  • The Law of Political Economy as Transformative Law: A New Approach to the Concept and Function of Law.Poul F. Kjaer - 2021 - Global Perspectives 2 (1):1 - 17.
This article outlines a new approach to the law of political economy as a form of transformative law, a new approach that combines a focus on the function of law with a concept of law encapsulating the triangular dialectics between the form-giving prestation of law, the material substance the law is oriented against, and the transcendence of legal forms—that is, the rendering of compatibility between forms. Transformative law thereby serves as an alternative to both law and economics and recently emerging (...)

  • Functional differentiation as ideology of the (neo)colonial society.Guilherme Leite Gonçalves - 2017 - Thesis Eleven 143 (1):70-81.
This article discusses the ideological character of the notion of functional differentiation. According to Luhmann, the development of worldwide social differentiation leads to different regional developments and generates, through the inclusion/exclusion code, a division of the world between places where the functional differentiation operates appropriately and inappropriately. This paper argues, however, that functional differentiation is only readable as an ensemble of relations of power and ideological discourses. This subject is developed in light of theoretical approaches from the Marxist tradition and (...)

Movements tend to employ instituent practices and to acquire constitutive characteristics when they set up the material foundations of their collective autonomy, i.e. when they establish socially reproductive commons, democratically producing forms of life that respond to basic needs of the participants to the commons. The legal recognition of the sphere of the commons and the freedom of people to share, co-establish and self-regulate whole infrastructures of their social production is therefore not a negligible change but a complete reversal of (...)

  • Paradox Preserved: From Ontology to Autology. Reflections on Niklas Luhmann's the Art of Society.David Roberts - 1987 - Thesis Eleven 51 (1):53-74.
As a universal theory Luhmann's systems theory of society includes art in its ambit. The Art of Society (1995) reconstructs the formal and the social-historical conditions of the functional differentiation of a system of art since the Renaissance. The methodological focus of the reconstruction - Luhmann's theory of form (perception, first and second order observation, medium and form) and of systemic differentiation (social function, self-organization, codes and programmes, evolution and self-description of art) - are analysed in the first part of (...)

Tort law and liability insurance have a complex interaction in which each shapes the evolution and effects of the other. This interaction and its many forms and facets in different international contexts must be comprehended to understand fully the ethical responsibilities of liability insurers. This essay builds on previous scholarship on the tort law–liability insurance interaction through a series of observations from the perspective of a global reinsurer. It seeks in part to extend previous analyses of this interaction by also (...)

  • Niklas Luhmann's systems theoretical redescription of the inclusion/exclusion debate.Antoon Braeckman - 2006 - Philosophy and Social Criticism 32 (1):65-88.
Relying on Niklas Luhmann's systems theoretical redescription of modern society, this article aims at questioning the basic theoretical notions of the ongoing inclusion/exclusion debate. The most remarkable aspect of Luhmann's reassessment of the inclusion/exclusion relationship within functionally differentiated societies is that individuals are basically situated within the exclusion domain of society, and thus cannot but partially be included within society's function systems and organizations. This reassessment not only allows Luhmann to raise fundamental questions with respect to the implicit norm of (...)

The main stream of legal theory tends to incorporate unwritten principles into the law. Weighing of principles plays a great role in legal argumentation, inter alia in statutory interpretation. A weighing and balancing of principles and other prima facie reasons is a jump. The inference is not conclusive. To deal with defeasibility and weighing, a jurist needs both the belief-revision logic and the nonmonotonic logic. The systems of nonmonotonic logic included in the present volume provide logical tools enabling one to speak (...)

The subject of this study are the argumentation strategies applied by the Polish and German apex courts competent in criminal matters, namely the Supreme Court and the Federal Court of Justice, respectively. The investigation encompasses a total of 200 rulings issued by the criminal panels of these bodies. Particular focus was put on examining which arguments both courts apply to solve interpretation problems, and secondly, how these courts systematize the interpretation process. Methodologically, the examination utilizes, inter alia, the principles of (...)

  • Breaking Frames: Economic Globalization and the Emergence of Lex Mercatoria.Gunther Teubner - 2002 - European Journal of Social Theory 5 (2):199-217.
Globalization processes imply the self-deconstruction of the hierarchy of legal norms. Thus, legal pluralism is no longer only an issue for legal sociology, but becomes a challenge for legal practice itself. Traditionally, rule making by `private regimes' has been subjugated under the hierarchical frame of the national constitution. When this frame breaks, then the new frame of legal institutions can only be heterarchical. The origin of global non-state law as a sequence of recursive legal operations is an `as if', not (...)

The concept of the political in Carl Schmitt’s works is not only defined by the distinction between friend and enemy, but also by the criterion of breaching the rules in a normatively unbound act of decision. According to Schmitt, this decision is, however, not arbitrary, but provoked by the necessity of a historical situation. This aspect of necessity calls the freedom of the decision into question and leads to tensions within Schmitt’s theory of the political. More explicitly than in Schmitt’s (...)

This article questions some assumptions in legal, moral and political theory regarding the law’s ways of functioning. As the constant revival of the topos ‘living law’ shows, underlying common models of law, and of the legitimacy of law, is, though often implicitly, the view that law is or should be particular, near to the facts, flexible, susceptible to realities, and as a consequence accessible to modernisations. However, this article proposes an immanent critique of similar hopes or fears, and it argues (...)

  • Who is Presumed Innocent of What by Whom?Carl-Friedrich Stuckenberg - 2014 - Criminal Law and Philosophy 8 (2):301-316.
The article analyses the components of the presumption of innocence and tries to clarify some of the conceptual and logical difficulties surrounding the notion of ‘innocence’ and the structure of legal presumptions. It is argued that all conceivable literal interpretations of the maxim make little or no sense, and that the presumptions form is, as such, devoid of original content: presumptions do not explain nor justify anything but are auxiliary norms which refer to the legal consequences spelled out in other (...)

The paper reconstructs Luhmann’s conception of legal argumentation and justice especially focussing on the aspects of contingency and self-referring operative closure. The aim of his conception is to describe/explain in a disenchanted way—from an external, of “second order” point of view—the work on adjudication, which, rather idealistically, lawyers and judges present as being a matter of reason. As a consequence of some surface similarities with Derrida’s deconstructive philosophy of justice, Teubner proposes integrating the supposed reductive image of formal justice described (...)

The article deals with `The Symbolic Force of Human Rights'. First, it restricts the meaning of the term `symbolic' and of the expression `symbolic force'. Second, it discusses the concept of human rights. Having established the conceptual framework, the author goes to the core of his argument, characterizing the symbolic force of human rights as ambivalent: on one hand, it serves for their generalized affirmation and accomplishment; on the other hand, it acts as a manner of political manipulation. In this (...)

In Brazil, for instance, one can see how recent legal rules promote benefits for those local groups who practice low environmental impact activities. Nevertheless, regarding traditional fishing communities that live on the coastal zone, a region where many protected areas have been created lately in Brazil, the positive social effects of those measures are often undermined by the economic and political (...)
