That various legal orders preside in any one jurisdiction has long been seen as evidence of legal pluralism; however, this approach lacks a systematic understanding of history in general, and as such, tells us little about the inner machinations of law’s relation to capitalist development in particular. What is needed instead is a dialectical materialist approach to legal development; for this reason, I tender an uneven and combined development theory of law. Law flexes in concert with ever-changing social relations, or (...) more plainly, law evolves in an uneven and combined manner. More than being mired in the contradictions that are the driving force of the UCD of capitalism, however, law also boasts its own set of contradictions that, if carefully accounted for, helps distinguish the historical evolution of capitalism as a social totality. “Racial capitalism” has surfaced during the past few decades in projects that highlight the production of difference in tandem with the production of capital—usually through violence. Scholars in this tradition typically draw their inspiration—and framework—from Cedric Robinson’s influential 1983 text, Black Marxism: The Making of the Black Radical Tradition. This article uses the work of Orlando Patterson to highlight some limits of “racial capitalism” as a theoretical project. First, the “racial capitalism” literature rarely clarifies what scholars mean by “race” or (...) “capitalism.” Second, some scholars using this conceptual language treat black subjectivity as a debilitated condition. An alleged byproduct of the Transatlantic slave trade, this debilitated form of black subjectivity derives from an African American exceptionalism that treats slavery as a form of abject status particular to capitalism without providing adequate theoretical justification or historical explanation. By contrast, we demonstrate how Patterson’s insights about property, status, and capital offer an analysis of slavery more attentive to race, gender, sexuality, age, and ability. We close by using the “forensics of capital” to explore the notions of causality and protocols for determining who owes what to whom implicit in Patterson’s concept of “social death.”. (shrink)

The analysis of long economic cycles allows us to understand long-term worldsystem dynamics, to develop forecasts, to explain crises of the past, as well as the current global economic crisis. The article offers a historical sketch of research on K-waves; it analyzes the nature of Kondratieff waves that are considered as a special form of cyclical dynamics that emerged in the industrial period of the World System history. It offers a historical and theoretical analysis of K-wave dynamics in the World (...) System framework; in particular, it studies the influence of the long wave dynamics on the changes of the world GDP growth rates during the last two centuries. Special attention is paid to the interaction between Kondratieff waves and Juglar cycles. The article is based on substantial statistical data, it extensively employs quantitative analysis, contains numerous tables and diagrams. On the basis of the proposed analysis it offers some forecasts of the world economic development in the next two decades. The article concludes with a section that presents a hypothesis that the change of K-wave upswing and downswing phases correlates significantly with the phases of fluctuations in the relationships between the World-System Core and Periphery, as well as with the World System Core changes. This essay revisits Karl Marx’s understanding of consumption, in an effort to rescue it from the overshadowing legacy of critical theory which has construed Marx as inveighing against false needs. It is argued that Marx regarded the expansion of needs entailed by capitalism in a generally favourable way, but saw capitalism as a system yoking use-value to the imperatives of profit accumulation, hence limiting and subjugating the consumption of the masses. While Marx’s position was radically different from conventional anti-consumerism it (...) is equally incompatible with complacent affirmations of ‘the consumer society’ in that Marx at all times aimed at a revolutionary change which will transform consumption both quantitatively and qualitatively. Marx’s views are first discussed as expressed in the perennially-cited text, the 1844Economic and Philosophical Manuscripts. The ontological and analytical status of Marxian social theory has been a matter of fierce controversy since Marx’s death, both within and without Marxist circles. A particular source of contention has been over whether Marxism should be construed as an objective science of the capitalist mode of production or as an ethico-philosophical critique of bourgeois society. This is paralleled by the dispute over whether Marxism ought to be considered a humanism or a structuralism. This article addresses both sides of this (...) debate. The argument is that, rather than Marx’s own social thought being split into incompatible poles, giving rise to ‘two Marxisms’, it forms a coherent unity. Marx’s social theory is neither humanist philosophy, nor structural science, but is in fact realist science, which synthesizes these apparent antinomies, and thereby transcends both. (shrink)

In this work, it is argued that one of the foundations of NiklasLuhmann’s theory of social systems, namely that it has no ontology, would prevent the elaboration of explanations in sociology. Because the theory has a formal-logical foundation, which does not presuppose ontology, there are insurmountable obstacles to achieving this objective. For this reason, it is valid to wonder about the merit of a theory that, after 20 years, insists on not aligning itself with ontological premises in a robust way (...) and suggests, therefore, a refusal to integrate sociology within the set of factual sciences. However, we think that the richness of Luhmann’s work allows a dialogue with the mainstream of contemporary theoretical practice. Three rules about what “should not be done” are revalidated from this analysis to philosophically base a theory in sociology and a key suggestion to overcome the problem of explanation in Luhmann’s sociology: social science seeks and directs its activity towards discovery and the use of substantive, real distinctions that also enrich the factual content of statements about social reality. This article assesses some of the implications of globalization for the scholarly debate on business ethics, CSR and related concepts. The argument is based, among other things, on the declining capacity of nation state institutions to regulate socially desirable corporate behavior as well as the growing corporate exposure to heterogeneous social, cultural and political values in societies globally. It is argued that these changes are shifting the corporate role towards a sphere of societal governance hitherto dominated by traditional political actors. (...) This leads to a discussion of the ambivalent results of such a process for a responsible corporate role in a globalized world. While assessing the current reception these changes have received in the management literature, the contributions of the four articles in this Special Issue are framed and evaluated. In this thesis I outline a view of primary legislation from a systems perspective. I suggest that systems theory and, in particular, autopoietic theory, as modified by field theory, is a mechanism for understanding how society operates. The description of primary legislation that I outline differs markedly from any conventional definition in that I argue that primary legislation is not, and indeed cannot be, either a law or any of the euphemisms that are usually accorded to an enactment by a (...) parliament. I cite two reasons for such a conclusion. The primary reason for my conclusion is that I see primary legislation as being an output of a particular subsystem of society, while the law is the output of another subsystem of society. I argue that these outputs are the discrete products of separate subsystems of society. I argue that primary legislation should be viewed as a trinity. The first state of this trinity is that, upon enactment, primary legislation is a brute fact in that it is but a thing and the only property of this thing is that of being a text. The second state of this trinity is that following the act of enactment, the thing enacted will be reproduced and this reproduction is a separate thing that will sit in some repository until used. The third state of this trinity is that, upon use, this thing that is primary legislation will be transformed into an object and the user will attribute such functions and attributes to that object as are appropriate to the context within which the object is used. The thing has therefore become an object and an institutional fact. The second reason for my conclusion that primary legislation is not a law relates to the fact that the thing that is primary legislation is a text and the only function of a text is that it is available to be read. That is to say, of itself, a text is incapable of doing anything: it is the reader who defines the status of the text and attributes functions and attributes. Upon use, primary legislation thus becomes a censored input for future action and one of these actions may be some statement by a court of law. I assert that the view of primary legislation that has been accepted within the body politic is the product of the discourse of a particular subsystem of society that I have designated 'the legal practice', and I outline why and how this has occurred. Outlining a view about primary legislation also necessitates outlining a view as to the nature of the law. I assert that the law is a myth and I see this myth as a product of the discourse of the legal practice. I have asserted that although it is the judges that state the law, such statements flow from the discourse of those who practise the law. (shrink)

Alain Badiou’s theoretical work maintains an ambiguous relation to Marx’s critique of political economy. In seemingly refusing the Marxian analytical strategy of displacement and referral across the fields of politics and economy, Badiou is frequently seen to be lacking a rigorous theoretical grasp of capitalism itself. In turn, this is often seen as a consequence of his understanding of political subjectivity. But the origins of this ‘lack’ of analysis of the social relation called ‘capital’ in his work can also be (...) investigated by means of a detour into the economic writings of theUnion des communistes de France marxiste-léniniste, the political organisation in which Badiou played a leading rôle throughout the 1970s in particular. By excavating this theoretical work of the 1970s, we can identify more precisely the historical and political reasons behind Badiou’s ambiguous relation to Marx and specifically to Marx’s systematic grasp of the logic of capital. This excavation will consequently lead us to a reflection on the limits and openings in Badiou’s thought for the Marxian critique of political economy. (shrink)

Historians have linked the emergence of contemporary lesbian/gay identities to the development of capitalism. A materialist approach should also look atdifferentforms of sexual identity, and their connections with specific phases of capitalist development. Marxist long-wave theory can help us understand how the decline of Fordism contributed to shifts in LGBT identities, speeding the consolidation of gay identity while fostering the rise of alternative sexual identities. These alternative identities, sometimes defined as ‘queer’, characterised by sexual practices that are still stigmatised, by (...) explicit power-differentials and above all by gender-nonconformity, are particularly common among young and disadvantaged working-class strata. The growing diversity of identities is a challenge to any gay universalism that neglects class, gender, sexual, racial/ethnic and other differences, to the currently dominant forms of lesbian/gay organising, and ultimately to the prevailing division of human beings into gay and straight.1. In this recent history of British sociology, Andrew Halsey suggests an intriguing connection between political economic régimes in the twentieth century and the development of sociology as an academic discipline, dividing British sociology into four periods, 1900-1950, 1950-1967, 1968-1975, and 1975-2000. In this way, by connecting disciplinary developments with contemporaneous régimes of economic regulation, Halsey begins to outline a sociology of sociology. However, although much of Halsey's book is informative, especially his description of the period from 1950-1967 when he personally (...) entered the discipline, Halsey ultimately fails to develop his sociology of the discipline sufficiently, especially after 1967. Recent events impel us to rethink fundamentals: to bring political economy, historical materialist theory, state theory, and the theory of nations and national consciousness together, and to bear on the core questions: How mature is world capitalism today? What stadial — stage-theoretic — elements must be invoked to explain the present? A rigorous stadial approach to capitalist evolution suggests that, contrary to much popular wisdom, capitalism's conquest of the world is far from complete. This understanding does not mechanically postpone significant (...) social transformation; to the contrary, it points toward the possibility of getting a better fix on what is possible in the short term, so as to bring longer range goals into clearer focus and relevance. To date, the primary focus of research in the field of corporate social responsibility (CSR) has been on the strategic implications of CSR for corporations and less on an evaluation of CSR from a wider political, economic and social perspective. In this paper, we aim to address this gap by critically engaging with marketing campaigns of so-called ‘ethical’ bottled water. We especially focus on a major CSR strategy of a range of different companies that promise to provide drinking water for (...) (what they name as) ‘poor African people’ by way of Western consumers purchasing bottled water. Following Fairclough's approach, we unfold a three-step critical discourse analysis of the marketing campaigns of 10 such ‘ethical’ brands. Our results show that bottled water companies try to influence consumers' tastes through the management of the cultural meaning of bottled water, producing a more ‘ethical’ and ‘socially responsible’ perception of their products/brands. Theoretically, we base our analysis on McCracken's model of the cultural meaning of consumer goods, which, we argue, offers a critical perspective of the recent emergence of CSR and business ethics initiatives. We discuss how these marketing campaigns can be framed as historical struggles associated with neo-liberal ideology and hegemony. Our analysis demonstrates how such CSR strategies are part of a general process of the reproduction of capitalist modes of accumulation and legitimation through the usage of cultural categories. The high-tech health service work done by amateur family caregivers in U.S. homes challenges the conventional division of the social world into public and private. Under new federal reimbursement systems, the diagnosis-related groups, patients are being discharged sicker than before from hospitals and nursing homes, or after treatments in outpatient clinics. Health care facilities depend on a work transfer, shifting their earlier responsibilities for the sick to the family. There, women family members do for free the work once done by (...) paid health service workers in health care facilities, caring for family members who need their nursing and housekeeping services. Women's unpaid work knits together “public” and “private,” demonstrating how capitalism reorganizes the labor process to make use of free service labor. (shrink)

This paper discusses how Switzerland is branded by the Swiss state under late capitalism. Drawing on discursive data collected in the framework of a research project investigating the international promotion of Switzerland, I particularly focus on how multilingualism and cultural diversity are constructed by the Swiss government as a capital belonging to Switzerland and its history and on how and why this imagined historical capital is reframed in promotional terms. In doing so, I question the function of the historicity of (...) Swiss multilingualism and cultural diversity in nation branding practices and analyze the logics causing specific tokens of multilingualism and cultural diversity to emerge as desirable promotional features. Finally, I research how the promotional investment in Swiss multilingualism and cultural diversity affects the status and value of its historical capital and how this has consequences for what can be said about Switzerland and its history. We examine the emergence of the ‘postfeminist’ sensibility from feminist theory and praxis, and its relation and relevance to education. Analytical frameworks such as postfeminism and intersectionality have given equal weight to recognition-based struggles, such as those based on sexual, racial, class-based, gender-related identities. We follow Nancy Fraser’s argument that these identity-based movements have been co-opted by neoliberal politicians and bureaucratic policy-makers, and become a divide and rule strategy, neglecting the subjugating power of capital. Beginning with third-wave feminism’s emphasis on (...) individual identity, women’s struggles have been become a part of the greater parisitic neoliberal project. We consider the implications of this docile and domesticated feminism for the education of women. (shrink)

This article critiques the concept and discourse of social responsibility in terms of theoretical coherence, empirical salience, normative viability, and power/knowledge implications from a Marxist-institutionalist perspective. The social responsibility concept and discourse is found to be problematic along each of the above dimensions. The basic point can be stated succinctly: The concept and discourse of social responsibility are viable only in the absence of a historically grounded understanding of capitalist political economy. At the same time, however, the article argues that (...) social responsibility constitutes an influential ideology with material implications for stakeholder groups. (shrink)

Consumer society has negated Freud's thesis presented in Civilization and its Discontents. The hindrance of desire affirmation is no longer the foundation of discontent. The inverse is now true. A seemingly limitless number of desires have been manufactured and administered with a solitary route to their affirmation via consumption. Because of this, consumer society's members find themselves in a lifeworld of aimless striving, dissatisfaction, disappointment and boredom. I demonstrate that the attempt to flee the sufferings of estranged labour through consumption (...) has pushed consumer society into a new web of suffering brought on by a continual development of manufactured desires, creating a minor yet perpetual pain that is best understood in the light of a sociologized and historicized Schopenhauerian philosophy.
