Cet article a deux objectifs. Le premier est de montrer pourquoi l’argument instrumental en faveur de la démocratie est insuffisant pour justifier la délibération politique. Si notre but est l’optimisation du potentiel épistémique d’un régime politique, et que des approches agrégatives et inférentielles (sans délibération) atteignent cet objectif, alors nous ne pouvons plus justifier la délibération sur cette base. Ce problème peut être contourné en reprenant une distinction de Daniel Andler. Pour ce dernier, le groupe délibératif se distingue du groupe (...) agrégatif parce qu’il permet aux agents, par une occasion éducative informelle, de se responsabiliser. La délibération présente donc un potentiel épistémique supérieur, mais qui ne se limite pas à identifier la meilleure réponse dans un temps donné. Le second objectif de l’article est de montrer comme l’argument d’Andler fait le pont entre, d’une part, les théories de la justification publique et, d’autre part, les théories de la démocratie épistémique. G. A. Cohen and J. Raz object that Constructivism is incoherent because it crucially deploys unconstructed elements in the structure of justification. This paper offers a response on behalf of constructivism, by reassessing the role of such unconstructed elements. First, it argues that a shared conception of rational agency works as a starting point for the justification, but it does not play a foundational role. Second, it accounts for the unconstructed norms that constrains the activity of construction as constitutive norms. (...) In matters of governance, is believing subject to ethical standards? If so, what are the criteria how relevant are they in our personal and political culture today? The really important matters in politics and governance necessitate a confidence that our beliefs will lead dependably to predictable and verifiable outcomes. Accordingly, it is unethical to hold a belief that is founded on insufficient evidence or based on hearsay or blind acceptance. In this paper, we demonstrate that the pragmatist concept of truth (...) best meets this standard for ethically held belief in matters of politics and governance. Currently, these standards are abused by the gaslighting and distortion characteristics of the often social media driven ‘misinformation society’. The legitimacy and trust in our institutions and leadership that is requisite for good governance is challenged thereby, threatening the viability of our republic. (shrink)

In this paper I try to illuminate the Rawlsian architectonic through an interpretation of what Rawls’ Lectures on the History of Political Philosophy say about Rousseau. I argue that Rawls’ emphasis there when discussing Rousseau on interpreting amour-propre so as to make it compatible with a life in at least some societies draws attention to, and helps explicate, an analogous feature of his own work, the strains of commitment broadly conceived. Both are centrally connected with protecting a sense of self (...) which is vital for one’s own agency. This allows us to appreciate better than much of the literature presently does the requirement for Rawls that justice and the good are congruent, that a society of justice does not disfigure citizens’ ability to live out lives relatively unmarked by relations of domination. The Public Justification Principle requires that coercive institutions be justified to all who live under them. I argue that this principle often cannot be satisfied without persons depending on the pure informative testimony of others, even under realistically idealized situations. Two main results follow. First, the sense of justification relevant to this principle has a strongly externalist component. Second, normative expectations of trust are essential to public justification. On the view I propose, whether the Public Justification Principle is satisfied depends (...) on the features of the network of testifiers in which persons are embedded. I consider several such networks to show which features are plausibly relevant. The importance of testimony for public justification ultimately suggests that we should moderate our expectations about the kind of conciliation we can achieve with the social order in which we live. Constructivism in ethics is the view that insofar as there are normative truths, for example, truths about what we ought to do, they are in some sense determined by an idealized process of rational deliberation, choice, or agreement. As a “first-order moral account”--an account of which moral principles are correct-- constructivism is the view that the moral principles we ought to accept or follow are the ones that agents would agree to or endorse were they to engage in a hypothetical (...) or idealized process of rational deliberation. As a “metaethical account” – an account of whether there are any normative truths and, if so, what they are like – constructivism holds that there are normative truths. These truths are not fixed by facts that are independent of the practical standpoint, however characterized; rather, they are constituted by what agents would agree to under some specified conditions of choice. In working to provide a more precise definition of constructivism in metaethics, the focus of this entry, one faces two main difficulties. The first difficulty is that constructivism comes in several varieties, each of which claims a different niche within metaethics, and some claim no space at all. The second difficulty concerns where to place constructivism on the metaethical map in relation to realism and anti-realism. These are terms of art, and it is highly contested which views count as realist and which as antirealist. These two difficulties will be addressed in what follows by focusing on the distinctive questions that constructivist theories are designed to answer. Section §1 defines the scope of constructivism in ethics, in contrast to constructivism in political theory. Sections §§2-5 illustrate the main varieties of metaethical constructivism, which are designed to account for the nature of normative truths and practical reasons. Section §6 presents the main varieties of constructivist accounts of the justification of moral judgments of right and wrong. U ovom radu raspravljamo odnos Rawlsovog političkog liberalizma i istine. Budući da je politički liberalizam teorija koja izbjegava sva kontroverzna epistemološka i metafizička pitanja, jednako tako izbjegava i pitanje svoje istinitosti i koncept istine uopće. Usredotočili smo se na tri autora koji tvrde da politički liberalizam ne može izbjeći pitanje istine. Prvi autor je perfekcionist, Joseph Raz, koji pokušava pokazati da je Rawlsova teorija nekoherentna ukoliko se ne bavi pitanjem istinitosti neke moralne doktrine na kojoj mora počivati. Drugi, David Estlund, (...) tvrdi da je teorija filozofski neodrživa ako se ne poziva na istinitost svog fundamentalnog načela. Treći, Joshua Cohen, pokazuje nemogućnost izbjegavanja nekog koncepta istine ako se u političkoj teoriji pozivamo na vjerovanja i opravdanje. Nastojimo dokazati tvrdnju o praktičko-političkoj i filozofskoj ograničenosti njihove kritike Rawlsove teorije. Temeljna intencija članka je opovrgnuti kritike koje se upućuju Rawlsu te time ojačati njegov prijedlog političkog liberalizma. Pri tome nastojimo i nadopuniti nedorečenosti u Rawlsovom prijedlogu te zbog toga nudimo preciznije određenu sliku političkog liberalizma u odnosu na njegovu izvornu.In this paper we discuss the relation between Rawls’ political liberalism and truth. Since political liberalism is a theory that avoids all controversial epistemological and metaphysical questions, it equally avoids the question of its truth and a concept of truth generally. We are focusing on three authors which claim that political liberalism can not avoid the question of truth. First, Joseph Raz, a perfectionist who claims that Rawls’ political theory is incoherent unless it is not concerned with the truth of some moral doctrine on which it must be derived. Second, David Estlund, who claims that Rawls’ theory is philosophically untenable unless it does not consider its fundamental principle as true one. Third, Joshua Cohen, indicates the impossibility of avoiding some concept of truth if political theory is invoking concepts such as beliefs and justification. We are pointing on theirs practical-political and philosophical limited range in criticizing Rawls’ theory. The basic intention of the article is to confute criticisms addressed to Rawls and, in this way, to strengthen his proposal of political liberalism. At the same time, we try to resolve issues deriving from indeterminacies in Rawls’ proposal. For this reason we offer a picture of political liberalism that is more determinate than his original proposal. (shrink)
