This essay responds to the thoughtful essays on the Order of Public Reason (OPR) by Elvio Baccarini, Giulia Bistagnino and Nenad Miscevic. All three essays interrogate OPR’s understanding of moral theory - “meta” matters about the nature of morality, reasons and modeling within moral theories. I first turn to the general understanding of the moral enterprise underlying OPR, explaining why it takes a view at odds with the contemporary mainstream in moral philosophy. I then explain the idea of moral truth (...) in OPR: when it comes to social morality, moral truth is necessarily a function of what can be endorsed by some collectivity. Th is leads to a fundamental worry about theories of public reason: why is the endorsement of the public so important? And if some sort of public endorsement is really so terribly important, how can a theory of public reason withstand the fact that it advances its own controversial claims that cannot be publicly endorsed? After considering when public endorsement is necessary, and when public reason theories can make controversial claims, I close by considering in what way OPR does, and in what way it does not, employ a thought experiment, and the complexities of that. Andrew Lister’s Public Reason and Political Community is an important new contribution to the debate over political liberalism. In this article, I critically evaluate some of the central arguments of the book in order to assess the current state of public reason liberalism. I pursue two main objections to Lister’s work. First, Lister’s justification for public reason, which appeals to the value of civic friendship, fails to show why public reason liberalism should be preferred to an alternative democratic theory that (...) does not include public reason restrictions. Second, there are several important ambiguities and tensions within Lister’s view that he does not adequately resolve. His approach to them often takes public reason liberalism in directions that many of its advocates will reject. More work thus remains to be done by public reason liberals both to show why public reason restrictions are necessary and to resolve these tensions in a more satisfactory way. (shrink)

Convergence liberalism has emerged as a prominent interpretation of public reason liberalism. Yet, while its main rival in the public reason literature—the Rawlsian consensus account of public reason—has faced serious scrutiny regarding its ability to secure equal citizenship forallmembers of society, especially for members of historically subordinated groups, convergence liberalism has not. With this article, we hope to start a discussion about convergence liberalism and its (in)ability to address group-based social inequalities. In particular, we aim to show that given the (...) core features of the viewandreal-world pluralism, the policies needed to secure gender equality and protect equal citizenship for women will not be justified. We make our case by considering various inequalities that are due to the gendered division of labor and potential convergence liberal responses. (shrink)

Public reason liberals claim that legitimate rules must be justifiable to diverse perspectives. This Public Justification Principle threatens that failing to justify rules to reprehensible agents makes them illegitimate. Although public reason liberals have replies to this objection, they cannot avoid the challenge of powerful deceivers. Powerful deceivers trick people who are purportedly owed public justification into considering otherwise good rules unjustified. Avoiding this challenge requires discounting some failures of justification according to what caused people’s beliefs. I offer a conception (...) of public justification that accommodates these externalist considerations while positioning Public Reason Liberalism to provide insight into real cases of deception. The crucial problem in the philosophy of psychiatry is to determine under which conditions certain behaviors, mental states, and personality traits should be regarded as symptoms of mental illnesses. Participants in the debate can be placed on a continuum of positions. On the one side of the continuum, there are naturalists who maintain that the concept of mental illness can be explained by relying on the conceptual apparatus of the natural sciences, such as biology and neuroscience. On the other side (...) of the continuum, there are normativists who maintain that the appropriate characterization of the concept of mental illness cannot avoid reference to epistemic, moral and other social values. Although, this article is primarily an introduction to the debate, we stress the importance of the normativist positions. (shrink)

Gerald Gaus was one of the leading liberal theorists of the early twenty-first century. He defended liberal order based on its unique capacity to handle deep disagreement and pressed liberals toward a principled openness to pluralism and diversity. Yet, almost everything written about Gaus's work is evaluative: determining whether his arguments succeed or fail. This essay breaks from the pack by outlining underlying themes in his work. I argue that Gaus explored how to sustain moral relations between persons in light (...) of the institutional threats of social control, evaluative pluralism, and institutional complexity, and the psychological threat of acting solely from what I shall call themere first-personal point of view. The idea of public justification is the key to sustaining moral relations in the face of such challenges. When a society's moral and political rules are justified to each person, moral relations survive the threats they face. (shrink)

According to public reason liberalism, the laws and institutions of society must be in some sense justifiable to all reasonable citizens. But why care about justifiability to reasonable citizens? Recently, Gerald Gaus has developed a novel and sophisticated defence of public justification. Gaus argues that our everyday reactive attitudes of resentment and indignation presuppose public justification and that these reactive attitudes are essential to social life. In this article, I challenge the first premise by considering cases in which agents are (...) liable to the reactive attitudes for violating moral rules that they had no sufficient reason to endorse, and I challenge the second premise by drawing on recent work on moral responsibility that suggests that social life would still be possible, and perhaps even improved, in the absence of the reactive attitudes. Finally, I question whether the reactive attitudes are even the kind of thing that could justify public reason. (shrink)

Public reason accounts commonly claim that exercises of coercive political power must be justified by appeal to reasons accessible to all citizens. Such accounts are vulnerable to the objection that they cannot legitimate coercion to protect basic liberal rights against infringement by deeply illiberal people. This paper first elaborates the distinctive interpersonal conception of justification in public reason accounts in contrast to impersonal forms of justification. I then detail a core dissenter-based objection to public reason based on a worrisome example (...) advanced by Jonathan Quong. While we may be able to impersonally justify coercing the illiberal dissenter, public reason liberals must explain how we can interpersonally justify such coercion—meaning justify given the perspective of the dissenter. The two prominent strategies for dealing with dissenters involve idealization of reasoning and requiring liberal values; I show that these strategies do not succeed in a way compatible with the public reason project. That is, the prominent strategies leave public reason theorists with a dilemma between denying the legitimacy of using coercion to protect core freedoms against deeply illiberal people or abandoning the fundamental public reason project. I conclude by proposing a different answer to public reason liberalism’s fundamental question: what requires justification? On my account, it is not that coercion requires interpersonal justification for its permissibility, but that such justification is necessary as a constitutive element of a kind of moral community. Public reason liberals hold that laws and institutions must be in some sense justifiable to all reasonable citizens. Different public reason liberals have developed different accounts of the constituency of reasonable citizens to whom justification is owed. Recently, a number of theorists have suggested that public reason views with less “sectarian” accounts of reasonableness are in one way better than public reason views with more “sectarian” accounts of reasonableness. Yet, despite being used to tremendous effect to motivate particular theories of (...) public reason, this anti-sectarianism desideratum has not received focused treatment, and hardly any detailed arguments have been offered for it. In this paper, I fill this gap by considering the case for the anti-sectarian desideratum. I find that there is no good reason to regard less sectarian public reason views as in one way better than more sectarian views. (shrink)

Michael Moehler’s Minimal Morality: A Multilevel Social Contract Theory makes important contributions to the social contract tradition, particularly in exploring how social contract theories can address challenges that arise from deep moral pluralism. Fundamentally, the work provides a multilevel account of morality, though simplified for presentation as a two-level view of morality. These two levels of morality differ significantly in their form and in their contexts of applicability. One level is that of ‘traditional morality’, involving a rich set of practices, (...) motivations and shared values common to many mainstream moral theories. For instance, John Rawls provides a version of traditional morality in the form of principles of justice grounded in a shared conception of society as a system of cooperation between free and equal citizens motivated by a sense of justice. The second level is that of ‘minimal morality’, for which the book is named. Minimal morality is grounded in purely prudential and instrumental reasoning, and thus does not rely upon any special moral commitments or motivations. This latter level of morality, Moehler argues, is particularly important for societies possessing extremely deep moral pluralism rather than the moral consensus necessary for traditional moral.
