This paper champions the view (REG) that the concept of a normative reason for an agent S to perform an action A is that of an explanation why it would be good (in some way, to some degree) for S to do A. REG has numerous virtues, but faces some significant challenges which prompt many philosophers to be skeptical that it can correctly account for all our reasons. I demonstrate how five different puzzles about normative reasons can be solved by (...) attention to the concept of goodness, and in particular observing the ways in which it—and consequently, talk about reasons—is sensitive to context (ends and information). Rather than asking simply whether or not certain facts are reasons for S to do A, we need to explore the contexts in which it is and is not correct to describe a certain fact as “a reason” for S to do A. These five puzzles concern: (1) reasons for attitudes of the “right kind”, (2) evidence as reasons, (3) normative facts as reasons, (4) subjective reasons, and (5) attitudes as reasons. (shrink)

In his famous paper John Rawls outlines a version of utilitarianism that takes into account the existing criticism of the utilitarian approach. Author shows that the traditional objections expressed in relation to two test cases of utilitarianism — punishment and promise-keeping — are based on the misunderstanding of utilitarian position, because they don’t make a distinction between justifying a practice and justifying a particular action falling under it. In the case of punishment, there two justifications of it: the retributive view (...) that presupposes that punishment is justified on the grounds that wrongdoing merits punishment, and the utilitarian view that holds that punishment is justifiable only by reference to the probable consequences of maintaining it as one of the devices of the social order. According to the author, utilitarian arguments are appropriate with regard to questions about practices, while retributive arguments fit the application of particular rules to particular cases. In the case of promising, truly utilitarian approach presupposes that promisor must weigh not only the effects of breaking his/her promise on the particular case, but also the effect which his/her breaking promise will have on the practice itself. Author thinks that the distinction between justifying a practice and justifying a particular action falling under it was neglected not only by the critics, but by the utilitarians themselves, due to the prevalence of the summary view of the rules. Rawls suggests his own, practical conception of the rules, that presupposes that practices are prior to particular cases of their application. (shrink)

Contemporary reasoning about health is infused with the work products of experts, and expert reasoning about health itself is an active site for invention and design. Building on Toulmin’s largely undeveloped ideas on field-dependence, we argue that expert fields can develop new inference rules that, together with the backing they require, become accepted ways of drawing and defending conclusions. The new inference rules themselves function as warrants, and we introduce the term “warranting device” to refer to an assembly of the (...) rule plus whatever material, procedural, and institutional resources are required to assure its dependability. We present a case study on the Cochrane Review, a new method for synthesizing evidence across large numbers of scientific studies. After reviewing the evolution and current structure of the device, we discuss the distinctive kinds of critical questions that may be raised around Cochrane Reviews, both within the expert field and beyond. Although Toulmin’s theory of field-dependence is often criticized for its relativism, we find that, as a matter of practical fact, field-specific warrants do not enjoy immunity from external critique. On the contrary, they can be opened to evaluation and critique from any interested perspective. (shrink)

Plato claimed that morality exits to control conflict. Business people increasingly are called upon to resolve moral conflicts between various stakeholders who maintain opposing ethical positions or principles. Attempts to resolve these moral conflicts within business discussions may be exacerbated if disputants have different communicative styles. To better understand the communication process involved in attempts to resolve a moral dilemma, we investigate the "discourse ethics" procedure of Jürgen Habermas. Habermas claims that an individual's level of moral reasoning parallels the type (...) of communication which that individual typically uses in attempts to resolve conflict. Our research focuses upon the relationship between the communicative style used by participants attempting to resolve a particular moral dilemma involving workplace safety and the level of moral reasoning possessed by those participants. The results of our study suggest that, contrary to Habermas' views, participants with "higher" levels of moral reasoning do not use "discursive" communicative tactics more frequently than participants that possessed "lower" moral reasoning. How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

Christian Kock’s essays show the essential interconnectedness of practical reasoning, rhetoric and deliberative democracy. They constitute a unique contribution to argumentation theory that draws on – and criticizes – the work of philosophers, rhetoricians, political scientists and other argumentation theorists. It puts rhetoric in the service of modern democracies by drawing attention to the obligations of politicians to articulate arguments and objections that citizens can weigh against each other in their deliberations about possible courses of action.

The article undertakes the problem of a Wittgensteinian background of Toulmin’s model of argument. While appreciating the original character of the investigations set out by Toulmin in The Uses of Argument, Wittgenstein’s ideas taken to be forerunners of both Toulmin’s philosophical method and the particular elements of the model of substantial argument are traced backward, to Toulmin’s earlier books: The Philosophy of Science (Toulmin, The philosophy of science. An introduction, Hutchinson University Library, London, 1953) and An Examination of the Place (...) of Reason in Ethics (Toulmin, An examination of the place of reason in ethics, Cambridge University Press, Cambridge, 1950). The technique of pinpointing the constituents of that model in the books preceding The Uses of Argument is superposing the layout of Toulmin’s model on the crucial arguments concerning the earlier books: the scientific one based on Newtonian optics and the moral one concerning keeping promises. Such a procedure allows identifying backing for warrants and argument fields with the methods of representation in The Philosophy of Science and with modes of reasoning in An Examination of the Place of Reason in Ethics. The former is traced to passages 6.3 ff of Wittgenstein’s Tractatus, while the latter—to the concept of word-games (the later Wittgenstein’s language games). The claim regarding Wittgenstein’s background is that in Toulmin’s view of Wittgenstein, some parts of Tractatus concerning representing are in line with Wittgenstein’s later reflections on language games; as well as that the overall method of The Uses of Argument goes along with Wittgenstein’s therapeutic approach to philosophical problems that have to be placed in the context of their ordinary use. Twenty-five years ago, field theory was among the most contested issues in argumentation studies. Today, the situation is very different. In fact, field theory has almost disappeared from disciplinary debates, a development which might suggest that the concept is not a useful aspect of argumentation theory. In contrast, I argue that while field studies are rarely useful, field theory provides an essential underpinning to any close analysis of an argumentative controversy. I then argue that the conflicting approaches to argument fields (...) were in fact not inconsistent, but instead reflected different aspects of field practices. A coherent approach to field theory can be developed by considering the way that all aspects of argumentative practice develop based on the purposes of arguers in an argumentative context. I then extend that position to argue that a justifiable theory of argumentation, which makes claims beyond the descriptive, must have at its core an analysis of the way that purpose constrains argumentation practice. In this view, the ultimate justification of principles found in a prescriptive or evaluative theory of argument must be in the way those principles fulfill practical problem-solving purposes related to the epistemic function of argument. Both the sociology of knowledge and the philosophy of science are centrally concerned with the succession of scientific beliefs. In case studies of scientific debates, however, the emphasis tends to be placed on the outcome of disputes. This paper proposes that attention should instead be focused on the process of debate: that is, on scientific argumentation. It is shown how such a focus circumvents many traditional epistemological problems concerning the truth-status of scientific knowledge. By reference to the consensus conception of (...) truth, it is claimed that scientific arguments can be studied naturalistically whilst still honouring the orientation towards truth exhibited by scientists. Finally, the paper offers a brief résumé of recent studies indicating how this naturalistic study of scientific argumentation can be developed through the sociology of language. (shrink)

Assertives have a word-to-world ‘direction-of-fit’: their illocutionary point is that the word should fit the world. Directives and commissives have a world-to-word direction-of-fit: their illocutionary point is to make the world fit the word. Arguments in politics and practical argumentation generally are often about directives or commissives, and many of these cannot meaningfully be reconstructed as assertives. Nevertheless, many theorists of argumentation proceed, tacitly or explicitly, as if all arguments must be about assertives, thereby obfuscating matters.

Since Toulmin’s discovery of the field-dependency of arguments, and Perelman’s emphasis on audiences, argumentation theorists have developed the notion of “spheres of arguments” or “argument communities”. Since argument communities are communities of discourse guided by the participants’ cog-nitive experiences, they are also cognitive communities. “Cognitive breaks” between different argument communities will produce misunderstanding and futile argument. The paper will investigate “cognitive breaks” and describe in which ways they may obstruct reasonable argumentation between communities.

This essay tries to demarcate and analyse Artificial Intelligence ethics. Going away from the traditional distinction in normative, meta, and applied ethics, a different split is executed, inspired by the three most prominent schools of thought: deontology, consequentialism, and Aristotelian virtue ethics. The reason behind this alternative approach is to connect all three schools back to ancient Greek philosophy. Having proven that the majority of arguments derive from some ancient Greek scholars (Socrates, Plato, Aristotle), a new voice is initiated into (...) the discussion, Protagoras the Sophist. A big advocate of -the later conceived- humanism and relativism, Protagoras is used as a prism to examine a new ethical model that is based on the personalization of agents. In other words, even though theories of objectivity have overflown contemporary discussions of finding a robust ethical model for Artificial Intelligence agents, there is potential in a subjective model, personalised after each and every user. Anti-theory is a multi-faceted critique of moral theory which, it appears, is undergoing something of reassessment. In a recent paper Hämäläinen discusses the relevance of an anti-theoretical perspective for the activity of applied ethics. This paper explores her view of anti-theory. In particular I examine its relevance for understanding the formal guidance on pandemic flu planning issues by the Department of Health in the UK and some subsequent discussions around triage and reverse triage decisions which may be considered by both (...) Primary and Secondary Care Trusts. in setting their own policies and which may face clinicians in the eventuality of a pandemic. Following Hämäläinen in contrasting reflective equilibrium with her anti-theory inspired suggestion of an instrumental approach to moral theory in practice I demonstrate how this understanding complements the diversity of our intuitive moral judgements. Consequentially I suggest that this anti-theoretical instrumental approach is in greater accord with the conditions under which such policy planning and decision making is, or will be, made. Furthermore, on the grounds of keeping open the ethical dimensions of medical practice in conditions of uncertainty, i.e. during a pandemic, I suggest that the anti-theoretical instrumental perspective is, ethically, the preferable approach to producing such policies and guidelines.
