Two arguments apparently support the thesis that collective identity presupposes an Other: the recognition argument, according to which seeing myself as a self requires recognition by an other whom I also recognize as a self (Hegel); and the dialogic argument, according to which my sense of self can only develop dialogically (Taylor). But applying these arguments to collective identity involves a compositional fallacy. Two modern ideologies mask the particularist thesis’s falsehood. The ideology of indivisible state sovereignty makes sovereignty as such (...) appear particularistic by fusing “internal” with “external” sovereignty; nationalism imagines national identity as particularistic by linking it to sovereignty. But the concatenation of internal sovereignty, external sovereignty, and nation is contingent. Schmitt’s thesis that “the political” presupposes an other conflates internal and external sovereignty, while Mouffe’s neo-Schmittianism conflates difference (Derrida) with alterity. A shared global identity may face many obstacles, but metaphysical impossibility and conceptual confusion are not among them. (shrink)

In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, (...) noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. How can liberal democracy best be realized in a world fraught with conflicting new forms of identity politics and intensifying conflicts over culture? This book brings unparalleled clarity to the contemporary debate over this question. Maintaining that cultures are themselves torn by conflicts about their own boundaries, Seyla Benhabib challenges the assumption shared by many theorists and activists that cultures are clearly defined wholes. She argues that much debate--including that of "strong" multiculturalism, which sees cultures as distinct pieces of a (...) mosaic--is dominated by this faulty belief, one with grave consequences for how we think injustices among groups should be redressed and human diversity achieved. Benhabib masterfully presents an alternative approach, developing an understanding of cultures as continually creating, re-creating, and renegotiating the imagined boundaries between "us" and "them." Drawing on contemporary cultural politics from Western Europe, Canada, and the United States, Benhabib develops a double-track model of deliberative democracy that permits maximum cultural contestation within the official public sphere as well as in and through social movements and the institutions of civil society. Agreeing with political liberals that constitutional and legal universalism should be preserved at the level of polity, she nonetheless contends that such a model is necessary to resolve multicultural conflicts. Analyzing in detail the transformation of citizenship practices in European Union countries, Benhabib concludes that flexible citizenship, certain kinds of legal pluralism and models of institutional powersharing are quite compatible with deliberative democracy, as long as they are in accord with egalitarian reciprocity, voluntary self-ascription, and freedom of exit and association. The Claims of Culture offers invaluable insight to all those, whether students or scholars, lawyers or policymakers, who strive to bridge the gap between the theory and practice of cultural politics in the twenty-first century. Das gilt im Moralischen ebenso wie im Politischen. Gleichheit ist die Grundidee der modernen Moralphilosophie und der modernen Verfassungsstaaten. Die moderne Begründung und Durchsetzung der Gleichheitsidee begleitet jedoch wie ein Schatten eine andere Einstellung: eine Haltung der 'Befragung' der Gleichheit. Diese andere Einstellung betrachtet die Gleichheitsidee (...) von außen, in ihren Folgen für das Leben der Individuen; sie betrachtet die Gleichheit in ihren Brechungen und Spiegelungen in deren Leben. Das ist die Methode der Befragung der Gleichheit: Sie ist eine 'Reflexion' der Gleichheit im Verhältnis zur Individualität. Die Idee der Gleichheit kann für die Individuen Einschränkungen, gar Verzerrungen und Verletzungen bedeuten; was für alle gerecht ist, ist nicht für jeden gut. Das ist der Inhalt der Befragung der Gleichheit: Sie ist eine 'Kritik' der Gleichheit am Maßstab der Individualität. Christoph Menke geht es in seinem Buch um dieses Unternehmen einer Befragung der Gleichheit. Dazu bezieht er sich auf wichtige Stationen ihrer Geschichte: die romantische Revolutionskritik (Burke, Schiller), Nietzsches Genealogie der Moral, Schmitts Theorie der Souveränität, Adornos negative Dialektik der Gleichheit. Many of Habermas's critical commentators agree that Discourse Ethics fails as a theory of the validity of moral norms and only succeeds as a theory of the democratic legitimacy of socio-political norms. The reason they give is that the moral principle is too restrictive to count as a necessary condition of the validity of norms. Other commentators more sympathetic to his project want to abandon principle and remodel Discourse Ethics without it. Still others want to downplay the role of universalizing (...) moral discourse and to make more of Habermas's less demanding, though still somewhat vague, conception of ethical discourse. Against this chorus of critical voices Habermas maintains that his conception of moral discourse and the moral principle are central to Discourse Ethics in general, and to the normative heart of his political theory in particular. The conflict may have arisen in part because the concept of a ‘universalizable interest’ which is central to Habermas's understanding of moral discourse and of the moral principle remains opaque even after nearly two decades of critical debate. Actually Habermas's concept of interest is pretty obscure too. But the obscurity surrounding the concept of interest is not the source of the confusion. For our present purposes we can simply stipulate that an interest is a reason to want. The notion of reason rests loosely on the notion of a need, and the concepts of need and desire are take left deliberately vague. The source of the current confusion lies in the notion of universalizability that is in play. Once we pay due attention to the conditions of the universalizability of interests contained in Habermas's formulation of the moral principle, we can distinguish between a weaker and a stronger version of the principle. I argue that only the weaker version is defensible. But I also want to show that Habermas is tempted into defending the stronger version, and to explain why he does so. (shrink)

There are two principal philosophical conceptions of socialism, corresponding to two interpretations of the notion of a rational society. The first conception corresponds to an instrumental view of social rationality. Captured by the image of socialism as “one big workshop,” the instrumental view holds that social ownership of the means of production is rational because it promotes the optimal development of the productive forces. Social ownership is optimal because it eliminates the costs of coordination imposed by the conduct of economic (...) activities in formally independent enterprises, and, more generally, overcomes fetters on development that result from the control of resources by individuals whose particular interests imperfectly correspond to a general interest in productive advance. In this book Joseph Heath brings Jürgen Habermas's theory of communicative action into dialogue with the most sophisticated articulation of the instrumental conception of practical rationality-modern rational choice theory. Heath begins with an overview of Habermas's action theory and his critique of decision and game theory. He then offers an alternative to Habermas's use of speech act theory to explain social order and outlines a multidimensional theory of rational action that includes norm-governed action as a specific type.In the second part (...) of the book Heath discusses the more philosophical dimension of Habermas's conception of practical rationality. He criticizes Habermas's attempt to introduce a universalization principle governing moral discourse, as well as his criteria for distinguishing between moral and ethical problems. THIS PAPER DEALS WITH HANS-GEORG GADAMER’S THEORY of the manner in which cognition depends on the cultural and historical context in which it occurs. In section 2 the historical background of this theory is briefly described. In section 3 Gadamer’s claim that context-dependence involves unreflected presuppositions is discussed; throughout the paper, different senses of this claim are distinguished. Section 4 examines his corresponding claim that these presuppositions are of a general kind in such a way that the manifold of seemingly (...) opposed views which rely on them is overrated by individuals sharing a cultural milieu.
