This paper uses argument diagrams, argumentation schemes, and some tools from formal argumentation systems developed in artificial intelligence to build a graph-theoretic model of relevance shown to be applicable as a practical method for helping a third party judge issues of relevance or irrelevance of an argument in real examples. Examples used to illustrate how the method works are drawn from disputes about relevance in natural language discourse, including a criminal trial and a parliamentary debate.

This is a formal and systematic study of the logical foundations of speech act theory. The study of speech acts has been a flourishing branch of the philosophy of language and linguistics over the last two decades, and John Searle has of course himself made some of the most notable contributions to that study in the sequence of books Speech Acts, Expression and Meaning and Intentionality. In collaboration with Daniel Vanderveken he now presents the first formalised logic of a general (...) theory of speech acts, dealing with such things as the nature of an illocutionary force, the logical form of its components, and the conditions of success of elementary illocutionary acts. Presumption is a remarkably versatile and pervasively useful resource. Firmly grounded in the law of evidence from its origins in classical antiquity, it made its way in the days of medieval scholasticism into the theory and practice of disputation and debate. Subsequently, it extended its reach to play an increasingly significant role in the philosophical theory of knowledge. It has thus come to represent a region where lawyers, debaters, and philosophers can all find some common around. In Presumption and the (...) Practices of Tentative Cognition, Nicholas Rescher endeavors to show that the process of presumption plays a role of virtually indispensable utility in matters of rational inquiry and communication. The origins of presumption may lie in law, but its importance is reinforced by its service to the theory of information management and philosophy. (shrink)

Intercultural Pragmatics studies how language systems are used in social encounters between speakers who have different first languages and cultures, yet communicate in a common language. The field first emerged in the early 21st century, joining two seemingly antagonistic approaches to pragmatics research: the cognitive-philosophical approach, which considers intention as an a priori mental state of the speaker, and the sociocultural-interactional approach, which considers it as a post factum construct created by both speaker and hearer though conversation. Istvan Kecskes, an (...) early proponent of intercultural pragmatics, was among the first to propose merging the two to form the socio-cognitive approach now core to the field. In Intercultural Pragmatics, the first book on the subject, Kecskes establishes the foundations of the field, boldly combining the pragmatic view of cooperation with the cognitive view of egocentrism in order to incorporate emerging features of communication. He argues that people cooperate by generating and formulating intention that is relevant to the given actual situational context. At the same time, however, because of their egocentrism they activate the most salient information to their attention in the construction and comprehension of utterances. Within this approach, interlocutors are considered as social beings searching for meaning with individual minds embedded in a socio-cultural collectivity, and intention is a cooperation-directed practice that is governed by relevance which depends on actual situational experience.Intercultural pragmatics is a rapidly-growing field, and the only subfield of pragmatics to incorporate features of intercultural interaction into mainstream pragmatics. The problem of establishing the best interpretation of a speech act is of fundamental importance in argumentation and communication in general. A party in a dialogue can interpret another’s or his own speech acts in the most convenient ways to achieve his dialogical goals. In defamation law this phenomenon becomes particularly important, as the dialogical effects of a communicative move may result in legal consequences. The purpose of this paper is to combine the instruments provided by argumentation theory with the (...) advances in pragmatics in order to propose an argumentative approach to meaning reconstruction. This theoretical proposal will be applied to and tested against defamation cases at common law. Interpretation is represented as based on a hierarchy of interpretative presumptions. On this view, the development of the logical form of an utterance is regarded as the result of an abductive pattern of reasoning in which various types of presumptions are confronted and the weakest ones are excluded. Conflicts of interpretations and equivocation become essentially interwoven with the dialectical problem of fulfilling the burden of defeating a presumption. The interpreter has a burden of explaining why a given presumption is subject to default, assuming that the speaker is reasonable and acting based on a set of shared expectations. (shrink)

Using tools like argument diagrams and profiles of dialogue, this paper studies a number of examples of everyday conversational argumentation where determination of relevance and irrelevance can be assisted by means of adopting a new dialectical approach. According to the new dialectical theory, dialogue types are normative frameworks with specific goals and rules that can be applied to conversational argumentation. In this paper is shown how such dialectical models of reasonable argumentation can be applied to a determination of whether an (...) argument in a specific case is relevant are not in these examples. The approach is based on a linguistic account of dialogue and text from congruity theory, and on the notion of a dialectical shift. Such a shift occurs where an argument starts out as fitting into one type of dialogue, but then it only continues to makes sense as a coherent argument if it is taken to be a part of a different type of dialogue. Metaphorical meaning can be analyzed as triggered by an apparent communicative breach, an incongruity that leads to a default of the presumptive interpretation of a vehicle. This breach can be solved through contextual renegotiations of meaning guided by the communicative intention, or rather the presumed purpose of the metaphorical utterance. This paper addresses the problem of analyzing the complex process of reasoning underlying the reconstruction of metaphorical meaning. This process will be described as a type of abductive argument, aimed at (...) explaining how the vehicle can best contribute to the purpose of the utterance. This type of reasoning involves the analysis of the possible predicates that can be and usually are attributed to the vehicle, and the selection of the one that can support the implicit conclusion constituting the communicative goal of the metaphorical utterance. Metaphorical meaning, in this perspective, becomes the outcome of a complex process of meaning reconstruction aimed at providing the best explanation of the function of the vehicle within a discourse move. The notions of types of dialogue and dialectical relevance are central themes in Walton’s work and the grounds for a dialectical approach to many fallacies. After outlining the dialogue models constituting the background of Walton’s account, this article presents the concepts of dialectical relevance and dialogue shifts in their application to biased argumentation, fallacious moves, and illicit argumentative strategies. Showing the different dialectical proposals Walton advanced in several studies on argumentation as a development of a dialogical system, it has proved (...) possible to highlight the fundamental aspects of his theory in a comprehensive model of communication and interaction. The distinction between constitutive and regulative rules is applied to rules for critical discussion that have to do with the use of ambiguous expressions. This leads to a distinction between rule violating fallacies, by which one abandons a critical discussion, and norm violating fallacies, which are in a way admissible within a critical discussion. According to the formal model for critical discussion, proposed in this paper, fallacies of the norm violating type arc not prohibited. The implicit dimension of enthymemes is investigated from a pragmatic perspective to show why a premise can be left unexpressed, and how it can be used strategically. The relationship between the implicit act of taking for granted and the pattern of presumptive reasoning is shown to be the cornerstone of kairos and the fallacy of straw man. By taking a proposition for granted, the speaker shifts the burden of proving its un-acceptability onto the hearer. The resemblance of the tacit premise (...) with what is commonly acceptable or has been actually stated can be used as a rhetorical strategy. (shrink)

When we use a word, we face a crucial epistemic gap: we ground our move on the fact that our interlocutor knows the meaning of the word we used, and therefore he can interpret our dialogical intention. However, how is it possible to know the other’s mind? Hamblin explained this dialogical problem advancing the idea of dialectical meaning: on his view, the use of a word is based on a set of presumptions. Building on this approach, the use of a (...) word in a dialogue can be analyzed in terms of presumptive reasoning, while the manipulative strategies based on slanted or loaded terms or redefinitions can be conceived as forms of conflicts of presumptions. A presumptive approach to meaning can also ground different dialectical strategies to solve misunderstanding or definitional disagreements, or tactics to undermine the interlocutor’s arguments by advancing charges of equivocation. Natural dialogue does not proceed haphazardly; it has an easily recognized “episodic” structure and coherence which conform to a well developed set of conventions. This paper represents these conventions formally in terms related to speech act theory and to a theory of action.The major formal unit, the dialogue game, specifies aspects of the communication of both participants in a dialogue. We define the formal notion of dialogue games, and describe some of the important games of English. Dialogue games are conventions (...) of interactive goal pursuit. Using them, each participant pursues his own goals in a way which sometimes serves the goals of the other. The idea of dialogue games can thus be seen as a part of a broader theoretical perspective which characterizes virtually all communication as goal pursuit activity.We also define and exemplify the property of Motivational Coherence of dialogues. Motivational Coherence can be used as an interpretive principle in explaining language comprehension.Actual dialogue games have a kind of causal connectedness which is not a consequence of their formal properties. This is explained in terms of a theory of action, which is also seen to explain a similar attribute of speech acts. (shrink)

Our book Relevance (Sperber and Wilson 1986) treats utterance interpretation as a two-phase process: a modular decoding phase is seen as providing input to a central inferential phase in which a linguistically encoded logical form is contextually enriched and used to construct a hypothesis about the speaker's informative intention. Relevance was mainly concerned with the inferential phase of comprehension: we had to answer Fodor's challenge that while decoding processes are quite well understood, inferential processes are not only not understood, but (...) perhaps not even understandable (see Fodor 1983). Here we will look more closely at the decoding phase and consider what types of information may be linguistically encoded, and how the borderline between decoding and inference can be drawn. It might be that all linguistically encoded information is cut to a single pattern: all truth conditions, say, or all instructions for use. However, there is a robust intuition that two basic types of meaning can be found. This intuition surfaces in a variety of distinctions: between describing and indicating, stating and showing, saying and conventionally implicating, or between truth-conditional and non-truth-conditional, conceptual and procedural, or representational and computational meaning. In the literature, justifications for these distinctions have been developed in both strictly linguistic and more broadly cognitive terms. The linguistic justification goes as follows (see for example Recanati 1987). Utterances express propositions; propositions have truth conditions; but the meaning of an utterance is not exhausted by its truth conditions, i.e. the truth conditions of the proposition expressed. Professor Recanati's book is a major new contribution to the philosophy of language. Its point of departure is a refutation of two views central to the work of speech-act theorists such as Austin & Searle: that speech acts are essentially conventional, & that the force of an utterance can be made fully explicit at the level of sentence-meaning & is in principle a matter of linguistic decoding. The author argues that no utterance can be fully understood simply in terms of (...) its linguistic meaning, but that only a contextual inference can provide an adequate framework. A standard view of the semantics of natural language sentences or utterances is that a sentence has a particular logical structure and is assigned truth-conditional content on the basis of that structure. Such a semantics is assumed to be able to capture the logical properties of sentences, including necessary truth, contradiction and valid inference; our knowledge of these properties is taken to be part of our semantic competence as native speakers of the language. In his paper “What is a Context of Utterance?”, Christopher Gauker argues that the phenomenon of informative presuppositions is incompatible with the “pragmatic” view of presuppositions as involving requirements on the common ground, the body of shared assumptions of the participants in a conversation. This is a surprising claim since most proponents of this view have in fact dealt with informative presuppositions by appealing to a process called presupposition accommodation. Gauker’s attack shows the need to clarify the nature of this (...) process. (shrink)

On a familiar and prima facie plausible view of metaphor, speakers who speak metaphorically say one thing in order to mean another. A variety of theorists have recently challenged this view; they offer criteria for distinguishing what is said from what is merely meant, and argue that these support classifying metaphor within 'what is said'. I consider four such criteria, and argue that when properly understood, they support the traditional classification instead. I conclude by sketching how we might extract a (...) workable notion of 'what is said' from ordinary intuitions about saying. (shrink)

It has long ben recognised that there are referential uses of definite descriptions. It is not as widely recognised that there are atttributives uses of idexicals and other such paradigmatically singular terms. I offer an account of the referential/attributive distinction which is intended to give a unified treatment of both sorts of cases. I argue that the best way to account for the referential/attributive distinction is to treat is as semantically underdetermined which sort of propositions is expressed in a context. (...) In certain contexts the proposition expressed will be a descriptive one, and in others it will be an object-dependent one. I appeal to Sperer and Wilson's (1986) idea that the recovery of the content of an utterance involves pragmatic processes of enrichment of a representation of the logical form of utterance. According to the account I offer, the first-level descriptive meaning associated with an expression (whether this is an indexical or a definite description) is pragmatically enriched and then used either to track an individual in the context, or is taken to lay down a condition of satisfaction for an individual. The proposition that the listener takes the speaker to have expressed is recovered on the basis of considerations of relevance and contextually available information about the speaker's directive intentions. Although my account has affinities with those of Recanati (1993) and Nunberg (1993), it also differs from theirs in crucial ways. Each of these authors sees asymmetries where I see none. The purpose of this paper is to show whether the two crucial dimensions used for assessing the quality of argumentation, argument-as-a-product (argument structure) and argument-as-a-process (relevance), are interrelated, and how they can be used to assess the effect of argumentative mode on students’ arguments. To this purpose, a twofold coding scheme will be developed, aimed at capturing: a) the argumentative function of evidence use and b) the dialogical relevance of evidence use. A study will be described in which students’ use (...) of evidence is elicited in two distinct argumentative modes (dialogical vs. non-dialogical). According to the results, in the dialogical mode students tended to use evidence in a more sophisticated way from both argument evaluation perspectives. (shrink)

The recent debate on pragmatics and the law has found ways to circumvent an important distinction, originally drawn by Dascal and Wróblewski (1991), between the historical law-maker, the current law-maker, and the ideal/rational law-maker.1 By insisting on the relationship between the rational law-maker and contextualism and textualism (see Manning 2005, 2006), I want to redress this fault in current discussions. In this paper, I start with general considerations on pragmatics, intentionality in ordinary conversation, and intentionality in the context of judiciary (...) proceedings and legal texts. I then move on to considerations on rationality as a prerequisite for understanding the law and on the rational law-maker, an ideal construct proposed by Dascal and Wróblewski (1991). I argue that contextualism (of the moderate kind) is the best way to carry out the program by Dascal and Wróblewski on interpretation and the rational law-maker (also see considerations by Fish 2005); (on contextualism see Dascal and Weizman 1987). I argue that bearing in mind the rational law-maker postulated by Dascal and Wróblewski is a guidance to interpretation of statutes whose texts create interpretative difficulties. I conclude by saying that the considerations on the rational law-maker constitute a compromise between Scalia’s (1997) textualism and contextualism (see Manning 2005, 2006 on the divide between textualism and contextualism). _Thoughts and Utterances_ is the first sustained investigation of two distinctions which are fundamental to all theories of utterance understanding: the semantics/pragmatics distinction and the distinction between what is explicitly communicated and what is implicitly communicated.

We are happy to present to the reader the first book of our Applied Logic Series. Walton's book on the fallacies of ambiguity is firmly at the heart of practical reasoning, an important part of applied logic. There is an increasing interest in artifIcial intelligence, philosophy, psychol ogy, software engineering and linguistics, in the analysis and possible mechanisation of human practical reasoning. Continuing the ancient quest that began with Aristotle, computer scientists, logicians, philosophers and linguists are vigorously seeking to deepen (...) our understanding of human reasoning and argumentation. Significant communities of researchers are actively engaged in developing new approaches to logic and argumentation, which are better suited to the urgent needs of today's applications. The author of this book has, over many years, made significant contributions to the detailed analysis of practical reasoning case studies, thus providing solid foundations for new and more applicable formal logical systems. Explicatures are not cancellable. Theoretical considerations.

This article analyses the fallacy of wrenching from context, using the dialectical notions of commitment and implicature as tools. The data, a set of key examples, is used to sharpen the conceptual borderlines around the related fallacies of straw man, accent, misquotation, and neglect of qualifications. According to the analysis, the main characteristics of wrenching from context are the manipulation of the meaning of the other’s statement through devices such as the use of misquotations, selective quotations, and quoting out of (...) context. The theoretical tools employed in the analysis are pragmatic theories of meaning and a dialectical model of commitment, used to explain how and why a standpoint is distorted. The analysis is based on a conception of fallacies as deceptive strategic moves in a game of dialogue. As a consequence, our focus is not only on misquotations as distortions of meaning, but on how they are used as dialectical tools to attack an opponent or win a dispute. Wrenching from context is described as a fallacy of unfairly attributing a commitment to another party that he never held. Its power as a deceptive argumentation tactic is based on complex mechanisms of implicit commitments and on their misemployment to improperly suggest an attribution of commitment. (shrink)

Within the philosophy of language, pragmatics has tended to be seen as an adjunct to, and a means of solving problems in, semantics. A cognitive-scientific conception of pragmatics as a mental processing system responsible for interpreting ostensive communicative stimuli (specifically, verbal utterances) has effected a transformation in the pragmatic issues pursued and the kinds of explanation offered. Taking this latter perspective, I compare two distinct proposals on the kinds of processes, and the architecture of the system(s), responsible for the recovery (...) of speaker meaning (both explicitly and implicitly communicated meaning). This paper presents a formal account of how to determine the discourse relations between propositions introduced in a text, and the relations between the events they describe. The distinct natural interpretations of texts with similar syntax are explained in terms of defeasible rules. These characterise the effects of causal knowledge and knowledge of language use on interpretation. Patterns of defeasible entailment that are supported by the logic in which the theory is expressed are shown to underly temporal interpretation.

The interpretation and the indirect reporting of a speaker’s communicative intentions lie at the crossroad between pragmatics, argumentation theory, and forensic linguistics. Since the leading case Masson v. New Yorker Magazine, Inc., in the United States the legal problem of determining the truth of a quotation is essentially equated with the correctness of its indirect reporting, i.e. the representation of the speaker’s intentions. For this reason, indirect reports are treated as interpretations of what the speaker intends to communicate. Theoretical considerations, (...) aimed at establishing the pragmatic meaning of an utterance and differentiating between presumptive and non-presumptive interpretation, are thus interwoven with the practical legal need of distinguishing a correct indirect report from an indirect one or a misquotation. An incorrect report or a misquotation has the dialectical effect of attributing to the misquoted party commitments that he never held, which the latter needs to rebut. This shifting of the burden of persuasion can be increased by using strategically the conflict between the presumptive interpretation of an utterance and the non-presumptive one, i.e. the different types of pragmatic ambiguity. When an interpreter is confronted with an utterance taken out of its dialogical context, his interpretative process is not guided by the actual context or intention, but rather the most frequent or prototypical dialogical setting or the most typical individual purpose that it could have served to achieve. This presumptive reconstruction can be used to provide a prima facie case that the other party needs to reject. The stronger the interpretative presumptions a speaker needs to rebut, the more effective the misquotation strategy. The conflict between the systematic and the presumptive process of interpretation can be represented as an argumentative mechanism of reconstruction of the individual intention, which allows one to assess the reasonableness of the interpretative reasoning. This volume gives a theoretical account of the problem of analyzing and evaluating argumentative discourse. After placing argumentation in a communicative perspective, and then discussing the fallacies that occur when certain rules of communication are violated, the authors offer an alternative to both the linguistically-inspired descriptive and logically-inspired normative approaches to argumentation. The authors characterize argumentation as a complex speech act in a critical discussion aimed at resolving a difference of opinion. The various stages of a critical discussion are outlined, (...) and the communicative and interactional aspects of the speech acts performed in resolving a simple or complex dispute are discussed. After dealing with crucial aspects of analysis and linking the evaluation of argumentative discourse to the analysis, the authors identify the fallacies that can occur at various stages of discussion. Their general aim is to elucidate their own pragma- dialectical perspective on the analysis and evaluation of argumentative discourse, bringing together pragmatic insight concerning speech acts and dialectical insight concerning critical discussion. Our studies of naturally occurring human dialogue have led to the recognition of a class of regularities which characterize impoltant aspects of communication. People appear to interact according to established patterns which span several turns in a dialogue and which recur frequently. These patterns appear to be organized around the goals which the dialogue serves for each participant. Many things which are said later in a dialogue can only be interpreted as pursuit of these goals, established by earlier dialogue.These patterns (...) have been represented b) a set of knowledge structures called Dialogue‐Games, capturing shared, conventional knowledge that people have about communication and how it can be used to achieve goals. A Dialogue‐Game has Parameters, which represent those elements that vary across instances of a particular pattern‐the particular dialogue participants and the content topic. The states of the world which must be in effect for a particular Dialogue‐Game to be employed successfully are represented by Specifications of these Parameters. Finally, the expected sequence of intermediate states that occur during instances of a particular conventional pattern are represented by the Components of the corresponding Dialogue‐Game.Representations for several Dialogue‐Games are presented here, based on our analyses of different kinds of naturally occurring dialogue. A process model is discussed, showing Dialogue‐Game identification, pursuit, and termination as part of the comprehension of dialogue utterances. This Dialogue‐Game model captures some of the important functional aspects of language, especially indirect uses to achieve implicit communication. (shrink)

We consider the logical form of a natural language sentence to be a formal object which determines both the logical properties of the sentence and, more generally, the ways the sentence is logically related to other sentences. Thus if some NL sentence logically entails another, this fact must follow, given the logical forms of the two sentences. The power of a theory of logical forms of natural language then lies first in what logical properties and relations it can define, and (...) second, in which NL sentences it can show to be logically related to which others. This book identifies 25 argumentation schemes for presumptive reasoning and matches a set of critical questions to each.

Philosophers and logicians use the term “indexical” for words such as “I”, “you” and “tomorrow”. Demonstratives such as “this” and “that” and demonstratives phrases such as “this man” and “that computer” are usually reckoned as a subcategory of indexicals. (Following [Kaplan, 1989a].) The “context-dependence” of indexicals is often taken as a defining feature: what an indexical designates shifts from context to context. But there are many kinds of shiftiness, with corresponding conceptions of context. Until we clarify what we mean by (...) “context”, this defining feature remains unclear. In sections 1–3, which are largely drawn from [Perry, forthcoming(a)], I try to clarify the sense in which indexicals are context-dependent and make some distinctions among the ways indexicals depend on context. In sections 3–6, I contrast indexicality with another phenomenon that I call “unarticulated constituents.”. (shrink)

I am often asked to explain the difference between my notion of impliciture (Bach 1994) and the relevance theorists’ notion of explicature (Sperber and Wilson 1986; Carston 2002). Despite the differences between the theoretical frameworks within which they operate, the two notions seem very similar. Relevance theorists describe explicatures as “developments of logical forms,” whereas I think of implicitures as “expansions” or “completions” of semantic contents (depending on whether or not the sentence’s semantic content amounts to a proposition). That is (...) not much of a difference. We agree that implicitures/explicatures go beyond what is said (in a strict sense) and yet fall short of being implicatures. So, what is the difference, or is it just terminological? As we will see, the real differences emerge when the two notions are situated in their respective theoretical frameworks with their contrasting conceptions of what is involved in linguistic communication. ('Can you pass the salt?' 'Yes.') Unsurprisingly, it was quickly picked up and put to a wide variety of uses in not only in philosophy but also in linguistics and psychology. What is surprising, however, is that upon close inspection Grice's conception of implicature turns out to be very different from those at work in the literature which has grown out of his original discussion. This would not be much of a criticism of this literature were it not for the fact that discussions of implicature explicitly claim to be using Grice's notion, not some other one inspired by him (generally going so far as to quote one of Grice's characterisations of implicature). This still would not be terribly interesting if the notion Grice was actually carving out had little theoretical or practical utility. But I will argue here that Grice's own notion of implicature, one quite different from the ones most of us have come to work with, is in fact far more interesting and subtle than that which has been attributed to him. According to truth-conditional semantics, to explain the meaning of a statement is to specify the conditions necessary and sufficient for its truth. This book develops a more radical mentalist semantics by shifting the object of semantic inquiry. Classical semantics analyzes an abstract sentence or utterance such as "Grass is green"; in attitudinal semantics the object of inquiry is a propositional attitude such as "Speaker so-and-so thinks grass is green".
