Research on the ethics of algorithms has grown substantially over the past decade. Alongside the exponential development and application of machine learning algorithms, new ethical problems and solutions relating to their ubiquitous use in society have been proposed. This article builds on a review of the ethics of algorithms published in 2016, 2016). The goals are to contribute to the debate on the identification and analysis of the ethical implications of algorithms, to provide an updated analysis of epistemic and normative (...) concerns, and to offer actionable guidance for the governance of the design, development and deployment of algorithms. Recently, there has been much discussion of ‘fair machine learning’: fairness in data-driven decision-making systems (which are often, though not always, made with assistance from machine learning systems). Notorious impossibility results show that we cannot have everything we want here. Such problems call for careful thinking about the foundations of fair machine learning. Sune Holm has identified one promising way forward, which involves applying John Broome's theory of fairness to the puzzles of fair machine learning. Unfortunately, his application of Broome's (...) theory appears to be fatally flawed. This article attempts to rescue Holm's central insight – namely, that Broome's theory can be useful to the study of fair machine learning – by giving an alternative application of Broome's theory, which involves thinking about fair machine learning in counterfactual (as opposed to merely statistical) terms. This paper argues that instituting Citizen Boards of Governance (CBGs) is the optimal strategy to democratically contain Big Tech’s algorithmic powers in the digital public sphere. CBGs are bodies of randomly selected citizens that are authorized to govern the algorithmic infrastructure of Big Tech platforms. The main advantage of CBGs is to tackle the concentrated powers of private tech corporations without giving too much power to governments. I show why this is a better approach than ordinary state regulation or relying (...) on market mechanisms. My proposal follows from the critique of Big Tech’s concentrated powers, and explains how this justifies democratizing algorithms in the digital public sphere. My approach thus speaks to a core commitment in democratic theory: enhancing the autonomy of the public sphere from the centers of powers in modern societies, be it corporations or governments. This paper argues against the call to democratize artificial intelligence (AI). Several authors demand to reap purported benefits that rest in direct and broad participation: In the governance of AI, more people should be more involved in more decisions about AI—from development and design to deployment. This paper opposes this call. The paper presents five objections against broadening and deepening public participation in the governance of AI. The paper begins by reviewing the literature and carving out a set of claims (...) that are associated with the call to “democratize AI”. It then argues that such a democratization of AI (1) rests on weak grounds, because it does not answer to a demand of legitimization, (2) is redundant in that it overlaps with existing governance structures, (3) is resource intensive, which leads to injustices, (4) is morally myopic and thereby creates popular oversights and moral problems of its own, and finally, (5) is neither theoretically nor practically the right kind of response to the injustices that animate the call. The paper concludes by suggesting that AI should be democratized not by broadening and deepening participation but by increasing the democratic quality of the administrative and executive elements of collective decision making. The demands of fair machine learning are often expressed in probabilistic terms. Yet, most of the systems of concern are deterministic in the sense that whether a given subject will receive a given score on the basis of their traits is, for all intents and purposes, either zero or one. What, then, can justify this probabilistic talk? We argue that the statistical reference classes used in fairness measures can be understood as defining the probability that hypothetical persons, who are representative (...) of social roles, will receive certain goods. We call these hypothetical persons “representative individuals.” We claim that what we owe to actual, concrete individuals—whose individual chances of receiving the good in the system might be extreme (i.e., either zero or one)—is that their representative individual has an appropriate probability of receiving the good in question. While less immediately intuitive than other approaches, we argue that the representative individual approach has important advantages over other ways of making sense of this probabilistic talk in the context of fair machine learning. The increasing implementation of and reliance on machine-learning (ML) algorithms to perform tasks, deliver services and make decisions in health and healthcare have made the need for fairness in ML, and more specifically in healthcare ML algorithms (HMLA), a very important and urgent task. However, while the debate on fairness in the ethics of artificial intelligence (AI) and in HMLA has grown significantly over the last decade, the very concept of fairness as an ethical value has not yet been sufficiently (...) explored. Our paper aims to fill this gap and address the AI ethics principle of fairness from a conceptual standpoint, drawing insights from accounts of fairness elaborated in moral philosophy and using them to conceptualise fairness as an ethical value and to redefine fairness in HMLA accordingly. To achieve our goal, following a first section aimed at clarifying the background, methodology and structure of the paper, in the second section, we provide an overview of the discussion of the AI ethics principle of fairness in HMLA and show that the concept of fairness underlying this debate is framed in purely distributive terms and overlaps with non-discrimination, which is defined in turn as the absence of biases. After showing that this framing is inadequate, in the third section, we pursue an ethical inquiry into the concept of fairness and argue that fairness ought to be conceived of as an ethical value. Following a clarification of the relationship between fairness and non-discrimination, we show that the two do not overlap and that fairness requires much more than just non-discrimination. Moreover, we highlight that fairness not only has a distributive but also a socio-relational dimension. Finally, we pinpoint the constitutive components of fairness. In doing so, we base our arguments on a renewed reflection on the concept of respect, which goes beyond the idea of equal respect to include respect for individual persons. In the fourth section, we analyse the implications of our conceptual redefinition of fairness as an ethical value in the discussion of fairness in HMLA. Here, we claim that fairness requires more than non-discrimination and the absence of biases as well as more than just distribution; it needs to ensure that HMLA respects persons both as persons and as particular individuals. Finally, in the fifth section, we sketch some broader implications and show how our inquiry can contribute to making HMLA and, more generally, AI promote the social good and a fairer society. Efforts to promote equitable public policy with algorithms appear to be fundamentally constrained by the “impossibility of fairness” (an incompatibility between mathematical definitions of fairness). This technical limitation raises a central question about algorithmic fairness: How can computer scientists and policymakers support equitable policy reforms with algorithms? In this article, I argue that promoting justice with algorithms requires reforming the methodology of algorithmic fairness. First, I diagnose the problems of the current methodology for algorithmic fairness, which I call “formal algorithmic (...) fairness.” Because formal algorithmic fairness restricts analysis to isolated decision-making procedures, it leads to the impossibility of fairness and to models that exacerbate oppression despite appearing “fair.” Second, I draw on theories of substantive equality from law and philosophy to propose an alternative methodology, which I call “substantive algorithmic fairness.” Because substantive algorithmic fairness takes a more expansive scope of analysis, it enables an escape from the impossibility of fairness and provides a rigorous guide for alleviating injustice with algorithms. In sum, substantive algorithmic fairness presents a new direction for algorithmic fairness: away from formal mathematical models of “fair” decision-making and toward substantive evaluations of whether and how algorithms can promote justice in practice. What does it mean for algorithmic classifications to be fair to different socially salient groups? According to classification parity criteria, what is required is equality across groups with respect to some performance measure such as error rates. Critics of classification parity object that classification parity entails that achieving fairness may require us to choose an algorithm that makes no group better off and some groups worse off than an alternative. In this article, I interpret the problem of algorithmic fairness as (...) a case concerning the ethics of the distribution of algorithmic classifications across groups (as opposed to, e.g., the fairness of data collection). I begin with a short introduction of algorithmic fairness as a problem discussed in machine learning. I then show how the criticism raised against classification parity is a form of leveling down objection, and I interpret the egalitarianism of classification parity as deontic egalitarianism. I then discuss a challenge to this interpretation and suggest a revision. Finally, I examine how my interpretation provides proponents of classification parity with a response to the leveling down criticism and how it relates to a recent suggestion to evaluate fairness for automated decision-making systems based on risk and welfare considerations from behind a veil of ignorance. In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

In this article, I show why it is necessary to abolish the use of predictive algorithms in the US criminal justice system at sentencing. After presenting the functioning of these algorithms in their context of emergence, I offer three arguments to demonstrate why their abolition is imperative. First, I show that sentencing based on predictive algorithms induces a process of rewriting the temporality of the judged individual, flattening their life into a present inescapably doomed by its past. Second, I demonstrate (...) that recursive processes, comprising predictive algorithms and the decisions based on their predictions, systematically suppress outliers and progressively transform reality to match predictions. In my third and final argument, I show that decisions made on the basis of predictive algorithms actively perform a biopolitical understanding of justice as management and modulation of risks. In such a framework, justice becomes a means to maintain a perverse social homeostasis that systematically exposes disenfranchised Black and Brown populations to risk. (shrink)

In response to calls for greater interdisciplinary involvement from the social sciences and humanities in the development, governance, and study of artificial intelligence systems, this paper presents one sociologist’s view on the problem of algorithmic bias and the reproduction of societal bias. Discussions of bias in AI cover much of the same conceptual terrain that sociologists studying inequality have long understood using more specific terms and theories. Concerns over reproducing societal bias should be informed by an understanding of the ways (...) that inequality is continually reproduced in society—processes that AI systems are either complicit in, or can be designed to disrupt and counter. The contrast presented here is between conservative and radical approaches to AI, with conservatism referring to dominant tendencies that reproduce and strengthen the status quo, while radical approaches work to disrupt systemic forms of inequality. The limitations of a conservative approach to racial bias are discussed through the specific example of biased criminal risk assessments and Indigenous overrepresentation in Canada’s criminal justice system. This illustrates the dangers of treating racial bias as a generalizable problem and equality as a generalizable solution, emphasizing the importance of considering inequality in context. Societal issues can no longer be out of scope for AI and machine learning, given the impact of these systems on human lives. This requires engagement with a growing body of critical AI scholarship that goes beyond biased data to analyze structured ways of perpetuating inequality, opening up the possibility for interdisciplinary engagement and radical alternatives. Fairness is one of the most prominent values in the Ethics and Artificial Intelligence (AI) debate and, specifically, in the discussion on algorithmic decision-making (ADM). However, while the need for fairness in ADM is widely acknowledged, the very concept of fairness has not been sufficiently explored so far. Our paper aims to fill this gap and claims that an ethically informed re-definition of fairness is needed to adequately investigate fairness in ADM. To achieve our goal, after an introductory section aimed (...) at clarifying the aim and structure of the paper, in section “Fairness in algorithmic decision-making” we provide an overview of the state of the art of the discussion on fairness in ADM and show its shortcomings; in section “Fairness as an ethical value”, we pursue an ethical inquiry into the concept of fairness, drawing insights from accounts of fairness developed in moral philosophy, and define fairness as an ethical value. In particular, we argue that fairness is articulated in a distributive and socio-relational dimension; it comprises three main components: fair equality of opportunity, equal right to justification, and fair equality of relationship; these components are grounded in the need to respect persons both as persons and as particular individuals. In section “Fairness in algorithmic decision-making revised”, we analyze the implications of our redefinition of fairness as an ethical value on the discussion of fairness in ADM and show that each component of fairness has profound effects on the criteria that ADM ought to meet. Recent advances in artificial intelligence offer many beneficial prospects. However, concerns have been raised about the opacity of decisions made by these systems, some of which have turned out to be biased in various ways. This article makes a contribution to a growing body of literature on how to make systems for automated decision-making more transparent, explainable, and fair by drawing attention to and further elaborating a distinction first made by Nozick between first-level bias in the application of standards and (...) second-level bias in the choice of standards, as well as a second distinction between discrimination and arbitrariness. Applying the typology developed, a number of illuminating observations are made. First, it is observed that some reported bias in automated decision-making is first-level arbitrariness, which can be alleviated by explainability techniques. However, such techniques have only a limited potential to alleviate first-level discrimination. Second, it is argued that second-level arbitrariness is probably quite common in automated decision-making. In contrast to first-level arbitrariness, however, second-level arbitrariness is not straightforward to detect automatically. Third, the prospects for alleviating arbitrariness are discussed. It is argued that detecting and alleviating second-level arbitrariness is a profound problem because there are many contrasting and sometimes conflicting standards from which to choose, and even when we make intentional efforts to choose standards for good reasons, some second-level arbitrariness remains. Responsible innovation in artificial intelligence calls for public deliberation: well-informed “deep democratic” debate that involves actors from the public, private, and civil society sectors in joint efforts to critically address the goals and means of AI. Adopting such an approach constitutes a challenge, however, due to the opacity of AI and strong knowledge boundaries between experts and citizens. This undermines trust in AI and undercuts key conditions for deliberation. We approach this challenge as a problem of situating the knowledge of (...) actors from the AI industry within a deliberative system. We develop a new framework of responsibilities for AI innovation as well as a deliberative governance approach for enacting these responsibilities. In elucidating this approach, we show how actors from the AI industry can most effectively engage with experts and nonexperts in different social venues to facilitate well-informed judgments on opaque AI systems and thus effectuate their democratic governance. Intelligent algorithms together with various machine learning techniques hold a dominant position among major challenges for contemporary value sensitive design. Self-learning capabilities of current AI applications blur the causal link between programmer and computer behavior. This creates a vital challenge for the design, development and implementation of digital technologies nowadays. This paper seeks to provide an account of this challenge. The main question that shapes the current analysis is the following: What conceptual tools can be developed within the value sensitive (...) design school of thought for evaluating machine learning algorithms where the causal relation between designers and the behavior of their computer systems has been eroded? The answer to this question will be provided through two levels of investigation within the value sensitive design methodology. The first level is conceptual. Within the conceptual level, we will introduce the notion of computer intentionality and will show how this term may be used for solving an issue of non-causal relation between designer and computer system. The second level of investigation is technical. At this level the emphasis will be given to machine learning algorithms. (shrink)

The now well-known impossibility results of algorithmic fairness demonstrate that an error-prone predictive model cannot simultaneously satisfy two plausible conditions for group fairness apart from exceptional circumstances where groups exhibit equal base rates. The results sparked, and continue to shape, lively debates surrounding algorithmic fairness conditions and the very possibility of building fair predictive models. This article, first, highlights three underlying points of disagreement in these debates, which have led to diverging assessments of the feasibility of fairness in prediction-based decision-making. (...) Second, the article explores whether and in what sense fairness as defined by the conjunction of the implicated fairness conditions is (un)attainable. Drawing on philosophical literature on the concept of feasibility and the role of feasibility in normative theory, I outline a cautiously optimistic argument for the _diachronic feasibility_ of fairness. In line with recent works on the topic, I argue that fairness can be _made possible_ through collective efforts to eliminate inequalities that feed into local decision-making procedures. (shrink)

Digital Twins are conceptualised in the academic technical discourse as real-time realistic digital representations of physical entities. Originating from product engineering, the Digital Twin quickly advanced into other fields, including the life sciences and earth sciences. Digital Twins are seen by the tech sector as the new promising tool for efficiency and optimisation, while governmental agencies see it as a fruitful means for improving decision-making to meet sustainability goals. A striking example of the latter is the European Commission who wishes (...) to delegate a significant role to Digital Twins in addressing climate change and supporting Green Deal policy. As Digital Twins give rise to high expectations, ambitions, and are being entrusted important societal roles, it is crucial to critically reflect on the nature of Digital Twins. In this article, we therefore philosophically reflect on Digital Twins by critically analysing dominant conceptualisations, the assumptions underlying them, and their normative implications. We dissect the concept and argue that a Digital Twin does not merely fulfil the role of being a representation, but is in fact a steering technique used to direct a physical entity towards certain goals by means of multiple representations. Currently, this steering seems mainly fuelled by a reductionist approach focused on efficiency and optimisation. However, this is not the only direction from which a Digital Twin can be thought and, consequently, designed and deployed. We therefore set an agenda based on a critical understanding of Digital Twins that helps to draw out their beneficial potential, while addressing their potential issues. (shrink)

The call to make artificial intelligence (AI) more democratic, or to “democratize AI,” is sometimes framed as a promising response for mitigating algorithmic injustice or making AI more aligned with social justice. However, the notion of “democratizing AI” is elusive, as the phrase has been associated with multiple meanings and practices, and the extent to which it may help mitigate algorithmic injustice is still underexplored. In this paper, based on a socio-technical understanding of algorithmic injustice, I examine three notable notions (...) of democratizing AI and their associated measures—democratizing AI use, democratizing AI development, and democratizing AI governance—regarding their respective prospects and limits in response to algorithmic injustice. My examinations reveal that while some versions of democratizing AI bear the prospect of mitigating the concern of algorithmic injustice, others are somewhat limited and might even function to perpetuate unjust power hierarchies. This analysis thus urges a more fine-grained discussion on how to democratize AI and suggests that closer scrutiny of the power dynamics embedded in the socio-technical structure can help guide such explorations. Recently, amid growing awareness that computer algorithms are not neutral tools but can cause harm by reproducing and amplifying bias, attempts to detect and prevent such biases have intensified. An approach that has received considerable attention in this regard is the Value Sensitive Design (VSD) methodology, which aims to contribute to both the critical analysis of (dis)values in existing technologies and the construction of novel technologies that account for specific desired values. This article provides a brief overview of the key (...) features of the Value Sensitive Design approach, examines its contributions to understanding and addressing issues around bias in computer systems, outlines the current debates on algorithmic bias and fairness in machine learning, and discusses how such debates could profit from VSD-derived insights and recommendations. Relating these debates on values in design and algorithmic bias to research on cognitive biases, we conclude by stressing our collective duty to not only detect and counter biases in software systems, but to also address and remedy their societal origins. Today, a major technological trend is the increasing focus on the person: technical systems personalize, customize, and tailor to the person in both beneficial and troubling ways. This trend has moved beyond the realm of commerce and has become a matter of public governance, where systems for citizen risk scoring, predictive policing, and social credit scores proliferate. What these systems have in common is that they may target the person and her ethical and political dispositions, her virtues. Virtue ethics is (...) the most appropriate approach for evaluating the impacts of these new systems, which has translated in a revival of talk about virtue in technology ethics. Yet, the focus on individual dispositions has rightly been criticized for lacking a concern with the political collective and institutional structures. This paper advocates a new direction of research into civic virtue, which is situated in between personal dispositions and structures of governance. First, it surveys the discourse on virtue ethics of technology, emphasizing its neglect of the political dimension of impacts of emerging technologies. Second, it presents a pluralist conception of civic virtue that enables us to scrutinize the impact of technology on civic virtue on three different levels of reciprocal reputation building, the cultivation of internal goods, and excellence in the public sphere. Third, it illustrates the benefits of this conceptions by discussing some paradigmatic examples of emerging technologies that aim to cultivate civic virtue. (shrink)

In various official documents, the European Union has declared its goal to pursue a citizen-centric governance of digital transformation. Through a critical review of several of these documents, here we show how “citizen-centric” is more a glamouring than a driving concept. De facto, the EU is enabling a federated data system that is corporate-driven, economic-oriented, and GDPR-compliant; in other words, a Digital Single Market (DSM). This leaves out societal and collective-level dimensions of digital transformation—such as social inclusion, digital sovereignty, and (...) environmental sustainability—which are acknowledged, but not operationalized, by the EU as pillars of a citizen-centric governance. Hence, the door is open to a complementary approach to the governance of digital transformation. We argue that, while a federated data model can constitute the tech-legal backbone of the emerging DSM, a commoning of data, as an ecosystemic approach that maintains a societal and collective outlook by default, can represent a complement to enact a truly citizen-centric governance. An Artificial Intelligence algorithm trained on data that reflect racial biases may yield racially biased outputs, even if the algorithm on its own is unbiased. For example, algorithms used to schedule medical appointments in the USA predict that Black patients are at a higher risk of no-show than non-Black patients, though technically accurate given existing data that prediction results in Black patients being overwhelmingly scheduled in appointment slots that cause longer wait times than non-Black patients. This perpetuates racial inequity, in (...) this case lesser access to medical care. This gives rise to one type of Accuracy-Fairness trade-off: preserve the efficiency offered by using AI to schedule appointments or discard that efficiency in order to avoid perpetuating ethno-racial disparities. Similar trade-offs arise in a range of AI applications including others in medicine, as well as in education, judicial systems, and public security, among others. This article presents a framework for addressing such trade-offs where Machine Learning and Optimization components of the algorithm are decoupled. Applied to medical appointment scheduling, our framework articulates four approaches intervening in different ways on different components of the algorithm. Each yields specific results, in one case preserving accuracy comparable to the current state-of-the-art while eliminating the disparity. (shrink)

AgeTech involves the use of emerging technologies to support the health, well-being and independent living of older adults. In this paper we focus on how AgeTech based on artificial intelligence (AI) may better support older adults to remain in their own living environment for longer, provide social connectedness, support wellbeing and mental health, and enable social participation. In order to assess and better understand the positive as well as negative outcomes of AI-based AgeTech, a critical analysis of ethical design, digital (...) equity, and policy pathways is required. A crucial question is how AI-based AgeTech may drive practical, equitable, and inclusive multilevel solutions to support healthy, active ageing. In our paper, we aim to show that a focus on equity is key for AI-based AgeTech if it is to realize its full potential. We propose that equity should not just be an extra benefit or minimum requirement, but the explicit aim of designing AI-based health tech. This means that social determinants that affect the use of or access to these technologies have to be addressed. We will explore how complexity management as a crucial element of AI-based AgeTech may potentially create and exacerbate social inequities by marginalising or ignoring social determinants. We identify bias, standardization, and access as main ethical issues in this context and subsequently, make recommendations as to how inequities that stem form AI-based AgeTech can be addressed. Medical artificial intelligence (AI) systems are value-laden technologies that can simultaneously encourage and discourage conflicting values that may all be relevant for the pursuit of justice. I argue that the predominant theory of healthcare justice, the Rawls-inspired approach of Norman Daniels, neither adequately acknowledges such conflicts nor explains if and how they can resolved. By juxtaposing Daniels’s theory of healthcare justice with Axel Honneth’s and Nancy Fraser’s respective theories of justice, I draw attention to one such conflict. Medical AI may (...) improve the distribution of opportunity qua health while simultaneously mis-recognizing patients and thereby reducing their self-respect. I argue that justly resolving this conflict will at times require greater inclusion of those mis-recognized in deliberation about medical AI, and consider what such inclusion may entail. (shrink)

In the past few years, calls for integrating ethics modules in engineering curricula have multiplied. Despite this positive trend, a number of issues with these ‘embedded’ programs remains. First, learning goals are underspecified. A second limitation is the conflation of different dimensions under the same banner, in particular confusion between ethics curricula geared towards addressing the ethics of individual conduct and curricula geared towards addressing ethics at the societal level. In this article, we propose a tripartite framework to overcome these (...) difficulties. Our framework analytically decomposes an ethics module into three dimensions. First, there is the ethical dimension, which pertains to the learning goals. Second, there is the moral dimension, which addresses the moral relevance of engineers’ conduct. Finally, there is the political dimension, which scales up issues of moral relevance at the civic level. All in all, our framework has two advantages. First, it provides analytic clarity, i.e. it enables course instructors to locate ethical dilemmas in either the moral or political realm and to make use of the tools and resources from moral and/or political philosophy. Second, it depicts a comprehensive ethical training, which enables students to both reason about moral issues in the abstract, and to socially contextualize potential solutions. (shrink)

The rapid progress of artificial intelligence (AI) has resulted in its integration into various stages of the media process, including information gathering, processing, and distribution. This integration has raised the possibility of AI dominating the media industry, leading to an era of “autonomous driving” within AI-driven media systems. Similar to the ethical dilemma known as the “trolley problem” (TP) in autonomous driving, a comparable problem arises in AI automated media. This study examines the emergence of the new TP in fully (...) automated AI-driven media (FAAIM), recognizing the complexity of this problem given the nature of media content and its societal impact. To address this complexity, we propose the adoption of the theory of “meaningful human control,” originally developed to address responsibility in the governance of lethal autonomous weapons systems, as a framework for governing FAAIM. By ensuring that humans can be held responsible for the operations of FAAIM, this paper aims to proactively confront the ethical challenges arising from FAAIM, identify potential solutions, and guide future research in media ethics. Despite the widespread use of automated decision-making (ADM) systems, they are often developed without involving the public or those directly affected, leading to concerns about systematic biases that may perpetuate structural injustices. Existing formal fairness approaches primarily focus on statistical outcomes across demographic groups or individual fairness, yet these methods reveal ambiguities and limitations in addressing fairness comprehensively. This paper argues for a holistic approach to algorithmic fairness that integrates procedural fairness, considering both decision-making processes and their outcomes. Procedural fairness (...) emphasizes the importance of fair decision-making procedures, which aligns with theories of relational justice that stress the quality of social relations and power dynamics. We highlight the need for substantive procedural fairness to ensure better outcomes and address forward-looking responsibilities. Additionally, we propose leveraging Public Engagement, a core dimension within the well-established Responsible Research and Innovation framework, to enhance procedural fairness in ADM systems. Our contribution underscores the value of Public Engagement in fostering fairer ADM processes, thereby expanding the current focus beyond technical outcome-based approaches to encompass broader procedural considerations. In an era defined by the global surge in the adoption of AI-enabled technologies within public administration, the promises of efficiency and progress are being overshadowed by instances of deepening social inequality, particularly among vulnerable populations. To address this issue, we argue that democratizing AI is a pivotal step toward fostering trust, equity, and fairness within our societies. This article navigates the existing debates surrounding AI democratization but also endeavors to revive and adapt the historical social justice framework, maximum feasible (...) participation, for contemporary participatory applications in deploying AI-enabled technologies in public administration. In our exploration of the multifaceted dimensions of AI’s impact on public administration, we provide a roadmap that can lead beyond rhetoric to practical solutions in the integration of AI in public administration. Artificial intelligence (AI) is a powerful tool for several healthcare tasks. AI tools are suited to optimize predictive models in medicine. Ethical debates about AI’s extension of the predictive power of medical models suggest a need to adapt core principles of medical ethics. This article demonstrates that a popular interpretation of the principle of justice in healthcare needs amendment given the effect of AI on decision-making. The procedural approach to justice, exemplified with Norman Daniels and James Sabin’s accountability for reasonableness (...) conception, needs amendment because, as research into algorithmic fairness shows, it is insufficiently sensitive to differential effects of seemingly just principles on different groups of people. The same line of research generates methods to quantify differential effects and make them amenable for correction. Thus, what is needed to improve the principle of justice is a combination of procedures for selecting just criteria and principles and the use of algorithmic tools to measure the real impact these criteria and principles have. In this article, the author shows that algorithmic tools do not merely raise issues of justice but can also be used in their mitigation by informing us about the real effects certain distributional principles and criteria would create. Modern society makes extensive use of automated algorithmic decisions, fueled by advances in artificial intelligence. However, since these systems are not perfect, questions about fairness are increasingly investigated in the literature. In particular, many authors take a Rawlsian approach to algorithmic fairness. Based on complications with this approach identified in the literature, this article discusses how Rawls’s theory in general, and especially the difference principle, should reasonably be applied to algorithmic fairness decisions. It is observed that proposals to achieve Rawlsian (...) algorithmic fairness often aim to uphold the difference principle in the individual situations where automated decision-making occurs. However, the Rawlsian difference principle applies to society at large and does not aggregate in such a way that upholding it in constituent situations also upholds it in the aggregate. But such aggregation is a hidden premise of many proposals in the literature and its falsity explains many complications encountered. (shrink)

In this paper we make the case for the emergence of novel kind of bias with the use of algorithmic decision-making systems. We argue that the distinctive generative process of feature creation, characteristic of machine learning (ML), contorts feature parameters in ways that can lead to emerging feature spaces that encode novel algorithmic bias involving already marginalized groups. We term this bias _assembled bias._ Moreover, assembled biases are distinct from the much-discussed algorithmic bias, both in source (training data versus feature (...) creation) and in content (mimics of extant societal bias versus reconfigured categories). As such, this problem is distinct from issues arising from bias-encoding training feature sets or proxy features. Assembled bias is not epistemically transparent in source or content. Hence, when these ML models are used as a basis for decision-making in social contexts, algorithmic fairness concerns are compounded. (shrink)

Algorithmic systems are increasingly used by state agencies to inform decisions about humans. They produce scores on risks of recidivism in criminal justice, indicate the probability for a job seeker to find a job in the labor market, or calculate whether an applicant should get access to a certain university program. In this contribution, we take an interdisciplinary perspective, provide a bird’s eye view of the different key decisions that are to be taken when state actors decide to use an (...) algorithmic system, and illustrate these decisions with empirical examples from case studies. Building on these insights, we discuss the main pitfalls and promises of the use of algorithmic system by the state and focus on four levels: The most basic question whether an algorithmic system should be used at all, the regulation and governance of the system, issues of algorithm design, and, finally, questions related to the implementation of the system on the ground and the human–machine-interaction that comes with it. Based on our assessment of the advantages and challenges that arise at each of these levels, we propose a set of crucial questions to be asked when such intricate matters are addressed. (shrink)

Purpose This study aims to develop an interdisciplinary political theory of data justice by connecting three major political theories of the public good with empirical studies about the functions of big data and offering normative principles for restricting and guiding the state’s data practices from a public good perspective. Design/methodology/approach Drawing on three major political theories of the public good – the market failure approach, the basic rights approach and the democratic approach – and critical data studies, this study synthesizes (...) existing studies on the promises and perils of big data for public good purposes. The outcome is a conceptual paper that maps philosophical discussions about the conditions under which the state has a legitimate right to collect and use big data for public goods purposes. Findings This study argues that market failure, basic rights protection and deepening democracy can be normative grounds for justifying the state’s right to data collection and utilization, from the perspective of political theories of the public good. The state’s data practices, however, should be guided by three political principles, namely, the principle of transparency and accountability; the principle of fairness; and the principle of democratic legitimacy. The paper draws on empirical studies and practical examples to explicate these principles. Originality/value Bringing together normative political theory and critical data studies, this study contributes to a more philosophically rigorous understanding of how and why big data should be used for public good purposes while discussing the normative boundaries of such data practices.
