Contemporary forms of Kantian constitutivism generally begin with a conception of agency on which the constitutive aim of agency is some form of autonomy or self-unification. This chapter argues for a re-orientation of the Kantian constitutivist project towards views that begin with a conception of rationality on which both theoretical and practical rationality aim at forms of understanding. In a slogan, then, understanding-first as opposed to autonomy-first constitutivism. Such a view gives the constitutivist new resources for explaining many classes of (...) reasons, while also offering a new way of understanding the unity of theoretical and practical reason. The chapter concludes by arguing that the resulting view is best understood, not so much as an alternative to autonomy-first constitutivism, but as a complement to it. (shrink)

In this book, Toby Svoboda develops and defends a Kantian environmental virtue ethic, challenging the widely-held view that Kant's moral philosophy takes an instrumental view toward nature and animals and has little to offer environmental ethics. On the contrary, Svoboda posits that there is good moral reason to care about non-human organisms in their own right and to value their flourishing independently of human interests, since doing so is constitutive of certain virtues. Svoboda argues that Kant’s account of indirect duties (...) regarding nature can ground a compelling environmental ethic: the Kantian duty to develop morally virtuous dispositions strictly proscribes unnecessarily harming organisms, and Svoboda argues that this duty compels us to act in ways that benefit non-human organisms, given that doing so can enhance one’s virtues. Svoboda’s argument engages the recent literature on environmental virtue and provides an original argument for an environmental virtue ethic firmly rooted in Kant’s moral philosophy. (shrink)

The paper explores the interplay among moral progress, evolution and moral realism. Although it is nearly uncontroversial to note that morality makes progress of one sort or another, it is far from uncontroversial to define what constitutes moral progress. In a minimal sense, moral progress occurs when a subsequent state of affairs is better than a preceding one. Moral realists conceive “it is better than” as something like “it more adequately reflects moral facts”; therefore, on a realist view, moral progress (...) can be associated with accumulations of moral knowledge. From an evolutionary perspective, on the contrary, since there cannot be something like moral knowledge, one might conclude there cannot even be such a thing as moral progress. More precisely, evolutionism urges us to ask whether we can acknowledge the existence of moral progress without being committed to moral realism. A promising strategy, I will argue, is to develop an account of moral progress based on moral understanding rather than moral knowledge. On this view, moral progress follows increases in moral understanding rather than accumulations of moral knowledge. Whether an understanding-based account of moral progress is feasible and what its implications for the notion itself of moral progress are, will be discussed. (shrink)

G. A. Cohen and J. Raz object that Constructivism is incoherent because it crucially deploys unconstructed elements in the structure of justification. This paper offers a response on behalf of constructivism, by reassessing the role of such unconstructed elements. First, it argues that a shared conception of rational agency works as a starting point for the justification, but it does not play a foundational role. Second, it accounts for the unconstructed norms that constrains the activity of construction as constitutive norms. (...) Constitutivism aims to justify substantial normative standards as constitutive of practical reason. In this way, it can defend the constructivist commitment to avoiding realism and anti-realism in normative disciplines. This metaphysical debate is the perspective from which the nature of the constitutivist justification is usually discussed. In this paper, I focus on a related, but distinct, debate. My concern will not be whether the substantial normative claims asserted by the constructivist have some elements, which are not constructed, but real, given (...) independently from us; instead, my concern will be more narrowly epistemic – whether those claims can be derived from premises, which are normatively less substantial than the normative conclusions themselves. I focus on Korsgaard’s transcendental articulation of the constitutivist argument. I conclude that more work would need to be done, in order for this argument to function as intended. (shrink)

In this essay, I claim that certain passages in Book IV of Benedict de Spinoza’s Ethics suggest a novel version of what is known as metaethical constructivism. The constructivist interpretation emerges in the course of attempting to resolve a tension between Spinoza’s apparent ethical egoism and some remarks he makes about the efficacy of collaborating with the right partners when attempting to promote our individual self-interest . Though Spinoza maintains that individuals necessarily aim to promote their self-interest, I argue that (...) Spinoza has an atypical conception of self that allows the interests of other people to be partially constitutive of one's own self-interest. In this way, Spinoza can account for the rationality of concern for the interests of others . This interpretation attributes to Spinoza a form of constructivism that differs in important ways from contemporary Humean and Kantian constructivisms and which can in principle be detached from Spinoza’s particular metaphysical commitments in order to yield a third general category of constructivist view . Though my treatment is necessarily brief, it is my hope that it can serve both to motivate a constructivist reading of Spinoza and, perhaps even more crucially, to suggest a Spinozistic variety of constructivism as a live theoretical option in metaethics. In the face of differences between the ethical religio-philosophies believed across the globe, how should a media ethicist theorize or make recommendations in the light of theory? One approach is relativist, taking each distinct moral worldview to be true only for its own people. A second approach is universalist, seeking to discover a handful of basic ethical principles that are already shared by all the world's peoples. After providing reasons to doubt both of these approaches to doing media ethics, consideration (...) is given to a third. This under-explored approach offers moral claims that would be reasonable for nearly all long-standing cultures to accept even though they currently do not, with the aim of creating new common ground among them. The chapter advances some rights and responsibilities, particularly as they concern the media's role in respect of self-government and self-expression, on which many of those with African, Confucian, Islamic, and Western foundational commitments could sensibly converge. This article describes how the facts in social reality take an intermediate position between objective facts and purely subjective ‘facts’. In turn, these social facts can be subdivided into constructivist and non-constructivist facts. The defining difference is that non-constructivist facts are completely determined by an approximate consensus between the members of a social group, while constructivist facts are founded in such a consensus but can nevertheless be questioned. Ought fact are such constructivist facts. Because they are founded in social reality, (...) a naturalistic theory of ought facts is attractive. The so-called Evolutionary Debunking Arguments are arguments that appeal to the evolutionary genealogy of our beliefs to undermine their justification. When applied to morality, such arguments are intended to undermine moral realism. In this paper I will discuss Andreas Mogensen’s recent effort to secure moral realism against EDAs. Mogensen attempts to undermine the challenge provided by EDAs in metaethics through the distinction between proximate and ultimate causes in biology. The problem with this move is that the proximate/ultimate distinction is misconceived. (...) If ultimate and proximate causes are properly understood to be complementary, such distinction cannot affect EDAs in metaethics. Therefore, I will argue, Mogensen’s argument fails and moral realism is still in danger. (shrink)

This paper demonstrates the innovative character of the approach to metaethics underlying John Dewey’s pragmatism. Dewey's theory of evaluation is contrasted with one of the most dominant contemporary metaethical theses: constructivism. I show that the insistence placed by metaethical constructivists on the actor’s practical point of view, on the rejection of the subjective preferences model, and on a specific form of ethical antirealism and naturalism echoes some of the most crucial claims made by Dewey. This argumentation leads to my main (...) hypothesis: an analysis of Dewey's conception of evaluation allows us to highlight the groundbreaking character of its metaethical approach—an approach that will be characterized as fairly constructivist. Metaethics is often dominated by both realist views according to which moral claims are made true by either non-natural or natural properties and by non-cognitivist views according to which these claims express desire-like attitudes. It is sometimes suggested that constructivism is a fourth alternative, but it has remained opaque just how it differs from the other views. To solve this problem, this article first describes a clear constructivist theory based on Crispin Wright’s anti-realism. It then outlines an argumentative strategy that (...) can be used to argue against constructivist views about practical reasons. The rest of the article explains how the outlined constructivist metaethical framework, reasons, and contractualism in normative ethics can still be used to create a new viable metaethical constructivist position about right and wrong. In this chapter, I consider the claim for pluralism commonly advanced in political philosophy as a claim concerning the standards, methods, and norms for forming belief and judgment about certain kinds of facts, rather than concerning the nature of facts themselves. After distinguishing between descriptive and normative epistemic pluralism, I contend that, in this context, pluralism needs to rest on grounds that are stronger than fallibilism yet weaker than relativism in order to enjoy a distinct standing. The idea of reasonable (...) pluralism seems to devise a variety of normative pluralism designed to meet this demand. I argue, however, that this is an unstable position and suggest that an epistemic view of deliberation may be better suited to making sense of political justification. The latter view, though, is bound to dispense with normative pluralism. (shrink)

This paper situates the problem of defeaters in a larger debate about the source of normative authority. It argues in favour of a constructivist account of defeasibility, which appeals to the justificatory role of normative principles. The argument builds upon the critique of two recent attempts to deal with defeasibility: first, a particularist account, which disposes of moral principles on the ground that reasons are holistic; and second, a proceduralist view, which addresses the problem of defeaters by distinguishing between provisional (...) and strictly universal principles. The particularist view fails to establish that moral principles have no epistemological import, but it raises important questions about their role in practical reasoning. The proceduralist view fails to distinguish between reasoning by default and reasoning by principles, but it shows that normative principles have a structural justificatory role. The constructivist view recognizes that the moral valence of normative claims vary across contexts, but denies that this is because of holism about reasons. Rather, it defends defeasibility within a constructivist account of reasoning where universality serves as the matrix of judgment. The constructivist view vindicates the justificatory role of universal normative principles, and makes room for some ordinary sources of defeasibility, which are left unaccounted by competing views, and which depend on the agent’s own progress. Constructivism is a theory that believes moral judgments are not real things but they are constructed by practical reason in a rational procedure for resolving practical problems in front of us. Christine Korsgaard, a contemporary American philosopher, is a Kantian constructivist, whose theory I consider in this paper. She is a radical constructivist and disagrees with moral realism and denies moral truths even as abstract facts. According to Korsgaard moral judgments are constructed by rational agents. She believes moral and political (...) principles are generally solutions to human practical problems. She justifies the normativity of moral obligations from this point that they are constructed by agent for resolving his problems. Introduction One of the traditional problems in moral philosophy is the nature and entity of moral truths and judgments. Do humans themselves make and construct them or are they facts and truths in the world which humans just discover? Are moral truths and values subjective or objective? Subjectivism and objectivism have been two old rivals in this question. But some philosophers have proposed a new theory between them that is called Constructivism. According to this theory, moral truths are not real and objective, but are constructed by human practical reason. In this view, an action is morally right when there is a sufficient reason to perform it. In this paper I will discuss Korsgaard’s constructivism. 1. Definition of Constructivism Constructivism is a theory about the justification of moral principles. It is the view that moral principles are the ones agents would agree with or endorse if they were to engage in a hypothetical or idealized process of rational deliberation. The critical target of my paper is the normativist stance of Kantian meta ethics. After a very short introduction, I develop a characterization of contemporary mainstream Kantism as a conjunction of a normativist claim, a rationalist claim and a proceduralist claim. In the subsequent section I make the case against the normativist claim by drawing a counterexample, and defend the relevance of such counterexample as a reason that defeats the appeal of the Kantian approach to meta ethics. I finally conclude (...) by highlighting the main reasons why the challenge my counterexample rises are not answerable within a Kantian framework. (shrink)

Classical logic is based on an underlying view of the world, according to which there are elementary facts and compound facts, which are logical combinations of these elementary facts. Sentences are true if they correspond to, in last instance, the elementary facts in the world. This world view has no place for rules, which exist as individuals in the world, and which create relations between the most elementary facts. As a result, classical logic is not suitable to deal with rules, (...) and is therefore unsuitable to deal with legal reasoning. A logic that is more suitable should take into account that law is a part of social reality, in particular a part that consists of constructivist facts, and that rules play a central role in law. This article gives a superficial description of how social reality exists and of the place of law and legal rules in it. It uses this description to argue that traditional techniques to reason with and about legal rules provide a better logic for law than classical logic. These techniques can be accommodated in a logic that treats rules as logical individuals. (shrink)

This monograph discusses the question of what it is to be a reason – mainly in practical ethics – and proposes an original contribution to metaethics.It critically examines theories of metaethical realism, constructivism and error theory and identifies several misunderstandings or unclarities in contemporary debates. Based on this examination, the book suggests a distinction between a conceptual question, that can be answered by pure first-personal thinking, and a material question, that targets responses to reasons as a natural phenomenon in space (...) and time and that can be answered by help of the sciences. While this book defends a sharp distinction between these approaches, it also argues that the insights gained by the distinct approaches can be fruitfully integrated into a comprehensive picture.The comprehensive picture promoted in this book, based on both philosophical analysis and resources from psychology and cognitive science, is a picture of reasons as items in a collective archive of mind – reconfiguring the “domain of reasons” as a collectively established and socially cultivated fund of considerations with normative weight. The developed Collective Archive View combines Reasons Fundamentalism as an answer to the conceptual question, with a social ontological proposal, similar to Haslanger’s critical realism, as an answer to the material question.Thereby, it introduces central ideas from the field of social metaphysics into metaethics. At the same time, it offers a way of settling some controversies within metaethics, going on between proponents of Reasons Fundamentalism and Constitutivism, realism and constructivism, as well as proponents of mind-dependence and mind-independence of normative facts. In this dissertation, I construct scientifically and practically adequate moral analogs of cognitive heuristics and biases. Cognitive heuristics are reasoning “shortcuts” that are efficient but flawed. Such flaws yield systematic judgment errors—i.e., cognitive biases. For example, the availability heuristic infers an event’s probability by seeing how easy it is to recall similar events. Since dramatic events, such as airplane crashes, are disproportionately easy to recall, this heuristic explains systematic overestimations of their probability (availability bias). The research program on cognitive heuristics (...) and biases (e.g., Daniel Kahneman’s work) has been scientifically successful and has yielded useful error-prevention techniques—i.e., cognitive debiasing. I attempt to apply this framework to moral reasoning to yield moral heuristics and biases. For instance, a moral bias of unjustified differences in the treatment of particular animal species might be partially explained by a moral heuristic that dubiously infers animals’ moral status from their aesthetic features. While the basis for identifying judgments as cognitive errors is often unassailable (e.g., per violating laws of logic), identifying moral errors seemingly requires appealing to moral truth, which, I argue, is problematic within science. Such appeals can be avoided by repackaging moral theories as mere “standards-of-interest” (a la non-normative metrics of purportedly right-making features/properties). However, standards-of-interest do not provide authority, which is needed for effective debiasing. Nevertheless, since each person deems their own subjective morality authoritative, subjective morality (qua standard-of-interest and not moral subjectivism) satisfies both scientific and practical concerns. As such, (idealized) subjective morality grounds a moral analog of cognitive biases—namely, subjective moral biases (e.g., committed anti-racists unconsciously discriminating). I also argue that "cognitive heuristic" is defined by its contrast with rationality. Consequently, heuristics explain biases, which are also so defined. However, such contrasting with rationality is causally irrelevant to cognition. This frustrates the presumed usefulness of the kind, heuristic, in causal explanation. As such, in the moral case, I jettison the role of causal explanation and tailor categories solely for contrastive explanation. As such, “moral heuristic” is replaced with "subjective moral fallacy," which is defined by its contrast with subjective morality and explains subjective moral biases. The resultant subjective moral biases and fallacies framework can undergird future empirical research. (shrink)

In this dissertation, I seek to explain G.W.F. Hegel’s view that human accessible conceptual content can provide knowledge about the nature or essence of things. I call this view “Conceptual Transparency.” It finds its historical antecedent in the views of eighteenth century German rationalists, which were strongly criticized by Immanuel Kant. I argue that Hegel explains Conceptual Transparency in such a way that preserves many implications of German rationalism, but in a form that is largely compatible with Kant’s criticisms of (...) the original rationalist version. After providing background on Hegel’s relationship to the traditional rationalist theory of concepts and Kant’s challenge to it, I claim that Hegel’s central task is to provide a theory of conceptual content that allows a relationship to the objective world without being dependent on the specifically sensory aspect of the world, which Kant’s theory of concepts required. Since many interpreters deny that Hegel’s use of the term “concept” is comparable to other historical philosophers (or our own), I first show that Hegel’s critique of standard conceptions of concepts presupposes an agreement of subject matter. I then show how Hegel’s account of the “formal concept” provides the skeleton for a view of conceptual content that relies on negative relations between terms, rather than a relation to sensibility, to provide content. Hegel’s account of conceptual content is completed when he shows how a universal term is further specified so that it can determine singular objects. This occurs in its adequate form in a teleological process. I argue that Hegel’s account of teleology in the Science of Logic is an attempt to explain how and where Conceptual Transparency obtains. A teleological process is one in which a concept constitutes an object, and this means that a concept is perfectly adequate to express that thing’s nature and not merely to represent it. However, in the final chapter, I show that Hegel’s concept of teleology is meant paradigmatically to illuminate how human purposive processes have constituted a social world that is conceptually accessible to us. In this way, the primary “province” of Hegel’s rationalism is the human constructed world. (shrink)
