[full article, abstract in English; abstract in Lithuanian] During the last few years, it has become usual to turn to some seventeenth century readings of the traditional idea of an original common possession of the earth for philosophical aid to explain and support the rights of persons in situations of extreme need, including refugees. Hugo Grotius’s conception of this idea is one of the most cited ones. In this paper, I hold that a Grotian reading of the idea of an (...) original common possession of the earth is not a fruitful principle if we want to elaborate a solid defence of the rights of the ones in need. I reconstruct and analyse the role this idea has in Grotius’s theory of private property and present objections to it from a Kantian perspective. (shrink)

The topic of my dissertation is the political and philosophical thought of Lü Zuqian, one of the key players in the history of the "True Way Learning" in Southern Song China and a close associate of Zhu Xi. Focusing on core concepts in Lü’s writings like self-cultivation, imperial sovereignty, law, rites, institutions and reform, this study advances a new interpretation of Lü Zuqian's modes of thinking. The comparison of Lü Zuqian's political ideas to those of contemporaries such as Zhu Xi, (...) Zhang Shi, Lu Jiuyuan, Chen Liang and Ye Shi clarifies the political language and the political engagements of Daoxue thinkers. This case study tries to explain the fundamental nature of political Daoxue discourse between 1160 and 1180 and to shed new light on the interpretation of "Neo-Confucian" thought in general. n diesem Beitrag zum Scherpunkt "Politische Theorie in der Krise" untersuche ich das von liberalen Theorien produzierte Wissen. Der Beitrag folgt dazu drei Selbstbeschreibungen des politischen Liberalismus, der sich erstens selbst als dominierendes Zentrum der gegenwärtigen Politischen Theorie sieht, der zweitens Anspruch darauf erhebt, mit seinem Wissen die politischen Selbstverständnisse von Bürger_innen anleiten und verändern zu können, und der schließlich drittens seine eigene Wirksamkeit in der Wirklichkeit im Rahmen der Diskussion um ideale und nicht-ideale Theorie verhandelt. Im affirmativen Nachvollzug dieser (...) drei Selbstbeschreibungen zeigt der Artikel, wie das Wissen des politischen Liberalismus eine von politischen Konflikten befreite Wirklichkeit erzeugt und zugleich die politischen Selbstverständnisse der Bürger_innen mithilfe dieser Wirklichkeitskonstruktion lenkt. Damit zielt das Wissen des politischen Liberalismus darauf ab, eine Subjektivität zu formen, die sich zugunsten einer rechtsförmigen Verwaltung von Politik verabschiedet. (shrink)

Abstract Carl Schmitt distinguishes between political theories in terms of whether they rest on the anthropological assumption that man is evil by nature or on the anthropological assumption that man is good by nature, and he claims that liberal political theory is based on the latter assumption. Contrary to this claim, I show how Kant's liberalism is shaped by his theory of the radical evil in human nature, and that his liberalism corresponds to the characterization of liberalism that Schmitt himself (...) offers. My discussion of this issue will be shown to have certain implications with respect to the view that for Kant evil is the product of society. I show that this view is mistaken insofar as it fails to recognize that Kant's political philosophy implies that human beings require the type of society that best suits their radically evil natures, namely, a commercial one in which the ?vices of culture? largely have free play, while the state's role is limited to that of preventing the antagonisms found in society leading to the mutual destruction of its members. A crucial socio-political challenge for our age is how to rede!ne or extend group membership in such a way that it adequately responds to phenomena related to globalization like the prevalence of migration, the transformation of family and social networks, and changes in the position of the nation state. Two centuries ago Immanuel Kant assumed that international connectedness between humans would inevitably lead to the realization of world citizen rights. Nonetheless, globalization does not just foster cosmopolitanism but simultaneously yields the (...) development of new group boundaries. Group membership is indeed a fundamental issue in political processes, for: “the primary good that we distribute to one another is membership in some human community” – it is within the political community that power is being shared and, if possible, held back from non-members. In sum, it is appropriate to consider group membership a fundamental ingredient of politics and political theory. How group boundaries are drawn is then of only secondary importance. Indeed, Schmitt famously declared that “[e]very religious, moral, economic, ethical, or other antithesis transforms into a political one if it is suffciently strong to group human beings e#ectively according to friend and enemy”. Even though Schmitt’s idea of politics as being constituted by such antithetical groupings is debatable, it is plausible to consider politics among other things as a way of handling intergroup di#erences. Obviously, some of the group-constituting factors are more easily discernable from one’s appearance than others, like race, ethnicity, or gender. As a result, factors like skin color or sexual orientation sometimes carry much political weight even though individuals would rather con!ne these to their private lives and individual identity. Given the potential tension between the political reality of particular groupmembership defnitions and the – individual and political – struggles against those definitions and corresponding attitudes, citizenship and civic behavior becomes a complex issue. As Kymlicka points out, it implies for citizens an additional obligation to non-discrimination regarding those groups: “[t]his extension of non-discrimination from government to civil society is not just a shift in the scale of liberal norms, it also involves a radical extension in the obligations of liberal citizenship”. Unfortunately, empirical research suggests that political intolerance towards other groups “may be the more natural and ‘easy’ position to hold”. Indeed, since development of a virtue of civility or decency regarding other groups is not easy, as it often runs against deeply engrained stereotypes and prejudices, political care for matters like education is justified. Separate schools, for example, may erode children’s motivation to act as citizens, erode their capacity for it and!nally diminish their opportunities to experience transcending their particular group membership and behave as decent citizens. This chapter outlines a possible explanation for such consequences. That explanation will be found to be interdisciplinary in nature, combining insights from political theory and cognitive neuroscience. In doing so, it does not focus on collective action, even though that is a usual focus for political studies. For example, results pertaining to collective political action have demonstrated that the relation between attitudes and overt voting behavior or political participation is not as direct and strong as was hoped for. Several conditions, including the individual’s experiences, self-interest, and relevant social norms, turned out to interfere in the link between his or her attitude and behavior. Important as collective action is, this chapter is concerned with direct interaction between agents and the in$uence of group membership on such interaction – in particular joint action. Although politics does include many forms of action that require no such physical interaction, such physical interaction between individuals remains fundamental to politics – this is the reason why separate schooling may eventually undermine the citizenship of its isolated pupils. This chapter will focus on joint action, de!ned as: “any form of social interaction whereby two or more individuals coordinate their actions in space and time to bring about a change in the environment”. Cognitive neuroscienti!c evidence demonstrates that for such joint action to succeed, the agents have to integrate the actions and expected actions of the other person in their own action plans at several levels of speci!city. Although neuroscienti!c research is necessarily limited to simple forms of action, this concurs with a philosophical analysis of joint action, which I will discuss below. (shrink)

The article is devoted to transformations and the crisis of values in a global world. The genealogy of values is traced as a way of existence and justification of normativity characteristic of modernity. In this context, value is compared with cost. Both the first and second are reductions inherent in the modern way of human existence. Value personifies the reduction of the complex, heterogeneous, qualitatively diverse world of external goods of pre-industrial society to a single denominator of abstract labor. Same, (...) the complexly structured and heterogeneous reality of due acquired the appearance of a single space of values. In this context, the theoretical limitations of the pan-production view of human historical development are analyzed. The current war, which in its impact on humanity has acquired a de facto global character, is considered as a defining symptom of the crisis of values in global reality. War as a feature of the modern world is significant not in itself, but as an expression of the growing role of violence in the life of global civilization. In turn, the increase in violence and coercion is a manifestation of an even deeper process — the depreciation of values. The depreciation of values does not mean the destruction of certain specific values, but in general the role of the due in human life. In this regard, a key question arises about the prospects for overcoming the process of depreciation of values. By analogy with the three recognized paradigms of philosophizing (being, consciousness/subject, language), three historical paradigms of normativity are distinguished: transpersonal indisputable prescriptions (“commandments”); mediated by personal reflection and recognition of binding significance (values); abstinences — negative normative presumptions aimed at ensuring peaceful productive interaction with guaranteed autonomy of participants in interactions. The development of the normative practice of such abstinences may be with a possible scenario for overcoming the depreciation of values in the global world. (shrink)

English title: Kant and the Right to Vote The article is a contribution to the ongoing debate in NFT about the moral responsibility of voters. Kristian Skagen Ekeli has argued that politically ignorant citizens have a duty to abstain from voting. He argues that such a duty fol- lows from Kant’s duty to respect other persons. I analyze Ekeli’s proposed duties by considering how they might fit into Kant’s system of duties. I conclude, contra Ekeli, that the Kantian duty to (...) respect persons does not give rise to a duty for politically ignorant voters to abstain from voting. -/- Denne artikkelen er et bidrag til debatten om velgeres moralske ansvar. Kristian Skagen Ekeli har i to artikler argu- mentert for at uvitende borgere har en plikt til ikke å stemme, noe han begrunner ut fra en kantiansk pliktetikk. Det er imidlertid uklart hvordan en uvitende borgers plikt til å avstå fra å stemme skulle følge av Kants plikt til å respek- tere personer, noe Cornelius og Herman Cappelen kort antyder i sin kommentar til Ekeli. I denne artikkelen foretar jeg en analyse av de pliktene som Ekeli tar til orde for, og undersøker hvordan disse eventuelt kunne passe inn i Kants system av plikttyper. Jeg konkluderer motsatt av Ekeli, med at den kantianske plikten til å respektere personer ikke gir grunnlag for en plikt for uvitende borgere til å avstå fra å stemme i valg. (shrink)

Isaiah Berlin viewed value conflict as tragic, as it requires the sacrifice of some values for others. It is a mark of maturity, he thought, to accept this tragic truth. This view raises certain conceptual problems that can be attributed to Berlin’s subtle departures from the German authors (Kant, Schelling, and Hegel) who originated the doctrine of tragic maturity—figures who had, in turn, transformed the earlier idea that enlightenment is a natural and morally neutral process of maturation. Kant moralized the (...) notion of enlightened maturation by portraying it as contingent on our courage to bring it about, such that we are responsible if we remain immature. This theory of maturity rested on the idea, which would have been uncongenial to Berlin, that we are intelligible creatures inhabiting the noumenal realm, duty bound to exercise moral freedom, even though this duty surpasses our ability to carry it out, as we also inhabit the phenomenal realm, where our natural inclinations tend to make us resist laboring to fulfill our duties. However, according to Kant, the metaphysical limitations we face as individuals can be transcended to an extent, allowing us to make moral progress as a species—so long as we do not lazily persist in our immaturity. Schelling built upon Kant’s notion of freedom to bring out the tragic and heroic dimension of individual moral life, where the tragedy is our doomed but noble struggle to exert moral freedom in a world of natural necessity. Hegel turned these metaphysical notions in a more recognizably Berlinian direction by extending Schelling’s account of tragic conflict to conflicts of values. But he identified the ultimate tragic hero as an ethical totality that enacts eternal justice by reconciling such conflicts, while Berlin attempted to repudiate both the notion of a historical totality and the possibility of reconciliation on empirical grounds, even though these are metaphysical claims. Thus, Berlin asserted the absolute, trans-historical necessity of tragic value conflict, while the evidence for this assertion was merely his personal conviction that in his particular time and place, specific values were, as a matter of empirical fact, tragically irreconcilable. In this manner he illicitly portrayed Cold War value pluralists (such as himself) as courageously accepting the tragic inevitability of value conflict, while Marxists, the legatees of Hegel and thus German Idealism, immaturely shrank from this reality by embracing the fantasy of total reconciliation. Mirtis, kaip egzistencinis niekio patyrimas, buvo laikoma kiekvieno žmogaus realybe sudėtingu amžių sandūros laikotarpiu. Rosenzweig‘ui niekis buvo atspirties taškas, permąstant ir siekiant išsaugoti asmens tapatumą. Asmens tapatumas apsaugo nuo niekio, tačiau jis taip pat yra atviras pokyčiams. Savo ankstyvuosiuose tekstuose Levinas daro panašias prielaidas, laikydamas Buvimą asmens tapatumo pradžia. Levinas plėtojo dialektinę fenomenologiją pradėdamas nuo mirties. Asmens tapatumas traktuojamas (...) kaip hipostazė, tačiau Levino darbe „Totalité et Infini“ įvyksta svarbus lūžis – jame asmens tapatumo šaltiniu laikomas troškimas. Buvimas tampa dėmesio centru kaip antroji elementale pusė, o asmens tapatumas suvokiamas kaip atsiskyrimas. (shrink)

For years business ethics has limited the moral duties of enterprises to negative duties. Over the last decade it has been argued that positive duties also befall commercial agents, at least when confronted with large scale public problems and when governments fail. The argument that enterprises have positive duties is often grounded in the political nature of commercial life. It is argued that agents must sometimes take over governmental responsibilities. The German republican tradition argues along these lines as does Nien-Hé (...) Hsieh. Agents in commercial life are bound by positive duties because at some point they become citizens that must take on the responsibilities of the state. In this paper we leave undisputed the claim that corporations must acknowledge positive duties. However, we demonstrate that the political grounding fails, at least in the sense that this theory insufficiently acknowledges a long standing liberal tradition that vindicates apolitical markets and clear borderlines between politics and economics. We carve out an alternative route to the grounding of one specific positive duty—the duty to further justice. Our argument is based on the moral nature of commercial agents and tries to demonstrate that the duty to further justice ensues from liberalism. Taking a Kantian perspective, it conceptualizes the duty to further justice as a moral duty, orientated toward the political domain. It is grounded in the obligation to attain moral autonomy in the civil condition. (shrink)

En este artículo se discuten algunas de las propuestas planteadas en la discusión moderna y contemporánea sobre los modelos normativos para un nuevo orden internacional. Se plantea si es posible demandar como un asunto de justicia la transformación de las relaciones de poder en el orden económico y político internacional entre las sociedades más ricas y las más pobres. Se exponen y critican cuatro diferentes modelos de orden estatal interno e interestatal. El modelo realista de un Estado absolutista que establece (...) la paz en el interior y en el exterior mediante la disuasión, y que niega que puedan plantearse criterios de justicia para definir las relaciones entre los Estados. En segundo lugar se presenta el modelo del Estado de Derecho de tipo kantiano. Le sigue el Estado social de Rawls con dos modelos diferenciados del contrato para definir las relaciones en el interior y en el exterior; y viene, por último, el proyecto cosmopolita. Por último, se critica el proyecto liberal de justicia porque reduce el problema de la reestructuración del orden internacional a un asunto de justicia distributiva y no cuestiona las estructuras del actual sistema económico global. Recent advances in genomic research have led to the development of new diagnostic tools, including tests which make it possible to predict the future occurrence of monogenetic diseases (e.g. Chorea Huntington) or to determine increased susceptibilities to the future development of more complex diseases (e.g. breast cancer). The use of such tests raises a number of ethical, legal and social issues which are usually discussed in terms of rights. However, in the context of predictive genetic tests a key question arises (...) which lies beyond the concept of rights, namely, What should we want to know about our future? In the following I shall discuss this question against the background of Kant’s Doctrine of Virtue. It will be demonstrated that the system of duties of virtue that Kant elaborates in the second part of his Metaphysics of Morals offers a theoretical framework for addressing the question of a proper scope of future knowledge as provided by genetic tests. This approach can serve as a source of moral guidance complementary to a justice perspective. It does, however, not rest on the – rather problematic – claim to be able to define what the “good life” is. (shrink)

Gender greatly impacts access to opportunities, potential, and success in corporate leadership roles. We begin with a general presentation of why such discussion is necessary for basic considerations of justice and fairness in gender equality and how the issues we raise must impact any ethical perspective on gender in the corporate workplace. We continue with a breakdown of the central categories affecting the success of women in corporate leadership roles. The first of these includes gender-influenced behavioral factors, such as the (...) requirements and expectations of gendered verbal and nonverbal communication styles as well as appearance. We move on to address the impact of family on corporate leadership opportunities and success, discussing the asymmetrical evaluation of an individual’s potential, authority, and competence based on gender stereotypes of familial obligations and expectations. Finally, we address how gender impacts access to networking and sponsorship opportunities and the long-term effects of systematic limitations on women’s inclusion in the upper echelons of corporate leadership. We conclude with a summary of the questions and issues raised by our discussion and direct individuals to consider how different ethical systems and moral requirements might influence their interpretations of gender and leadership in the corporate workplace. On the assumption that theistic religious commitment takes place in the face of evidential ambiguity, the question arises under what conditions it is permissible to make a doxastic venture beyond one’s evidence in favour of a religious proposition. In this paper I explore the implications for orthodox theistic commitment of adopting, in answer to that question, a modest, moral coherentist, fideism. This extended Jamesian fideism crucially requires positive ethical evaluation of both the motivation and content of religious doxastic ventures. I (...) suggest that, even though the existence of horrendous evil does not resolve evidential ambiguity in favour of atheism, there are reasonable value commitments that would preclude those who hold them from satisfying extended Jamesian fideist conditions for committing themselves to classical theism. I then begin a discussion of a possible revisionary theistic alternative (in the Christian tradition) which – one might hope – may meet those conditions. In reconstructing and commenting upon the Kosovo conflict, the cognitive interest of practical philosophy does not evade a political judgment but is primarily led by the interest in answering the question of what normative yardsticks are available (to politicians and to the public) for coping with a situation where the international order of law fails to provide a legal solution to the problem of preserving peace and, at the same time, protecting human rights that are severely violated by a sovereign (...) state. The paper proposes an answer from the point of view of an ethics of history-related responsibility, which takes into account three normative levels based on ethical, legal and political considerations. O artigo trata de dois pontos polêmicos e interconectados na teoria de Kant sobre o direito das gentes: a natureza da personalidade dos Estados e o arranjo soberano da República Mundial. Em relação ao primeiro ponto, procura-se mostrar que as dificuldades dos intérpretes de Kant em determinar o tipo e o fundamento da personalidade dos Estados decorrem de diferenças no modo como Kant implicitamente considera a função da lei moral, o que permite mostrar que os direitos relativos à guerra não (...) são uma espécie de direito natural dos Estados, mas se fundam na dignidade dos indivíduos. A elucidação desse primeiro ponto também contribui para a compreensão, no segundo ponto, dos motivos das dificuldades de Kant em encontrar um arranjo consistente para a soberania dos Estados na constituição de uma República Mundial. Dificuldades essas que fazem com que ele não exponha diretamente as características dessa República Mundial, mas apenas indiretamente por meio de críticas aos modelos do Estado Mundial e da Liga de Estados. Professional work is currently based on explicit knowledge and evidence to a greater degree than in the past. Standardising professional services in this way requires repetitive scenarios and might be seen as a challenge to professional autonomy. In the context of policing, officers perform a range of familiar tasks, but they may also encounter novel challenges at any moment. Moreover, police tasks are not well-defined. Therefore, many missions require police officers to rely on common sense, tacit knowledge or gut feeling. (...) In this article, I argue that a values-based methodology may serve as a tool to help evaluate decisions in unfamiliar situations, to learn from experience, as well as be a quality control for established routines. _Keywords:_ ethics, policing, decision-making, values, experiential learning routines. Bei Berufen, in denen Menschen auf eine gewaltverstrickte Lebenswelt treffen, ihrerseits staatlich legitimiert Gewalt ausüben und selbst von Gewalt betroffen sind, tauchen dabei besondere Widersprüche und Sinnfragen auf. Diese Herausforderungen in den Blick zu nehmen und an der Schnittstelle von Philosophie und praktischer Theologie zu erörtern, so wie es der Münsteraner Theologe Werner Schiewek richtungsweisend vorgezeichnet hat, ist das Ziel (...) des vorliegenden Bandes. ZusammenfassungDie gegenwärtige Debatte um die normativen Grundlagen kritischer Gesellschaftstheorie weist eine große Bandbreite ethischer Positionen auf: vom ethischen Negativismus, der gänzlich auf einen positiven Kritik-Maßstab verzichtet, über Entfremdungs- und Resonanztheorien, die zumindest eine grobe Vorstellung des guten Lebens vermitteln wollen, bis hin zu deontologischen Ansätzen, die Gesellschaftskritik in intelligibler Freiheit begründet sehen. Der folgende Beitrag zeigt, dass diese drei Grundpositionen sich mit Problemen konfrontiert sehen, die der hegelsche Freiheitsbegriff zu lösen vermag.

Practical philosophy in the classical German tradition from Kant to Hegel seems to be moralistic and even ascetic. The core of its moral and legal philosophy is a concept of freedom as independence from any longing for pleasure and happiness. Tracing the development of Hegel’s philosophy of subjective, objective and absolute spirit, however, exhibits a deep systematic connection between the forms of freedom and happiness in all their traditional and modern meanings. Many of them can be compared with modern conceptions, (...) but others have to be saved from oblivion and defended against reductive conceptions of freedom and happiness in modern philosophy. Das vorliegende Buch präsentiert eine phänomenologische Analyse der verschiedenen Formen zwischenmenschlicher Gewalt und ihrer oft unterbelichteten Beziehungen. Auf der Grundlage einer Transformation der Phänomenologie und im Rekurs auf den aktuellen Diskurs der Gewaltforschung entwickelt es einen methodologischen Rahmen für eine nicht-reduktive Analyse von Gewalt, der in angewandten phänomenologischen Fallstudien erprobt wird. -/- Gewalt war bislang vorwiegend in den Human und den Sozialwissenschaften ein zentrales Thema, wurde aber nur allzu selten zum Gegenstand genuin philosophischer Reflexion. Um dieses Desiderat aufzugreifen und die (...) Bedeutung philosophischer Reflexion für den Diskurs über Gewalt zu demonstrieren, entwickelt das vorliegende Buch einen phänomenologischen Ansatz zur Analyse zwischenmenschlicher Gewalt. Seine Intention besteht darin, ein Korrektiv zu den konventionellen, allzu einseitig verfahrenden instrumentalistischen, essentialistischen oder funktionalistischen Erklärungen von Gewalt vorzulegen. -/- Im Anschluss an eine kritische Reflexion auf zentrale Aporien des Gewaltdiskurses, denen es sich zu stellen gilt, integriert der Autor relevante Theoreme klassischer Phänomenologie mit neueren Ansätzen in einen umfassenden Analyserahmen. In drei „Fallstudien“ wird dieser Rahmen in konkreten Phänomenanalysen angewandt und der ihm zugrunde liegende weite Gewaltbegriff auf die Probe gestellt. Das Buch schließt mit einem Entwurf einer „relationalen Phänomenologie“, die es erlaubt, die vielfach unterbelichteten bzw. ausgeblendeten Beziehungen zwischen den verschiedenen Formen von Gewalt ins Auge zu fassen. Brauchen Roboter moralische Kompetenz? Die Antwort lautet ja. Einerseits benötigen Roboter moralische Kompetenz, um unsere Welt aus Regeln, Vorschriften und Werten zu begreifen, andererseits um von ihrem Umfeld akzeptiert zu werden. Wie aber lässt sich moralische Kompetenz in Roboter implementieren? Welche philosophischen Herausforderungen sind zu erwarten? Und wie können wir uns und unsere Kinder auf Roboter vorbereiten, die irgendwann über moralische Kompetenz verfügen werden? Vertrauen ist ein Grundbaustein seelsorglicher Arbeit wie auch einer des interpersonalen und gemeinschaftlichen Zusammenhalts. Während es im seelsorglichen Kontext zumeist theologisch fundiert und religiös rückgebunden ist, bricht im säkularen Zusammenhang an ihm die Frage aller modernen pluralen Gesellschaften nach einer ethischen Verbindlichkeit auf. Wiewohl dem Vertrauen also eine zentrale Rolle zuzukommen scheint, ist es nur vereinzelt in philosophischer Reflexion beachtet. Bei Hannah Arendt findet sich eine dieser raren Stellen, in der ihr gerade der theologisch-religiöse Rahmen Sprungbrett für eine säkulare Überlegung (...) wird, die das Vertrauen als ein interpersonales Phänomen ersten Ranges ausweist. The main point of our study is that the Kantian problem of a suitability between theory and practice, one of the key issues in Kant’s practical thinking in general, was erroneously perceived not only by those who defended it, and conceived of its possibility, but also by those who denied it and defended its impossibility. Our position, conversely, is that Kant, upon approaching a seemingly irresoluble problem, was forced to conceive of a via media, an “intermediate member of connection” between (...) theory and practice; an alternative which, in our view, does not arise out of mere necessity, rather is intimately interconnected from the mid-1770s onwards with the formation of Kant’s fundamental scheme of human knowledges, a scheme which, in its tridimensionality, establishes Pragmatic Anthropology as a third dimension of human knowledge and therefore as the only suitable soil for the dialogue between theory and practice, beyond the mere possibility or impossibility of the problem. This proposition, we hope, will enable us to ascertain what Kant envisages by the “talent of nature”, the special “act of the power of judgment” that is to serve as connecting member between theory and practice; to explain how Anthropology is to be seen as the natural abode for this mediating interplay; and, finally, to better position, as well as delimit, the scope of Kant’s anthropo-cosmological view of Man in the World, which is to be seen precisely between the merely rational of theory and the merely empirical of practice. This paper attempts to clarify the conceptual foundations of sovereignty in Hegel’s Philosophy of Law in order to provide an answer to this question and thus be able to evaluate the scope of contemporary sovereignty and the adequacy of its claims. As will be seen, Hegel constructs his own position in critical dialogue with Hobbes’ and Kant’s approaches, with more or less explicit references. The development of this article is divided into three parts. In the first, the Hegelian conception of (...) sovereignty is presented in the framework of his organicist understanding of the state, taking into account both its internal and external aspects. The second, analyses Hegel’s theoretical foundations of war and his position in international relations. Finally, the scope of sovereignty today is discussed in the light of Hegelian thought. Heidegger already recognized in the 1920s the difficulties facing a phenomenology of religion, but the problems are greatly multiplied once one recognizes that many of the so-called religions were constituted as such only in the late eighteenth and early nineteenth centuries and that the "invention" of these religions was according to an idea of religion shaped by Christianity. By investigating the incompatible attempts of Kant and Hegel to negotiate that idea, I identify the genealogy of the double bind whereby today (...) it appears that one is faced with a choice between two violences: the violence of imposing the word religion on practices that do not readily follow the model of the Christian religion and the violence of refusing the word to non-Christian religions. Die Suche nach einem angemessenen Umgang mit Moral und ihrem rhetorisch-strategischen Einsatz in Diskursen führt unweigerlich zu der Frage, welche Perspektiven verschiedene Wissenschaftsdisziplinen aufmachen, wenn sie sich mit Moral und Moralisierung beschäftigen. Mit der Erörterung verschiedener Disziplinenzugänge ist auch das Spannungsverhältnis zwischen einem deskriptiven Erörterungsansatz und Aspekten der Bewertung inklusive der ihr zugrundeliegenden Werte angesprochen. Die Beiträge des Bandes geben auf diese Fragen keine abschließenden Antworten. Sie beginnen allerdings damit, ein multi- und interdisziplinäres Bild von Moralisierung zu zeichnen, das geschichts- (...) und politikwissenschaftliche, linguistische, philosophische und theologische Sichtweisen einbezieht und miteinander ins Gespräch bringt. Das komplementäre Bild ist einerseits gekennzeichnet durch die kritische Auseinandersetzung mit Moralisierung als einer rhetorischen Strategie, der ein nicht unbeträchtliches diskursprägendes und sogar -schädigendes Potenzial innewohnt. Andererseits sperrt es sich gegen eine grundsätzliche Moralisierungsskepsis und weist stattdessen darauf hin, dass gesellschaftliche Debatten sich notwendigerweise zwischen Moralisierung und Entmoralisierung bewegen. Trust can be understood as a precondition for a well-functioning society or as a way to handle complexities of living in a risk society, but also as a fundamental aspect of human morality. Interactions on the Internet pose some new challenges to issues of trust, especially connected to disembodiedness. Mistrust may be an important obstacle to Internet use, which is problematic as the Internet becomes a significant arena for political, social and commercial activities necessary for full participation in a liberal (...) democracy. The Categorical Imperative lifts up trust as a fundamental component of human ethical virtues – first of all, because deception and coercion, the antitheses of trust, cannot be universalized. Mistrust is, according to Kant, a natural component of human nature, as we are social beings dependent on recognition by others but also prone to deceiving others. Only in true friendships can this tendency be overcome and give room for unconditional trust. Still we can argue that Kant must hold that trustworthy behaviour as well as trust in others is obligatory, as expressions of respect for humanity. The Kantian approach integrates political and ethical aspects of trust, showing that protecting the external activities of citizens is required in order to act morally. This means that security measures, combined with specific regulations are important preconditions for building online trust, providing an environment enabling people to act morally and for trust-based relationships. Our challenge for the twenty-first century consists in showing how to construct a global ethics and in trying to discover a rational foundation for it, which may be used as guidance for action and as a norm for the criticism of specific situations. I argue that four tasks must be accomplished to construct a global ethics: Construct that global governance or that world government that makes cosmopolitan citizenship possible. Foster the joint work of bioethics, economic and business ethics, and development (...) ethics – areas of applied ethics, each one of which on its own has reached the global level. Discover a rational basis for a global ethics, which has a universal normative force, but assumes cultural differences. Develop and promote a dilaogical ethics of cordial reason, which renders one capable of compassion and care. (shrink)

: This essay analyzes the U.S. political situation before the 2003 invasion of Iraq and ties this conflict to the events of 9/11. The guiding thread of the discussion is the definition of “terrorism” that has led to George W. Bush's declared “war on terrorism.” By means of Hegel's dialectic logic, the essay exposes the problem offered by the category of causality involved in the definition of terrorism: Is terrorism the original “cause” of the war declared on it by the (...) United States or is terrorism rather the very “consequence” of that war? (shrink)

The paper begins by discussing the normative principles of the two main theoretical currents in public administration in our days: NewPublicManagement and NeoWeberianism. Both orientations are very influential, not only froma theoretical point of view, but also as blueprints for administrative reforms. The paper focuses on the differences between the two currents regarding normative principles: rational self-interest, in the case of New Public Management, and civic duty or altruism, in the case of NeoWeberianism. The paper discusses such normative principles or (...) normativemotivationswith some references to the history of political thought, particularly to Hegel’s criticism of Kant regarding the concept of the state and its relationships to the market. In a final section, the paper develops some proposals for institutional designs that could promote desinterested (altruistic) motivations among civil servants. The institutional designs materialize thus the idea of a positive ethics for public administration. (shrink)

Este trabajo tiene por objetivo evaluar los distintos argumentos que se han elaborado para explicar el deber de asistencia a los pobres en la filosofía política kantiana. En primer lugar, nos concentraremos en desarrollar, puntualizar y criticar los intentos de justificación de dicho deber a partir de concepciones minimalistas del Estado, consideraciones instrumentales o apelaciones al valor de la dignidad humana. Acto seguido, examinaremos los principales argumentos de corte republicano que se han elaborado a los mismos efectos. Dado que unos (...) y otros se muestran insatisfactorios, intentaremos esbozar la estructura de un argumento más robusto en favor del deber de asistencia a los pobres a partir del concepto de “posesión común originaria del suelo”. El objetivo del presente trabajo es analizar hermenéuticamente el desencuentro que se produce en primer lugar entre Aristóteles y los autores presocráticos a los que él mismo denomina como physiologoi y, en segundo lugar, el desencuentro que se produce entre la Naturphilosophie de Schelling y la Physica aristotélcia. No se tratará en ningún caso de criticar o juzgar dichos desencuentros, antes bien el análisis de los mismos servirá para sugerir que una correcta comprensión del proceso histórico tiene lugar justamente gracias (...) a errores, desencuentros y malentendidos. This paper argues that economic agents, including corporations, have the duty to further justice, not just a duty merely to comply with laws and do their share. The duty to further justice is the requirement to assist in the establishment of just arrangements when they do not exist in society. The paper is grounded in liberal theory and draws heavily on one liberal theorist, Kant. We show that the duty to further justice must be interpreted as a duty of virtue (...) that is owed. This means that the duty is not enforceable but that violating this duty is still wrong and not merely non-virtuous. Our analysis has consequences for the morality of commercial life. It is often suggested that the morality of the market is a special, restricted morality that is leaner than the morality that agents must acknowledge outside the market. If our analysis is correct, the duty to further justice cannot be exempted from market morality, even if it is agreed that this must be leaner than the morality outside commercial life. Our analysis also has direct consequences for John Ruggie’s view on the responsibilities of businesses. Ruggie has never explicitly acknowledged a duty on the part of business enterprises to further justice. If our analysis is correct, his view is contradictory in that it presupposes the normative validity of free market enterprise yet shrinks from taking into account the conditions of its possibility. Las posibilidades de que el proyecto de un “orden cosmopolita” tenga éxito no son menos hoy de lo que eran en 1945 o 1989-90. Esto no significa, sin embargo, que sean más; ahora bien, no deberíamos perder de vista la magnitud de las cosas. El proyecto kantiano saltó a la palestra por primera vez con la Sociedad de Naciones, es decir, más de doscientos años después de que se hubiera planteado; además, la idea de un orden cosmopolita no se plasmaría (...) de forma duradera hasta la creación de las Naciones Unidas. Desde comienzos de los años noventa, la ONU ha ido aumentando su relevancia política y se ha erigido como un elemento muy a tener en cuenta en los conflictos políticos mundiales. Incluso la gran superpotencia se vio obligada a enfrentarse a la organización mundial cuando esta última se negó a dar legitimidad a una intervención unilateral. La ONU sobrevivió al intento posterior de marginarla, y ahora parece estar decidida a llevar a cabo las reformas necesarias y urgentes de sus principales órganos y agencias. (shrink)

Recent philosophy has developed an overblown concept of autonomy. In fact we do not have moral autonomy, and personal autonomy we only have in the sense of being able to decide some things that affect the course of our lives, not in the sense of shaping these lives and being master over them; nor ought we to have autonomy in the latter sense, or come closer to having it. As for our political institutions, they do not presuppose, as prevailing doctrines (...) claim they do, citizens’ autonomy in a more demanding sense. Freedom and democracy as understood for instance in the German constitution only assume subordinates capable of deciding some matters on their own. Current talk of autonomy is just gilding people’s real dependence. (shrink)

Most theories of nationalism presume a causal link between 'culture' and 'identity' in the analysis of nationalism. This article argues for a more contingent linkage while drawing conclusions for the 'globalization of cultures-national identity' nexus in different theoretical domains. It goes on to review core assumptions about transnational identity formation, arguing that a distinctive phenomenon is a tendency to approach identities as strategic resources. This has significant impact on, for example, perceptions of boundaries and images of belonging. Finally, the article (...) addresses central figurations between identity, globalization and European integration, in the context of the European Union viewed as an instrument for proactively handling transnational problems, and it proposes some salient differences between this 'Euronationalism' and nationalism in more traditional formats. Wars and Fatal Illusions of Defeatability as a Threat. Metatheoretical Observations and Desiderata of a Contemporary Philosophy of Martial Violence This essay deals with the question how war threatens us even when peace seems to reign. Refering to Heraklit, Kant, and recent theories of war, the author takes answers to this question into account especially with respect to the problem if it is possible to keep in check illusions which make us believe that one can get rid of enmity by (...) way of 'final solutions'. I argue that although in the Foundations of Natural Right Fichte adopts a theory of cosmopolitan right that is in a number of important respects formally identical to the one developed by Kant, he later came in The Closed Commercial State to reassess his earlier Kantian cosmopolitanism. This work can in fact be seen to identify a problem with Kant's cosmopolitanism, namely, Kant's failure to recognize the possibility of an indirect form of coercion based on unequal relations of economic dependence. (...) I argue that Kant's failure to acknowledge such a possibility stems from his uncritical acceptance of this type of relation. Whereas Fichte's awareness of the possibility of one-sided forms of economic dependence leads him to offer a solution to the problems it raises: the severing of all commercial relations with other states. This solution is itself highly problematic, however, as I indicate with reference to Fichte's remarks on ‘natural frontiers’. (shrink)

Para alcanzar dichos objetivos, en primer lugar identifico los problemas que son dejados abiertos en el derecho cosmopolita en el Fundamento del derecho natural, en particular en virtud del supuesto del egoísmo universal. De este modo, procuro comprender el proyecto de El Estado comercial cerrado como un intento de resolver estos problemas pendientes. Luego apunto a reconstruir los argumentos centrales del último texto, a fin de echar luz sobre su arquitectura, de (...) acuerdo con sus objetivos primordiales. Finalmente, considero el problema de la viabilidad de este proyecto, tomando en cuenta la falta de una educación moral de los ciudadanos en torno de ciertas disposiciones morales y psicológicas, que deberían reducir la codicia por bienes superfluos.
