A new pragmatic approach, based on the latest developments in argumentation theory, analyzing appeal to expert opinion as a form of argument. Reliance on authority has always been a common recourse in argumentation, perhaps never more so than today in our highly technological society when knowledge has become so specialized—as manifested, for instance, in the frequent appearance of "expert witnesses" in courtrooms. When is an appeal to the opinion of an expert a reasonable type of argument to make, and when (...) does it become a fallacy? This book provides a method for the evaluation of these appeals in everyday argumentation. Specialized domains of knowledge such as science, medicine, law, and government policy have gradually taken over as the basis on which many of our rational decisions are made daily. Consequently, appeal to expert opinion in these areas has become a powerful type of argument. Challenging an argument based on expert scientific opinion, for example, has become as difficult as it once was to question religious authority. Walton stresses that even in cases where expert opinion is divided, the effect of it can still be so powerful that it overwhelms an individual's ability to make a decision based on personal deliberation of what is right or wrong in a given situation. The book identifies the requirements that make an appeal to expert opinion a reasonable or unreasonable argument. Walton's new pragmatic approach analyzes that appeal as a distinctive form of argument, with an accompanying set of appropriate critical questions matching the form. Throughout the book, a historical survey of the key developments in the evolution of the argument from authority, dating from the time of the ancients, is given, and new light is shed on current problems of "junk science" and battles between experts in legal argumentation. Appeals to emotion—pity, fear, popular sentiment, and _ad hominem_ attacks—are commonly used in argumentation. Instead of dismissing these appeals as fallacious wherever they occur, as many do, Walton urges that each use be judged on its merits. He distinguished three main categories of evaluation. First, is it reasonable, even if not conclusive, as an argument? Second, is it weak and therefore open to critical questioning for argument? And third, is it fallacious? The third category is a strong charge that incurs (...) a critical burden to back it up by citing evidence from the given text and context of dialogue. Walton uses fifty-six case studies to demonstrate that the problem of emotional fallacies is much subtler than has been previously believed. Ranging over commercial advertisements, political debates, union-management negotiations, and ethical disputes, the case studies reveal that these four types of appeals, while based on presumptive reasoning that are tentative and subject to default, are not always or necessarily fallacious types of argumentation. The basic question of this monograph is: how should we go about judging arguments to be reasonable or unreasonable? Our concern will be with argument in a broad sense, with realistic arguments in natural language. The basic object will be to engage in a normative study of determining what factors, standards, or procedures should be adopted or appealed to in evaluating an argument as "good," "not-so-good," "open to criticism," "fallacious," and so forth. In many contexts a retraction of commitment isfrowned upon. For instance, it is not appreciated,generally, if one withdraws a promise or denies anearlier statement. Critical discussion, too, caneasily be disrupted by retractions, if these occur toofrequently and at critical points. But on the otherhand, the very goal of critical discussion –resolution of a dispute – involves a retraction,either of doubt, or of some expressed point of view.A person who never retracts, not even under pressureof cogent arguments, would hardly qualify as (...) areasonable discussant. Also, inconsistencies in one'sposition, once they have been pointed out, must bedealt with by some kind of retraction. The problem ofretraction is to find a suitable model of dialoguethat allows retractions where they seem reasonable, oreven required, and rules them out (or puts sanctionsupon them) whenever they would become disruptive of awell-organized process of dialogue.The present paper tries to point to a solution basedon the following principles: (1) Retraction rulesdetermine what retractions are permissible, and (2) ifpermissible what the consequences of retraction are.(3) Retraction rules vary according to the type ofdialogue and (4) according to the type of commitmentretracted. For instance, assertions and mereconcessions need to be distinguished, as well aslight-side and dark-side commitments. Section 1 contains a survey of options in constructing a formal system of dialogue rules. The distinction between material and formal systems is discussed (section 1.1). It is stressed that the material systems are, in several senses, formal as well. In section 1.2 variants as to language form (choices of logical constants and logical rules) are pointed out. Section 1.3 is concerned with options as to initial positions and the permissibility of attacks on elementary statements. The problem of ending a (...) dialogue, and of infinite dialogues, is treated in section 1.4. Other options, e.g., as to the number of attacks allowed with respect to each statement, are listed in section 1.5. Section 1.6 explains the concept of a chain of arguments.From section 2 onward four types of dialectic systems are picked out for closer study: D, E, Di and Ei. After a preliminary section on dialogue sequents and winning strategies, the equivalence of derivability in intuitionistic logic and the existence of a winning strategy (for the Proponent) on the strength of Ei is shown by simple inductive proofs. A slippery slope argument is an argument to this twofold effect. First, that if a policy or practice P is permitted, then we lack the dialectical resources to demonstrate that a similar policy or practice P* is not permissible. Since P* is indeed not permissible, we should not endorse policy or practice P. At the heart of such arguments is the idea of dialectical impotence, the inability to stop the acceptance of apparently small deviations from a heretofore secure policy or (...) practice from leading to apparently large and unacceptable deviations. Using examples of analogical arguments and sorites arguments I examine this phenomenon in the context of collapsing taboos. (shrink)

In this paper, I try to develop an informal model for the analysis and evaluation of argumentative strategies based on active authorities. The explanations necessary to understand the idea of the model and what is modelled are given through the development of the paper. I first give an example of argumentative activities. After that, the main assumption of the model is given. In the third part, the relevant aspects of the argumentative activity are analysed, while the principles of the evaluation (...) are explained in the fourth part. The informal model is presented in the fifth part. In the final remarks, the suggestions for further work are given, as well as a comparison with some related recent works in argumentation theory. Ethical discourse and fallacy theory come together in a natural way over concepts such as bias, prejudice, preconceived opinion, prototypical and stereotypical thinking, dogmatism and loyalty. By and large, these are concepts that have not been sufficiently worked up to bear the theoretical weight either of ethics or of logic. The present paper seeks to ameliorate this situation. It proposes that situations describable by any such concepts partition into (a) the rationally and morally regrettable and (b) the rationally and morally (...) impeccable, and in any event, unavoidable.
