It is common to think that what theory of linguistic vagueness is correct has implications for debates in philosophy of law. I disagree. I argue that the implications of particular theories of vagueness on substantive issues of legal theory and practice are less far-reaching than often thought. I focus on four putative implications discussed in the literature concerning (i) the value of vagueness in the law, (ii) the possibility and value of legal indeterminacy, (iii) the possibility of the rule of (...) law, and (iv) strong discretion. I conclude with some methodological remarks. Delineating questions about conventional meaning, the metaphysics/metasemantics of (legal) content determination, and norms of legal interpretation and judicial practice can motivate clearer answers and a more refined understanding of the space of overall theories of vagueness, interpretation, and law. This paper takes up an important epistemological challenge to the naturalistic moral realist: that her metaphysical commitments are difficult to square with a plausible rationalist view about the epistemology of morality. The paper begins by clarifying and generalizing this challenge. It then illustrates how the generalized challenge can be answered by a form of naturalistic moral realism that I dub joint-carving moral realism. Both my framing of this challenge and my answer advertise the methodological significance of non-fundamental epistemological theorizing, which (...) defends and deploys epistemological claims without adverting to the most fundamental epistemological facts. This paper outlines a novel solution to the problem of the many and a conception of ordinary objects that implies it. The solution is that many collections of particles can simultaneously constitute a single object. The proposed conception of ordinary objects maintains that they are fundamentally subjects of change: the changes an object is able to survive explain its constitution.

How does vagueness interact with metaphysical modality and with restrictions of it, such as nomological modality? In particular, how do definiteness, necessity (understood as restricted in some way or not), and actuality interact? This paper proposes a model-theoretic framework for investigating the logic and semantics of that interaction. The framework is put forward in an ecumenical spirit: it is intended to be applicable to all theories of vagueness that express vagueness using a definiteness (or: determinacy) operator. We will show how (...) epistemicists, supervaluationists, and theorists of metaphysical vagueness like Barnes and Williams (2010) can interpret the framework.  We will also present a complete axiomatization of the logic we recommend to both epistemicists and local supervaluationists. . Several variants of Lewis's Best System Account of Lawhood have been proposed that avoid its commitment to perfectly natural properties. There has been little discussion of the relative merits of these proposals, and little discussion of how one might extend this strategy to provide natural property-free variants of Lewis's other accounts, such as his accounts of duplication, intrinsicality, causation, counterfactuals, and reference. We undertake these projects in this paper. We begin by providing a framework for classifying and assessing the variants (...) of the Best System Account. We then evaluate these proposals, and identify the most promising candidates. We go on to develop a proposal for systematically modifying Lewis's other accounts so that they, too, avoid commitment to perfectly natural properties. We conclude by briefly considering a different route one might take to developing natural property-free versions of Lewis's other accounts, drawing on recent work by Williams. (shrink)

One class of central debates between normative realists appears to concern whether we should be naturalists or reductionists about the normative. However, metaethical discussion of naturalism and reduction is often inconsistent, murky, or uninformative. This can make it hard to see why commitments relative to these metaphysical categories should matter to normative realists. This paper aims to clarify the nature of these categories, and their significance in debates between normative realists. I develop and defend what I call the joint-carving taxonomy, (...) which builds on David Lewis’ notion of elite properties. I argue that this taxonomy is clear and metaphysically interesting, and answers to distinctive taxonomic interests of normative realists. I also suggest that it has important implications for the project of adjudicating debates among normative realists. (shrink)

Epistemicism associates vagueness with ignorance produced by semantic plasticity: the shiftiness of intensions in our language resulting from small changes in usage. The recent literature (Caie 2012; Magidor 2018; Yli-Vakkuri 2016) points to a missing piece in the epistemicist theory of vagueness, namely a clear account of the semantics of the definiteness operator Δ. The fundamentals of the epistemicist theory are well understood. However, the technical work of defining the definiteness operator has proven difficult. There are several desiderata that we (...) would like Δ to satisfy. For instance, we would like the epistemicist notion of ‘definiteness’ to interact well with modal operators and validate intuitive principles like ‘necessarily, if φ is definitely true, then φ is true’. Providing an account that would meet all such desiderata has eluded the epistemicists so far. In this paper, I present a novel version of a multidimensional model inspired by the work of Robert Stalnaker and David Kaplan. Using this model, I provide an account of epistemicist definiteness that meets our desiderata. (shrink)

An increasing number of philosophers argue that indeterminacy is metaphysical (or worldly) in the sense that indeterminacy has its source in the world itself (rather than how the world is represented or known). The standard arguments for metaphysical indeterminacy are centered around the sorites paradox. In this essay, I present a novel argument for metaphysical indeterminacy. I argue that metaphysical indeterminacy follows from the existence of constitutive social construction; there is indeterminacy in the social world because there is indeterminacy in (...) how the social world is constructed. A problem of the many Fs arises in cases where intuitively there is precisely one F (in the region you are talking about), but when you look closely you find many candidates for being that F, each one apparently as well-qualified as the next. Imagine an apparently solitary cloud in an otherwise blue sky. Look closer, and you'll see lots of water vapor molecules, with no one collection of them more eligible than the others to count as the cloud. Many (...) things are like this when you look closely enough. The problem arises for mundane things like rocks, houses and coins. It also arises for entities that present special philosophical challenges, like persons and experiencers. In this essay, I present a new argument that the problem of the many experiencers is an especially hard problem of the many, and property dualism—the view that properties that there is something it is like to instantiate are irreducible—may be the best way to solve it. This article surveys recent developments in the epistemology of modality.

What kind of semantics should someone who accepts the epistemicist theory of vagueness defended in Timothy Williamson’s Vagueness (1994) give a definiteness operator? To impose some interesting constraints on acceptable answers to this question, I will assume that the object language also contains a metaphysical necessity operator and a metaphysical actuality operator. I will suggest that the answer is to be found by working within a three-dimensional model theory. I will provide sketches of two ways of extracting an epistemicist semantics (...) from that model theory, one of which I will find to be more plausible than the other. (shrink)

The Problem of Overlappers is a puzzle about what makes it the case, and how we can know, that we have the parts we intuitively think we have. In this paper, I develop and motivate an overlooked solution to this puzzle. According to what I call the self-making view it is within our power to decide what we refer to with the personal pronoun ‘I’, so the truth of most of our beliefs about our parts is ensured by the very (...) mechanism of self-reference. Other than providing an elegant solution to the Problem of Overlappers, the view can be motivated on independent grounds. It also has wide-ranging consequences for how we should be thinking about persons. Among other things, it can help undermine an influential line of argument against the permissibility of elective amputation. After a detailed discussion and defence of the self-making view, I consider some objections to it. I conclude that none of these objections is persuasive and we should at the very least take seriously the idea that we are to some extent self-made. (shrink)

I argue, pace Timothy Williamson, that one cannot provide an adequate account of what it is for a case to be borderline by appealing to facts about our inability to discriminate our actual situation from nearby counterfactual situations in which our language use differs in subtle ways. I consider the two most natural ways of using such resources to provide an account of what it is for a case to be borderline and argue that both face crippling defects. I argue (...) that the problems faced by these two accounts point to more general reasons to be skeptical of the claim that facts about semantic indiscriminability provide sufficient resources for an analysis of what it is for a case to be borderline. The conclusion of this chapter is that higher-order vagueness is universal: no sentence whatsoever is definitely true, definitely definitely true, definitely definitely definitely true, and so on ad infinitum. The argument, of which there are several versions, turns on the existence of Sorites sequences of possible worlds connecting the actual world to possible worlds where a given sentence is used in such a way that its meaning is very different. I will here present a number of problems concerning the idea that there is ontological vagueness, and the related claim that appeal to this idea can help solve some vagueness-related problems. A theme underlying the discussion will be the distinction between vagueness specifically and indeterminacy more generally (and, relatedly, the distinction between ontological vagueness and ontological indeterminacy). Even if the world is somehow ontologically indeterminate it by no means follows that it is, properly speaking, ontologically vague.1..

This paper considers the connections between semantic shiftiness (plasticity), epistemic safety and an epistemic theory of vagueness as presented and defended by Williamson (1996a, b, 1997a, b). Williamson explains ignorance of the precise intension of vague words as rooted in insensitivity to semantic shifts: one’s inability to detect small shifts in intension for a vague word results in a lack of knowledge of the word’s intension. Williamson’s explanation, however, falls short of accounting for ignorance of intension.

: Radical sceptical possibilities challenge the anti-realist view that truth consists in ideal rational acceptability. Putnam, as part of his defence of an anti-realist view, subjected the case of the brain in a vat to a semantic externalist treatment, which aimed to maintain the desired connection between truth and ideal rational acceptability. It is argued here that self-consciousness poses special problems for this externalist strategy. It is shown how, on a standard model of first-person reference, Putnam's brain in a vat (...) will be mistaken in its rational self-ascription of externalist predicates. The natural response, which employs an alternative model of first-person reference, is shown to have the equally realist consequence that there are enquiry-transcendent truths about the self. The paper challenges Williamson’s safety based explanation for why we cannot know the cut-off point of vague expressions. We assume throughout (most of) the paper that Williamson is correct in saying that vague expressions have sharp cut-off points, but we argue that Williamson’s explanation for why we do not and cannot know these cut-off points is unsatisfactory. -/- In sect 2 we present Williamson's position in some detail. In particular, we note that Williamson's explanation relies on taking a particular safety (...) principle ('Meta-linguistic belief safety' or 'MBS') as a necessary condition on knowledge. In section 3, we show that even if MBS were a necessary condition on knowledge, that would not be sufficient to show that we cannot know the cut-off points of vague expressions. In section 4, we present our main case against Williamson's explanation: we argue that MBS is not a necessary condition on knowledge, by presenting a series of cases where one's belief violates MBS but nevertheless constitutes knowledge. In section 5, we present and respond to an objection to our view. And in section 6, we briefly discuss the possible directions a theory of vagueness can take, if our objection to Williamson's theory is taken on board. (shrink)
