Dagger argues for a republican liberalism that, while celebrating the liberal heritage of autonomy and rights, solidly places these within social relations and obligations, which while ubiquitous, are often obscured and forgotten.

This chapter explores the relationship between republican democracy and justice by comparing Philip Pettit's notion of neo-republicanism with that of Immanuel Kant. It begins by describing a republican, political conception of justice as nondomination and explaining why the discourse of republicanism and that of theories of justice often remain at odds with one another. It then considers the basis of a republican conception of justice as nondomination and locates it within the principle of justification, along with Pettit's idea of autonomy (...) and respect. It also examines the notions of ‘arbitrariness’ and ‘domination’ as well as Pettit's ‘negative republicanism’ and its emphasis on legally and politically secure freedom of choice. This book continues and revises the ideas of justice as fairness that John Rawls presented in _A Theory of Justice_ but changes its philosophical interpretation in a fundamental way. That previous work assumed what Rawls calls a "well-ordered society," one that is stable and relatively homogenous in its basic moral beliefs and in which there is broad agreement about what constitutes the good life. Yet in modern democratic society a plurality of incompatible and irreconcilable doctrines--religious, philosophical, and moral--coexist within the (...) framework of democratic institutions. The Machiavellian Moment is a classic study of the consequences for modern historical and social consciousness of the ideal of the classical republic revived by Machiavelli and other thinkers of Renaissance Italy. J.G.A. Pocock suggests that Machiavelli's prime emphasis was on the moment in which the republic confronts the problem of its own instability in time, and which he calls the "Machiavellian moment." The first comprehensive analysis of the philosophical issues raised by the hijab controversy in France, this book also conducts a dialogue between contemporary Anglo-American and French political theory and defends a progressive republican solution to so-called multicultural conflicts in contemporary societies. It critically assesses the official republican philosophy of laïcité which purported to justify the 2004 ban on religious signs in schools. Laïcité is shown to encompass a comprehensive theory of republican citizenship, centered on three ideals: equality (secular neutrality of (...) the public sphere), liberty (individual autonomy and emancipation) and fraternity (civic loyalty to the community of citizens). Challenging official interpretations of laïcité, the book then puts forward a critical republicanism which does not support the hijab ban, yet upholds a revised interpretation of three central republican commitments: secularism, non-domination and civic solidarity. Thus, it articulates a version of secularism which squarely addresses the problem of status quo bias - the fact that Western societies are historically not neutral towards all religions. It also defends a vision of female emancipation which rejects the coercive paternalism inherent in the regulation of religious dress, yet does not leave individuals unaided in the face of religious and secular, patriarchal and ethnocentric domination. Finally, the book outlines a theory of immigrant integration which places the burden of civic integration on basic socio-political institutions, rather than on citizens themselves. Critical republicanism proposes an entirely new approach to the management of religious and cultural pluralism, centred on the pursuit of the progressive ideal of non-domination in existing, non-ideal societies. Examining the ways in which philosophers from Plato onwards have used the concept of power, this work develops a field theory of power that rejects many of the reigning assumptions made about power. Incorporating the insights of feminist theorists, it argues that power has a positive as well as a negative role to play in social relations.

Imagine you are walking through a park. Suddenly, a mugger points a gun at you, threatening to shoot you if you do not hand over your valuables. Is this an instance of domination? Many authors working within the neo-republican framework - including Philip Pettit himself - are inclined to say 'yes'. After all, the mugger case seems to be a paradigmatic example of what it means to be at someone's mercy. However, I argue that this conclusion is based on a (...) misleading, interactional account of domination that misconceives its structural character. Domination, I maintain, is a structurally constituted form of power. Whether the mugger in the park dominates you or not can only be established by analysing the wider power structures in which your interaction is embedded. (shrink)

This article undertakes a republican analysis of power in the workplace and labour market in order to determine whether workers are dominated by employers. Civic republicans usually take domination to be subjection to an arbitrary power to interfere with choice. But when faced with labour disputes over what choices it is normal for workers to make for themselves, these accounts of domination struggle to determine whether employers possess the power to interfere. I propose an alternative capabilitarian conception of domination as (...) the arbitrary power to determine access to capabilities necessary for relationships of equality between citizens. This approach allows us to diagnose domination in the workplace and the labour market but does not capture unfreedom arising from the wider socio-structural position of workers. Thus, I supplement this capabilitarian account of the domination of workers with a structural account of dominating power, which reveals a richer set of conditions under which employers dominate workers. In a democracy, citizens should have some control over how they are governed. If they do not participate directly in making policy, they ought to maintain control over the public officials who design policy on their behalf. Rule by Multiple Majorities develops a novel theory of popular control: an account of what it is, why democracy's promise of popular control is compatible with what we know about actual democracies, and why it matters. While social choice theory suggests there is no (...) such thing as a 'popular will' in societies with at least minimal diversity of opinion, the author argues that multiple, overlapping majorities can nonetheless have control, at the same time. After resolving this conceptual puzzle, the author explains why popular control is a realistic and compelling ideal for democracies, notwithstanding voters' low levels of information and other shortcomings. In contrast with a widely held interpretation of Rousseau's philosophy, Professor Viroli argues that natural and political order are by no means the same for Rousseau. He explores the (...) differences and interrelations between the different types of order which Rousseau describes, and shows how the philosopher constructed his final doctrine of the just society, which can be based only on every citizen's voluntary and knowing acceptance of the social contract and on the promotion of virtue above ambition. At the core of republican thought, on Philip Pettit’s account, lies the conception of freedom as non-domination, as opposed to freedom as noninterference in the liberal sense. I revisit the distinction between liberal and republican freedom and argue that republican freedom incorporates a particular rule-of-law requirement, whereas liberal freedom does not. Liberals may also endorse such a requirement, but not as part of their conception of freedom itself. I offer a formal analysis of this rule-of-law requirement and compare liberal and (...) republican freedom on its basis. While I agree with Pettit that republican freedom has broader implications than liberal freedom, I conclude that we face a trade-off between two dimensions of freedom (scope and robustness) and that it is harder for republicans to solve that trade-off than it is for liberals. The need for ecological sustainability has been translated into different indicators such as the ‘ecological footprint’ and the ‘planetary boundaries’. Analysis of both concepts concludes that the planet is currently undergoing a period of ecological unsustainability. For this reason, ecologists argue that various limits are required in order to move to a path of sustainability. The implementation of such limits has mostly been analysed from the perspectives of environmental rights and environmental justice, however research in terms of freedom is (surprisingly) (...) still lacking. In what way do such limits have an impact on freedom? I will argue that there are two different ways to analyse the relation between freedom and ecological limits: on the one hand, freedom is often referred to as being in competition with ecological sustainability and the limits it is required to impose, and, on the other hand, the impact on an individual’s freedom due to ecological catastrophe if strict limits are not implemented. Accepting that freedom is an important topic regarding ecological challenges, I ask which conception of freedom is better suited to answer this challenge as well as the required implementation of ecological limits. I compare and confront the closely linked conceptions of freedom as non-frustration and the closely linked conception of non-limitation, as well as non-interference and the conception of freedom as non-domination. After presenting these conceptions I examine their relationship with ecological limits. The conclusion is that the conception of freedom as non-domination is better placed to justify ecological limits necessary to promote an ecologically sustainable future. (shrink)

Scholars loosely affiliated with the “Cambridge School” accentuate rule of law, common good, class equilibrium, and non-domination in Machiavelli's political thought and republicanism generally but underestimate the Florentine's preference for class conflict and ignore his insistence on elite accountability. The author argues that they obscure the extent to which Machiavelli is an anti-elitist critic of the republican tradition, which they fail to disclose was predominantly oligarchic. The prescriptive lessons these scholars draw from republicanism for contemporary politics reinforce rather than reform (...) the “senatorial,” electorally based, and socioeconomically agnostic republican model that permits common citizens to acclaim but not determine government policies. Cambridge School textual interpretations and practical proposals have little connection with Machiavelli's “tribunate,” class-specific model of popular government elaborated in The Discourses, one that relies on extra-electoral accountability techniques and embraces deliberative popular assemblies. Sometimes dictators are benevolent. Sometimes masters are kind and gentle to their slaves. John Adams was a pretty good "husband" to Abigail Adams. But it seems like there’s something very wrong with being a dictator or a master or a spouse with the power that John Adams had over Abigail Adams in late 18th Century America. A theory of domination tries to pinpoint what’s distinctive about dictatorship and mastery and traditional husbanding, and what is distinctively wrong with such—even the benevolent, (...) kind, gentle, and pretty good varieties. -/- There has been a lot of thinking about domination over the last twenty-five or so years. This is due largely to the efforts of republican political philosophers, who have used domination and its absence — nondomination — as the primary moving part in their conceptions of freedom. Even so, perhaps because domination has often appeared in a supporting role for the analysis of other concepts, conceptualizing domination itself is still a fairly nascent endeavor. -/- Accounts of domination need at least two movements. First, domination is a subset of a social phenomenon with—at least more or less—unobjectionable varieties. Maybe this social phenomenon is power; maybe it’s the capacity to interfere with choice; maybe something else. Whatever it is, it’s plausible to think it’s not always bad. Sometimes it’s perfectly alright to have power over someone else; sometimes there’s nothing wrong with the capacity to interfere with someone’s choices. (For example, if what you’d rather do is go after your neighbor with a meat-axe, it’s a good thing if someone is in a position to interfere with you, or if your choice situation can be worsened, so that charging next door, axe in hand, without having to worry about a lengthy prison sentence is not among your options.) The first task of a theory of domination is to specify exactly what this broader social phenomenon is. -/- Next we need to figure out what gives domination its negative moral valence, and thus sets it apart from that broader social phenomenon. Republicans usually say that what makes domination morally problematic is its arbitrariness. Frank Lovett claims that domination is instantiated in a social relationship between A and B only if A is permitted to exercise power over B arbitrarily (2010, 120). Philip Pettit, until recently, claimed that domination is a capacity for arbitrary interference. Marilyn Friedman calls it “arbitrary interference in someone’s choices…”(2008, 265). If that’s right, and arbitrariness is the difference maker between forms of social power that aren’t domination and those that are, we need a story about what arbitrariness is. -/- Such are the two essential tasks of conceptualizing domination. I offer here what I think are important course-corrections for recent attempts to complete them. In §1 I set out some desiderata for a useful conception of domination before sketching the elements of earlier attempts I think we can’t do without. §2 addresses the problem of “cheap domination”. This is the problem of identifying ordinary, innocuous human interactions with anything we call domination. I don’t think we should do this, but some of the most influential accounts of domination on offer nowadays — in particular, Lovett’s and Pettit’s — have this result. Instead, I contend that only certain forms of social power can underwrite domination, and try to provide a principled way of identifying what these forms are like. This study builds on the work of contemporary civic republicans, supplying a detailed analysis of the concept of domination absent in the familiar accounts of political freedom as non-domination.

In response to the dominance of liberalism, some theorists have recently embraced the republican model as an attractive alternative. The overriding appeal of these moves seems to be the robust emphasis that forms of republicanism place on citizenship and civic virtue in light of what many commentators see as a decline in the social nature of modern politics. However, many of these discussions about republicanism are inconsistent and fail to capture the essence of a classical republican theory for today's complex (...) modern world. The result is that the ideals and values of classical republicanism have become diluted and misappropriated as they are utilized by both philosophers and politicians without a clear and consistent sense of their historical pedigree and their relevance to the contemporary world. Republicanism in the Modern World develops and extends the theoretical implications of a distinctive republican conception of liberty as non-domination. Building on the recent work of Quentin Skinner and Philip Pettit, Maynor explores the complex interdependent relationship between liberty as non-domination and conflict, citizenship, and civic virtue to develop a modern theory of republicanism. Maynor argues that modern republicanism, inspired and informed by classical versions, can be the basis for a renewed effort to rejuvenate the political ideals and institutions of the modern democratic nation-state. The market is traditionally hailed as the very exemplar of a system under which people enjoy freedom, in particular the negative sort of freedom associated with liberal and libertarian thought: freedom as noninterference. But how does the market appear from the perspective of a rival conception of freedom (freedom as non-domination) that is linked with the Roman and neo-Roman tradition of republicanism? The republican conception of freedom argues for important normative constraints on property, exchange, and regulation, without supporting extremes to (...) the effect that ‘property is theft’ or ‘taxation is theft’ or anything of that kind. The republican revival in political philosophy, political theory, and legal theory has produced an impressive range of novel interpretations of the historical figures of the republican tradition. It has also given rise to a variety of contemporary neo-republican theories that build on its historical themes. Although there have been some feminist discussions of its historical representatives, neo-republicanism has not generated a great deal of enthusiasm among feminists. The present paper examines Phillip Pettit's theory of freedom as nondomination in order to (...) assess its potential usefulness for those with feminist goals. It defends Pettit's account of interpersonal domination from certain feminist objections, but argues that his account of state domination needs to be amended if it is fully to protect the interests of women and other groups. It is clear that a revival of republicanism is under way, but it is not clear that the republican tradition truly speaks to contemporary concerns. In particular, it is not clear that republicanism has anything of value to say about economic matters in the early 21st century. I respond to this worry by delineating the main features of a neo-republican civic economy that is, I argue, reasonably coherent and attractive. Such an economy will preserve the market, while constraining it to (...) serve public purposes, and promote what John Rawls calls a ‘property-owning democracy’. To accomplish these ends, a civic economy is likely to concern itself with the character of work and the workplace, to take steps to preserve and protect the sense of community or publicity, to levy an inheritance tax and a progressive consumption tax, and to provide some kind of ‘social’ or ‘civic’ minimum of support to all citizens. The rule of law is a valuable human achievement. It is valuable not only instrumentally, but also for its own sake as a significant aspect of social justice. Only in a society that enjoys the rule of law is it possible for people to regard one another as fellow free citizens; no one the master of anyone else. Nevertheless, the rule of law is poorly understood. In this book, Frank Lovett develops a rigorous conception of the rule of law that (...) is grounded in legal positivism, and offers a civic republican argument for its value in terms of freedom from domination. Assuming that states will remain a permanent feature of our world, what is the ideal that we should hold out for the international order? An attractive proposal is that those peoples that are already organized under non-dominating, representative states should pursue a twin goal: first, arrange things so that they each enjoy the republican ideal of freedom as non-domination in relation to one another and to other multi-national and international agencies; and second, do everything possible and productive to facilitate the (...) representation of less fortunate peoples in non-dominating states and to incorporate them in a non-dominating international order. This republican ideal stands midway between a utopian ideal of cosmopolitan justice and a sceptical ideal of non-intervention. The republican tradition seems to have a blind spot about global justice. It has had little to say about pressing international issues such as world poverty or global inequalities. According to the old, if apocryphal, adage: extra rempublicam nulla justitia. Some may doubt that distributive justice is the primary virtue of republican institutions; and at any rate most would agree that republican values have traditionally been realized in the polis not in the cosmopolis. The article sketches a republican account of (...) global non-domination which suggests that duties of distributive justice are not bounded to the institutions of a single society. In particular, it argues that republicans have good reasons to seek to curb those global inequalities which underpin what I call capability-denying domination. (shrink)
