This paper has two aims. The first is to describe several sources of the moral responsibility to remedy or alleviate global poverty—reasons why an agent might have such a responsibility. The second is to consider what sorts of agents bear the responsibilities associated with each source—in particular, whether they are collective agents like states, societies, or corporations, on the one hand, or individual human beings on the other. We often talk about our responsibilities to the poorest people in the world, (...) or what we owe them. So the question is who this we is. I shall argue that the answer depends on the source of the responsibility. Some responsibilities—one species of causal responsibilities—belong in the first instance to collectives, although they will also trickle down to at least some individuals within the collective. Other responsibilities—humanitarian responsibilities, and a different species of causal responsibilities—belong in the first instance to individuals, but can, I shall argue, “trickle up” to collectives of which individuals are members. Primero, se discute la estrategia argumentativa de Rawls, en la cual se opone a la idea cosmopolita de una transformación del orden internacional a partir de las exigencias de justicia económica global. Segundo, se muestra que la propuesta de justicia global planteada por Pogge es insuficiente, porque aunque formula una propuesta redistributiva global, no plantea el (...) problema de la transformación del sistema de relaciones de poder en el orden capitalista actual. En tercer lugar es presentada la propuesta de Cristina Lafont de un modelo pluralista de los derechos humanos y considerada críticamente su perspectiva de construcción de una política que se oriente a la regulación del orden económico mundial, enmarcada en un nuevo discurso de los derechos humanos. This article is focused on the consideration and critique of some of the ideas exposed by the contemporary reflection on the normative models for a new international order. First, it discuses Rawls argumentative strategies, in which it is exposed the cosmopolitan idea of the transformation of the world order, beginning from the global economic justice requirement. Second, it demonstrates that the approach of Pogge's global justice is insufficient because although he formulates a global redistributive proposal, it does not touch the problem concerning the transformation of the relational power system within the current capitalist order. Lastly, it presents Cristina Lafont's proposal for a human rights pluralist model, and considers, critically, her perspective for a regulatory-oriented world economic politics, within the new discourse on human rights. In contemporary debates about justice, political philosophers take themselves to be engaged with a subject that’s narrower than the whole of morality. Many contemporary liberals, notably John Rawls, understand this narrowness in terms of context specificity. On their view, justice is the part of morality that applies to the context of a society’s institutions, but only has indirect application to the context of citizens’ personal lives. In contrast, many value pluralists, notably G.A. Cohen, understand justice’s narrowness in terms of singularity (...) against a plural background. On their view, justice is one fundamental value amongst a plurality of fundamental values. The purpose of my thesis is to establish that the pluralist conception of justice’s narrowness is theoretically significant and true. To establish its theoretical significance, I argue that proper attention to the ways in which different understandings of narrowness inform the work of contemporary egalitarians explains a considerable amount of disagreement between them concerning the content and scope of distributive justice. On the one hand, I’ll argue that if we understand justice’s narrowness in the manner Cohen and other pluralists do, i.e., understand a conception of justice to be a conception of a particular fundamental value, then both luck-egalitarianism and the claim that justice extends to the personal context are compelling. On the other hand, I’ll argue that if we understand justice’s narrowness in a contextual manner, i.e., understand justice to comprise one or more all-things-considered principles adopted for the institutional context, then both luck-egalitarianism and the claim that justice extends to the personal context prove implausible. To establish the truth of the pluralist conception of narrowness, I argue first, that the contextual understanding is only plausible if fairness should be understood procedurally instead of substantively; and second, that substantive fairness cannot be eliminated, as specifying the content of procedural fairness requires a substantive criterion. The upshot is that justice’s narrowness is best understood in terms of singularity against a plural background, rather than in terms of context specificity. (shrink)

In a recent article Allan Buchanan and Robert Keohane defend the view that one of the necessary conditions for the legitimacy of global governance institutions such as the WTO and the IMF is that they respect basic human rights. I certainly agree that setting the minimal threshold of moral acceptability any lower would be entirely unreasonable. But, unfortunately, the view that global governance institutions have human rights obligations is far from uncontroversial. These institutions themselves go to great lengths to deny (...) such a claim. Their official stance finds strong normative support in the state-centric conception of human rights that dominates both normative debates about human rights and current human rights practice. In this article I challenge some of the normative assumptions behind the state-centric conception in order to defend a pluralist conception that ascribes human rights obligations not only to states but also to non-state actors such as global governance institutions. After briefly analyzing some of the proposals currently under discussion about how to legally entrench the obligation to respect human rights in those institutions, I will defend the feasibility of those proposals against the objection that their implementation is incompatible with the current state-system and thus it would require the creation of a world state. Democracy seems to be no longer self-evident. Colin Crouch and others describe a growing sense of alienation in politics: democratic institutions and procedures may be working properly, yet they themselves promote non-democratic values such technocracy, oligarchy, elitism. For the citizens, only an illusion of democracy persists. The article argues that the weakening of democracy in practice mirrors the vanishing of democracy in political theory and philosophy. We may face a crisis of democratic politics as a result of a crisis of (...) democratic theory. Predominant theories of democracy fail, for the most part, to adequately reflect the changing social conditions in democratic societies and to offer a conception of democratic politics that would address current legitimacy deficits. The article discusses prominent theoretical approaches and points out that all have difficulties conceptualizing possible resources for democratization adequate to contemporary issues and conditions. A new version of political theory is outlined and defended, such that builds upon a redefined notion of democratic sovereignty and communicative power, complex enough to reflect the sociological reality of today’s politics and to reach beyond the institutionalized and formalized setting of democracy. Modern democracy attempted to solve the dilemmas posed by opposing features from various traditions through two strategies: representation, which allowed it to incorporate citizens’ conflicting interests within a restricted collegiate group that permitted deliberation and agreement, on one side, and universal choice of representatives and governments for limited periods of time, on the other. Since the first decades of the 20th century, this notion of democracy within the framework of a republican constitution was opposed by another one that rejected all (...) forms of parliamentarianism, discussion and public deliberation in the name of a “democracy” based on the identity and homogeneity of a mass of people under the hegemonic leadership of a party, centered around the will and decisions of a managing elite and a charismatic leader, viewed as the sole representative of the people themselves. Both forms of democracy –strict and perverted – are being harassed by the powers unleashed by globalization and transnationalisation that are becoming alien oligarchies, opposed to the notion of citizenship and restrictive of its rights. In liberal parliamentary democracies the functional imperative issued by the financial sector is channeled through a crisis cabinet that assimilates demands and transforms them by managing an ever-changing budget whose aim is to add new sufferings to the bulk of the population that can only counteract through protest. Given the constitutional backdrop of these societies, with their deep democratic network, the gradual transformation of the European Union into a transnational arena fuelled by “a club of chiefs of state” has only made yet more patent the oligarchic turn of its post-crisis evolution. In plebiscite democracies the turn was operated through a sovereign entrenchment of the power of the oligarchy on the pretext of resistance to the pressure set by globalization. Since the onset of the 90s, Latin America as well as countries in Eastern Europe have witnessed a gradual turn toward what O’Donnell has termed “delegative democracies”, or neo-populism, according to other authors. These regimes are characterized by exalting a populist leader, upholding him as a savior who will gauge the needs and wishes of the mass of individuals without intermediaries, focusing mainly on those who feel excluded from the mainstream of institutionalized democracy. This ensures feedback to populist regimes supported by a hegemonic political party that lives on State resources and on the rampant corruption it protects in order to finance ‘clientelism’ among those excluded from the system by the policies of the State itself. This thesis in political philosophy considers justifications for a bias towards compatriots in the allocation of resources. I reject arguments in support of national partiality that appeal to the intrinsic value of the nation as well as those based on analogies between the nation and the family. Instead I offer an impartial defense of the existence of special duties towards conationals as fellow participants in a nation state, based on the account offered by Michael Blake. The use of political power (...) by the state gives rise to a greater degree of concern for the needs of compatriots than for the needs of foreigners. I extend Blake's argument by claiming the existence of a global basic structure, which is coercive in nature. This basic structure gives rise to a concern for distributive justice globally. (shrink)

In this thesis I defend the principle of global egalitarianism. According to this idea most of the existing detrimental inequalities in this world are morally objectionable. As detrimental inequalities I understand those that are not to the benefit of the worst off people and that can be non-wastefully removed. To begin with, I consider various justifications of the idea that only those detrimental inequalities that occur within one and the same state are morally objectionable. I identify Thomas Nagel’s approach as (...) the most promising defence of this traditional position. However, I also show that Nagel’s argument does not even justify the elimination of detrimental inequalities within states. A discussion of the concept of political legitimacy rather shows that egalitarian justice is not a necessary condition of the justifiability of the exercise of coercive political power. I, then, consider other, more Rawlsian approaches to the question of detrimental inequalities. These views appear more plausible than Nagel’s position and argue that egalitarian duties also arise in certain international contexts. But also these more global theories of distributive justice suffer from shortcomings. Since they make the application of duties of justice dependent on the existence of social practices they cannot adequately account for the justified interests of non-participants that are affected by these practices. The counter-intuitive implications of practice-dependent theories lead me to investigate the plausibility of a theory that does not limit justice to existing practices and that argues for the inherent value of equality. This theory is global egalitarianism. I defend global egalitarianism by debilitating three objections that opponents of this idea frequently present in the relevant literature. Finally I also address two particular objections to the idea that global egalitarian duties are institutionalizable with the help of coercive global authorities. (shrink)

Purpose: The objective of this study is to determine the importance of supplementary medical ethics course for resident physicians. In this study, we assessed the current state of their knowledge of medical ethics and aimed to improve and deepen their understanding of clinical scenarios to increase their awareness of the link between the practice of medicine and ethical issues. Methods: The course was held for groups of 10-12 people for 3 days a week for a total of 6 hours. Tests (...) given prior to and following completion of the course were used to assess the effectiveness of a medical ethics training course in which 120 resident physicians completed. The evaluation was made on the basis of the same pre-and post-tests (14 scenarios) and direct observation of participants. Result and Discussion: The average age was 28.23 ± 4.08 and 25% were female and 75% were male. Of the participants, 68.3% were training to be internists, 24.2% were training to be surgeons, and 7.5% were training in laboratory medicine. There was a significant statistical difference between the mean total scores of both tests (p=0.00). After completing the course, residents took into account the medical ethical principles while discussing ethical decisions. Conclusion: After finishing the course, participants defended their responses in regard to issues of medical ethics more carefully and articulated their thoughts more clearly. Our experience demonstrated that the trainees benefited from a structured curriculum in medical ethics. We believe that the development and implementation of our course may serve as a case study for training resident physicians in medical ethics. (shrink)

The COVID-19 global health crisis has affected numerous lives, jobs, and properties. The virus is infectious and deadly, and the most vulnerable are the poor and the elderly. Due to its contagious nature, businesses were forced to shut down causing tremendous damage to many workers. The municipality of Burauen in Leyte as well as its neighboring towns are not exempt from the virus wrath. People perished and many lost their livelihood, disabling them if not limiting their purchasing capacity for food (...) and sustenance. The Eastern Visayas State University Burauen Campus is primarily an agricultural school. With the existence and persistence of COVID-19, such campus rose to the challenge by elevating its food production with the hope of providing food security not only in the town where it is located but also to neighboring municipalities. This paper will delve into the problems and challenges the school faced, and likewise its methods and strategies to hurdle the difficulties it handled to help provide cheap but healthy agricultural products for the people. This chapter explores the different dimensions of domination, including whether it has a structural approach, its relation to race and imperialism, and how non-domination can be institutionalized and achieved at a global level.

Theorists have argued that under certain background conditions the commercial, for-profit corporation might bear responsibility to act to advance justice. However, other agents too may be responsible to take remedial action, especially when the state defaults. This raises the question of the sequence in which the agents should act. I develop a framework that offers guidance in determining when the corporation ought to intervene to advance justice. The existing literature typically identifies responsibility-bearers solely by their capacity to remedy an unjust (...) situation which I believe to be too simplistic. I introduce two additional grounds for identifying responsibility-bearers, a role-based account and participation-based account and show that this pluralist approach delivers a better account of who bears responsibility to act and when to discharge this responsibility. There are various global problems we find ourselves faced with and those problems necessitate a new kind of ethic, a global one. I will argue that while there are several ways of understanding it one is more adequate than others. That claim has implications for the kind of basis suitable for global ethic, namely that we need a political ethic, such as liberalism. I will also take up some general objections which this kind of global ethic is able to give (...) good replies. (shrink)

Thomas Pogge claims "that, by shaping and enforcing the social conditions that foreseeably and avoidably cause the monumental suffering of global poverty, we are harming the global poor ... or, to put it more descriptively, we are active participants in the largest, though not the gravest, crime against humanity ever committed." In other words, he claims that by upholding certain international arrangements we are violating our strong negative duties not to harm, and not just some positive duties to help. I (...) shall argue that even if Pogge were correct in claiming that certain rich states or at least the rich states collectively violate certain negative duties towards the poor and harm the poor, he is far too hasty in concluding that "we," the citizens of those states, are thus harming the global poor or violating our negative duties towards them. In fact, his conclusion can be shown to be wrong not least of all in the light of some of his own assumptions about collective responsibility, the enforceability of human rights, and terrorism. In addition, I will also argue that his view that we share responsibility for the acts of our political "representatives," who allegedly act "on our behalf," is unwarranted. (shrink)

The current situation of climate change at a global level clearly requires policy changes at local levels. Global efforts to reach a consensus regarding the reduction of greenhouse gas emissions have so far been focused on developing Climate-Friendly Technologies (CFTs). The problem is that in order for these efforts to have an actual impact at a global level we need to be concerned with more than just promotion and info-dissemination on the already existing CFTs, but also with costs, implementation and (...) the international intellectual property and trade system necessary for this strategy to work. Currently, almost 80% of all patent applications belong to OECD countries like Japan, US, Germany, South Korea, Great Britain and France. The obligations climate change imposes on developing countries represent a technological shift that depends on Technology Transfer (TT) and implementation of IP laws. The current IP framework, especially patent law, copyright and trade secrets produces another kind of obligations. The main question is if the conjunction of these two sets of obligations (rules) is fair from a global justice point of view. Also, it is questionable whether this conjunction helps developing countries to produce their own CFTs. When discussing the demands of global justice one cannot skip the very important distinction Pogge makes between negative and positive obligations. In the context of global warming and the measures that the world’s states ought to take to prevent it, there seems to lie another conjunction between the positive obligation of preserving the natural environment that we all share and a negative obligation of allowing the less developed countries to help us all do so. Because one cannot impose regulations that cannot be put into practice, it is more and more obvious that a new framework of action and development needs to be drawn in the field of TT of CFTs. In this article the author presents a critical review of populism as it has been implemented in recent years in some Latin American countries. The article begins with a description of institutions and international economic and political crises; it then analyzes and criticizes the political alternative as presented by populism. And lastly, it explains the political ideal that derives from a constitutional democracy. The author offers a response that seeks to overcome the choice between national “populism” and international “cosmopolitanism-liberalism” by (...) way of a new reformist perspective at the international level of global governance. The point of departure for this comes from a democratization initiative within the countries undertaken by the nations of Latin America. (shrink)

This thesis aims to determine whether international gestational surrogacy contracts are exploitative, and whether they should be prohibited. I chose a group of women working as surrogates at Kaival Maternity Home and Surgical Hospital, in Anand, Gujarat, India as a study group. After examining their life circumstances, I argue that these women live in unjust circumstances caused by institutional sexism and poverty. I critically assess arguments launched against surrogacy, organ trade, and prostitution and find that none of these are sufficient (...) for demonstrating that contracts involving the sale of the body are necessarily exploitative. I find that surrogacy is exploitative because of a complex set of social conditions. Further, the contracts are beneficial to both the woman acting as surrogate and to the couple hiring her. I conclude that international gestational surrogacy is exploitative yet mutually beneficial, and prohibiting surrogacy would be harmful unless accompanied by drastic social change. (shrink)

The recent global surge in large-scale foreign land acquisitions marks a radical transformation of the global economic and political landscape. Since land that attracts capital often becomes the site of expulsions and displacement, it also leads to new forms of migration. In this paper, I explore this connection from the perspective of a political philosopher. I argue that changes in global land governance unsettle the congruence of political community and bounded territory that we often take for granted. As a case (...) study, I discuss the European Union’s Renewable Energy Directive as a significant driver of foreign land acquisitions. Using its global power, the European Union (EU) is effectively governing land far outside of its international borders and with it the people who live on this land or are expelled from it. As a result, EU citizens ought to consider such people fellow members of their political community. This has implications for normative debates about immigration and, in particular, for arguments that appeal to collective self-determination to justify a right of political communities to exclude newcomers. The political community to which EU citizens belong reaches far beyond the EU’s official borders. (shrink)

Two classes of arguments are often deployed by the anti-global egalitarians against attempts to universalize the demands of distributive equality. One are arguments attempting to show that global egalitarians have misconstrued the reasons for why equality matters domestically, and hence have wrongly extended these reasons to the global arena. These arguments hold that the boundary of distributive justice is effectively coextensive with the boundaries of state. The other are arguments that attempt to show that membership in political societies generates special (...) duties among members that may outweigh the demands of global egalitarianism. These arguments appeal to the ethical significance of state boundaries and membership. In my defense of global egalitarianism, I reject both the attempts to limit the boundary of justice and the attempts to give state boundaries special moral significance and priority. In particular, I will argue that the boundary of justice cannot coincide with the boundaries of states when the justice of the boundaries is at issue. (shrink)

In this paper, I examine whether Wenar's Bloody Oil ( 2016) succeeds in providing a theory able to accommodate the statist commitment to peoples’ sovereignty without dismissing the cosmopolitan concern regarding a just global market. Contextualising Blood Oil within the broader debate on global justice and resource ownership, I focus on some specific aspects of Wenar’s Clean Trade scheme and explain why it comes to quite radical conclusions. Yet, if these conclusions are taken seriously, Clean Trade seems too demanding from (...) the point of view of a statist account of justice. For cosmopolitans, too, the lack of normative justification for any alleged national resource sovereignty might weaken this position, especially for those who might oppose arguments to justify different forms of resource ownership. I will therefore discuss two problems with Wenar’s theory. First, I will show that, in spite of its statist premises, Wenar’s radical conclusions hardly pass the test of anti-paternalism. Is the Clean Trade scheme able to accommodate the demand of pluralism emerging in the Society of Peoples? Second, I focus on an issue that is neglected in Wenar’s book and which refers directly to the normative basis of resources ownership. I argue that this is a crucial issue, especially in contexts where the traditional idea of national sovereignty is contested, which often occurs in resource-cursed societies. (shrink)

This paper aims to address two seemingly independent issues in the field of moral and political philosophy, namely the problem of global justice with elements regarding research ethics. The first section of the paper will be concerned with a short overview of the problem at hand, highlighting the particular way in which research is carried out in the 21st century. While admitting that the matrix of moral issues linked to the current topic is more diverse, I will limit the scope (...) of my analysis to only two elements. First of all, in the second section of my paper I will try to identify an answer to the following question: are researchers from non-native English speaking countries who seek to publish in academic journals from abroad in a position of inequality in relation to their peers from Australia, Great Britain or USA? I will explore the moral relevance of this question at a global level by presenting Philippe Van Parijs’ conception of linguistic justice. My argument will rest upon the fact that the emergence of English as a lingua franca in research publishing has had more positive than negative externalities in relation to researchers from developing countries. The third and final part of my paper will be a critique of the current Intellectual Property system which, in my opinion, hinders the access of researchers from developing countries to new research available in journals indexed in international databases like Wiley-Blackwell, SAGE or JSTOR.
