This article addresses the question of the coherence of enactivism as a research perspective by making a case study of enactivism in mathematics education research. Main theoretical directions in mathematics education are reviewed and the history of adoption of concepts from enactivism is described. It is concluded that enactivism offers a ‘grand theory’ that can be brought to bear on most of the phenomena of interest in mathematics education research, and so it provides a sufficient theoretical framework. It has particular (...) strength in describing interactions between cognitive systems, including human beings, human conversations and larger human social systems. Some apparent incoherencies of enactivism in mathematics education and in other fields come from the adoption of parts of enactivism that are then grafted onto incompatible theories. However, another significant source of incoherence is the inadequacy of Maturana’s definition of a social system and the lack of a generally agreed upon alternative. (shrink)

Sociological, economic and evolutionary paradigms of human agency have often seen social agents either as the rational controllers of their fate or as marionettes on the strings of historical, functional or adaptive necessity. They found it therefore difficult to account for the variability, intentionality and creativity of human behaviour and for its frequently redundant or harmful results. This paper argues that human agency is a product of evolution, but that genetic variation and inheritance can only provide a limited explanation of (...) its complex nature. The primary evolutionary problem which human agents face while they are alive is not to adapt to stable environments, but to respond flexibly and creatively to a contingent, uncertain world. Variation and selection therefore take two connected but distinct forms, one external, genetic, and inherited across generations, the other internal and cognitive, and operating during the lifetime of individuals. An examination of this lived part of evolution provides a better understanding of key properties of agency. (shrink)

Based on an empirical study of the British think tank Demos, the article deliberates on the nature of current political ideas. The key argument is that such a deliberation must take into account not only ideas of production but also ideas of mediation. The article argues that the ability to disseminate, brand, and market political ideas in the public sphere through the mass media is a crucial part of the activities of modern idea producers such as think tanks. Ideas are (...) normally conceptualized as statements. As an analytical tool, the article makes a distinction between the two components of a statement. The two components are utterance (or impartation) and proposition (or semantic unit more generally). By so doing, it is possible to focus on (1) the necessity for think tanks to be an `impartational node' in communicative networks and (2) the importance of attributing certain meanings and values to the political ideas (to brand ideas). From this theoretical outset, the article then describes the logic or nature of the mediation, marketing and branding of political ideas. (shrink)

It is commonplace that economic globalization poses new challenges to legal theory. But instead of responding to these challenges, legal scholars often get caught up in heated yet purely abstract discussions of positivist and legal pluralist conceptions of the law. Meanwhile, economics-based theories such as “Law and Social Norms” have much less difficulty in analysing the newly arising forms of private and hybrid “governance without government” from a functional perspective. While legal theory has much to learn from these approaches, we (...) argue that they fail in one crucial point: They cannot uphold the analytical distinction between law and non-law. The reasons for this shortcoming are theory-immanent in that the economic theories' focus on efficiency and their actor-based perspective are necessarily blind to “law's own rationality.” We therefore propose to further develop those functional approaches to the study of global governance by complementing them with elements from Niklas Luhmann's systems theory of law. This will provide us with a conceptual framework for analyzing the workings of global governance regimes without ignoring their potential for “legalisation” and “constitutionalisation.” As we will show in three concrete examples (Corporate Social Responsibility, lex mercatoria, and internet regulation) we can thus describe the evolution of new forms of legal regulation beyond the nation-state. This will also allow us to draw some preliminary conclusions on the role of law in the context of globalization and, at the same time, show the direction for further empirical research. (shrink)

This article examines the financial technology of derivatives. Derivatives are financial products whose values are based on possible fluctuations in the values of underlying assets. Hence derivatives markets are markets that trade in the risks of other markets. In order for derivatives markets to function, forms of prognostication that can assess the possible future fluctuations of the underlying markets are necessary. What such prognostications do, the article argues, is to create information out of future possibilities. Building upon a notion of (...) virtuality derived from Gilles Deleuze, Ulrich Beck and Niklas Luhmann, the article shows how market risks and uncertainties, by means of prognostications, cease to be mere possibilities and instead come to have virtual existence. Through the technology of derivatives, uncertainty and risk can be rendered virtual and be traded. The article suggests that this technology is an example of a new way in which capitalism is now expanding self-referentially as it creates markets out of markets; and of how it is colonizing the future by developing new technologies for ‘hyper-speculation’, that is, speculation not in the possible developments of a given asset but simply in the risk of such speculation. This paper explores the political import of Husserl’s critical discussion of the epistemic effects of the formalization of rational thinking. More specifically, it argues that this discussion is of direct relevance to make sense of the pervasive processes of ‘technization’, that is, of a mechanistic and superficial generation and use of knowledge, to be observed in current contexts of governance. Building upon Husserl’s understanding of formalization as a symbolic technique for abstraction in the thinking with and about numbers, I argue (...) that processes of technization, while being necessary and legitimate procedures for the reduction of complexities, also may give rise to politically unresponsive and ultimately dysfunctional ‘economies of thinking.’ This paper is structured in three parts. In the first part I outline Husserl’s account of the formalization and technization of thought and knowledge. In the second part I make my case for the political import of this account, departing in this context from positions that (a) regard Husserl’s discussions of formalization and its effects as merely epistemological, or that (b) try to mobilize Husserl for a one-sided critique of instrumental reason. In the final part I address a major shortcoming of Husserl’s account, namely its neglect of the concrete and historically evolving technological infrastructures of processes of formalization/technization. Abstract This essay explores what it means to be human in an age of infomedia. Appropriating Niklas Luhmann's systems theory/media theory in dialogue with other resources, I propose a post-Luhmannian paradigm of (1) extended media/meaning that conceives the world as world multimedia systems processing variegated meanings, and (2) an embodied, contextualized soft posthumanist anthropology that conceives the human as emergent collective phenomena of distinct meaning making by body-mind-society-technology media couplings. I argue: (1) Homo sapiens is Homo medialis distinct with mediatic (...) communication that emerged to cope with contingencies. (2) Evolution is the mediatization/codification of the world that culminated with the outcome of Homo medialis uniquely equipped to process transcendent meanings and to mediatize the world via diverse media—Mediatized Co-Mediatizer or Codified Co-Codifier. (3) This anthropic universe is possibly the most “meaningful” (full of meaning possibilities) of all possible worlds. (4) Social fragmentation could be an optimization; science-and-religion is an infomedium optimizing religion's manifest and science’ latent observation of divine manifestations. (shrink)

The public debate on climate change is filled with moral claims. However, scientific knowledge about the role that morality, ethics, and values play in this issue is still scarce. Starting from this research gap, we focus on corporations as central decision makers in modern society and analyze how they respond to societal demands to take responsibility for climate change. While relevant literature on business ethics and climate change either places a high premium on morality or presents a strong skeptical bias, (...) our sociological model depicts morality as an indeterminate force: it can lead to both workable solutions or merely reinforce the status quo, depending on what different corporations make of it. We describe, on the one side, the diffusion of moral values in the media discourse on climate change and, on the other side, the specific responses of corporations. While the media discourse generates a pressure on corporations to act responsibly, their moral claims do not provide clear advice for action. As a result, morality becomes available to organizations as a medium that can be re-specified according to their internal dynamics. Corporations transform moral values into something compatible with their own structures through a variety of different responses: introducing formal ethical structures (e.g., codes of conduct), initiating value-oriented projects, or developing informal moral norms, and so on. In some occurrences, morality becomes a mere façade, while in others it serves as a decision-making criterion and deeply influences core activities in firms. (shrink)

In normative ethics there has been a long-standing debate between consequentialists and deontologists. To settle this dispute moral theorists have often used a selective approach. They have focused on particular aspects of our moral practice and have teased out what consequentialists and deontologists have to say about it. One of the focal points of this debate has been the morality of promising. In this paper I review arguments on both sides and examine whether consequentialists or deontologists offer us a more (...) plausible account of promissory obligation. My conclusion is negative. Given the arguments on the table, I argue, we should conclude that the debate is in a stalemate. It is, therefore, hard to see how the issue of promissory obligation could help us choose between consequentialism and deontology. (shrink)

This article inquires whether and to which degree some fundamental traits of the World Wide Web may encourage us to revise traditional conceptions of what constitutes scientific information and knowledge. Turning to arguments for `open access' in scientific publishing and its derivatives (open content, open archives, etc.), contemporary tendencies in `social software' and knowledge sharing, the authors project a new look on knowledge, dissociated with linear notions of cumulation, progression, and hierarchy (e.g. of scientific argument), but related to circularity, heterarchy, (...) and evolution. Arguing from a medium theoretical perspective, they illustrate their ideas with developments in library science, current debates in epistemology and theories about information architecture, with a particular focus on `unsystematic' folksonomies. It is well known that Niklas Luhmann’s theory of social systems is grounded in Spencer-Brown’s seminal Laws of Form (LoF) or ‘calculus of indications’. It is also known that the reception of the latter has been rather problematic. This article attempts to describe the construction of LoF, and confront it with Niklas Luhmann’s ontological and epistemological premises. I show how LoF must be considered a protologic, or research into the fundamentals of logical systems. The clue to its understanding is to (...) be found in its profoundly topological conception of common mathematics and (Boolean) algebra. Both are explained as direct offspring of their planar orientation. Self-reference is a justified instance of an extended, more intricate topological arrangement. Its consequences for ontology (non-identity) and epistemology (autology), I argue, have been adopted correctly by Niklas Luhmann. Separate sections are devoted to how Spencer-Brown’s notion of re-entry relates to Luhmann’s definition of system/environment, and to a comparison between Luhmann’s and Parsons’ functionalism. This paper offers a panoramic assessment of the significant changes experienced by psychiatric care in Western Europe and North America in the course of the last decades of deinstitutionalization and reform. Drawing on different comparative studies and an own review of relevant data and reports, the main transformations in the mental health field are analyzed around seven major topics: the expanding scope of psychiatry; the decline and metamorphosis of the asylum; the introduction of alternative and diversified forms of care; the (...) new challenges posed by chronic mental illness; the emergence of modern psychopharmacology; the deployment of subspecialization; and the new forms of coercion implemented with community mental health practices. Following a renewed diagnosis on the essential features of the reformed mental health systems based on the pattern of social inclusion inherent to the new devices and philosophies of care, some major challenges for the future such as the overburdening of services or the overt exclusion of a significant part of potential users are also identified and briefly discussed. Why is it so plausible that business organisations in contemporary society use values in their communication? In order to answer this question, a sociological, system theoretical approach is applied which approaches values not pre-empirically as invisible drivers for action but as observable semantics that form organisational behaviour. In terms of empirical material, it will be shown that business organisations resort to a communication of values whenever uncertainty or complexity is very high. Inevitably, value semantics are applied in organisations first when (...) the speakers are uncertain about which stakeholders to whom they have to address (uncertainty) or when different stakeholder groups have to be addressed simultaneously (complexity); second, when the identity of the organisation has to be described; and third, when future strategic options that cannot be expressed by quantitative terms have to be communicated. Values accordingly play a role in organisational practice when certain aspects are indeterminate. Therefore, they are a means for organisations to communicate under fuzzy circumstances. On the basis of these findings, new approaches to value management can now be formulated. (shrink)

In C. S. Peirce, as well as in the work of many biosemioticians, the semiotic object is sometimes described as a physical “object” with material properties and sometimes described as an “ideal object” or mental representation. I argue that to the extent that we can avoid these types of characterizations we will have a more scientific definition of sign use and will be able to better integrate the various fields that interact with biosemiotics. In an effort to end Cartesian dualism (...) in semiotics, which has been the main obstacle to a scientific biosemiotics, I present an argument that the “semiotic object” is always ultimately the objective of self-affirmation (of habits, physical or mental) and/or self-preservation. Therefore, I propose a new model for the sign triad: response-sign-objective. With this new model it is clear, as I will show, that self-mistaking (not self-negation as others have proposed) makes learning, creativity and purposeful action possible via signs. I define an “interpretation” as a response to something as if it were a sign, but whose semiotic objective does not, in fact, exist. If the response-as-interpretation turns out to be beneficial for the system after all, there is biopoiesis. When the response is not “interpretive,” but self-confirming in the usual way, there is biosemiosis. While the conditions conducive to fruitful misinterpretation (e.g., accidental similarity of non-signs to signs and/or contiguity of non-signs to self-sustaining processes) might be artificially enhanced, according to this theory, the outcomes would be, by nature, more or less uncontrollable and unpredictable. Nevertheless, biosemiotics could be instrumental in the manipulation and/or artificial creation of purposeful systems insofar as it can describe a formula for the conditions under which new objectives and novel purposeful behavior may emerge, however unpredictably. This article addresses the relationship between the structuralism, especially the anthropological version of the latter in Levi-Strauss and Luhmann’s theory of social systems. The analysis is done through two guiding hypotheses. It reviews the historical background relating structuralism with systems theory and discusses the fundamental concepts that appear in this relationship. Luhmann's systems thinking are contrasted in some of its central concepts with Lévi-Strauss’s structuralist perspective. The paper concludes with a review of the hypotheses presented and some proposals about the (...) perspective of the social systems. Se revisan los antecedentes históricos que relacionan al estructuralismo con la teoría de sistemas y se analizan los conceptos fundamentales que aparecen en esta relación. The aim of this article is to explore how a self-referential social system, although it is not a human being, can be said to “observe.” For this purpose, the article reformulates Niklas Luhmann’s theory of social systems as sociological phenomenology, or the de-consciousness philosophized phenomenology, because a social system has the same structure of intentionality as consciousness: Just as consciousness is always consciousness of something, communication is always communication of something. In correlation to this communicative intentionality, communicated environments come and (...) go as social phenomena. A social system is not a thing, but an autonomously observing subject. Hence, this systems theory takes on the role of a second-order observer: It observes how social systems as first-order observers observe self-referentially because phenomena given to the natural attitude of the first-order observer constitute multiple social realities in daily life. Therefore, the theory of self-referential social systems is not objectivism, but a variation of mundane subjectivist phenomenology. (shrink)

Besides their skepticism about universal reason and universal morality, the Frankfurt Schools of Critical Systems Theory and Critical Theory share basic assumptions: (1) the thinking in societal-systemic, institutional concepts, which transcend simple reciprocal relations by dint of their complexity; (2) the assumption that society is based on fundamental paradoxes, antagonisms, antinomies; (3) the strategy to conceptualize justice as a contingent and transcendental formula; (4) the form of immanent (and not morality-based, external) critique as an attitude of transcendence; (5) the aim (...) of societal (and not only political) emancipation in an ‘association of free individuals’ (Marx). This article introduces an “ordonomic” approach to corporate citizenship. We believe that ordonomics offers a conceptual framework for analyzing both the social structure and the semantics of moral commitments. We claim that such an analysis can provide theoretical guidance for the changing role of business in society, especially in regard to the expectation and trend that businesses take a political role and act as corporate citizens. The systematicraison d'êtreof corporate citizenship is that business firms can and—judged by the criterion of (...) prudent self-interest—“should” take on an active role in rule-finding discourses and rule-setting processes with the intent of realizing a win-win outcome of the economic game. Twenty years ago, the biopsychosocial model was proposed by George Engel to be the new paradigm for medicine and psychiatry. The model assumed a hierarchical structure of the biological, psychological and social system and simple interactions between the participating systems. This article holds the thesis that the original biopsychosocial model cannot depict psychiatry's reality and problems. The clinical validity of the biopsychosocial model has to be questioned. It is argued that psychiatric interventions can only stimulate but not determine their target (...) systems, because intervention and outcome are only loosely coupled. Thus, psychiatric interventions have in principle limited ranges which differ according to the type of intervention and according to the system to be stimulated. Psychosocial interventions face far more obstacles to be overcome than psychopharmacogical therapy. (shrink)

The paper introduces the concept, of self-organisation as a concept which explains in a general way the emergence of order. It shows how this concept can be used to describe social dynamics, i.e. the mutual construction of social institutions and the social processes which are regulated by these institutions. The driving force of this mutual construction is called ‘coping with uncertainty’. This concept is shown to be fruitful in the discussion of innovation networks, a new form of knowledge production.

This article focuses on theoretical reflections on sovereignty and constitutionalism in the context of the globalization and Europeanisation of the nation states, their politics, and legal systems. Starting from a critical assessment of the Kelsen-Schmitt polemic, the author claims that sovereignty needs to be analysed by the sociological method in order to disclose its current structural differentiation. The constitution of society may be imagined as the multitude of self-constituted and functionally differentiated social subsystems. The constitutional pluralism argument subsequently reconceptualizes sovereignty (...) as socially differentiated and divided between specific subsystems. The EU's differentiated constitutional domain and the paradox of divided sovereignty are used as examples of profound structural and semantic changes in contemporary national and transnational societies. While the sovereign nation-state institutions have become marginalized in political structures of European societies, the self-constitutionalization of the functionally differentiated EU legal system proceeds by internalizing the concept of divided sovereignty and using it semantically as its mode of self-reference. Niklas Luhmann verwendet in seiner soziologischen Systemtheorie offenbar etwas, das er den Büchern des englischen Mathematikers George Spencer Brown entnimmt. Dessen Formenkalkül ist für Luhmann, wie Günther Schulte treffend bemerkt, “Mädchen für alles, mit dem er nicht nur in der Lage ist Teezukochen, sondern auch Auto oder Straßenbahn zu fahren”. Der erste Blick in Spencer Browns Laws of Form vermittelt einen anderen Eindruck: nichts scheinen sie mit soziologischer Systemtheorie zu tun zu haben. Der vorliegende Text bearbeitet hieran anknüpfend eine recht (...) bescheidene Frage, die sich gleichwohl jedem Luhmann-Leser schon einmal gestellt haben dürfte: Was wollen die Laws of Form und was will Luhmann mit ihnen? Als Antwort ergibt sich, nach Zurückverfolgung der relevanten Fußnoten, eine gute und eine schlechte Nachricht. Die schlechte Nachricht ist, daß die Lektüre der Laws of Form offenbar niemandem wirklich weiterhelfen kann, auch Luhmann selbst nicht. Die gute ist folglich, daß dem Luhmann-Leser die Notwendigkeit erspart bleibt, einen so dunklen, weil sparsamen Kalkül zu verstehen. Of all contemporary social theorists, Luhmann has best understood the centrality of the concept of meaning to social theory and has most extensively worked out the notion's implications. However, despite the power of his theory, the theory suffers from difficulties impeding its reception. This article attempts to remedy this situation with some critical arguments and proposals for revision. First, the theory Luhmann adopted from biology as the basis of his own theory was a poor choice since that theory has no (...) explanatory power, being purely descriptive; furthermore, that theory is fundamentally flawed since it implies that viruses are impossible. Second, Luhmann's theory of meaning cannot coherently make the social domain autonomous as he desires since Luhmann does not take into account the distinction between syntax and semantics. By introducing this distinction, making clear that social systems consist of rules, not just communications, and raising the rule concept to the same prominence in social theory as those of actor and system, autonomy can be maintained while avoiding the counterintuitive aspects of Luhmann's theory. Relying on Niklas Luhmann's systems theoretical redescription of modern society, this article aims at questioning the basic theoretical notions of the ongoing inclusion/exclusion debate. The most remarkable aspect of Luhmann's reassessment of the inclusion/exclusion relationship within functionally differentiated societies is that individuals are basically situated within the exclusion domain of society, and thus cannot but partially be included within society's function systems and organizations. This reassessment not only allows Luhmann to raise fundamental questions with respect to the implicit norm of (...) full inclusion which still dominates the debate on inclusion and exclusion, but it also directs his attention to the different inclusion/exclusion conditions within function systems, organizations and interaction systems. Eventually Luhmann's position comes down to the idea that exclusion rather than inclusion is the rule, and, moreover, that inclusions differ from one another. The article closes off with a critical evaluation of Luhmann's redescription of the inclusion/exclusion debate. It is argued that systems theory might suffer from empirical deficiency, as it seems to have difficulties to detect and to depict the actual mechanisms of social exclusion without resorting to theories that are more geared to empirical reality and that are of help in observing it. The role of normative reflection and the possibilities of ethical inquiry in technology assessment have been under discussion in the TA community for several years. As an outcome of this discussion the necessity of explicitly dealing with normativity in TA has widely been acknowledged. However, it is still quite unclear in which way this should be done. This paper is dedicated to the role (and limitations) of ethical expertise in this field, especially in HTA. By methodological analysis an approach is (...) developed to show how entry points for ethical expertise could be identified. The result is that ethical expertise can inform moral debates by uncovering underlying assumptions, by making the normative structure of argumentation transparent, and by weighing the strength of the arguments. In this way moral debates in HTA can become more transparent and opened to argumentative reasoning instead of consisting of bargaining processes determined by power distributions. Ethical reflection, however, does not replace decision-making. (shrink)

This article outlines a new approach to the law of political economy as a form of transformative law, a new approach that combines a focus on the function of law with a concept of law encapsulating the triangular dialectics between the form-giving prestation of law, the material substance the law is oriented against, and the transcendence of legal forms—that is, the rendering of compatibility between forms. Transformative law thereby serves as an alternative to both law and economics and recently emerging (...) culturalist and neo-Marxist approaches. The timing of this publication is not coincidental. The era of neoliberalism—that is, of structural liberalism, which started in the 1970s and experienced its breakthrough in the 1980s and 1990s after the collapse of structural Marxism—is ending. SummaryThis article explores the representation of Yusra Mardini as a refugee Olympic athlete. Her participation in the 2016 Olympic Games is analyzed through different areas of programming of the mass media and, specifically, through Mardini’s autobiography, documents of the International Olympic Committee, and German newspapers. A qualitative content analysis is carried out and a systems theoretical framework applied. The results reveal that Mardini’s refugee background was both an obstacle and an advantage for her career within the sport system. The establishment (...) of the Refugee Olympic Team generated positive response from the International Olympic Committee but also exposed contradictions in its inclusion rules. The newspapers showed a strong interest in Mardini and presented her as a hero, downplaying her performances and emphasizing her life story. Following an analysis of the interconnections between these different representations, the discussion turns to the mechanisms that go beyond the inclusion of Mardini in professional sports and focuses on the latent information within the materials. The equation between the concept of society and the nation-state in modernity is known as methodological nationalism in scholarly debates. In agreement with the thesis that methodological nationalism must be rejected and transcended, this article argues that we still lack an understanding of what methodological nationalism actually is and, because of that, we remain unable to answer the substantive problem methodological nationalism poses to social theory: how to understand the history, main features and legacy of the nation-state in modernity. The (...) first section of the article reconstructs the origins of the critique of methodological nationalism in the 1970s and differentiates between its logical and historical versions. It then critically reviews the most salient critique of methodological nationalism in contemporary social theory, that of Ulrich Beck. The final part of the article assesses the thesis of social theory’s immanent methodological nationalism by demonstrating how social theory’s equivocations towards the nation-state only mirror the nation-state’s own ambivalence within modernity. It is shown that social theory’s ambivalent attempts at conceptualizing the nation-state reflect the actual ambivalence of the position of the nation-state in modernity: its historical opacity, its sociological uncertainty and its normative ambiguity. This article explores the concept of trust put forth by Niklas Luhmann and Talcott Parsons. It shows the outline of Luhmann's theory of trust and its connections to his autopoietic systems theory. It also deliberates upon the role of trust in the Luhmannian research of future society as well as examines the role of trust in risk society and shows why norms, values and familiarity play only a peripheral role in today's society. In consequence, a number of ethics guidelines have been released in recent years. These guidelines comprise normative principles and recommendations aimed to harness the “disruptive” potentials of new AI technologies. Designed as a semi-systematic evaluation, this paper analyzes and compares 22 guidelines, highlighting overlaps but also omissions. As a result, I give a detailed overview of the field of AI ethics. Finally, (...) I also examine to what extent the respective ethical principles and values are implemented in the practice of research, development and application of AI systems—and how the effectiveness in the demands of AI ethics can be improved. This article examines the financial technology of derivatives. Derivatives are financial products whose values are based on possible fluctuations in the values of underlying assets. Hence derivatives markets are markets that trade in the risks of other markets. In order for derivatives markets to function, forms of prognostication that can assess the possible future fluctuations of the underlying markets are necessary. What such prognostications do, the article argues, is to create information out of future possibilities. Building upon a notion of (...) virtuality derived from Gilles Deleuze, Ulrich Beck and Niklas Luhmann, the article shows how market risks and uncertainties, by means of prognostications, cease to be mere possibilities and instead come to have virtual existence. Through the technology of derivatives, uncertainty and risk can be rendered virtual and be traded. The article suggests that this technology is an example of a new way in which capitalism is now expanding self-referentially as it creates markets out of markets; and of how it is colonizing the future by developing new technologies for ‘hyper-speculation’, that is, speculation not in the possible developments of a given asset but simply in the risk of such speculation. Excluded and/or marginalized social groups frequently face problems involving representation in the public sphere. Moreover, the very notion of exclusion typically refers to communicatively or discursively produced mechanisms of being considered irrelevant in public processes of communication. Exclusion and marginalization, understood as processes of silencing or invisibilizing social groups, are particularly serious in cases involving social suffering, i.e. socially produced suffering and/or suffering that can be eliminated or alleviated socially. Making silence heard, giving voice to the silenced and bringing the (...) invisibilized back into the public domain are therefore fundamental tasks of solidarity in reaching a higher degree of social integration. The main aim of this article is to reveal how it is possible to disclose and understand the social grammar of the normative claims of silenced and invisibilized social groups. Therefore, grounded in Axel Honneth’s Theory of Recognition, I first develop a theoretic model of criticism that elucidates silent and invisible suffering as universal normative language. Next, I develop a typology of silencing and invisibilizing that allows research attention to be directed towards specific fields of normative claims with different validity claims. Finally, I offer some general advice with regard to performing empirical research aimed at normative social criticism that considers the grammar of the silenced and invisible language of suffering. This paper discusses the reception and impact of Berger and Luckmann’s The Social Construction of Reality. The article will, first, address Berger and Luckmann themselves and their approach to the book. In the next part, we will sketch the diffusion of the basic concept of the book. Then we want to show that the reception exhibits a particular open form, which allowed it to disperse into extremely different disciplines not only of the social sciences and the humanities. It is the (...) disciplinary distance in particular that detaches the diffusion of the concept from reference to the book. In the next part, we can see that this detachment leads to the variation of approaches to social construction. Particularly, it is the misidentification with constructivism that leads to misunderstandings, which will then be clarified in contrast to our reconsideration of the basic thesis of SCR. The conclusion will state that Berger and Luckmann’s concept therefore constitutes the common denominator of social constructivist approaches. (shrink)

Many traditional conceptions of ethics use categories and arguments that have been developed under conditions of pre-modern societies and are not useful in the age of globalisation anymore. I argue that we need an economic ethics which employs economics as a key theoretical resource and which focuses on institutions for implementing moral norms. This conception is then elaborated further in the area of business ethics. It is illustrated in the case for banning child labour.

The present paper builds on the Rawlsian critique of utilitarianism in order to identify the moral implications of Niklas Luhmann’s social systems theory. While Luhmann aptly discerned the pervasive problems of the precarious system–environment relations throughout the modern society, he took moral communication to be person-centered and thus ill-equipped to deal with these problems. At the same time, the Rawlsian possibility of sacrificing fundamental liberties for the sake of economic gains not only exemplifies the Luhmannian precariousness of the relations of (...) the economic system to its societal environment, but also shows this precariousness to be a moral problem. Thus, from the systems-theoretic perspective, the Rawlsian idea of justice denotes the moral dimension of the capacity of the societal environment to carry the economic system. More generally, the proposed complementarity between Rawls and Luhmann allows to see the precariousness of system–environment relations, for any type of social system, as a moral problem. Two implications follow. First, the morally problematic manifestations of the precarious system–environment relations are not limited to the Rawlsian case of the discrimination of the least advantaged groups but rather include a broad range of social costs and damaging effects of business on society and nature. Second, and related, the proposed systems-theoretic perspective explicates the moral value of sustainability of the economic as well as other social systems in their environment, societal and ecological alike. In a first retrospective of Niklas Luhmann's work, it is surprising to see that concepts regarding time and temporality received comparatively little attention. This article starts with the hypothesis that, over the years, Luhmann tended to subsume and deal with topics regarding time under the notion of `contingency'. Identified as the central ` Eigenwert' of modern societies, Luhmann seems to suggest that contingency ended up modifying the three classical time dimensions. In the case of the future dimension, the question arises (...) of what effect a modification of contingency through contingency as social Eigenwert might yield. The answer proposed is that this effect lies in our contemporary tendency to see the future as a field of risk-calculation. (shrink)

This year marks the 30th anniversary of the publication of Niklas Luhmann’s (1927–1998) magnum opus Soziale Systeme. Grundriss einer allgemeinen Theorie [14]. The text consists of two parts. Part one puts the works of Hans Blumenberg, as far as they tackle the problem of rhetoric, into their historical context. Relevant here in particular is the tradition of topological philosophies of the Renaissance and their different types of revival in the 20th century. Part two analyses three main ‘absolute metaphors’ or ‘topoi’ Hans Blumenberg has investigated, the metaphors of ‘light’, ‘shipwreck’, and ‘book of nature’, in order to add to the philosophical perspective taken (...) by Blumenberg a hidden philological perspective, which shows the shortcomings of conceptualizing rhetorical techne (how does a metaphor work), which does not always account for philological techne (how do we write texts). Although Darwinian concepts have largely been banned from the social sciences of the last century, they have recently seen a revival in several disciplines such as sociology, anthropology, or economics. Most of the current proponents of evolutionary theorizing in the social sciences avoid references to the older literature on social evolution. On that background, this article presents a contribution to Darwinist thinking in early American sociology that has mainly been overlooked in the literature. As the leading figure of the Human (...) Ecology Approach, which was established during the 1920s and 1930s, Robert Ezra Park drew heavily on evolutionary concepts to explain human evolution. A systematic presentation of these concepts in the light of the modern discussion on sociocultural evolution is given, followed by a conclusion about what can be learned from Park today. (shrink)

Autopoietic theory is increasingly seen as a candidate for a radical theory of law, both in relation to its theoretical credentials and its relevance in terms of new and emerging forms of law. An aspect of the theory that has remained less developed, however, is its material side, and more concretely the theory’s accommodation of bodies, space, objects and their claim to legal agency. The present article reads Luhmann’s theory of autopoietic systems in a radical and material manner, linking it (...) on the one hand to current post-structural theorisations of law and society, and on the other hand extending its ambit to accommodate the influx of material considerations that have been working their way through various other disciplines. The latter comprises both a materialisation of the theory itself and ways of conceptualising the legal system as material through and through. This I do by further developing what I have called Critical Autopoiesis, namely an acentric, topological, post-ecological and posthuman understanding of Luhmann’s theory, that draws on Deleuzian thought, feminist theory, geography, non-representational theory, and new material and object-oriented ontologies. These are combined with some well-rehearsed autopoietic concepts, such as distinction, environment and boundaries; Luhmann’s earlier work on materiality continuum; more recent work on bodies and space; as well as his work on form and medium in relation to art. The article concludes with five suggestions for an understanding of what critical autopoietic materiality might mean for law. (shrink)

This article discusses the concepts of collective subjectivity and collective causality as an alternative to methodological individualism, structuralism and functionalism. It resumes Aristotelian issues in a realist framework and applies, by way of example, its main concepts to criticize and suggest a distinct view of capabilities"" and ""freedom"" in connection with collective subjectivity.".

Among others, the term problem plays a major role in the various attempts to characterize interdisciplinarity or transdisciplinarity, as used synonymously in this paper. Interdisciplinarity is regarded as problem solving among science, technology and society and as problem orientation beyond disciplinary constraints. The point of departure of this paper is that the discourse and practice of ID have problems with the problem. The objective here is to shed some light on the vague notion of problem in order to advocate a (...) specific type of interdisciplinarity: problem-oriented interdisciplinarity. The outline is as follows: Taking an ex negativo approach, I will show what problem-oriented ID does not mean. Using references to well-established distinctions in philosophy of science, I will show three other types of ID that should not be placed under the umbrella term problem-oriented ID : object-oriented ID, theory-oriented ID, and method-oriented ID. Different philosophical thought traditions can be related to these distinguishable meanings. I will then clarify the notion of problem by looking at three systematic elements: an undesired state, a desired state, and the barriers in getting from the one to the other. These three elements include three related kinds of knowledge: systems, target, and transformation knowledge. This paper elaborates further methodological and epistemological elements of problem-oriented ID. It concludes by stressing that problem-oriented ID is the most needed as well as the most challenging type of ID. (shrink)

This paper provides an interpretation, based on the social systems theory of German sociologist Niklas Luhmann, of the recent paradigmatic shift of mental health care from an asylum-based model to a community-oriented network of services. The observed shift is described as the development of psychiatry as a function system of modern society and whose operative goal has moved from the medical and social management of a lower and marginalized group to the specialized medical and psychological care of the whole population. From this theoretical viewpoint, the wider deployment of the modern social order as a functionally differentiated system may be considered to be a consistent driving force for this process; it has made asylum psychiatry overly incompatible with prevailing social values (particularly with the normative and regulative principle of inclusion of all individuals in the different functional spheres of society and with the common patterns of participation in modern function systems) and has, in turn, required the availability of psychiatric care for a growing number of individuals. After presenting this account, some major challenges for the future of mental health care provision, such as the overburdening of services or the overt exclusion of a significant group of potential users, are identified and briefly discussed.
