This paper deals with the particularities of vagueness in law. Thereby the question of the law’s capacity for vagueness is closely related to the question of the impact of vagueness in law, since exaggerated vagueness combined with the elasticity of legal interpretation methodology may affect the constitutional principles of legal certainty, the division of powers, and the binding force of statute. To represent vagueness and the instability of legal concepts and rules, a Hyperbola of Meaning is introduced, opposing Heck’s metaphor (...) of a core and a periphery of meaning. Furthermore, evidence is provided that the use of vague legal concepts and the capability of legal methodology to affect the specific meaning of those concepts, may give rise to astonishing and irrational changes of meaning of the law. Finally the paper sets out in search of an added value of vagueness in law, and weighs several stated pros and contras of vagueness. In this article, we explore the implicit conceptions of business ethics and social responsibility of owners−managers of small and medium enterprises (SME) in Cameroon. While using a hermeneutical approach, our main objective is to clarify how Sub-Saharan African business people themselves understand and define corporate responsibility in their particular economic and political environment. Our aim is not to deliver an empirical study of business practices and management behavior in SMEs. We wish to discuss which responsibilities they themselves judge to be (...) relevant and which can legitimately be attributed to them by third parties. Secondly, we relate our findings to other empirical work on SMEs, in Africa and elsewhere. It is shown that there are similarities with the way in which SMEs in Europe interpret their responsibility, but also striking differences. Further, we relate our findings to some theoretical controversies around corporate social responsibility (CSR) in SMEs, to questions about evaluation tools for CSR in the SME context, and to the role of CSR with respect to poverty alleviation in developing countries. The paper analyses the role played by the concept of ‘common ground’ in argumentation theories. If a common agreement on all the rules of a discursive exchange is required, either at the beginning or at the end of an argumentative practice, then no violation of the rules is possible. The paper suggests an alternative understanding of ‘common ground’ as something that can change during the development of the argumentative practice, and in particular something that can change without the practice being (...) stopped, just as one sometimes violates the rule of a game without stopping playing. The analysis of some historical examples shows that the violation of rules sometimes leads to a consensual change of a set of beliefs and values. The argumentative rationality thus needs to be reconsidered in the light of the analysis of the conditions under which it would be legitimate to change the rules of an argumentative practice: ‘common ground’ and the right to disagreement, even radical or violent, could then be defended as essential components of argumentative rationality. This paper presents some perspectives in contemporary epistemology, relating in particular to the links between contextualism and interdisciplinary approaches. The author considers the role played by different theories of context in the frame of a social epistemology.

The essay reflects on how Hans-Georg Gadamer and Karl Barth view interpretation of the Christian Bible. It proceeds in three main sections. The first contends that Gadamer secularizes Christian theology, and that this has drawbacks for the sort of reading his hermeneutic can give to Christian Scripture. The second part turns to Barth, arguing that the whole structure of his approach to the Bible factors in theological commitment, with benefits for the readings he can deliver. The final part makes a (...) case that contemporary reflection on interpretation can nonetheless glean important insights from Gadamer, especially regarding the readerly reception of texts, because his perspective has a certain sort of richness that Barth’s cannot match. The overall suggestion emerging from the interrogation of these two thinkers is that phenomenology and theology might learn from one another, that they each contribute something valuable to discussions of biblical interpretation. What is the philosophical significance of Heidegger’s interpretation of the Japanese notion of kotoba (言葉) for Japanese philosophy? Was his conversation with Tezuka Tomio a real dialogue or not? To answer to these correlated questions, I elucidate Heidegger’s 1954 essay “A Dialogue on Language” by following a topological mode of thinking, and I inquire into the way-making of a “thinking conversation”. First, I problematize whether Heidegger engaged in a genuine dialogue with Tezuka. To that end, I distinguish the hermeneutic horizon (...) of the actual encounter between Tezuka and Heidegger from Heidegger’s essay which places Tezuka (the Japanese) and Heidegger (the Inquirer) in a fictional philosophical conversation. Second, I argue that Heidegger’s topological method of interpretating kotoba can be read as a poetic means of thematizing East-West dialogue. Third and finally, exploring the topological sense of kotoba, I engage with third generation Kyoto School thinker Ueda Shizuteru’sideaof“hollow words” of language, situated in a twofold view of the world. I conclude that the true character of Heidegger’s conversation with Tezuka can be identified neither in Heidegger’s “actual” encounter with Tezuka, nor merely in Heidegger’s “hollow” essay. Departing from Ueda’s account of kotoba, it appears that a genuine conversation with language can be located in the dialogue of actuality and hollowness, which finds it expression in poetic language. The article is a philosophical reflection of the current status of the humanities in Slovakia. In many areas of our society there is an evident deficit in humanities-science knowledge, reflected also in parliamentary election results in 2016 and having serious consequences on our society. The article therefore suggests the possibility of transposing the knowledge of the humanities, particularly philosophy, in the educational process appropriate to the character of a pluralistic liberal democracy in the 21st century.

La confrontación de Heidegger con el humanismo es bien conocida: es la forma de toda metafísica entendida desde la subjetividad. La tesis que se defiende en el ensayo es que hay otra forma de entender su relación con el humanismo desde un punto de vista espacial. Se establece una relación entre la concepción del espacio cotidiano y de lo «a la mano» en Ser y Tiempo, y la noción de colección en los primeros humanistas. De este modo se muestra que (...) el humanismo temprano no es un antecesor del subjetivismo cartesiano, y que, tal como lo proponen Gadamer o Grassi, representa una corriente que bebe de fuentes diferentes a la dominante en el pensamiento occidental. Schließlich ist die Frage interessant, ob etwas Neues anstelle der bestehenden konfessionellen und institutionalisierten Grenzziehungen tritt. The present essay discusses a notorious rhetoric means familiar to all scholars in the social sciences and humanities including philosophy: name-dropping. Defined as the excessive over-use of authoritative names, I argue that it is a pernicious practice leading to collective disorientation in spoken discourse. First, I discuss name-dropping in terms of informal logic as an ad verecundiam-type fallacy. Insofar this perspective proves to lack contextual sensitivity, name-dropping is portrayed in Goffman’s terms as a more general social practice. By narrowing down (...) the focus to social science and the humanities, the essay emphasizes its function of discursive legitimation. This view, I argue, is incomplete because it overlooks the basic mechanism beneath. Names not only provide legitimation of but also orientation in discourse. Consequently, two tipping points—detour and disorientation—are proposed as benchmarks for it to become problematic. The conclusion re-widens the argument’s scope by suggesting questions for future inquiries. (shrink)

This thesis articulates a novel interpretation of Heidegger’s explication of the being (Seins) of gear (Zeugs) in §15 of his masterwork Being and Time (1927/2006) and develops and applies the position attributed to Heidegger to explain three phenomena of unreflective action discussed in recent literature and articulate a partial Heideggerian ecological metaphysics. Since §15 of BT explicates the being of gear, Part 1 expounds Heidegger’s concept of the ‘being’ (Seins) of beings (Seienden) and two issues raised in the ‘preliminary methodological (...) remark’ in §15 of BT regarding explicating being. §1.1 interprets the being (Sein) or synonymously constitution of being (Seinsverfassung) of a being (Seienden) as a regional essence: a property unifying a region (Region), district (Bezirk), or subject-area (Sachgebiet) – a highly general (‘regional’) class of entities. Although Heidegger posits two components of the being of a being, viz. material-content (Sachhaltigkeit, Sachgehalt) and mode-of-being (Seinsart) or way-of-being (Seinsweise, Weise des Seins, Weise zu sein) (1927/1975, 321), the unclarity of this distinction means that it does not figure prominently herein. §1.2 addresses Heidegger’s distinction between ontological and ontic investigations and his notion of ‘modes of access’ (Zugangsarten, Zugangsweisen). Part 2 expounds §15 of BT’s explication of the being of gear. §2.1 analyses Heidegger’s two necessary and sufficient conditions for being gear and three core basic concepts (Grundbegriffe) enabling comprehension of these conditions and therewith a foundational comprehension of gear. Heidegger explicates the being of gear through content of unreflectively purposeful, non-intersubjective intentional states. I term such states ‘mundane concern’, which is almost synonymous with Hubert Dreyfus’s term ‘absorbed coping’ (1991, 69). Heidegger’s explication highlights around-for references (Um-zu-Verweisungen) as the peculiar species of property figuring in mundanely concernful intentional content. §2.2 clarifies Heidegger’s position on the relationship between to-hand-ness (Zuhandenheit) and extantness (Vorhandenheit) in the narrow sense: two of Heidegger’s most widely discussed concepts. I reject Kris McDaniel’s recent reading of Heidegger as affirming that nothing could be both to-hand and extant simultaneously (McDaniel 2012). Part 3 develops and applies Heidegger’s phenomenology of mundane concern. §3.1 explains the phenomena of situational holism, situated normativity, and mundanely concernful prospective control. §3.2 undertakes the metaphysical accommodation of around-for references, which §3.1 posited as featuring prominently within mundanely concernful intentional content. This thesis thus contributes not only to Heidegger scholarship, but also to contemporary debates within the philosophy of action and cognitive science. (shrink)

Niettegenstaande de tendens van het failliet van het multiculturalisme is multiculturele dialoog niet weg te denken in een zich globaliserende wereld. Taylor, Gadamer, Honneth en Kymlicka hebben een bijdrage geleverd op het vlak van de erkenning van identiteit, respect en waardering van verschil. Wij voeren het argument aan dat bovenstaande auteurs niet ontsnappen aan het postmodernistisch dilemma van zelfautonomie en slachtofferschap. Dit komt doordat zij in hun rationale vertrekken van het afzonderlijke subject en deze situeren in een ruimte-tijd waarin de (...) tijd slechts een historische rol heeft en de ruimte geen actieve rol speelt. Tegenover deze uitvloeisels van het postmodern denken stellen wij het eco-communau-tarisme. Vanuit de vaststelling dat het individu denkt, spreek en handelt in de context van zijn taal en cultuur en dus vanuit zijn gemeenschap, situeren wij dit subject en de gemeenschap tevens in een particulier territorium of het ecotoop. Door middel van Hacking’s sociaal constructivisme, het Leibniziaanse meerwereldenbeeld en het biologische paradigma als nieuw denkkader, structureren wij de gemeenschap volgens een cyclisch en een lineair tijdverloop. Het cyclische waarborgt de traditie van een gemeenschap, het lineaire doet de gemeenschap evolueren naar een moreel betere toekomst en heeft een transcendent statuut. Het eco-communautarisme biedt het kader voor een kwalitatieve evolutie van individuen en gemeenschappen. Het normerend aspect hiervan is de pluriforme en multiculturele dialoog. (shrink)

Recently, archaeologists have been focusing on material relies as evidence of a historical consciousness. This article examines the Iliad and the Odyssey from the point of view of this 'archaeology of the past'. Various material objects, ranging from tombs to everyday objects, evoke the past in the epic poems, thereby enriching the narrative and providing reflections on the act of memory. In turn, Homeric evidence sheds new light on the hermeneutics of relies in archaic oral society.

This paper introduces the philosophical foundation and practical application of empirical phenomenology in social research. The approach of empirical phenomenology builds upon the phenomenology of the philosophers Edmund Husserl and Martin Heidegger and the sociologist Alfred Schütz, but considers how their more philosophical and theoretical insights can be used in empirical research. It aims at being practically useful for anyone doing qualitative studies and concerned about safeguarding the perspective of those studied. The main idea of empirical phenomenology is that scientific (...) explanation must be grounded in the first-order construction of the actors; that is, in their own meanings. These constructions are then related to the second-order constructions of the scientist. In this paper, empirical phenomenology is considered in the light of phenomenological philosophy. The paper includes an explication of the approach, which is summarized in seven steps through which the researcher is guided, and considers its implications for qualitative methods such as interviewing and participant observation. Para lograr una evaluación precisa de este enfoque, se lleva a cabo un recorrido por las cuatro posiciones cardinales del debate alemán en torno al sentido, el método y la función de la historia de la filosofía. Mediante la contraposición de la propuesta de Heidegger frente a estas cuatro posiciones cardinales, se espera aclarar cuáles son los fundamentos del pensamiento hermenéutico y sacar a la luz las razones por las que el estudio del pasado filosófico podría ser considerado esencial para la formación en filosofía.: The article aims to introduce the problem that represents the study of the history of philosophy, especially today when this practice has established as the model in the academic formation of the field. In order to raise this problem more specifically, the article focuses on the legitimacy of the hermeneutic approach, as it consists in the affirmation of the necessity of the study of the past for philosophy. The evaluation of this approach is carried out in the light of a description of the four cardinal positions of the German debate about the meaning, method and function of the history of philosophy. By contrasting Heidegger’s proposal with these four cardinal positions, it is hoped to clarify the foundations of hermeneutic thought and to bring to light the reasons because the study of philosophical past can be considered essential for philosophy. Persons with profound intellectual and multiple disabilities cannot speak about their Quality of Life, which makes it necessary to involve others. In current approaches, these ‘others’ are seen as assessors trying to describe QoL as objectively as possible, which involves a reduction of their experiences, through which they develop knowledge on the QoL of the person with PIMD. The objective of this paper is to give caregivers’ knowledge on the QoL of a person with PIMD a theoretical basis that values (...) these experiences. We will argue that caregivers should be seen as witnesses, not assessors, and their statements on QoL as testimonies, not assessments. Audiences judge the trustworthiness of these witnesses intersubjectively, which implies a relationship characterized by trust and suspicion. Trust supports the witness to tell in her own words about the QoL of the person with PIMD; it demands receptivity, indicating that both the witness and the audience are willing to reconsider their perspective on QoL. Suspicion is necessary too, which helps the witness to critically approach her own interpretations and supports her to create more trustworthy testimonies. We conclude that the concept of witnessing helps to acknowledge caregivers’ experiential knowledge of QoL of a person with PIMD, which may also apply to other persons who cannot speak about their own QoL. We hope that our study will empower caregivers to give testimonies on QoL of a person with PIMD, which is crucial when complex decisions about the life of this person have to be made. (shrink)

In healthcare practice, care providers are confronted with tragic situations, in which they are expected to make choices and decisions that can have far-reaching consequences. This article investigates the role of moral case deliberation in dealing with tragic situations. It focuses on experiences of care givers involved in the treatment of a pregnant woman with a brain tumour, and their evaluation of a series of MCD meetings in which the dilemmas around care were discussed. The study was qualitative, focusing on (...) the views and experiences of the participants. A case study design is used by conducting semi-structured interviews with health care professionals who both played a role in the treatment of the patient and attended the MCD. The results show that MCD helps people to deal with tragic situations. An important element of MCD in this respect is making explicit the dilemma and the damage, demonstrating that there is no simple solution. MCD prompts participants to formulate and share personal experiences with one another and thus helps to create a shared perception of the situation as tragic. The article concludes that MCD contributes to the sharing of tragic experiences, and fosters mutual interaction during a tragedy. Its value could be increased through explicit reflection on the aspect of contingency that characterises tragedy. (shrink)

In this article I scrutinize the question whetherclinical medicine, in order to be considered ahermeneutical enterprise, must be thought of as areading of different texts. Three differentproposals for a definition of the concept of text inmedicine, suggested by other hermeneuticians, arediscussed. All three proposals are shown to beunsatisfying in various ways. Instead of attempting tofind a fourth definition of the concept of textsuitable to a hermeneutics of medicine, I then try toshow that the assumption that one needs to operatewith the (...) concept of text in order to develop ahermeneutics of medicine is false. Clinicalinterpretation can be shown to essentially consist ina dialogical hermeneutics, the pattern of which can befound in the philosophy of Hans-Georg Gadamer. Thiskind of hermeneutics is not a methodology of textreading, but an ontological, phenomenologicalhermeneutics in which understanding is a necessaryfeature of the being-together of human beings in theworld. This being-together in and through languagetakes on a peculiar form in the clinical encounter,since the medical meeting is typically characterizedby an asymmetrical enstrangement and has a specificgoal – health for the patient – absent in other formsof hermeneutics. Central issues of Gadamer''sphilosophy, e.g. fusion of horizons, are shown tofit the structure of clinical practice. (shrink)

Pig farmers and scientists appear to have different perspectives and underlying framing on animal welfare issues as tail biting and natural behaviour of pigs. Literature proposes a joint learning process in which a shared vision is developed. Using two different settings, a symposium and one-to-one dialogues, we aimed to investigate what elements affected joint learning between scientists and pig farmers. Although both groups agreed that more interaction was important, the process of joint learning appeared to be rather potentially dangerous for (...) the farmer–scientist relationship. During the symposium, farmers were only moderately open for scientific knowledge and the issue of tail biting had the tendency to run into a deadlock. The setting was an influencing element for the degree of success, because the dialogues did lead to improved mutual trust and understanding of each other’s framing and context. Another element was the degree of usability and absoluteness of scientific facts. They were frequently not concrete enough, too uncertain or not relating to the context of the farmers. In addition, some scientific facts were not recognized by the farmers. Both groups appeared to react and argue from their praxis, including their local environment, way of living, handling and understanding their environment. These praxises appeared to function as a filter, influencing the way of observing the environment, inducing ‘blind spots’ and misunderstandings. Stepping in each other’s praxis might provide concrete and fusing insights, required to realize joint learning processes. (shrink)

El propósito de este artículo es estudiar uno de los tópicos centrales de la concepción cusana del lenguaje, esto es, la imposición de nombres a las cosas, a la luz del tratamiento que ofrece (...) en el tercero de los Idiotae libri, el De mente (1450), y evaluar allí la presencia plausible del Crátilo de Platón en su desarrollo. Con ello buscamos ofrecer una clave hermenéutica aún no suficientemente explorada en el ámbito internacional de los estudios sobre el pensamiento de Nicolás de Cusa. (shrink)

The concept of moral individualism is part of the foundational structure of most prominent modern moral philosophies. It rests on the assumption that moral obligations towards a respective individual are constituted solely by her or his capacities. Hence, these obligations are independent of any ἔθος, of any shared ethical sense and social significations. The moral agent and the individual with moral status are construed as subjects outside of any social relation or lifeworld significations. This assumption has been contested in the (...) last decades by diverse authors with very different approaches to moral philosophy. In the last years, an increasing number of philosophers like Cora Diamond and Alice Crary, but also phenomenologists like Paul Ricœur, Klaus Held, and Bernhard Waldenfels question the presupposition that individual capacities are the agent-neutral and context-neutral ground of moral considerations. This critique of moral individualism in different contemporary discourses shows a striking similarity between Wittgensteinian and phenomenological philosophers as their critical inquiry of prominent theories like the ones by Immanuel Kant, John Rawls, Peter Singer or Tom Regan is derived from mostly implicitly efficacious Aristotelian theorems. Telling examples are the ἔθος as pre-given normative infrastructure, the ἕξις as individual internalization of the ethos, the φρόνησις described as a specific practical know-how in contrast to scientific knowledge, and not at least the definition of the human being as ζῷον πολιτικόν. However, the Aristotelian sources of this movement have not yet been scrutinized systematically. This paper aims, first, to reveal the significance of these sources to make them visible and, second, to contribute to the notion of the topicality of Aristotelian philosophy in current debates on ethics. Hermeneutic research in nursing: developing a Gadamerian‐based research method This paper takes the stance that although there are many different approaches to phenomenological and hermeneutic research, some of these have become blurred due to multiple interpretations of translated materials. Working from original texts by the German philosophers, this paper reconsiders the relevance of phenomenology and hermeneutics to nursing research. All concepts, methods, and techniques of the philosophy of language arise from its conceptions of language. Conceptions of language have determined the character of the philosophy of language and the direction of its philosophical research. Various schools and currents within the philosophy of language differ from each other, mainly in the way they understand the referential character of the sign—that is, the relationship between the meaning of a word and its referential object.

This experimental article claims that relatively recent trends in Western philosophy provide a much more open approach to philosophies originating in nonwestern traditions, including the Chinese, than found in most mainstream Western philosophy. More specifically, I argue that a slightly modified version of Jacques Derrida’s concept of différance offers a hermeneutic parallel to native Chinese philosophical approaches to interpretation. Gadamer claims that an essential form of truth is disclosed in the search for, and discovery of, a shared language in and through which the matter at issue between the participants in a conversation can come to presentation. He maintains in this regard that the thing itself is given in language. This contention is grounded in his account of the “belonging together” of word and thing. In healthcare practice, care providers are confronted with decisions they have to make, directly affecting patients and inevitably harmful. These decisions are tragic by nature. This study investigates the role of Moral Case Deliberation in dealing with tragic situations. In MCD, caregivers reflect on real-life dilemmas, involving a choice between two ethical claims, both resulting in moral damage and harm. One element of the reflection process is making explicit the harm involved in the choice. How harmful are our decisions? We (...) investigated how facilitators of MCD experience the importance of addressing harm in MCD and what participants learn from reflecting on harm. The study was qualitative, focusing on the views and experiences of the facilitators of MCD. Semi-structured interviews were conducted with facilitators of MCD. The research focuses on the subjective experiences of facilitators. Grounded Theory was used for analysis. The results show two main categories. The first concerns the awareness of tragedy. Within this category, five themes were discerned: making explicit that there is no solution, visualizing consequences, uncovering pain, focusing on emotion, and exploring perspectives on harm. The second category concerns the support for healthcare professionals in dealing with the tragedy of the choices they face. In this category, five themes came forward: acknowledging, offering comfort, managing harm, consideration through dialogue and repairing harm. Our study shows that addressing harm in MCD in tragic situations provides an important moral learning opportunity for participants. By formulating and becoming aware of harm, MCD aids healthcare professionals in the task they are faced with, namely making difficult and painful choices. MCD helps healthcare professionals to repair moral damage, making clear at the same time that harm cannot be undone. (shrink)

The purpose of this article is to critically assess the ‘three-world theory’ as it is presented—with some slight but decisive differences—by Jürgen Habermas and Karl Popper. This theory presents the philosophy of science with a conceptual and material problem, insofar as it claims that science has no single access to all aspects of the world. Although I will try to demonstrate advantages of Popper’s idea of ‘the third world’ of ideas, the shortcomings of his ontological stance become visible from the (...) pragmatic point of view in Habermas’s theory of communicative acts. With regard to the critique that the three-world theory has met in both its pragmatic and ontological versions, I will take a closer look at John Searle’s naturalistic counter-position. By teasing out some problematic implications in his theory of causation, I aim to show that Searle’s approach is, in fact, much closer to Popper’s than he might think. Finally, while condoning Habermas’s distinction between the natural world and the lifeworld, I will opt for a pragmatically differentiated view of ‘the real’, rather than speaking of different worlds. In this paper I examine the subject of the intersubjective constitution of intentional objects in Ingarden, particularly in the literary work. Subsequently, I cover certain topics of Husserl’s phenomenology adopted and developed further by Ingarden, which were certainly taken up in Reception Aesthetics, but were insufficiently recognized as Husserl’s legacy. In doing so, I attempt to show that Ingarden’s literature aesthetics, as regards its origin in Husserl’s essential-eidetic phenomenology, provides important clues to suggest that Ingarden may not necessarily be regarded (...) as the founder of reader-oriented hermeneutics. Socratic Philosophizing is an open process of thinking that follows a net of methods. Martens develops his Five Finger Model in accordance with Socrates and the history of philosophy. Philosophizing within the community of inquiry is characterized by attitudes of curiosity, openness, and the willingness to make oneself understandable as well as to understand the other person in return. There are five core philosophical methods that assist in making such philosophizing successful: Phenomenology, Hermeneutics, Analysis, Dialectics and Speculation. These five methods (...) are understood as reflective operations which are learned in an elementary way and practiced step-by-step: to be able to describe something exactly, to understand oneself and others, to clarify in a conceptual and argumentative way how something is understood), to ask and to disagree,, to fantasize how something could be understood. Marten’s Five Finger Model builds on these methods in order to help children build broader and distinct questions through philosophizing. To illustrate this we will present an interactive game that can be used to introduce the teaching themes of Who am I?, Partnership, Tolerance, and Foreign Cultures. The game is called “Distance and Closeness.” The game was evaluated afterward using the framework of the five finger method. (shrink)

Turner. The main purpose of this “Reply to my critics” is to reflect upon the most important issues raised by these commentators and thereby contribute to a more nuanced understanding of key questions arising from Bourdieu’s (...) analysis of language. Background: Metaphors are often used within the context of ethics and healthcare but have hardly been explored in relation to moral reasoning. Objective: To describe a central set of metaphors in one case and to explore their contribution to moral reasoning. Method: Semi-structured interviews were conducted with 16 parents of a child suffering from the neurodegenerative disease CLN3. The interviews were recorded, transcribed, and metaphors were analyzed. The researchers wrote memos and discussed about their analyses until they reached consensus. Ethical (...) considerations: Participants gave oral and written consent and their confidentiality and anonymity were respected. Findings: A central set of metaphors referred to the semantic field of the hands and arms and consisted of two central metaphors that existed in a dialectical relationship: grasping versus letting go. Participants used these metaphors to describe their child’s experiences, who had to “let go” of abilities, while “clinging” to structures and the relationship with their parent(s). They also used it to describe their own experiences: participants tried to “grab” the good moments with their child and had to “let go” of their child when (s)he approached death. Participants, in addition, “held” onto caring for their child while being confronted with the necessity to “let go” of this care, leaving it to professional caregivers. Discussion: The ethical analysis of the findings shows that thinking in terms of the dialectical relationship between “grasping” and “letting go” helps professional caregivers to critically think about images of good care for children with CLN3. It also helps them to bear witness to the vulnerable, dependent, and embodied nature of the moral self of children with CLN3 and their parents. Conclusion: Metaphorical reasoning may support the inclusion of marginalized perspectives in moral reasoning. Future studies should further explore the contribution of metaphorical reasoning to moral reasoning in other cases. (shrink)

A novel rereading of the relationship between ethics and ontology in Aristotle.

Starting from the often-used metaphor of the “horizon of experience” this article discusses three different types of intercultural hermeneutics, which respectively conceive hermeneutic interpretation as a _widening_ of horizons, a _fusion_ of horizons, and a _dissemination_ of horizons. It is argued that these subsequent stages in the history of hermeneutics have their origin in—but are not fully restricted to—respectively premodern, modern and postmodern stages of globalization. Taking some striking moments of the encounter between Western and Chinese language and philosophy as (...) example, the particular merits and flaws of these three types of hermeneutics are being discussed. The claim defended is that although these different types of hermeneutics are mutually exclusive from a theoretical point of view, as interpreting beings in the current era we depend on each of these distinct hermeneutic practices and cannot avoid living them simultaneously. This paper discusses the theory of knowledge based on the idea of dynamical space. The goal of this effort is to comprehend the knowledge that remains beyond the human domain, e.g., of the artificial cognitive systems. This theory occurs in two versions, weak and strong. The weak version is limited to knowledge in which retention and articulation are performed through the discourse. The strong version is general and is not limited in any way. In the weak version, knowledge is represented (...) by the trajectories of discourses in time, in a dynamical space called the discursive space, which has an arbitrary number of dimensions. Given space is used to represent a given part of knowledge. A manifold is introduced to represent knowledge with a wider scope (all knowledge). The strong version is an extrapolation of the weak version to cover all forms of knowledge, not necessarily human or manifesting in language. The use of dynamical space construction allows one to formalize knowledge as such. Such an effort requires us to initially consider knowledge as mainly a social and linguistic phenomenon, which also could be presented as a result of the evolution of the understanding of knowledge that took place in the 20th century. No presente artigo, propomo-nos a explicitar em que medida Gadamer retoma o conceito de metafísica em sua proposta hermenêutica, com o objetivo principal de explorar como esse aspecto ressalta seu posicionamento em relação à tentativa heideggeriana de refundar uma linguagem propriamente metafísica — com base nas pesquisas de Jean Grondin e Dennis J. Schmidt — e à crítica que caracteriza a hermenêutica gadameriana como relativista, sob um prisma conceitual niilista — especialmente sob a ótica de Gianni Vattimo. Ao final, algumas (...) limitações de tal crítica relativista poderão ser revistas à luz da compreensão das condições ontológicas e metafísicas latentes na obra gadameriana, que contribuem para uma revisão da herança heideggeriana e da crítica pós-moderna contemporânea. Gadamer’s notion of dialogical truth relies on the claim that self and world “belong together” as aspects of a single, unitary phenomenon, one which is made manifest in language. This view has difficulty, however, accounting for that which is untruthful. To get past this obstacle I suggest that we turn to Nishida’s work, which shows how we can bring self and world together into a kind of harmony such that the cultivation of perception makes possible truthful expression.
