The social trust argument asserts that a political community cannot survive without social trust, and that social trust cannot be achieved or maintained without a political community having discretionary control over immigration. Various objections have already been raised against this argument, but because those objections all assume various liberal commitments they leave the heart of the social trust argument untouched. This chapter argues that by looking at the socio-historical circumstances of Latino/as in the United States, an inherent weakness of the (...) social trust argument gets exposed. Giving a political community discretionary control over immigration not only fails to deliver on the promise of social trust, but it actually seems to promote its opposite, social mistrust. This suggests that a far better way of promoting the goal of social trust, and at the same time abating social mistrust, is to actually circumvent a political community’s ability to control immigration by giving priority both to socio-historical circumstances and immigrant rights (at least in a minimalist sense) in determining immigration policy. What does social cohesion require in culturally diverse post-immigration societies? Immigration and social cohesion are, in the public debate, believed to be incompatible. In normative political philosophy, a similar understanding manifests in the argument that social cohesion-based on a common national identity-is incompatible with immigration. In so doing, its proponents justify restrictive border policies. In this chapter, I will critically engage with this argument by reconnecting the literature in social sciences to normative political philosophy. I will offer a conditional and (...) pro tanto argument that social cohesion in post-immigration societies justifies open and non-discriminatory border policies. My argument is conditional in two senses: first, it assumes social cohesion is based on a common identity, and second, it only applies to the societies with significant cultural, religious, and ethnic diversity that can be best described as post-immigration societies. My argument implies that liberal nationalists have a choice: they can either keep defending social cohesion in the traditional way, which comes with open borders; or they can abandon this view, thereby losing one of the strongest justifications for restrictive borders. Most refugees residing in the European Union (EU) do not retain their voting rights in states of origin or lack the means to exercise them effectively. Most member states of the EU do not extend voting rights to refugees. This leaves a large population of refugees residing within the borders of the EU in a unique state of disenfranchisement. In this article, I consider this problem from a democratic perspective. Should refugees in the EU have voting rights? My answer turns (...) on three aspects characterizing the circumstances of refugees: First, refugees reside in member states for an indeterminate, and typically protracted, amount of time without any exit options. Second, the political governance of the EU and its member states significantly shapes the lives of refugees. And third, refugees lack effective voting rights, and consequently, a meaningful political membership, in any political community across the world. In turn, based on an all-subjected principle of democratic inclusion, I argue that refugees should be secured state-level voting rights in member states, albeit with a condition of the period of residency. Moreover, they should have immediate voting rights at the supranational institutions of the EU such as the European Parliament. (shrink)

The philosophical debate on the freedom of movement focuses almost exclusively on long-term migration, what I call, migration as settlement. The normative justifications defending border controls assume that the movement of people across political borders, independent of its purpose and the length of stay, refers to migration as settlement. “Global mobility,” “international movement,” and “immigration” are oftenused interchangeably. However, global mobility also refers to the movements of people across international borders for a short length of time such as travel, short-term (...) and circular migration. While most scholarly attention has focused on long-term migration, the vast majority of cross-border movement of people (approximately 85% of all cross-border movements in 2019) is short-term. The existing literature offers normative arguments for border controls, which are grounded on states’ right to self-determination, the freedom of (dis)association, the welfare state, the duty to compatriots, and brain drain. In this paper, I argue that these arguments do not justify excluding travelers, short-term and circular migrants from the territory. (shrink)

The best arguments for a nation-state’s right to exclude unwanted outsiders actually condemn nation-level regimes of restriction. Two argumentative steps lead to this conclusion. The first points out that the best arguments for exclusion generalize: if they show that nation-states have the right to exclude, they perform the same service for a great many towns, cities, subnational states, and provinces. The second step constructs a dilemma. The right to exclude is important enough to justify the suffering of would-be immigrants, or (...) it is not. If it is, the right to exclude is very important indeed–would-be immigrants often suffer grievously. But nation-level regimes would then be a serious moral problem: they would deprive a great many municipalities of a right that matters a great deal. Turning to the dilemma’s second horn, if the right to exclude is not important enough to justify the suffering of would-be immigrants, nation-level regimes are straightforwardly immoral. Either way, we arrive at this paper’s central thesis: the best arguments for a nation-states right to exclude actually condemn nation-level regimes of exclusion. (shrink)

Liberal egalitarians tend to be committed both to generous asylum policies and generous, universal welfare states. Yet there may be political, social and economic reasons why there is a conflict in realising both. Asylum seekers may create economic pressures to the welfare state, or undermine national solidarity supposedly necessary to support redistribution. In this paper, I discuss how political theorists should approach these empirical concerns. I take issue with the view that theorists can simply move between ‘realism’ and ‘idealism’ by (...) accepting more or less of reality. Instead, political theorists should seek to offer a critical description of the conflict, which can reveal structures of power that ought to be subject to normative scrutiny. To this end, I discuss two accounts of how the welfare state may justify asylum restrictions in relation to the case of Sweden, a universal welfare state that has recently introduced restrictions on asylum to protect the welfare state. I argue along these accounts that the welfare state is both an important source of political and social order and a foundation of the personal moral experience. Yet a critical analysis also illustrates how these claims weaken as underlying methodological nationalism and bias towards existing power structures are brought to light. Asylum restrictions cannot be justified if they contribute to perpetuating these power structures, which cause some of the conflict with the welfare state in the first place. (shrink)

In this paper I re-state the egalitarian argument against the morality of immigration controls: such limits violate the central ethical commitment to moral equality. This means that immigration controls fail a fundamental moral test and represent the ethical failure of the liberal project of moral equality. I set this re-statement against recent arguments about what moral equality means, specifically Christopher Heath Wellman's use of Elizabeth Anderson's notion of relational equality. Wellman believes that Anderson's ideas seriously damage the egalitarian argument, but (...) I argue that this is a misreading of her account. I conclude that any liberal attempt to morally justify immigration controls must fail through committing the basic logical error of ‘begging the question’. (shrink)

Can awarding migrants fewer legal rights than citizens ever be just? This paper explores this issue. I first outline an abstract argument in favor of rights differentiation. According to this argument, people’s rights ought to track their independent claims; since these claims may vary, some rights differentiation is permissible. I then suggest that this argument threatens to undermine the institution of citizenship because citizens’ claims on the state can differ in just the way migrants’ claims can, and the rights of (...) citizenship can be unbundled and awarded piecemeal. To resolve this tension, I offer a novel account of the normative functions of citizenship, which turns on the assertion that citizenship’s public conferral of equal rights promotes status equality and confers equal recognition. This account sets firm bounds on rights differentiation without ruling it out entirely. (shrink)

The current European ‘migration crisis’ encompasses increasing rates of migration and the accompanying failure of migrants, including both economic migrants and refugees, to integrate. In this paper, I focus on a normative analysis of the entry fee immigration system, providing both an internal and external critique. In the internal critique, I take for granted that states are best understood as clubs. However, states seem to share greater similarities with clubs that are too exclusive to allow membership to be purchased. In (...) the external critique, I argue that imposing a substantial entry fee on club membership is impermissible if exclusion from membership deprives non-members of basic rights and interests, even if measures are taken to equalise their ability to pay. The upshot of the internal and external critique, I believe, is that membership ought not to be contingent on the payment of a fee, or more generally, the acceptance of current members. (shrink)

Low-skilled migrants in wealthy receiving states are routinely subordinated across a range of social contexts. There is a rich philosophical literature on the inferiorizing effects of “crimmigration”—that is, the growing criminalization of unauthorized migrants and the state’s use of uniquely harsh law enforcement methods against them. Yet there is less interest in the existing racialized division of migrant labor. Low-skilled Latino/a/x migrants disproportionately perform “dirty” and “difficult” work that citizens do not wish to perform. Theoretically, this division of labor is (...) compatible with a more permissive immigration system that legally admitted far larger numbers of low-skilled migrants to continue “doing the dirty work.” Indeed, many have assumed the desirability of such a system. Against this, I argue that “crimmigration” and the racialized division of migrant labor cannot be conceptually disentangled. Rather, they are mutually constitutive in reproducing background conditions that constrain the social equality of low-skilled migrants, as well as others perceived to be such. “Crimmigration” has not only excluded migrants, but enabled states to include them on socially unequal terms: as an instrumental and fungible source of cheap labor. Drawing on Alasia Nuti’s valuable observation that “banal” historical mechanisms like stereotypes and social scripts can play a crucial role in maintaining present-day injustice, I show that stereotypes of migrants as workers in low-skilled occupations, as well as the expectation that they continue to take on those jobs, also profoundly undermine immigration justice. This article considers the implications of luck egalitarianism for a range of issues relating to international, South-North migration. More specifically, the implications of luck egalitarianism for the question of whether receiving societies are justified in extending to immigrants a less comprehensive set of rights than that enjoyed by other members of society are considered. First, are voluntary migrants responsible for their migration in such a way that receiving societies are justified in extending to them a less comprehensive set of rights (...) than if, say, they had been involuntary migrants, or citizens of the destination country? Since luck egalitarianism aims to redistribute only for inequalities for which individuals are not responsible, there is an issue of whether it will hold individuals responsible for their choice of migration in such a way that it may justify asymmetrical sets of rights between voluntary immigrants and other members of society. Second, it may be possible to allow access for a larger number of disadvantaged migrants if they are granted access to a less extensive package of rights when they reach the destination country than if they were granted access to a more extensive such package. If so, may not the less extensive package of rights turn out to have a greater positive impact on global equality? Both these arguments are critically discussed and it is concluded that neither justifies extending to immigrants a less comprehensive set of rights. (shrink)

States combine the routine refusal of citizenship to migrants with policies that grant newborns of citizens (or residents) full membership of society without questions asked. This paper asks what, if anything, can justify this differential treatment of the two types of newcomers. It explores arguments for differential treatment based on the differential environmental impact, different impact on the (political) culture of the society in question and differences between the positions of the newcomers themselves. I conclude that, although some justification for (...) differential treatment exists, the case for it is weaker than one may expect and the grounds on which it can be justified are surprising and problematic. Many affluent states seek to discharge their responsibilities to refugees through extraterritorial policies, which limit the number of refugees that they admit whilst contributing to protection in a third country. Is this morally permissible? I argue that under non-ideal circumstances, where states’ non-compliance with their duties to refugees are persistent, such policies can be permissible. However, extraterritorial protection must satisfy two conditions. First, it must come about through bilateral or multilateral agreements. Second, the protection provided must allow for full integration (...) in a new society. I argue that the lower the costs a state bears for admitting refugees to its territory, the higher its contribution to extraterritorial protection must be. This notion of costs is illustrated by exemplifying how refugee admission may impose costs to the self-determination and equality of the hosting state. (shrink)
