Unlike natural-born citizens, many immigrants have agreed to undertake political obligations. Many have sworn oaths of allegiance. Many, when they entered their adopted country, promised to obey the law. This paper is about these agreements. First, it’s about their validity. Do they actually confer political obligations? Second, it’s about their justifiability. Is it permissible to get immigrants to undertake such political obligations? Our answers are ‘usually yes’ and ‘probably not’ respectively. We first argue that these agreements give immigrants political obligations. (...) We then argue that getting immigrants to undertake such obligations is morally wrong. This is because it makes immigrants’ political obligations more burdensome than those of natural-born citizens. We conclude that the practice of getting immigrants to undertake such obligations should be abolished. (shrink)

Morally supererogatory acts are those that go above and beyond the call of duty. More specifically: they are acts that, on any individual occasion, are good to do and also both permissible to do and permissible to refrain from doing. We challenge the way in which discussions of supererogation typically consider our choices and actions in isolation. Instead we consider sequences of supererogatory acts and omissions and show that some such sequences are themselves problematic. This gives rise to the following (...) puzzle: what problem can we have with a sequences of actions if each individual act or omission is itself permissible? In this paper, we develop a response to this question, by exploring whether solutions analogous to those proposed in the rational choice literature are available in the case of supererogatory sequences. Our investigation leads us to the view that making sense of the supererogatory requires accepting that there are global moral norms that apply to sequences of acts alongside the local moral norms that apply to individual acts. Suppose, we could take a pill that would turn us into morally better people. Would we have a duty to take such a pill? In recent years, a number of philosophers have discussed this issue. Most prominently, Ingmar Persson and Julian Savulescu have argued that we would have a duty to take such a pill. In this article, I wish to investigate the possible limits of a duty to take moral enhancement drugs through investigating the related question of whether it (...) would be desirable to create a world populated entirely with morally perfect people. I argue, drawing on the work of Bernard Williams, Susan Wolf, and Michael Slote, that we have reason to be grateful that we do not live a world in which everyone is morally perfect, as this would prevent people from dedicating their lives to valuable nonmoral projects. I then argue that this thought should serve as a limitation on attempts to morally improve people through the use of technology. Finally, I explore the implications of this discussion for some of the less ambitious forms of moral enhancement currently being explored in the literature. I argue that these forms of enhancement give us no reason to worry about preventing valuable, morally imperfect ways of life. In fact, by acting as a shortcut to moral development, they might serve as an aid to help people fulfill valuable nonmoral goals in a way that is morally permissible. (shrink)

According to many, to have epistemic justification to believe P is just for it to be epistemically permissible to believe P. Others think it is for believing P to be epistemically good. Yet others think it has to do with being epistemically blameless in believing P. All such views of justification encounter problems. Here, a new view of justification is proposed according to which justification is a kind of composite normative status. It is commonly assumed that praiseworthiness should form part of the analysis of supererogation. I will argue that this view should be rejected. I will start by arguing that, at least on some views of the connection between moral value and praiseworthiness, it does not follow from the fact that acts of supererogation go beyond what is required by duty that they will always be praiseworthy to perform. I will then consider and dismiss what I will call the Argument from (...) Stipulation in favour of holding that acts of supererogation are always praiseworthy. Next, I will examine what I will call the Necessary Connection Argument, which posits a necessary connection between supererogation and praiseworthiness. I will argue that the intuitions used to motivate this argument are best explained by a debunking explanation. (shrink)

Motivational judgement internalists hold that there is a necessary connection between moral judgments and motivation. There is, though, an important lack of clarity in the literature about the types of moral evaluation the theory is supposed to cover. It is rarely made clear whether the theory is intended to cover all moral judgements or whether the claim covers only a subset of such judgements. In this paper I will investigate which moral judgements internalists should hold their theory to apply to. (...) I will argue that the possibility of the supererogation amoralist, someone who makes genuine supererogation judgements but remains unmotivated by them, makes it implausible to be an internalist about moral goodness. As a result, internalists should restrict their claim to moral requirement judgements. I will then argue that this creates an explanatory burden for Internalism. In order for their view to be plausible they must explain why some moral judgements and not others are necessarily connected to motivation. (shrink)

Generosity is not the same thing as kindness or self-sacrifice. Presumptuousness is incompatible with generosity, but not with kindness or self-sacrifice. I consider a kind but interfering neighbour who inappropriately takes over the role of mother to my daughter; her behaviour is not generous. Presumptuousness is the improper exercise of a disposition to adopt a role that one does not have. With this in mind I explore the idea that generosity is the proper exercise of the disposition to adopt a (...) role that one does not have. It is a mean between meanness on the one hand (where that disposition is not exercised when it should be) and presumptuousness on the other hand (where that disposition is exercised when it should not be). Adopting a role is being motivated by the considerations that should motivate someone who actually has that role. The disposition to adopt roles you do not have is important in social situations where there is a need for a role that nobody is filling. It is also the basis of developing relationships like friendship; you have to act as if you are a friend before you become a friend. This model fits the parable of the Good Samaritan in an obvious way. It also explains charity and forgiveness. I suggest that forgiveness is demanded by a certain relationship – call it love. What makes forgiveness optional after someone has wronged you is that love itself may be optional after someone has wronged you. There is nothing generous about forgiving someone you love, though loving them may be generous. Forgiveness only counts as generous when you don’t love the person, and even then it can fail to be generous if it is presumptuous. (shrink)

How can we make sense of God’s moral goodness if God cannot be subject to moral obligations? This question is troubling for divine command theorists, as if we cannot make sense of God’s moral goodness then it seems hard to see how God’s commands could be morally good. Alston argues that the concept of supererogation solves this problem. If we accept the existence of acts that are morally good but not morally required then we should accept that there is no (...) need for an act to fulfill a moral obligation in order for it to be morally good. This view has been criticized by both Stump and Lombardi :313–326, 2005), who claim that it is impossible for an agent who has no obligations to perform acts of supererogation. Young attempts to defend Alston’s solution by offering a new analysis of supererogation. In this paper I will argue first that Young fails to provide an adequate response to Lombardi’s objection. I will then provide my own defence of Alston’s proposal. (shrink)

Many find it plausible to posit a category of supererogatory actions. But the supererogatory resists easy analysis. Traditionally, supererogatory actions are characterized as actions that are morally good, but not morally required; actions that go the call of our moral obligations. As I shall argue in this article, however, the traditional analysis can be accepted only by a view with troubling consequences concerning the structure of the moral point of view. I propose a different analysis that is extensionally correct, avoids (...) the problems of the traditional view, and, incidentally, also defuses any objection to act-consequentialism, or any other first-order moral theory, on grounds that it cannot accommodate the supererogatory. There has been some debate as to whether or not it is possible to keep a promise, and thus fulfil a duty, to supererogate. In this paper, I argue, in agreement with Jason Kawall, that such promises cannot be kept. However, I disagree with Kawall’s diagnosis of the problem and provide an alternative account. In the first section, I examine the debate between Kawall and David Heyd, who rejects Kawall’s claim that promises to supererogate cannot be kept. I disagree with (...) Heyd’s argument, as it fails to get to the heart of the problem Kawall articulates. Kawall’s argument however fails to make clear the problem with promising to supererogate because his discussion relies on the plausibility of the following claim: that supererogatory actions cannot also fulfil obligations. I argue that this view is mistaken because there are clear examples of supererogatory actions that also fulfil obligations. In the final section, I give my alternative account of the problem, identifying exactly what is wrong with fulfilling a duty, and thus keeping a promise, to supererogate. My diagnosis emphasises the importance of identifying non-supererogatory actions when it comes to understanding the way in which supererogatory actions go above and beyond the call of duty. (shrink)

It has been claimed, by David Heyd, that in order for an act to count as supererogatory the agent performing the act must possess altruistic intentions (1982 p.115). This requirement, Heyd claims, allows us to make sense of the meritorious nature of acts of supererogation. In this paper I will investigate whether there is good reason to accept that this requirement is a necessary condition of supererogation. I will argue that such a reason can be found in cases where two (...) people act in the same way but with only the person who acted with altruistic intent counting as having performed an act of supererogation. In such cases Heyd’s intention requirement plays an important role in ruling out acts that intuitively are not supererogatory. Despite this, I will argue that we should reject Heyd’s requirement and replace it with a moral intention requirement. I will then investigate how to formulate this requirement and respond to two objections that might be raised against it. (shrink)

It is widely accepted that morality does not demand that we do our very best, but our most significant moral traditions do not easily accommodate this intuition. I will argue that the underlying problem is not specific to any particular tradition. Rather, it will be difficult for any moral theory to account for binary moral concepts like permissible/impermissible while also accounting for scalar moral concepts like better/worse. If only the best is considered permissible, morality will seem either unreasonably demanding or (...) implausibly minimal. But if we draw a line of duty below the optimal, then we must explain how the act that is worse is nonetheless permissible. Some have tried to explain this by appealing to non-moral considerations, and others have appealed to agent-relative moral considerations. I argue that no such approach will work. We should instead exploit the distinction between reasons for performing an act and reasons for holding someone accountable for an act’s performance. This approach will also help to clear up a confusion regarding the notion of a moral demand. (shrink)

The purpose of this paper is to consider the question of whether we have a duty to forgive those who repent and apologize for the wrong they have done. I shall argue that we have a pro tanto duty to forgive repentant wrongdoers, and I shall propose and consider the norm of forgiveness. This norm states that if a wrongdoer repents and apologizes to a victim, then the victim has a duty to forgive the wrongdoer, other things being equal. That (...) someone has a pro tanto duty to forgive a repentant wrongdoer means that he or she ought to forgive unless other considerations outweigh the norm of forgiveness. Furthermore, a distinction is made between what are termed 'general considerations' and 'case-relative considerations', and it is argued that only after all the relevant considerations have been examined can it be determined whether there is a duty to forgive, all things considered. I argue that recent virtue theories (including those of Hursthouse, Slote, and Swanton) face important initial difficulties in accommodating the supererogatory. In particular, I consider several potential characterizations of the supererogatory modeled upon these familiar virtue theories (and their accounts of rightness) and argue that they fail to provide an adequate account of supererogation. In the second half of the paper I sketch an alternative virtue-based characterization of supererogation, one that is grounded in the attitudes of virtuous ideal observers, and (...) that avoids the concerns raised in the first part of the paper. In the latter half of this century, there have been two mostly separate threads within ethical theory, one on 'superogation', one on 'common-sense morality'. I bring these threads together by systematically reflecting on doing more than one has to do. A rich and coherent set of concepts at the core of common-sense morality is identified, along with various logical connections between these core concepts. Various issues in common-sense morality emerge naturally, as does a demonstrably productive definition of doing more than (...) one has to do. I then present an interpreted model-theoretic framework with the expressive power to generate truth-conditions for the core concepts, and the explanatory power to predict and explain the independently motivated logical connections between these concepts. The framework also has a certain heuristic power for 'discovering' substantive ethical theories that can derivatively generate the model-theoretic framework for the core concepts. Two theories discussed are expansions of traditional theories; two others, each giving pride of place to justice, are devised to resonate with more recent concerns. Methodologically, it is hoped that the approach within might suggest the possibility of bridging another gap: that between formal and informal studies of moral notions. (shrink)

Acts that are considered undesirable standardly violate our expectations. In contrast, acts that count as morally desirable can either meet our expectations or exceed them. The zone in which an act can be morally desirable yet not exceed our expectations is what we call the zone of moral indifference, and it has so far been neglected. In this paper, we show that people can use positive terms in a deflated manner to refer to actions in the zone of moral indifference, (...) whereas negative terms cannot be so interpreted. (shrink)

Are we ever morally permitted to do what is morally wrong? It seems intuitive that we are, but evidence for dissociations among judgment of permissibility and wrongness are relatively scarce. Across 4 experiments (N = 1,438), we show that people judge that some behaviors can be morally wrong and permissible. The dissociations arise because these judgments track different morally relevant aspects of everyday moral encounters. Judgments of individual rights predicted permissibility but not wrongness, while character assessment predicted wrongness but not (...) permissibility. These findings suggest a picture in which moral evaluation is granular enough to express reasoning about different types of normative considerations, notably the possibility that people can exercise their rights in morally problematic ways. Suppose that somebody is asking me kindly to do her a favor. She has no right to it. It is my choice whether or not to respond positively. Hence, she asks me for the favor rather than demand it. On the other hand, it seems that my refusal to do her the favor would be rude, inconsiderate, unkind, and morally wrong. This is why we tend to respond positively to favor asking and feel that we have to apologize if we (...) refuse. In this article, I address this puzzle. I claim that refusing to do a favor is morally wrong precisely because a favor has been asked. The requestee needs me, and her very need calls upon me to reveal my goodness. In a sense, this is the strength of her weakness. I claim that acceding to do a favor is a special kind of imperfect obligation in Kant's and Mill's terminologies. As opposed to their descriptions, this obligation is directed toward a definite person at a prescribed time. It turns out that small favors are of the greatest importance for human activity. We all have our needs. We are social animals, and we are depended on others to fulfill our needs. Agreeing to do a favor is one of the building blocks of our shared social endeavor. (shrink)

Organizations have neither a right to the vote nor a weighty right to life. We need not enfranchise Goldman Sachs. We should feel few scruples in dissolving Standard Oil. But they are not without rights altogether. We can owe it to them to keep our promises. We can owe them debts of gratitude. Thus, we can owe some things to organizations. But we cannot owe them everything we can owe to people. They seem to have a peculiar, fragmented moral status. (...) What explains this? Individualistic views explain this in terms of individualistic notions alone. Such notions don’t invoke any distinctive features of organizations. They just invoke the features of individual members of organizations. Collectivistic views, instead, explain this in terms of collective notions alone. Such notions don’t invoke the features of individual members of organizations. They just invoke the features of those organizations. We argue that neither approach works. Instead, one needs to synthesize the two approaches. Some individual interests, we think, are distinctively collective. We, as individuals, have a distinctive interest in playing a part in successful collective action. From this, so we argue, flows the apparently peculiar, fragmented moral status of organizations. A familiar part of debates about supererogatory actions concerns the role that cost should play. Two camps have emerged: one claiming that extreme cost is a necessary condition for when an action is supererogatory, while the other denies that it should be part of our definition of supererogation. In this paper, I propose an alternative position. I argue that it is comparative cost that is central to the supererogatory and that it is needed to explain a feature that all accounts (...) agree is central to the very notion of supererogation: optionality. Perhaps because of this agreement on its importance, few attempts have been made to clarify and explain the notion of optionality. I argue that giving an account of the optionality of supererogatory requires drawing a line between doing the bare minimum permissible and going beyond the bare minimum and that this line ought to be drawn based on comparative cost of alternative permissible acts. Having outlined my account and motivated it, I discuss and reject two concerns that might be raised: firstly, that it is extreme cost, not comparative cost, that matters and, secondly, that in fact no cost is needed for an act to be supererogatory. It is often claimed that all acts of supererogation involve sacrifice. This claim is made because it is thought that it is the level of sacrifice involved that prevents these acts from being morally required. In this paper, I will argue against this claim. I will start by making a distinction between two ways of understanding the claim that all acts of supererogation involve sacrifice. I will then examine some purported counterexamples to the view that supererogation always involves sacrifice and (...) examine their limitations. Next, I will examine how this view might be defended, building on comments by Dale Dorsey and Henry Sidgwick. I will then argue that the view and the argument in favor of it should be rejected. I will finish by showing how an alternative explanation for the limits of moral obligation avoids the problems facing The Sacrifice View. (shrink)

I argue that supererogation poses a serious problem for theories of moral reasoning and that this problem results, at least in part, from our taking too narrow a view of the reasons that can influence an act’s deontic status. We tend to focus primarily on those reasons that count directly for and against an act’s performance. To adequately account for supererogation, we need to consider also a different class of moral reasons. Aside from those reasons that contribute, for instance, to (...) an act’s being morally better or worse than its alternatives, there are moral reasons that govern the ways in which we respond to the performance or non-performance of those acts. These reasons govern the attitudes we express in response to moral acts as well as our practices of issuing demands and of seeking justification in the case of an omission. These sorts of moral reasons are, I argue, integral to an account of supererogation. Attending to them will allow us to accept that the supererogatory omission does actually involve a moral failure of sorts while denying that it is a failure of obligation. And this will allow us to account for our intuitions regarding supererogation while avoiding what I call the problem of supererogation. I begin with a discussion of what we might mean by ‘supererogation’, and I outline the problem that it raises. I then provide an account of supererogation that avoids this problem. (shrink)

Philosophers are by now familiar with “the” paradox of supererogation. This paradox arises out of the idea that it can never be permissible to do something morally inferior to another available option, yet acts of supererogation seem to presuppose this. This paradox is not our topic in this paper. We mention it only to set it to one side and explain our subtitle. In this paper we introduce and explore another paradox of supererogation, one which also deserves serious philosophical attention. (...) People who perform paradigmatic acts of supererogation very often claim and believe that their acts were obligatory. Plausibly, this is simply a mistake insofar as the actions really are “above and beyond the call of duty,” as common sense would have it. The fact that moral heroes tend to view their actions in this apparently mistaken way is puzzling in itself, and we might learn something interesting about the moral psychology of such individuals if we could explain this tendency. However, this puzzling aspect of the moral psychology of moral heroes is also the chief ingredient in a deeper puzzle, one perhaps more worthy of the title “paradox.” In this paper we present and try to resolve this paradox. The paradox arises when we combine our initial observation about the moral psychology of moral heroes with three plausible claims about how these cases compare with one in which the agent realizes her act is “above and beyond.” The first of these three additional claims is that the agent who mistakenly claims that the act is obligatory is no less virtuous than someone who performs such an act whilst correctly judging it to be obligatory. The second is that the agent who makes such a mistake would display more moral wisdom if she judged the act to be supererogatory. The third is that there is no other relevant difference between the two agents. These three claims, together with a plausible principle about the way in which the virtues work, give rise to a paradox. We consider several ways in which this paradox might be resolved. We argue that the most plausible resolution is to reject the claim that there is no other relevant difference between the two agents. More specifically, we argue that a relevant difference is that the agent who makes this mistake does so because of the depth of their commitment to certain moral values, and that this is itself an important moral virtue: moral depth. Governments are subject to the requirements of justice, yet often seem to go above and beyond what justice requires in order to act in ways many people think are good. These kinds of acts – examples of which include putting on celebrations, providing grants to poets, and preserving historic architecture – appear to be acts of government supererogation. In this paper, I argue that a common view about the relationship between government, coercion, and justice implies that most such acts are (...) not supererogatory, but wrong. First, I will provide an overview of the debate about whether or not acts of supererogation exist. Next, I will investigate the issue of how to define the supererogatory. 'May one be pardon’ d and retain the offence?’ asks King Claudius in his tormented monologue in Hamlet. Forgiveness appears incompatible with the retention of the offence, both in the sense of enjoying its consequences and in the sense of the subsistence of the attitude which underlay the offensive act. There are, however, views which allow for, even admire, an attitude of forgiveness towards people who have ‘retained’ their offense in some way. This idea of forgiveness is harder to justify, (...) since no change has taken place in the agent. We suggest that the concept of toleration can serve as an illuminating clue in such an analysis. The tolerant attitude involves a certain kind of reconciliation with people who not only have done something wrong in the past, but insist on sticking to their objectionable conduct in the present and the future. Tolerance, in other words, is not conditioned by repentance or by commitment to behavioral transformation; it is a kind of unconditional ‘forgiveness’ in advance. (shrink)

Gratitude is the proper or called-for response in a beneficiary to benefits or beneficence from a benefactor. It is a topic of interest in normative ethics, moral psychology, and political philosophy, and may have implications for metaethics as well. Despite its commonness in everyday life, there is substantive disagreement among philosophers over the nature of gratitude and its connection to other philosophical concepts. The sections of this article address five areas of debate about what gratitude is, when it is called (...) for, and what implications it has for other debates in moral philosophy and philosophy generally. Bourdieu and Derrida share a focus on the ambiguity of the practice of gift relationships already pointed out by Mauss. From Bourdieu’s perspective, the question of gratuity is epistemically futile, as it veils the objective truth of gift-giving, yet ethically and politically relevant, as it refers to a hypocrisy which can be instrumental to enhancing civic virtue and solidarity. Bourdieu’s “scientific humanism,” however, implausibly reduces this ambiguity to interest maximization, and aims to build a solidaristic democracy by means of the (...) generalization of the hypocrisy of gratuity. In turn, by interpreting gratuity as “unconditionality,” Derrida aims not at dissolving, but at dramatizing the ambiguity of gift relationships by turning it into “madness” and an “impossible possibility”. Whereas I agree with Derrida’s insistence on the salience of the requirement of gratuity, his approach can lead to counterintuitive and hubristic consequences. Instead, I suggest some elements of an alternative way of understanding gratuitous gifts as communicative acts irreducible to an economic calculation or circle. From this standpoint, a gratuitous gift can be constituted by certain forms of recognition, emotions, or convictions without for that becoming an “impossibility”. (shrink)

Can there be a duty to forgive those who have wronged us? According to a popular view amongst philosophers working on forgiveness the answer is no. Forgiveness, it is claimed, is always elective. This view is rejected by Gamlund (2010a; 2010b) who argues that duties to forgive do exist and then provides conditions that are relevant to determining whether forgiveness is obligatory or supererogatory. In this paper I will argue that the conditions that Gamlund provides do not provide a plausible (...) account of the connection between forgiveness and duty. The problems I will raise against Gamlund’s view is a problem that faces any moral view that makes room for supererogation. I will then investigate whether the existing solutions to this problem provide a more plausible account of the connection between forgiveness and obligation. I will argue that the two most prominent solutions, The Favouring Reasons View and The Sacrifice View, produce implausible results when applied to the case of forgiveness. However, an alternative view, The Freedom View, can provide plausible results when applied to the case of forgiveness. This gives us defeasible reason to favour this as a general solution to The Problem of the Good Ought Tie-Up. (shrink)

Drawing on Victor Frankl’s observations, this comment illustrates how human beings are prior to any initiative that is pre-directed towards meaning. In pointing to this human condition, it introduces a subtle distinction between striving for happiness and a will for meaning, yet it is in the trans-ethical meaningful acts that a relation can be found with the witnessing as referred to by Note and Van Daele.

We argue that permissibility-based solutions to the paradox of supererogation encounter a nested dilemma. Such approaches solve the paradox by distinguishing moral and rational permissions. If they do not also include a bridge condition that relates these two permissions, then they violate a very plausible monotonicity condition. If they do include a bridge condition, then permissibility-based solutions either amount to rational satisficing or they collapse back into the classical account of supererogation and fail to resolve the paradox.

The problem of supererogation has attracted significant attention from contemporary moral philosophers. In this paper, we show that this problem was outlined in different terms in the work of the 11th century Persian philosopher Abū Alī Miskawayh. As well as identifying this problem, Miskawayh also developed a unique solution cashed out in terms of virtue ethics that has not yet been considered in the contemporary literature. We will argue that this solution, which is in its general form independent of virtue (...) ethics, provides a plausible explanation of what makes some acts supererogatory and faces two important advantages over the most popular response to the problem of supererogation, The Sacrifice View. Unlike The Sacrifice View, The Cautionary Account can class acts of benevolence that advance the agent's own interests as supererogatory and easily explain why certain acts of sacrifice are neither permissible nor praiseworthy. How can it be that some acts of very high moral value are not morally required? This is the problem of supererogation. I do not argue in favor of a particular answer. Instead, I analyze two opposing moral intuitions the problem involves. First, that one should always do one’s best. Second, that sometimes we are morally allowed not to do our best. To think that one always has to do one’s best is less plausible, as it makes every morally best (...) act obligatory. I argue that, despite its implausibility, this is the main ingredient in a traditional outlook I call ‘morality of law,’ which conceives of morality as impartial, impersonal, rule-based and obligation-based. My main point is that supererogation will always be seen as problematic if the background theory is a morality of law. This is because supererogation encapsulates a view of morality-outside-obligation, whereas morality of law centers upon obligation as its main instrument of curbing a supposedly natural human selfishness. This study builds on prior research investigating the antecedents of firm supererogation. Examining vehicle recalls in the U.S. automobile industry from 1966 to 2010 reveals that surveillance-based government enforcement programs can have widespread industry effects on a specific type of supererogatory action, firm volunteerism. Specifically, increases in government surveillance are associated with firms going beyond what is legally required of them by initiating voluntary product recalls for defects not covered in existing government regulation. Such effects are shown to be unique (...) among surveillance efforts as other government enforcement activities, such as standards-based regulation, are revealed to have a negative association with firm supererogation.
