The paper investigates phenomenology’s possibilities to describe, reflect and critically analyse political and legal orders. It presents a “toolbox” of methodological reflections, tools and topics, by relating to the classics of the tradition and to the emerging movement of “critical phenomenology,” as well as by touching upon current issues such as experiences of rightlessness, experiences in the digital lifeworld, and experiences of the public sphere. It is argued that phenomenology provides us with a dynamic methodological framework that emphasizes correlational, co-constitutional, (...) and interrelational structures, and thus pays attention to modes of givenness, the making and unmaking of “world,” and, thereby, the inter/subjective, affective, and bodily constitution of meaning. In the case of political and legal orders, questions of power, exclusion, and normativity are central issues. By looking at “best practice” models such as Hannah Arendt’s analyses, the paper points out an analytical tool and flexible framework of “spaces of meaning” that phenomenologists can use and modify as they go along. In the current debates on political and legal issues, the author sees the main task of phenomenology to reclaim experience as world-building and world-opening, also in a normative sense, and to demonstrate how structures and orders are lived while they condition and form spaces of meaning. If we want to understand, criticize, act, or change something, this subjective and intersubjective perspective will remain indispensable. (shrink)

Wissenschaftsfreiheit wird vorherrschend als Freiheit der Wissenschaft von politischer Einmischung verstanden. Der Artikel kritisiert dieses negative Verständnis von Wissenschaftsfreiheit anhand einer Analyse seines prominentesten Vertreters, dem Netzwerk Wissenschaftsfreiheit, das damit eine Politisierung einseitig den Vertreter*innen gesellschaftskritischer Ansätze zuschreibt, während es die eigene Position als ‚rein wissenschaftlich‘ und politisch neutral dargestellt. Demgegenüber schlägt der Artikel ein kritisches Verständnis von Wissenschaftsfreiheit vor, das seine Politizität reflektiert. Ausgehend von der Analyse, dass starre Macht- und Privilegienstrukturen das zentrale Hindernis für die gemeinsame Arbeit an (...) wissenschaftlicher Objektivität sind, geht es beim kritischen Begriff der Wissenschaftsfreiheit um die Reflexion und Transformation des Verhältnisses von Wissenschaft und Politik. Dabei steht die Diversifizierung von Zugangschancen und Standpunkten innerhalb der Wissenschaft im Mittelpunkt – also die Neuverteilung von Macht und Privilegien. Der Artikel entwickelt dieses Verständnis aus einer Diskussion des Verhältnisses von Wissenschaft und Politik in zwei philosophischen Begründungsmöglichkeiten der Wissenschaftsfreiheit und aus einer Rekonstruktion der kritischen politischen Theorie, insbesondere der foucaultschen Machttheorie und der feministischen Standpunkttheorie. Er zeigt auf dieser Grundlage, dass drei verschiedene Arten der Diversifizierung der Wissenschaft – intern, extern-institutionell und extern-aktivistisch –, die vom vor dem Hintergrund des negativen Begriffs als Einschränkung der Wissenschaftsfreiheit verstanden werden, tatsächlich zu ihrer Verbesserung beitragen. Philosophy & Social Criticism, Volume 48, Issue 6, Page 904-933, July 2022. In this article, I reconstruct Étienne Balibar’s work against the background of the debate on modern universal citizenship. I argue that universal citizenship is neither fundamentally emancipatory nor fundamentally oppressive but is rather both. In order to defend this position, I build on Balibar’s concept of the “citizen subject.” First, I parse this concept, showing how it allows us to think about the contradictions of modern universal citizenship. In (...) the second section, I elucidate its temporal logic and show how it undermines the telos of modern universal citizenship. In sections three to five, I show how citizenship’s universalism clarifies both its oppressive and its emancipatory thrust. The dialectic of universal citizenship, I argue, unfolds as a conflict between and within political universals. In the conclusion, I will tie up these different strands and end with some reflections on the conditions of possibility of this dialectic. (shrink)

In der sozialphilosophischen Debatte um Freiheit bei Foucault wird das ‚Freiheitsproblem‘ verhandelt: Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Die Arbeit unterscheidet systematisch vier verschiedene Interpretationsstrategien von Foucaults Werk, die es als kohärente sozialphilosophische Theorie konstruieren und dabei das Freiheitsproblem lösen sollen; sie rekonstruiert die Arbeiten von exemplarischen Vertreter_innen dieser Strategien: 1. Foucault ist kohärent (Paul Patton), 2. Foucault korrigiert sich (Thomas Lemke), 3. Foucault kritisiert kohärent (Martin Saar), 4. Foucault ist nicht (...) genug (Amy Allen). Das erste Ziel der Arbeit ist, die Debatte und die in ihr verhandelten Probleme und Begriffe durch die systematische Rekonstruktion zu differenzieren und klarer zu fassen. Dafür werden einige neue systematische Unterscheidungen entwickelt: u.a. das Freiheitsproblem der Machtdetermination im Gegensatz zum Freiheitproblem der Subjektivierung, Freiheit als Anders-handeln-Können im Gegensatz zu Freiheit als Kritik, verschiedene Modalitäten dieser Freiheitsbegriffe und eine Foucault-Lesart der Regierungstranszendenz im Gegensatz zu einer Lesart der radikalen Immanenz. Das zweite Ziel der Arbeit ist die Entwicklung einer neuen These zur Freiheit im Rahmen einer Subjektivierungstheorie durch die interne Kritik der vier Interpretationsstrategien auf Grundlage der dort entwickelten Differenzierungen. Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung ‒ kurz: Freiheit als Kritik ‒ kann verstanden werden als das Resultat von freiheitlicher Subjektivierung, deren gesellschaftlicher Ort politische Institutionen sind, die im Rahmen einer postfundamentalen, pluralen und liberalen politischen Theorie bestimmt werden können. Drittens verfolgt die Arbeit das Ziel, durch den Begriff der Freiheit als Kritik die allgemeine sozialphilosophische Debatte um Freiheitsbegriffe zu erweitern und ihn als einen Kandidaten neben der negativen, reflexiven und sozialen Freiheit zu präsentieren, der einerseits plausible Einsichten dieser drei Ansätze aufnimmt und andererseits ihre blinden Flecken korrigiert. In response to critiques of rights as moralistic and depoliticising, a literature on the political nature and contestability of rights has emerged. In this view, rights are not merely formal, liberal and moralistic imperatives, but can also be invoked by the excluded in a struggle against domination. This article examines the limits to this practice of rights-claiming and its implication in forms of domination. It does this by returning to Marx’s blueprint for the critique of subjective rights. This engagement with (...) Marx will, however, take a particular form. I will read Marx first through the eyes of Claude Lefort and thereafter against Lefort. The latter’s critique of Marx still constitutes the strongest case against the dismissal of subjective rights. Introducing a reading of Lefort into the argument allows us to discover what is dead and what is well alive in the Marxist theory of rights. What is dead, I will argue, is Marx’s early conception of subjective rights as ideology and illusion. However, the more mature Marx developed a theory and critique of the legal form that is able to explain why the politics of rights—despite its undeniable advances—has not been able to overcome certain forms of domination. Right-wing intellectuals often invoke Nietzsche's concept of slave morality to underpin their criticism of 'political correctness' ('PC'). This interconnection of Nietzsche's slave morality and 'PC' criticism is correct, as a systematic analysis of their common elements shows, which leads to a new description of 'PC' criticism as a defense of privilege. In contrast to the right-wing Nietzschean 'PC' critique, the left-wing Nietzschean concept of a privilege-critical ‘political judgement' understands politics as a struggle for power, in which the space of the (...) political and related discourses are always already regulated and determine the conditions under which resources and privileges are distributed. Therefore, it is appropriate for an emancipatory position to critically question the established norms and to support political projects that aim to rewrite them. Because 'PC', as emancipative political judgement, dismantles privileges, its restricting of the privileged is not a side effect to be avoided but one of its reasonable core effects. Left-wing Nietzscheanism helps to avoid being surprised by right-wing aggression and to counter it vigorously by setting strict political norms. (shrink)

In this paper, I discuss the possibility of reading the description of promise presented by Reinach in The Apriori Foundations of the Civil Law under the light of Husserl’s Ideas I. In order to present my argument, first, I briefly present the phenomenological method proposed by Husserl in Ideas I highlighting eidetic reduction. Second, I present the Reinachian description of social acts emphasizing the act of promising. Third, and finally, I try to demonstrate that the Reinachian description of the social (...) act of promising is the description of a universal and necessary relation, a synthetic and a priori statement and corresponds to the idea of promise. PrEP (Pre-Exposure Prophylaxis) is a relatively new drug-based HIV prevention technique and an important means to lower the HIV risk of gay men who are especially vulnerable to HIV. From the perspective of biopolitics, PrEP inscribes itself in a larger trend of medicalization and the rise of pharmapower. This article reconstructs and evaluates contemporary literature on biopolitical theory as it applies to PrEP, by bringing it in a dialogue with a mapping of the political debate on PrEP. As PrEP changes (...) sexual norms and subjectification, for example condom use and its meaning for gay subjectivity, it is highly contested. The article shows that the debate on PrEP can be best described with the concepts ‘sexual-somatic ethics’ and ‘democratic biopolitics’, which I develop based on the biopolitical approach of Nikolas Rose and Paul Rabinow. In contrast, interpretations of PrEP which are following governmentality studies or Italian Theory amount to either farfetched or trivial positions on PrEP, when seen in light of the political debate. Furthermore, the article is a contribution to the scholarship on gay subjectivity, highlighting how homophobia and homonormativity haunts gay sex even in liberal environments, and how PrEP can serve as an entry point for the destigmatization of gay sexuality and transformation of gay subjectivity. ‘Biopolitical democratization’ entails making explicit how medical technology and health care relates to sexual subjectification and ethics, to strengthen the voice of (potential) PrEP users in health politics, and to renegotiate the profit and power of Big Pharma. Zusammenfassung Der Beitrag befasst sich mit der Sinnsuche und -differenzierung des Boxens als einem Element der normativen Ordnung des modernen Sports. Auf der Basis einer gesellschaftstheoretischen Analyse wird das moderne Boxen vom traditionellen Duellwesen unterschieden, um die spezifische Modernität des Boxens herauszuarbeiten. Die Modernität des modernen Boxens liegt in der politischen Vermitteltheit seiner sozialen Verhältnisse, die durch eine triadische Konstellation des Vergleichs gleicher Leistungen charakterisiert sind. Demgegenüber gilt das Duell als Ausdruck einer Gesellschaftsformation, die im Medium der Ehre an soziale (...) Ungleichheit gebunden ist. Die Selbstunterscheidung vom klassischen Duell wird in der Quasi-Verfassung des modernen Boxens, den Queensberry Rules, konstitutionalisiert. Die Queensberry Rules spannen den kategorialen Raum des modernen Boxens auf, innerhalb dessen die Genese des Boxens normativ vermittelt ist. (shrink)

The connection between fear, law and the state is a topic that is given particular attention in times of social insecurity. Some approximations are explored here under the notion of fear constitutions. We are equal in fear of one another, which is why fear can be understood as a condition of modern constitutions. However, the social contract does not lead to freedom from fear, but rather fear shifts; the legal subjects remain subjects of fear, in relation to one another, but (...) in particular towards that multiple artificial person which the state comes to embody as it takes on a life of its own. The degree of fear varies with the degree of unpredictability and indeterminacy of executive action. State measures against terrorism or against the pandemic are often an unpredictable response to an unknown danger and are therefore at the same time both an expression of fear and its trigger. It would be helpful if there was a clear distinction between sensible and unreasonable, functional and dysfunctional forms of fear. Freud tried to provide criteria with his concept of neurotic fear, a concept that has been taken up in political and legal philosophy. However, the concept is obscure and cannot be used without normative specifications. (shrink)

Why has the global West (North America, Europe) handled the covid-19 pandemic and the corresponding economic crisis so much worse than the global East (East Asia)? The crises demonstrate the degree to which the West is shaped by its forms of competition and the East by its forms of cooperation. In the West, we have become habitualised to American neoliberalism over the last two generations. In the East, varieties of neo-Confucianism and neo-Buddhism have been transformed into national cultures. The way (...) humans understand their position in the world intellectually and react to crises according to corresponding habit makes an effective difference. The present comparison between global East and West makes use of Hannah Arendt’s conception of politics and the shared world as well as of Helmuth Plessner’s conception of mediated immediacy in forms of modern biopower. The pandemic is a catalyst within the decline of the West and the rise of the East. (shrink)

„Kann das Anthropozän gelingen?" Der Begriff „Anthropozän" fungiert in aktuellen Debatten als Chiffre für eine mehrfache Krise. Empirisch wird der Begriff verwendet, um den von Menschen verursachten Bruch mit dem stabilen Zeitalter des Holozäns zu bezeichnen. Normativ wird er gebraucht, um zu Neuanfängen aufzufordern: beim Verständnis und bei der praktischen Ausgestaltung menschlicher Verhältnisse zur Natur. Zugleich gerät der Begriff zunehmend selbst in die Kritik: dass er mit seinem Bezug auf ‚den Menschen‘ die tatsächlichen Verantwortlichkeiten für die aktuellen Natur- und Klima-Katastrophen (...) verdecke. Der Band macht sich das Schillern des Anthropozän-Begriffs zunutze. In interdisziplinärer Perspektive – aus der Philosophie, Theologie, Geographie, sowie den Literatur-, Politik-, Sozial- und Klimawissenschaften – verbindet er kritische und affirmativ-konstruktive Debatten: Welche Menschenbilder, Motive, Macht- und Gewaltstrukturen bestimmen die gesellschaftlich vorherrschenden Naturverhältnisse? Was wären alternative Vorstellungen des menschlichen Lebens mit der Natur als Teil der Natur? Der vorliegende Text ist der Versuch einer Dekonstruktion der herrschenden ideologischen Annahmen des gegenwärtigen Corona-Diskurses. Er ist der Versuch, diese ideologischen Gedankengänge in ihrer Mangelhaftigkeit darzustellen und ihren ideologischen Charakter zu benennen, sohin der Versuch eines Nachvollzugs des herrschenden Nachdenkens über Corona. Dieses herrschende Nachdenken über Corona und dessen Fortgehen von der einen ideologischen Annahme zur nächsten können als Metamorphosen des pandemischen Bewusstseins bezeichnet werden. Seinen Ausgangspunkt nimmt das pandemische Bewusstsein bei der Diagnose des krisenhaften Charakters der gegenwärtigen Gesellschaft, dem (...) es eine „alte Normalität“ entgegenimaginiert. Hier betreibt es eine Rechtfertigung des alten, in dessen Krisencharakter jedoch nicht durchschauten, Zustandes der Gesellschaft. In Sehnsucht nach der Idylle der präpandemischen Gesellschaft entwirft es eine „solidarische“ Gemeinschaft gegen die Bedrohung durch einen äußeren Feind und konstituiert sich also negativ als homogenes Ganzes. Seine Sehnsucht wird zur Harmoniebedürftigkeit im Hier und Jetzt, die es sich durch seinen Glauben an die gute Herrschaft zu stillen weiß, wenn es sich über die Unverhältnismäßigkeit der staatlich verordneten Corona-Maßnahmen echauffiert. Dabei fühlt es sich durch den staatlichen Appell an den gesunden Menschenverstand im täglichen Umgang mit Corona bestätigt und lauscht in aufklärerischem Ethos seiner ewigen Vernunftfähigkeit. In dialektischer Akrobatik veranstaltet es das pandemische Bewusstsein, in der Isolation eine neue Form der Solidarität, das Glück im Unglück zu entdecken, ohne zu erkennen, dass es damit seine Rückkehr zum „Normalzustand“ der bürgerlichen als einer warenproduzierenden Gesellschaft vollzogen hat. Mit gutem Gewissen enthält es sich eines kritischen Urteils über die Corona-Krise und resigniert staatstreu vor der Einsicht in die Wirklichkeit. So lässt es sich gut regieren. (shrink)

En este artículo analizamos la teoría crítica de la moral de Theodor Adorno. Para ello, estudiamos la revisión adorniana de los conceptos de la moral racional en dos pasos: primero, examinando las dificultades del conocimiento práctico situado en el contexto de las condiciones culturales del capitalismo tardío; luego, por medio de una indagación de estos obstáculos desde la perspectiva de la experiencia ética, esto es, desde el impulso de solidaridad que suscita el sufrimiento ajeno. Seguidamente, presentamos lo que Adorno denomina (...) un límite ideológico de la moral para la reflexión y la práctica política orientada en un sentido emancipatorio. (shrink)

Zusammenfassung Der Beitrag will ein sportphilosophischer Beitrag zur Inklusionsdebatte sein und zugleich kenntlich machen, was es heißen kann, einen Gegenstand der Sportwissenschaft philosophisch zu verhandeln. Der Sache nach geht es primär um die Artikulation ausgewählter kategorialer Bedingungen der Möglichkeit von Inklusion, sekundär um empirische Bedingungen der konkreten Realisierungsformen von Inklusion. Die herausgestellten kategorialen Bedingungen sind dem eigentümlichen Geltungsstatus von Inklusion geschuldet, nämlich kategorisch rechtsverbindlich zu gelten, gleichwohl aber auf einer freien Entscheidung zu beruhen, insbesondere also diskutierbar sein zu müssen. Erinnert (...) wird daran, dass unterschiedliche Paradigmen von Inklusion unterschiedliche Konsequenzen für das soziale Miteinander haben, an die völkerrechtliche Verankerung des Inklusionsprinzips und an den völkerrechtlichen Status der UN-Behindertenrechtskonvention.
