  1. (1 other version)Are All Tautologies True?Philip Hugly & Charles Sayward - 1989 - Logique Et Analyse 125 (125-126):3-14.
The paper asks: are all tautologies true in a language with truth-value gaps? It answers that they are not. No tautology is false, of course, but not all are true. It also contends that not all contradictions are false in a language with truth-value gaps, though none are true.

  2. What’s So Special About Sentences?Philip Hugly & Charles Sayward - 1995 - Communication and Cognition: An Interdisciplinary Quarterly Journal 28 (4):409-25.
This paper is a discussion of Frege's maxim that it is only in the context of a sentence that a word has a meaning. Quine reads the maxim as saying that the sentence is the fundamental unit of significance. Dummett rejects this as a truism. But it is not a truism since it stands in opposition to a conception of meaning held by John Locke and others. The maxim denies that a word has a sense independently of any sentence in (...)

The purpose of this article is to continue the discussion on Europe’s converging criminal justice systems. In particular, I test a hypothesis that has recently appeared in the literature, which sees the jurisprudence of the European Court of Human Rights as one of the most significant factors that encourage a harmonization process between the adversarial and inquisitorial criminal justice systems of Europe. This claim is supported by examining the Court’s jurisprudence to identify decisions that led to legislative and policy amendments (...)

For Rudolf Carnap the question ‘Do numbers exist?’ does not have just one sense. Asked from within mathematics, it has a trivial answer that could not possibly divide philosophers of mathematics. Asked from outside of mathematics, it lacks meaning. This paper discusses Carnap ’s distinction and defends much of what he has to say.

In Tractatus, Wittgenstein held that there are null sentences – prominently including logical truths and the truths of mathematics. He says that such sentences are without sense (sinnlos), that they say nothing; he also denies that they are nonsensical (unsinning). Surely it is what a sentence says which is true or false. So if a sentence says nothing, how can it be true or false? The paper discusses the issue.

Suppose there is a domain of discourse of English, then everything of which any predicate is true is a member of that domain. If English has a domain of discourse, then, since ‘is a domain of discourse of English’ is itself a predicate of English and true of that domain, that domain is a member of itself. But nothing is a member of itself. Thus English has no domain of discourse. We defend this argument and go on to argue to (...)

The paper purports to show, against Quine, that one can construct a language , which results from the extension of the theory of truth functions by introducing sentence letter quantification. Next a semantics is provided for this language. It is argued that the quantification is neither substitutional nor requires one to consider the sentence letters as taking entities as values.

  10. Some Meta-Theoretical Questions for Restorative Justice.Theo Gavrielides - 2005 - Ratio Juris 18 (1):84-106.
Unquestionably, Restorative Justice (hereafter RJ) has finally gathered some real momentum. It has become a sine qua non topic in many national and international policy and statutory agendas. However, as the restorative practice expands to deal with crimes, ages and situations it has never addressed before (at least in its contemporary version), and as its application starts to make sense not only to national but also to regional and international bodies and fora, new theoretical problems are posed. In the fast-growing (...)

It exists in the form of many practices such as mediation, conferencing, circles, and panels. As the interest in RJ continues to grow, this research takes a step back to ask how reconcilable RJ is with incapacitation. Through a combination of normative thinking, literature review, and primary research that applied qualitative methodologies over a 3-year period, the article examines where the two notions meet (...)

Although the fast-growing literature on restorative justice is extensive, and in some regards repetitive, there is still no consensus as to the nature and extent of applicability of the restorative notion. This article claims that the restorative movement is experiencing a tension between normative abolitionist and pragmatic visions of restorative justice. It proceeds to identify six conceptual fault-lines that characterize this tension. These do not only refer to various definitional positions, but also disagreements that negatively affect both the theoretical and (...)

Human rights and restorative justice are rarely brought under the same spotlight despite their normative similarities. In fact, this gap becomes even more apparent when put in the context of policy and practice internationally. Firstly, there is a developing gap between public perception and evidence-based depiction of crime. Secondly, scholarly debates are rarely reflected in criminal justice policy and legislation. This failure has an impact on recidivism, the spiralling costs of penal interventions, but most importantly on how we view our (...)

I argue that we can only find something funny if we regard it as norm-violating in a way that doesn’t make certain cognitive or pragmatic demands upon us. It is compatible with these conditions that humour reinforces our attitude that something is norm-violating. However, it is not compatible with these conditions that, on the basis of finding it (...)

The COVID-19 pandemic led to social restrictions that often prevented us from hugging the ones we love. This absence helped some realize just how important these interactions are to our sense of care and connection. Many turned to digitally mediated social interactions to address these absences, but often unsatisfactorily. Some theorists might blame this on the disembodied character of our digital spaces, e.g., that interpersonal touch is excluded from our lives online. However, others continued to find care and connection in (...)

Traditional moral education grounded in a Kohlbergian theory of moral development is indeed unsuitable for that task; however, the psychology of moral development and education has come a long way since then.
