This seminal contribution to Kant studies, originally published in 1982, was the first to present a thorough survey and evaluation of Kant's theory of mind. Ameriks focuses on Kant's discussion of the Paralogisms in the Critique of Pure Reason, and examines how the themes raised there are treated in the rest of Kant's writings. Ameriks demonstrates that Kant developed a theory of mind that is much more rationalistic and defensible than most interpreters have allowed.

How should an agent decide what to do when she is uncertain not just about morally relevant empirical matters, like the consequences of some course of action, but about the basic principles of morality itself? This question has only recently been taken up in a systematic way by philosophers. Advocates of moral hedging claim that an agent should weigh the reasons put forward by each moral theory in which she has positive credence, considering both the likelihood that that theory is (...) true and the strength of the reasons it posits. The view that it is sometimes rational to hedge for one's moral uncertainties, however, has recently come under attack both from those who believe that an agent should always be guided by the dictates of the single moral theory she deems most probable and from those who believe that an agent's moral beliefs are simply irrelevant to what she ought to do. Among the many objections to hedging that have been pressed in the recent literature is the worry that there is no non-arbitrary way of making the intertheoretic comparisons of moral value necessary to aggregate the value assignments of rival moral theories into a single ranking of an agent's options. -/- This dissertation has two principal objectives: First, I argue that, contra these recent objections, an agent's moral beliefs and uncertainties are relevant to what she rationally ought to do, and more particularly, that agents are at least sometimes rationally required to hedge for their moral uncertainties. My principal argument for these claims appeals to the enkratic conception of rationality, according to which the requirements of practical rationality derive from an agent's beliefs about the objective, desire-independent value or choiceworthiness of her options. Second, I outline a new general theory of rational choice under moral uncertainty. Central to this theory is the idea of content-based aggregation, that the principles according to which an agent should compare and aggregate rival moral theories are grounded in the content of those theories themselves, including not only their value assignments but also the metaethical and other non-surface-level propositions that underlie, justify, or explain those value assignments. Empirical findings suggest that temptation causes agents not only to change their desires, but also to revise their beliefs, in ways that are not necessarily irrational. But if this is so, how can it be rational to maintain a resolution to resist? For in maintaining a resolution it appears that one will be acting against what one now believes to be best. This paper proposes a two-tier account according to which it can be rational neither to reconsider the question of (...) what one is going to do nor the question of what it is best to do; hence in the resolute agent the change in belief is not actual but merely potential. In A Theory of Justice, John Rawls defines a hypothetical contract situation and argues rational people will agree on reflection it is fair to contractors. He solves the rational choice problem it poses by deriving two lexically-ordered principles of justice and suggests the derivation justifies the principles. Its soundness aside, just what justificatory force does such a derivation have?On one view, there is no justificatory force because the contract is rigged specifically to yield principles which match our pre-contract moral judgments. Rawls provides ammunition for this claim: “By going back and forth, sometimes altering the conditions of the contractual circumstances, at others withdrawing our judgments [about what is just] and conforming them to principle, I assume that eventually we shall find a description of the initial situation that both expresses reasonable conditions and yields principles which match our considered judgments duly pruned and adjusted.”. In the paper, after clarifying terms such as ‘identity’, ‘self’ and ‘personhood’, I propose an empirical account of identity based on the notion of “whole phenotype”. This move allows one to claim the persistence of the individuals before and after their being affected by dementia. Furthermore, I show how this account permits us to address significant questions related to demented individuals’ loss of the capacity of moral decisions.

A dogma of contemporary normative theorizing holds that some reasons are distinctively moral while others are not. Call this view Reasons Pluralism. This essay looks at four approaches to vindicating the apparent distinction between moral and non-moral reasons. In the end, however, all are found wanting. Though not dispositive, the failure of these approaches supplies strong evidence that the dogma of Reasons Pluralism is ill-founded.

The idea that people’s numerical identity may sometimes be discontinuous over time initially appears to provide useful material for defending restrictions on putatively self-harming behaviour in a non-paternalistic manner. According to this line of thinking, sometimes a putatively self-harming act is, in fact, a matter of ‘harm to others’. Yet, in this paper I argue that if we, as we ought to do, take into consideration the non-identity problem, this challenges the notion that the agent at T1 is in fact (...) imposing harm on anyone, even when we accept that he or she is numerically different from the agent at T2. If the life of the agent at T2 is still worth living, the agent is not worse off than he or she would have been in spite of the consequences pertaining to the putatively self-harming act since he or she would otherwise never have come into existence. In this way, the argument I put forward in this paper calls in question the ability of the shifting identity argument to actually justify imposing restrictions on self-harming behaviour. (shrink)

Some propositions are structurally unknowable for certain agents. Let me call them ‘Moorean propositions’. The structural unknowability of Moorean propositions is normally taken to pave the way towards proving a familiar paradox from epistemic logic—the so-called ‘Knowability Paradox’, or ‘Fitch’s Paradox’—which purports to show that if all truths are knowable, then all truths are in fact known. The present paper explores how to translate Moorean statements into a probabilistic language. A successful translation should enable us to derive a version of (...) Fitch’s Paradox in a probabilistic setting. I offer a suitable schematic form for probabilistic Moorean propositions, as well as a concomitant proof of a probabilistic Knowability Paradox. Moreover, I argue that traditional candidates to play the role of probabilistic Moorean propositions will not do. In particular, we can show that violations of the so-called ‘Reflection Principle’ in probability need not yield structurally unknowable propositions. Among other things, this should lead us to question whether violating the Reflection Principle actually amounts to a clear case of epistemic irrationality, as it is often assumed. This result challenges the importance of the principle as a tool to assess both synchronic and diachronic rationality—a topic which is largely independent of Fitch’s Paradox—from a somewhat unexpected source. You and I lead different lives. While we share a society and a world, our existence is separate from one another. You and I matter individually, by ourselves. My dissertation is about this simple thought. I argue that this simple insight, the separateness of persons, tells us something fundamental about morality. My dissertation seeks to answer how the separateness of persons matters. I develop a precise view of the demands of the separateness of persons. The separateness of persons imposes both (...) a requirement on the justification of first-order moral principles as well as a requirement on the content of first-order moral principles. In specifying these demands, I argue that respecting the separateness of persons requires taking into consideration each person’s point of view separately. This requires taking into account the moral relations in which individuals stand to one another. I make use of this relational understanding of the separateness of persons to advance various debates in moral and political philosophy. I argue for a framework to assess to which extent the veil of ignorance can be reconciled with the separateness of persons. I also argue for a new view on the ethics of risk which is a form of contractualism that discounts risks only by their objective risk. Furthermore, I argue for a new solution to the problem of aggregation that is skeptical of aggregation and can set plausible limits to aggregation. Lastly, I provide a new relational agent-based justification for deontological constraints. In addition to answering how the separateness of persons matters, I defend the separateness of persons against challenges. Most importantly, I argue that the importance of the separateness of persons is not undermined even if we believe that our personal identity, i.e. whether we persist as the same person, is unimportant. Sometimes we make decisions which affect our lives at times when we will hold values that are different from our values at the time the decision is made. What is the reasonable way to make such a choice? Some think we should accept a requirement of temporal neutrality and take both sets of values into account, others think we should decide on the strength of our present values, yet others think that in evaluating what will happen at that other time (...) we should use the values that we will endorse at that time instead of our present values. These views see the problem as one about finding some attitude towards time itself that is distinctively rational. This article argues that these views are subject to serious objections. It suggests that instead we should think in terms of well-being. If a person approves of, or positively responds to, the way their life is going they will experience more well-being than if there is no positive response. The article explores the implications of a positive response condition on well-being for deciding what it is rational to do in cases involving changing goals. (shrink)

‘Marital faithfulness’ refers to faithful love for a spouse or lover to whom one is committed, rather than the narrower idea of sexual fidelity. The distinction is clearly marked in traditional wedding vows. A commitment to love faithfully is central: ‘to have and to hold from this day forward, for better for worse, for richer for poorer, in sickness and in health, to love and to cherish, till death us do part… and thereto I plight [pledge] thee my troth [faithfulness]’. (...) Sexual fidelity is promised in a subordinate clause, symbolizing its supportive role in promoting love's constancy: ‘and, forsaking all other, keep thee only unto her/him.’. (shrink)

Multiple self approaches purport that to have equal concern about all stages of one’s life is not a requirement of rationality. This poses a challenge to the prudential lifespan account which Norman Daniels advocates in Just health: meeting health needs fairly. Daniels has criticised the multiple self approach in earlier works, most extensively in Am I my parents keeper? In Just health, he only takes up the issue except in one footnote, presumably because he is convinced that his preceding discussions (...) settled the matter. This article argues that Daniels underestimates the force of the multiple self objection to prudential lifespan account. (shrink)

Is a theory of identity necessary for bioethics? In this paper I investigate that question starting from an empirical explication of identity based on post-genomics, in particular on epigenetics. After analysing whether the classic problems a theory of identity has to cope with also affect the proposed epigenetic account of identity, I deal with three topics to offer an insight on the relationship between that account and bioethics.

Philosophical positions that try to account for the phenomenon of identity loss include numerical theories of identity which argue for a psychological or a biological continuity criterion, narrative theories of identity, as well as reflections about different forms of memory, some of which have had influence in modern psychology and (...) in the neurosciences. A ‘Ulysses arrangement’ (UA) is an agreement where a patient may arrange for psychiatric treatment or non-treatment to occur at a later stage when she expects to change her mind. In this article, I focus on ‘competence-insensitive’ UAs, which raise the question of the permissibility of overriding the patient’s subsequent decisionally competent change of mind on the authority of the patient’s own prior agreement. In “The Ethical Justification for Ulysses Arrangements”, I consider sceptical and supportive arguments concerning competence-insensitive UAs, and (...) argue that there are compelling reasons to give such UAs serious consideration. In “Decisional Competence and Legal Capacity in UAs”, I examine the nature of decisional competence and legal capacity as they arise in UAs, an issue neglected by previous research. Using the distinctions which emerge, I then identify the legal structure of a competence-insensitive UA in terms of the types of legal capacity it embodies and go on to explain how types of legal capacity might be shared between the patient and a trusted other to offer support to the patient in the creation and implementation of a competence-insensitive UA. This is significant because it suggests possibilities for building patient support mechanisms into models of legal UAs, which has not addressed in the literature to date. Drawing on this, in “Using Insights from the Competence/Capacity Distinction to Enhance Patient Support in UAs”, I offer two possible models to operationalize competence-insensitive UAs in law that allow for varying degrees of patient support through the involvement of a trusted other. Finally, I outline some potential obstacles implementing these models would face and highlight areas for further research. (shrink)

Among theories of personal identity over time the simple view has not been popular among philosophers, but it nevertheless remains the default view among non philosophers. It may be construed either as the view that nothing grounds a claim of personal identity over time, or that something quite simple (a soul perhaps) is the ground. If the former construal is accepted, a conspicuous difficulty is that the condition of causal dependence between person-stages is absent. But this leaves such a view (...) open to an objection from the failure to provide a condition of individuation. If, on the other hand something like a soul is said to ground personal identity over time, such an account turns out to be more suited to a kind of continuity view. (shrink)

This paper seeks to lay down the theoretical groundwork for the emergence of holistic cross-cultural philosophical investigations of personal identity ¾ investigations that approach the theoretical, phenomenological, psychological, and practical-ethical dimensions of selfhood as indissociable. My strategy is to discuss three closely connected conceptual distinctions that the Buddhist approach to personal identity urges us to draw, and a lucid understanding of which is essential for the emergence of appropriately comprehensive and thus genuinely cosmopolitan discussions at the cross-road between Western and (...) Buddhist philosophical traditions. The first, primary distinction is that between the “visceral sense of self” and the “substance view of self”. This in turn gives rise to two derivative distinctions, namely between “harbouring VSS” and “believing SVS”, and between “overcoming VSS” and “rejecting SVS”. After discussing these distinctions, I consider and respond to three philosophical objections to features of Buddhist approach to selfhood that are thrown into sharper relief when attention is paid to these three distinctions. I then discuss some of the ways the foregoing may inform research in cross-cultural philosophy of personal identity. This discussion focuses on: the primacy of the first-person stance in matters of personal identity; the relationship between numerical identity and narrative identity; interdisciplinarity in the study of selfhood; and personal identity and egoism. The relation of our past memories and our communication with others is not simply that of linear causality, whereby our memories smoothly glide into our communicative performance and remain unaffected themselves. Psychologists reveal the opposite process where a current communication has an effect on our memories, not just influencing their selection but also producing false recognition. In this article I will attempt to give a philosophical evaluation of this twofold relationship of memory and communication, paying a special attention to the (...) fabrication of memories, to the significance of this process for the effectiveness of social integration, and to the effects it may have on our authenticity as individuals.An act of communication is not a creation ex nihilo but is a culmination of numberless physical and psychological processes, one of which is remembering, forgetting and recalling. What we say ourselves may be a logical and smooth prolongation of our memories and our past lives, but what we hear from others is not. The information that is communicated to us may contradict our previous beliefs, our previous understanding of the matter in question, and even threaten our established worldview. This is acutely felt by people who have to live through a value-changing period in their society or through a crisis in their personal life.Nevertheless we are required to maintain the communicative process and respond to new demands, and so we have to find ways of adapting ourselves to the new information, even if our past experiences and beliefs cannot serve as a foundation for accepting it. We can, however, construct such a foundation retrospectively, making ourselves believe that we were being prepared for this new situation. For example, the people who lived through the collapse of the Soviet Union, had to face a complete change of values, and the process of adaptation seemed less traumatic for those who, fabricated or inflated their own supposed disagreement with the system prior to the political changes. This paper defends a modest conception of human nature and argues that any adequate moral theory must incorporate this conception. Against the extreme historicist view it is argued that there are morally important necessary characteristics all human beings possess, and that many moral theories can be justified and criticized on the basis of these characteristics. Against the extreme naturalist view it is argued that the morally important and necessary characteristics give only a minimum content to moral theories and an adequate (...) theory must both include and go beyond this minimum. In conclusion, it is claimed that it follows that purely formal, some relativistic, some élitist, and some natural law moral theories are mistaken. (shrink)

What results is a relaxed and relativized probabilistic theory of epsilon-Causal necessity and an explicit attempt to avoid deterministic assumptions. The theory developed emphasizes the notions of partial cause, Causal contribution, And the degree of contribution. Implications for causal overdetermination, Causal preemption, And causal discourse are discussed.

On 25 April 2002, the German Parliament has passed a strict new law referring to stem cell research. This law took effect on July 1, 2002. The so-called embryonic Stem Cell Act ( Stammzellgesetz — StZG ) permits the import of embryonic stem (ES) cells isolated from surplus IvF-embryos for research reasons. The production itself of ES cells from human blastocysts has been prohibited by the German Embryo Protection Act of 1990, with the exception of the use of ES cells (...) which exist already. The debate on the legitimate use of ES cells escalated, after the main German research funding agency, the Deutsche Forschungsgemeinschaft (DFG), unexpectedly published new guidelines recommending are stricted use of human ES cells for research. Meanwhile, the debate has ethically dividedsociety, political parties, government and church members into a group supporting and a group rejecting ES cell research. The arguments in favour of such a research can be summarized as arguments derived from a new ethics ofhealing calling for a therapeutic imperative, whereas the arguments against can be summarized as arguments violating the fundamental principle of human dignity as they imply the destruction of human embryos. This article willtry to present and evaluate various ethical arguments founded on the latest biological and medical data on the potential use of stem cell technologies. It will finally come to the conclusion that ES cell research is opposed to human dignity, since the procedures of isolating ES cells require the destruction and instrumentalization of human embryos. Human embryos are human beings at a very early stage of their development, fully possessing the ability of completing their development. At this very early stage, human embryos are extremely dependent and fragile, and thus vulnerable corporealities. Vulnerability and human dignity demand the protection of the embryo's corporeal integrity. Hence, this essay will try to propagate research with adult stem(AS) cells, a procedure which does not require the destruction of human embryos; with regard to the necessary plasticity, it should be emphasized that AS cells very much resemble ES cells. Starting from the sensuous perception of what is seen, an attempt is made at re-casting a Husserlian theory of constitution of the object of intuition, as one leaves the natural attitude through a transcendental method, by positing several theses so as to avoid the aporias of philosophical binary oppositions such as rationalism and empiri-cism, realism and idealism, logicism and psychologism, subjectivism and objectivism, transcendentalism and ontologism, metaphysics and positivism. Throughout fifty-five theses on constitution, the Husserlian proposal of continuously reforming philosophizing (...) by transcendental reduction is revisited, leaving the latter incomplete as new conversions are required by noetic-noematic correlations between world and consciousness. Following Hardin’s paper of “The tragedy of the commons”, it has been traditionally sustained that the government should manage public good resources since their private management would lead to their depletion. However, Elinor Ostrom has challenged this account by identifying a specific type of Common-pool resources that, under circumstances of trust and fluid communication between the parties involved, can be efficiently managed by groups of individuals. In this context, it is this paper’s contention that the postulates of deliberative democracy are (...) compatible with an efficient management of common-pool resources. Thus, this finding would contradict literature that autocratic governments are more effective in managing natural resources. (shrink)
