This paper has two aims. The first is to present and defend a new argument for rights contributionism – the view that the notion of a moral claim-right is a contributory (or pro tanto) rather than overall normative notion. The argument is an inference to the best explanation: it is argued that (i) there are contributory moral factors that contrast with standard moral reasons by way of having a number of formal properties that are characteristic of rights, even though they (...) can be overridden, and (ii) that this is best explained by a view that takes these factors to correlate with rights. The second aim is to show that the truth of rights contributionism matters for normative ethics. More specifically, it is argued that rights contributionism clears the way for deontologists to justify the pre-theoretically plausible verdict that we have a duty to save the greater number in so-called Taurek scenarios – scenarios in which we have to choose between saving either a greater or a smaller number of different people. The chapter offers a novel and distinctively deontological explanation of this verdict that is based on the assumption that everyone has a pro tanto right to be saved in a Taurek scenario. (shrink)

Philosophers have often noted a contrast between practical and theoretical reasons when it comes to cases involving equally balanced reasons. When there are strong practical reasons for A-ing, and equally strong practical reasons for some incompatible option, B-ing, the agent is permitted to make an arbitrary choice between them, having sufficient reason to A and sufficient reason to B. But when there is strong evidence for P and equally strong evidence for ~ P, one isn’t permitted to simply believe one (...) or the other. Instead, one must withhold belief, neither believing that P nor believing that ~ P. This paper examines what explains this contrast, focusing in particular on a proposal recently developed by Mark Schroeder across several papers. Schroeder aims to explain the contrast by an appeal to non-evidential, epistemic reasons against belief. But, I argue, it’s not clear exactly what those reasons are, nor how those reasons are to be weighed against evidential reasons. Despite these challenges, I argue that there are grounds for optimism that the contrast can be explained within the broad framework Schroeder provides, and I aim to provide resources to meet the aforementioned challenges. The motivational constraint on normative reasons says that a consideration is a normative reason for an agent to act only if it is logically possible for the agent to act for that reason, or at least to be moved so to act. The claim figures Zelig-like in philosophical debates about practical reasons: on hand, occasionally prominent, but never the focus of discussion. However, because it is entailed by a number of prominent views about normative reasons—including various forms of internalism and (...) some views that closely connect reasons to good practical reasoning—its truth or falsehood has important implications. Mark Schroeder (2007) and Julia Markovits (2014) have recently criticized the Motivational Constraint on the grounds of so-called “elusive reasons”: reasons for some agent to act that are such that it is logically impossible both that they are normative reasons for that agent and the agent is moved to act for those reasons. In response, a number of philosophers (Sinclair 2016; Ridge and McKeever 2012; Paakkunainen 2017) have attempted to reconcile blindspot reasons with the motivational constraint. My aim in this paper is to show that these conciliatory strategies fail to overcome the challenge posed by elusive reasons. First, I examine each strategy and argue that it unsuccessful on its own terms. Second, I adduce another type of elusive reason not heretofore discussed in the literature, and I argue that these strategies also cannot make this kind of reason consistent with the motivational constraint. Finally, I defend the existence of this kind of reason against an important objection. (shrink)

We use normative reasons in a bewildering variety of different ways. And yet, as many recent theorists have shown, one can discern systematic distinctions underlying this complexity. This paper is a contribution to this project of constructive normative metaphysics. We aim to bring a black sheep back into the flock: the balancing model of weighing reasons. This model is threatened by a variety of cases in which distinct reasons overlap, in the sense that they do not contribute separate weight for (...) or against an option. Our response is to distinguish between derivative reasons and load-bearing reasons, only the latter of which contribute non-overlapping weight to an option. This distinction is close at hand for analyses of reasons in terms of the promotion of significant outcomes. But we also develop an account of this distinction for fundamentalist theories of normative reasons. (shrink)

Often, when one faces a choice between alternative actions, there are reasons both for and against each alternative. On one way of understanding these words, what one “ought to do all things considered (ATC)” is determined by the totality of these reasons. So, these reasons can somehow be “combined” or “aggregated” to yield an ATC verdict on these alternatives. First, various assumptions about this sort of aggregation of reasons are articulated. Then it is shown that these assumptions allow for the (...) proof of a “Reasons Aggregation Theorem” – parallel to John Harsanyi’s 1955 “Social Aggregation Theorem”. All reasons for action are grounded in reason-providing values; and, for every such reason-providing value, there is in principle a way of measuring how strongly this value counts against each alternative. The theorem tells us that the appropriate measure of how much reason ATC there is against each alternative is simply a weighted sum of the strengths with which these values count against that alternative; the agent ought not ATC to perform an action iff there is ATC more reason against it than against some available alternative. In this article I advocate a worldly account of normative reasons according to which there is an ontological gap between these and the premises of practical thought, i.e. motivating considerations. While motivating considerations are individuated fine-grainedly, normative reasons should be classified as coarse-grained entities, e.g. as states of affairs, in order to explain certain necessary truths about them and to make sense of how we count and weigh them. As I briefly sketch, acting for normative reasons is nonetheless possible if (...) the connection between normative reasons and motivating considerations is a competence-based correspondence. How do multiple reasons combine to support a conclusion about what to do or believe? This question raises two challenges: How can we represent the strength of a reason? How do the strengths of multiple reasons combine? Analogous challenges about confirmation have been answered using probabilistic tools. Can reductive and nonreductive theories of reasons use these tools to answer their challenges? Yes, or more exactly: reductive theories can answer both challenges. Nonreductive theories, with the help of a result in confirmation (...) theory, can answer one, and there are grounds for optimism that they can answer the other. (shrink)

This chapter investigates different ways that pro tanto reasons bearing on our options can compete with one another in order to determine the overall normative status of those options. It argues for two key claims: (i) any theory of this competition must include a distinct role for reasons against, in addition to reasons for, and (ii) any theory must allow for comparative verdicts about how strongly supported the options are by the reasons, rather than simply which options are permissible or (...) required. A simple balancing account and an account based on a distinction between requiring and justifying reasons are rejected, and a new account giving a distinct role for reasons against is introduced. The wrong kind of reason (WKR) problem is a problem for attempts to analyze normative properties using only facts about the balance of normative reasons, a style of analysis on which the ‘Reasons First’ programme depends. I argue that this problem cannot be solved if the orthodox view of reasons is true --- that is, if each normative reason is numerically identical with some fact, proposition, or state-of-affairs. That’s because solving the WKR problem requires completely distinguishing between the right- and (...) wrong-kind reasons for an attitude. I argue that some facts give both right- and wrong-kind reasons for an attitude. Consequently, no such distinction between the two types of reasons is complete if reasons are facts or the like. I conclude by suggesting that reasons and facts are related by constitution, not identity. (shrink)

Kearns and Star have previously recommended that we measure the degree to which a reason supports a conclusion, either about how to act or what to believe, as the conditional probability of the conclusion given the reason. I show how to properly formulate this recommendation to allow for dependencies and conditional dependencies among the considerations being aggregated. This formulation allows us to account for how considerations, which do not themselves favour a specific conclusion, can modify the strength of a reason (...) for that conclusion, and thus to explain the intensifiers and attenuators described by Dancy. The formulation also accounts for the workings of partial undercutters in epistemology. I then show how my account avoids the counterexamples that Brunero levied against probability-based theories of the strengths of reasons. My account supports the theory, suggested by Kearns and Star, that the strengths of reasons are measured by conditional probabilities. If my account is successful, then it will count in favour of the idea that the strengths of reasons are measured on the same scale as are conditional probabilities. (shrink)

The paper proposes a revised logic of rights in order to accommodate moral conflict. There are often said to be two rival philosophical accounts of rights with respect to moral conflict. Specificationists about rights insist that rights cannot conflict, since they reflect overall deontic conclusions. Generalists instead argue that rights reflect pro tanto constraints on behaviour. After offering an overview of the debate between generalists and specificationists with respect to rights, I outline the challenge of developing a logic of rights-reasoning (...) that is compatible with generalism. I then proceed to offer a new logical framework, which utilizes a simple non-monotonic logic of practical reasoning. Both generalist and specificationist interpretations of the logic are explored. The revised logic shows that traditional characterizations of the debate between specificationists and generalists obscure other relevant philosophical positions. (shrink)

I critically respond to Scott A. Davison, Petitionary Prayer: A Philosophical Investigation. I attack his Contrastive Reasons Account of what it takes for a request to be answered and provide an alternative account on which a request is answered as long as it has deliberative weight for the person asked. I also raise issues with Davison’s dismissive treatment of direct divine communication. I then emphasize the importance of value theory for addressing the puzzles of petitionary prayer. Whether a defense of (...) petitionary prayer is successful depends on whether it can support the sort of requests that are central to the theological practices of the religion in question, explaining how they could be known to be effective, and this depends on the value theory of the theology in question. As an example, I show the relevance the traditional distinction between temporal and spiritual goods could have for knowing whether one’s prayers have been answered. How prayers could make a difference also depends on the theology in question, raising issues of ecclesiology and collective action that demand further attention. (shrink)

In this paper, I introduce a new species of elusive reason–reasons that it is impossible for an agent to act, or be motivated to act, for–and I show how this kind of elusive reason undermines a plausible claim about normative reasons, the Motivational Constraint. To defend the existence of this new kind of elusive reason, I respond to the objection that our intuitions are tracking another normative or evaluative phenomenon, such as reasons to have certain affective responses or reasons for (...) others to act. In addition, because accepting the new kind of elusive reason requires affirming the claim that S acts for a reason p only if S regards p as a reason to A, I develop an account of what it is for S to regard p as a reason to A. Finally, as part of arguing for the former claim, I argue that the idea of being moved to A for a reason p entails the idea of being moved to A in light of p, which itself entails the idea of regarding p as a reason. Though there have been productive interactions between moral philosophers and deontic logicians, there has also been a tradition of neglecting the insights that the fields can offer one another. The most sustained interactions between moral philosophers and deontic logicians have notbeen systematic but instead have been scattered across a number of distinct and often unrelated topics. This chapter primarily focuses on three topics. First, we discuss the “actualism/possibilism” debate which, very roughly, concerns the relevance of what one will do at (...) some future time to what one ought to do at present (§2). This topic is also used to introduce various modal deontic logics. Second we discuss the particularism debate which, very roughly, concerns whether there can be any systematic general theory of what we ought to do (§3). This topic is also used to introduce various non-modal deontic logics. Third, we discuss collective action problems which concern the connection between the obligations of individuals and the behavior and obligations of groups of individuals (§4).This topic is also used to discuss formal systems that allow us to study the relationship between individuals and groups. The chapter also contains a general discussion of the relation between ethical theory and deontic logic (§1) and a brief consideration of other miscellaneous topics (§5). (shrink)

This paper presents a dilemma for the additive model of reasons. Either the model accommodates disjunctive cases in which one ought to perform some act $$\phi $$ just in case at least one of two factors obtains, or it accommodates conjunctive cases in which one ought to $$\phi $$ just in case both of two factors obtains. The dilemma also arises in a revised additive model that accommodates imprecisely weighted reasons. There exist disjunctive and conjunctive cases. Hence the additive model (...) is extensionally inadequate. The upshot of the dilemma is that one of the most influential accounts of how reasons accrue to determine what we ought to do is flawed. A common worry about moral conciliationism is that it entails at best uncertainty about many of our moral beliefs and at worst epistemological moral scepticism. Against this worry, I argue that moral conciliationism saves us from epistemological moral scepticism and enables us to be confident in many of our moral beliefs. First, I show that only taking disagreements seriously as a threat to our beliefs allows us to utilise agreements in support of our beliefs (call this symmetry). Next, I argue (...) that utilising moral agreements as an epistemic resource allows moral conciliationism to resist the potentially worrisome reduction in confidence of our moral beliefs. Taking the relevance of moral agreement into account, I argue that it is anti-conciliationism that must meet the challenge of epistemological moral scepticism. For this, I suggest that moral inquiry is best understood as a collective endeavour. If so, then agreement on our moral judgments is required to justify the confidence we have in many of our moral beliefs. However, by symmetry, this appeal is possible only if one accepts the conciliatory attitude towards disagreements. Hence, accepting, rather than rejecting moral conciliationism, is the way out of moral scepticism. (shrink)
