rhetoric. Personhood and relationality can be better analyzed as dynamic, negotiated qualities realized through social practice.

Social scientists often lament the fact that philosophically trained ethicists pay limited attention to the insights they generate. This paper presents an overview of tendencies in sociological and anthropological studies of morality, ethics and bioethics, and suggests that a lack in philosophical interest might be related to a tendency among social scientists to employ either a deficit model (social science perspectives accommodate the sense of context that philosophical ethics lacks), a replacement model (social scientists have finally found the “right way” (...) of doing ethics), or a dismissal model (ethics should be abandoned all together as a misconstrued veil of power). Increased awareness of differences in styles of reasoning and objects of research interest might help to overcome the hostility, and an anthropological project is presented as an invitation to a dialogue informed by awareness of such differences. This paper formulates the categories of "ethics," "self," and "subject" for an analysis of classical rabbinic ethics centered on the text, "The Fathers According to Rabbi Nathan." Early rabbis were concerned with the realms of life that today's scholars describe as ethics and self-cultivation, yet they had no overarching concepts for either the self/person or for ethics. This analysis, then, cannot rely only upon native rabbinic terminology, but also requires a careful use of contemporary categories. This paper first sets out (...) basic features of "Rabbi Nathan" and presents appropriate formulations of the relevant scholarly terms. The latter sections address possibilities for employing and revising these categories in descriptive and comparative studies more broadly, first surveying relevant scholarship on Christian, Muslim, and Manichaean sources, and then turning to ancient East Asian sources with a particular focus upon passages in the "Zhuangzi". This essay examines the ways that the terms "self and "no-self can illuminate the views of classical Chinese thinkers, particularly Confucians such as Confucius, Mencius, and Xunzi, and the Daoist thinker Zhuangzi. In particular, the use of the term "no-self" to describe Zhuangzi's position is defended. The concepts of self and no-self are analyzed in relation to other terms within the thinkers' "concept clusters" - specifically temporality, nature, and social roles - and suggestions are given for constructing typologies that sort (...) out the range of meanings of self and no-self based on the characteristics of the relations among terms within the concept clus- ters. The essay focuses on the way that the Confucians and Zhuangzi use concepts of self and no-self, respectively, as soteriological strategies that aim at making connections with larger systems or wholes, and it concludes that different connections are emphasized by the Confucians and Zhuangzi precisely because the various connections are made possible and sustained by different conceptions of self, temporality, nature, and social roles. Over the coming century, the accelerating advance of bioenhancement technologies, robotics, and artificial intelligence (AI) may significantly broaden the qualitative range of sentient and intelligent beings. This article proposes a taxonomy of such beings, ranging from modified animals to bioenhanced humans to advanced forms of robots and AI. It divides these diverse beings into three moral and legal categories—animals, persons, and presumed persons—describing the moral attributes and legal rights of each category. In so doing, the article sets forth a framework (...) for extending the concept of personhood well beyond its current boundaries, assigning moral standing to a variety of biological and nonbiological beings. The author concludes that six of the eight subgroups of such beings deserve to be treated as persons or as if they were persons, with full consideration for their presumed interests, rights, obligations, and capabilities for ethically significant agency and patiency. Biomedicine is a global enterprise constructed upon the belief in the universality of scientific truths. However, despite huge scientific advances over recent decades it has not been able to formulate a specific and universal definition of death: In fact, in its attempt to redefine death, the concept of death appears to have become immersed in ever increasing vagueness and ambiguity. Even more worrisome is that bioethics, in the form of principlism, is also endeavouring to become a global enterprise by claiming (...) neutrality. It appears that the discourse within both disciplines have similarly manipulated the boundaries of death to include the “dying”. This paper argues that the redefinition of death debate in biomedicine reveals a concept of personhood which is profoundly western in origin and which is in accordance to the concept adhered to within principlism. Biomedicine and bioethics do not appear to acknowledge the limitations of their own world view and hence lack an understanding of their applicability and appropriateness in diverse social and cultural contexts; a situation which adds credence to claims as to the hegemonic and imperialistic nature of all such global enterprises. In the 17th century, ‘reflexivity’ was coined as a new term for introspection and self-awareness. It thus was poised to serve the instrumental function of combating skepticism by asserting a knowing self. In this Cartesian paradigm, introspection ends in an entity of self-identity. An alternate interpretation recognized how an infinite regress of reflexivity would render ‘the self’ elusive, if not unknowable. Reflexivity in this latter mode was rediscovered by post-Kantian philosophers, most notably Hegel, who defined the self in its self-reflective (...) encounter with an other, and whose full articulation would occur at the final culmination of Reason's evolution. In the rising tide of 19th-century individualism, Emerson and Kierkegaard formulated constructions both in debt to, and in opposition against, Hegelian metaphysics. For each, although employing distinct strategies of self-consciousness, ‘the self’ reached its apogee through divine encounter. Characterized by personal responsibility and individual choice, their philosophies would later be subsumed by secular existentialists committed to defining moral individualism and asserting the possibilities for human freedom and selfauthentication. In her article “The ‘We’ in the Me: Solidarity in the Era of Personalized Medicine,” Barbara Prainsack develops an earlier interest in the relationship between solidarity and autonomy and the way that these notions operate once passed through the lens of bioethical thought and practice. In his response to this article, Simpson introduces the perspective of two South Asian physicians on these issues. The piece highlights issues of personhood upon which the informed consent transaction is based and draws attention to (...) the culturally specific versions of how people conceive of relationality, duty, care, and the obligations they feel they owe to others. The piece highlights the pronomial shifts between the “we” and the “me” and the way that these dispositions emerge in sociopolitically configured spaces. By paying careful attention to the settings and situations in which the movements between different positions actually take place, the ways in which the fabric of ethical life is made rather than simply given is revealed. Ethnographic inquiry is seen as crucial in understanding this process because it points to disjunctions between the categories that we are provided to apprehend the world and what it is actually like to live in that world. This paper attempts to reconcile two apparently opposed ways of thinking about the imagination and its relationship to literature, one which casts it as essentially concerned with fiction-making and the other with culture-making. The literary imagination’s power to create fictions is what gives it its most obvious claim to “autonomy”, as Kant would have it: its freedom to venture out in often wild and spectacular excess of reality. The argument of this paper is that we can locate the literary imagination’s (...) complementary power of cultural articulation in this fictional activity. The suggestion is that we should conceive of the literary imagination as expressing its interests in culture not mimetically but by producing a certain kind of meaning. This meaning is irreducibly narratological, and understanding it helps us to see the role of narrative in bringing into harmony the literary imagination’s interests in both the imaginary and the real. This paper offers an analysis of the notion “the quest for identity.” The discussion emphasizes the importance of communal belonging, but rejects the view that one ought to belong to the community one was born to. It suggests that the quest for identity may lead individuals to follow many avenues: while some individuals might affirm their “inherent” affiliations and traditions, others may remain within their community of origin and strive to change its ways, or chose to leave their social group (...) and opt for membership in a new one. This analysis suggests that choice, characteristic of the liberal conception of the person, and rootedness, characteristic of the communitarian conception of the person, both play an important role in the formation of personal identity. Criticisms of the scientific status of sociology possess some validity when applied against narrowly positivist interpretations of sociological methods and metatheory, but do not undermine the scientific project of formulating generalized explanatory models. (1) Critics allege that sociology has made no lawful findings; but valid general principles exist in many areas. (2) Situational interpretation, subjectivity, reflexivity, and emergence are alleged to undermine explanatory sociology, but these topics themselves can be explained by a widened conception of science that allows informal procedures (...) in theorizing aimed at maximizing explanatory coherence. (3) The fact that intellectual discourse itself is a historically changeable social product does not invalidate objective explanatory knowledge. (4) The historicist claim that there can be no principles that hold across particular times and places is invalid and rests upon a confusion of underlying generative principles with the complexities of the empirical surface of history. (5) Metatheoretical criticism of the concept of causality does not undermine a sophisticated conception of scientific sociology. Sociological knowledge can and does advance, but it depends upon building the coherence of theoretical conceptions across different areas and methods of research. (shrink)

Linda Trinkaus Zagzebski here explains and defends the idea that the God of the monotheistic religions does not only know all objective facts, but he also perfectly grasps the conscious states of all conscious beings from their own point of view. She calls that property omnisubjectivity. God not only knows that you are in pain, for instance, but is present in your pain, grasping your pain the way you grasp it. The same point applies to every feeling, every belief, every (...) thought, every desire you have. It also applies to the conscious states of animals. Zagzebski begins with an account of what subjectivity is and why it differs from anything in the objective world, then argues that omnisubjectivity is entailed by divine omniscience and omnipresence, divine love and justice, and practices of prayer. She offers three models of how omnisubjectivity is possible: the empathy model, the perceptual model, and panentheism. She answers objections that it is incompatible with other attributes such as timelessness, immutability, impassibility, divine goodness, divine holiness, and infinity. She extends the account of omnisubjectivity to the divine grasp of possible but non-actual subjective states, arguing that God grasps all possible subjective states of all possible conscious beings in his imagination. She then applies the conclusions of the book to the doctrines of the Trinity, the Incarnation, and the inspiration of the Holy Spirit. Many arguments in the book apply to all the monotheistic religions and some arguments apply to monotheistic Hinduism. The book concludes with the claim that subjectivity is primary in the universe. God is intrinsically subjectivity and intersubjectivity. Objectivity is being from the outside viewpoint, and it exists only relative to the created world. (shrink)

The principle of limited liability is one of the defining characteristics of modern corporate capitalism. It is also, we argue in this article, a powerful structural source of moral hazard. Engaging in a double conceptual genealogy, we investigate how the concepts of moral hazard and limited liability have evolved and diffused over time. We highlight two parallel but unconnected paths of construction, diffusion, moral contestation, and eventual institutionalization. We bring to the fore clear elective affinities between both concepts and their (...) respective evolution. Going one step further, we suggest that both concepts have come to be connected through time. In the context of contemporary capitalism, limited liability has to be understood, we argue, as a powerful structural source of moral hazard. In conclusion, we propose that this structural link between limited liability and moral hazard is an important explanatory factor of the systemic instability of contemporary capitalism and, as a consequence, of a pattern of recurrent crises that are regularly disrupting our economies and societies.
