This chapter investigates how a reading of Wittgenstein along the lines laid out by Cora Diamond makes room for a novel approach to ethical truth. Following Diamond, I develop the connection between the kinds of elucidatory propositions by means of which we spell out and maintain the shape of our theoretical thinking, such as “‘someone’ is not the name of someone” and “five plus seven equals twelve,” and the kind of propositions by means of which we spell out and maintain (...) the shape of ethical thinking, such as “slavery is unjust.” As Diamond points out in connection with the last example, this is a proposition that we take to be an undeniable truth; for anyone who would attempt to negate it would become unintelligible to us. In this sense this ethical truth spells out the limits of ethical thinking. And yet what counts as coherent thought about such matters tends to shift over time. Indeed the great difficulty of overcoming ethical disagreements has to do with the fact that what is at stake in them is not just the content, but the form and limits of thought. Nonetheless, Diamond proposes that ethical propositions may count as genuine truths. For this to make sense, a middle path between realism and relativism must be found. In order to show how this is possible, and in order to defend Diamond’s view, I propose to approach ethical truth by means of a disjunctivist strategy. On this approach, while we, just as much as our interlocutor, may at times be misled in our ethical thinking, and while we may at times fail to shape our ethical thought in ways that prevent us from gaining clarity on ethical matters, this does not detract from the fact that we may at times be right, and that we may then genuinely possess ethical truth. This dissertation addresses a debate about the proper relationship between democratic theory and institutions. The debate has been waged between two rival approaches: on the one side is an aggregative and economic theory of democracy, known as constitutional economics, and on the other side is deliberative democracy. The two sides endorse starkly different positions on the issue of what makes a democracy legitimate and stable within an institutional setting. Constitutional economists model political agents in the same way that neoclassical economists (...) model economic agents, that is, as self-regarding, rational maximizers; so that evaluations of democratic legitimacy and stability depend on the extent to which the design of institutional rules and practices maximize individual utility by promoting efficient schemes of collective choice. Deliberative democrats, on the other hand, understand political agents as communicative reason-giving subjects who justify their preferences and positions on issues that jointly affect them in a process of consensus-directed discourse, or deliberation; so that evaluations of democratic legitimacy and order depend on the degree to which institutional norms and practices promote deliberation and draw upon deliberated public judgment. I argue that despite the numerous incompatibilities between constitutional economics and deliberative democracy—which amount to a 'deep divide'—an opportunity to produce a genuine synthesis of the two approaches arises inasmuch as it is possible to overcome several points of opposition in their separate research programmes. The central thesis of the dissertation is that it is possible to construct a bridge spanning the divide between constitutional economists and deliberative democrats, and that Dewey and Bentley's transactional view can facilitate this bridge-building project. Pursuant to this end, the points of opposition between the v research programmes are mediated by way of five concepts which, on balance, favor deliberative democracy and its feasible institutionalization. The social intuitionist approach to moral judgments advanced by social psychologist Jonathan Haidt presupposes that it is possible to provide an explanation of the human moral sense without normative implications. By contrast, Iris Murdoch’s philosophical work on moral psychology suggests that every description of morality necessarily involves evaluative features that reveal the thinker’s own moral attitudes and implicit philosophical pictures. In the light of this, we contend that Haidt’s treatment of the story about Julie and Mark, two siblings who decide (...) to have casual, protected, and in his view harmless sex, provides a too simplistic picture of what is involved in understanding human morality. Despite his aim to explain the roots of moral judgments, he fails to provide a deeper understanding of morality in two different respects. First, he does so by suggesting that his story contains all the relevant information needed to take a moral stand on it, and by rejecting as irrelevant the wider human context in which questions about sexual and family relations arise. Second, he simplifies the responses of the people who are subject to his experiment by disregarding their various reasons for disapproving and by equating understanding human morality with explaining an impersonal psychological process. The text deals with the role of particular examples in our understanding, especially in the encounters with unfamiliar cases that may require us to expand our concepts. I try to show that Peter Winch’s reflections on the nature of understanding can provide the foundations for such an account. Understanding consists in a response informed by a background network of particular canonical examples. It is against this background that the distinction between appropriate differentiated reactions and misplaced ones makes sense. To accommodate (...) applications of known concepts to unfamiliar cases, particular examples are needed that invite the recipient in a certain direction of understanding, while providing a “closure” against arbitrary mis- or re-interpretations. This capacity has to do with a capacity or incapacity to convey the sense of seriousness of an example dealing with the _lives_ of the persons concerned. (shrink)

Philosophy as well as anthropology is a discipline concerned with what it means to be human, and hence with investigating the multiple ways of making sense of human life. An important task in this process is to remain open to diverse conceptions of human beings, not least conceptions that may on the face of it appear to be morally alien. A case in point are conceptions that are bound up with cannibalism, a practice sometimes assumed to be so morally scandalous (...) that it probably never happens, at least in a culturally sanctioned form. Questioning this assumption, along with Cora Diamond's contention that the very concept of a human being involves a prohibition against consuming human flesh, the present article explores how cannibalism can have an intelligible place in a human society – exemplified by the Wari’ of western Brazil. By coming to see this, we are enabled to enlarge our conception of the heterogeneity of possible ways of being human. (shrink)

Works of art can be difficult in several ways. One important way is by making us face up to unsettling truths. Such works typically receive praise. I maintain, however, that sometimes they deserve moral censure. The crux of my argument is that, just as we have a right to know the truth in certain contexts, so too we have a right not to know it. Provided our ignorance does not harm or seriously endanger others, the decision about whether to know (...) the truth ought to be left to us. Within this limit, therefore, difficult art is morally problematic if it intentionally targets those who have chosen not to know. To illustrate the problem, I discuss the literary writings of Søren Kierkegaard, which aim to deceive readers into seeing unpleasant truths about themselves that they seek to ignore. (shrink)

This article argues that analytic philosophy has a “convincingness deficit”; that proponents of the analytic method’s application to questions of theology must consider whether it is the best tool for the purpose at hand; and that phenomenology – in particular, Sartrean phenomenology – provides a useful methodological complement to the scholarly analysis of faith. After defining the convincingness deficit and what I take analytic theology to be, I defend phenomenology against the charge of “subjectivity” in order to argue that the (...) varied ends of theological discourse require varied means – means which include phenomenology. The aim of this article is to establish—and explore—James Baldwin’s significance for educational theory. Through a close reading of ‘Everybody’s Protest Novel’, I show that Baldwin’s thinking is an important precursor to the work of Stanley Cavell and Cora Diamond, and is relevant to a number of problems that are educationally significant, in particular problems of race and racism.

ABSTRACT This article argues for a unique role of imagination and mental images in the moral education of students. Imagination is rendered here as a capacity oriented toward realizable and salient goals; mental images are understood as particular future-oriented self-representations (FOSRs) devised by and held in imagination. FOSRs have four moral attributes: they are 1) expressive of us as moral agents, 2) shape our moral identity, 3) serve as moral pointers, and 4) help devise mitigating strategies. FOSRs can be created (...) and utilized in educational settings to further the goals of moral education by i) fostering sensitivity to moral situations among students, ii) motivating learners to act morally, iii) facilitating environments supportive of moral practice and moral habituation, and iv) helping strengthen cross-situational consistency of moral action. The four moral attributes of future-oriented self-representations (FOSRs) (1–4) that are to be engaged in moral education to further its goals (i–iv) are correlated with four elements of moral education, namely: a) moral awareness; b) moral competency; c) moral motivation; and d) moral capacity. To argue for the special role of imagination and mental images in moral education this paper integrates philosophical research and conceptual and empirical studies in psychology and education on the morality of imagination and mental images. Subtlety is a concept as deeply intertwined with aesthetic judgements as virtually any other. But it is not clear what makes subtlety a good property of an artwork, or indeed if it is one. In this paper, I explore this under-discussed issue. First, I spend some time setting out hallmarks of subtlety and discussing different ways in which subtlety might be valuable. I then go on to defend a particular view about why subtlety is aesthetically valuable, by thinking through why (...) heavy-handedness is aesthetically bad. In essence, subtlety is valuable because it promotes active engagement with the artwork, and heavy-handedness is bad because it forces us into too passive a role. I connect this to the role of agency and autonomy in artistic experience. Finally, I discuss some related aesthetic concepts, and expand the view of subtlety to cover borderline art forms, nature, and people themselves. (shrink)

I provide an explanation of moral understanding. I begin by describing decisions, es- pecially moral ones. I detail ways in which deviations from an ideal of decision-making occur. I link deviations to characteristic critical judgments, e.g. being cavalier, banal, coura- geous, etc. Moral judgments are among these and carry a particular personal gravity. The question I entertain in following chapters is: how do they carry this gravity? In answering the question, I try “external” accounts of moral understanding. I distin- guish (...) between the ideas of a person and a life. The idea of a life essayed is of a network of relations to others. The character of those relations, e.g. friendship, is the object of our understanding of ourselves and our lives. I argue that one’s understanding of oneself conditions the context of decision-making. I elaborate one way of making moral under- standing answerable to truth using Plato’s metaphysics in the Philebus. Truth is valued and truth is essential to the independence of the moral such that seeming right and being right are distinct. However, truth is neither primary nor exhaustive of morality, because we have additional distinct resources for morally judging others. I turn instead to an “internal” account of moral understanding to answer the question regarding the personal gravity of moral criticism. Using Winch’s work on universalizabil- ity and fellowship, I argue that our conception of others must be sufficient to reflect their individuality within our moral understanding. Second, using Gaita’s work on remorse and the lucidity of self-reflection, I argue that the truth about ourselves and the wrong we do others can arrest and constrain our moral understanding and our authority. Moral understanding operates in a social milieu: argument, conversation and rational- ity. Arguments are grounded in meanings with primary (shared) sense, but solicit agree- ment in secondary sense—of what is similar, of what follows. Meaning in the secondary sense can be necessarily practical, creating practical necessities within points of view. Accounting for the consequences and understanding of disagreement is identified as pressing. An original contribution is the idea of critical authority. One’s articulation of moral meaning is controlled via the critical authority expressed using critical vocabulary. Accepting another’s critical authority is based, in differing domains, on our relation to them, e.g. friendship, trust, fellowship. The nature of inter-personal relations are delim- ited by the critical authority characteristic of those relations. Critical authority explains the independent and personal force of moral criticism. To be intelligible depends on accepting some critical authorities, though I allow for the intelligible repudiation of morality in some circumstances. Wronging someone is ex- plained as denying his critical authority, thus denying his relation to oneself, and thereby undermining his place in the moral world. The consequence of wrongdoing is the disinte- gration of the moral world. I defend against Nagel’s realism and Korsgaard’s constructivism. Both are committed to judging individuals but their accounts of morality undermine the intelligibility of the personal gravity of moral criticism. Developing the idea of Moral Consensus, I defend myself against the related charge of relativism. (shrink)

Various educational strategies use narrative artworks to pursue ethical training purposes. Based on the works of Dewey and Greene I show how these strategies do not always contribute to an aesthetic education ‒one that promotes experiences with artworks in which we develop sensitivities and capacities necessary to more richly, deeply and intensely experience what these and other artworks have to be experienced‒ and therefore end up having an instrumental use. This is the case with the most commonly used strategies: the (...) exemplary modelling strategy ‒which seeks to inspire students through characters that show an admirable moral character‒ and the moral deliberation strategy ‒which extracts dilemmas or moral problems from which characters from the works face to discuss them with the students. From Diamond’s work I show that, at the same time, it is precisely the non-aesthetic nature of these strategies that limits their chances of becoming a fully fledged ethical education. Hence, ethical education through the narrative arts is only fully developed when it is also an aesthetic education, and aesthetic education in the narrative arts is only fully developed when it also deals with matters of moral significance and is therefore also an ethical education. The documentary film is a popular curriculum tool, and the goal of this paper is to expand the educational significance of the documentary genre I argue that current understandings of this genre are limited and limiting, and offer an alternative perspective on the genre. This alternative will be built from Stanley Cavell’s philosophy of education, in particular, his understanding of the role that ‘representativeness’ plays in teaching and learning.

Most punishment theories acknowledge neither the full extent of the harms which punishment risks, nor the caring practices which punishment entails. Consequently, I shall argue, punishment in most of its current conceptualizations is inconsistent with treating offenders as equals qua persons. The nature of criminal punishment, and of our interactions with offenders in punishment decision-making and delivery, risks causing harm to offenders. Harm is normalized when central to definitions of punishment, desensitizing us to unintended harms and obscuring caring practices. Offenders (...) may be partially silenced and excluded by mainstream criminal justice practices which limit interaction between offenders and practitioners. When we ignore significant harms, or silence and exclude, we treat others as passive non-subjects. This partially objectifies offenders, and is inconsistent with treatment as equals. Penal theories employing harm-centred and harm-normalizing definitions of punishment can provide few resources to help practitioners either avoid, or recognize and respond to, harms. Care ethics, by contrast, motivates the avoidance of harm, ongoing inclusive engagement, and respectful interaction with others. I argue that defining punishment without presupposing harm facilitates the identification of morally problematic harms, and recognition of caring practices. I offer a principled argument, and political and pragmatic supplementary arguments, for responding to offenders without intentional harm and with care. Principles drawn from care ethics can help to strengthen mainstream criminal practices by structuring decision-making and action. Bottom-up alternative criminal justice practices share some values with these proposed guiding principles, allowing a partial test of the principles. I consider examples of restorative justice practices, therapeutic jurisprudence, community justice and other problem-solving court practices, in addition to considering how well mainstream punishment practices measure up to these principles. My analysis illuminates the strengths and weaknesses of the principles, and how they might contribute to securing treatment as equals for offenders in mainstream practices. (shrink)

Recognizing yourself in literature cannot only help you to get a clearer grasp of what you already think and feel. It can also deeply unsettle your vision of yourself. This article examines a hitherto neglected mechanism to this effect: learning by way of seeing yourself in others’ blindness. I show that In Search of Lost Time epitomizes this phenomenon. Confronting characters oblivious to their old age makes the protagonist realize that he, too, has aged without noticing it, and invites readers (...) to analogous insights. The paper contributes to the discussion on how you can learn from literature and adds a twist to Proust’s claim that the purpose of literature is that readers recognize themselves in it. (shrink)

Tomando como ponto de partida o conto de Ann Beattie, “Learning to Fall”, o presente texto considera as possibilidades pedagógico-morais abertas à literatura ao traçar um diagnóstico crítico, e negativo, a respeito das falhas das filosofias morais tradicionais quanto ao aspecto mais vulnerável de nossa humanidade, insistindo na importância de um aprendizado amplo, lento e disciplinado de nossas “quedas” através de leituras e amizades essencialmente literárias.

My Cavellian argument is that the form or space of skeptical questioning -- regardless of whether we are asking about the veridicality of the appearance of another's pain, about the veridicality of the meaning of a word or phrase, about the veridicality of a perception, etc. -- leaves behind the ordinary, finite, and social activities and practices which make meaningful language use possible. But Cavell does not mean "left behind" in the sense that returning to these finite and social practices (...) of language use will defeat skepticism; Cavell thinks that the direct attempt to defeat skepticism has still not adequately understood what the appearance of a skeptical problem has deflected. Rather, in Cavell's philosophy, if we return to the everyday use of language after working through the threat of skepticism and after coming to terms with what led us into skeptical thinking, what we find is a renewed relation to the felt life of the ordinary mind, one which acknowledges those unhandsome elements of our condition which skepticism would seek to deny. In later work, Cavell will describe the proper response to skepticism as a transformation of the actual everyday into the eventual everyday. With respect to the question of how language corresponds to or represents the world, I suggest, throughout this dissertation, that this question is a confused response to the fact of our inheritance of language and culture, the fact that we are born into a social, already-made system of meanings over which in many ways we have astonishingly little freedom. And that conclusion, I argue -- the conclusion that a particular form of skepticism deflects -- is yet another starting point for Cavell's philosophy, an insight brought out only through an engagement with skepticism. This article clarifies the puzzling lack of adequate human environmental behavior, the primary driver of the ongoing climate crisis. It advocates using Wittgensteinian attitude analysis as an investigative framework and argues that attitudes toward nature are crucial yet understudied factors in shaping environmental behavior. The study focuses on the Romantic attitude toward nature as wilderness (understood as the negation of extractivism) and reveals its profound yet often misunderstood adverse impact on environmental behavior. This leads to a reflection on which attitude (...) toward nature could foster more adequate environmental behavior, suggesting kinship as its core. (shrink)

A filósofa americana Cora Diamond, especialista em Frege e Wittgenstein, que os lê dando especial atenção à filosofia da linguagem, do pensamento, da lógica e da matemática, tem também coisas importantes a dizer, a partir da maneira wittgensteiniana de ver a filosofia, acerca de filosofia moral. Em particular, ela é fortemente crítica de uma certa forma de conceber a natureza da filosofia moral, muito comum hoje entre os filósofos analíticos, como exclusivamente centrada na acção e na decisão de agentes e (...) em argumentos acerca daquilo que é racional fazer. Foi essa crítica, que podemos considerar feita de um ponto de vista metodológico, que fez Diamond entrar em polémica, há cerca de trinta anos, com autores muito influentes em ética como Peter Singer e Tom Regan, mesmo se partilha com eles muitas intuições. Neste artigo pretendo simplesmente descrever a posição de Diamond acerca da natureza do pensamento moral e do que pensamos que fazemos quando fazemos filosofia moral. Por trás da análise do papel da imaginação moral em ética, está a questão mais geral da natureza do método flosófico. (shrink)

American philosopher Cora Diamond's view of the materials admissible in moral philosophy is bound to strike many analytic philosophers as too broad: they wouldn't dream of thinking of them (namely of literature) as 'part of their job'. This, of course, assumes a conception of the nature of the such job, one in regard to which Diamond expresses doubts of several kinds. In this paper I search for different reasons for those doubts and then try to make the connection clear between (...) Diamond's proposal of a change in 'the way we want to do moral philosophy' and her reading of Wittgenstein on ethical non-sense. Finally, I suggest that although Diamond has a strong case when she defends that the dismissal of literary materials in moral philosophy marks an untenable neutrality ideal, not every aspect of her view of the role of literature in moral philosophy is equally compelling. She recruits literature for two different purposes: countering the prevailing 'blindness to blindness' and countering the lack of awe and the obliviousness to the 'difficulty of reality' in moral thinking. Since these are different purposes, philosophers might be rejecting any of various things when they do not dream of counting literature as part of their job. A concepção dos materiais admissíveis em filosofia moral da filósofa americana Cora Diamond certamente parecerá a muitos filósofos analíticos demasiado lata: muitos são aqueles que nem sonhariam contar materiais literários como 'parte do seu trabalho'. Ora isto presume urna concepção da natureza de tal trabalho, e é quanto a essa concepção que Diamond exprime dúvidas de vários tipos. Neste artigo procuro identificar as diferentes razões para tais dúvidas. Procuro também explicitar a relação da proposta de Diamond de uma alteracão na 'forma como queremos fazer filosofia moral' com a sua leitura de Wittgenstein acerca de nonsense ético. Finalmente, sugiro que se é certo que Diamond tem um caso sólido quando defende que a rejeição de materiais literários na filosofia moral é marca de um indefensável ideal de neutralidade, nem todos os aspectos da sua forma de ver o papel da literatura na filosofia moral são igualmente convincentes. Uma vez que ela recruta a literatura para propósitos distintos - para contrariar a 'cegueira à cegueira' mas também para contrariar a falta de assombro no pensamento moral, que torna este estanque à 'dificuldade da realidade' -, os filósofos que nem sonhariam contar a literatura como parte do seu trabalho podem estar a rejeitar coisas completamente diferentes quando rejeitam o papel da literatura na filosofia moral.
