(Early) Modern social contract theories reject the idea that legal and political institutions are grounded in an alleged natural ordering or hierarchy of human beings, and instead argue that only government by a public (and not private) authority can fulfil the idea of justice as freedom and equality for all. To be authoritative and not just powerful, governing institutions must be shared as ours in this irreducible sense. I first outline how Kant’s ideal account of rightful freedom brilliantly transforms this (...) tradition as found in the works of Hobbes, Locke, and Rousseau, before proposing a way to see Kant’s two-layered non-ideal theory—his accounts of human nature (“moral anthropology”) and historical societies (“the principle of politics”)—as complementing his ideal theory of rightful freedom. This enables us to envision a conception not only of rightful external freedom but of rightful human freedom in particular societies—with their histories—on planet Earth. With these arguments at hand, we can also better appreciate the importance of realizing that the four possible political conditions for Kant—anarchy, barbarism, despotism, and republic—are ideas of reason, which means that they are never perfectly realized. Hence, historical societies we are not either in the state of nature or in civil society. In addition, in historical societies founded on principles of freedom, there are pockets of injustice or pockets that are devoid of justice that can only be captured by means of one of the three political ideas that are not constitutive of the republican legal-political framework. Kant’s four ideas therefore give us more tools with which to capture the nature of different political forces and challenges facing us in our historical societies. (shrink)

This book stems from an examination of how Western philosophy has accounted for the foundations of law. In this tradition, the character of the “sovereign” or “lawgiver” has provided the solution to this problem. But how does the sovereign acquire the right to found law? As soon as we ask this question we are immediately confronted with a convoluted combination of jurisprudence and theology. The author begins by tracing a lengthy and deeply nuanced exchange between Derrida and Nancy on the (...) question of community and fraternity and then moves on to engage with a diverse set of texts from the Marquis de Sade, Saint Augustine, Kant, Hegel, and Kafka. These texts—which range from the canonical to the apocryphal—all struggle in their own manner with the question of the foundations of law. Each offers a path to the law. If a reader accepts any path as it is and follows without question, the law is set and determined and the possibility of dialogue is closed. The aim of this book is to approach the foundations of law from a series of different angles so that we can begin to see that those foundations are always in question and open to the possibility of dialogue. I demonstrate that the pre-Critical Kant is essentialist and intellectualist about the relational properties of substances. That is to say, God can choose whether or not to create a substance, and whether or not to connect this substance with other substances, so as to create a world: but God cannot choose what the nature of the relational properties is, once the substance is created and connected. The divine will is constrained by the essences of substances. Nonetheless, Kant considers that essences (...) depend upon God, in that they depend upon the divine intellect. I conclude by gesturing towards some possible implications of this interpretation, when considering the role that might be played by God – both historically and conceptually – in relation to the notion of ‘laws of nature’, and when understanding Kant's transcendental idealism and his Critical conception of freedom. Many regard Kant’s account of the highest good as a failure. His inclusion of happiness in the highest good, in combination with his claim that it is a duty to promote the highest good, is widely seen as inconsistent. In this essay, I argue that there is a valid argument, based on premises Kant clearly endorses, in defense of his thesis that it is a duty to promote the highest good. I first examine why Kant includes happiness in the highest (...) good at all. On the basis of a discussion of Kant's distinction between 'good' and 'pleasant', and in light of his methodological comments in the second chapter of the Critique of Practical Reason, I explain how Kant’s conception of the good informs his conception of the highest good. I then argue that Kant's inclusion of happiness in the highest good should be understood in light of his claim that it is a duty to promote the happiness of others. In the final section of this essay, I reconstruct Kant’s argument for the claim that it is a duty to promote the highest good and explain in what sense this duty goes beyond observance of the Categorical Imperative. This monograph offers a fresh perspective on the applicability of mathematics in science. It explores what mathematics must be so that its applications to the empirical world do not constitute a mystery. In the process, readers are presented with a new version of mathematical structuralism. The author details a philosophy of mathematics in which the problem of its applicability, particularly in physics, in all its forms can be explained and justified. Chapters cover: mathematics as a formal science, mathematical ontology: what (...) does it mean to exist, mathematical structures: what are they and how do we know them, how different layers of mathematical structuring relate to each other and to perceptual structures, and how to use mathematics to find out how the world is. The book simultaneously develops along two lines, both inspired and enlightened by Edmund Husserl’s phenomenological philosophy. One line leads to the establishment of a particular version of mathematical structuralism, free of “naturalist” and empiricist bias. The other leads to a logical-epistemological explanation and justification of the applicability of mathematics carried out within a unique structuralist perspective. This second line points to the “unreasonable” effectiveness of mathematics in physics as a means of representation, a tool, and a source of not always logically justified but useful and effective heuristic strategies. Gottscheds vertraute Korrespondenten Flottwell, Scheyb und Brucker berichten aus Königsberg, Wien und Augsburg wie gewohnt über ihre Projekte und Ereignisse aus ihrem Umfeld. Christoph Otto (...) von Schönaich verfolgte die öffentliche Resonanz auf sein Epos Hermann und sandte Gottsched bereits Umdichtungen für die Neuauflage. 1751 begann die Korrespondenz mit dem Dichter Magnus Gottfried Lichtwer, nachdem Gottsched Lichtwers Fabeln glänzend rezensiert hatte. Zu den 19 neuen Korrespondenten gehörte auch Jean-Jacques Dortous de Mairan, Mitglied zahlreicher europäischer Akademien. Er reagierte auf das Angebot, eine deutsche Übersetzung seiner Arbeit über das Eis anzufertigen, deren eminenten Wert Gottsched in einer seiner seltenen Rezensionen naturwissenschaftlicher Publikationen herausgestellt hatte. One of Bolzano’s objections to Kant’s way of drawing the analytic-synthetic distinction is that it only applies to judgments within a narrow range of syntactic forms, namely, universal affirmative judgments. According to Bolzano, Kant cannot account for judgments of other syntactic forms that, intuitively, are analytic. A recent paper by Ian Proops also attributes to Kant the view that analytic judgments beyond a limited range of syntactic forms are impossible. Issue number 4 of "SYMPHILOSOPHIE: International Journal of Philosophical Romanticism" is devoted to the Dutch philosopher François Hemsterhuis and 250th anniversary of the birth of the German romantics Novalis and Friedrich Schlegel. This fourth issue of the journal contains nearly 600 pages of new research articles, translations, review-essays, and book reviews. The main section on Hemsterhuis among the German Romantics was guest edited by Daniel Whistler (Royal Holloway, University of London).

An unprecedented reading of Hegel’s Logic that sets this difficult work in a dialogue with literary texts. In this book, Angelica Nuzzo proposes a reading of Hegel’s Logic as “logic of transformation” and “logic of action,” and supports this thesis by looking to works of literature and history as exemplary of Hegel’s argument and method. By examining Melville’s Billy Budd, Molière’s Tartuffe, Beckett’s Endgame, Elizabeth Bishop’s and Giacomo Leopardi’s late poetry along with Thucydides’ History in this way, Nuzzo finds an (...) unprecedented and productive way to render Hegel’s Logic alive and engaging. She argues that Melville’s Billy Budd is the most successful embodiment of the abstract movement of thinking presented in Hegel’s Logic, connecting Billy Budd’s stutter to the puzzlingly inarticulate beginning of Hegel’s Logic, “Being, pure Being,” identical with “Nothing,” and argues that the Logic serves as an especially appropriate tool for understanding the sudden violent action that strikes Claggart dead. Through these and other readings, Nuzzo finds a fresh way to address interpretive issues that have remained unresolved for almost two centuries in Hegel scholarship, and also presents well-known works of literature in an entirely new light. This account of Hegel’s Logic is framed by the need for an interpretive tool able to orient our understanding of the contemporary world as mired in an unprecedented global crisis. In this article I offer an opinionated overview of the central elements of Kant’s philosophical methodology during the critical period. I begin with a brief characterization of how Kant conceives of the aims of human inquiry – focusing on the idea that inquiry ideally aims at not just cognition (Erkenntnis), but also the more demanding cognitive achievements that Kant labels insight (Einsehen) and comprehension (Begreifen). Then I explore the implications of this picture for philosophy — emphasizing Kant’s distinction between critical (...) and doctrinal phases of philosophical inquiry, with the first of these playing both a negative and a positive role with respect to the second. Then, I will argue that this positive role is possible, according to Kant, only insofar as philosophy follows what I call a “capacities-first” methodology – that is, one that treats basic cognitive capacities (such as reason) and their self-conscious activities as fundamental (in both a cognitive sense and in an explanatory sense) for the sort of philosophy human beings are capable of. It is this methodology, I will argue, that allows Kant to introduce the first principles that philosophy in its doctrinal phase requires in a manner that is neither arbitrary nor (at least obviously) incompatible with Kant’s own critical restrictions on cognition. I conclude by discussing some of the implications of this methodological picture – including the methodological significance of self-consciousness and regressive or “transcendental” arguments, Kant’s distinction between analytic and synthetic methods in philosophy, and Kant’s conception of reason as autonomous. The article illustrates the different meanings of the term “logic” in Weber's work and then proceeds to discuss his approach to the explanation of historical events and in particular to counterfactual analysis. Weber's epistemology is first situated within the neo-Kantian debates of his time as well as legal positivism and historical jurisprudence. The article then focuses on this author's conception of science as a value sphere, on the aims and methods of explanation in the social and historical sciences and on (...) the key concepts of possibility judgements and adequate causation. The central role played by counterfactuals and modal logic is illustrated through the example of the battle of Marathon, which Weber himself saw as the starting point of a causal chain leading to the rise of Western rationalism. The article concludes by highlighting the pioneering role of Weber's counterfactualism for the subsequent development of possible worlds theory and its use in the causal analysis of singular historical events. Kant defines ‘enlightenment’ as ‘humankind’s emergence from its self-imposed immaturity’. This essay considers the meaning, role, and novelty of this definition, while also examining its relation to the Enlightenment slogans: ‘sapere aude’ (‘Dare to be wise!’) and ‘Think for yourself’. It is argued that there are two subtly different aspects to the ‘immaturity’ from which Kant, insofar as he endorses the transformative process of enlightenment, is urging us to ‘emerge’. These aspects correspond to his two images of immaturity: first, confinement (...) within a kind of baby walker (Gängelwagen), and, second, attachment to ‘leading strings’ (Leitbande). It is argued that the first is a matter of thinking only ‘by courtesy’, the second a matter of thinking under the guidance of another – one’s guardian. It is asked whether Kant’s slogan ‘think for yourself’ might not be pragmatically self-defeating, and whether his insistence that one think for oneself can be made consistent with his permitting belief formation on the basis of the testimony of another. Finally, Kant’s concept of enlightenment is situated with respect to his distinction between the public and private ‘uses of reason’, on the one hand, and his defence of ‘freedom of the pen’, on the other. In this paper I argue that Kant’s psychology of moral motivation has less in common with Hutcheson’s view than interpreters have traditionally thought. I first offer an interpretation of the role that feeling, desire, and cognition play in Kant’s account of moral action. I then outline the essential features of Hutcheson’s understanding of desire before arguing that although Kant and Hutcheson share the trivial similarity that even moral action springs from a desire, Kant conceives of the desire at the root (...) of moral action as qualitatively different from all other desires in a number of important ways. This chapter offers a reassessment of the relationship between Kant, the Kantian tradition, and phenomenology, here focusing mainly on Husserl and Heidegger. Part of this reassessment concerns those philosophers who, during the lives of Husserl and Heidegger, sought to defend an updated version of Kant’s philosophy, the neo-Kantians. The chapter shows where the phenomenologists were able to benefit from some of the insights on the part of Kant and the neo-Kantians, but also clearly points to the differences. This is an essay on Kant's neglected late tract On a Recently Adopted Prominent Tone in Philosophy (RTP) and Derrida's oblique commentary on this work in his D'un ton apocalyptique adopté naguère en philosophie. The theme of the essay is metaphilosophical and considers issues concerning the nature of critical philosophy, fanaticism (Schwärmerei), and the use of religious tropes in philosophy. I am primarily interested in the ways in which RTP thematises the legitimacy of speaking in an exalted, quasi-religious tone apropos (...) of the authority of Reason as a self-legitimising capacity in philosophical speech. An important additional reason for taking a closer look at this text is because the late Jacques Derrida (1930–2004) took a great interest in this work of Kant’s and, indeed, emphasised, rightly I think, that despite its prima facie rhetorically charged, polemical nature this work—which might at first be taken to be merely a lampoon—is anything but insignificant in Kant’s œuvre. Derrida’s On a Recently Adopted Apocalyptic Tone in Philosophy, originally published in 1983, is an oblique commentary on Kant’s RTP, and aims to expose to view the alleged hidden underpinnings of Kant’s polemic against exaltation or fanaticism (Schwärmerei) in philosophy. Derrida tries to show that Kant’s appeal for tonal moderation in philosophy, for a measured speech, which should rein in exalted modes of speech, is itself not neutral and rather fundamentally biased against an exalted, quasi-religious, manner of thought. It is evident that, as he himself notes early on in RTP, Kant is predisposed towards a more Aristotelian, academic kind of philosophy, which adopts a “proper” tone or pitch in philosophical debate, but Derrida claims that Kant himself raises his voice precisely in lampooning exalted thinkers. I am particularly interested in the extent to which Derrida’s critique manifests a fundamental misapprehension of the Kantian mode of moderating critique. By expounding this misapprehension, Kant’s own reasons for his philippic against religious or quasi-religious talk in philosophy are foregrounded, thus showing the nature of properly critical thought. At the same time, I shall show how Derrida underestimates the self-reflexivity, and hence properly critical, self-authorising mode of thinking, underlying his own oblique references to the adieu as a trope for quasi-transcendental intentionality towards the so-called ‘Other’. I examine here if Kant’s metaphysics of matter can support any late-modern versions of classical mechanics. I argue that in principle it can, by two different routes. I assess the interpretive costs of each approach, and recommend the most promising strategy: a mass-point approach.

I argue that Rawls’ reading of Kant has been a major influence on the work of some contemporary Kantian scholars. Rawls’ influence on the new Kantian moral theory can be recognized in several points: a) the conception of philosophy as a “deeply practical project”, which leads to the adoption of a first-person approach to ethics; b) the reception of Kant’s philosophy within a pragmatic context, which leads to play down the metaphysical implications of Kant’s dualisms, in favor of an interpretation (...) which seems plausible within a political culture given in advance c) a characteristic interpretation of Kant’s moral constructivism, which while stressing the primacy of the right over the good, tries to specify the ways in which the good plays a role in morals, thereby opening a way to show the relevance of the empirical in Kant’s ethics d) an approach to Kant’s practical reason which stresses the complementarities between the Hypothetical and the Categorical Imperative, interpreted in the light of Rawls’ distinction between the Rational and the Reasonable; e) the central role played by the concept of “rational nature” in the new Kantian moral theory, which may likewise be related to Rawls’ concern for clarifying the conception of the person behind his approach to practical reason. Freud (and later commentators) have failed to explain how the origins of psychoanalytical theory began with a positivist investment without recognizing a dual epistemological commitment: simply, Freud engaged positivism because he believed it generally equated with empiricism, which he valued, and he rejected ‘philosophy’, and, more specifically, Kantianism, because of the associated transcendental qualities of its epistemology. But this simple dismissal belies a deep investment in Kant’s formulation of human reason, in which rationality escapes natural cause and thereby bestows humans (...) with cognitive and moral autonomy. Freud also segregated human rationality: he divided the mind between (1) an unconscious grounded in the biological and thus subject to its own laws, and (2) a faculty of autonomous reason, lodged in consciousness and free of natural forces to become the repository of interpretation and free will. Psychoanalysis thus rests upon a basic Kantian construction, whereby reason, through the aid of analytic techniques, provides a detached scrutiny of the natural world, i.e. the unconscious mental domain. Further, sovereign reason becomes the instrument of self-knowing in the pursuit of human perfection. Herein lies the philosophical foundation of psychoanalytic theory, a beguiling paradox in which natural cause and autonomous reason — determinism and freedom — are conjoined despite their apparent logical exclusion. Although we cannot find any Aesthetics system in the works of NISHIDA Kitarõ (1870-1945), the most significant and influential Japanese philosopher of the twentieth-century, one of his central themes is the role of art and aesthetics in relation with morality and religion. His aesthetics approaches are magnificent examples of his aim to overcome the innate dualism that sustains modern epistemology and a door, apparently hidden, to a better understanding of all his speculative scheme of philosophy. This paper attempts to throw (...) light to the importance of the first aesthetic approximation developed by Nishida eleven years before the publication of Zen no Kenkyû [ 善 の?究 ] (An Inquiry into the Good) (1911) and twenty-three years before the publication of the more accurate system of aesthetics that we read in Geijutsu to dôtoku [芸術 と 道? ] (Art and Morality) (1923). We will analyze the small essay entitled "Bi no Setsumei" [美 の?明] ("An explanation of Beauty") (1900) and Nishida's first definition of beauty as muga [無我] (self-effacement or ecstasy). (shrink)

In this paper, building on recent and longstanding work (Warren 2001, Friedman 2013, Glezer 2018), I investigate how the account of the essences or natures of material substances in the Metaphysical Foundations is related to Kant’s demand for the completeness of the system of nature. We must ascribe causal powers to material substances for the properties of those substances to be observable and knowable. But defining those causal powers requires admitting laws of nature, taken as axioms or principles of natural (...) science, which govern anything that can be constructed mathematically or “given as an object of experience” (MAN, 4:474–75). Presenting a complete system of nature requires adumbrating the properties of material substances that can be objects of experience. But it is not possible to show how those properties are involved in explanations of the phenomena without involving the laws that govern interactions between material substances. For Kant, or so I will argue, it is not possible to account for the natures of things, or for the features of laws of nature, independently of each other. The paper will substantiate the Finitist Account (FA) of Kant on laws. The Finitist Account has it that modal judgments about the possible proofs that can be made, or interactions that can be explained, are (1) based on concrete intuitive reasoning and motivated by the desire to avoid appeal to the actual infinite, (2) grounded in finite decision procedures, which are (3) based on reliable systems of axioms or rules of inference. The problem of knowledge in German Idealism has drawn increasing attention. This is the first attempt at a systematic critique that covers all four major figures, Kant, Fichte, Schelling, and Hegel. The book offers a fresh and challenging analysis.

German into English of the-- Das älteste Systemprogramm des deutschen Idealismus.]. -/- Note: the manuscript is in the handwriting of G.W.F. Hegel, but the actual authorship is disputed. No date is given. Franz Rosenzweig made up the title as it is known today. He published the text in 1917. At that time, F. Rosenzweig thought F.W.J. Schelling was the author. No one has read this book for errors. As always, any errors, mistakes or oversights etc. are mine alone. Given a couple more years, I could improve this book. This is a philosophical translation and not a philological translation. Martin Luther who did the famous early translation of the Bible into German wrote in a letter, “If anyone does not like my translation, they can ignore it… (September 15, 1530)”. There are no ‘correct’ translations. Some are just better than other translations. -/- The Oldest Systematic Program of German Idealism. The German title is: Das Älteste Systemprogramm Des Deutschen Idealismus. This title was made up by Franz Rosenzweig in 1917, when he first published the manuscript. He found the manuscript in the Royal Library in Berlin in 1913. The manuscript suggested date is around 1796 and was done by handwriting research. However, the manuscript is not dated. The Prussian State Library auctioned in March 1913 from the auction of the house Liepmannssohn in Berlin a single sheet on the front and back with Hegel's cursive handwriting. The manuscript was lost during WWII. But Dieter Henrich found it again in 1979 in the “Biblioteka Jagiellonska” in Krakow (Poland), where it is today. Address: Jagiellonian Library, Jagiellonian University, al. Mickiewicza 22, 30-059 Cracow, Poland. Later research suggests that manuscript had come from the estate of Hegel’s student Friedrich Christoph Förster (1791-1868). He was one of the editors of Hegel’s posthumous works and most likely had access to a number of Hegel’s manuscripts. This text actually being one of them. Hegel traveled around Bohemia with Marie and Friedrich Christoph Förster around the year 1820-21 (see Klaus Vieweg). -/- Philosophical mystery -- who is the author or authors of this text? -/- Take a plunge into the deep and cold waters. Maybe a quagmire or quandary, but decidedly interesting. This project is to contextualize an old handwritten manuscript which is about 225 years old. The actual author is a mystery. I offer my own assessment. You can make your own assessments. The mystery has continued to unfold since 1917. There is plenty to read. Otherwise, think about the authorship and read more of the German philosophers and authors from this period and enjoy the depth of thinking and philosophizing. On one hand, there is just the sheer fun in the puzzle of the authorship questions; and on the other hand, these are the alluring thoughts that lead to the nascent stage of German Idealism and our intellectual heritage. There is no end to the accolades for this group of philosophers. A heritage that we still hear in in our attempts to move forward into our future. -/- Do your own astute exegesis (ἐξήγησις) as all paths are still open. Let your thought take to the wings of what is called thinking with this text. Critical encounters (Auseinandersetzung, or a Gegenüberstellung) with at least: Friedrich Hölderlin (1770-1843) Friedrich Wilhelm Joseph Schelling (1775-1854), and Georg Wilhelm Friedrich Hegel (1770-1831) --- starts here! German Idealism. We are not going to study this situation endlessly, instead we make some broad strokes and provide you a general context. You are allowed to read between the lines too. Goal: to understand the overall affinity and differences between the intellectuals of this period in German history; and to come to grips with this demanding text within its large scholarly context in the last 100 years. 'Ethics of Behavior Control. A new foundation' Do we need a new ethics? Or even an 'ethics of behavior control'? Partly founded by Immanuel Kant, but no longer valid in all its aspects? If there are values and norms, which of them can survive the so called "decay of values"? And if there are limits of ethcis, for example caused by (social) system conditions, arises the question of how to legitimate new ethical challenges and demands. Arguing that our attachment to Aristotelian modes of discourse makes a revision of their conceptual foundations long overdue, the author proposes the consideration of unacknowledged factors that play a central role in argument itself. These are in particular the subjective imprint and the dynamics of argumentation. Their inclusion in a four-dimensional framework and the focus on thesis validity allow for a more realistic view of our discourse practice. Exhaustive analyses of fascinating historical and contemporary arguments are provided. These range from (...) Columbus’s advocacy of the Western Passage to India, over the trial of King Louis XVI during the French Revolution, to today’s highly charged controversies surrounding euthanasia and embryo research. Excavating foundational issues such as the purpose of argument itself and the contested role of argument as a generator of knowledge, the book culminates in a discussion of the relationship between rationality and reasonableness and criticizes the restrictions of ‘rational’ argument relying on fixed logical, economic or cultural criteria that in reality are mutable. Here, a true, open argument requires the infusion of Paul Lorenzen’s principle of ‘transsubjectivity’, which recognizes but transcends the partiality of the individual and which can be seen in the pragmatic and expanding consensus that humanity can control itself to safeguard the future of a fragile, damaged world.
