Source incompatibilism is an increasingly popular version of incompatibilism about determinism and moral responsibility. However, many self-described source incompatibilists formulate the thesis differently, resulting in conceptual confusion that can obscure the relationship between source incompatibilism and other views in the neighborhood. In this paper I canvas various formulations of the thesis in the literature and argue in favor of one as the least likely to lead to conceptual confusion. It turns out that accepting my formulation has some surprising taxonomical consequences.

I’ve been told that in the good old days of the 1970s, when Quine’s desert landscapes were regarded as ideal real estate and David Lewis and John Rawls had not yet left a legion of influential students rewriting the terrain of metaphysics and ethics respectively, compatibilism was still compatibilism about free will. And, of course, incompatibilism was still incompatibilism about free will. That is, compatibilism was the view that free will was compatible with determinism. Incompatibilism was the view that free (...) will was incompatible with determinism.1 What philosophers argued about was whether free will was compatible with determinism. Mostly, this was an argument about how to understand claims that one could do otherwise. You needn’t have bothered to talk about moral responsibility, because it was just obvious that you couldn’t have moral responsibility without free will. The literature was a temple of clarity. Then, somehow, things began to go horribly wrong. To be sure, there had been some activity in the 1960s that would have struck some observers as ominous. Still, it was not until the 1980s that those initial warning signs gave way to real trouble. The meanings of terms twisted. (shrink)

In this paper we argue that defenders of Frankfurt-style counterexamples to the Principle of Alternative Possibilities do not need to construct a metaphysically possible scenario in which an agent is morally responsible despite lacking the ability to do otherwise. Rather, there is a weaker (but equally legitimate) sense in which Frankfurt-style counterexamples can succeed. All that's needed is the claim that the ability to do otherwise is no part of what grounds moral responsibility, when the agent is indeed morally responsible.

In three experiments we studied lay observers’ attributions of responsibility for an antisocial act (homicide). We systematically varied both the degree to which the action was coerced by external circumstances and the degree to which the actor endorsed and accepted ownership of the act, a psychological state that philosophers have termed ‘identification’. Our findings with respect to identification were highly consistent. The more an actor was identified with an action, the more likely observers were to assign responsibility to the actor, (...) even when the action was performed under constraints so powerful that no other behavioral option was available. Our findings indicate that social cognition involving assignment of responsibility for an action is a more complex process than previous research has indicated. It would appear that laypersons’ judgments of moral responsibility may, in some circumstances, accord with philosophical views in which freedom and determinism are regarded to be compatible. In this article we survey six recent developments in the philosophical literature on free will and moral responsibility: (1) Harry Frankfurt's argument that moral responsibility does not require the freedom to do otherwise; (2) the heightened focus upon the source of free actions; (3) the debate over whether moral responsibility is an essentially historical concept; (4) recent compatibilist attempts to resurrect the thesis that moral responsibility requires the freedom to do otherwise; (5) the role of the control condition in free (...) will and moral responsibility, and finally (6) the debate centering on luck. Two intuitions lie at the heart of our conception of free will. One intuition locates free will in our ability to deliberate effectively and control our actions accordingly: the ‘Deliberation and Control’ (DC) condition. The other intuition is that free will requires the existence of alternative possibilities for choice: the AP condition. These intuitions seem to conflict when, for instance, we deliberate well to decide what to do, and we do not want it to be possible to act in some (...) other way. I suggest that intuitions about the AP condition arise when we face ‘close calls,’ situations in which, after deliberating, we still do not know what we really want to do. Indeed, several incompatibilists suggest such close calls are necessary for free will. I challenge this suggestion by describing a ‘confident agent’ who, after deliberating, always feels confident about what to do (and can then control her actions accordingly). Because she maximally satisfies the DC condition, she does not face close calls, and the intuition that the AP condition is essential for free will does not seem to apply to her. I conclude that intuitions about the importance of the AP condition rest on our experiences of close calls and arise precisely to the extent that our deliberations fail to arrive at a clear decision. I then raise and respond to several objections to this thought experiment and its relevance to the free will debate. (shrink)

Galen Strawson has published several versions of an argument to the effect that moral responsibility is impossible, whether determinism is true or not. Few philosophers have been persuaded by the argument, which Strawson remarks is often dismissed “as wrong, or irrelevant, or fatuous, or too rapid, or an expression of metaphysical megalomania.” I offer here a two-part explanation of why Strawson’s argument has impressed so few. First, as he usually states it, the argument is lacking at least one key premise. (...) The premise in question concerns the very point on which Strawson and many of his contemporary opponents disagree. Strawson will persuade these opponents only when he convinces them of the truth of this crucial premise. Second, Strawson employs a striking conception of responsibility that has not generally been remarked upon. Many might accept that responsibility so conceived is impossible. But there is very different conception of responsibility that appears of great importance to us. To be thoroughly convincing, Strawson will have to show either that this second conception is inadequate or that his argument goes through even given this alternative conception. (shrink)

Whatever else a theory of impeccability assumes about the moral life of heavenly agents, it seems to imply something about the type of actions possible for such agents, along with the quality of their moral characters. Regarding these characters, there are many that have argued impeccable and heavenly agents must also be perfectly virtuous agents. Michael Slote has recently argued, however, that perfect virtue is impossible. Assuming Slote’s argument is successful, a theory of impeccability that relies on the possibility of (...) perfect virtue would be greatly harmed, even to the point of incoherence. My intent here is to defend the coherence of the doctrine of impeccability, at least as it applies to the moral life of heavenly agents. (shrink)

In the early 1980’s van Inwagen presented the Direct Argument for the incompatibility of determinism with moral responsibility. In the course of the ensuing debate, Fischer, McKenna and Loewenstein have replied, each in their own way, that versions of the Direct Argument do not pose even a prima facie threat to compatibilism. Their grounds were that versions of the Direct Argument all use the “Transfer NR” inference rule in a dialectically problematic way. I rebut these replies here. By so doing, (...) Kant holds that the applicability of the moral ‘ought’ depends on a kind of agent-causal freedom that is incompatible with the deterministic structure of phenomenal nature. I argue that Kant understands this determinism to threaten not just morality but the very possibility of our status as rational beings. Rational beings exemplify “cognitive control” in all of their actions, including not just rational willing and the formation of doxastic attitudes, but also more basic cognitive acts such as judging, conceptualizing, and synthesizing.

This thesis investigates the conceptual relationship between laws of nature and free will. In order to clarify the discussion, I begin by distinguishing several questions with respect to the nature of a law: i) do the laws of nature cover everything that happens? ii) are they deterministic? iii) can there be exceptions to universal and deterministic laws? iv) do the laws of nature govern everything in the world? In order to answer these questions I look at three widely endorsed accounts (...) of laws: "Humean" regularity accounts, laws as relations among universals, and the dispositional essentialist account. I argue that there is nothing in the very nature of a law - in any of the accounts surveyed - that implies a positive answer to questions (i) and (ii). I show that this has important consequences for the free will problem. I then turn to the compatibility of free will and determinism. I focus on the Humean view and the dispositional essentialist account of laws. And the bulk of this discussion concerns the consequence argument, especially the question of whether the laws of nature are "up to us". I show that, on the dispositional conception of laws, there is no sense in which the laws of nature are up to us, contrary to the Humean view. However, this does not mean that there is no room for free will on the dispositional account. I argue that free will requires the laws of nature to be limited in scope, rather than being indeterministic. I conclude by showing that this allows one to resist the claim that indeterminism rules out free will. (shrink)

What are the freedom-relevant conditions necessary for someone to be a morally responsible person? I examine several key authors beginning with Harry Frankfurt that have contributed to this debate in recent years, and then look back to the writings or Søren Kierkegaard to provide a solution to the debate. In this project I investigate the claims of semi-compatibilism and argue that while its proponents have identified a fundamental question concerning free will and moral responsibility—namely, that the agential properties necessary for (...) moral responsibility ascriptions are found in scenarios where the agent acts on her own as opposed to her action resulting from freedom undermining external causes such as manipulation, phobias, etc.—they have failed to show that the freedom-relevant agential properties identified in those actual-sequence scenarios are compatible with causal determinism. My argument is that only a voluntarist-libertarian theory can adequately account for the kinds of cases that the semicompatibilist identify. I argue that there are three freedom-relevant conditions necessary for someone to be a morally responsible person: a hierarchical understanding of human desires [specifically and mental states generally], an incompatibilist (non-deterministic) understanding of human action, and a historical understanding of character development. The ability to reflect critically about one’s own desires and emotions, and thus to have a kind of self-knowledge and understanding with regard to the springs of one’s own actions, is required to make it possible for the agent to be the “source” of her own actions and character. The non-deterministic understanding of human action is needed for a similar reason: if determinism is true, then every action a person performs can be ultimately traced to and exhaustively explained in terms of factors outside the agent’s control, thus making the agent’s responsibility for his actions an illusion. And finally,human nature must be such that, over time, one’s choices leave a dispositional residue self-understanding and motivation in the person’s self, out of which, in mature understanding and motivation, the person acts as a fully responsible agent. I also now refer to a manipulation argument which has a generalization step that concludes to impossibilism and an explanation step which proposes an explanation for the impossibility of free will as a "Master Manipulation Argument" (examples of master manipulation arguments include Mickelson 2015 and 2019). This article explores the conceptual connections between free action and action for which the agent is morally responsible. Questions addressed include the following. Can agents who are never morally responsible for anything sometimes act freely? Can agents who never act freely be morally responsible for some of their actions? Various compatibilist and incompatibilist responses to these questions are discussed, as is the control over their behavior that ordinary agents attribute to themselves.

There is a new objection to the Consequence Argument for incompatibilism. I argue that the objection is more wide-ranging than originally thought. In particular: if it tells against the Consequence Argument, it tells against other arguments for incompatibilism too. I survey a few ways of dealing with this objection and show the costs of each. I then present an argument for incompatibilism that is immune to the objection and that enjoys other advantages.

The Direct Argument for the incompatibility of moral responsibility and determinism is designed to side-step complaints given by compatibilist critiques of the so-called Transfer Argument. I argue that while it represents an improvement over the Transfer Argument, it loses some of its plausibility when we reflect on some metalogical issues about normal modal modeling and the semantics of natural language. More specifically, the crucial principle on which the Direct Argument depends appears doubtful where context plays a role in evaluation of (...) normative claims. (shrink)

Peter van Inwagen has developed two highly influential strategies for establishing incompatibilism about causal determinism and moral responsibility. These have come to be known as ‘the Direct Argument’ and ‘the Indirect Argument,’ respectively. In recent years, the two arguments have attracted closely related criticisms. In each case, it is claimed, the argument does not provide a fully general defense of the incompatibilist’s conclusion. While the critics are right to notice these arguments’ limitations, they have not made it clear what the (...) problem with the arguments is supposed to be. I suggest three possibilities, arguing that none proves to be well founded. I conclude that the scope of these arguments is fully adequate for their defenders’ purposes. (shrink)

In this paper, I distinguish causal from logical versions of the direct argument for incompatibilism. I argue that, contrary to appearances, causal versions are better equipped to withstand an important recent challenge to the direct-argument strategy. The challenge involves arguing that support for the argument’s pivotal inference principle falls short just when it is needed most, namely when a deterministic series runs through an agent’s unimpaired deliberations. I then argue that, while there are limits to what causal versions can accomplish, (...) they can be used to buttress the ultimacy argument, another important argument for incompatibilism. (shrink)

Some scientists have reported what they regard as evidence of indeterministic brain processes that influence behavior (Brembs 2011, Maye et al. 2007). How do these reports bear on the positive side of libertarianism about free will? That is an approximation of my guiding question in this article. I make the question more precise in section 1, in light of some conceptual and scientific background. In the remainder of the article, I seek—and eventually offer—an answer. Kadri Vihvelin has recently argued that between compatibilists and incompatibilists, the incompatibilists have a greater dialectical burden than compatibilists. According to her, both must show that free will is possible, but beyond this the incompatibilists must also show that no deterministic worlds are free will worlds. Thus, according to Vihvelin, so long as it is established that free will is possible, all the compatibilist must do is show that the incompatibilists' arguments are ineffective. I resist Vihvelin's assessment of the dialectical (...) burdens of compatibilists and incompatibilists, as well as her assessment of the best arguments for incompatibilism. (shrink)

Peter van Inwagen contends that nonresponsibility transfers across deterministic relations. Suppose it does. If the facts of the past and the laws of nature entail every truth about what one does, and no one is even in part morally responsible for the past and the laws, then no one is even in part morally responsible for what one does. This argument, the Direct Argument, has drawn various critics, who have attempted to produce counterexamples to its core inference principle. This article (...) considers two notable efforts, one by John Martin Fischer and Mark Ravizza and another by David Widerker. It shows that neither is sufficient to reject the Direct Argument. The article then proceeds to challenge the argument in a novel fashion. Van Inwagen has not given us good reason to think that the principle in question has an adequate anchor in our inferential practices, especially in light of the dialectical context with the compatibilist. Hence, it is not the compatibilists' burden to produce counterexamples to it. Rather, it is van Inwagen's burden to produce relevant confirming instances of it. (shrink)

Harry Frankfurt dramatically shaped the debates over freedom and responsibility by arguing that the sort of freedom germane to responsibility does not involve the freedom to do otherwise. His argument turns upon an example meant to disprove the Principle of Alternative Possibilities: A person is morally responsible for what she has done only if she could have done otherwise. Debate over Frankfurt's argument has turned almost exclusively on the success of the example meant to defeat it. But there is more (...) to Frankfurt's argument than the example in question, and this is not widely recognized. Inattention to these other aspects of Frankfurt's argument has distorted the force of it. In this paper I shall explore avenues for both refuting and advancing Frankfurt's argument that look beyond the examples. These further considerations invite us to think in broader terms about moral responsibility's nature and the sort of freedom required for it. (shrink)

Numerous philosophers in recent decades have argued that a partial explanation for how the blessed in heaven are impeccable while remaining free and responsible is that they have cultivated or developed such a virtuous character prior to heaven that once in heaven they are incapable of acting contrary to their virtuously cultivated characters. Further, because the agents are at least partially responsible for the construction of their characters, they can be considered free and responsible with regard to the choices or (...) actions such virtuous characters allow. In what follows I will argue that the impeccability of the blessed is not achieved through a character-development process performed by the blessed themselves. (shrink)

The Direct Argument for the incompatibility of determinism and moral responsibility is so christened because this argument allegedly circumvents any appeal to the principle of alternate possibilities – a person is morally responsible for doing something only if he could have avoided doing it – to secure incompatibilism. In this paper, I first summarize Peter van Inwagen’s version of the Direct Argument. I then comment on David Widerker’s recent responses to the argument. Arguments for the incompatibility of determinism and moral responsibility sometimes make use of various transfer of non-responsibility principles. These principles purport to specify conditions in which lack of moral responsibility is transmitted to the consequences of things for which people are not morally responsible. In this paper, after developing what I take to be the most serious objections to extant principles of this sort, I identify and defend a new transfer of non-responsibility principle that is immune to these and other (...) objections. This new principle says, roughly, that if you are not morally responsible for any of the circumstances that led to a particular outcome, and if you are not morally responsible for those circumstances leading to that outcome, then you are not morally responsible for the outcome either. After defending this principle against a number of objections, I use it to argue for the conclusion that no one is even partly morally responsible for anything, if determinism is true. (shrink)

The direct argument is among the most prominent arguments for the incompatibility of determinism and moral responsibility. Some critics of the argument have accused it, or certain defenses of its central premise, of begging the question. This article responds to that accusation.

This is the introduction to a volume of new essays in the metaphysics of moral responsibility by John Martin Fischer, Carl Ginet, Ishtiyaque Haji, Alfred R. Mele, Derk Pereboom, Paul Russell, and Peter van Inwagen. I provide some background for the essays, cover the main debates in the metaphysics of moral responsibility, and emphasize some of the authors' contributions to this area of philosophy.

Traditional theorists about free will and moral responsibility endorse the principle of alternative possibilities (PAP): an agent is morally responsible for an action that she performs only if she can do or could have done otherwise. According to source theorists, PAP is false and an agent is morally responsible for her action only if she is the source of that action. Source incompatibilists accept the source theory but also endorse INC: if determinism is true, then no one is morally responsible (...) for any action. This paper is a critique of a kind of source incompatibilism, namely, direct source incompatibilism. Direct source incompatibilists reject PAP on the basis of Frankfurt-style examples. Since PAP is one of two premises in the traditional argument for INC, direct source incompatibilists opt for a version of the direct argument, which argues for INC with the aid of some non-responsibility transfer principle. I demonstrate that this option is not available, for there is a tension between the following two claims. (shrink)

Traditionally, incompatibilists about moral responsibility and determinism claim that we cannot be morally responsible unless we could have done otherwise and that we cannot do otherwise if we are determined. The Direct Argument for incompatibilism supposedly offers its defenders a dialectical advantage over this traditional approach insofar as it does not appear to rely on either of these controversial claims. Recently, though, David Widerker has argued against this supposition and urged that it is time to say farewell to the Direct (...) Argument. I examine two of Widerker’s criticisms and argue that, while they are not compelling, a revised version of one does show that supporters of the Direct Argument will very likely need to deny that an agent could do otherwise if determinism is true. I conclude that, nevertheless, the Direct Argument may still have considerable dialectical appeal and that neither of Widerker’s criticisms should lead us to say goodbye to it just yet. (shrink)

Traditionally, incompatibilism has rested on two theses. First, the familiar Principle of Alternative Possibilities says that we cannot be morally responsible for what we do unless we could have done otherwise. Accepting this principle, incompatibilists have then argued that there is no room for such alternative possibilities in a deterministic world.
