Utilitarians must think collectively about the future because many contemporary moral issues require collective responses to avoid possible future harms. But current rule utilitarianism does not accommodate the distant future. Drawing on my recent books Future People and Ethics for a Broken World, I defend a new utilitarianism whose central ethical question is: What moral code should we teach the next generation? This new theory honours utilitarianism’s past and provides the flexibility to adapt to the full range of credible futures (...) – from futures broken by climate change to the digital, virtual and predictable futures produced by various possible technologies. One of Mill's primary targets, throughout his work, is intuitionism. In this paper, I distinguish two strands of intuitionism, against which Mill offers separate arguments. The first strand, a priorism, makes an epistemic claim about how we come to know norms. The second strand, ‘first principle pluralism’, makes a structural claim about how many fundamental norms there are. In this paper, I suggest that one natural reading of Mill's argument against first principle pluralism is incompatible with the naturalism that drives (...) his argument against a priorism. It must, therefore, be discarded. Such a reading, however, covertly attributes Mill realist commitments about the normative. These commitments are unnecessary. To the extent that Mill's argument against first principle pluralism is taken seriously, I suggest, it is an argument that points towards Mill as having an antirealist approach to the normative. Most recent discussions of John Stuart Mill’s System of Logic (1843) neglect the fifth book concerned with logical fallacies. Mill not only follows the revival of interest in the traditional Aristotelian doctrine of fallacies in Richard Whately and Augustus De Morgan, but he also develops new categories and an original analysis which enhance the study of fallacies within the context of what he calls ‘the philosophy of error’. After an exploration of this approach, the essay relates the philosophy of error (...) to the discussion of truth and error in chapter two of On Liberty (1859) concerned with freedom of thought and discussion. Drawing on Socratic and Baconian perspectives, Mill defends both the traditional study of logic against Jevons, Boole, De Morgan, and others, as well as the study of fallacies as the key to maintaining truth and its dissemination in numerous fields, such as science, morality, politics, and religion. In Mill’s view the study of fallacies also liberates ordinary people to explore the truth and falsity of ideas and, as such, to participate in society and politics and develop themselves as progressive beings. This paper considers the question of whether Mill's account of the nature and justificatory foundations of deductive logic is psychologistic. Logical psychologism asserts the dependency of logic on psychology. Frequently, this dependency arises as a result of a metaphysical thesis asserting the psychological nature of the subject matter of logic. A study of Mill's System of Logic and his Examination reveals that Mill held an equivocal view of the subject matter of logic, sometimes treating it as a set of psychological (...) processes and at other times as the objects of those processes. The consequences of each of these views upon the justificatory foundations of logic are explored. The paper concludes that, despite his providing logic with a prescriptive function, and despite his avoidance of conceptualism, Mill's theory fails to provide deductive logic with a justificatory foundation that is independent of psychology. J. S. Mill lays great emphasis on the importance of the notion of the individual as a progressive being. The idea that we need to conceive the self as an object of cultivation and perfection runs through Mill’s writings on various topics, and has played a certain role in recent interpretations. In this paper I propose a specific interpretation of Mill’s understanding of the self, along the lines of what Stanley Cavell identifies as a “perfectionist” concern for the self. Various (...) texts by Mill, ranging from the Logic to On Liberty, show an understanding of the self in which both the theoretical and the practical domain are presented as being internally connected to the transformation of the self. Mill elaborates a criticism of a notion of truth articulated by doctrines having a life independent of the self, as well as a notion of choice which is not the expression of one’s inner self. This internal relation of truth and choice to the self generates a special dialectic within the self, which Mill explores in On Liberty’s second and third chapters by means of several contrasts, such as passive vs. active knowledge, living vs. dead beliefs, or being oneself vs. liking and choosing in crowds. Nietzsche’s favourable comments about science and the senses have recently been taken as evidence of naturalism. Others focus on his falsification thesis: our beliefs are falsifying interpretations of reality. Clark argues that Nietzsche eventually rejects this thesis. This article utilizes the multiple ways of being science friendly in Nietzsche’s context by focussing on Mach’s neutral monism. Mach’s positivism is a natural development of neo-Kantian positions Nietzsche was reacting to. Section 15 of Beyond Good and Evil is crucial to Clark’s interpretation. (...) The aim of this paper is to give an account of what it is to internalize a rule. I claim that internalization is the process of redistributing the burden of instruction from the teacher to the student. The process is complete when instruction is no longer needed, and the rule has reshaped perceptual classification of the circumstances in which it applies. Teaching a rule is the initiation of this process. We internalize rules by simulating instruction coming from someone else. Running (...) these simulations enables us to toggle between the perspective of the instructor and our own perspective. By doing this we coordinate our perspectives with that of the teacher. The account given here provides a deeper explanation of why internalizing a rule involves the dispositions and reactive attitudes proponents of Rule Consequentialism often say it does, why moral reflection is variably demanding, how intergenerational moral progress is made possible by our cognitive architectures, and why the adoption of a rule should be understood in terms of teaching that rule. The passage of Mill’s Utilitarianism that sets out the condition in which one pleasure has a superior quality than another stokes interpretive controversy. According to the Lexical Interpretation, Mill takes one pleasure, P1, to be of a superior quality than another, P2, if, and only if, the smallest quantity of P1 is more valuable than any finite quantity of P2. This paper argues that, while the Lexical Interpretation may be supported with supplementary evidence, the passage itself does not rule out (...) qualitative superiority without lexical dominance, as it only requires P1 to be more valuable than any quantity of P2 that it is possible for someone to experience. Some will object that this concession to opponents of the Lexical Interpretation still renders Mill’s condition for qualitative superiority too demanding to be plausible. However, if Mill’s qualitative rankings apply to higher-order pleasures taken in modes of existence as such rather than to the pleasures of different activities chosen from within these modes, the objection loses much of its force. One upshot is that Mill may have more to contribute to debates in contemporary population axiology than is usually acknowledged. (shrink)

The philosophical background important to Mill’s theory of induction has two major components: Richard Whately’s introduction of the uniformity principle into inductive inference and the loss of the idea of formal cause.

There is a fundamental disagreement about which norm regulates assertion. Proponents of factive accounts argue that only true propositions are assertable, whereas proponents of non-factive accounts insist that at least some false propositions are. Puzzlingly, both views are supported by equally plausible (but apparently incompatible) linguistic data. This paper delineates an alternative solution: to understand truth as the aim of assertion, and pair this view with a non-factive rule. The resulting account is able to explain all the relevant linguistic data, (...) and finds independent support from general considerations about the differences between rules and aims. (shrink)

A book chapter (about 7,000 words, plus references) on the interpretation of Mill’s criterion of right and wrong, with particular attention to act utilitarianism, rule utilitarianism, and sanction utilitarianism. Along the way, major topics include Mill’s thoughts on liberalism, supererogation, the connection between wrongness and punishment, and breaking rules when doing so will produce more happiness than complying with them will.

In the earliest phase of his logical investigations, Peirce adopts Mill's doctrine of real Kinds as discussed in the System of Logic and adapts it to the logical conceptions he was then developing. In Peirce's definition of natural class, a crucial role is played by the notion of information: a natural class is a class of which some non-analytical proposition is true. In Peirce's hands, Mill's distinction between connotative and non-connotative terms becomes a distinction between symbolic and informative and pseudo-symbolic (...) and non-informative forms of representation. A symbol is for Peirce a representation which has information. Just as for Mill all names of Kind connote their being such, so for Peirce all symbols profess to correspond to a natural class. A leading classical utilitarian, John Stuart Mill is an unlikely contributor to the public reason tradition in political philosophy. To hold that social rules or political institutions are justified by their contribution to overall happiness is to deny that they are justified by their being the object of consensus or convergence among all those holding qualified moral or political viewpoints. In this chapter, I explore the surprising ways in which Mill nevertheless works to accommodate the problems and insights of the (...) public reason tradition, and the extent to which he makes arguments that can help those working within that tradition. Mill’s utilitarian theory incorporates the claim that the demands of social life require a publicly accepted set of normative expectations to govern judgments about when one has met one’s obligations and, relatedly, about the appropriateness of blame or punishment. The Racial and Religious Hatred Act 2006 represents a significant development in UK law. It extends the offence of incitement to racial hatred set out in the Public Order Act 1986 to make it also an offence to stir up hatred against persons on religious grounds. As the most celebrated liberal thinker of the nineteenth century, J.S. Mill might be expected to offer some lessons about the possible dangers of this sort of legislation. A Millian response to the 2006 Act (...) is developed here by first applying Mill’s famous defence of free speech to the Lords amendments to the Racial and Religious Hatred Bill 2005 and then by looking at potential cases in which even freedom of expression loses its immunity when this is necessary to prevent harm to others. Three versions of the harm‐prevention justification for liberty‐limiting restrictions are assessed and it is argued that the most promising version is the claim that it may be permissible to punish incitement to racial and religious hatred not so much because it is itself a kind of harm but by virtue of the acts of discrimination, violence and injustice that are more likely to occur within a climate of hatred. Ultimately, however, this rationale must be weighed against what is, for Mill, the special value of free speech and may in the end justify intervention in only the most acute cases. (shrink)

This thesis is concerned with John Stuart Mill’s democratic theory. In chapter I, I examine the relations between political philosophy and political theory and science before providing a detailed outline of the aims of the dissertation. In chapter II, I argue that in order to reconcile the concepts of progress and equality within a utilitarian theory, a Millian political system needs to devise institutions that promote general happiness, protect individual autonomy, safeguard society from mediocrity. Chapter III discusses what different authors (...) have said about Mill and liberty, then explores James Mill’s theory of education and Coleridge’s influence on John Stuart Mill’s thought. I conclude by criticising Richard Arneson’s interpretation according to which the Considerations and On Liberty are inconsistent, and some of Gregory Claeys’ conclusions on Mill and paternalism. Chapter IV explores the methodology of the social sciences and the philosophy of history as found in Mill’s writings; then it considers Mill’s thought in regard to his father’s Radical proposals. I also discuss at some length the idea of the tyranny of the majority. Chapter V begins with a discussion of Hanna Pitkin’s theory of representation. I then provide a critical account of Richard Krouse and Nadia Urbinati’s interpretations of Mill. I conclude by arguing that, in a Millian democracy, the higher is the degree of complexity or the need for expertise in dealing with affairs, the greater is the bearing of the principle of competence in assessing whether a representative should act as a trustee or a delegate. I also introduce the idea of rational debate as a sort of ‘influence multiplier’, arguing that this would help to make a democracy rational and effective along Millian lines. In the last two chapters, I stress the relevance of Mill’s political philosophy as for some contemporary issues (nationalism, European federalism, current social and economic changes) while suggesting some potential further investigations, and summarise my conclusions. Rule consequentialism holds that an action's moral standing depends on its relation to the moral code whose general adoption would have the best consequences. Heretofore rule consequentialists have understood the notion of a code's being generally adopted in terms of its being generally obeyed or, more commonly, its being generally accepted. I argue that these ways of understanding general adoption lead to unacceptable formulations of the theory. For instance, Brad Hooker, Michael Ridge, and Holly Smith have recently offered different answers (...) to the question of what ‘acceptance rate’ we should build into our formulation of rule consequentialism, and all are unsatisfactory. I argue instead for a novel approach to formulating rule consequentialism, ‘uniform-moral-education’ rule consequentialism, on which what it means for a moral code to be generally adopted is not for it to be generally followed or generally accepted, but instead for it to be generally taught. Unsere Kritik zielt auf den Nachweis, dass konsequenzialistische Ansätze einer methodischen Anforderung bei der Begründung eines Moralprinzips nicht gerecht werden, weil sie einen Begriff des Guten voraussetzen, ohne auf seinen epistemischen Status zu reflektieren. Es gelingt ihnen daher nicht, einen Begriff des Guten zu entwickeln, der gleichermaßen sowohl die Erkenntnis einer logischen Notwendigkeit als auch einer praktischen Relevanz zum Ausdruck bringen kann. Aus methodischen Gründen muss daher unklar bleiben, warum das, was (...) als „gut“ gesetzt und erkannt wird, auch realisiert werden muss.Wir gehen in vier Schritten vor: In einem ersten Schritt greifen wir mit dem Ziel der Verschärfung des Problems mit dem so genannten deontologischen Paradox eine der größten Herausforderungen für deontologische Ethiken auf. Wir wollen aber zeigen, dass dieses Paradox überhaupt nur formuliert werden kann, wenn bereits von einem Prinzip des Guten ausgegangen wird, ohne es in ein Verhältnis zur praktischen Vernunft des Handelnden zu setzen. Dazu rekonstruieren wir in einem zweiten Schritt Mills Beweis für das Nützlichkeitsprinzip des Utilitarismus, weil sich daran das methodische Problem einer Erkenntnis des Guten besonders gut herausarbeiten lässt. Im dritten Schritt entwickeln wir unter Rückgriff auf methodologische Überlegungen Kants aus der Kritik der praktischen Vernunft ein Argument, das zeigen soll, dass in keiner moralphilosophischen Argumentation ein Begriff des Guten einfach vorausgesetzt werden kann, ohne logisch primär die durch das Prädikat „gut“ erkannte praktische Notwendigkeit in ein Verhältnis zum Handelnden zu setzen. Das, was überhaupt als gut erkannt werden kann, ist daher durch reflexive Urteile über den Modus des praktischen Erkennens zu bestimmen. John Stuart Mill didn’t take his life; but he could have done it. Had he done it when he was twenty, we would have never known what he thought about it. But he didn’t. And many years later he wrote about nature, God, religion and autonomy. My aim in this article is to show how his thoughts about nature and theism affect in fact his stance about autonomy to commit suicide.

Auguste Comte's doctrine of the three phases through which sciences pass (the theological, the metaphysical, and the positive) allows us to explain what John Stuart Mill was attempting in his magnum opus, the System of Logic: namely, to move the science of logic to its terminal and 'positive' stage. Both Mill's startling account of deduction and his unremarked solution to the Humean problem of induction eliminate the notions of necessity or force—in this case, the 'logical must'—characteristic of a science's metaphysical (...) stage. Mill's treatment had a further surprising payoff: his solution to the Problem of Necessity (what today we call the problem of determinism and freedom of the will). (shrink)

This chapter challenges the view that psychology emerged from philosophy about 1900, when each found its own proper sphere with little relation to the other. It begins by considering the notion of a discipline, defined as a distinct branch of learning. Psychology has been a discipline from the time of Aristotle, though with a wider ambit, to include phenomena of both life and mind. Empirical psychology in a narrower sense arose in the eighteenth century, through the application (in Britain and (...) elsewhere) of the observational attitudes of the physical and life sciences to mental phenomena. The experimental psychology of the latter nineteenth century was a transformation of this empirical psychology, although the British version was characterized by new theoretical conceptions (including evolutionary ideas) as well as new empirical techniques. After surveying psychology in and out of universities in this period, the chapter reviews a taxonomy of “schools” of psychology from 1923. Notice of anti-psychological attitudes in British philosophy before and after 1900 is balanced by considering positive conceptions of psychology’s role in connection with epistemology and the problem of the external world. This paper scrutinizes the tension between individuals’ rights and paternalism. I will argue that no normative account that includes rights of individuals can justify hard paternalism since the infringement of a right can only be justified with the right or interest of another person, which is never the case in hard paternalism. Justifications of hard paternalistic actions generally include a deviation from the very idea of having rights. The paper first introduces Tom Beauchamp as the most famous contemporary hard paternalist (...) by outlining his moral theory (principlism) and showing why it, as it stands, has to allow for hard paternalism. Secondly, the paper focuses on the notion of rights within principlism. I will employ traditional theories of rights to make sense of rights in principlism. Unfortunately, this attempt fails. In the third part, then, I claim that rights can only be limited with reference to the rights or interests of others. This structure is the very point of rights, it is their bite. I will argue for this claim and show its implications. The most important implication is that not only principlism, but every normative theory that includes rights of individuals, has to abolish hard paternalism. (shrink)

It is the purpose of this article to offer an account of Mill's metaethics. Expanding upon clues given recently by Dale Miller, and previously by John Skorupski, I suggest that when it comes to the foundations of his philosophy, Mill might share more with the intuitionists than we are accustomed to think. Common wisdom holds that Mill had no time for the normativity of intuitions. I wish to dispute, or at least temper, this dogma, by claiming that Mill's attitude towards (...) intuitions is far more complex and ambivalent than is generally thought. I argue that, according to Mill, our belief in the reliability of inductive moves and apparent memories, as well as the desirability of pleasure, is vindicated by something akin to intuition. Mill's System of Logic (1843) indicates that the definition of ‘nationality’ he offered in Considerations on Representative Government (1861) is not a throwaway comment but a carefully considered causal hypothesis tailored to his politico-ethological research programme. This matters because Lord Acton's critique of Mill's claim that free institutions are almost impossible in multinational states ignored the definition, thereby obscuring subsequent scholars' vision of the conceptual dimension of this famous dispute. Although Mill struggled in his politico-ethological endeavour, he was sufficiently confident (...) to judge that, if nationalities seek self-determination through exclusive control of the state, liberal democratic institutions would be unlikely to emerge in multinational states, let alone survive and prosper. Since Acton's critique presupposed an undemocratic conception of free institutions and a far weaker notion of national self-determination, it failed to contradict that judgement. Indeed, once their conceptual disagreements are clarified, Acton's empirical analysis can be seen to support it. (shrink)

This article examines the nineteenth-century debate about scientific method between John Stuart Mill and William Whewell. Contrary to standard interpretations (given, for example, by Achinstein, Buchdahl, Butts, and Laudan), I argue that their debate was not over whether to endorse an inductive methodology but rather over the nature of inductive reasoning in science and the types of conclusions yielded by it. Whewell endorses, while Mill rejects, a type of inductive reasoning in which inference is employed to find a property or (...) cause shared by the observed members of a class, which is generalized to all its members, including the unobserved ones. Because of this, Whewell’s inductivism, unlike Mill’s, is able to yield theoretical hypotheses referring to unob-servables such as molecules and light waves. This is contrary to the claims of some critics of inductivism who argue that inductivism is unable to yield such hypotheses. Moreover, I suggest that Whewell’s view of induction conforms more closely than Mill’s view to the practice of scientists such as Kepler, Newton, and Fresnel, who do attempt to discover laws involving unobservables. In this article, I explore the relation between theoretical and practical reason in the work of J.S. Mill. I argue that Mill holds that theoretical reason is subordinate to practical reason. Ultimately, this amounts to the claim that the norms of theoretical reason – those rules governing how we ought to believe – are grounded in considerations of utility.

Mill argues that, apart from the principle of utility, his utilitarianism is incompatible with absolutes. Yet in On Liberty he introduces an exceptionless anti-paternalism principle—his liberty principle. In this paper I address ‘the absolutism problem,’ that is, whether Mill's utilitarianism can accommodate an exceptionless principle. Mill's absolute claim is not a mere bit of rhetoric. But the four main solutions to the absolutism problem are also not supported by the relevant texts. I defend a fifth solution—the competence view—that turns on (...) his attention to decision-making structures and, in particular, on the role of expertise considerations in his account. (shrink)

According to G. E. Moore, moral expertise requires abilities of several kinds: the ability to factor judgments of right and wrong into (a) judgments of good and bad and (b) judgments of cause and effect, (2) the ability to use intuition to make the requisite judgments of good and bad, and (3) the ability to use empirical investigation to make the requisite judgments of cause and effect. Moore’s conception of moral expertise is thus extremely demanding, but he supplements it with (...) some very simple practical guidance. (shrink)

The subject of the paper is a contemporary interpretation of J.S. Mill’s elimination method using selected concepts of Zdzisław Pawlak’s decision logic. The aim of the interpretation is to reformulate the original rules of Mill’s induction so that they correspond more precisely to his concept of cause as a complex sufficient condition. In the first part of the paper, we turn to Mill’s writings and justify the thesis that in his understanding the cause is an aggregation of circumstances, and not (...) a single circumstance; next, we point out that Mill’s original canons do not allow causes-aggregations to be singled out from empirical data. In the second part of this paper, we present such aspects of Z. Pawlak’s decision logic that serve as the basis for the formalisation of the method of eliminative induction. We describe exhaustively the schema of induction that involves a gradual - divided into three stages - simplification of a set of implications corresponding to the observed dependencies [system of potential causes, effect]. The simplification is deductive because it maintains consistency within the set of implications. We show that such schema is ideal for isolating complex causes, ultimately described using complex conditional formulas of decision logic. (shrink)
