This paper is about the so-called meta-grounding question, i.e. the question of what grounds grounding facts of the sort ‘φ is grounded in Γ ’. An answer to this question is pressing since some plausible assumptions about grounding and fundamentality entail that grounding facts must be grounded. There are three different accounts on the market which each answer the meta-grounding question differently: Bennett’s and deRosset’s “Straight Forward Account” (SFA), Litland’s “Zero-Grounding Account” (ZGA), and “Grounding Essentialism” (GE). I argue that if (...) grounding is to be regarded as metaphysical explanation (i.e. if unionism is true), (GE) is to be preferred over (ZGA) and (SFA) as only (GE) is compatible with a crucial consequence of the thought that grounding is metaphysical explanation. In this manner the paper contributes not only to discussions about the ground of ground but also to the ongoing debate concerning the relationship between ground, essence, and explanation. (shrink)

This paper argues that Kant’s concept of ‘respect’ for the moral law has roots in Adam Smith’s concept of ‘regard’ for the general rules of conduct, which was translated as Achtung in the first German translation of the Theory of Moral Sentiments. After illustrating that Kant’s technical understanding of respect appeared relatively late in his intellectual development, I argue that Kant’s concept of respect and Smith’s concept of regard share a basic similarity: they are both a single complex phenomenon with (...) two core aspects, namely an attitude and a feeling. I then suggest that the concept of regard offered Kant a way to deal a problem concerning moral motivation that he was trying to solve at the time he likely first read Smith. I conclude by drawing some implications from the account I have offered for our understanding of Kant’s relation to Smith more generally. (shrink)

Recently, Kit Fine's (1994) view that modal truths aretrue in virtue of,grounded in, orexplained byessentialist truths has been under attack. In what follows we offer two responses to the wave of criticism against his view. While the first response is pretty straightforward, the second is based on the distinction between, what we call,Reductive Finean EssentialismandNon-Reductive Finean Essentialism. Engaging the work of Bob Hale onNon-Reductive Finean Essentialism, we aim to show that the arguments against Fine's view are unconvincing, while we acknowledge (...) the presence of a deep standoff between the two views. Fine, Lowe and Hale accept the view that necessity is to be explained by essences: Necessarily p iff, and because, there is some x whose essence ensures that p. Hale, however, believes that this strategy is not universally applicable; he argues that the necessity of essentialist truths cannot itself be explained by once again appealing to essentialist truths. As a consequence, Hale holds that there are basic necessities that cannot be explained. Thus, Hale style essentialism falls short of what Wilsch (...) calls the explanation-challenge (EC) for the metaphysics of necessity. Without endorsing the EC, I argue that Hale’s argument for basic, unexplained necessities fails due to a misunderstanding of the structure of essentialist explanations. Getting clear about the structure of essentialist explanations of necessity leads to a re-evaluation of crucial circularity- and regress-arguments that have been discussed in the debate about essentialism. In this article I argue that Hutcheson has a theory of obligation that is different in important ways from the views of his predecessors and that his theory may not be as problematic as critics have claimed. In section (I) I sketch a brief picture of the rich conceptual landscape surrounding the concept of obligation in the Early Modern period. I focus on the five figures Hutcheson explicitly references: Hugo Grotius, Samuel Pufendorf, their French translator and commentator Jean Barbeyrac, as (...) well as G. W. Leibniz and Richard Cumberland. In section (II) I offer an account of Hutcheson’s theory of obligation and illustrate that not only does Hutcheson have a view on what previous figures called the source, end, and object of obligation, he also focuses on the epistemological question of the origin of our idea of obligation as opposed to the metaphysical question of the efficient cause of obligation. Furthermore, although Hutcheson shares with his predecessors the idea that obligation implies a certain kind of necessity, he conceives of this necessity in a unique way, namely in terms of the necessity of a perception. In section (III) I defend Hutcheson’s theory of obligation against three objections: 1. that it makes a sham of obligation by locating its source within the human being, 2. that it is reducible to divine command theory, and 3. that, in the end, Hutcheson has no real or meaningful theory of obligation. My hope is that, at the very least, appraising these objections helps further clarify the theory of obligation that Hutcheson presents in his works. (shrink)

Several interpreters argue that Kant believes we have a duty to act “from duty.” If there is such a duty, however, then Kant's moral theory faces a serious problem, namely that of an allegedly vicious infinite regress of duties. No serious attempt has been made to determine how Kant might respond to this problem and insufficient work has been done to determine whether he even believes we have a duty to act from duty. This chapter illustrates that Lambert’s works focus not only on mathematical and scientific topics but include reflections on issues in practical philosophy as well. I illustrate, first, that Lamber conceives of moral science [Moral] as the theory of moral judgement and, second, that an important part of this science illustrates how we are to distinguish moral truth from moral illusion.

The fact of evolution raises important questions for the position of moral realism, because the origin of our moral dispositions in a contingent evolutionary process is on the face of it incompatible with the view that our moral beliefs track independent moral truths. Moreover, this meta-ethical worry seems to undermine the normative justification of our moral norms and beliefs. If we don’t have any grounds to believe that the source of our moral beliefs has any ontological authority, how can our (...) moral judgments be justified in an objective way? In this chapter, I argue that while traditional moral realism is untenable in the light of evolution, normative justification should not be handed the same fate. It is precisely in the fact that moral norms and beliefs are grounded in evolved, innate and therefore universally shared intuitions that those norms and beliefs can be objective-for-us. Such an internalist justification allows us to differentiate moral right from wrong, not because some feature of the external world forces us to acknowledge this, but because our moral nature forces us to project this moral judgment on the world. What’s more, guided by this innate moral compass we can both assess and realize moral progress. (shrink)

The debate about scientific realism is concerned with the relation between our scientific theories and the world. Scientific realists argue that our best theories or components of those theories correspond to the world. Anti-realists deny such a correspondence. Traditionally, this central issue in the philosophy of science has been approached by focusing on the theories themselves (e.g., by looking at theory change or the underlying experimental context). I propose a relatively unexplored way to approach this old debate. In addition to (...) focusing on the theory, we should focus on the theorizer. More precisely, in order to determine on which component of a theory we should hinge a realist commitment, we should analyze the cognitive processes underlying scientific theorizing. In this paper I do just that. Drawing from recent developments in the cognitive sciences and evolutionary epistemology, I formulate some tentative conclusions. The aim of this paper is not so much to defend a particular position in the debate on scientific realism but to showcase the value of taking a cognitive perspective in the debate. (shrink)

In this article, I vindicate the longstanding intuition that the Stoics are transitional figures in the history of ethics. I argue that the Stoics are committed to thinking that the ideal of human happiness as a life of virtue is impossible for some people, whom I dub ‘hopeless fools.’ In conjunction with the Stoic view that everyone is subject to the same rational requirements to perform ‘appropriate actions’ or ‘duties’ (kathēkonta/officia), and the plausible eudaimonist assumption that happiness is a source (...) of normative reasons only if it is in principle attainable, the existence of hopeless fools demonstrates that the Stoics were pluralists about the ultimate justificatory basis of rational action. Hopeless fools are required to behave just like their non-hopeless counterparts, not because doing so is conducive to their happiness, but because doing so conforms with the dictates of Right Reason. In all three of his major works on moral philosophy, Kant conceives of moral obligation, moral permissibility, and moral impermissibility in decidedly modal terms, namely in terms of moral necessity, moral possibility, and moral impossibility respectively. This terminology is not Kant’s own, however, but has a rather long history stretching back to a group of Spanish Jesuit theologians in the early seventeenth century, and it was used in two contexts: first, in the context of divine and human action to explain (...) how volition can be both metaphysically and physically free and yet morally necessary, and second in a deontic context to refer to moral obligation, permissibility, and impermissibility. In this paper, my first and primary aim is to sketch the way in which four of Kant’s most important German predecessors, namely Leibniz, Christian Wolff, Alexander Gottlieb Baumgarten, and Christian August Crusius, used the language of moral necessity, possibility, and impossibility in both the context of action and obligation. My second, more limited aim is to suggest that Kant’s use of these terms can be clarified by taking this background into consideration. (shrink)

I develop a contractualist theory of just intelligence collection based on the collective moral responsibility to deliver security to a community and use the theory to justify certain kinds of signals interception. I also consider the rights of various intelligence targets like intelligence officers, service personnel, government employees, militants, and family members of all of these groups in order to consider how targets' waivers or forfeitures might create the moral space for just surveillance. Even people who are not doing anything (...) prejudicial to other states' security can be modeled as ceding rights against diagnostic collection--light touch collection limited to ascertaining if someone is likely an intelligence threat--as part of their duty to support just foreign institutions. Foreign intelligence officers could not perform the same job potential targets can reasonably demand their intelligence agencies perform on their behalf without this ceding of rights. More invasive forms of collection can only be justified if officers can reasonably model their citizens consenting to being the target of the same sort of collection by adversary states. (shrink)

Empirical evidence from developmental psychology and anthropology points out that the human mind is predisposed to conceptualize the world in particular, species-specific ways. These cognitive predispositions lead to universal human commonsense views, often referred to as folk theories. Nevertheless, humans can transgress these views – i.e. they can contradict them with alternative descriptions, they perceive as more accurate – as exemplified in modern sciences. In this paper, I enquire about the cognitive faculties underlying such transgressions. I claim that there are (...) three faculties enabling us to part with these universal commonsense views of the world imposed by our nature. The first is our ability to represent representations – i.e. to form metarepresentations. The second is our ability to produce alternative representations both by explaining a familiar subject matter in terms of the principles governing different conceptual domains than the one that we are predisposed to apply to the subject matter and by directing our mind to new subject matters (for which we have no predisposed conceptual grasp), understanding them in terms of familiar domains. The third, finally, is our ability to give these representations an epistemic orientation. Case studies about institutional pressures encouraging dishonesty in the US Navy.

The ‘black box’ in Stoic axiology refers to the mysterious connection between the input of Stoic deliberation (reasons generated by the value of indifferents) and the output (appropriate actions). In this paper, I peer into the black box by drawing an analogy between Stoic and Kantian axiology. The value and disvalue of indifferents is intrinsic, but conditional. An extrinsic condition on the value of a token indifferent is that one's selection of that indifferent is sanctioned by context-relative ethical principles. The (...) value of an indifferent that does not meet this condition is normatively silenced, such that it fails to constitute a reason for action. (shrink)

In the first ever commentary on the Groundwork, one of Kant’s earliest critics, Gottlob August Tittel, argues that the categorical imperative is not a new principle of morality, but merely a new formula. This objection has been unjustly neglected in the secondary literature, despite the fact that Kant explicitly responds to it in a footnote in the second Critique. In this paper I seek to offer a thorough explanation of both Tittel’s ‘new formula’ objection and Kant’s response to it, as (...) well as illustrate its significance. I argue that the objection is in fact the third step in a line of argument that Tittel presents in his commentary, and that the objection is best understood within this context. I analyze Kant’s response in the second Critique footnote line-by-line so as to show that Kant both clarifies that it was never his aim to offer a new principle, but only ‘establish’ the principle that common human reason already implicitly employs. Furthermore, I show that Kant uses the opportunity to clarify the sense in which the categorical imperative is a ‘formula [Formel]’, namely as a representation of a complicated and abstract principle, like the moral law, in a way that is easier to understand and apply. I conclude by illustrating the fourth step in Tittel’s line of argument, which makes the overall significance of the ‘new formula’ objection clear: for Tittel, the problem is not that Kant seems to be offering merely a new formula, but that the categorical imperative lacks a foundation. Influential thinkers such as Young, Sugden, Binmore, and Skyrms have developed game-theoretic accounts of the emergence, persistence and evolution of social contracts. Social contracts are sets of commonly understood rules that govern cooperative social interaction within societies. These naturalistic accounts provide us with valuable and important insights into the foundations of human societies. However, current naturalistic theories focus mainly on how social contracts solve coordination problems in which the interests of the individual participants are aligned, not competition problems in which (...) individual interests compete with group interests. In response, I set out to build on those theories and provide a comprehensive naturalistic account of the emergence, persistence and evolution of social contracts. My central claim is that social contracts have culturally evolved to solve cooperation problems, which include both coordination and competition problems. I argue that solutions to coordination problems emerge from “within-group” dynamics, while solutions to competition problems result largely from “between-group” dynamics. (shrink)

In this paper, I outline the ways that reification as a pathology of what I call “cybernetic society” shapes the fundamental structures of the self and our shared social reality. Whereas the classical theory of reification was a diagnostic attempt to understand the failure of class consciousness, I believe we must push this thesis further to show how is fundamentally an ontological and not a merely cognitive or epistemic concern. By this I mean that it is a pathology of consciousness (...) as well as social praxis and, as such, infects the ontological substrates of social reality. In effect, reification is a collective rather than merely subjective phenomenon. I explore this dialectic between our subjective and social dimensions of being to show how reification actively shapes self and world. I end with a discussion of how this theory of reification as an ontological concept can be used to overcome it via what I term “ontological coherence,” or the capacity of the self to reflect dialectically on the shapes of sociality that one inhabits, opening it up to evaluative reflection and critique. Husserl famously argues that it is essential to perception to present the perceived object in perspectives. Hence, there is no – and there cannot be – perception without perspectival givenness. Yet, it seems that there are counterexamples to this essentialist claim, for we seem to be able to imagine beings that do not perceive in perspectives. Recently, there have been some accounts in the literature that critically discuss those counterexamples and assess to what extent they succeed in challenging Husserl’s essentialist (...) claim. In this paper I discuss three different answers to these counterexamples, all of them are found wanting. I offer a novel solution, taking into account some crucial findings of the contemporary debate about imagination and modality. I argue that this new solution is capable of fully vindicating Husserl’s essentialist claim. Finally, I reconstruct Husserl’s own way to treat such counterexamples, in order to showcase the notion of modality Husserlian phenomenology relies on. I argue for the hitherto widely underappreciated point that Husserl’s transcendental phenomenology cannot appeal to strictly absolute modality but that the kind of modality in Husserlian phenomenology is conditional on the facticity that we have the transcendental structure we do in fact have. Finean essentialists take metaphysical necessity to be metaphysically explained by essence. But whence the explanatory power of essence? A recent wave of criticism against the Finean account has put pressure on essentialists to answer this question. Wallner and Vaidya (2020) have responded by offering an axiomatic account of the explanatory power of essence. This paper discusses their account in light of some recent criticism by Bovey (2022). Building on work by Glazier (2017), Bovey succeeds in showing that Wallner and Vaidya’s (...) account is in need of modification and clarification. In this paper, I take up Bovey’s challenge and argue that Wallner and Vaidya have the resources available to incorporate the necessary modifications. I discuss the details of this modification, specifically, the question of what kind of metaphysical explanation is at work in the explanation of the necessity of essence itself. To get clear on this, I will introduce the distinction between generative and non-generative metaphysical explanation. In this way the paper contributes to both, the debate about whether essences can explain necessity and to the ongoing debate about metaphysical explanation. (shrink)

This chapter will develop standards for assessing individual moral responsibility for collective action. In some cases, these standards expand a person’s responsibility beyond what she or he would be responsible for if performing the same physical behavior outside of a group setting. I will argue that structural differences between two ideal types of groups— organizations and goal- oriented collectives— largely determine the baseline moral responsibility of group members for the group’s collective action. (Group members can be more or less responsible (...) for collective action beyond that baseline due to personal qualities like knowledge of the intended collective outcome.) The same individual physical behavior can make the member of a goal-oriented collective responsible for the entire collective action to an equal degree with her fellow group members, whereas the typical organization member is only responsible for his contributory action. Humans often behave altruistically towards strangers with no chance of reciprocation. From an evolutionary perspective, this is puzzling. The evolution of altruistic cooperative behavior—in which an organism’s action reduces its fitness and increases the fitness of another organism —only makes sense when it is directed at genetically related organisms or when one can expect the favor to be returned. Therefore, evolutionary theorists such as Sober and Wilson have argued that we should revise Neo-Darwininian evolutionary theory. They argue that human altruism (...) evolved through group selection in which groups of altruists were naturally selected because they had a comparative advantage over other groups. Wilson and Sober’s hypothesis attracted followers but is rejected by most of their peers. The heated debate between advocates and critics of group selection often suffers from a lack of conceptual clarity. In response, I set out to clearly distinguish ‘genetic’ from ‘cultural’ group selection and argue that the latter does not face the potentially debilitating problems plaguing the former. I defend the claim that human altruistic dispositions evolved through cultural group selection and gene-culture coevolution and offer empirical evidence in support. I also argue that actual altruistic behavior often goes beyond the kind of behavior humans have evolved to display. Conscious and voluntary reasoning processes, I show, have an important role in altruistic behavior. This is often overlooked in the scientific literature on human altruism. (shrink)

The article assesses different models of professional ethics and develops a model which sees professional imperatives as the institutionally-guided expression of foundational moral principles. This article uses the model to assess the moral pressures placed on interrogators in undercover operations in which a detective poses as a suspect in pre-arraignment holding. While highly effective, the level of empathetic rapport required risks incurring compassion fatigue and burn out on the part of detectives.

Nanotechnology (henceforth NT) is a rapidly advancing field with the potential of revolutionizing diverse areas such as electronics, healthcare, transport and energy production. NT products and applications come with (potential) benefits and (potential) harms. The presence of potential harms calls for regulation. Both under- and overregulation – I argue – are morally undesirable. In the case of underregulation, stakeholders fall victim to the harmful effects of the technology. In the case of overregulation, stakeholders are deprived of the benefits of the (...) technology. In this chapter, I identify the biases and factors that lead to under- and overregulation and offer solutions in response. More precisely, I argue that a lack of specific regulation, the presence of conflicts of interest and short-term economic incentives could lead to the underregulation of NT products and applications. Conversely, I argue that a negativity bias, harm aversion, the fear of opening ‘Pandora’s box’ and the intuition that what is natural is good and what is artificial (human-made) is bad could lead to overregulation. To avoid these pitfalls and the woes of under- and overregulation following in their wake, we need to set up a process – which I describe – in which policymakers and independent scientists closely collaborate. In this chapter I evaluate whether Garve was a ‘eudaimonist’, as Kant famously alleged he was. In the first sections of the paper I clarify that eudaimonism can mean either that happiness is the final end of creation, or that human beings are always motived by the desire for happiness, and I discuss Garve’s engagement with Aristotle’s understanding of eudaimonia. I then provide an account of Garve’s understanding of happiness and discuss his theory of motivation before arguing that Garve believes (...) that happiness is both the final end of creation and ultimate end of all human action. I suggest, however, that although Garve is an egoist of sorts, he should not be classified as a hedonist. (shrink)

An assessment of Martha Nussbaum's capabilities approach with respect to religion. I contend that her contribution to John Rawls's project of political-liberalism would be less accommodating of religion, specifically illiberal religions, than it desires to be. This feature weakens the capabilities approach as a foundation for inclusive and stable political institutions in pluralistic societies.

This paper argues that Kant’s most famous objection to the ontological argument -- that existence is not a real predicate -- is not, in fact, his most effective objection, and that his ”neglected objection’ to the argument deserves to be better known. It shows that Kant clearly anticipates William Rowe’s later objection that the argument begs the question, and discusses why Kant himself seems to have overlooked the force of this criticism in his attempt to demolish the traditional proofs for (...) This paper will address the moral implications of non-coercive interrogations in intelligence contexts. U.S. Army and CIA interrogation manuals define non-coercive interrogation as interrogation which avoids the use of physical pressure, relying instead on oral gambits. These methods, including some that involve deceit and emotional manipulation, would be mostly familiar to viewers of TV police dramas. As I see it, there are two questions that need be answered relevant to this subject. First, under what circumstances, if any, may a state (...) agent use deception or manipulation in the course of his or her duties? Second, if there are classes of persons who, by their activities, lose a legitimate expectation for honest-dealing, how are state agents to proceed when the identity of such persons is unclear? Starting from the premise that akrasia is irrational, I argue that it is always a rational mistake to have false beliefs about the requirements of rationality. Using that conclusion, I defend logical omniscience requirements, the claim that one can never have all-things-considered misleading evidence about what's rational, and the Right Reasons position concerning peer disagreement.

In an important article published in this journal, Dryzek, Bächtiger and Milewicz (2011) champion the convocation of a Deliberative Global Citizens’ Assembly (DGCA). In this article, I aim to further strengthen the case for a DGCA by addressing: (i) why a DGCA is likely to take a long-term perspective in the global interest and (ii) why it is so vital that a global institution should do so. I start by analyzing the nature of the issues requiring global policy. These issues, (...) I will argue, are typically global cooperation problems. Cooperation problems pose two major challenges. The first is to prevent freeriding – i.e. serving one’s short-term interests at the expense of the long-term global interest. The second is to align on an efficient global policy. In both respects, I will argue, a DGCA is a good candidate to yield desirable results (and is likely to do better than current supranational institutions). (shrink)

This chapter addresses the morality of two types of national security electronic surveillance (SIGINT) programs: the analysis of communication “metadata” and dragnet searches for keywords in electronic communication. The chapter develops a standard for assessing coercive government action based on respect for the autonomy of inhabitants of liberal states and argues that both types of SIGINT can potentially meet this standard. That said, the collection of metadata creates opportunities for abuse of power, and so judgments about the trustworthiness and competence (...) of the government engaging in the collection must be made in order to decide whether metadata collection is justified in a particular state. Further, the moral standard proposed has a reflexive element justifying adversary states’ intelligence collection against one another. Therefore, high-tech forms of SIGINT can only be justified at the cost of justifying cruder versions of signals intelligence collection practiced by a state’s less-advanced adversaries. (shrink)

This article discusses the rights enjoyed by irregular combatants in detention, that is, members of organized groups (who may be fighting an insurgency or engaging in terror attacks) who fail to qualify for POW status. The paradigmatic example of such a detainee would be an al-Qaeda agent.

Et qui plus est, cela satisfait un désir pour le transcendant, parce que, dans la mesure où les gens pensent qu’ils peuvent voir les ‘«limites de la compréhension humaine », ils croient bien sûr ce ils peuvent voir au-delà de ceux-ci. Cette citation est de Ludwig Wittgenstein qui a redéfini la philosophie il ya 70 ans (mais la plupart des gens n’ont pas encore de le savoir). Dennett, bien qu’il ait été un philosophe pendant une quarantaine d’années, est l’un d’entre eux. Il est également curieux que lui et son antagoniste principal, John Searle, étudié sous les célèbres Wittgensteiniens (Searle avec John Austin, Dennett avec Gilbert Ryle) mais Searle plus ou moins obtenu le point et Dennett n’a pas, (bien qu’il est étirer les choses à appeler Searle ou Ryle Wittgensteinians).
