Die Märkte für außerbörslich (OTC) gehandelte Finanzderivate haben durch die Steigerung von Nahrungsmittelpreisen, die Beeinflussung der fiskalischen Situation von Staaten und den Aufbau systemischer Risiken erhebliche negative Auswirkungen. Die Demokratisierung dieser Märkte ist deshalb eine der wichtigsten Aufgaben des globalen Rechts. Die International Swaps and Derivatives Association (ISDA) prägt als private Institution die rechtliche Infrastruktur dieser Märkte. Johan Horst untersucht die Rechtspraxis der ISDA und zeigt auf, dass das ISDA-Regime eigene Formen legislativer Tätigkeit, der Rechtsdurchsetzung und der Adjudikation ausgebildet hat. (...) What is law? The usual answer is that the law is a system of norms. But this answer gives us at best half of the story. The law is a way of relating to one another. We do not do this as lovers or friends and not as people who are interested in obtaining guidance from moral insight. In a legal context, we are cast as 'character masks', for example, as 'buyer' and 'seller' or 'landlord' and 'tenant'. We expect to (...) have our claims respected simply because the law has given us rights. We do not want to give any other reason for our behavior than the fact that we have a legal right. Backing rights up with coercive threats indicates that we are willing to accept legal obligations unwillingly. I argue that believing at will – i.e. believing for practical reasons – is in some sense possible and in some sense impossible. It is impossible insofar as we think of belief formation as a re-sult of our exercise of certain capacities (perception, memory, agency). But insofar as we think of belief formation as an action that might lead to such a result (i.e. a deliberation or an in-quiry), believing at will is possible. First I present and clarify the problem (...) and its philosophical relevance (section 1). I then argue that a belief formation as an immediate reaction to practical reasons is not necessarily equivalent to believing at will because the causal mechanism that leads to the formation might be deviant (section 2). Finally, I explain the difference between the two above mentioned meanings of “belief formation” in order to clarify the possibility and impossibility of believing at will (section 3). (shrink)

In this paper I examine Hegel's notion of 'idea'. I provide first of all some general clarifications on this notion, and then I analyze the meaning of the logical Doctrine of the idea in relation to the internal organization of the system. My aim is to interpret this section of the Science of Logic as a Grammar of Hegel's Realphilosophie.

ABSTRACT:This essay offers an interpretation of Hegel's theory of normativity according to which normative evaluation is primarily a matter of a thing's answerability to its own constitutive norms. I show that natural and spiritual norms correspond to two different species of normative evaluation for Hegel, two categorically distinct ways something can violate its own constitutive norms. I conclude with some general reflections on the relationship between normativity and ontology in Hegel's system.
