There is, on a given moral view, an agent-centered restriction against performing acts of a certain type if that view prohibits agents from performing an instance of that act-type even to prevent two or more others from each performing a morally comparable instance of that act-type. The fact that commonsense morality includes many such agent-centered restrictions has been seen by several philosophers as a decisive objection against consequentialism. Despite this, I argue that agent-centered restrictions are more plausibly accommodated within a (...) consequentialist framework than within the more standard side-constraint framework. For I argue that when we combine agent-relative consequentialism with a Kantian theory of value, we arrive at a version of consequentialism, which I call 'Kantsequentialism', that has several advantages over the standard side-constraint approach to accommodating constraints. What’s more, I argue that Kantsequentialism doesn’t have any of the disadvantages that critics of consequentializing have presumed that such a theory must have. (shrink)

According to the “Textbook View,” there is an extensional dispute between consequentialists and deontologists, in virtue of the fact that only the latter defend “agent-relative” principles—principles that require an agent to have a special concern with making sure that she does not perform certain types of action. I argue that, contra the Textbook View, there are agent-neutral versions of deontology. I also argue that there need be no extensional disagreement between the deontologist and consequentialist, as characterized by the Textbook View.

How should deontologists concerned with the ethics of killing apply their moral theory when we don’t know all the facts relevant to the permissibility of our action? Though the stakes couldn’t be higher, and uncertainty is endemic where killing is concerned, few deontologists have an answer to this question. In this paper I canvass two possibilities: that we should apply a threshold standard, equivalent to the ‘beyond a reasonable doubt’ standard applied for criminal punishment; and that we should fit our (...) deontological ethical theory into the apparatus of decision theory. I show that the first approach faces insurmountable obstacles, while the second holds much more promise for deontologists than they might first have assumed. (shrink)

I propose and defend a novel view called “de se consequentialism,” which is noteworthy for two reasons. First, it demonstrates—contra Doug Portmore, Mark Schroeder, Campbell Brown, and Michael Smith, among others—that agent-neutral consequentialism is consistent with agent-centered constraints. Second, it clarifies the nature of agent-centered constraints, thereby meriting attention from even dedicated nonconsequentialists. Scrutiny reveals that moral theories in general, whether consequentialist or not, incorporate constraints by assessing states in a first-personal guise. Consequently, de se consequentialism enacts constraints through the (...) very same feature that nonconsequentialist theories do. (shrink)

It is often assumed that morally permissible acts are morally better than impermissible acts. We call this claim Betterness of Permissibility. Yet, we show that some striking counterexamples show that the claim’s truth cannot be taken for granted. Furthermore, even if Betterness of Permissibility is true, it is unclear why. Apart from appeals to its intuitive plausibility, no arguments in favour of the condition exist. We fill this lacuna by identifying two fundamental conditions that jointly entail betterness of permissibility: ‘reasons (...) monotonicity of permissibility’ and the ‘weak classical view’. We then argue that there are good reasons for accepting both of the fundamental conditions. We note that there exist plausible moral theories that reject one of the fundamental conditions. However, the way in which those theories reject the fundamental conditions does not allow them to endorse the counterexamples that motivate the belief that Betterness of Permissibility might be false. The aim of the consequentializing project is to show that, for every plausible ethical theory, there is a version of consequentialism that is extensionally equivalent to it. One challenge this project faces is that there are common-sense ethical theories that posit moral dilemmas. There has been some speculation about how the consequentializers should react to these theories, but so far there has not been a systematic treatment of the topic. In this article, I show that there are at least five (...) ways in which we can construct versions of consequentialism that are extensionally equivalent to the ethical theories that contain moral dilemmas. I argue that all these consequentializing strategies face a dilemma: either they must posit moral dilemmas in unintuitive cases or they must rely on unsupported assumptions about value, permissions, requirements, or options. Reliabilism—the view that a belief is justified iff it is produced by a reliable process—is often characterized as a form of consequentialism. Recently, critics of reliabilism have suggested that since it is a form of consequentialism, reliabilism condones a variety of problematic trade-offs involving cases where someone forms an epistemically deficient belief now that will lead her to more epistemic value later. In the present paper, we argue that the relevant argument against reliabilism fails because it equivocates. A traditional picture is that cases of deontic constraints--- cases where an act is wrong (or one that there is most reason to not do) even though performing that act will prevent more acts of the same morally (or practically) relevant type from being performed---form a kind of fault line in ethical theory separating (agent-neutral) consequentialist theories from other ethical theories. But certain results in the recent literature, such as those due to Graham Oddie and Peter Milne in "Act and (...) Value", do not sit well this traditional wisdom. My aim in this paper is to argue that both the traditional wisdom and Oddie and Milne are mistaken. I begin by looking more closely at the traditional wisdom and why it fails (§1). Then I develop my account of this fault line in ethical theory and its importance (§2). Finally I show that a diagnosis of where Oddie and Milne go wrong follows as a corollary of this new account (§3). An important upshot will be that discussions of cases of deontic constraints would do best to focus on the account of the nature and importance of the cases identified in this paper rather than continuing to work with the mistaken traditional picture. This essay begins by describing T.M. Scanlon’s contractualism according to which an action is right when it is authorised by the moral principles no one could reasonably reject. This view has argued to have implausible consequences with regards to how different-sized groups, non-human animals, and cognitively limited human beings should be treated. It has also been accused of being theoretically redundant and unable to vindicate the so-called deontic distinctions. I then distinguish between the general contractualist framework and Scanlon’s version of (...) contractualism. I explain how the general framework enables us to formulate many other versions of contractualism some of which can already be found in the literature. Understanding contractualism in this new way enables us both to understand the structural similarities and differences between different versions of contractualism and also to see the different objections to contractualism as internal debates about which version of contractualism is correct. It is through our actions that we affect the way the world goes. Whenever we face a choice of what to do, we also face a choice of which of various possible worlds to actualize. Moreover, whenever we act intentionally, we act with the aim of making the world go a certain way. It is only natural, then, to suppose that an agent's reasons for action are a function of her reasons for preferring some of these possible worlds to others, (...) such that what she has most reason to do is to bring about the possible world which, of all those available to her, is the one that she has most reason to want to obtain. This is what is known as the `teleological conception of practical reasons'. Whether this is the correct conception of practical reasons is important not only in its own right, but also in virtue of its potential implications for what sort of moral theory we should accept. Agent-relative reasons are an important feature of any nonconsequentialist moral theory. Many authors think that they cannot be accommodated within a value-first theory that understands all value as agent-neutral. In this paper, I offer a novel explanation of agent-relative reasons that accommodates them fully within an agent-neutral value-first view. I argue that agent-relative reasons are to be understood in terms of second-order value responses: when an agent acts on an agent-relative reason, she responds appropriately to the agent-neutral value of her (...) own appropriate response to some agent-neutral value. This view helps reconcile important elements of deontology and consequentialism. (shrink)

In traditional consequentialism the good is position-neutral. A single evaluative ranking of states of affairs is correct for everyone, everywhere regardless of their positions. Recently, position-relative forms of consequentialism have been developed. These allow for the correct rankings of states to depend on connections that hold between the state being evaluated and the position of the evaluator. For example, perhaps being an agent who acts in a certain state requires me to rank that state differently from someone else who lacks (...) this connection. In this chapter several different kinds of position-relative rankings related to agents, times, physical locations, and possible worlds are explored. Arguments for and against adopting a position-relative axiology are examined, and it is suggested that position-relative consequentialism is a promising moral theory that has been underestimated. Many claim that a plausible moral theory would have to include a principle of beneficence, a principle telling us to produce goods that are both welfarist and agent‐neutral. But when we think carefully about the necessary connection between moral obligations and reasons for action, we see that agents have two reasons for action, and two moral obligations: they must not interfere with any agent's exercise of his rational capacities and they must do what they can to make sure that agents (...) have rational capacities to exercise. According to this distinctively deontological view of morality, though we are obliged to produce goods, the goods in question are non‐welfarist and agent‐relative. The value of welfare thus turns out to be, at best, instrumental. (shrink)

Agent-relative consequentialism is thought attractive because it can secure agent-centred constraints while retaining consequentialism's compelling idea—the idea that it is always permissible to bring about the best available outcome. We argue, however, that the commitments of agent-relative consequentialism lead it to run afoul of a plausibility requirement on moral theories. A moral theory must not be such that, in any possible circumstance, were every agent to act impermissibly, each would have more reason to prefer the world thereby actualized over the (...) world that would have been actualized if every agent had instead acted permissibly. A lengthy reply to 13 critical discussions of _Meaning in Life: An Analytic Study_ collected in an e-book and reprinted from the _Journal of Philosophy of Life_. The contributors are from a variety of philosophical traditions, including the Anglo-American, Continental and East Asian (especially Buddhist and Japanese) ones.

I outline a dilemma for Derek Parfit’s project to vindicate moral realism. In On What Matters, Parfit argues that the best versions of three of the main moral traditions agree on a set of moral principles, which should make us more confident about the prospects of truth in ethics. I show that the result of this Convergence Argument can be interpreted in two ways. Either there remain three separate and deontically equivalent theories or there remains just one theory, the Triple (...) Theory. Both interpretations fail to deliver what Parfit is looking for. The first interpretation leads to a situation of underdetermination of theory choice that gives rise to a skeptical challenge. The second interpretation jettisons Parfit’s Conciliatory Project, that is, the reconciliation of the three moral traditions. The dilemma, I contend, is the result of Parfit failing to resolve two antithetical lines of thought. His search for the Trinity of moral theorizing must thus fail. (shrink)

There are a number of assumptions made in our accepted psychology of moral decision-making that consequentialism seems to violate:: value connectionism, pluralism and dispositionalism. But consequentialism violates them only on a utilitarian or similar theory of value, not on the rival sort of theory that is sketched here.

What is the connection between moral rights and the good? While familiar normative theories give justificatory precedence to one notion over the other, this paper explores a neglected alternative: when properly specified, the notion of moral rights and of the good conceptually depend on each other.1.

Why ought we to perform the actions that we ought to perform? We can categorize the various answers to this question depending on whether they hold that the oughts governing actions are explained by the oughts governing non-actions. In this essay, I show how a handful of plausible claims from normative ethics, moral psychology, and the philosophy of action entail the conclusion that what an agent ought to do is explained by the attitudes she ought to have.

This article responds to Barry Maguire's recent attempt to justify partiality within a consequentialist framework.

Frank Jackson, Michael Smith, and Philip Pettit contend in their 2000 paper that an argument from supervenience deals a fatal blow to shapeless moral particularism, the view that the moral is shapeless with respect to the natural. A decade has passed since the Canberrans advanced their highly influential supervenience argument. Yet, there has not been any compelling counter-argument against it, as far as I can see. My aim in this paper is to fill in this void and defend SMP against (...) the Canberrans’ supervenience argument. Such being the case, I will firstly re-construct the Canberrans’ supervenience argument in detail and push it as far as it can go. In fact, I will defend it against a number of existing objections respectively from Garfield, Dancy, and McDowell. Next, I will argue, however, that the supervenience argument, despite its initial plausibility, has one major pitfall: it hinges on an overly permissive conception of ‘shape’ such that it does not generate the right kind of moral principles the shapeless moral particularists are concerned to refute. I thus conclude that the seemingly scathing supervenience argument turns out to be toothless against SMP. Although this would not prove SMP to be right, for it might attract criticisms from other fronts, yet, until they come up, SMP, contrary to prevalent conceptions, remains alive and kicking. (shrink)

This dissertation is about the partiality problem for fitting attitude (FA) analyses of value. More specifically, it is about whether and how the problem might be resolved. In Chapter 1, I set the stage by offering a short introduction to the topic and a rationale for investigating it. I then give a more detailed account of FA analyses of value in Chapter 2, including a brief outline of their history and appeal, before explaining more thoroughly just what the partiality problem (...) is for such analyses in Chapter 3, where I distinguish between several different versions of the problem, identify two broad strategies for resolving it and put forward six evaluation criteria in terms of which the plausibility of a resolution can be assessed. According to FA analyses of value, what it is for something to have value is, roughly, for it to be fitting to have a certain sort of attitude toward it. To have a positive value, such as being good, is to be something that it is fitting to favor (to have a pro-attitude toward); to have a negative value, such as being bad, is to be something that it is fitting to disfavor (to have a con-attitude toward); and to have a relational or comparative value like being better than, worse than, equally good as or equally bad as something else is to be something that it is fitting to favor more than, disfavor more than, favor equally much as or disfavor equally much as the other thing. The partiality problem is, roughly, that there are situations in which two things seem to have equal value, which, if things are as they seem and FA analyses of value are correct, means that it is fitting to respond to them equally – to be impartial between them. However, in these situations, there are some people for whom it does not seem fitting to respond in that way because they stand in a certain relationship to one of the bearers of value. For these people, it seems that the fitting response is an unequal or partial response, not an impartial one. If such intuitions about fitting partiality and value are veridical, then how can FA analyses of value be correct? The rest of the dissertation is then a critical, in-depth study of a wide range of responses to the partiality problem. In Chapter 4, I examine the first of the two response strategies, which is to deny the veracity of at least one of the intuitions that generate the problem without making any changes to the FA analyses themselves. I then turn to the second strategy, which is to try to accommodate the intuitions by revising the FA analyses in some suitable manner. In Chapters 5–13, I consider the possibility and plausibility of solving the problem by revising the FA analyses on the basis of: the distinction between intrinsic and extrinsic properties (Chapter 5), the notion of basic value (Chapter 6), the notion of agent-relative value (Chapter 7), the notion of an impartial observer (Chapter 8), the distinction between moral and non-moral fittingness (Chapter 9), a sui generis notion of fittingness (Chapter 10), the distinction between pro tanto and overall fittingness (Chapter 11), the distinction between actions and attitudes (Chapter 12) and the notions of evaluative distance and perspective (Chapter 13). My assessment is that none of these responses is entirely plausible. Thus, in Chapter 14, I conclude that although the partiality problem may not be irresolvable, it is yet to receive a fully plausible resolution. I also discuss the ramifications of this conclusion.
