Recent debates in political theory display a renewed interest in the problem of judgment. This article critically examines the different senses of judgment that are at play in Jürgen Habermas’ theory of law. The article offers a new critical reading of Habermas’ account of the legitimacy of law, and a revisionary interpretation of the reconstructive approach to political theory that underpins it. Both of these are instrumental to an understanding of what is involved in judging the legitimacy of law that (...) is richer than has been recognized thus far by both critics and defenders of Habermas. Uniquely among contemporary philosophies, Roy Bhaskar’s system of critical realism attempts to sublate (draw out the real strengths of and surpass) the philosophical discourse of modernity considered as a dialectically developing totality. This paper systematically expounds and comments on Bhaskar’s metacritique of that discourse and situates it briefly in relation to Jürgen Habermas’s earlier critique.

The paper develops ethical guidelines for the development and usage of persuasive technologies (PT) that can be derived from applying discourse ethics to this type of technologies. The application of discourse ethics is of particular interest for PT, since ‘persuasion’ refers to an act of communication that might be interpreted as holding the middle between ‘manipulation’ and ‘convincing’. One can distinguish two elements of discourse ethics that prove fruitful when applied to PT: the analysis of the inherent normativity of acts (...) of communication (‘speech acts’) and the Habermasian distinction between ‘communicative’ and ‘strategic rationality’ and their broader societal interpretation. In modern continental thought, natural science is widely portrayed as an exclusively instrumental mode of reason. The breadth of this consensus has partly preempted the question of how it came to persuade. The process of persuasion, as it played out in Germany, can be explored by reconstructing the intellectual exchanges among three twentieth-century theorists of science, Heidegger, Habermas, and Werner Heisenberg. Taking an iconic Heisenberg as a kind of limiting case of “the scientist,” Heidegger and Habermas each found themselves driven (...) to place new constraints on their previously more capacious assessments of science, especially its capacity to reflect on its method. Tracing how that happened, through archival and historical contextualization and close readings of their texts, lets us make visible Heidegger and Habermas’s intellectual affinities and argumentative parallels, which derived not only from their shared grounding in earlier reactions against positivism, but also from confrontation with contemporary events. The latter included, for Heidegger, the rise of a technically powerful science exemplified by nuclear physics, and for Habermas, post-World War II controversies over science, technology, and their socially critical possibilities. Postmodernism precludes philosophical justifications for democracy. This undermines the role of philosophy of education and leaves us with weaker reasons for educational democracy than we need. If the ‘postmodern challenge’ is as Wilfred Carr conceives it, Jürgen Habermas meets that challenge. His work rests on neither Enlightenment essentialism nor foundationalism. Habermas can accept and explain that consciousness is historically and socially situated in discourse, yet still argue to the possibility of emancipation. I defend his conception of rationality from charges of (...) essentialism. Rational thinking can critique its own specific forms, so superior forms of rationality remain universalisable by rational means. A historicising account of such critique avoids situationist relativism. These considerations justify educational democracy and preserve a role for philosophy of education. (shrink)

Muchos siguen las huellas de los fundadores de esta tendencia, mientras que otros se presentan como críticos de la misma y unos cuantos más tratan de vincular problemas y contextos (...) de relevancia a los conceptos más destacados que se empezaron a construir hace cien años en Frankfurt. Encontramos como buena excusa para su publicación precisamente el año centenario del Instituto de Investigación Social. Además, hemos creído conveniente organizar los materiales en secciones que van desde la historia de la Escuela de Frankfurt hasta la consideración de algunos interrogantes de actualidad motivados por el desarrollo de la teoría crítica. No obstante, con esto no pretendemos establecer límites absolutos de clasificación. Confesamos que nuestra forma de organizar los ensayos responde simplemente a criterios editoriales más que a cuestiones teóricas y conceptuales. Habermas’ fundamental philosophical project is to reinstate, in a contemporary context, the classical idea that human lives can be guided by practical knowledge; i.e., that it is possible to know what are the ultimate human values and direct our lives in accord with this knowledge:2 This project has a central importance because of the ironic turn taken by the development of contemporary society. Previously, societies generally thought they had a clear and rationally founded notion of the ultimate values that should (...) guide human lives; but they lacked the technical resources needed to implement (or remove obstacles to) these values. Today, we have the technical resources to at least make a significant effort toward the realization of our values. But the very scientific advances that have provided these technical resources have called into question the rational bases of traditional values and even led to the suggestion—urged by the positivists—that our ultimate values have no cognitive status but are merely irrational givens. Critics of Jürgen Habermas's theory of communicative action argue that he has failed to recognize the extent to which moral argumentation is grounded in particular historical contexts, cultural traditions, collective identities, or social lifeworlds. Although he has engaged in a series of strategies aimed at acknowledging the role of particularistic considerations without abandoning his primary commitment to ethical universalism, Habermas has not succeeded in meeting all of the objections of his critics. This paper treats the contradiction between formal and substantive (...) rationality, which lies at the heart of the debate, as an empirical phenomenon within the social world. It argues that the antinomy of formal and substantive rationality plays a central role in historical processes of social change. Through critical argumentation, social actors deliberate on contradictions among strategic, moral, and ethical standards of validity, and they struggle to resolve these contradictions through collective action and the reform of laws, policies, and institutions. Examples are drawn from US political history to substantiate the argument, and some questions are raised for further research. (shrink)

I argue that contemporary accounts of ideology critique—paradigmatically those advanced by Haslanger, Jaeggi, Celikates, and Stanley—are either inadequate or redundant. The Marxian concept of ideology—a collective epistemic distortion or irrationality that helps maintain bad social arrangements—has recently returned to the forefront of debates in contemporary analytic social philosophy. Ideology critique has similarly emerged as a technique for combating such social ills by remedying those collective epistemic distortions. Ideologies are sets of social meanings or shared understandings. I argue in this paper (...) that because agents must coordinate on them to be mutually intelligible, ideologies, on the fashionable contemporary account, are conventions. They are equilibrium solutions to a particular kind of social coordination problem. The worry is that changing pernicious conventions requires more than the epistemic remedy contemporary critical social theorists prescribe. It also requires overcoming strategic impediments like high first-mover costs. Thus contemporary proponents of ideology critique—the “new ideology critics,” as I’ll call them—face a dilemma. Either their account of social change fails to account for important strategic impediments to social change, in which case it is inadequate, or it incorporates a theory of strategic behavior, and thus merely reinvents the wheel, poorly. It adds nothing to prominent convention-based accounts of social change in the social sciences. More generally, this is an example of a pernicious trend in contemporary critical social theory. Contemporary critical social theorists have abandoned their predecessors’ commitment to engaging with social science, thereby undermining their efforts. (shrink)

El presente artículo analiza la crítica de Axel Honneth a la distinción habermasiana entre sistema y mundo de la vida como una ficción teórica que acarrea un déficit explicativo de la dinámica social y una rebaja del propio enfoque comunicativo del autor. Se vincula esta crítica con la que han realizado otros teóricos y se valora su pertinencia a la luz de la réplica que el propio Habermas brindó. A partir de allí, se intenta mostrar cómo este distanciamiento de Honneth (...) habilita una nueva forma –aunque no explorada por el autor- de conceptualizar el carácter y rol de la sociedad civil. Since the Enlightenment, critique has played an overarching role in how Western society understands itself and its basic institutions. However, opinions differ widely concerning the understanding and evaluation of critique. To understand such differences and clarify a viable understanding of critique, the article turns to Kant’s critical philosophy, inaugurating the “age of criticism”. While generalizing and making critique unavoidable, Kant coins an unambiguously positive understanding of critique as an affirmative, immanent activity. Not only does this positive conception prevail in the (...) critique of pure and practical reason and the critique of judgment; these modalities of critique set the agenda for three major strands of critique in contemporary thought, culminating in among others Husserl, Popper, Habermas, Honneth, and Foucault. Critique affirms and challenges cognition and its rationality, formulates ethical ideals that regulate social interaction, and further articulates normative guidelines underway in the ongoing experimentations of a post-natural history of human nature. In contradistinction to esoteric Platonic theory, philosophy at the threshold of modernity becomes closely linked to an outward-looking critique that examines and pictures what human forms of life are in the process of making of themselves and challenges them, by reflecting upon what they can and what they should make of themselves. As a very widely diffused practice, however, critique may also become a self-affirming overarching end in itself. (shrink)

Dicha concepciones enfrentan problemas serios a la hora de articular de manera consistente dos dimensiones que parecen ir naturalmente asociadas a la idea de legitimidad: la dimensión procedimental, vinculada a la equidad del procedimiento, y la dimensión epistémica, asociada a la corrección de los resultados. Against the easy presupposition that such a thing as ‘democratic taxation’ not only exists but is also practicable, this paper points to the dilemma posed by what I call ‘quantifiable action.’ The essay develops an approach to theorizing the place of taxation in political theory that counters trends in fiscal sociology, political science, and liberal theory by highlighting how taxation presumably violates the requirement that self-government includes an absence of instrumental rationality on the part of democratic citizens. For this reason, (...) taxation presents a persistent problem for any concept of self-government, and may usefully be regarded as a technology of the self, conventional with democracy but at most ambiguous in its capability to be genuinely democratic, both theoretically and practically. The topic of eschatology is generally confined to the field of theology. However, the subject has influenced many other fields, such as politics and history. This dissertation examines the question why eschatology remained a topic of discussion within twentieth century philosophy. Concepts associated with eschatology, such as the end of time and the hope of a utopian age to come, remained largely background assumptions among intellectuals in the modern age. Martin Heidegger, Nicolai Berdyaev, and Hans Blumenberg, however, explicitly addressed the (...) subject in their philosophies. The impetus of this study is Heidegger's statement, "Being itself is inherently eschatological," which indicates the centrality of the subject in his understanding of Being. This statement led to the question whether eschatology played a larger role in Western thought. It also raised the question concerning the relationship between eschatology and other philosophical subjects such as teleology. Because of the multitude of assumptions concerning the meaning of eschatology, Chapter One provides essential working definitions. In order to obtain a sufficient understanding of the topic and address the use of the term among the three philosophers, it was necessary to see how eschatology was understood and acted upon in Western thought. Chapter Two addresses the history of eschatology in the West and concludes that there are two general streams of eschatological thought that explains why it continued to remain a subject for contemporary philosophers. Chapters Three through Five address how eschatology was used by Heidegger, Berdyaev, and Blumenberg respectively. Each utilized the subject in different ways: for Heidegger eschatology constitutes Dasein's existence. Futurity ("forward-directedness") is a condition Dasein as a totality. Dasein is "being-toward-the-end" or "toward-death." Berdyaev combines the eschatological tradition with philosophical achievements and offers an "eschatological metaphysics." He distinguishes eschatology from teleology arguing against teleology, noting that only a "personalist" eschatology can solve the problems of dualism and objectification. Blumenberg differs from Heidegger and Berdyaev by offering a negative evaluation of eschatological belief in the West contending that the modern secular age is the result of a failed eschatology. The conclusion of this work follows Charles Taylor's contention in A Secular Age that "our sense of where we are is crucially defined in part by a story of how we got there." The conclusion is that eschatology, throughout most of Western thought, functioned largely as a background assumption for understanding time and history. The transition from the linear concept of time to a cyclical concept defines in part the modern secular age. The notion of future time is an important and often neglected dimension of hermeneutic understanding. The continued influence of eschatological thought in Western history explains why the philosophers under consideration in this work address eschatology and signals that its influence upon philosophical thought is not likely to diminish in the future. The question this paper examines is whether or not discourse ethics is an environmentally attractive moral theory. The answer reached is: no. For firstly, nature has nothing to gain from the discourse ethical shift from mono-logical moral reflection to discourse, as nature cannot partake in discourse. And secondly, nature (even sentient animal nature) has no socio-personal integrity, which, according to discourse ethics, it is the function of morality to protect. Discourse ethics is a thoroughly anthropocentric moral theory.

Over four decades, Habermas has put to paper many critical remarks on Husserl’s work as occasion has demanded. These scattered critical engagements nonetheless do add up to a coherent (if contestable) position regarding the project of transcendental phenomenology. This essay provides a comprehensive reconstruction of the arguments Habermas makes and offers a critical assessment of them. With an eye in particular to the theme of intersubjectivity (a theme of fundamental interest to both thinkers), it is argued that Habermas’s arguments do (...) indeed show up deficiencies in Husserlian phenomenology and yet that they do not succeed in proving that we must abandon the methods and tasks of phenomenological research. On the contrary, it is argued that phenomenological methods may well be needed in order to investigate certain philosophical questions that Habermas’s theory of communication has thus far only partially addressed. It has often been said that discourse ethics as developed by Jürgen Habermas can be understood as a dialogical continuation of the monological ethics developed by Immanuel Kant, as formulated in the categorical imperative in Grounding for the Metaphysics of Morals. Like Kant’s categorical imperative, Habermas’ principle of universalization specifies a rule for impartial testing of norms for their moral worthiness. This article will substantiate that discourse ethics develops a dialogical version of the categorical imperative, and will make this explicit. (...) This is done by presenting a new interpretation of the Kantian ethics. Renewing the traditional understanding, four instead of two or three formulations of the categorical imperative are identified. Finally it is shown how this interpretation relates to Jürgen Habermas’ discourse ethics. This analysis shows that one must specify which formulation of the categorical imperative one is talking about when discussing it. (shrink)

Habermas's transcendentalism in Knowledge and Human Interests ( KHI) deserves to be reappraised for a number of reasons. Prevailing conceptions of strong transcendental arguments, which inform many of his critics, cannot be sustained. The analytic reception of Kant suggests a more modest role for them that is remarkably similar to Habermas's claims for the paradigm of rational reconstruction. Hence a reinterpretation of transcendentalism provides a new basis for establishing a continuity between his early and later work. Habermas's underlying argument structure (...) owes much, albeit unconsciously, to Kant's concept of a regulative idea. Only the "as if" status of regulative ideas allows one to make sense of the metacritical structure of KHI and Habermas's transcendental arguments emerge as deeply hermeneutic in character rather than logical in any formal sense. This book contains 20 essays tracing the work of David Zarefsky, a leading North American scholar of argumentation from a rhetorical perspective. The essays cohere around 4 general themes: objectives for studying argumentation rhetorically, approaches to rhetorical study of argumentation, patterns and schemes of rhetorical argumentation, and case studies illustrating the potential of studying argumentation rhetorically. These articles are drawn from across Zarefsky’s 45-year career. Many of these articles originally appeared in publications that are difficult to access today, and this (...) collection brings the reader up to date on the topic. Zarefsky’s scholarship focuses on the role of language in political argumentation, the ways in which argumentation creates public knowledge and belief, the influence of framing and context on what is said and understood, the deployment of particular patterns and schemes of argumentation in public reasoning, and the influence of debate on politics and governance. All these topics are addressed in this book. Each of the conceptual essays includes brief application to specific cases, and five extended case studies are also presented in this volume. The case studies cover different themes: two explore famous political debates, the third focuses on presidential rhetoric across the course of United States history, the fourth on the arguments for liberalism at a time of political polarization, and the fifth on the contemporary effort to engage the United States with the Muslim world. This book is of interest to scholars in the fields of philosophy, logic, law, philosophy of law, and legal history. In political science the method is of particular interest because of its ambition to bridge the gap between empirical and normative approaches. In this article the author traces Habermas’s interest in rational reconstruction by going back to his writings on theory and practice and subsequently shows what the method’s main principles (...) are. He then specifies how this methodological conception is used in Habermas’s political theory. Finally, the introduction of an empirical design allows the author to discuss one of the fundamental tensions in Habermas’s approach: the hypotheses arrived at through rational reconstruction are empirical hypotheses but cannot be tested by empirical means. Naturalists seek continuity between epistemology and science. Critics argue this illegitimately expands science into epistemology and commits the fallacy of scientism. Must naturalists commit this fallacy? I defend a conception of naturalized epistemology which upholds the non-identity of epistemic ends, norms, and concepts with scientific evidential ends, norms, and concepts. I argue it enables naturalists to avoid three leading scientistic fallacies: dogmatism, one dimensionalism, and granting science an epistemic monopoly.

This paper is predicated on the understanding that clinical encounters between clinicians and patients should be seen primarily as inter-relations among persons and, as such, are necessarily moral encounters. It aims to relocate the discussion to be had in challenging medical decision-making situations, including, for example, as the end of life comes into view, onto a more robust moral philosophical footing than is currently commonplace. In our contemporary era, those making moral decisions must be cognizant of the existence of perspectives (...) other than their own, and be attuned to the demands of inter-subjectivity. Applicable to clinical practice, we propose and justify a Habermasian approach as one useful means of achieving what can be described as dialogic consensus. The Habermasian approach builds around, first, his discourse theory of morality as universalizable to all and, second, communicative action as a cooperative search for truth. It is a concrete way to ground the discourse which must be held in complex medical decision-making situations, in its actual reality. Considerations about the theoretical underpinnings of the application of dialogic consensus to clinical practice, and potential difficulties, are explored. (shrink)

What can rhetoric tell us about good arguments? The answer depends on what we mean by “good argument” and on how we conceive rhetoric. In this article I examine and further develop Jürgen Habermas’s argumentation theory as an answer to the question—or as I explain, an expanded version of that question. Habermas places his theory in the family of normative approaches that recognize (at least) three evaluative perspectives on all argument making: logic, dialectic, and rhetoric, which proponents loosely align with (...) the three dimensions of product, procedure, and process, respectively (cf. The aim of this paper is to introduce a correction into the notion of self-directed adult learning by way of conjoining it with philosophically elaborated notions of autonomy, self-reflectiveness, and maturity. The basic premise of this intervention is that in andragogical theorizing, learners’ self-directedness ought not to be thought as obvious and thus beyond question. Since adult selves are not transparent but socially, culturally, and discoursively constructed, adult educators are encouraged to think of themselves as facilitators of adult learners’ self-awareness (...) and self-directedness in their learning processes. Adult learners need to be assisted in developing critical skills that can be used to eliminate distortions in their perception of social reality, in understanding their own personalities, their needs and decisions concerning continuing education. The problematization of the concept of human autonomy amid external influences, is first discussed in Immanuel Kant’s idea of maturity as an ability to use one’s understanding without guidance from another. I then turn to Habermas’s philosophy of communicative action and three knowledge-constitutive interests where the human interest in emancipation comes to the fore. Its significance for critical adult learning is further emphasized in line with Stephen Brookfield’s and Jack Mezirow’s association of self-directed learning with empowerment, understood as freeing consciousness from its dependence on hypostatized powers. Drawing on Foucault’s work, I argue that attaining the state of autonomy requires practice in “the care for oneself” which amounts to the lifelong endeavor to create and govern oneself and to learn how not to be governed. The agenda for adult education for citizenship opted for in this paper attributes essential significance to learnable skills of critical reasoning, deliberation, and self-reflectiveness which all operate within three proposed dimensions of adult education: experiential learning, literacy, and vocationalism. Herbert Marcuse was one of the most influential political philosophers in the 20th century. After his death, his popularity started decreasing and the philosopher somewhat sank into oblivion. This dissertation intends to investigate the Marcusean contribution to the subject of technics, so imbricated on his political philosophy, and demonstrate that it deserves reappraisal. We shall analyse the theoretical context of Marcuse’s work and put opposing stances, both technophobe and technophile, up for debate. The intent is to not only present the (...) topics that organized this discussion back in its day, but also to set Marcuse apart from such hardline approaches. We shall then elucidate the Marcusean criticism of the capitalist technological system of advanced industrial societies and present the fundamental lines of its new historical project, supported by a qualitative change made possible by the ambivalence of technics. Since, in Marcuse’s view, technics configure the basis for the organisation of the status quo, and also the basis which might modify it if duly reoriented, the ambivalent character which the philosopher identifies in technics becomes the nuclear idea in his thesis; it is the very foundation upon which he builds his philosophy of technics. The marcusean thoughtshall then be exposed to critique: we shall examine the most relevant objections raised against it, but also its most fruitful ideas. Through the contributions of Gorz and, more specifically, of Feenberg, we intend to confirm the relevance of Marcuse’s thought in the context of the hodiern technological reality. (shrink)

An anti-representationalist view of language and a deflationary view of truth, key themes in contemporary pragmatism and especially Richard Rorty, do not undermine the notion, in critical theory, of ideology as 'false consciousness'. Both Foucault and Marx were opposed to what Marxists call historical idealism and so they should be seen as objecting to forms of ideology-critique that do not sufficiently avoid such an 'Hegelian' perspective. Foucault's general views on the relations between truth and power can plausibly be construed in (...) a way that makes them compatible with a Marxian critical theory. (shrink)

According to the principles derived from his theory of discourse ethics, Habermas's model of deliberative democracy is justified only if the public is capable of making political decisions that advance the common good. Recent public‐opinion research demonstrates that the public's overwhelming ignorance of politics precludes it from having such capabilities, even if radical measures were taken to thoroughly educate the public about politics or to increase the salience of politics in their lives.

Given the prominent position Habermas' philosophy has gained, it is surprising that his method, rational reconstruction, has not caused more debate. This article clarifies what this method consists of, and shows how it is used in two of Habermas' research programs. The method is an interesting, but problematic way of confronting some of the basic epistemological questions in the social sciences. It represents an alternative to both the empirical-analytical and the hermeneutic tradition. On the basis of this methodology, Habermas' work (...) is situated between the transcendental and the empirical approach. A fundamental problem is that it remains unclear how to test the hypothesis put forward through rational reconstruction. (shrink)

Yanchar, Slife, and their colleagues have described how mainstream psychology's notion of critical thinking has largely been conceived of as “scientific analytic reasoning” or “method-centered critical thinking.” We extend here their analysis and critique, arguing that some version of the one-sided instrumentalism and confusion about tacit values that characterize scientistic approaches to inquiry also color phenomenological, critical theoretical, and social constructionist viewpoints. We suggest that hermeneutic/dialogical conceptions of inquiry, including the idea of social theory as itself a form of ethically (...) motivated human practice, give a fuller account of critical thinking in the social disciplines. The problem which motivates this paper bears on the relationship between Marxism and morality. It is not the well-established question of whether the Marxist's commitments undermine an attachment to ethical standards, but the more neglected query as to whether they allow the espousal of political ideals. The study and assessment of political ideals is pursued nowadays under the title of theory of justice, the aim of such theory being to provide a criterion for distinguishing just patterns of social organization from (...) unjust ones. The main rivals in the field represent justice respectively as legitimacy, welfare and fairness. Marxism does not put forward a distinctive conception of justice itself and the question is whether the Marxist is free to choose as he thinks fit among the candidates on offer. (shrink)

German philosopher G. W. F. Hegel problematized the term “aesthetics” in his writings on art. This article attempts to capture the tension between Hegel's theory of art and philosophy of art and its impact on the subsequent theorization of art in the twentieth century as consumer or emancipatory. Music, poetry and plastic arts seem to resonate differently with philosophers such as Plato, Aristotle, Kant, Hegel and Adorno. Plato considered music soothing to the soul. In Aristotle, one could trace the oblique (...) beginnings of the tension between a theory of art and a philosophy of art as he questioned the role of art in philosophy. While Kant's approach is more formal and deals with concepts such as beauty, sublime, genius, and the status of aesthetic objects, Hegel grapples with the rational and emotional aspects of works of art which determine whether art is free or under the thralldom of nature. Both Kant and Hegel distinguished artistic from natural beauty. Critical theorists such as Adorno were also influenced by Hegel. Adorno's analysis of concepts such as mimesis forms an important part of his critique of culture industry. Adorno was also emphatic that classical art could only exist as a product of an epoch. Yet in its dialectical form, art serves as a critique of ideology. Progressively, from the nineteenth to the twentieth century, what began as a crevice between a philosophy of art and a theory of art became a chasm. Thus, begins a contentious relationship between art as a pursuit in itself and art for consumption, that is, art as an integral aspect of consumer culture. The new phenomenon of AI art also poses interesting questions about the paradigmatic shift in dynamics between human element and technology. This article would also attempt to trace how art continues to defy reification, while in the process being consumed constantly, recreating and reinventing itself. (shrink)

The author revisits H. L. A. Hart's theory of positive law and argues for a major qualification to the thesis of the separation of law and morality based on a concept of systemic legitimacy derived from the social theory of Jurgen Habermas. He argues that standards for assessing the degree of systemic legitimacy in modern legal systems can develop through reflective exercise of “critical legality,” a concept coined to parallel Hart's “critical morality,” and an expanded understanding of the “external” and (...) “internal” perspectives on legal systems. Following Habermas, he argues that modern positive law must retain systemic legitimacy. After suggesting criteria for measuring systemic legitimacy, the author concludes that the concept provides a useful approach to contemporary problems of “lawless” regimes and “law's imperialism.”. The label ‘Frankfurt School’ became popular in the ‘positivism dispute’ in the mid-1960s, but this article shows that it is wrong to describe Jürgen Habermas as representing a ‘second generation’ of exponents of critical theory. His communication theory of society is intended not as a transformation of, but as an alternative to, the older tradition of thought represented by Adorno and Horkheimer. The novel and innovative character of Habermas’s approach is demonstrated in relation to three thematic complexes: (1) the public (...) sphere and language; (2) democracy and the constitutional state; and (3) system and lifeworld as categories for a theory of modernity. Debates between Habermas and the poststructuralists - specifically, Derrida, Foucault and Lyotard - over the nature of critiques of Enlightenment rationality and modernity are investigated in order to argue for an agenda for critical theory beyond the 'French Fries and the Frankfurter'.1 Part I interrogates key elements of Habermas' theory of communicative rationality in his reconstruction of Enlightenment modernity and his critique of the poststructuralists. This orients the discussion toward an evaluation of Habermas' neo-Kantianism, theory of language (discourse ethics), and (...) the 'critique' he employs in his bid to defend and complete the project of modernity. Reviews of business ethics usually differentiate the field in terms of prescription as opposed to description: the application of normative ethical theory verses empirical analysis. Despite recent departures from this dualism, through the elaboration of what has been called postmodern business ethics, the metatheoretical basis of this (increasing) pluralism of business ethics remains opaque. This paper attempts to provide some reflexive clarification and, using codes of ethics as an example, to show that the diversity of business ethics is neither chaotic (...) nor haphazard. It explores how variable metatheoretical assumptions about the epistemic status of ethical and social scientific knowledge systematically lead to the constitution of four distinct modes of engagement in business ethics: prescriptive ethics; descriptive ethics; postmodern ethics; and critical ethics. This diversity is illustrated, with examples from the relevant literatures, in terms of variation in: the aims of business ethics; its organisational focus; the role of the business ethicist; how corporate codes of ethics are construed; the internal contradictions and tensions that arise. We conclude by examining the pre-paradigmatic status of these four modes of engagement and speculating about their future. (shrink)

The question of truth is central to current discussions in both of the major contemporary styles of philosophizing. In the Anglo-American linguistic and empiricist tradition there is a lively response (some might say backlash) to apparent difficulties caused by recent recognition of theory change and meaning variance in science. And within the Continental hermeneutio tradition there is raised the central question of the truth status of interpretations in the cultural sciences where these appear not to be subject to the criteria (...) of empirical science. Let me say straight away that I believe that the almost universal dependence on versions of the correspondence theory of truth among analytical philosophers will prove seriously inadequate to both forms of the epistemological problem, and that we have to face here a deep challenge to many entrenched assumptions of empiricism — assumptions that are too infrequently brought to the light of day in these discussions.2.
