Expression and Meaning is a direct successor, concerned to develop and refine the account presented in Searle's earlier work, and to extend its application to other modes of discourse such as metaphor, fiction, reference, and indirect speech arts. Searle also presents a rational taxonomy of types of speech acts and explores the relation between the meanings of sentences and the contexts of their utterance. The (...) book points forward to a larger theme implicit in these problems - the basis certain features of speech have in the intentionality of mind, and even more generally, the relation of the philosophy of language to the philosophy of mind. This volume gives a theoretical account of the problem of analyzing and evaluating argumentative discourse. After placing argumentation in a communicative perspective, and then discussing the fallacies that occur when certain rules of communication are violated, the authors offer an alternative to both the linguistically-inspired descriptive and logically-inspired normative approaches to argumentation. The authors characterize argumentation as a complex speech act in a critical discussion aimed at resolving a difference of opinion. The various stages of a critical discussion are outlined, (...) and the communicative and interactional aspects of the speech acts performed in resolving a simple or complex dispute are discussed. After dealing with crucial aspects of analysis and linking the evaluation of argumentative discourse to the analysis, the authors identify the fallacies that can occur at various stages of discussion. This article reacts against the undesirable ideological separation between dialectical and rhetorical approaches to argumentative discourse. It argues that a sound evaluation of argumentation requires an analysis that reveals all aspects of the discourse pertinent to critical testing. To explain the rationale of the various moves made in the discourse and the strategic patterns behind them, not only the interlocutors' dialectical goals must be taken into account, but also their rhetorical goals. This paper investigates the role that the stylistic device of praeteritio (or paralipsis) can play in arguers’ attempts to reconcile their rhetorical with their dialectical aims by manoeuvring strategically when carrying out particular discussion moves of the dialectical procedure for resolving a dispute. First, attention will be paid to the ways in which praeteritio can be realized in discourse. Next, an analysis is given of the effects the use of praeteritio may have as a result of the presentational means that (...) are employed. This analysis will be used to establish the possibilities for strategic manoeuvring with this device in the different stages of an argumentative discussion. Finally, an indication is given of how the types of strategic manoeuvring that a praeteritio can be instrumental in may derail, and in which violations of the rules for critical discussion such derailed manoeuvrings may result. The paper reacts against the strict separation between dialectical and rhetorical approaches to argumentation and argues that argumentative discourse can be analyzed and evaluated more adequately if the two are systematically combined. Such an integrated approach makes it possible to show how the opportunities available in each of the dialectical stages of a critical discussion have been used strategically to further the rhetorical aims of the speaker or writer. Arguments from plausibility, in which an appeal is made to customary behavior, are often used in the legal practice. For example: Joran van derSloot must have murdered Natalee Holloway, otherwise he would have called an ambulance when she looked dead. As in the example, such arguments are often presented with an explicit appeal to an inference license that gives the argument amodus tollensstructure [if he had not murdered her...]. I will address the question what motivates such a presentation.

Persuasive definitions – those that convey an attitude in the act of naming – are frequently employed in discourse and are a form of strategic maneuvering. The dynamics of persuasive definition are explored through brief case studies and an extended analysis of the use of the “war” metaphor in responding to terrorism after September 11, 2001. Examining persuasive definitions enables us to notice similarities and differences between strategic maneuvering in dialectical and in rhetorical argument, as well as differences between the (...) role of strategic maneuvering in normatively ideal argument and in actually existing argument. This will avoid the double standard of comparing ideal dialectic with actual rhetoric, or vice versa. The results of the analysis suggest possibilities for a rapprochement between dialectical and rhetorical approaches to argumentation. (shrink)

In this paper I investigate the role of the rhetorical trope metonymy in arguers’ attempts to reconcile their rhetorical with their dialectical aims in the confrontation stage and argumentation stage of a discussion. I show how different types of metonymies may help to present a party’s position advantageously and to make the strongest case.
