The theory of justice is one of the most intensely debated areas of contemporary philosophy. Most theories of justice, however, have only attained their high level of justification at great cost. By focusing on purely normative, abstract principles, they become detached from the sphere that constitutes their “field of application” - namely, social reality. Axel Honneth proposes a different approach. He seeks to derive the currently definitive criteria of social justice directly from the normative claims that have developed within Western (...) liberal democratic societies. These criteria and these claims together make up what he terms “democratic ethical life”: a system of morally legitimate norms that are not only legally anchored, but also institutionally established. Honneth justifies this far-reaching endeavour by demonstrating that all essential spheres of action in Western societies share a single feature, as they all claim to realize a specific aspect of individual freedom. In the spirit of Hegel’s _Philosophy of Right_ and guided by the theory of recognition, Honneth shows how principles of individual freedom are generated which constitute the standard of justice in various concrete social spheres: personal relationships, economic activity in the market, and the political public sphere. Democratic politics might be defined as the agonistic struggle of different parties, groups or individuals over resources, recognition and influence under reciprocal and inclusive conditions. It is based on an unconditional orientation to equality as well as freedom of all those involved to consent to - or dissent from - the norms, policies and practices that are established in the process of public dialogue. This article reconstructs the general agent-based capabilities required for a democratically defined public sphere under conditions of (...) globalization. Making capabilities central is intended to correct a certain over-emphasis regarding institutional macro-structures in the discourse on globalization and cosmopolitanism. After setting the stage with a critical analysis of Martha Nussbaum’s concept of capabilities, the analysis proceeds in two major steps. In the first part, a notion of hermeneutic agency is introduced that avoids a Foucauldian reduction of agency to power structures, while thoroughly situating agency in a symbolically mediated social context. The symbolic mediation of agency is, in the second part, taken as a ground of potentiality for reflexive capabilities that, once actualized and enacted, allow for a normatively satisfying process of public deliberation. The aim of the analysis is to relate a normative model of value-orientation to the linguistically grounded empirical resources of social agents. The core argument lays out as basic capabilities (1) to be able to normatively orient oneself at contextually defined yet universally open postconventional commitments, (2) to be able to engage in an interpretive and dialogical perspective-taking vis-a-vis differently situated agents and backgrounds, and (3) to be able to critically distance oneself from one’s taken-for-granted assumptions and background structures via a power-alert social reflexivity. O artigo trata da questão dos direitos humanos quanto ao potencial de consenso entre culturas através do diálogo intercultural. Trata-se de uma contribuição para superar os confrontos entre civilizações e a imposição coercitiva de direitos humanos sobre outras culturas. O paper mostra que a promoção intercultural de direitos humanos entre culturas individuais que se reconhecem mutuamente é uma das formas efetivas de resistência contra a falta de reconhecimento. Todavia, é mister uma formulação dos direitos humanos embasada nos valores de culturas (...) individuais e no diálogo entre elas. A interpretação aqui adotada é uma contribuição para criar ‘unidade na pluralidade’, i.e. uma universalidade de direitos humanos dentro da pluralidade de culturas. (shrink)

The paper summarizes current knowledge on the paleographical evidence for rén 仁 and its earliest variants. It is argued that no reliable attestations of the character exist prior to the mid-Warring States period. The variants recently discovered in the Guōdiàn and Shàngbó corpuses and elsewhere are shown to be predominantly based on phonetic principles which can be explained in a systematic fashion using current models of reconstruction. Proceedingfrom Baxter's arguments for rén as a cognate of Written Tibetan snying and extending (...) it to Tibeto-Burman congeners, a final section speculates about a chain shift, which propelled rén from its Sino-Tibetan meanings to an ethical notion harnessed by earlyConfucianism. This shift left a lexical gap which was quickly filled by xīn 心 and ài 愛. (shrink)

Weiming’s program of overcoming the enlightenment mentality and throws a critical light on his conceptions of religious or spiritual Confucianism, of a Confucian modernity, and of the multiple modernities theory in general. It defends a unitary rather than multiple concept of modernity in terms of the realization of a morally controlled principle of free subjectivity and tries to show how Confucianism, understood as a secular ethics, could contribute to this goal.

Globalization generates new structures of human interdependence and vulnerability while also posing challenges for models of democracy rooted in territorially bounded states. The diverse phenomena of globalization have stimulated two relatively new branches of political theory: theoretical accounts of the possibilities of democracy beyond the state; and comparative political theory, which aims at bringing non-Western political thought into conversation with the Western traditions that remain dominant in the political theory academy. This article links these two theoretical responses to globalization by (...) showing how comparative political theory can contribute to the emergence of new global “publics” around the common fates that globalization forges across borders. Building on the pragmatist foundations of deliberative democratic theory, it makes a democratic case for comparative political theory as an architecture of translation that helps deliberative publics grow across boundaries of culture.
