  1. Is it a boy or a girl? Who should (not) know children's sex and why?Daniela E. Cutas & Simona Giordano - 2013 - Journal of Medical Ethics 39 (6):374-377.
In this paper, we present the case of a couple who refused to disclose the sex of their child to others, and some of the responses that this case prompted in the international media. We outline the ethical issues that this case raises, and we place it into the more general context of parental preferences regarding the gender (development) of their children and of the impact on children of parental choices in the matter. Based on current knowledge of gender identity (...)

  • The Democratic Inclusion of Artificial Intelligence? Exploring the Patiency, Agency and Relational Conditions for Demos Membership.Ludvig Beckman & Jonas Hultin Rosenberg - 2022 - Philosophy and Technology 35 (2):1-24.
Should artificial intelligences ever be included as co-authors of democratic decisions? According to the conventional view in democratic theory, the answer depends on the relationship between the political unit and the entity that is either affected or subjected to its decisions. The relational conditions for inclusion as stipulated by the all-affected and all-subjected principles determine the spatial extension of democratic inclusion. Thus, AI qualifies for democratic inclusion if and only if AI is either affected or subjected to decisions by the (...)

  • Robots and cyborgs: to be or to have a body?Emma Palese - 2012 - Poiesis and Praxis 8 (4):191-196.
Starting with service robotics and industrial robotics, this paper aims to suggest philosophical reflections about the relationship between body and machine, between man and technology in our contemporary world. From the massive use of the cell phone to the robots which apparently “feel” and show emotions like humans do. From the wearable exoskeleton to the prototype reproducing the artificial sense of touch, technological progress explodes to the extent of embodying itself in our nakedness. Robotics, indeed, is inspired by biology in (...)

Sie zeigen: Soziale Medien und digitale Plattformen sind nicht nur Räume des Austauschs, sie erschaffen Affektökonomien – und darin liegt auch ihre Macht. Indem sie neue Formen des sozialen (...)

  • First–Person Plural Legislature: Political Reflexivity and Representation.Bert Van Roermund - 2003 - Philosophical Explorations 6 (3):235 – 250.
In the Social Contract Rousseau gives what could be called a philosophical rule of recognition for law in Modernity: a law is law if and only if 'the whole people rules over the whole people'. Thus, he defines self-legislation as, at bottom, collective intentional action. I will first map out the speech act structure [LEX] underlying self-legislation on this account. In particular, I argue for a first person plural counterpart of the reflexive structure inherent to intentions generally: the notion of (...)

  • Language and imagined Gesellschaft: Émile Durkheim’s civil-linguistic nationalism and the consequences of universal human ideals.Mitsuhiro Tada - 2020 - Theory and Society 49 (4):597-630.
When Thomas Luckmann, a pioneer of the “linguistic turn” in sociology, regarded Émile Durkheim as a source for the sociology of language, he had lifeworldly community–building in mind. However, the French sociologist himself understood language in the context ofcivil society–building. To Durkheim, language was a “social thing in the highest degree” that enabled general ideas and intermediated them to people. Abstract human ideals like the civil religion since the French Revolution could be shared through (a common) language. Thus, Durkheim took (...)

The expression “common good” usually conjures up benevolent associations: it is something to be desired, a worthy goal, and it would be a brave person who declared he or she was against the common good. Yet modern times have taught us to be critical and even suspicious of such grand rhetoric, leading us to query what lies behind this ambitious notion, who formulates what it stands for, and how such formulations have been reached.

Several interpretive disagreements about Kant's theory of divine commands (esp. in the work of Allen Wood and John E. Hare) can be resolved with further attention to Kant's works. It is argued that Kant's moral theism included (at least until 1797) the claim that practical reason, reflecting upon the absolute authority of the moral law, should lead finite rational beings like us to believe that there exists an omnipotent, omniscient and holy being who commands our obedience to the moral law (...)

From psychology, public health, and human resource management to development and security studies, resilience is replacing an earlier focus on resistance and adaptability within these fields. There exist several studies dealing with resilience discourse as a key to a diagnostic of the present. Social relations are predominantly influenced by an exchange paradigm whereby the logic of reciprocity shapes behaviour. If the notion of exchange instrumentalism is common across different business disciplines, this does not deny attempts -such as through gift exchange theory—to present different conceptions of traditional exchange-based relations. Gift exchange theory appears promising as it seeks to establish more meaning and significance to the nature and context of exchange relations between human actors or parties. The underlying processes may be different for gift (...)

Although Hegel is very critical of representative democracy, his views on political participation are in many ways richer and more sophisticated than the ones favoured today by most Western societies. The present paper aims to shed light on this apparent paradox by dispelling some of the misunderstandings still associated with Hegel’s ethical and political thought. I argue, on the one hand, that Hegel’s emphasis on the notion of freedom does not amount to an endorsement of political liberalism, but to a (...)

Joseph Raz’s theory of authority has become influential among moral, political, and legal philosophers. I first situate the theory among philosophical examinations of authority, and then explain the theory itself in detail.

  • Silencing the laws to save the fatherland: Rousseau’s theory of dictatorship between Bodin and Schmitt.Marc de Wilde - 2019 - History of European Ideas 45 (8):1107-1124.
Jean-Jacques Rousseau devoted an important chapter of his Social Contract to the dictatorship. Carl Schmitt interpreted Rousseau’s chapter as marking the transition from ‘commissarial’ to ‘sovereign dictatorship’. This article argues that Schmitt’s interpretation is historically and conceptually inaccurate. Instead of paving the way for sovereign dictatorship, Rousseau carefully distinguished the dictatorship from the people’s sovereign authority. Taking position in the ‘debate’ between Bodin and Grotius on the relation between dictatorship and sovereignty, he argued that the dictator could provisionally suspend the (...)

Only minor attention, however, has been devoted to the arbitrariness of judicial decisions and to the judicial role in general in the numerous proceedings that increasingly affect the path of migrants. This path is the main object of this paper. The study focuses on Italian (...)

What is the point of appealing to a social contract? An intuitively plausible answer is that the metaphor functions as a justification for the obligation to obey the law. If I have made a contract to establish a political authority, then I am bound to obey the commands of that authority. In a contract, my agreement creates an obligation to perform. Then only remaining question is what reasons I have to make the agreement in the first place. It would then (...)
