What can rhetoric tell us about good arguments? The answer depends on what we mean by “good argument” and on how we conceive rhetoric. In this article I examine and further develop Jürgen Habermas’s argumentation theory as an answer to the question—or as I explain, an expanded version of that question. Habermas places his theory in the family of normative approaches that recognize (at least) three evaluative perspectives on all argument making: logic, dialectic, and rhetoric, which proponents loosely align with (...) the three dimensions of product, procedure, and process, respectively (cf. The question of the identity or persistence of the self through time may be interesting for philosophers, but it is hardly a burning question for most individuals. On the other hand, the question of who I am, what or who I take myself to be, can be a vital, even burning question for most of us at some time in our lives. This is the notion of personal identity I take up in this paper. It is an identity that is (...) not pre-given a priori but is always in some sense an open question, never completely decided. Here the narrative conception of self is relevant, since it is often a question of what story or kind of story my identity instantiates. This notion of personal identity is inherently temporal, but not in the sense of temporal persistence but of temporal coherence of past, present and future. And here the question of personal identity is inevitably social, since it is largely a question of what group I identify myself with, what social role I take myself to embody. And what complications occur when I identify myself with more than one group? Here many social conflicts and also intrapersonal conflicts have their source. My topic thus turns on ideas of personal identity that are reflected in the popular expressions “identity crisis” and “identity politics.”. (shrink)

Reflective equilibrium has been criticized for various reasons ever since the publication of Rawls’ A Theory of Justice. Recent empirical research into moral decision-making poses new challenges to RE because it questions the reliability of moral intuitions. This research might discredit moral intuitionism in general and RE in particular insofar as it ascribes epistemic value to moral intuitions. These findings suggest, for instance, that moral intuitions vary with cultural background, gender or framing. If it could be shown that all or (...) certain kinds of moral intuitions are unreliable, this would diminish the plausibility of the claim that they provide good reasons to believe in the truth of their content, especially given the growing evidence that professional philosophers are just as biased and susceptible to distorting factors as lay people. In this paper I critically discuss three recent defenses of RE against this unreliable intuitions objection. Two of these defenses argue that the UIO misses its target, because RE does not depend on intuitions, or because the relevant considered judgments in RE are not intuitions. The third defense grants that RE depends on intuitions and that some Rawlsian considered judgments are intuitions. But it argues that the notion of considered judgments can be revised, and that wide reflective equilibrium has the means to adopt the criticism because it can use information about unreliable intuitions and exclude those from further consideration. I argue that the first two defenses do not succeed. The third defense is the most promising one. However, I argue that this defense also fails. In this defense, RE is not a distinctive moral epistemic theory: different versions of RE would be conceivable, all of which are deeply problematic. I conclude with a discussion of the broader philosophical implications of the UIO, specifically whether or not accepting the UIO would warrant skepticism regarding moral knowledge. (shrink)

How do we and should we decide what is morally right and what is morally wrong? For much of human history, the teachings of religion were presumed to provide either the answer, or much of the answer. Over time, two developments challenged this. The first was the establishment of the discipline of moral philosophy. Foundational texts, such as Immanuel Kant's Groundwork of the Metaphysics of Morals, and the growth of coherent, nonreligious approaches to ethics, notably utilitarianism, served to marginalize the (...) role of religion. And then, second, the twentieth century saw the rapid growth of evolutionary biology with an enthusiastic presumption that biology was the source of ethics. Here, I begin by discussing these developments and then examine the extent to which religion is still needed for a coherent account of ethics. (shrink)

This article investigates the status assigned to Max Weber’s The Protestant Ethic and the Spirit of Capitalism as a case study on the development of the concept of theory in twentieth century sociology. I trace this development in the interplay between scholars in the United States and Germany and distinguish three waves of meaning given to the text. The transitions between these phases were brought about by an initial process of mystification of the text in the 1930s and a dynamic (...) of de- and re-mystification beginning in the 1980s. Following this process of (re)interpretation over time, I show that at the beginning of the century the work was perceived as an empirical inquiry, while at the end of the century it was treated as pure theory. Based on the example of the peculiarities of the Weberian expert communities in the United States and Germany, I analyze how the invention of a concept of theory as independent from empirical evidence helped to stabilize the value of scholarly expertise on Weber in the face of otherwise declining resonance of the text. The analysis of this paradigmatic case adds to our understanding of the development, uses, and meaning of theory in contemporary sociology. (shrink)

Der Beitrag analysiert Techniken öffentlicher Gesundheitskommunikation und skizziert im Ausblick Minimalbedingungen für ihre ethische Vertretbarkeit. Dazu wird erstens an einem aktuellen Beispiel veranschaulicht, wie mittels Text und Bild die Öffentlichkeit überzeugt werden soll, ein bestimmtes Gesundheitsverhalten an den Tag zu legen. Zweitens werden anhand der internationalen Ethik-Debatte fünf Grundtypen von Techniken in der Gesundheitskommunikation (Information, Argumentation, Persuasion, Manipulation und Zwang) rekonstruiert und entlang von Mittel, Zweck, Folgen für Adressaten sowie Implikationen für Autonomie aus ethischer Sicht unterschieden. Am besonders ambivalenten Beispiel (...) der Persuasion wird dann drittens diskutiert, welche ethischen Fallstricke es bei Gesundheitskommunikation zu bedenken gibt. Schließlich zeigen wir argumentativ auf, dass es in sensiblen bioethischen Themenfeldern wichtig ist, zwischen verschiedenen Techniken der Gesundheitskommunikation analytisch zu differenzieren. Ziel sollte die Ermöglichung einer fairen und transparenten Diskussion für breite Bevölkerungsgruppen sein. (shrink)

Abstract:This paper investigates whether, in theoretical terms, corporations can be citizens. The argument is based on the observation that the debate on “corporate citizenship” (CC) has only paid limited attention to the actual notion of citizenship. Where it has been discussed, authors have either largely left the concept of CC unquestioned, or applied rather unidimensional and decontextualized notions of citizenship to the corporate sphere. The paper opens with a critical discussion of a major contribution to the CC literature, the work (...) of Logsdon and Wood (Wood and Logsdon 2001; Logsdon and Wood 2002). It continues with a consideration of the nature and role of metaphors for business and of the contestable nature of the political concept of citizenship. It evaluates corporations as citizens through a four-dimensional framework of democratic citizenship offered by Stokes (2002). The analysis suggests that corporations do not easily fit the “liberal minimalist” model of citizenship. It finds, however some possibilities for fit with the three more participatory models. The paper concludes by cautioning against basing corporate citizenship on legal and administrative status or identity, and mapping out specific criteria by which we might determine whether corporations could be considered as citizens by virtue of their participation in processes of governance. Joseph Heath's Communicative Action and Rational Choice may be read as a critical commentary upon Habermas's critical social theory, but it may also be read as merely using the latter as “scaffolding” for the presentation of Heath's own version of critical theory. In what follows, I will focus on the second option and thus largely ignore the exegetical question to what extent Heath provides a fair reading of Habermas. This does not mean, however, that I will not make comparative judgements. (...) On the contrary, my overall claim will be that Heath's new critical theory is more functionalist, and. partly as a result, less critical than Habermas's. Since lack of space does not permit me to argue this in accordance with the standards of detail that Heath's own book generally observes, my procedure may be justified by the attempt to provoke a clarificatory response from Heath. Um diesem Vorwurf entgegenzutreten, soll unter Bezugnahme auf ein Projekt der Klinischen Ethik („METAP“) die ethische Unterstützung in Form der ethischen Fallbesprechung und der Ethikkonsultation mittels Prinzipienethik und Diskursethik gerechtfertigt werden. Prinzipienethik und Diskursethik können einander über das Medium der ethischen Fallbesprechung oder Ethikkonsultation fruchtbar (...) ergänzen. So können einige theoretische und praktische Schwächen der beiden Ansätze durch den jeweils anderen abgefedert werden. Die Diskursethik übernimmt bspw. die Sicherung der ethischen Gültigkeit von moralischen Entscheidungen bzw. Handlungsnormen und vermindert dadurch ein Rechtfertigungsdefizit, welches bei einem rein prinzipienorientierten Verfahren auftritt. Umgekehrt antwortet die Prinzipienethik u. a. auf Fragen der ethischen Angemessenheit und dient v. a. der adäquaten Einzelfallentscheidung. Durch die Integration des einen Ansatzes in den anderen ist eine umfassendere Rechtfertigungsleistung erzielbar als bei einem alleinigen Einsatz von Prinzipienethik oder Diskursethik. Selbst wenn einige Herausforderungen bestehen bleiben und auch das integrierte Modell moralische Dissense nicht immer verhindern kann, vermag es durch seine „doppelte“ Absicherung (Prinzipien und Diskurs) ein praktisches Vertrauen in die getroffene ethische Entscheidung zu stärken und so der Klinischen Ethik mehr „Robustheit“ zu geben, als sie bisher besitzt. This paper has two aims, as an exposition of Jürgen Habermas's response to the work of Michel Foucault, and to engage in and assess this debate between two influential contemporary schools of Continental philosophy. Habermas locates Foucault's project in the history of several attempts at a totalizing critique of reason, attempts which are trapped in a performative self?contradiction. Habermas also argues that Foucault is still caught up in the conceptual straitjacket of the philosophy of the subject which his theory was (...) meant to overcome. He shows that Foucault's central notion of power is used in two different and ultimately irreconcilable ways ? as a transcendental as well as an empirical concept. Much of Habermas's critique is justified and could, indeed, be extended to Foucault's anti?realist relativism, but Habermas's own defence of rationalism is not without difficulties of its own. Thus his notion of knowledge?guiding interests commits him to a form of anti?realism and a transcendental concept of instrumental power which is almost as problematic in its consequences as the anti?realism of Foucault. Berufliche Autonomie ist Voraussetzung für Zufriedenheit mit der eigenen Tätigkeit. Dem Arztberuf wird ein hohes Maß an Autonomie zugeschrieben, verbunden mit fachlicher und ethisch-moralischer Kompetenz für lebenswichtige Bereiche. Das sind wesentliche Elemente für das positive Image dieses Berufes. Zu Beginn der ärztlichen Tätigkeit ist die ethischmoralische Kompetenz weitgehend ausgebildet, während die fachliche Kompetenz erst erworben werden muss. Kliniken, in denen die Weiterbildung meist erfolgt, sind oft auch heute noch traditionell hierarchisch organisiert. Die z.T. feudalistischen oder militärischen Strukturen behindern autonome moralische (...) Entscheidungen und bewirken eine strukturelle Verantwortungslosigkeit. Behinderungen und Druck durch Vorgesetzte, finanzielle Sanktionen, Standesdünkel und Profilierungsbestreben werden an typischen Konfliktsituationen aufgezeigt. Es kommt dadurch zu Spannungen, Unzufriedenheit, Gewissenskonflikten und Erkrankungen bis zum Burn out. Engagement von Mitarbeitern wird verhindert, Kreativität nicht genutzt und Fehler werden nicht konstruktiv bearbeitet. Dadurch können Patienten unangemessen belastet oder geschädigt werden. Nicht nur Vorgesetzte, sondern auch Nachgeordnete können so in Gefahr geraten, ihre moralischen Werte anderen Interessen unterzuordnen. Es werden Wege zu einer autonomiefördernden Kultur zwischen Ärzten und mit anderen Berufsgruppen aufgezeigt. Dazu gehört eine institutionalisierte Kommunikation auf der Basis gegenseitiger Wertschätzung in einem partnerschaftlichen Team, das auch ethische Fragen im Diskurs bearbeiten kann. (shrink)

The author describes Heller’s concept of ethics as a “quasi-sphere” intersecting with various fields relating to human relationships. Special attention is paid to the axiological aspects of her concept of ethics and the relationship between virtues and responsibility. The author also seeks to show how Heller integrated a traditional philosophical question—the relationship between “is” and “ought to be”—into her concept of “radical philosophy” at an earlier stage in the development of her philosophy. She initially considered the relationship between “is” and (...) “ought to be” to be contrasting. Later, when she had come to accept the political model of liberal capitalist society, the ideal of all-compassing equality became the ideal of “equality of opportunities”. The author interprets this shift as one in which the relationship becomes continual. He is also critical of Heller’s underestimation of the effect the “social a priori” has on the possibilities of human life. (shrink)

S'agissant du problème lié au statut de la connaissance humaine en général, la querelle du faillibilisme et du fondationnalisme n'est pas neuve. On peut même dire qu'elle parcourt l'histoire de la philosophie depuis ses tout débuts. Dans le contexte des préoccupations propres à la pensée contemporaine, cette querelle semble cependant se cristalliser autour de la question suivante : quel statut devons-nous aujourd'hui accorder à nos énoncés philosophiques? Pouvons-nous et devons-nous encore revendiquer pour ces énoncés, traditionnellement chargés d'établir les fondements et (...) les principes premiers, un statut ontologique, sinon transcendantal? Ou au contraire, le développement des sciences expérimentales modernes, ayant éveillé en nous de manière sans cesse plus aiguë la conscience de la précarité de nos connaissances, ne nous incite-t-il pas désormais à envisager les propositions philosophiques comme n'étant rien de plus, malgre leur prétention et leur visée, que des énoncés faillibles, relatifs à l'expérience ou à l'histoire? Wird in philosophischen Diskussionen auf Emmanuel Levinas Bezug genommen, bleibt es zumindest in einigen Theoriekontexten häufig bei dem Verweis auf den „Anderen“, dem wir die Moral schulden, gelten doch seine Schriften immer noch als metaphysisch aufgeladen und in ihrer Radikalität als unplausibel. Weitgehend außer Acht gelassen wird dabei, wie Levinas sich dazu äußert, dass wir in der Welt nie nur mit einem, sondern mit vielen Anderen leben und somit vor der Frage stehen, wie wir diesen allen gerecht werden können. Auch (...) dass für Levinas diese Frage nicht mehr in den Bereich der Ethik, sondern in das Feld der Politik gehört, wird entsprechend oft nicht weiter reflektiert. Um das Verhältnis zwischen Ethik und Politik bei Levinas im Hinblick auf einen Dialog mit anderen Theorieansätzen näher zu beleuchten, werde ich zunächst wichtige Grundannahmen seiner Philosophie in Erinnerung rufen. In einem zweiten Schritt werde ich überlegen, inwiefern die Bezugnahme auf seine Arbeiten für andere moralphilosophische Ansätze fruchtbar sein könnte. Schließlich werde ich darlegen, inwiefern auch für an Levinas anknüpfende Theorien eine Öffnung hin zu anderen Philosophietraditionen sinnvoll ist. (shrink)

Institutional economics and discourse theory stand unconnected next to each other, in spite of the fact that they both ask for the legitimacy of institutions (normative) and the functioning and effectiveness of institutions (positive). Both use as theoretical constructions rational individuals and the concept of consensus for legitimacy. Whereas discourse theory emphasizes the conditions of a legitimate consensus and could thus enable institutional economics to escape the infinite regress of judging a consensus legitimate, institutional economics has a tested social science (...) paradigm (rational choice) of explaining and predicting the functioning of institutions. The article outlines a theoretical synthesis of the two theories by finding points in common and possibilities of fruitful combinations concerning the problem of legitimacy, institutional design and effectiveness of legal norms. Philosophy and Structure. On why it is necessary for hermeneutic philosophy to make use of structural theory. In this essay I give reasons for the thesis that hermeneutic philosophy has to adopt considerations on structural theory in order to avoid the paradox of historism. Concepts of structure like 'criticism', 'centralism', 'creativity' etc. possess both a metaphilosophical and an empirical status which enables us to compare and to combine differend and opposed philosophies by means of common structures. Such an hermeneutic reflection (...) on philosophical structures requires the methodical work of fiction and selection. Otherwise relativism concerning the evaluation of philosophical traditions would be the result. (shrink)
