Martin Luther affirms his theological position by saying “Here I stand. I can do no other.” Supposing that Luther’s claim is true, he lacks alternative possibilities at the moment of choice. Even so, many libertarians have the intuition that he is morally responsible for his action. One way to make sense of this intuition is to assert that Luther’s action is indirectly free, because his action inherits its freedom and moral responsibility from earlier actions when he had alternative possibilities and (...) those earlier directly free actions formed him into the kind of person who must refrain from recanting. Surprisingly, libertarians have not developed a full account of indirectly free actions. I provide a more developed account. First, I explain the metaphysical nature of indirectly free actions such as Luther’s. Second, I examine the kind of metaphysical and epistemic connections that must occur between past directly free actions and the indirectly free action. Third, I argue that an attractive way to understand the kind of derivative moral responsibility at issue involves affirming the existence of resultant moral luck. (shrink)

I distinguish three senses of the term chance I thenargue that van Inwagen''s case for free will mystrianism fails,since there is no single construal of the term change on whichall of the premises of his argument for (...) free will–causalindeterminism incompatibilism are true. A common compatibilist view says that we are free and morally responsible in virtue of the ability to respond aptly to reasons. Many hold a version of this view despite disagreement about whether free will requires the ability to do otherwise. The canonical version of this view is reductive. It reduces the pertinent ability to a set of modal properties that are more obviously compatible with determinism, like dispositions. I argue that this and any reductive view of abilities faces a (...) significant challenge: it cannot adequately explain the freedom-grounding element of this ability. The problem has the form of a dilemma. This leaves reasons-responsive compatibilists with two options: abandon theories of free will grounded in abilities or abandon reductive theories of abilities. The modal collapse objection to classical theism has received significant attention among philosophers as of late. My aim in this paper is to advance this blossoming debate. First, I briefly survey the modal collapse literature and argue that classical theists avoid modal collapse if and only if they embrace an indeterministic link between God and his effects. Second, I argue that this indeterminism poses two challenges to classical theism. The first challenge is that it collapses God’s status as an intentional (...) agent who knows and intends what he is bringing about in advance. The aim of this paper is to establish that free agency, which is a capacity of many animals including human beings, is compatible with indeterminism: an indeterministic world allows for the existence of free agency. The question of the compatibility of free agency and indeterminism is less discussed than its mirror image, the question of the compatibility of free agency and determinism. It is, however, of great importance for our self-conception as free agents in our (arguably) indeterministic world. We begin (...) by explicating the notions of indeterminism and free agency and by clarifying the interrelation of free agency and the human-specific notion of free will. We then situate our claim of the compatibility of free agency and indeterminism precisely in the landscape of the current debate on freedom and determinism, exposing an unhappy asymmetry in that debate. Then we proceed to make our case by describing the mathematically precise, physically motivated model of projective simulation, which employs indeterminism as a central resource for agency modeling. We argue that an indeterministic process of deliberation modeled by the dynamics of projective simulation can exemplify free agency under indeterminism, thereby establishing our compatibility claim: Free agency can develop and thrive in an indeterministic world. The dilemma of free will is that if actions are caused deterministically, then they are not free, and if they are not caused deterministically then they are not free either because then they happen by chance and are not up to the agent. I propose a conception of free will that solves this dilemma. It can be called agent causation but it differs from what Chisholm and others have called so.

Peter van Inwagen famously offers a version of the luck objection to libertarianism called the ‘Rollback Argument.’ It involves a thought experiment in which God repeatedly rolls time backward to provide an agent with many opportunities to act in the same circumstance. Because the agent has the kind of freedom that affords her alternative possibilities at the moment of choice, she performs different actions in some of these opportunities. The upshot is that whichever action she performs in the actual-sequence is (...) intuitively a matter of mere chance. I explore a new response to the Rollback Argument. If there are true counterfactuals of libertarian freedom, then the agent performs the same action each time she is placed in the same circumstance, because that is what she would freely do in that circumstance. This response appears to negate the chancy intuition. Ultimately, however, I argue that this new response is unsuccessful, because there is a variant of the Rollback Argument that presents the same basic challenge to the libertarian on the assumption that there are true counterfactuals of libertarian freedom. Thus, true counterfactuals of libertarian freedom do not provide the libertarian with a solution to the Rollback Argument. (shrink)

Mental causation, idea that it is us – via our minds – who cause bodily actions is as commonsensical as it is indispensable for our understanding of ourselves as rational agents. Somewhat less uncontroversial, but nonetheless widespread (at least among ordinary people) is the idea that the mind is non-physical, following the intuition that what is physical can neither act nor think nor judge morally. Taken together, and cast into a metaphysical thesis, the two intuitions yield interactive dualism: the view (...) that human persons and their minds are non-physical but can nonetheless interact with their bodies, most notably through their brains. This thesis has two main objectives: first, to defend interactive dualism against objections, and second, to show how it can blend in with a physical world in which laws of nature hold. The first part (chapter 1) consists in a brief motivation of interactive dualism as opposed to non-interactive dualism. I argue that non-interactive, epiphenomenalist dualism sacrifices so many crucial aspects of our human existence that interactive dualism is highly to be preferred to it, barring even stronger counterarguments against the latter. It is those putative counterarguments I address in parts II and III. Part II takes on the philosophical objections from the causal closure of the physical and from causal heterogeneity. The former takes the success of physics and physiology as basis for the doctrine of the causal closure of the physical (CCP). I argue against this that there is not only no convincing argument for CCP, but also that any science-based belief in CCP cannot be epistemically justified. As regards the causal heterogeneity objection, it is ‘weighed and found wanting’, because it relies on unwarranted assumptions about causation. In part III, I examine the objection from energy conservation. It roughly says that if interactive dualism were true, then energy would not be conserved, which physics taught us cannot be the case. My reply is that the underlying conception of energy (and momentum) conservation is wrong-headed and not the one that actual physicists use. Instead of being categorical and global, conservation laws are conditional and local, thereby making natural room for mental interaction. Some dualists, however, have sought to make interactive dualism conservation-friendly, notably by invoking quantum physics; I show that these attempts are unnecessary and create more problems than they solve. Finally, in chapter 9, I turn the tables on non-interactionists by investigating current neurophysiological literature on volitional actions, which, though not addressing the question directly, still encourages the interactive dualist picture more than a non-interactionist one. Part IV is about the interplay between interactive dualism and the laws of nature. The ultimate goal is, if possible, to come up with a theory of the laws of nature that explains the lawlike behavior of nature and at the same time makes room for interaction. I begin by pointing out that the laws of nature are or at least should be what physicalists worry about (chapter 10). I then proceed with a historical survey on the development of the notion of laws of nature (chapter 11) that sheds light on its theistic origin. This is followed by an inquiry into the question how a law of nature could possibly be broken (chapter 12) and a survey of the extant metaphysical theories of the laws of nature with special regard to their receptivity to interaction (chapter 13). Finally, in chapter 14 I develop a theory of the laws of nature both faithful to their divine origin and the possibility of mental interaction: dispositionalist divine decretalism, a synthesis of dispositionalism and Jeffrey Koperski’s divine decretalism. One of the most serious challenges (if not the most serious challenge) for interactive psycho-physical dualism (henceforth interactive dualism or ID) is the so-called ‘interaction problem’. It has two facets, one of which this article focuses on, namely the apparent tension between interactions of non-physical minds in the physical world and physical laws of nature. One family of approaches to alleviate or even dissolve this tension is based on a collapse solution (‘consciousness collapse/CC) of the measurement problem in quantum mechanics (...) (QM). The idea is that the mind brings about the collapse of a superposed wave function onto one of its eigenstates. Thus, it is claimed, can the mind change the course of things without violating any law figuring in physical theory. I will first show that this hope is premature because energy and momentum are probably not conserved in collapse processes, and that even if this can be dealt with, the violations are either severe or produce further ontological problems. Second, I point out several conceptual difficulties for interactionist CC. I will also present solutions for those problems, but it will become clear that those solutions come at a high cost. Third, I shall briefly list some empirical problems which make life even harder for interactionist CC. I conclude with remarks about why no- collapse interpretations of QM don’t help either and what the present study has shown is the real issue for ID: namely to find a plausible integrative view of dualistic mental causation and laws of nature. The problem of luck is advanced and defended against libertarian theories of responsibility-enabling ability. An outline of an account of ability is articulated to explore some features of the sort of ability moral responsibility requires. The account vindicates the luck objection and suggests a novel puzzle: Libertarianism is structurally barred from answering the problem of luck because responsibility requires, but inherently lacks, an explanation from reason states to actions that preserves reliability of connection between responsibility-grounding reasons-sensitivity and action.

Since our moral and legal judgments are focused on our decisions and actions, one would expect information about the neural underpinnings of human decision-making and action-production to have a significant bearing on those judgments. However, despite the wealth of empirical data, and the public attention it has attracted in the past few decades, the results of neuroscientific research have had relatively little influence on legal practice. It is here argued that this is due, at least partly, to the discussion on (...) the relationship of the neurosciences and law mixing up a number of separate issues that have different relevance on our moral and legal judgments. The approach here is hierarchical; more and less feasible ways in which neuroscientific data could inform such judgments are separated from each other. The neurosciences and other physical views on human behavior and decision-making do have the potential to have an impact on our legal reasoning. However, this happens in various different ways, and too often appeal to any neural data is assumed to be automatically relevant to shaping our moral and legal judgments. Our physicalist intuitions easily favor neural-level explanations to mental-level ones. But even if you were to subscribe to some reductionist variant of physicalism, it would not follow that all neural data should be automatically relevant to our moral and legal reasoning. However, the neurosciences can give us indirect evidence for reductive physicalism, which can then lead us to challenge the very idea of free will. Such a development can, ultimately, also have repercussions on law and legal practice. (shrink)

The Direct Argument for the incompatibility of determinism and moral responsibility is so christened because this argument allegedly circumvents any appeal to the principle of alternate possibilities – a person is morally responsible for doing something only if he could have avoided doing it – to secure incompatibilism. In this paper, I first summarize Peter van Inwagen’s version of the Direct Argument. I then comment on David Widerker’s recent responses to the argument. Sometimes you make a choice. Whether or not you made it was up to you. The choice was free. But how can this be? A scientific view of the world may leave no room for free choice. Free will literature continually explodes. Yet experts still focus on control or on a power to do otherwise. Sadly, they neglect another intuitive feature of free will: being an underived source or ultimate originator. When acting freely, one is a self-determined, self-directed, sole author (...) of change. Surprisingly, though the literature is replete with this pre-theoretic feature of free will, virtually no one makes rigorous use of it when constructing arguments. Equipped with fresh research, this book contends that agent-causation—currently an unpopular theory—deserves serious reconsideration. Only agent-causation accounts for ultimate origination, and popular objections fail under rigorous scrutiny. This book is tightly argued. It challenges and deepens recent advances in free will scholarship made by Peter van Inwagen, Robert Kane, Carl Ginet, Randy Clarke, Stewart Goetz, Tim O’Connor, and others. (shrink)

If God brings about an event in the universe, does it have a preceding cause? For example, if the universe began with the Big Bang and if God brought it about, did the Big Bang then have a preceding cause? The standard answer is: yes, it was caused by a divine willing. I propose an alternative view: God’s actions, unlike human actions, are not initiated by willings, undertakings, or volitions, but God brings about the intended event directly. Presenting a solution (...) to the dilemma of free will I explain what ‘bringing about directly’ means and show that the question of what an action begins with is distinct from the question whether it is a basic action. Famed so-called 'Frankfurt-type examples' have been invoked to cast doubt on the principle that a person is morally responsible for what she has done only if she could have done otherwise. Many who disagree that the examples are successful in this respect argue that these examples succumb to a deadly dilemma. I uncover and assess libertarian assumptions upon which the 'dilemma objection' is based. On exposing these assumptions, it becomes clear that various sorts of libertarian are no longer entitled to (...) one or the other horns of the dilemma. (shrink)

Something is a matter of luck if it is beyond our control. In this paper, I argue for the primary thesis that luck can undermine varieties of obligation, such as moral and prudential obligation, as well as judgments that are best from an agent’s own point of view. Among the considerations invoked to defend this thesis is a prevalent form of libertarianism, event-causal libertarianism. Arguments for the primary thesis that call on event-causal libertarianism raise concerns with this variety of libertarianism.

Chisholm's theory of agent causation is criticised. An alternative theory of agent causation is proposed.

In this project, I will analyze, summarize, and critique the incompatibilist theory known as source incompatibilism, which argues that a moral agent is morally responsible for an action only if they are the proper source of that action. More specifically, I will analyze the source incompatibilist views of event-causal incompatibilism, which argues that an agent has free will only if there exists indeterminacy in her decision-making process, either before the formation of a decision itself of during the formation of a (...) decision. I will argue that event-causal incompatibilist views suffer from problems of control and moral chanciness. Thus I will argue that event-causal incompatibilism is no more philosophically tenable than its compatibilist counterparts. If this is true, the event-causal incompatibilist ought to abandon it due to considerations of parsimony. After I have successfully refuted event-causal incompatibilism, I will introduce a novel theory of moral responsibility compatibilism of my own, which I will argue is the only tenable philosophical theory left for the proponent of event-causal incompatibilism. I will attempt to reconcile moral responsibility with causal determinism, utilizing an argument from the philosophy of David Enoch in his book Taking Morality Seriously. When this is complete, I will defend my compatibilist theory from various objections by philosophers Saul Smilansky and Ishtiyaque Haji. I will end the discussion with a brief introduction to other non-libertarian views of moral responsibility and determinism, which do not require libertarian notions of free will and thus do not require indeterminacy for freedom. These include Saul Smilansky’s illusionism and Derk Pereboom’s hard incompatibilism. I will analyze these views, but ultimately I will critique them. I will argue that these theories also are lacking, and so they are not viable alternatives to the proponent of moral responsibility. (shrink)

This paper highlights and discusses some key positions on free will and moral responsibility that I have defended. I begin with reflections on a Strawsonian analysis of moral responsibility. Then I take up objections to the view that there is an asymmetry in freedom requirements for moral responsibility and moral obligation: obligation but not responsibility requires that we could have done otherwise. I follow with some thoughts on the viability of different sorts of semi-compatibilism. Next, I turn to defending the (...) “luck objection“ to a popular libertarian account of the control that responsibility requires. This is, roughly, the objection that when our decisions are indeterministically caused, their occurrence is a matter of responsibility-undermining luck. Finally, I comment on Frankfurt examples.
