English title: Kant and the Right to Vote The article is a contribution to the ongoing debate in NFT about the moral responsibility of voters. Kristian Skagen Ekeli has argued that politically ignorant citizens have a duty to abstain from voting. He argues that such a duty fol- lows from Kant’s duty to respect other persons. I analyze Ekeli’s proposed duties by considering how they might fit into Kant’s system of duties. I conclude, contra Ekeli, that the Kantian duty to (...) respect persons does not give rise to a duty for politically ignorant voters to abstain from voting. -/- Denne artikkelen er et bidrag til debatten om velgeres moralske ansvar. Kristian Skagen Ekeli har i to artikler argu- mentert for at uvitende borgere har en plikt til ikke å stemme, noe han begrunner ut fra en kantiansk pliktetikk. Det er imidlertid uklart hvordan en uvitende borgers plikt til å avstå fra å stemme skulle følge av Kants plikt til å respek- tere personer, noe Cornelius og Herman Cappelen kort antyder i sin kommentar til Ekeli. I denne artikkelen foretar jeg en analyse av de pliktene som Ekeli tar til orde for, og undersøker hvordan disse eventuelt kunne passe inn i Kants system av plikttyper. [full article, abstract in English; abstract in Lithuanian] During the last few years, it has become usual to turn to some seventeenth century readings of the traditional idea of an original common possession of the earth for philosophical aid to explain and support the rights of persons in situations of extreme need, including refugees. Hugo Grotius’s conception of this idea is one of the most cited ones. In this paper, I hold that a Grotian reading of the idea of an (...) original common possession of the earth is not a fruitful principle if we want to elaborate a solid defence of the rights of the ones in need. I reconstruct and analyse the role this idea has in Grotius’s theory of private property and present objections to it from a Kantian perspective. (shrink)

El propósito de este artículo es discutir y comparar las concepciones de Rousseau y Kant sobre la paz perpetua. Como escritores de la Ilustración, ambos tuvieron el interés filosófico de establecer los fundamentos para un orden internacional justo que permitiera a las naciones coexistir y desarrollarse pacíficamente. En nuestro análisis nos centramos en las estrategias discursivas que ambos filósofos emplearon a fin de presentar y justificar sus proyectos. Asimismo, realizamos una comparación entre el procedimiento pragmático de Rousseau y la postura (...) moral de Kant. Con ello ponemos de relieve los defectos de la postura de Rousseau y presentamos la postura kantiana como un proyecto robusto que puede presentar una base normativa adecuada de cara al fin de la paz perpetua. This paper argues that Paul Ricoeur’s hermeneutical philosophy attempts to reopen the question of human transcendence in contemporary terms. While his conception of language as self-transcending is deeply Husserlian, Ricoeur also responds to the analytical challenge when he deploys a basic distinction in Fregean logic in order to clarify Heidegger’s phenomenology of world. Ricoeur’s commitment to a transcendental view is evident in his conception of narrative, which enables him to emphasize the role of the performative in literary reading. The meaning (...) of the self in time provides Ricoeur with a discursive basis for distinguishing his own position from that of Kant and other philosophers in the transcendental tradition. (shrink)

The topic of my dissertation is the political and philosophical thought of Lü Zuqian, one of the key players in the history of the "True Way Learning" in Southern Song China and a close associate of Zhu Xi. Focusing on core concepts in Lü’s writings like self-cultivation, imperial sovereignty, law, rites, institutions and reform, this study advances a new interpretation of Lü Zuqian's modes of thinking. The comparison of Lü Zuqian's political ideas to those of contemporaries such as Zhu Xi, (...) Zhang Shi, Lu Jiuyuan, Chen Liang and Ye Shi clarifies the political language and the political engagements of Daoxue thinkers. This case study tries to explain the fundamental nature of political Daoxue discourse between 1160 and 1180 and to shed new light on the interpretation of "Neo-Confucian" thought in general. Abstract Carl Schmitt distinguishes between political theories in terms of whether they rest on the anthropological assumption that man is evil by nature or on the anthropological assumption that man is good by nature, and he claims that liberal political theory is based on the latter assumption. Contrary to this claim, I show how Kant's liberalism is shaped by his theory of the radical evil in human nature, and that his liberalism corresponds to the characterization of liberalism that Schmitt himself (...) offers. My discussion of this issue will be shown to have certain implications with respect to the view that for Kant evil is the product of society. I show that this view is mistaken insofar as it fails to recognize that Kant's political philosophy implies that human beings require the type of society that best suits their radically evil natures, namely, a commercial one in which the ?vices of culture? largely have free play, while the state's role is limited to that of preventing the antagonisms found in society leading to the mutual destruction of its members. Isaiah Berlin viewed value conflict as tragic, as it requires the sacrifice of some values for others. It is a mark of maturity, he thought, to accept this tragic truth. This view raises certain conceptual problems that can be attributed to Berlin’s subtle departures from the German authors (Kant, Schelling, and Hegel) who originated the doctrine of tragic maturity—figures who had, in turn, transformed the earlier idea that enlightenment is a natural and morally neutral process of maturation. Kant moralized the (...) notion of enlightened maturation by portraying it as contingent on our courage to bring it about, such that we are responsible if we remain immature. This theory of maturity rested on the idea, which would have been uncongenial to Berlin, that we are intelligible creatures inhabiting the noumenal realm, duty bound to exercise moral freedom, even though this duty surpasses our ability to carry it out, as we also inhabit the phenomenal realm, where our natural inclinations tend to make us resist laboring to fulfill our duties. However, according to Kant, the metaphysical limitations we face as individuals can be transcended to an extent, allowing us to make moral progress as a species—so long as we do not lazily persist in our immaturity. Schelling built upon Kant’s notion of freedom to bring out the tragic and heroic dimension of individual moral life, where the tragedy is our doomed but noble struggle to exert moral freedom in a world of natural necessity. Hegel turned these metaphysical notions in a more recognizably Berlinian direction by extending Schelling’s account of tragic conflict to conflicts of values. But he identified the ultimate tragic hero as an ethical totality that enacts eternal justice by reconciling such conflicts, while Berlin attempted to repudiate both the notion of a historical totality and the possibility of reconciliation on empirical grounds, even though these are metaphysical claims. Thus, Berlin asserted the absolute, trans-historical necessity of tragic value conflict, while the evidence for this assertion was merely his personal conviction that in his particular time and place, specific values were, as a matter of empirical fact, tragically irreconcilable. In this manner he illicitly portrayed Cold War value pluralists (such as himself) as courageously accepting the tragic inevitability of value conflict, while Marxists, the legatees of Hegel and thus German Idealism, immaturely shrank from this reality by embracing the fantasy of total reconciliation. Mirtis, kaip egzistencinis niekio patyrimas, buvo laikoma kiekvieno žmogaus realybe sudėtingu amžių sandūros laikotarpiu. Rosenzweig‘ui niekis buvo atspirties taškas, permąstant ir siekiant išsaugoti asmens tapatumą. Asmens tapatumas apsaugo nuo niekio, tačiau jis taip pat yra atviras pokyčiams. Savo ankstyvuosiuose tekstuose Levinas daro panašias prielaidas, laikydamas Buvimą asmens tapatumo pradžia. Levinas plėtojo dialektinę fenomenologiją pradėdamas nuo mirties. Asmens tapatumas traktuojamas (...) kaip hipostazė, tačiau Levino darbe „Totalité et Infini“ įvyksta svarbus lūžis – jame asmens tapatumo šaltiniu laikomas troškimas. Buvimas tampa dėmesio centru kaip antroji elementale pusė, o asmens tapatumas suvokiamas kaip atsiskyrimas. (shrink)

For years business ethics has limited the moral duties of enterprises to negative duties. Over the last decade it has been argued that positive duties also befall commercial agents, at least when confronted with large scale public problems and when governments fail. The argument that enterprises have positive duties is often grounded in the political nature of commercial life. It is argued that agents must sometimes take over governmental responsibilities. The German republican tradition argues along these lines as does Nien-Hé (...) Hsieh. Agents in commercial life are bound by positive duties because at some point they become citizens that must take on the responsibilities of the state. In this paper we leave undisputed the claim that corporations must acknowledge positive duties. However, we demonstrate that the political grounding fails, at least in the sense that this theory insufficiently acknowledges a long standing liberal tradition that vindicates apolitical markets and clear borderlines between politics and economics. We carve out an alternative route to the grounding of one specific positive duty—the duty to further justice. Our argument is based on the moral nature of commercial agents and tries to demonstrate that the duty to further justice ensues from liberalism. Taking a Kantian perspective, it conceptualizes the duty to further justice as a moral duty, orientated toward the political domain. It is grounded in the obligation to attain moral autonomy in the civil condition. (shrink)

O presente artigo pretende mostrar uma dupla perspectiva do ensino da filosofia proposto de forma disjuntiva: aprender a filosofar ou aprender a filosofia, representada, respectivamente, por Kant e por Hegel. A análise dessa questão será desenvolvida dentro do contexto da filosofia kantiana, nela destacando três aspectos: a) o ideal de perfectibilidade do gênero humano; b) o preceito da Aufklärung do pensar por si mesmo e o exercício crítico da razão, e c) a necessidade da coação como instrumento para o cumprimento (...) do caráter normativo da conduta humana. Estes aspectos serão, também, abordados na filosofia de Hegel, bem como as suas conseqüências para o ensino da filosofia, e da possibilidade de uma escolha não disjuntiva de uma ou de outra perspectiva. Recent advances in genomic research have led to the development of new diagnostic tools, including tests which make it possible to predict the future occurrence of monogenetic diseases (e.g. Chorea Huntington) or to determine increased susceptibilities to the future development of more complex diseases (e.g. breast cancer). The use of such tests raises a number of ethical, legal and social issues which are usually discussed in terms of rights. However, in the context of predictive genetic tests a key question arises (...) which lies beyond the concept of rights, namely, What should we want to know about our future? In the following I shall discuss this question against the background of Kant’s Doctrine of Virtue. It will be demonstrated that the system of duties of virtue that Kant elaborates in the second part of his Metaphysics of Morals offers a theoretical framework for addressing the question of a proper scope of future knowledge as provided by genetic tests. This approach can serve as a source of moral guidance complementary to a justice perspective. It does, however, not rest on the – rather problematic – claim to be able to define what the “good life” is. (shrink)

Rawls says that public reason is the reason of the citizens of a democratic state and takes the Supreme Court in the USA as the exemplar of public reason. It differs from non public reason, which is used e.g., in universities and academic institutions. Rawls contrasts with Kant, which opposes the public reason of the scholar—or the philosopher—, who speaks before the world, to the private reason of state or church officials. The later, once they accept an authority, cannot think (...) by themselves (selbst denken). A closer examination shows that Rawls is not so far from Kant as it seems, because he takes the constitutional judges not as they are, but as they should be. However Rawls still apparently refuses Kant’s unity of reason. Further investigation of the relations between ethical reason, democratic reason and legal reason is needed. Democratic reason is tantamount both to public reason and to legal reason in a modern constitutional state. It is a requirement of ethics but still not identical with ethical reason, since it is possible to accept democratic reason and to argue against it from an ethical point of view. There is just one good way of reasoning, in spite of the constraints that the sources of law and the rules of procedure impose on legal reasoning, compared with ethics. Such constraints are based on the democratic principle, which is again based on ethical reason, which at last both grounds and limits the constraints that law imposes on reason. (shrink)

Gender greatly impacts access to opportunities, potential, and success in corporate leadership roles. We begin with a general presentation of why such discussion is necessary for basic considerations of justice and fairness in gender equality and how the issues we raise must impact any ethical perspective on gender in the corporate workplace. We continue with a breakdown of the central categories affecting the success of women in corporate leadership roles. The first of these includes gender-influenced behavioral factors, such as the (...) requirements and expectations of gendered verbal and nonverbal communication styles as well as appearance. We move on to address the impact of family on corporate leadership opportunities and success, discussing the asymmetrical evaluation of an individual’s potential, authority, and competence based on gender stereotypes of familial obligations and expectations. Finally, we address how gender impacts access to networking and sponsorship opportunities and the long-term effects of systematic limitations on women’s inclusion in the upper echelons of corporate leadership. We conclude with a summary of the questions and issues raised by our discussion and direct individuals to consider how different ethical systems and moral requirements might influence their interpretations of gender and leadership in the corporate workplace. In reconstructing and commenting upon the Kosovo conflict, the cognitive interest of practical philosophy does not evade a political judgment but is primarily led by the interest in answering the question of what normative yardsticks are available (to politicians and to the public) for coping with a situation where the international order of law fails to provide a legal solution to the problem of preserving peace and, at the same time, protecting human rights that are severely violated by a sovereign (...) state. The paper proposes an answer from the point of view of an ethics of history-related responsibility, which takes into account three normative levels based on ethical, legal and political considerations. O artigo trata de dois pontos polêmicos e interconectados na teoria de Kant sobre o direito das gentes: a natureza da personalidade dos Estados e o arranjo soberano da República Mundial. Em relação ao primeiro ponto, procura-se mostrar que as dificuldades dos intérpretes de Kant em determinar o tipo e o fundamento da personalidade dos Estados decorrem de diferenças no modo como Kant implicitamente considera a função da lei moral, o que permite mostrar que os direitos relativos à guerra não (...) são uma espécie de direito natural dos Estados, mas se fundam na dignidade dos indivíduos. A elucidação desse primeiro ponto também contribui para a compreensão, no segundo ponto, dos motivos das dificuldades de Kant em encontrar um arranjo consistente para a soberania dos Estados na constituição de uma República Mundial. Dificuldades essas que fazem com que ele não exponha diretamente as características dessa República Mundial, mas apenas indiretamente por meio de críticas aos modelos do Estado Mundial e da Liga de Estados. Professional work is currently based on explicit knowledge and evidence to a greater degree than in the past. Standardising professional services in this way requires repetitive scenarios and might be seen as a challenge to professional autonomy. In the context of policing, officers perform a range of familiar tasks, but they may also encounter novel challenges at any moment. Moreover, police tasks are not well-defined. Therefore, many missions require police officers to rely on common sense, tacit knowledge or gut feeling. (...) ZusammenfassungDie gegenwärtige Debatte um die normativen Grundlagen kritischer Gesellschaftstheorie weist eine große Bandbreite ethischer Positionen auf: vom ethischen Negativismus, der gänzlich auf einen positiven Kritik-Maßstab verzichtet, über Entfremdungs- und Resonanztheorien, die zumindest eine grobe Vorstellung des guten Lebens vermitteln wollen, bis hin zu deontologischen Ansätzen, die Gesellschaftskritik in intelligibler Freiheit begründet sehen. Der folgende Beitrag zeigt, dass diese drei Grundpositionen sich mit Problemen konfrontiert sehen, die der hegelsche Freiheitsbegriff zu lösen vermag.

Practical philosophy in the classical German tradition from Kant to Hegel seems to be moralistic and even ascetic. The core of its moral and legal philosophy is a concept of freedom as independence from any longing for pleasure and happiness. Tracing the development of Hegel’s philosophy of subjective, objective and absolute spirit, however, exhibits a deep systematic connection between the forms of freedom and happiness in all their traditional and modern meanings. Many of them can be compared with modern conceptions, (...) but others have to be saved from oblivion and defended against reductive conceptions of freedom and happiness in modern philosophy. Das vorliegende Buch präsentiert eine phänomenologische Analyse der verschiedenen Formen zwischenmenschlicher Gewalt und ihrer oft unterbelichteten Beziehungen. Auf der Grundlage einer Transformation der Phänomenologie und im Rekurs auf den aktuellen Diskurs der Gewaltforschung entwickelt es einen methodologischen Rahmen für eine nicht-reduktive Analyse von Gewalt, der in angewandten phänomenologischen Fallstudien erprobt wird. -/- Gewalt war bislang vorwiegend in den Human und den Sozialwissenschaften ein zentrales Thema, wurde aber nur allzu selten zum Gegenstand genuin philosophischer Reflexion. Um dieses Desiderat aufzugreifen und die (...) Bedeutung philosophischer Reflexion für den Diskurs über Gewalt zu demonstrieren, entwickelt das vorliegende Buch einen phänomenologischen Ansatz zur Analyse zwischenmenschlicher Gewalt. Seine Intention besteht darin, ein Korrektiv zu den konventionellen, allzu einseitig verfahrenden instrumentalistischen, essentialistischen oder funktionalistischen Erklärungen von Gewalt vorzulegen. -/- Im Anschluss an eine kritische Reflexion auf zentrale Aporien des Gewaltdiskurses, denen es sich zu stellen gilt, integriert der Autor relevante Theoreme klassischer Phänomenologie mit neueren Ansätzen in einen umfassenden Analyserahmen. In drei „Fallstudien“ wird dieser Rahmen in konkreten Phänomenanalysen angewandt und der ihm zugrunde liegende weite Gewaltbegriff auf die Probe gestellt. Das Buch schließt mit einem Entwurf einer „relationalen Phänomenologie“, die es erlaubt, die vielfach unterbelichteten bzw. ausgeblendeten Beziehungen zwischen den verschiedenen Formen von Gewalt ins Auge zu fassen. The main point of our study is that the Kantian problem of a suitability between theory and practice, one of the key issues in Kant’s practical thinking in general, was erroneously perceived not only by those who defended it, and conceived of its possibility, but also by those who denied it and defended its impossibility. Our position, conversely, is that Kant, upon approaching a seemingly irresoluble problem, was forced to conceive of a via media, an “intermediate member of connection” between (...) theory and practice; an alternative which, in our view, does not arise out of mere necessity, rather is intimately interconnected from the mid-1770s onwards with the formation of Kant’s fundamental scheme of human knowledges, a scheme which, in its tridimensionality, establishes Pragmatic Anthropology as a third dimension of human knowledge and therefore as the only suitable soil for the dialogue between theory and practice, beyond the mere possibility or impossibility of the problem. This proposition, we hope, will enable us to ascertain what Kant envisages by the “talent of nature”, the special “act of the power of judgment” that is to serve as connecting member between theory and practice; to explain how Anthropology is to be seen as the natural abode for this mediating interplay; and, finally, to better position, as well as delimit, the scope of Kant’s anthropo-cosmological view of Man in the World, which is to be seen precisely between the merely rational of theory and the merely empirical of practice. Heidegger already recognized in the 1920s the difficulties facing a phenomenology of religion, but the problems are greatly multiplied once one recognizes that many of the so-called religions were constituted as such only in the late eighteenth and early nineteenth centuries and that the "invention" of these religions was according to an idea of religion shaped by Christianity. By investigating the incompatible attempts of Kant and Hegel to negotiate that idea, I identify the genealogy of the double bind whereby today (...) it appears that one is faced with a choice between two violences: the violence of imposing the word religion on practices that do not readily follow the model of the Christian religion and the violence of refusing the word to non-Christian religions. Die Suche nach einem angemessenen Umgang mit Moral und ihrem rhetorisch-strategischen Einsatz in Diskursen führt unweigerlich zu der Frage, welche Perspektiven verschiedene Wissenschaftsdisziplinen aufmachen, wenn sie sich mit Moral und Moralisierung beschäftigen. Mit der Erörterung verschiedener Disziplinenzugänge ist auch das Spannungsverhältnis zwischen einem deskriptiven Erörterungsansatz und Aspekten der Bewertung inklusive der ihr zugrundeliegenden Werte angesprochen. Die Beiträge des Bandes geben auf diese Fragen keine abschließenden Antworten. Sie beginnen allerdings damit, ein multi- und interdisziplinäres Bild von Moralisierung zu zeichnen, das geschichts- (...) und politikwissenschaftliche, linguistische, philosophische und theologische Sichtweisen einbezieht und miteinander ins Gespräch bringt. Das komplementäre Bild ist einerseits gekennzeichnet durch die kritische Auseinandersetzung mit Moralisierung als einer rhetorischen Strategie, der ein nicht unbeträchtliches diskursprägendes und sogar -schädigendes Potenzial innewohnt. Andererseits sperrt es sich gegen eine grundsätzliche Moralisierungsskepsis und weist stattdessen darauf hin, dass gesellschaftliche Debatten sich notwendigerweise zwischen Moralisierung und Entmoralisierung bewegen. El ideal cosmopolita desarrollado por Kant en su breve escrito La paz perpetua , publicado en 1795, ha gozado de una inmensa influencia y conserva aún hoy una indiscutible vigencia. En su formulación original el ideal kantiano se encontraba íntimamente ligado a la necesidad de encontrar medios adecuados para superar el estado de guerra en el que la historia humana se ha instalado. Tres son las principales propuestas kantianas al respecto: la formación de gobiernos democráticos, la instauración de una federación (...) de Estados libres y la constitución de un derecho cosmopolita. Estas ideas son examinadas a lo largo del presente artículo a la luz de los problemas de las actuales relaciones internacionales, y con especial referencia a dos recientes textos de Rawls y Habermas. The article is devoted to I. Kant's views on the problem of war and peace and the possibility of achieving "perpetual peace" on the basis of the pamphlet "To Eternal Peace" and some other late works of the thinker. In particular, attention is paid to the historical background of the appearance of the work as a certain completion of moral philosophy and philosophy of law in the context of developing one's own project of "eternal peace" taking into account the solution (...) of specific problems of foreign policy at the end of the 18th century. The article examines a kind of Kantian "formula of peace", which claims universal significance. It is laid out in the preliminary and especially in the definitive articles of the imaginary contract. It is argued that it is based on three main principles: republicanism, federalism and the presence of a cosmopolitan citizenship limited to hospitality. These principles are complemented by the so-called "guarantees" of "perpetual peace": the progress of law and the spirit of international trade. The article analyzes apologetic and critical responses to Kant's work and its subsequent interpretations in European philosophy and political thought. In particular, special attention is paid to the interpretation of his work as a "pacifist manifesto". Based on this, it was argued that Kant was one of the founders of secular pacifism. The article reasonably refutes such a position on the basis of its anachronism and inconsistency with the views of Kant himself, who considered "eternal peace" only as a higher normative ideal of foreign policy. The influence of Kantian ideas on the formation of modern philosophy of international relations, in particular the theory of democratic peace (DPT), is indicated. It is indicated that the three main principles of Kant's formula of "eternal peace" found their embodiment in the postulates of this theory. At the same time, it is noted that the practice of implementing DPT in US foreign policy has not always had positive consequences. In this regard, the problem of its application to the analysis of the causes and course of the Russian-Ukrainian war is analyzed. There are different positions on this matter, but based on the latest publications and the real course of events. It is concluded that the "militant" version of DPT can be useful for achieving our victory and a just, fair and worthy peace. (shrink)

Our challenge for the twenty-first century consists in showing how to construct a global ethics and in trying to discover a rational foundation for it, which may be used as guidance for action and as a norm for the criticism of specific situations. I argue that four tasks must be accomplished to construct a global ethics: Construct that global governance or that world government that makes cosmopolitan citizenship possible. Foster the joint work of bioethics, economic and business ethics, and development (...) ethics – areas of applied ethics, each one of which on its own has reached the global level. Discover a rational basis for a global ethics, which has a universal normative force, but assumes cultural differences. Develop and promote a dilaogical ethics of cordial reason, which renders one capable of compassion and care. (shrink)

: This essay analyzes the U.S. political situation before the 2003 invasion of Iraq and ties this conflict to the events of 9/11. The guiding thread of the discussion is the definition of “terrorism” that has led to George W. Bush's declared “war on terrorism.” By means of Hegel's dialectic logic, the essay exposes the problem offered by the category of causality involved in the definition of terrorism: Is terrorism the original “cause” of the war declared on it by the (...) United States or is terrorism rather the very “consequence” of that war? (shrink)

Although Kant disapproved of war, he asserted it was sublime. His views of war are disconnected and in places surprisingly positive, but he avoids grappling with their implications. This article analyses these heterogeneous discussions through Kant’s notion of the sublime to argue that some of his statements imply war’s sublimity can provoke an educated public into forming an international federation: the power to keep all in awe in Kant’s interpretation of international foundation is not the Hobbesean sovereign or a coercive (...) international government, but reflection on war itself. Kant’s ideas about sublime warfare are internally contradictory. Although they are valuable as an encouragement to work toward peace, working toward peace in actual fact may have unintended results. The paper begins by discussing the normative principles of the two main theoretical currents in public administration in our days: NewPublicManagement and NeoWeberianism. Both orientations are very influential, not only froma theoretical point of view, but also as blueprints for administrative reforms. The paper focuses on the differences between the two currents regarding normative principles: rational self-interest, in the case of New Public Management, and civic duty or altruism, in the case of NeoWeberianism. The paper discusses such normative principles or (...) normativemotivationswith some references to the history of political thought, particularly to Hegel’s criticism of Kant regarding the concept of the state and its relationships to the market. In a final section, the paper develops some proposals for institutional designs that could promote desinterested (altruistic) motivations among civil servants. The institutional designs materialize thus the idea of a positive ethics for public administration. (shrink)

The chances of the project of a “cosmopolitan order” being successful are not worse now than they were in 1945 or in 1989–1990. This does not mean that the chances are good, but we should not lose sight of the scale of things. The Kantian project first became part of the political agenda with the League of Nations, in other words after more than 200 years; and the idea of a cosmopolitan order first received a lasting embodiment with the foundation (...) of the United Nations (UN). This process points toward a continuation of the Kantian project. We can still take our cue from Kant's idea of a cosmopolitan condition if we simply construe it in sufficiently abstract terms. I wish to show first of all why I consider the Kantian alternative between a world of republic and a league of nations to be incomplete (section I) and will then go on to outline how we can reconceptualize the Kantian project under contemporary conditions (section II). And I shall close by addressing an actual challenge to which that project might well offer the most promising response (section III). (shrink)

The article is devoted to the problem of the relationship between normative reason and anthropology in Kant's critical philosophy. This problem is considered in close connection with the concept of the transcendental subject, the basic concept of Kantian philosophy, as this concept applies to both theoretical and practical philosophy; this subject is also manifested in the aesthetic power of judgements and judgements of expediency. Attention is drawn to several levels of Kant's transcendental subject, where the transcendental unity of apperception, Self, (...) is of primary importance. It is this level that Kant considered as the highest point of synthesis - both inner experience (mental) and outer experience (empirical experience) since the transcendental Self accompanies all acts of consciousness, will and power of judgement, both aesthetic and expediency judgement. In addition, other levels of transcendental subjectivity are considered, which relate to the activity of reason, especially practical reason, which is associated with the normative activity of the subject. In this context, the interaction of Kant's anthropology and its various models, with what the German philosopher defined as anthroponomy is analysed. Various aspects of this concept, its importance for the understanding of Kant's doctrine of the normative activity of reason, its ability to produce normative and legal norms of human common life, and the relationship between transcendental and anthropological aspects in this constitution are considered. Thus, Kant's discovery of anthroponomy as one of the basic dimensions of the transcendental subject, its intersection with the anthropological characteristics of man, is a significant achievement of critical philosophy. We are only on the verge of clarifying the semantic possibilities of this extremely productive conceptual construction of the eminent German philosopher. (shrink)

Este trabajo tiene por objetivo evaluar los distintos argumentos que se han elaborado para explicar el deber de asistencia a los pobres en la filosofía política kantiana. En primer lugar, nos concentraremos en desarrollar, puntualizar y criticar los intentos de justificación de dicho deber a partir de concepciones minimalistas del Estado, consideraciones instrumentales o apelaciones al valor de la dignidad humana. Acto seguido, examinaremos los principales argumentos de corte republicano que se han elaborado a los mismos efectos. Dado que unos (...) y otros se muestran insatisfactorios, intentaremos esbozar la estructura de un argumento más robusto en favor del deber de asistencia a los pobres a partir del concepto de “posesión común originaria del suelo”. El objetivo del presente trabajo es analizar hermenéuticamente el desencuentro que se produce en primer lugar entre Aristóteles y los autores presocráticos a los que él mismo denomina como physiologoi y, en segundo lugar, el desencuentro que se produce entre la Naturphilosophie de Schelling y la Physica aristotélcia. No se tratará en ningún caso de criticar o juzgar dichos desencuentros, antes bien el análisis de los mismos servirá para sugerir que una correcta comprensión del proceso histórico tiene lugar justamente gracias (...) a errores, desencuentros y malentendidos. In the fifth and sixth letter of Friedrich Schiller's On the Aesthetic Education of Man [Über die ästhetische Erziehung des Menschen], which is based on letters written from 1793 to 1795 to his patron, the Duke of Augustenburg, Schiller critiques his contemporary society and culture. He describes how the organization of a state based on rationality alone does not develop but rather alienates man in a society in which "the dead letter succeeds the living intellect and a trained memory leads (...) more securely than genius and sensibility."1 In other words, he describes a society based on scientific knowledge, habit, and rote learning that doesn't leave room for judgment, imagination, and sensibility—and thereby neither... This paper argues that economic agents, including corporations, have the duty to further justice, not just a duty merely to comply with laws and do their share. The duty to further justice is the requirement to assist in the establishment of just arrangements when they do not exist in society. The paper is grounded in liberal theory and draws heavily on one liberal theorist, Kant. We show that the duty to further justice must be interpreted as a duty of virtue (...) that is owed. This means that the duty is not enforceable but that violating this duty is still wrong and not merely non-virtuous. Our analysis has consequences for the morality of commercial life. It is often suggested that the morality of the market is a special, restricted morality that is leaner than the morality that agents must acknowledge outside the market. If our analysis is correct, the duty to further justice cannot be exempted from market morality, even if it is agreed that this must be leaner than the morality outside commercial life. Our analysis also has direct consequences for John Ruggie’s view on the responsibilities of businesses. Ruggie has never explicitly acknowledged a duty on the part of business enterprises to further justice. If our analysis is correct, his view is contradictory in that it presupposes the normative validity of free market enterprise yet shrinks from taking into account the conditions of its possibility.
